दिल्ली, 11 फरवरी, 2025 का.आ. 734(अ).—जनम्नजलजखत प्रारूप अजधसूचना, जिसे केन्द्रीर् सरकार पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खडं (v) और खडं (xiv) तथा उपधारा (3) के साथ परित उपधारा (1) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए िारी करने का प्रस्ट्ताव करती है, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के अधीन अपेजक्षत रूप से, उसस े प्रभाजवत होन े वाली िनता की िानकारी के जलए प्रकाजित दकर्ा िाता है; और इसके द्वारा र्ह सूचना िी िाती ह ै दक उि प्रारूप अजधसचू ना उस तारीख से साि दिन की अवजध की समाजि पर र्ा उसके पश्चात जवचार म ेंली िाएगी, जिसको इस अजधसूचना वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी िाती हैं; मसौिा अजधसूचना में जनजहत प्रस्ट्तावों पर कोई आपजत्त र्ा सुझाव िेने में रुजच रखने वाला कोई भी व्यजि, जनधााररत अवजध के भीतर केन्द्रीर् सरकार के जवचाराथा उसे जलजखत रूप म ें सजचव, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्, इंदिरा पर्ाावरण भवन, िोरबाग रोड, अलीगंि, नई दिल्ली-110003 को भेि सकता ह ैअथवा मंत्रालर् के ई-मले पते esz-mef@nic.in पर भिे सकता ह।ै प्रारूप अजधसचू ना िबदक, रूपी भाभा वन्द्र्िीव अभर्ारण्र् 503 वग ा दकलोमीटर के क्षेत्र म ें फैला हुआ ह ै और जहमाचल प्रिेि के दकन्नौर जिल े के जनचार उप-जवभाग म ें जस्ट्थत ह।ै र्ह ऊपरी सतलुि घाटी म ें 31º 35′ और 31º 45′ उत्तरी अक्षांिों और 77º 49′ और 78º 07′ पूवी ििे ांतरों के बीच फैला हुआ ह।ै दकन्नौर जिले का मुख्र्ालर् रेकॉन्द्ग जपर्ो (कल्पा) अभर्ारण्र् के पूवी जहस्ट्से में लगभग 40 दकलोमीटर की िरू ी पर जस्ट्थत ह।ै 1084 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और िबदक, रूपी भाभा वन्द्र्िीव अभर्ारण्र् पजश्चम और उत्तर में धौलाधार पवातमाला के श्रीखंड पवातों और िजक्षण म ें सतलुि निी के बीच जस्ट्थत ह।ै इस अभर्ारण्र् को जहमाचल प्रििे सरकार द्वारा अजधसूचना संख्र्ा एफएफई- बीएफ(6)II/2005-11 दिनांक 07.06.2013 के तहत वन्द्र्िीव अभर्ारण्र् का ििाा दिर्ा गर्ा था। और िबदक, रूपी-भाबा वन्द्र्िीव अभर्ारण्र् को मध्र् जहमालर् म ें जस्ट्थत होने का जविेषाजधकार प्राि ह ैऔर र्ह िोन 2 बी (पजश्चमी जहमालर्) िीवन संबंधी क्षेत्र की पुजि करता ह।ै रूपी-भाबा वन्द्र्िीव अभर्ारण्र् ग्रेट जहमालर्न नेिनल पाका और जपन वलै ी निे नल पाका के साथ जमलकर सरं जक्षत क्षेत्र नेटवका का एक सतत और कॉम्पैक्ट ब्लॉक बनाता ह ै और इसे पजश्चमी जहमालर्ी बार्ोस्ट्फीर्र ररिवा म ेंगरित दकर्ा िाना उपर्ुि ह।ै और िबदक, अभर्ारण्र् अपन े जविाल अल्पाइन चरागाहों और घास के मैिानों के जलए िाना िाता ह।ै सामान्द्र् धारणा घने िेविार, केल और चौडी पत्ती वाले िगं लों (2000 मीटर और उससे अजधक) की ह,ै उच्चतर स्ट्तर (2800 मीटर और उससे अजधक) पर बांस के साथ िेविार-स्ट्प्रूस संर्ोिन हावी ह।ै अल्पाइन क्षेत्र 3500 मीटर की ऊँचाई से िुरू होता ह।ै और िबदक, रूपी भाभा वन्द्र्िीव अभर्ारण्र् प्रकृजत प्रेजमर्ों को मध्र् जहमालर् के सबसे सुंिर मनोरम िश्ृ र्ों म ें से एक प्रिान करता ह ैऔर इसमें साहजसक साधकों के आनंि के जलए रैककंग मागों, पवात चोरटर्ों और ऊंच े िरों की बडी संख्र्ा ह।ै अभर्ारण्र् के भीतर पंरह से अजधक चोरटर्ां ह ैं िो 5000 मीटर से अजधक ऊंचाई पर ह।ैं सबसे ऊंची चोटी (5914 मीटर) पूवी सीमा पर जचदकम धार पर ह।ै पांडोश्वर चोटी (5806 मीटर) िसू री सबसे ऊंची चोटी ह ै और दकन्नौर जिले का एक बहुत ही महत्वपूणा भौगोजलक स्ट्थल ह।ै उत्तरी सीमा पर तीन ऊंचे पवातीर् िरे हैं, जिनके नाम िकरौग खांगो (5100 मीटर), जनजमष खांगो (4890 मीटर) और तारी खागं ो (4865 मीटर) ह,ैं िो सभी रूपी-भाभा वन्द्र्िीव अभर्ारण्र् को लाहौल और स्ट्पीजत जिल ेके स्ट्पीजत उप-मंडल के जपन वैली राष्ट्रीर् उद्यान से िोडत े ह।ैं और िबदक, रूपी-भाबा वन्द्र्िीव अभर्ारण्र् का अल्पाइन क्षत्रे औषधीर् िडी-बूरटर्ों में प्रचुर मात्रा म ें ह,ै और स्ट्थानीर् समुिार् इन पौधों को इकट्ठा करके और बेचकर अपनी आर् में वृजि करते ह।ैं प्रचुर मात्रा में एकत्र की गई सबसे महत्वपूणा िडी-बूरटर्ाँ ह ैं कारू (जपक्रोररजा कुरूआ), पारटि (एकोजनटम हटेरोफाइलम) बनफ्सा (जवर्ोला कैनेसेंस), कुथ (सौररर्ा लप्पा) मुिाकबाला (वेलेररर्ाना वाजलची), ररवाडा चीनी (रर्ूम इमोडी), बैंकाक्री (पोडोदफलम इमोडी) आदि। आर्ुवेदिक िवाओं के जलए इस अभर्ारण्र् के अल्पाइन चरागाहों में पाई िाने वाली सभी िडी-बूरटर्ाँ महान आर्थाक मूल्र् और महत्व की ह।ैं और िबदक, अभर्ारण्र् म ें प्रमुख पाई िाने वाली प्रमुख पिु प्रिाजतर्ाँ ह ैं कस्ट्तूरी मृग (मोस्ट्चस मोजस्ट्चफेरस), गोरल (नेमोरहडेस गोरल), भरल (स्ट्र्ूडोइस नार्र), सीरो ( कैपररसोजनस सुमात्रेजन्द्सस), जहमालर्न थार (हजेमत्रगस िेम्लाजहकस), जहमालर्न नेवला (मुस्ट्टेला जसररजबका)), जहम तेंिआु (अनजसर्ा अनजसर्ा), सामान्द्र् तेंिआु (पेंथरेा पाडास)), तेंिआु जबल्ली (फेजलस बगेंालजेंसस), लाल लोमडी (वुल्प्स वल्प्स), छोटी कश्मीर उडने वाली जगलहरी (हाइलोपेटेस दफजम्िएटस), एजिर्ाई काला भालू (उरस के िजृ िकोण स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें क्षेत्र, जवस्ट्तार और सीमा को संरजक्षत और सुरजक्षत रखना आवश्र्क ह ैऔर उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगा और उनके संचालन और प्रदक्रर्ाओं को प्रजतबंजधत करना आवश्र्क ह;ै अतः अब , पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उपधारा (2) के खंड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित, केन्द्रीर् सरकार जहमाचल प्रििे राज्र् के दकन्नौर जिले में रूपी भाबा वन्द्र्िीव अभर्ारण्र् की सीमा से 0 दकलोमीटर से 3.45 दकलोमीटर तक के क्षेत्र को रूपी भाबा पाररजस्ट्थजतकी सवं िे ी िोन (जिसे इसके पश्चात ् पाररजस्ट्थजतकी संवेिी िोन कहा िाएगा) के रूप म ेंअजधसूजचत करती ह,ै जिसके ब्र्ौरे जनम्नानसु ार हैं, अथाता :-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाएं- (1) पाररजस्ट्थजतकी संवेिी िोन रूपी भाबा वन्द्र्िीव अभर्ारण्र् की सीमा के आसपास 0 दकलोमीटर से 3.45 दकलोमीटर तक फैला हुआ ह ैऔर पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल लगभग 85.53 वग ादकलोमीटर ह।ै रटप्पणी: रूपी-भाबा वन्द्र्िीव अभर्ारण्र् तीन तरफ़ से पूव ा में जलप्पा-असरंग वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन (ईएसिेड)के साथ अपनी सीमाएँ साझा करता ह।ै उत्तर की ओर, र्ह जपन वलै ी नेिनल पाका के पाररजस्ट्थजतकी संवेिी िोन के साथ-साथ पाका की सीमा पर भी ह।ै उत्तर-पजश्चमी तरफ़, अभर्ारण्र् ग्रेट जहमालर्न नेिनल पाका स े सटा हुआ ह।ै इसजलए, रूपी-भाभा वन्द्र्िीव अभर्ारण्र् के इन तीनों तरफ़ कोई पाररजस्ट्थजतकी संवेिी िोन नहीं ह।ै (2) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण अनलु ग्नक-I के रूप म ेंसलं ग्न ह ै । (3) रूपी भाबा वन्द्र्िीव अभर्ारण्र् के आसपास के पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र अनलु ग्नक- IIक, अनलु ग्नक II ख के रूप म ेंसलं ग्न ह।ैं अनलु ग्नक ग और अनलु ग्नक II घ के रूप में सलं ग्र ह।ै (4) रूपी भाभा वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा पर भू-जनिेिांक अनलु ग्नक -III म ें सलं ग्न ह।ैं (5) पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल ेगांवों की सूची अनलु ग्नक-IV म ेंसलं ग्न ह ै (6) क्षेत्र म ेंमौिूि वनस्ट्पजतर्ों और िीवों की जवस्ट्तृत सूची अनलु ग्नक-V पर ह ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.- (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए, स्ट्थानीर् ज‍ र्ि र्ों के परामिा से और इस अजधसूचना म ें दिए गए अनुबंधों का पालन करते हुए, रािपत्र में इस अजधसचू ना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिन के जलए एक आचं जलक महार्ोिना तैर्ार करेगी। (2) पाररजस्ट्थजतकी संवेिी िोन के जलए क्षेत्रीर् महार्ोिना राज्र् सरकार द्वारा इस अजधसूचना म ें जवजनर्िाि केंर एवं राज्र् सरकार के संगत कानूनों के अनरूु प केन्द्रीर् एव ं राज्र् कानूनों तथा केन्द्रीर् सरकार द्वारा िारी दििा- जनिेिों, र्दि कोई हों, के अनुरूप तैर्ार की िाएगी। (3) आंचजलक महार्ोिना राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार दकर्ा िाएगा, तादक उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् पहलुओं को एकीकृत दकर्ा िा सके:- i. पर्ाावरण; ii. वन एवं वन्द्र्िीव; iii. कृजष; iv. आर्; v. िहरी जवकास; vi. पर्ाटन; vii. ग्रामीण जवकास; viii. पसंचाई और बाढ़ जनर्ंत्रण; ix. पंचार्ती राि; x. नगर पाजलका; xi. जहमाचल प्रिेि राज्र् प्रिषू ण जनर्ंत्रण बोडा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) आंचजलक महार्ोिना अनमु ोदित मौिूिा भूजम उपर्ोग, बुजनर्ािी ढांचे और गजतजवजधर्ों पर कोई प्रजतबंध नहीं लगाएगा, िब तक दक इस अजधसूचना में ऐसा जनर्िाि न दकर्ा गर्ा हो और आंचजलक महार्ोिना में सभी बुजनर्ािी ढांचे और गजतजवजधर्ों को और अजधक कुिल और पर्ाावरण अनुकूल बनाने के जलए सुधार को िाजमल दकर्ा िाएगा। (5) आंचजलक महार्ोिना म ें िल-जवहीन क्षेत्रों के पनु रुिार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िलग्रहण प्रबंधन, भूिल प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार् की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलओंु , जिन पर ध्र्ान िने े की आवश्र्कता ह,ै के जलए प्रावधान दकर्ा िाएगा। (6) आंचजलक महार्ोिना म ें सभी मौिूिा पूिा स्ट्थलों, गांवों और िहरी बजस्ट्तर्ों, वनों के प्रकार और दकस्ट्मों, कृजष क्षेत्रों, हररत क्षेत्र िैसे पाका, बागवानी क्षेत्र, बाग-बगीचे, झीलों और अन्द्र् िल जनकार्ों को मौििू ा और प्रस्ट्ताजवत भूजम उपर्ोग जविेषताओं का ब्र्ौरा िेन े वाल ेमानजचत्रों के साथ जचजननत दकर्ा िाएगा। (7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगा और पैराग्राफ 4 में ताजलका में सूचीबि जनजषि और जवजनर्जमत गजतजवजधर्ों का पालन करेगा और स्ट्थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत और बढ़ावा िगे ा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना के साथ समाि होगा। (9) इस तरह अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपबंधों के अनुसार जनगरानी से संबंजधत सजमजत के जलए उसके कार्ों के कार्ाान्द्वर्न हते ु संिभा िस्ट्तावेि होगा। (10) आंचजलक महार्ोिना की तैर्ारी और अनुमोिन तक, कोई भी नई जवकासात्मक गजतजवजधर्ां पैराग्राफ 6 के उप-पैरा (1) और (2) में जनर्ििा प्रावधानों द्वारा िाजसत होंगी। 3. राज्र् सरकार द्वारा उिाए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- 1. भजू म उपर्ोग.- (क) पाररजस्ट्थजतकी संवेिी िोन म ें मनोरंिन प्रर्ोिनों के जलए जचजन्द्हत वन, बागवानी क्षेत्र, कृजष क्षत्रे , पाका और खलु े स्ट्थान का उपर्ोग वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक गजतजवजधर्ों के जलए नहीं दकर्ा िाएगा र्ा उन्द्ह ेंक्षेत्रों में पररवर्तात नहीं दकर्ा िाएगा: बिते दक ऊपर भाग (क) म ें जवजनर्िाि प्रर्ोिनों के अलावा अन्द्र् प्रर्ोिनों के जलए पाररजस्ट्थजतकी संवेिी िोन के भीतर कृजष और अन्द्र् भूजम के पररवतान की अनुमजत जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और केंर सरकार र्ा राज्र् सरकार के अन्द्र् जनर्मों और जवजनर्मों के तहत सक्षम प्राजधकारी के पूव ा अनुमोिन से, िैसा भी लाग ू हो और इस अजधसूचना के प्रावधानों के अनुसार, स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने और जनम्नजलजखत गजतजवजधर्ों के जलए िी िा सकेगी- i. मौिूिा सडकों का चौडीकरण एवं सुिढ़ृ ीकरण तथा नई सडकों का जनमााण; ii. बुजनर्ािी ढांचे और नागररक सजु वधाओं का जनमााण और नवीनीकरण; iii. प्रिषू ण न फैलान े वाले लघ ु उद्योग; iv. कुटीर उद्योग जिनमें ग्रामोद्योग भी िाजमल ह;ै सुजवधािनक स्ट्टोर और होम स्ट्टे सजहत पाररजस्ट्थजतकी पर्ाटन को समथना िने े वाली स्ट्थानीर् सुजवधाएं; तथा v. अनुच्छेि 4 म ेंिी गई गजतजवजधर्ों को बढ़ावा दिर्ा गर्ा: र्ह भी प्रावधान ह ै दक िनिातीर् भूजम का उपर्ोग वाजणजज्र्क और औद्योजगक जवकास गजतजवजधर्ों के जलए क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और राज्र् सरकार के अन्द्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 र्ा अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ें लाग ू कानून के प्रावधानों के अनपु ालन के जबना नहीं दकर्ा िाएगा:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 र्ह भी प्रावधान ह ै दक पाररजस्ट्थजतक संवेिी िोन के भीतर भूजम अजभलेखों में पाई िाने वाली दकसी त्रुरट को राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार जनगरानी सजमजत के जवचार प्राि करने के पश्चात िीक दकर्ा िाएगा और उि त्रुरट के सुधार की सूचना पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् में केन्द्रीर् सरकार को िी िाएगी: र्ह भी प्रावधान ह ै दक त्रुरट सुधार म ें इस उप-पैराग्राफ के अतं गात दिए गए प्रावधान को छोडकर अब दकसी भी मामले म ेंभूजम उपर्ोग म ेंपररवतान िाजमल नहीं होगा; वनरोपण और आवास पुनस्ट्थापा न गजतजवजधर्ों के माध्र्म स े अप्रर्िु र्ा अनुत्पािक कृजष क्षेत्रों में पुनः वनरोपण करन े के प्रर्ास दकए िाएंगे। 2. प्राकृजतक िल जनकार्.- सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरुिार के जलए र्ोिनाएं आचं जलक महार्ोिना में िाजमल की िाएंगी और राज्र् सरकार द्वारा दििाजनिेि इस प्रकार तैर्ार दकए िाएगं े दक इन क्षेत्रों म ें र्ा इनके जनकट ऐसी जवकास गजतजवजधर्ों पर रोक लगाई िा सके िो इन क्षेत्रों के जलए हाजनकारक ह।ैं 3. पर्टा न र्ा पाररजस्ट्थजतकी पर्टा न.- (क) पाररजस्ट्थजतकी संविे ी िोन के भीतर सभी नई पाररजस्ट्थजतकी पर्ाटन गजतजवजधर्ां र्ा मौिूिा पर्ाटन गजतजवजधर्ों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन के जलए पर्ाटन मास्ट्टर प्लान के अनुसार होगा; 1. पर्ाटन मास्ट्टर प्लान राज्र् के पर्ाटन जवभाग द्वारा राज्र् के पर्ाावरण एव ं वन जवभागों के परामिा स े तैर्ार दकर्ा िाएगा; 2. पर्ाटन मास्ट्टर प्लान, आंचजलक महार्ोिना का एक घटक होगा; 3. पर्ाटन मास्ट्टर प्लान पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तर्ै ार दकर्ा िाएगा; ड. पाररजस्ट्थजतकी पर्ाटन की गजतजवजधर्ों को जनम्नानुसार जवजनर्जमत दकर्ा िाएगा, अथाात्:- i. संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकट हो, होटलों और ररसॉर्टसा के नए जनमााण की अनुमजत नहीं िी िाएगी; बिते दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरू ी से आगे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटलों और ररसॉर्टसा की स्ट्थापना की अनुमजत केवल पर्ाटन मास्ट्टर प्लान के अनुसार पाररजस्ट्थजतक पर्ाटन सुजवधाओं के जलए पूवा-पररभाजषत और जनर्िाि क्षेत्रों म ेंही िी िाएगी; ii. पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन गजतजवजधर्ां र्ा मौिूिा पर्ाटन गजतजवजधर्ों का जवस्ट्तार, केंरीर् सरकार द्वारा िारी दििाजनिेिों और राष्ट्रीर् बाघ सरं क्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतक पर्ाटन दििाजनिेिों (समर्-समर् पर संिोजधत) के अनुसार होगा, जिसमें पाररजस्ट्थजतक पर्ाटन, पाररजस्ट्थजतक जिक्षा और पाररजस्ट्थजतक जवकास पर िोर दिर्ा िाएगा; iii. िब तक आंचजलक महार्ोिना को मंिरू ी नहीं जमल िाती, पर्ाटन के जलए जवकास और मौिूिा पर्ाटन गजतजवजधर्ों के जवस्ट्तार की अनुमजत संबंजधत जनर्ामक प्राजधकरणों द्वारा वास्ट्तजवक साइट जवजिि िांच और जनगरानी सजमजत की जसफाररि के आधार पर िी िाएगी और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी नए होटल, ररसॉटा र्ा वाजणजज्र्क प्रजतष्ठान के जनमााण की अनुमजत नहीं िी िाएगी। 4. प्राकृजतक जवरासत -पाररजस्ट्थजतकी संवेिनिील िोन में मल्ू र्वान प्राकृजतक जवरासत के सभी स्ट्थलों, िैसे िीन पलू आरजक्षत क्षेत्र, चट्टान संरचनाएं, बहुमल्ू र् चिम,ें झरने, घारटर्ा,ं उपवन, गुफाए,ं स्ट्थान, पैिल माग,ा सैरगाह, चट्टानें आदि की पहचान की िाएगी और आंचजलक महार्ोिना के एक भाग के रूप म ें उनके संरक्षण और संवधना के जलए जवरासत संरक्षण र्ोिना तैर्ार की िाएगी। 5. मानव जनर्मता जवरासत स्ट्थल- पाररजस्ट्थजतकी संवेिी िोन में इमारतें, ढांचा, वास्ट् तुजिल और सांस्ट्कृजतक महत्व की इमारतों, संरचनाओं, कलाकृजतर्ों, क्षेत्रों और पररसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रूप म ेंतैर्ार की िाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 6. ध्वजन प्रिषू ण.- पाररजस्ट्थजतक संवेिी िोन में ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण, ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 और उसके संिोधनों के प्रावधानों के अनुसार दकर्ा िाएगा। 7. वार् ु प्रिषू ण.- पाररजस्ट्थजतक सवं ेिी िोन में वार्ु प्रिषू ण का जनवारण और जनर्ंत्रण वार्ु ( प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 के उपबंधों और इन अजधजनर्मों के अधीन बनाए गए जनर्मों के अनुसार दकर्ा िाएगा। 8. बजहःस्रावों का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में िोजधत बजहःस्रावों का जनस्ट्सरण िल (प्रिषू ण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) तथा पर्ाावरण (संरक्षण) अजधजनर्म, 1986 तथा इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। 9. िोस अपजिि.- िोस अपजिि का जनपटान और प्रबंधन जनम्नानसु ार होगा:- क. पाररजस्ट्थजतकी संवेिी िोन में िोस अपजिि जनपटान और प्रबंधन, िोस अपजिि प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिस े भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् द्वारा अजधसूचना संख्र्ा एसओ 1357 (ई), दिनाकं 8 अप्रैल, 2016 द्वारा प्रकाजित दकर्ा गर्ा ह ैऔर समर्-समर् पर संिोजधत दकर्ा गर्ा ह;ै अकाबाजनक सामग्री को पाररजस्ट्थजतकी संवेिी िोन के बाहर पहचाने गए स्ट्थल पर पर्ाावरण स्ट्वीकार्ा तरीके से जनपटार्ा िा सकता है; (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर पहचानी गई प्रौद्योजगदकर्ों का उपर्ोग करते हुए मौिूिा जनर्मों और जवजनर्मों के अनुरूप िोस अपजििों के सुरजक्षत और पर्ाावरण की िजृ ि से सही प्रबंधन (ईएसएम) की अनुमजत िी िा सकती ह।ै 10. िवै -जचदकत्सा अपजिि.- िैव-जचदकत्सा अपजिि प्रबंधन जनम्नानुसार होगा:- क. पाररजस्ट्थजतकी संवेिी िोन में िैव-जचदकत्सा अपजिि का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित िीएसआर 343 (ई), दिनांक 28 माच,ा 2016 तथा समर्-समर् पर संिोजधत िैव-जचदकत्सा अपजिि प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा ; ख. पाररजस्ट्थजतकी संवेिी िोन के भीतर जचजन्द्हत प्रौद्योजगदकर्ों का उपर्ोग करत े हुए मौिूिा जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजििों के सुरजक्षत और पर्ाावरण की िजृ ि से उजचत प्रबंधन की अनुमजत िी िा सकती ह।ै 11. प्लाजस्ट्टक अपजिि प्रबधं न .- पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिि प्रबंधन, प्लाजस्ट्टक अपजिि प्रबंधन जनर्म, 2016 के प्रावधानों के अनुसार दकर्ा िाएगा, जिसे भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा अजधसूचना संख्र्ा िीएसआर 340 (ई), दिनांक 18 माचा , 2016 द्वारा प्रकाजित दकर्ा गर्ा ह,ै जिसे समर्-समर् पर संिोजधत दकर्ा गर्ा ह ै । 12. जनमाणा और जवध्वसं अपजिि प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण और जवध्वंस अपजिि प्रबंधन, समर्- समर् पर संिोजधत, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना संख्र्ा िीएसआर 317(ई) दिनांक 29 माच,ा 2016 द्वारा प्रकाजित जनमााण और जवध्वंस अपजिि प्रबंधन जनर्म, 2016 के प्रावधानों के अनुसार दकर्ा िाएगा। 13. ई-अपजिि.- पाररजस्ट्थजतकी सवं ेिी िोन में ई-अपजिि प्रबधं न, समर्-समर् पर संिोजधत, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित ई-अपजिि प्रबंधन जनर्म, 2016 के प्रावधानों के अनुसार दकर्ा िाएगा। 14. वाहनों का आवागमन.- वाहनों के आवागमन को पर्ाावरण अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में जवजिि प्रावधान आंचजलक महार्ोिना में िाजमल दकए िाएंगे और िब तक आंचजलक महार्ोिना तैर्ार नहीं हो िाता और राज्र् सरकार म ें सक्षम प्राजधकारी द्वारा अनुमोदित नहीं हो िाता, तब तक जनगरानी सजमजत संबंजधत अजधजनर्मों और उनके तहत बनाए गए जनर्मों और जवजनर्मों के तहत वाहनों के आवागमन के अनुपालन की जनगरानी करेगी। 15. वाहन प्रिषू ण.- वाहन प्रिषू ण की रोकथाम और जनर्ंत्रण लागू कानूनों के अनुपालन में दकर्ा िाएगा और स्ट्वच्छ ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 16. औद्योजगक इकाइर्ा.ँ - (क) इस अजधसूचना के आजधकाररक रािपत्र में प्रकािन के बाि र्ा उसके पश्चात्, पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई भी नर्ा प्रिषू णकारी उद्योग स्ट्थाजपत करने की अनुमजत नहीं िी िाएगी; (ख) केवल गरै -प्रिषू णकारी उद्योगों को ही केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 म ें िारी र्थासंिोजधत दििा-जनिेिों म ें उद्योगों के वगीकरण के अनुसार पाररजस्ट्थजतकी संवेिी िोन के भीतर अनुमजत िी िाएगी, र्ाि इस अजधसूचना में ऐसा जनर्िाि नहीं दकर्ा गर्ा है, और इसके अजतररि, गैर-प्रिषू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। 17. पहाडी ढलानों का सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानसु ार होगा:- क. आंचजलक महार्ोिना म ें पहाडी ढलानों पर जस्ट्थत क्षेत्रों को ििाार्ा िाएगा िहां दकसी जनमााण की अनुमजत नहीं होगी; ख. मौिूिा खडी पहाडी ढलानों र्ा अत्र्जधक कटाव वाली ढलानों पर जनमााण की अनुमजत नहीं िी िाएगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन के अतं गता जनजषि र्ा जवजनर्जमत की िान ेवाली गजतजवजधर्ों की सचू ी. - पाररजस्ट्थजतकी संवेिी िोन में सभी गजतजवजधर्ां पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के प्रावधानों द्वारा िाजसत होंगी, जिनमें पर्ाावरण प्रभाव आकलन अजधसूचना, 2006 (र्ा नवीनतम अजधसूचना) और अन्द्र् लाग ू कानून िाजमल ह,ैं जिनम ें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (सरं क्षण) अजधजनर्म, 1972 (1972 का 53) और उनम ेंदकए गए संिोधन िाजमल ह ैंऔर उन्द्ह ेंनीचे िी गई ताजलका म ेंजनर्िाि तरीके से जवजनर्जमत दकर्ा िाएगा, अथाात:- सचू ी क्र .स. ं दक्रर्ाकलाप रटप्पजणर्ा ँ क .प्रजतजषि गजतजवजधर्ा ँ 1. वाजणजज्र्क खनन, पत्थर उत्खनन और परे ाई क. पाररजस्ट्थजतकी संवेिी िोन के भीतर घरों के जनमााण इकाइर्ाँ। र्ा मरम्मत के जलए जमट्टी की खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ू िरूरतों को पूरा करन े के अलावा सभी नए और मौिूिा खनन (लघु और प्रमुख खजनि), पत्थर उत्खनन और क्रपिंग इकाइर्ों पर तत्काल प्रभाव से प्रजतबंध लगार्ा िाएगा; ख. अगस्ट्त, 2006 के आिेिों के अनुसार दकए िाएगं े, िो टीएन गोिावमान जथरुमुलपाि बनाम र्ूओआई के मामले म ें डब्ल्र्ूपी(सी) संख्र्ा 202/1995 म,ें दिनांक 21 अप्रैल, 2014 के आिेिों के अनुसार, िो गोवा फाउंडेिन बनाम र्ओू आई के मामल े म ें डब्ल्र्पू ी(सी) संख्र्ा 435/2012 म,ें तथा दिनांक 28 अप्रैल, 2023 के आििे ों के अनसु ार दकए िाएंगे, िो टीएन गोिावमान जथरुमलु पाि बनाम र्ूओआई के मामले में तथा डब्ल्र्ूपी(सी) संख्र्ा 202/1995 म ें दिए गए थे। 2. प्रिषू ण उत्पन्न करने वाल े उद्योगों की स्ट्थापना पाररजस्ट्थजतकी संवेिी िोन में प्रिषू णकारी उद्योगों के नए (िल, वार्,ु मृिा, ध्वजन, आदि)। र्ा जवस्ट्तार की अनुमजत नहीं िी िाएगी। 3. प्रमुख िलजवद्युत पररर्ोिना की स्ट्थापना। प्रजतजषि। 4. दकसी भी खतरनाक पिाथ ा का उपर्ोग, उत्पािन पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई भी खतरनाक र्ा प्रसंस्ट्करण। अपजिि उपचार सुजवधा स्ट्थाजपत नहीं की िाएगी पाररजस्ट्थजतकी संवेिी िोन के अिं र उत्पन्न सभी खतरनाक अपजिि को पाररजस्ट्थजतकी संवेिी िोन के बाहर ल े िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बाहर उत्पन्न दकसी भी खतरनाक अपजिि को पाररजस्ट्थजतकी संवेिी िोन के अंिर संभालने, संसाजधत करने र्ा उपचाररत करने की अनुमजत नहीं िी िाएगी। 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र म ें प्रजतजषि। अनुपचाररत अपजििों का जनवहा न। 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों र्ा मौिूिा आरा जमलों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। 7. ईंट भट्टों की स्ट्थापना। प्रजतजषि। 8. पॉजलथीन/प्लाजस्ट्टक बैग का उपर्ोग प्रजतजषि। 9. िलाऊ लकडी का व्यावसाजर्क उपर्ोग। प्रजतजषि। 10. पर्ाटन स े संबंजधत अन्द्र् गजतजवजधर्ां िैस ेप्रजतजषि। पाररजस्ट्थजतकी संवेिी िोन के ऊपर गम ा हवा के गुब्बारे, हले ीकॉप्टर, ड्रोन, माइक्रोलाइर्टस आदि द्वारा उडान भरना। 11 र्ांजत्रक साधनों द्वारा मछली पकडना। प्रजतजषि। ख. जवजनर्जमत गजतजवजधर्ा ँ 12. होटलों और ररसॉटों की व्यावसाजर्क स्ट्थापना। संरजक्षत क्षेत्र की सीमा के एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, दकसी भी नए वाजणजज्र्क होटल और ररसॉटा की अनुमजत नहीं िी िाएगी, जसवार् पाररजस्ट्थजतकी-पर्ाटन गजतजवजधर्ों के जलए छोटे अस्ट्थार्ी ढांचों के: बिते दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर स े आग े र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, सभी नई पर्ाटन गजतजवजधर्ां र्ा मौिूिा गजतजवजधर्ों का जवस्ट्तार, पर्ाटन मास्ट्टर प्लान और लागू दििाजनििे ों के अनरूु प होगा। 13. जनमााण गजतजवजधर्ाँ। क. संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, दकसी भी प्रकार के नए वाजणजज्र्क जनमाणा की अनुमजत नहीं िी िाएगी: बिते दक, स्ट्थानीर् लोगों को स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उप-जनर्मों के अनसु ार पैराग्राफ 3 के उप-पैरा (1) में सूचीबि गजतजवजधर्ों सजहत उनके उपर्ोग के जलए उनकी भूजम पर जनमााण कार् ा करने की अनुमजत होगी: बिते दक प्रिषू ण न फैलाने वाले लघु उद्योगों स े संबंजधत जनमााण गजतजवजध को लाग ू जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार सक्षम प्राजधकारी से पूवा अनुमजत लके र जवजनर्जमत दकर्ा िाएगा और न्द्र्ूनतम रखा िाएगा। ख. एक दकलोमीटर से आगे इसे आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 िाएगा। 14. लघ ु पैमाने के गरै -प्रिषू णकारी उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण के अनुसार गरै -प्रिषू णकारी उद्योग, िैसा दक समर्-समर् पर संिोजधत दकर्ा गर्ा ह,ै तथा पाररजस्ट्थजतकी संवेिी िोन से स्ट्विेिी सामजग्रर्ों से उत्पाि बनान े वाल े गरै -खतरनाक, लघ ु एव ं सेवा उद्योग, कृजष, पुष्प-कृजष, बागवानी र्ा कृजष-आधाररत उद्योग को अनुमजत िी िाएगी। 15. पेडों की कटाई। क. राज्र् सरकार म ें सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी, रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। ख. संबंजधत केन्द्रीर् र्ा राज्र् अजधजनर्म तथा उसके अंतगात बनाए गए जनर्मों के प्रावधानों के अनुसार जवजनर्जमत दकर्ा िाएगा । 16. वन उपि र्ा गरै -काष्ठ वन उपि का संग्रहण। लाग ूकानूनों के तहत जवजनर्जमत। 17. जवद्युत एवं संचार टावरों का जनमााण तथा केबल लागू काननू ों के तहत जवजनर्जमत भूजमगत केबपलगं को एवं अन्द्र् अवसंरचनाए ंजबछाना। बढ़ावा दिर्ा िा सकता ह।ै 18. नागररक सुजवधाओं सजहत बुजनर्ािी ढांचा। लाग ू कानूनों, जनर्मों और जवजनर्मों तथा उपलब्ध दििाजनिेिों के अनुसार िमन के उपार् करना। 19. जवद्यमान सडकों को चौडा करना, उन्द् ह ें पक्क ा लाग ू कानूनों, जनर्मों और जवजनर्मों तथा उपलब्ध बनाना और नई सडकों का जनमााण। दििाजनिेिों के अनुसार उजचत पर्ाावरण प्रभाव आकलन के साथ िमन के उपार् करना। 20. पहाडी ढलानों और निी तटों का संरक्षण। लाग ूकानूनों के अनुसार जवजनर्जमत। 21. राजत्र में वाहनों का आवागमन। लाग ूकानूनों के अनुसार जवजनर्जमत 22. स्ट्थानीर् समुिार्ों द्वारा डेर्री, डेर्री फार्मिंग, स्ट्थानीर् लोगों के उपर्ोग के जलए लागू कानूनों के िलीर् कृजष और मत्स्ट्र् पालन के साथ-साथ चल अनुसार अनुमजत िी गई ह।ै रही कृजष और बागवानी प्रथाएँ। 23. फमों, कॉपोरेट और कंपजनर्ों द्वारा बडे पैमाने पर स्ट्थानीर् आवश्र्कताओं को परू ा करने के अलावा लाग ू वाजणजज्र्क पिुधन और पोल्री फामों की कानूनों के अनुसार जवजनर्जमत। स्ट्थापना। 24. कृजष र्ा अन्द्र् उपर्ोग के जलए खुला कुआँ, बोरवले जवजनर्जमत दकर्ा िाना चाजहए तथा उजचत प्राजधकारी आदि। द्वारा गजतजवजध की कडाई स ेजनगरानी की िानी चाजहए। 25. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र म ें उपचाररत उपचाररत अपजिि िल र्ा अपजििों को िल जनकार्ों म ें अपजिि िल/अपजििों का जनवाहन। िाने से रोका िाएगा और उपचाररत अपजिि िल के पुनचाक्रण और पुनः उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्द्र्था, उपचाररत अपजिि िल/ अपजििों (1) जनगरानी सजमजत, वास्ट्तजवक स्ट्थल-जवजििाओं के आधार पर, भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा एसओ 1533 (ई), दिनांक 14 जसतम्बर, 2006 की अनुसूची में िाजमल गजतजवजधर्ों की िांच करेगी, और िो पाररजस्ट्थजतकी संवेिी िोन म ें आती ह,ैं जसवार् इसके परै ा 4 के अंतगात ताजलका म ें जनर्ििा जनजषि गजतजवजधर्ों के, और उि अजधसूचना के प्रावधानों के तहत पूवा पर्ाावरणीर् मंिरू ी के जलए, िैसा भी मामला हो, केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण प्रभाव आकलन प्राजधकरण को संिर्भात दकर्ा िाता ह।ै (2) भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा एसओ 1533 (ई), दिनांक 14 जसतम्बर, 2006 की अनुसूची में िाजमल न की गई गजतजवजधर्ां और पाररजस्ट्थजतकी संवेिी िोन म ें आने वाली गजतजवजधर्ां, परै ा 4 के अतं गता ताजलका म ें जनर्िाि प्रजतबंजधत गजतजवजधर्ों को छोडकर, वास्ट्तजवक स्ट्थल-जवजिि जस्ट्थजतर्ों के आधार पर जनगरानी सजमजत द्वारा िांच की िाएंगी और संबंजधत जनर्ामक प्राजधकरणों को भेिी िाएंगी। (3) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के तहत दकसी भी व्यजि के जखलाफ जिकार्त ििा करन े के जलए सक्षम होगा िो इस अजधसूचना के प्रावधानों का उल्लघं न DRAFT NOTIFICATION WHEREAS, the Rupi Bhaba Wildlife Sanctuary is spread over an area of 503 square kilometres and is located in the Nichar sub-division of Kinnaur district in Himachal Pradesh. It is situated along the Upper Sutlej valley spreading between 31° 35′ and 31° 45′ N latitudes and between 77° 49′ and 78° 07′ E longitudes. Reckong Peo (Kalpa), the headquarters of Kinnaur district lies about 40 kilometers on the eastern side of the sanctuary. AND WHEREAS, the Rupi Bhaba Wildlife Sanctuary is positioned between the Shrikhand mountains of the Dhauladhar range in the West and North and the Sutlej River in the South. The sanctuary was given the status of a Wildlife Sanctuary by the Government of Himachal Pradesh vide Notification No. FFE-B-F(6)II/2005-11 dated 07.06.2013. AND WHEREAS, the Rupi-Bhaba wildlife Sanctuary enjoys the privilege of being situated in the Middle Himalayas and confirm to Zone 2 B (Western Himalayas) biographic zone. The Rupi-Bhaba Wildlife Sanctuary together with Great Himalayan National Park and Pin Valley National Park form a continuous and compact block of Protected area network and is suitable to be constituted into a Western Himalayan Biosphere Reserve. AND WHEREAS, the Sanctuary is known for its vast alpine pastures and meadows with thick Deodar, Kail and broad leaved forests (2000 meters and above), Fir-Spruce with bamboo dominating the under growth on higher attitude (2800 meters & above). The alpine zone starts from above 3500 meters altitude. AND WHEREAS, the Rupi Bhaba Wildlife Sanctuary provides one of the most beautiful panoramic views of the Middle Himalayas to the nature lovers and has large members of trekking routes, mountain peaks and high passes to the delight of adventure seekers. There are more than fifteen peaks within the Sanctuary which are above 5000 meters of altitude. The highest Peak (5914 mtrs.) is on Chikim Dhar on the eastern boundary. The Pandoswar Peak (5806 mtrs.) is the second highest peak and a very important geographical landmark in Kinnaur District. On the northern boundary there are three high mountain passes namely Shakarog Khango (5100 mtrs), Nimish Khango (4890 mtrs) and Tari Khango (4865 mtrs), all of which connect Rupi-Bhaba Wildlife Sanctuary with Pin Valley National Park of Spiti Sub-Division of Lahaul & Spiti District. AND WHEREAS, The alpine region of the Rupi-Bhaba Wildlife Sanctuary is abundant in medicinal herbs, and the local communities supplement their income by gathering and selling these plants. The most-important herbs collected profusely are Karu (Picrorhiza kurooa), Patish (Aconitum heterophyllum) Banafsa (Viola biflora), Kuth30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (Sausurea lappa), Mushaqbala (Valeriana wallichii), Reward Chini (Rheum emodii), Bankakri (Sinopodophyllum hexandrum) etc. For Ayurvedic medicines, all the herbs found in alpine pastures of this Sanctuary are of great economic value & importance. AND WHEREAS, the major faunal species found in the sanctuary are musk deer (Moschus moschiferus), goral (Nemorrhaedus goral), bharal (Pseudois nayar), serow (Capricornis sumatraensis thar), Himalayan thar (Hemitragus jemlahicus), Himalayan weasel (Mustela siribica), snow leopard (Uncia uncia), common leopard (Panthera pardus), leopard cat (Felis bengalensis), red fox (Vulpes vulpes), small Kashmir flying squirrel (Hylopetes fimbriatus), Asiatic Black bear (Urus thibetanus), Western tragopan (Tragopan melanocephalus), cheer pheasant (Catreus wallichi), Himalayan monal (Lophophorus impejanus), Himalayan griffon (Gyps himalayensis), Woodcock etc. AND WHEREAS, the Rupi Bhaba Wildlife Sanctuary harbours key floral species such as brown oak (Quercus semicarpifolia), spruce (Picea smithiana), fir (Abies pindrow), chilgosa (Pinus gerardiana), maple (Acer pentapomicum), ash/olive (Fraxinus xanthoxyloides), Alnus nitida, Betula anoides, Buxus wallichiana, Cornus sp., pink rhododendron, Berberis sp. Artemisia vulgaris, Lonicera augustifolia, Ephdera gerardiana, Plactranthus sp. Juniperus indica etc. AND WHEREAS, it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the protected area as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment(Protection) Act1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules,1986, the Central Government hereby notifies an area extending from 0 kilometer to 3.45 kilometers from the boundary of the Rupi Bhaba Wildlife Sanctury in Kinnaur district in the State of Himachal Pradesh as the Rupi Bhaba Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-Sensitive Zone.- (1) The Eco-sensitive Zone extends from 0 kilometer to 3.45 kilometers around the boundary of Rupi Bhaba Wildlife Sanctuary and the area of the Eco-sensitive Zone is approximately 85.53 square kilometer. Note: The Rupi-Bhabha Wildlife Sanctuary shares its boundaries on three sides with the Eco-Sensitive Zone (ESZ) of the Lippa-Asarang Wildlife Sanctuary to the east. To the north, it borders the Eco-Sensitive Zone of the Pin Valley National Park, as well as the park itself. On the north-western side, the sanctuary adjoins the Great Himalayan National Park. Therefore, there is no Eco-Sensitive Zone on these three sides of the Rupi-Bhabha Wildlife Sanctuary. (2) The boundary description of the Eco Sensitive Zone is appended as Annexure-I. (3) The Maps of the Eco-sensitive Zone around Rupi Bhaba Wildlife Sanctuary is appended as Annexure- II A, Annexure II B, Annexure II C and Annexure II D. (4) Geo Coordinates on the boundary of Rupi Bhaba Wildlife Sanctuary and its Eco-sensitive zone are appended at Annexure -III. (5) The list of villages falling under the Eco-sensitive Zone are appended as Annexure-IV. (6) The detailed list of Flora and Fauna present in the area is at Annexure-V. 2. Zonal Master Plan for Eco-Sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 i. Environment; ii. Forest and Wildlife; iii. Agriculture; iv. Revenue; v. Urban Development; vi. Tourism; vii. Rural Development; viii. Irrigation and Flood Control; ix. Panchayati Raj; x. Municipality; xi. Himachal Pradesh State Pollution Control Board (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified at sub-para (1) and (2) of paragraph 6. 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - 1. Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- i. widening and strengthening of existing roads and construction of new roads; ii. construction and renovation of infrastructure and civic amenities; iii. small scale industries not causing pollution; iv. cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. 2. Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. 3. Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; b. the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; c. the Tourism Master Plan shall form a component of the Zonal Master Plan; d. the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; e. the activities of eco-tourism shall be regulated as under, namely:- i. new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer; Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; ii. all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; iii. until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. 4. Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. 5. Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. 6. Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and its amendments. 7. Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts. 8. Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts. 9. Solid wastes.- Disposal and Management of solid wastes shall be as under:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33 a. the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) Safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive zone. 10. Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- a. the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide number G.S.R. 343 (E), dated the 28th March, 2016 as amended from time to time; b. safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. 11. Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. 12. Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. 13. E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. 14. Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 15. Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. 16. Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non- polluting cottage industries shall be promoted. 17. Protection of hill slopes.- The protection of hill slopes shall be as under:- a. the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; b. construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone- All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Environmental Impact Assessment Notification, 2006 (or the latest notification) and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S. New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 35 Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. b. Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 14. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small- scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted. 15. Felling of trees. a. There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. b. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro- forma specified in Annexure-VI, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures: The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders.
