अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (धिसे इस अधिसूचना म ें इसके िश्चात िर्ाावरण अधिधनर्म कहा गर्ा ह)ै की धारा 3 की उप-धारा (1) और उप-धारा (2) के खडं (v) और खंड (xiv) तथा उप-धारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, पजिम बगं ाल राज्र् के िार्िाललगं और िलपाईगडु ी धिलों के महानंिा वन्र्िीव अभर्ारण्र् की सीमा से लगे 1 दकमी. से 18.16 दकमी. तक जवस्ट्ताररत क्षेत्र को महानंिा वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ् :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाए ं - (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार महानंिा वन्र्िीव अभर्ारण्र् की सीमा से लग े 1 दकमी. से 18.16 दकमी. तक जवस्ट्ताररत क्षेत्र और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 539.86 वग ादकलोमीटर ह।ै (2) महानंिा वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण सलं ग्न क-I के रूप म ें संलग्न ह।ै (3) महानंिा वन्र्िीव अभर्ारण्र् के आस-पास के पाररजस्ट्थजतकी संवेिी जोन के मानजचत्र तथा महत्वपूणा मागा लबंिओंु के भू-जनिेिांक सलं ग्न क-IIक, सलं ग्न क-IIख, सलं ग्न क-IIग और सलं ग्न क-IIघ के रूप म ेंसंलग्न ह।ैं (4) महानंिा वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिाकं सलं ग्न क-III के रूप में संलग् न ह।ै (5) पाररजस्ट्थजतकी संवेिी जोन के अतं गात आने वाल े क्षेत्रों (ग्रामों, चार् के बागानों, वनों) की सूची सलं ग्न क-IV के रूप में संलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना – (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अंजतम अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा स े और इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी जिस पर राज्र् म ें सक्षम प्राजधकारी का अनुमोदित प्राि करना होगा। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िाष् ट रीजत से तथा प्रासंजगक केंद्रीर् और राज्र् जवजधर्ों के अनरूु प और राज्र् सरकार द्वारा िारी दििा जनिेिों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) इस आंचजलक महार्ोिना को जनम्नजलजखत जवभागों के परामिा से तैर्ार दकर्ा िाएगा जिससे दक इसमें पाररजस्ट्थजतकी और पर्ाावरण सम्बंधी जवषर्ों को िाजमल दकर्ा िा सके:- (i) वन; (ii) रािस्ट्व; (iii) कृजष; (iv) पंचार्ती राि और ग्रामीण जवकास; (v) जसचांई और बाढ़ जनर्ंत्रण; (vi) पर्ाटन; (vii) नगरपाजलका और िहरी जवकास; (viii) लोक जनमााण जवभाग और रािमागा; (ix) पजिम बंगाल राज्र् प्रिषू ण जनर्ंत्रण बोडा; (x) पर्ाावरण; (xi) चार् बागानों, रेलव,े रक्षा, एनएचपीसी और भारतीर् तले जनगम के प्रजतजनजधर्ों न े भाग जलर्ा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (4) िब तक इस अजधसूचना में जवजनर्िाष्ट न हो, आंचजलक महार्ोिना में वतामान म ें अनमु ोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्ह े अजधक कारगर और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) इस आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एवं पर्ाावरण के ऐस े अन्र् सन्िभो के जलए प्रावधान दकर्े िार्ेंगे जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) इस आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट्थ लों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं दकस्ट् मों, कृजष क्षेत्रों, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और प्रस्ट्ताजवत भू-उपर्ोग की जविेषताओं का ब्र्ौरा भी दिर्ा िाएंगा। (7) इस आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी में र्थासूचीबद्ध प्रजतजषद्ध, जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा और इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर्न एव ंसंवधना दकर्ा िाएगा। (8) र्ह आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी। (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि का काम करेगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके। (10) आंचजलक महार्ोिना की लजम्बत और अनुमोिन, कोई नर्ा जवकासात्मक दक्रर्ाकलाप उपपैरा (1) और (2) के पैरा 6 म ें जवजनर्िाष्ट उपबंधों द्वारा िाजसत होंगे। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार् - राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, र्था:- (1) भ-ू उपर्ोग – (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए अजभज्ञात उद्यानों और खलु े स्ट्थानों का वहृ ि वाजणजज्र्क र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा इसके संपररवतान की अनुमजत नही होगी: परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्ुाि भाग (क) में जवजनर्िाष्ट प्रर्ोिन से जभन्न दकसी अन्र् प्रर्ोिन के जलए कृजष और अन्र् भूजम का संपररवतान को जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्र सरकार र्ा राज्र् सरकार के अन्र् जनर्मों एवं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार सक्षम प्राजधकारी के पवू ा अनुमोिन से स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को परू ा करने के जलए अनुमजत िी िा सकेगी:- i. जवद्यमान सडकों को चौडा करना, उन्ह ेंसुिढ़ृ करना और नई सडकों का जनमााण करना; ii. बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; iii. प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; iv. कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और v. पैराग्राफ-7 में र्था उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु र्ह भी दक राज्र् सरकार अनुमोिन के जबना एवं भारत के संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी। परंत ु र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पिात्, राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार सुधारा िा सकेगा और उि त्रुरट को सुधारे िाने की सूचना केंद्र सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह और भी दक उपर्ुाि त्रुरट के संिोधन म ें इस उप परै ा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भ-ू उपर्ोग का पररवतना सजम्मजलत नहीं होगा : (ख) वनीकरण और पर्ाावास पुनबाहाली दक्रर्ालापों के साथ अप्रर्ुसत र्ा अनुत्प ािक कृजष क्षेत्रों म ें पुन: वनीकरण करन े के प्रर्ास दकए िाएंगे । (2) प्राकृजतक िल स्रोत - इस आंचजलक महार्ोिना में आने वाले सभी प्राकृजतक िलमागों के आवाह क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा िल आवाह प्रबंधन र्ोिना इस रीजत स े बनाई िाएगी दक उसमें आवाह क्षेत्रों में जवकास दक्रर्ाकलापों को प्रजतजषद्ध और जनबिंजधत दकर्ा गर्ा हो । (3) पर्टा न एव ंपाररजस्ट्थजतकी पर्टा न – (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार होगा। ख. पाररजस्ट्थजतकी पर्ाटन महार्ोिना, राज्र् के पर्ाावरण और वन जवभागों के परामिा स े राज्र् के पर्ाटन जवभाग द्वारा बनार्ी िाएगी। ग. पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। घ. पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। ङ. पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - i. वन् र्िीव अभर्ारण्र् की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें से िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा जनमााण को अनुमत नहीं दकर्ा िाएगाः परंत ु र्ह भी दक, इस सरं जक्षत क्षेत्र की सीमा रेखा से 1 दकलोमीटर की िरू ी स े परे और पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, दकसी नर्े होटलों और ररिॉटा के जनमाणा की कोई भी अनुमजत पर्ाटन महार्ोिना के अनुसार तथा पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए पूवा जनधााररत और अजथजचजन्हत क्षत्रे ों में ही िी िाएगी; ii. पाररजस्ट्थजतकी संवेिी िोन के अन्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्र सरकार के पर्ावा रण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; iii. िब तक इस आंचजलक महार्ोिना को तैर्ार एव ं अनुमोदित नहीं कर दिर्ा िाता ह ैं तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की कोई भी अनुमजत सम्बजन्धत जवजनर्ामक प्राजधकरणों के द्वारा ही िी िाएगी िो दक जनगरानी सजमजत की स्ट्थल जवजिष्ट वास्ट्तजवक िाचाँ और उसकी[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 ररपोटा पर आधाररत होगी और तब तक ऐसे पाररजस्ट्थजतकी संवेिी िोन में दकसी नए होटल, ररिॉटा र्ा वाजणजज्र्क स्ट्थापना के जनमााण की अनुमजत नहीं होगी। 4. प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल े बहुमल्ू र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररजव ा क्षेत्र, िैल सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। 5. मानव जनर्मता जवरासत स्ट्थ ल - पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। 6. ध्व जन प्रिषू ण - पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसमें संिोधन के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण दकर्ा िाएंगा । 7. वार् ु प्रिषू ण - पाररजस्ट्थजतकी संवेिी िोन म ें वार्ु प्रिषू ण का जनवारण और जनर्ंत्रण, भारत सरकार के पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 351 (अ), तारीख 15 मई, 1981, के द्वारा प्रकाजित वार्ु (प्रिषू ण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14), तथा पर्ाावरण अजधजनर्म तथा तद्धीन बनाए गए जनर्मों, के उपबंधों के अनुसार दकर्ा िाएगा । 8. बजहस्राव का जनस्ट्सरण - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण, भारत सरकार के पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 58 (अ), तारीख 27 फरवरी, 1975, के द्वारा प्रकाजित िल प्रिषू ण) जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) तथा पर्ाावरण अजधजनर्म और तद्धीन बनाए गए जनर्मों, के उपबंधों के अनुसार दकर्ा िाएगा। 9. िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबन्धन जनम्नानसु ार दकर्ा िाएगा:- क. पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबंधन केंद्र सरकार द्वारा पर्ावा रण, वन और िलवार्ु पररवतना मंत्रालर् की अजधसूचना स.ं का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन और उपरोि अपजिष्ट प्रबंधन जनर्मों के अनुसार स े बाहर अजभज्ञात दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा। ख. पाररजस्ट्थजतकी संवेिी िोन म ें मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट के जनरापि और पर्ाावरण अनुकूल प्रबंधन की अनुमजत िी िा सकेगी। ग. (iii) िैव अक्रमणीर् सामग्री का पुनचाक्रण अजधमानतः कम्पोलस्ट्टंग र्ा वमीकल्चर के माध्र्म से दकर्ा िाएगा। घ (iv) अिैजवक सामग्री का जनपटान पाररजस्ट्थजतकी-संवेिी िोन के बाहर अजभज्ञात स्ट्थलों म ें पार्ाावरणीर् स्ट्वीकार्ा रीजत से दकर्ा िाएगा और पाररजस्ट्थजतकी-संवेिी िोन में िोस अपजिष्टों को िलाने र्ा भस्ट्मीकरण की अनुमजत नहीं होगी। (10) िवै जचदकत्सा अपजिष्ट - िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- क. पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान केंद्र सरकार द्वारा पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना स.ं सा.का.जन 343 (अ), तारीख8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा। 11. प्लाजस्ट्टक अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंधन, केंद्र सरकार द्वारा पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसचू ना सं. सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। 12. जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संविे ी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, केंद्र सरकार द्वारा पर्ाावरण, वन और िलवार् ु पररवतान मत्रं ालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित जनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। 13. ई–अपजिष्ट - पाररजस्ट्थजतकी सवं ेिी िोन म ें ई–अपजिष्ट का प्रबंधन, केंद्र सरकार द्वारा पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। 14. सडक-र्ातार्ात - सडक-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना में जविषे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी। 15. वाहन िजनत प्रिषू ण - वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा। स्ट्वच्छतर ईंधन उिाहरण के जलए सीएनिी, एलपीिी आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। 16. औद्योजगक ईकाइर्ा ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा। इसके अजतररि, गैर प्रिषू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। 17. पहाडी ढलानों का सरं क्षण - पहाडी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी जनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजषद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी -पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) के उपबंधों और उसके अधीन बन े जनर्मों, जिसमें तटीर् जवजनर्मन िोन (सीआरिडे ), 2011 एवं पर्ाावरणीर् प्रभाव आकलन अजधसूचना (ईआईए), 2006 िाजमल ह,ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16),[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) अन्र् लाग ू जनर्मों के उपबंधों तथा उनमें दकए गए संिोधनों के अनुसार िाजसत होंगे और नीच ेिी गई सारणी म ेंजवजनर्िाष्ट उत्खनन और भ्रन्िक इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी; (ख) खनन प्रचालन, वषा 1995 की डब्ल्र्ू.पी.(सी) सं. 202 में टी.एन. गोिावमान जतरुमलपाि बनाम र्ूओआई के मामले में दिनांक 04 अगस्ट् त, 2006; वष दिनांक 28 अप्रैल, 2023 के माननीर् उच् चतम न्र्ार्ालर् के आिेिों के अनुसार दकए िाएंगे। 2. प्रिषू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन में कोई प्रिषू णकारी उद्योग लगाने र्ा उसके जवस्ट्तार की अनुमजत नहीं िी िाएगी। मौिूिा उद्योगों द्वारा प्रिषू ण जनवारण प्रौद्योजगदकर्ां और उत्पन्न करने वाले उद्योगों की स्ट्थापना। ध्वजन अवरोधक संस्ट्थाजपत दकए िाने चाजहए। 3. बडी िल जवद्युत पररर्ोिनाओं की स्ट्थापना। प्रजतजषद्ध। 4. दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा क. पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई पररसंकटमर् अपजिष्ट िोधन सुजवधा उत्पािन र्ा प्रस्ट्संकरण। अवजस्ट्थत नहीं होगी ख. पाररजस्ट्थजतकी संवेिी िोन के भीतर उत्पन्न सभी पररसंकटमर् अपजिष्ट को पाररजस्ट्थजतकी संवेिी िोन के बाहर ले िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत्पन्न दकसी भी पररसंकटमर् अपजिष्ट को पाररजस्ट्थजतकी संवेिी िोन के अंिर संभालने, संसाजधत करने र्ा िोजधत करने की अनुमजत नहीं िी िाएगी। 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षत्रे में प्रजतजषद्ध। अिोजधत बजहस्रावों का जनस्ट्सरण। 6. नई सॉ जमलों की स्ट् थापना की स्ट् थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई र्ा मौिूिा सॉ जमलों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। 7. ईंट भट्टों की स्ट्थापना। प्रजतजषद्ध। 8. पॉलीथीन बैग और प्लाजस्ट्टक का प्रर्ोग। पर्ाटन कार्ाकलाप के जलए प्रजतजषद्ध। अन्र् वाजणजज्र्क प्रजतष्ठान के जलए 50 माइक्रोन से कम आकार का प्लाजस्ट्टक प्रजतजसद्ध रहेगा। 9. िलावन लकडी का वाजणजज्र्क उपर्ोग। प्रजतजषद्ध। 10. सतही एवं भूिल का वाजणजज्र्क जनष्कषाण। प्रजतजषद्ध। 11. जविेिी प्रिाजतर्ों को लाना। प्रजतजषद्ध। 12. िोस अपजिष्ट िोधन (क) पाररजस्ट्थजतकी संवेिी िोन में िैव-जनम्नीकरणीर् िोस अपजिष्ट जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा दिनांक 8 अप्रैल, 2016 की अजधसूचना संखर्ा का.आ. 1357 (ई) द्वारा प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा; अिैजवक सामग्री का जनपटान पाररजस्ट्थजतकी संवेिी िोन के बाहर जचजन्हत स्ट्थल पर पर्ाावरण की िजृष्ट से स्ट्वीकार्ा तरीके से दकर्ा िा सकता है। (ख) पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी िोस अपजिष्ट को पाररजस्ट्थजतकी संवेिी िोन के भीतर उपचाररत/प्रसंस्ट्कृत करने की अनुमजत नहीं िी िाएगी। 13. िैव-जचदकत्सा अपजिष्ट की िोधन सुजवधा (क) पाररजस्ट्थजतकी संवेिी िोन में िैव-जचदकत् सा अपजिष्ट का जनपटान भारत सरकार की स्ट्थापना। के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की दिनांक 28 माचा, 2016 की अजधसूचना संखर्ा सा.का.जन. 343(अ) द्वारा प्रकाजित िैव-जचदकत् सा अपजिष्ट प्रबंधन, जनर्म, 2016 के अनुसार दकर्ा िाएगा। पाररजस्ट्थजतकी संवेिी जोन के भीतर कोई िैव-जचदकत् सा अपजिष्ट िोधन सुजवधा जस्ट्थत नहीं होगी।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर िैव-जचदकत्सा इकाइर्ों से उत् सर्िात सभी अपजिष् ट को िोधन और जनपटान के जलए पाररजस्ट्थजतकी संवेिी िोन के बाहर ल े िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी िैव- जचदकत्सा अपजिष्ट का पाररजस्ट्थजतकी संवेिी िोन के अंिर हथालन, प्रसंस्ट् करण र्ा िोधन करने की अनुमजत नहीं िी िाएगी। 14. प्लाजस्ट्टक अपजिष्ट की िोधन सुजवधा की (क) पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन, भारत सरकार के स्ट्थापना। पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा दिनांक 18 माचा, 2016 की अजधसूचना संखर्ा सा.का.जन. 340(अ) के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016, समर्-समर् पर र्थासंिोजधत, के उपबंधों के अनुसार दकर्ा िाएगा। आंचजलक महार्ोिना में अजतररि स्ट् थान-जवजिष्ट प्रजतबंध जनधााररत दकए िा सकते हैं। पाररजस्ट्थजतकी संवेिी िोन के अंिर कोई भी प्लाजस्ट्टक अपजिष्ट िोधन सुजवधा जस्ट्थत नहीं होनी चाजहए। (ख) पाररजस्ट्थजतकी संवेिी िोन के अंिर उत् सर्िात सभी प्लाजस्ट्टक अपजिष् ट को ईएसिेड के बाहर ले िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी प्लाजस्ट्टक अपजिष् ट का पाररजस्ट्थजतकी संवेिी िोन के अंिर हथालन, प्रसंस्ट् करण र्ा िोधन करने की अनुमजत नहीं िी िाएगी। 15. ई-अपजिष्ट की िोधन सुजवधा की स्ट्थापना। (क) पाररजस्ट्थजतकी संवेिी िोन में ई-अपजिष् ट प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित ई-अपजिष् ट प्रबंधन जनर्म, 2016, समर्-समर् पर र्थासंिोजधत, के प्रावधानों के अनुसार दकर्ा िाएगा। आंचजलक महार्ोिना में जवजिष्टताएं और अजतररि स्ट् थान-जवजिष्ट प्रजतबंध जनधााररत दकए िा सकते हैं। पाररजस्ट्थजतकी संवेिी िोन के अंिर कोई ई-अपजिष् ट िोधन सुजवधा जस्ट्थत नहीं होनी चाजहए। (ख) पाररजस्ट्थजतकी संवेिी िोन के अंिर उत् सर्िात सभी ई- अपजिष्ट को पाररजस्ट्थजतकी संवेिी िोन के बाहर ले िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी ई-अपजिष्ट का पाररजस्ट्थजतकी संवेिी िोन के अंिर हथालन, प्रसंस्ट् करण र्ा िोधन करने की अनुमजत नहीं िी िाएगी। ख. जवजनर्जमत दक्रर्ाकलाप 16. होटलों और ररसोटों की वाजणजज्र्क स्ट्थापना पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हेतु लघु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, । संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना की अनुमजत नहीं होगी: परंतु, संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू दििाजनिेिों के अनुसार सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी। 17. जनमााण दक्रर्ाकलाप। (क) संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क जनमााण को अनुमत नहीं दकर्ा िाएगा: परंतु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप पैराग्राफ (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए जनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िा सकेगी: परन्तु ऐसे लघु उद्योगों िो प्रिषू ण उत् पन्न नहीं करते हैं, से संबंजधत जनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लाग ूजनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से ही न्र् ूनतम पर रखे िाएंगे। (ख) एक दकलोमीटर से आग ेआंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे। 18. गैर प्रिषू णकारी लघु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी समर्-समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार सक्षम प्राजधकारी गैर-प्रिषू णकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन की अपनी सामग्री से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग को अनुमजत िे सकेंगे। 19. वृक्षों की कटाई। (क) राज्र् सरकार के सक्षम प्राजधकारी की पूव ाअनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िा सकेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 (ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी। 20. वन उत्पािों और गैर काष्ठ वन उत्पािों लाग ूजवजधर्ों के अधीन व्यवस्ट्था। 22. नागररक सुजवधाओं सजहत बुजनर्ािी ढााँचा। लाग ू कानूनों, जनर्मों और जवजनर्मों और उपलब्ध दििाजनिेिों के अनुसार िमन के उपार् करना। 23. मौिूिा सडकों को चौडा करना, उन्ह ें सुिढृ लाग ू जवजधर्ों, जनर्मों और जवजनर्मन और उपलब्ध दििाजनिेिों के अनुसार उजचत बनाना और नई सडकों का जनमााण। पर्ाावरण प्रभाव मूल् र्ांकनके साथ न्र्ूनीकरण उपार् करना। 24. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िसै े दक लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। पाररजस्ट्थजतकी संवेिी िोन क्षत्रे के ऊपर से गम ा वार्ु के गुब्बारे, हेलीकाप्टर, ड्रोन, माइक्रोलाइट्स उडाना आदि। 25. पहाडी ढालों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। 26. राजत्र में वाहन र्ातार्ात का संचलन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। 27. स्ट्थानीर् िनता द्वारा अपनार्ी िा रही स्ट्थानीर् िनता के प्रर्ोग के जलए लाग ूजवजधर्ों के अधीन अनुमत होंगे। वतामान कृजष और बागवानी पद्धजतर्ों के साथ डेर्ररर्ां, िग्ुध उत्पािन, िल कृजष और मत्स्ट्र् पालन। 28. फमों, कारपोरेट, कंपजनर्ों द्वारा बडे पैमाने स्ट्थानीर् आवश्र्कताओं को पूरा करने को लागू जवजधर्ों के अधीन जवजनर्जमत (अन्र्था पर वाजणजज्र्क पिुधन संपिा और कुसकुट प्रिान दकए गए) होंगे। फामों की स्ट्थापना। 29. कृजष र्ा अन्र् उपर्ोग के जलए खुला कुआाँ, जवजनर्जमत और कार्ाकलाप सजमजत, वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर उन दक्रर्ाकलापों की छानबीन करेगी िो दक भारत सरकार के एतद्पूव ा पर्ाावरण और वन मंत्रालर्, की अजधसूचना संखर्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006, के अंतगात आते हों और पाररजस्ट्थजतकी संवेिी िोन में हो रह े हों, उसके परै ा 4 के अधीन सारणी में जनर्िष्टा जनजषद्ध दक्रर्ाकलापों को छोडकर, और उि अजधसूचना के प्रावधानो के अंतगात पर्ाावरण की िजृ ष्ट स े पूवा-जसलर्रेन्स के जलए केन्द्र सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण आघात मूल्र्ांकन प्राजधकरण के पास सन्िर्भात कर दिए गए हों। (2) भारत सरकार के तत्कालीन पर्ाावरण एवं वन मंत्रालर् की अजधसूचना क्रमांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 और पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाले दक्रर्ाकलापों, उसके पैरा 4 के अधीन सारणी में जनर्िाष्ट जनजषद्ध दक्रर्ाकलापों को छोडकर, की जनगरानी सजमजत द्वारा वास्ट्तजवक साइट-जवजिष्ट की जस्ट्थजतर्ों के आधार पर िाचं की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को जनर्िाष्ट की िाएगी। (3) जनगरानी सजमजत के सिस्ट्र्-सजचव र्ा संबंजधत कलेसटर र्ा संबंजधत उप वन संरक्षक पर्ावा रण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लंघन करन े वाले दकसी भी व्यजि के जवरुद्ध जिकार्त िि ाकरने के जलए सक्षम होंगे। (4) esz-mef@nic.in Draft Notification WHEREAS, the Mahananda Wildlife Sanctuary is situated in Darjeeling and Jalpaiguri districts of West Bengal which are characterized by forest and riverine ecosystem adjoining tea gardens and villages with diverse ethnicities. The Sanctuary has an area of 161.17 square kilometers harboring species of Gaurs (Bos gaurus). It also acts as a corridor for sustaining population of wild elephants in North Bengal in between Teesta and Mechi River, between Gorumara National Park, Baikunthpur Forests and between Teesta river and Forests of Kalimpong division; AND WHEREAS, Mahananda Wildlife Sanctuary is characterized by elephant migration route and variety of migratory elephant takes shelters. Royal Bengal tiger (Panthera tigris) was also reported from the Sanctuary during monsoons and winter seasons. The area is also famous for chital (Axis axis), barking deer (Muntiacus munjtak), boar (Sus scrofa), pangolin (Manis crassicaudata), sambar (Rusa unicolour), Rhesus monkey (Macaca mulatta), Himalayan black bear (Ursus thibetanus laniger), fishing cat (Prionailurus viverrinus), jungle cat (Felis chaus), clouded leopard (Neofelis nebulosa), rare mountain goat (Capricornis thar), etc.; AND WHEREAS, the major butterflies so far known to be found in Mahananda Wildlife Sanctuary are, Common Bluebottle butterfly (Graphium sarpedon), Tailed Jay butterfly (Graphium Agamemnon), Common Five ring butterfly (Ypthima baldus), Plain Tiger butterfly (Danaus), Common Leopard butterfly (Phalanta Phalantha), Banded Treebrown butterfly Neope confuse, Psyche butterfly (Leptosia nina), Crimson Rose butterfly (Pachliopta hector), Danaid eggfly butterfly (Hypolimnas misippus), Chocolate Pansy butterfly (Precis iphita), Painted Jazebel butterfly (Delias hyperate), Oakleaf butterfly (Kallima horsfieldi), Common Nawab butterfly (Charaxes athamus), Common Sailor butterfly (Neptis hylas), Striped Tiger butterfly (Danaus genutia), Common Map (Cyrestis thyodbmus), Tawny Rajah butterfly (Charaxes bernardus) etc; AND WHEREAS, for effective conservation and protection of the floral and faunal biodiversity of Mahananda Wildlife Sanctuary, the extent of different anthropogenic pressures has to be regulated as the immediate area adjoining this fragile ecosystem is much ecologically sensitive having great impact on this protected area and wildlife in whole of North Bengal; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Mahananda Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, , in exercise of the powers conferred by sub-section (1) clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notify 1 kilometer to 18.16 kilometers from the boundary of the Mahananda Wildlife Sanctuary in Darjeeling , Kalimpong and Jalpaiguri District in the State of West Bengal as the Eco-sensitive Zone (hereafter in this notification referred to as Eco- sensitive zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-Sensitive Zone- (1) The Eco-sensitive Zone is extends from 1 kilometer to 18.16 kilometers around the boundary of Mahananda Wildlife Sanctuary and the area of the Eco-sensitive Zone is approximately 539.86 square kilometer. (2) The boundary description of the Eco Sensitive Zone of Mahananda Wildlife Sanctuary is appended as Annexure-I. (3) The Maps of the Eco-sensitive Zone around Mahananda Wildlife Sanctuary and Geo- coordinates of the important way points is appended as Annexure- II A, Annexure II B Annexure II C and Annexure II D. (4) Geo Coordinates on the boundary of Mahananda Wildlife Sanctuary and its Eco-sensitive zone are appended at Annexure -III. (5) The list of areas falling (Villages, Tea Gardens, Forests) under the Eco-sensitive Zone is appended as Annexure-IV. 2. Zonal Master Plan for Eco-Sensitive Zone- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) Forest; (ii) Revenue; (iii) Agriculture; (iv) Panchayati Raj and Rural Development; (v) Irrigation and Flood Control; (vi) Tourism; (vii) Municipal and Urban Development; (viii) Public Works Department and Highway; (ix) West Bengal State Pollution Control Board; (x) Environment; (xi) Representatives from Association of Tea Gardens, Railways, Defense, NHPC and Indian Oil Corporation. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified at paragraph 6 of sub-para (1) and (2). 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer; Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco- tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and its amendments. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (c) (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (d) (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall he permitted in the Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non- polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted 3. List of activities prohibited or to be regulated within Eco-sensitive Zone- All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Environmental Impact Assessment Notification, 2006 (or the latest notification) and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33 TABLE Sl. (a) The bio-degradable solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco- sensitive Zone. (b) No solid waste generated outside the Eco Sensitive Zone will be allowed to be treated/ processed within the Eco Sensitive Zone. 13. Treatment of Bio-Medical waste. (a) The Bio-Medical Waste disposal in the Eco Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016. No Bio Medical Waste treatment facility shall be located within the Eco Sensitive Zone. (b) All waste generated from bio-medical units within the Eco-34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] sensitive Zone shall be taken outside the Eco-sensitive Zone for treatment and disposal. No Bio-medical waste generated outside the Eco-sensitive Zone will be allowed to be handled, processed or treated inside the Eco-sensitive Zone. 14. Treatment of plastic waste. (a) The Plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the MoEF&CC vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. Additional site-specific restrictions may be prescribed in the Zonal Master Plan. No plastic waste treatment facility should be located inside the Eco-sensitive Zone. (b) All plastic waste generated inside the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone . No plastic waste generated outside the Eco-sensitive Zone will be allowed to be handled, processed or treated inside the Eco-sensitive Zone . 15. Treatment of E-waste. (a) The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the e-waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. Specifications and additional site- specific restrictions may be prescribed in the Zonal Master Plan. No e-waste treatment facility should be located inside the Eco-sensitive Zone. (b) All e-waste generated inside the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone . No e-waste generated outside the Eco-sensitive Zone will be allowed to be handled, processed or treated inside the Eco-sensitive Zone. B. Regulated Activities 16. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 18. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted. 19. Felling of trees. Functions of the Monitoring Committee – (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-V, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.
