और एतद्द्वारा सूजचत दकया िाता ह ै दक िन सामान् य को उपलब्ध कराने हते ु इस अजधसचू ना के सरकारी रािपत्र में प्रकािन की तारीख स े तीस दिनों की अिजध के पश् चात उि मसौिा जनयमों पर जिचार दकया िाएगा; यदि कोई आपजत्त या सुझाि हो, तो उसे श्री राम चरण मीणा, अिर सजचि, भारत सरकार, दिव्ांगिन सिजिकरण जिभाग, कमरा नंबर 11ए, 5िीं मंज़िल, पंजडत िीन ियाल अंत्योिय भिन, सीिीओ कॉम््लेक्स, लोधी रोड, नई दिल्ली, 110003 को अथिा ईमेल आईडी - rcmeena.79@gov.in. पर भेिा िा सकता ह।ै उपरोि जिजनर्िथष् ट अिजध के समाप्त होने से पहले, उि मसौिा जनयमों के संबंध में दकसी भी व्जि स े प्राप्त आपजत्तयों और सुझािों पर केंद्र सरकार द्वारा जिचार दकया िाएगा। 8607 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] मसौिा जनयम 1. लघ ु िीषकथ और प्रारंभ — (1) इन जनयमों को भिनों और जनर्मतथ िातािरण में गैर-पराक्रम्य सुगम्यता मानकों पर दिव्ांगिन अजधकार (संिोधन) जनयमािली, 2025 कहा िाएगा। (2) ये सरकारी रािपत्र में अपने प्रकािन की तारीख से लागू होंगे। 2. जनयम 15 म ें उप-जनयम का समाििे — दिव्ांगिन अजधकार जनयम, 2017 में जनयम 15 के उप-जनयम (1) के खंड (त) के पश् चात जनम्नजलजखत खंड िोडा िाएगा, अथाथत्: “(थ) भिनों और जनर्मथत िातािरण में गैर-पराक्रम्य सुगम्यता मानक” (क) पररभाषा— िब तक दक संिभ थ के होते हुए अन्यथा अपेजित न हो— (क) िो अजभव्जियााँ यहा ाँ प्रयुि ह ैं और पररभाजषत नहीं ह,ैं परंतु इस अजधजनयम में पररभाजषत हैं, उनके िही अथथ होंगे िो इस अजधजनयम में उनके जलए दिए गए ह;ैं (ख) “गैर-पराक्रम्य मानक” का अथ थ इन जनयमों की अजधसूचना के प्रभािी होने की तारीख स े प्रभािी होने िाले मानकों स े है, जिनका पालन न करने पर इस अजधजनयम के अनुसार पररणाम भुगतन े के जलए उत्तरिायी होंगे, जिसमें भिन जनमाथण की अनुमजत या मिं ूरी िेने से मना करना, पूणथता/अजधभोग प्रमाण पत्र िेने से मना करना, और िुमाथना लगाना िाजमल ह;ै (ग) “सािथिजनक भिन” और “िन सुजिधाएं और सेिाएं” का इस अजधजनयम की धारा 2(ब) तथा 2(भ) में जनर्िथष्ट अथथ होंगे; (घ) “सािथभौजमक पहुचं ” का आिय सभी आय ु और िमताओं के लोगों के जलए जनबाथध पहुचं से है; (ङ) “सािभथ ौजमक जड़िाइन” का अथथ एक ऐसे जड़िाइन स े ह ै जिस े सभी लोग, जबना दकसी बिलाि की ़िरूरत के, अजधकतम संभि सीमा तक उपयोग कर सकें। (ख) सामान्य— (1) अनुसूची में जनर्िथष्ट गैर-परक्राम्य सगु म्यता मानक समय-समय पर यथा-संिोजधत भारतीय राष्ट्रीय भिन संजहता (एनबीसी) और भारतीय सडक काग्रं ेस (आईआरसी) कोड से प्राप्त हैं, और उन् ह ें समय-समय पर यथासंिोजधत रूप के साथ सामंिस्ट्यपूणथ रूप से पढा िाएगा। (2) िायरा और प्रयोज्यता— ये मानक इस अजधजनयम की धारा 44, 45 और 46 में उजल्लजखत सभी भिनों और जनर्मथत िातािरण पर लागू हैं, इसमें सामूजहक आिास के अंिर अस्ट्थायी अिसंरचनाए ं और सािथिजनक रूप से इस्ट्तेमाल की िाने िाली िगह ें िाजमल ह,ैं चाह े ि े केंद्र, राज्य या स्ट्थानीय सरकारों या जनिी प्रजतष्ठानों के स्ट्िाजमत्ि या जनयंत्रण में हों, िहा ं तक ऐसी िगह ें सािथिजनक भिन ह ैं अथिा िन सुजिधाएं और सेिाएं प्रिान करती ह।ैं (3) प्रकटन — सािथिजनक भिनों के माजलक, ऑपरेटर और जनयामक अपनी िेबसाइट पर और उस स्ट्थल पर सुगम्यता संबंधी जििेषताएं आसान फॉमेट में प्रिर्िथत करेंगे। (4) अनुमजत और पूणथता — स्ट्िीकृजत िेने िाले प्राजधकरण भिन के संबंध में अनुमजत और पूणथता/अजधभोग प्रमाणपत्र तभी िारी करेंगें, िब इन जनयमों का पालन दकया गया हो और दिव्ांगिनों और सुगम्यता जििेषज्ञों के प्रजतजनजध सजहत सिम प्राजधकारी द्वारा इन भिनों का सुगम्यता ऑजडट दकया गया हो। (5) प्रितथन समय-सीमा — ये मानक उन पररयोिनाओं पर तत्काल लागू होंग े िहां पूणथता प्रमाणपत्र िारी नहीं हुआ ह ै या जिन पररयोिनाओं पर अजधभोग नहीं दकया गया ह।ै (6) ििाबिेही — अजधसूचना के तीन महीने के अंिर, प्रत्येक ज़िम्मेिार प्रजतष्ठान अनुपालन सजु नजित करन े के जलए अजधकारी की जनयुजि करेंगे और इस संबंध में प्रदक्रया सुजनजित करेंगे। (7) आिजधक समीिा — केंद्र सरकार एनबीसी/आईआरसी और भारत म ें सािथभौजमक सुगम्यता के जलए सुसंगत दििा-जनिेि और स्ट्थान मानक (2021) की अद्यतन जस्ट्थजत को ििाथने के जलए हर तीन साल में इन मानकों की समीिा करेगा। 3. िये ता: भिन संबंधी ्लान को अनुमोिन िने े, पूणथता और अजधभोग प्रमाणपत्र िारी करने, या सािथिजनक भिनों और िन सुजिधाओं को जनयंजत्रत/संचाजलत करन े िाल े सभी सिम प्राजधकरणों को इन गैर- पराक्रम्य मानकों का अनुपालन सुजनजित करना होगा। इन जनयमों का अनुपालन न करने पर इस अजधजनयम और इन जनयमािजलयों के तहत कारथिाई की िाएगी। एनबीसी/आईआरसी कोड या सुसगं त दििा-जनिेिों (आिास और िहरी कायथ मंत्रालय, 2021) में संिोधन होने पर, आिश्यकतानुसार, अजधसूचना के माध्यम से अनुसचू ी को अद्यजतत दकया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 अनसु चू ी भाग क: भिन और जनमाणथ स्ट्थल (मख्ु य सगु म्य ता सबं धं ी मद्दु े) क्रम गरै -परक्राम्य मानक प्राथजमक सिं भ थ सख्ं या ए1 साइट में पैिल आने-िान े िाल े पियाजत्रयों को पहुचं की सुजिधा; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public; The objections and suggestions, which may be received from any person with respect to the said draft rules before the expiry of the period specified above, will be considered by the Central Government. DRAFT RULES 1. Short title and Commencement— (1) These rules may be called the Rights of Persons with Disabilities (Amendment) Rules on Non-Negotiable Accessibility Standards in Buildings and Built Environment, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Insertion of sub-rule in Rule 15— In the Rights of Persons with Disabilities Rules, 2017, after clause (p) of sub- rule (1) of rule 15, the following clause shall be inserted, namely: “(q) Non-negotiable Accessibility Standards for Building and Built Environment.” (A) Definitions— Unless the context otherwise requires— (a) expressions used and not defined herein but defined in the Act shall have the meanings respectively assigned to them in the Act; (b) “non-negotiable standards” mean standards coming into effect from the date of notification of these rules, non-compliance with which shall be liable to consequences as per the Act, including refusal of building permission or sanction, refusal of completion/occupation certificate, and imposition of penalties; (c) “public building” and “public facilities and services” shall have the meanings assigned to them in sections 2(w) and 2(x) of the Act; (d) “universal access” means unimpeded access for8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] people of all ages and abilities; (e) “universal design” means a design usable by all people, to the greatest extent possible, without the need for adaptation. (B) General— (1) The non-negotiable accessibility standards specified in the Schedule are derived from, and shall be read harmoniously with, the National Building Code of India (NBC) and Indian Roads Congress (IRC) codes as revised from time to time. (2) Scope and applicability.—These standards apply to all buildings and built environment referred to in sections 44, 45 and 46 of the Act, including temporary structures and publicly-used spaces within group housing, whether owned or controlled by Central, State or local governments or private establishments, insofar as such spaces are public buildings or provide public facilities and services. (3) Disclosure. — Owners, operators and regulators of public buildings shall disclose accessibility features on their websites and on site in accessible formats. (4) Permission and completion. — Sanctioning authorities shall issue building permission, and completion/occupation certificates, only upon compliance with these rules and after an accessibility audit by a competent authority with representation of persons with disabilities and accessibility experts. (5) Enforcement timeline. — These standards take immediate effect for projects where completion certificate has not been issued or projects not yet occupied. (6) Accountability. — Within three months of notification, every responsible establishment shall designate officers and processes to ensure compliance. (7) Periodic review. — The Central Government shall review these standards every three years to reflect updates to NBC/IRC and the Harmonised Guidelines and Space Standards for Universal Accessibility in India (2021). 3. Liability: All authorities competent to approve building plans, issue completion and occupation certificates, or regulate/operate public buildings and facilities shall ensure compliance with these non-negotiable standards. Non- compliance shall attract consequences under the Act and these Rules. The Schedule shall be updated, as necessary, upon revision of NBC/IRC codes or the Harmonised Guidelines (MoHUA, 2021), through notification.
