खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ परित उपधारा (1) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए जनम्नजलजखत प्रारूप अजधसूचना को िारी करने का प्रस्ट्ताव करती ह ै और तद्नुसार पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) की अपक्षे ानुसार इससे प्रभाजवत होन ेवाली िनता की िानकारी के जलए एतद्द्वारा प्रकाजित करती ह;ै और इसके द्वारा र्ह सूजचत दकर्ा िाता ह ैदक उि प्रारूप अजधसूचना उस तारीख स ेसाि दिन की अवजध की समाजि पर र्ा उसके पश्चात ्जवचार म ेंजलर्ा िाएगा, जिस तारीख से इस अजधसूचना वाल ेरािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी िाती ह;ैं मसौिा अजधसूचना म ें जनजहत प्रस्ट्तावों पर कोई आपजत्त र्ा सुझाव िेने म ें रुजच रखन े वाला कोई भी व्यजि इस े जलजखत रूप म,ें केन्द्रीर् सरकार के जवचाराथा, जनधााररत अवजध के भीतर सजचव, पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर्, इंदिरा पर्ाावरण अजधसचू ना िबदक, सतकोजसर्ा टाइगर ररिवा मध्र् ओजडिा के िो सटे हुए वन्द्र्िीव अभर्ारण्र्ों, अथाता ् सतकोजसर्ा गॉिा वन्द्र्िीव अभर्ारण्र् और बैसीपल्ली वन्द्र्िीव अभर्ारण्र् को जमलाकर बना ह ैऔर इसका क्षेत्रफल 1136.70 वगा दकलोमीटर ह।ै महानिी निी के उत्तर में जस्ट्थत बाघ अभर्ारण्र् का जहस्ट्सा अंगलु , कटक और ढेंकनाल जिलों के अधीन आता है, िबदक निी के िजक्षण म ें जस्ट्थत जहस्ट्सा बौध और नर्ागढ़ जिलों के अधीन आता ह।ै टाइगर ररिवा का क्षेत्रफल सतकोजसर्ा गॉि ा वन्द्र्िीव अभर्ारण्र् (968.35 वगा दकलोमीटर) और बैसीपल्ली वन्द्र्िीव अभर्ारण्र् (168.35 वग ादकलोमीटर) की बाहरी सीमाओं से सटा हुआ ह।ै बाघ अभर्ारण्र् भौगोजलक रूप स े 20°23′51.86″ उत्तर स े 20°47′18.38″ उत्तर अक्षांि और 84°34′03.02″ पूव ा स े 85°10′41.09″ पूवा ििे ांतर के मध्र् जस्ट्थत ह;ै और सतकोजसर्ा टाइगर ररिव ा को ओजडिा सरकार द्वारा अजधसूचना संख्र्ा 8एफ (डब्लूएल)15/2018-26865 तारीख 14 दिसंबर 2018 के द्वारा अजधसूजचत दकर्ा गर्ा था। टाइगर ररिवा में 523.61 वगा दकलोमीटर का मुख्र् क्षेत्र और 613.09 वगा दकलोमीटर का बफर क्षेत्र सजममजलत ह।ै र्ह मुख्र्तः पणापाती वनों के भीतर समृद्ध िैव जवजवधता को समेटे हुए ह ैऔर एजिर्ाई हाजथर्ों की एक बडी आबािी को आश्रर् िेती ह।ै र्ह घजडर्ाल और मगरमच्छों के जलए भी महत्वपणू ा आवास प्रिान करता ह,ै साथ ही गौर, सांभर, चार सींग वाले मगृ , भौंकने वाले जहरण, भारतीर् जविाल जगलहरी, तेंिआु और स्ट्लॉथ जबर्र सजहत वन्द्र्िीवों के जवजवध समूह का भी आवास ह।ै र्ह अभर्ारण्र् पजक्षर्ों, जततजलर्ों और िलीर् िीवों की कई िलु ाभ और लुिप्रार् प्रिाजतर्ों को भी आश्रर् िेता ह।ै महानिी निी की 22.4 दकलोमीटर लंबी घाटी अजद्वतीर् सतकोजसर्ा घाटी पाररजस्ट्थजतकी तंत्र का जनमााण करती ह,ै िो मछली, उभर्चर और क्रस्ट्टेजिर्न सजहत समृद्ध िलीर् िैव जवजवधता को बनाए रखती ह;ै और इस अभर्ारण्र् म ेंएंजिर्ोस्ट्पमा की 820 प्रिाजतर्ां, सूक्ष्म कवक की 80 प्रिाजतर्ां, लाइकेन की 25 प्रिाजतर्ां, ब्रार्ोफाइट्स की 41 प्रिाजतर्ां, फना की 44 प्रिाजतर्ां और जिम्नोस्ट्पम ा की एक प्रिाजत पाई िाती है, जिनम ेंलैजसओकोका कोमबेरी, अफानोजमजससस पॉलीस्ट्टैजचर्ा, अल्फोजन्द्सर्ा मिेरास्ट्पैटना िैसी लुिप्रार् वृक्ष प्रिाजतर्ों और नर्वाजलर्ा जललकाटा, बुलबोदफलम एसपीपी., ससंजबजडर्म बाइकोलर, डड्रें ोजबर्म एसपीपी. िैसी ऑर्काड प्रिाजतर्ों की अच्छी खासी आबािी सजममजलत ह।ै इस क्षेत्र की वनस्ट्पजत में वृक्ष प्रिाजतर्ों का एक जवजवध समूह सजममजलत है, जिसमें जडजलजनर्ा इंजडका, जडजलजनर्ा पेंटाजगना, जमिेजलर्ा चंपाका, टर्मानजलर्ा टोमटेंोसा, एनोजिसस लैरटफोजलर्ा, बैररंगटोजनर्ा एसर्ूटैंगुला, एनोजिसस एसर्ूजमनाटा, एजडना कॉर्डाफोजलर्ा, दफकस ग्लोमेराटा, लैनेर्ा कोरोमैंडेजलका, जमरागाइना पार्वाफ्लोरा, होलोलटेजलर्ा इंटीजिफोजलर्ा, लैगरस्ट्रोजमर्ा पार्वाफ्लोरा, ओउिेजनर्ा ओओिेइनेंजसस और बंबूसा बंबोस सजममजलत ह।ैं क्षेत्र से ििा की गई अन्द्र् महत्वपूण ाप्रिाजतर्ों में िोररर्ा रोबस्ट्टा, बॉमबेसस सीइबा, सीइबा पेंटेंड्रा, स्ट्राइकोनोस नसस-वोजमका, पेरोकापास मासुाजपर्म, टर्मानजलर्ा अिुान, जब्रडेजलर्ा रेटुसा, दफकस बेंघालेंजसस, दफकस ररजलजिर्ोसा, स्ट्टेरकुजलर्ा र्ूरेन्द्स, सोर्जमडा फेजब्रफुगा, श्लीचेरा ओजलर्ोसा, डालबर्गार्ा लैरटफोजलर्ा, डालबर्गार्ा जसस्ट्सू, और डड्रेंोकैलामस जस्ट्रसटस आदि, सजममजलत ह;ैं और अभर्ारण्र् म ें जवजभन्न प्रकार के स्ट्तनधारी िैस ेपथैं ेरा पाडसा (तेंिआु ), पैराडॉससुरस हमे फ्रै ोजडटस (कॉमन पाम जसवेट), एजलफस मैजससमस (एजिर्ाई हाथी), टेरासेरस क्वाजड्रकोर्नास (चार सींग वाला मृग), जहजस्ट्रसस इंजडका (भारतीर् क्रेस्ट्टेड साही), वल्ुलस बेंगालेंजसस (भारतीर्) फॉसस), रतुफा इंजडका (भारतीर् जविाल जगलहरी), लपेस जनजिकोजलस (भारतीर् खरगोि), मुंरटर्ाकस मंटिैक (बार्किंग जहरण), सस स्ट्क्रोफा (िंगली सुअर), फेजलस चौस (िंगल जबल्ली), मकाका मुलट्टा (रीसस मकाक), रुसा र्ूजनकलर (सांबर), मेलसास उर्सानस (स्ट्लॉथ जबर्र), अक्ष अक्ष (जचत्तीिार जहरण), जववेररकुला इंजडका (छोटा भारतीर् जसवेट), बोस गौरस (गौर), मोजिर्ोला इंजडका (भारतीर् माउस जहरण), और जप्रर्ोनेलरुस बेंगालेंजसस (तेंिआु जबल्ली) आदि, पाए िाते ह;ैं और इस अजधसूचना के पैरािाफ 1 में जवजनर्िाष्ट सतकोजसर्ा बाघ अभर्ारण्र् के संरजक्षत क्षत्रे के आसपास के क्षेत्र, जवस्ट्तार और सीमा को पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता की िजृ ष्ट से पाररजस्ट्थजतकी-संवेिी िोन के रूप में संरजक्षत और सुरजक्षत करना आवश्र्क ह ैतथा उि पाररजस्ट्थजतकी-संवेिी िोन में उद्योगों र्ा उद्योगों के वगा तथा उनके संचालन और प्रदक्रर्ाओं पर प्रजतबंध लगाना आवश्र्क ह;ै अतः, पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खडं (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 जनर्म (3) के साथ परित, केंर सरकार एतद्द्वारा ओजडिा राज्र् म ें सतकोजसर्ा टाइगर ररिवा की सीमा के आसपास 0 से 14.61 दकलोमीटर तक के क्षेत्र को सतकोजसर्ा टाइगर ररिवा, पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके बाि पाररजस्ट्थजतकी संवेिी िोन कहा िाएगा) के रूप म ेंअजधसूजचत करती है, जिसका जववरण जनम्नजलजखत ह:ै - 1. पाररजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार एव ं सीमाएँ: — (1) ओजडिा के सतकोजसर्ा टाइगर ररिवा की सीमा के आसपास पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार 0 दकलोमीटर से 14.61 दकलोमीटर तक के बीच ह।ै अथमजल्लक अजधसूजचत क्षेत्र पररषि म ें िहरी बस्ट्ती के कारण उत्तर-पजश्चम दििा की ओर िून्द्र् दकलोमीटर का जवस्ट्तार ह,ै िो क्षेत्र की आिीजवका और जवकासात्मक दक्रर्ाकलापों को ध्र्ान म ेंरखत ेहुए दकर्ा गर्ा ह।ै पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 548.725 वग ा दकलोमीटर ह।ै जवजभन्न दििाओं म ें पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार नीच े िी गई सारणी में दिर्ा गर्ा ह:ै उत्तर 1 दकलोमीटर उत्तर-पूव ा 1 दकलोमीटर पूवा 1 दकलोमीटर िजक्षण-पूव ा 1 दकलोमीटर िजक्षण 1 दकलोमीटर िजक्षण-पजश्चम 1 दकलोमीटर पजश्चम 1 दकलोमीटर उत्तर-पजश्चम िीपीएस स्ट्थान उ 20º 45’ 03.421” प ू 84º 34’ 39.071” पर 0 दकलोमीटर से िुरू होकर िीपीएस स्ट्थान उ 20º 45’ 33.867” प ू 84º 34’ 15.302 तक िारी ह।ै उत्तर-पजश्चम 14.6 दकलोमीटर (इसमें तलेपाथर आरएफ, नुगाँव आरएफ और पुरुनापानी डीपीएफ सजममजलत ह ैंऔर र्ह नुगाँव-बरुनेई जचजननत हाथी गजलर्ारे की बाहरी सीमा को छूता ह,ै िो बिले में महानिी और संबलपरु हाथी अभर्ारण्र्ों को िोडता ह)ै (2) पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण अनलु ग्नक-I पर संलग्न ह।ै (3) पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र और सीमा जववरण अनलु ग्नक-IIक, अनलु ग्नक-IIख और अनलु ग्नक-IIग पर सलं ग्न ह।ैं (4) सरं जक्षत क्षेत्र और उसके पाररजस्ट्थजतकी संवेिी िोन के भौगोजलक जनिेिांक अनलु ग्नक-III म ेंदिए गए ह।ैं (5) पाररजस्ट्थजतकी संवेिी िोन के अधीन आने वाल े 205 गांवों की सूची अनलु ग्नक-IV पर सलं ग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसचू ना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए उपबधं ों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसचू ना के उपबंधों के अनुसार तथा केंरीर् और राज्र् जवधानों के सुसंगत और केंरीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, अनरुु प तैर्ार की िाएगी। (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार की िाएगी तादक पाररजस्ट्थजतकी और पर्ाावरणीर् िजृ ष्टकोणों को एकीकृत दकर्ा िा सके.- i. पर्ाावरण; ii. वन; iii. आवास और िहरी जवकास;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iv. पंचार्ती राि और िामीण जवकास; v. ऊिाा; vi. पर्ाटन; vii. रािस्ट्व और आपिा प्रबंधन; viii. कृजष और दकसान सिजिकरण; ix. ओजडिा राज्र् प्रिषू ण जनर्त्रं ण बोडा; x. अनुसूजचत िनिाजत एवं अनसु ूजचत िाजत जवकास, अल्पसंख्र्क एवं जपछडे वगा कल्र्ाण; xi. कौिल जवकास एवं तकनीकी जिक्षा; xii. उद्योग, सूक्ष्म, लघ ु एवं मध्र्म उद्यम; xiii. ससंचाई; xiv. नगरपाजलका; और xv. लोक जनमााण एवं रािमाग।ा (4) आंचजलक महार्ोिना म ेंअनुमोदित भ-ू उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह ें अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, वनों की कटाई से प्रभाजवत क्षेत्रों के पुनास्ट्थापन, जवद्यमान िल जनकार्ों के संरक्षण, िलिहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलुओं का उपाबंध दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ेंसभी जवद्यमान पूिा स्ट् थलों, िामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ उपलब्ध करवार्ा िाएगा, जिनम ेंजवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेषताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी-संवेिी िोन के जवकास को जवजनर्जमत दकर्ा िार्ेगा और पैरा 4 म ें सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनपु ालन दकर्ा िाएगा और स्ट् थानीर् समिु ार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसका संवधना दकर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसचू ना के उपबंधों के अनुसरण म ें जनगरानी कार्ों को परू ा करने के जलए जनगरानी सजमजत के जलए संिभ ा िस्ट्तावेि होगा। 3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात:् - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का मुख्र् वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा पररवतना की अनुमजत नहीं होगी: बिते दक जनगरानी सजमजत की जसफाररि पर केंर तथा राज्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एव ं जवजनर्मों र्था लागू, के अधीन तथा इस अजधसूचना के उपबंधों के पूव ाअनुमोिन स ेपाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजष और अन्द्र् भूजम के गैर कृजष उपर्ोग के रुपान्द्तरण को स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्रर्ाकलापों को पूरा करने के जलए अनुमजत िी गई ह,ै िैस,े - (i) जवद्यमान सडकों को चौडा और मिबूत करना और नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (iii) प्रिषू ण न उत्पन्न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग सजहत िाम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैरािाफ-4 के मि में र्था उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः बिते दक र्ह भी दक राज्र् सरकार के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 र्ा अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ेंलागू जवजधर्ों के उपबंधों के अनुपालन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के दकसी भी उपर्ोग की अनुमजत नहीं िी िाएगी: बिते दक र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: बिते दक र्ह भी दक उपर्ुाि त्रुरट को सुधारने म,ें इस उप-पैरा म ेंर्था उपबंजधत के जसवार्, दकसी भी ििा म ेंभू-उपर्ोग का पररवतान सजममजलत नहीं होगा: (ख ) अनुप्रर्िु र्ा अनुत्प ािक कृजष क्षेत्रों म ेंवनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स ेपुन: वनीकरण दकए िाने के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल जनकार्.— सभी प्राकृजतक झरनों/नदिर्ों/नहरों के िलिहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पनु रुद्धार की र्ोिनाओं को आंचजलक महार्ोिना म ेंसजममजलत दकर्ा िाएगा तथा राज्र् सरकार द्वारा िारी मागाििाक जसद्धांत तैर्ार दकए िाएंग े िो इन क्षेत्रों म ें र्ा इनके जनकट ऐसी जवकास दक्रर्ाकलापों पर रोक लगाई िा सके िो इन क्षेत्रों के जलए हाजनकारक हों। (3) पर्टा न र्ा पारर-पर्टा न – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पारर-पर्टा न दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन सबं ंधी पर्ाटन महार्ोिना के अनसु ार होगा। (ख) पर्ाावरण और वन जवभाग के परामि ा से राज्र् पर्ाटन जवभाग द्वारा पर्ाावरण-पर्ाटन आंचजलक महार्ोिना तैर्ार की िाएगी; (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी; (ङ) पारर-पर्ाटन संबंधी दक्रर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंगे, अथाात:् - (i) संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकट हो, होटलों और ररसॉट्सा का नर्ा जनमााण करने की अनुमजत नहीं होगी: बिते दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरू ी से परे, पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटल और ररसॉटा की स्ट्थापना केवल पर्ाटन आंचजलक महार्ोिना के अनुसार पर्ाावरण पर्ाटन सुजवधाओं के जलए पूवाजनधााररत और जवजनर्िाष्ट क्षेत्रों म ेंही अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन दक्रर्ाकलापों र्ा मौिूिा पर्ाटन दक्रर्ाकलापों का जवस्ट्तार केंर सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धातं ों और राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरणों द्वारा िारी पाररजस्ट्थजतकी पर्ाटन मागाििका जसद्धांतों (समर्-समर् पर संिोजधत) के अनुसार होगा; जिसमें पर्ाावरण-पर्ाटन पर जविेष िोर दिर्ा िाएगा। (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ाटन के जवकास और जवद्यमान6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों के द्वारा स्ट्थल जवजिष्ट संवीक्षा और जनगरानी सजमजतर्ों की जसफाररि के आधार पर िी िाएगी और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी नए होटल, ररसॉटा र्ा वाजणजज्र्क प्रजतष्ठान के जनमााण की अनुमजत नहीं िी िाएगी। (4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अधीन आन ेवाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररज़व ा क्षत्रे , िलै सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल - पाररजस्ट्थजतकी संवेिी िोन म ें ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ा और सांस्ट्कृजतक महत्व के भवनों, सरं चनाओं, कलाकृजतर्ों, क्षेत्रों और पररसरों की पहचान की िाएगी और उनके सरं क्षण के जलए जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रूप म ेंतैर्ार की िाएगी। (6) ध्व जन प्रिषू ण –पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और समर्-समर् पर संिोजधत उपबंधों के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के अनुसार दकर्ा िाएगा। (7) वार् ुप्रिषू ण - पाररजस्ट्थजतकी सवं ेिी िोन म ेंवार् ुप्रिषू ण की रोकथाम और जनर्ंत्रण वार् ु(प्रिषू ण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्म और उसके संिोधनों के अनुसार की िाएगी। (8) बजहस्राव का जनस्ट्सरण - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत अपजिष्ट िल का जनवाहन िल (प्रिषू ण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6), पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अंतगात जनर्मात जनर्मों र्ा राज्र् सरकार द्वारा जनधााररत मानकों, िो भी अजधक सख्त हो, के उपाबंधों के अनसु ार होगा। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा, - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट जनपटान एवं प्रबंधन भारत सरकार के पर्ाावरण, वन एवं िलवार्ु पररवतना मंत्रालर् द्वारा अजधसूचना संख्र्ा का.आ. 1357 (अ), तारीख 8 अप्रलै , 2016 के माध्र्म से प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिसमें समर्-समर् पर संिोधन दकए गए ह;ैं अकाबाजनक पिाथों का जनपटान पर्ाावरण के अनकु ूल तरीके स े पाररजस्ट्थजतकी सवं ेिी िोन के बाहर जवजनर्िाष्ट स्ट्थल पर दकर्ा िा सकता ह।ै (ख) पर्ाावरण संवेिनिील क्षेत्र म ें जचजन्द्हत प्रौद्योजगदकर्ों का उपर्ोग करते हुए, मौिूिा जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्टों का सुरजक्षत और पर्ाावरण के अनुकूल प्रबंधन (ईएसएम) करने की अनुमजत िी िा सकती ह।ै (10) िवै जचदकत्सा अपजिष्ट- िैवजचदकत्सा अपजिष्ट प्रबंधन जनम्नानसु ार होगा- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की समर्-समर् पर संिोजधत अजधसूचना सं. सा.का.जन. 343(अ), तारीख 28 माच,ा 2016 के अधीन प्रकाजित िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में जवजनर्िाष्ट प्रौद्योजगदकर्ों का उपर्ोग करत े हुए, मौिूिा जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्टों का सुरजक्षत और पर्ाावरण के अनुकूल प्रबंधन (ईएसएम) करने की अनुमजत िी िा सकती ह।ै (11) ललाजस्ट्टक अपजिष्ट का प्रबधं न -पाररजस्ट्थजतकी संवेिी िोन म ें ललाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर संिोजधत; अजधसूचना सं. सा.का.जन. 340(अ), तारीख 18 माचा, 2016 के अधीन प्रकाजित ललाजस्ट्टक अपजिष्ट का प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संविे ी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर संिोजधत अजधसूचना सं. सा.का.जन. 317(अ), तारीख 29 माचा, 2016 के अधीन प्रकाजित जनमाणा और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म,2016 , समर्-समर् पर संिोजधत; के उपबंधों के अनुसार दकर्ा िाएगा। (14) सडक-र्ातार्ात - सडक-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध सजममजलत दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण - वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लाग ूजवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईधनों िैसे संपीजडत प्राकृजतक गैस, रवीकृत पेरोजलर्म गैस, आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा-ं (क) आजधकाररक रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात ् पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिषू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी; (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 में िारी जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै -प्रिषू णकारी उद्योगों को अनुमत दकर्ा िाएगा और इसके अजतररि, गरै प्रिषू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण - पहाडी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना में पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ेंअत्र्जधक भ-ू क्षरण होता ह ैउनम ेंदकसी भी जनमााण की अनुज्ञा नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंप्रजतजषद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचू ी - पाररजस्ट्थजतकी-संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) और उसके अधीन जनर्मात जनर्मों तथा पर्ाावरण, वन और वन्द्र्िीवों से संबंजधत भारत सरकार की अन्द्र् अजधसूचनाओं, जवजधर्ों और अजधजनर्मों द्वारा िाजसत होंगी, िो पूवावती पर्ाावरण एवं वन मंत्रालर् द्वारा क्रमांक 1533(अ), तारीख 14 जसतंबर, 2006 को िारी की गई थीं, तथा समर्- समर् पर लागू जवजधर्ों द्वारा, िैसा दक नीचे िी गई सारणी म ेंजवजनर्िाष्ट ह,ै अथाात:् - सारणी क्रम स.ं दक्रर्ाकलाप रटलपणीर्ा ं (1) (2) (3) क. प्रजतजषद्ध दक्रर्ाकलाप 1. वाज णजज्र्क खनन, वाजणजज्र्क (क) पाररजस्ट्थजतकी-संवेिी ज़ोन के जवद्यमान (लघु और प्रमुख खजनि), पत्थर उत्खनन और उनकी क्रसिंग की इकाइर्ों को तत्काल प्रभाव से प्रजतजषद्ध दकर्ा िाता ह।ै (ख) खनन कार्ा माननीर् उच्चतम न्द्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के आिेि टी.एन. ज़ोन म ें नए प्रिषू णकारी उद्योगों की स्ट्थापना आदि) उत्पन्न करने वाल े उद्योगों और जवद्यमान प्रिषू णकारी उद्योगों के जवस्ट्तार की अनुमजत नहीं िी की स्ट्थापना । िाएगी। जवद्यमान उद्योगों को प्रिषू ण जनवारण तकनीक और ध्वजन अवरोधक लगाने होंगे। 3. प्रम ुख नई िलजवद्युत प्रजतजषद्ध। पररर्ोिनाओं और ससचं ाई पररर्ोिनाओं की स्ट्थापना। 4. दक सी पररसंकटमर् पिाथा का प्रजतजषद्ध। प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । 5. प्राक ृजतक िल जनकार्ों र्ा भूजम प्रजतजषद्ध। क्षेत्र में अनुपचाररत अपजिष्टों का जनवाहन। 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी-संवेिी िोन के भीतर नई र्ा जवद्यमान आरा जमलों का जवस्ट्तार की अनुज्ञा नहीं होगी। 7. ईंट भट्टों की स्ट्थापना। प्रजतजषद्ध। 8. िल ावन लकडी का वाजणजज्र्क प्रजतजषद्ध। उपर्ोग। 9. पॉल ीजथन बगै का उपर्ोग। लाग ूजवजधर्ों के अधीन (अन्द्र् उपाबंधों को छोडकर) एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, इनम ेंिो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ू मागाििाक जसद्धांतों के अनुरूप होगा ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 11. संज नमााण दक्रर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार उप-परै ा (1) में उजल्लजखत दक्रर्ाकलापों सजहत स्ट्थानीर् लोगों को उनके उपर्ोग के जलए अपनी भूजम पर संजनमााण करन े की अनुज्ञा िी िाएगी, इसका उपर्ोग आजतथ्र् सरकार संर्ोिनों (होटलों, होमस्ट्टे तथा ररिॉटा )के दकए नहीं दकर्ा िाना चाजहए: बित े दक, गरै प्रिषू णकारी लघ ु उद्योगों स े संबंजधत संजनमााण दक्रर्ाकलाप लाग ू जनर्मों और जवजनर्मों र्दि कोई हो, के अनुसार सक्षम प्राजधकारी की पूवा अनज्ञु ा से जवजनर्जमत दकए िाएंगे और व े न्द्र्ूनतम होंगे। (ख)एक दकलो मीटर के परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे। 12. गैर प्रिषू णकारी लघ ु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण के अनुसार गरै -प्रिषू णकारी उद्योग और अपररसंकटमर्, लघ ुऔर सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन की अपनी सामिी से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुमत होंगे। 13. वृक्ष ों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई समबद्ध केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगें। 14. वन उत्पािों और गैर काष्ठ वन लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। उत्पािों (एनटीएफपी) का संिहण । 15. जवद्य ुत और संचार टॉवर लगाने, लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबछाने को तार-जबछान े तथा अन्द्र् बुजनर्ािी बढ़ावा दिर्ा िा सकेगा) ढांचे की व्यवस्ट्था । 16. नाग ररक सुजवधाओं सजहत लाग ू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागाििाक बुजनर्ािी ढांचा। जसद्धांतों के अनुसार िमन उपार्ों के साथ दकर्ा िाएगा 17. जवद्य मान सडकों को चौडा करना, लाग ू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध माग ा ििाक उन्द्ह ेंपक्का बनाना । जसद्धांतों के अधीन िमन उपार् दकए िाएंगे। 18. पर् ाटन से संबंजधत अन्द्र् लाग ूजवजधर्ों के िल कृजष और मत् स्ट्र् पालन । 22. फम ों, कंपजनर्ों, कॉरपोरेट्स द्वारा स्ट्थानीर् आवश्र्कताओं को पूरा करन े के अलावा, लाग ू जवजधर्ों के बडे पैमाने पर वाजणजज्र्क पिधु न अधीन जवजनर्जमत होगा। और कुसकुट sub-section (2) and subsection (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the Tiger Reserve comprises two adjoining wildlife sanctuaries of central Odisha, namely Satkosia Gorge Wildlife Sanctuary and Baisipalli Wildlife Sanctuary, and covers an area of 1136.70 square kilometre. The portion of the Tiger Reserve located north of the Mahanadi River falls within Angul, Cuttack, and Dhenkanal districts, while the portion south of the river lies within Boudh and Nayagarh districts. The area of the Tiger Reserve is coterminous with the outer boundaries of Satkosia Gorge Wildlife Sanctuary (968.35 square kilometre) and Baisipalli Wildlife Sanctuary (168.35 square kilometre). The Tiger Reserve is geographically located between 20°23′51.86″ N to 20°47′18.38″ N latitude and 84°34′03.02″ E to 85°10′41.09″ E longitude; AND WHEREAS the Satkosia Tiger Reserve was notified vide Notification No. 8F(WL)15/2018-26865 dated the 14th December 2018 by the Government of Odisha. The Tiger32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Reserve comprises a core area of 523.61 square kilometre and a buffer area of 613.09 square kilometre. It harbours rich biodiversity within predominantly deciduous forests and supports a significant population of Asian Elephant. It also provides important habitat for Gharial and Mugger Crocodile, along with a diverse assemblage of wildlife including Gaur, Sambar, Four-horned Antelope, Barking Deer, Indian Giant Squirrel, Leopard, and Sloth Bear. The Reserve also supports several rare and endangered species of birds, butterflies, and aquatic fauna. A 22.4 kilometre stretch of the Mahanadi River gorge forms the unique Satkosia Gorge ecosystem, which sustains rich aquatic biodiversity including fish, amphibians, and crustaceans; AND WHEREAS the sanctuary harbors 820 species of angiosperms, 80 species micro fungi, 25 species of Lichens, 41 species of Bryophytes, 44 species of Ferns and one species of Gymnosperm including good population of threatened tree species like Lasiococca comberii, Aphanomyxis polystachya, Alphonsea maderaspatna, orchids like Nervilia plicata, Bulbophyllum spp., Cymbidium bicolor, Dendrobium spp. The vegetation of the area comprises a diverse assemblage of tree species including Dillenia indica, Dillenia pentagyna, Michelia champaca, Terminalia tomentosa, Anogeissus latifolia, Barringtonia acutangula, Anogeissus acuminata, Adina cordifolia, Ficus glomerata, Lannea coromandelica, Mitragyna parviflora, Holoptelea integrifolia, Lagerstroemia parviflora, Ougeinia oojeinensis, and Bambusa bambos. Other important species recorded from the area include Shorea robusta, Bombax ceiba, Ceiba pentandra, Strychnos nux-vomica, Pterocarpus marsupium, Terminalia arjuna, Bridelia retusa, Ficus benghalensis, Ficus religiosa, Sterculia urens, Soymida febrifuga, Schleichera oleosa, Dalbergia latifolia, Dalbergia sissoo, and Dendrocalamus strictus etc.; AND WHEREAS different types of mammals are found in the sanctuary such as Panthera pardus (Leopard), Paradoxurus hermaphroditus (Common Palm Civet), Elephas maximus (Asian Elephant), Tetracerus quadricornis (Four-horned Antelope), Hystrix indica (Indian Crested Porcupine), Vulpes bengalensis (Indian Fox), Ratufa indica (Indian Giant Squirrel), Lepus nigricollis (Indian Hare), Muntiacus muntjak (Barking Deer), Sus scrofa (Wild Pig), Felis chaus (Jungle Cat), Macaca mulatta (Rhesus Macaque), Rusa unicolor (Sambar), Melursus ursinus (Sloth Bear), Axis axis (Spotted Deer), Viverricula indica (Small Indian Civet), Bos gaurus (Gaur), Moschiola indica (Indian Mouse Deer), and Prionailurus bengalensis (Leopard Cat) etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the protected area of Satkosia Tiger Reserve as Eco- sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of Rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent of 0 to 14.61 kilometre around the boundary of Satkosia Tiger Reserve in the State of Odisha as the Satkosia Tiger Reserve, Eco-sensitive Zone (herein after referred to as the Eco- sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. — (1) the extent of Eco-Sensitive Zone varies from 0 kilometre to 14.61 kilometre around the boundary of Satkosia Tiger Reserve, Odisha. Zero- kilometre extent towards north-west direction is due to urban settlement at Athmallik Notified Area Council, keeping in view of the livelihood and developmental activities of the area. The area of Eco- sensitive Zone is 548.725 square kilometre. (3) The maps of the Eco-Sensitive Zone along with boundary details are appended as Annexure-II A, Annexure-II B and Annexure- II C. (4) The geo-coordinates of the protected area and its Eco-sensitive Zone are given in Annexure-III. (5) The list of 205 villages falling within the Eco-sensitive Zone is appended as Annexure-IV. 2. Zonal Master Plan for Eco-Sensitive Zone.— (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: i. Environment; ii. Forest; iii. Housing and Urban Development; iv. Panchayati Raj and Rural Development; v. Energy; vi. Tourism; vii. Revenue and Disaster Management; viii. Agriculture and Farmers Empowerment; ix. Odisha State Pollution Control Board; x. ST & SC Development, Minorities & Backward Classes Welfare; xi. Skill Development & Technical Education; xii. Industries, Micro, Small & Medium Enterprises; xiii. Irrigation; xiv. Municipality; and xv. Public Works and Highways. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.— The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use.— (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities given under paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 35 (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.— The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.— a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; b) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests; c) the Tourism Master Plan shall form a component of the Zonal Master Plan; d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site-specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco- Sensitive Zone area. (4) Natural heritage.— All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.— Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and as amended from time to time. (7) Air pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents.— Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) Solid wastes.— Disposal and Management of solid wastes shall be as under: - a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste.— Bio medical waste management shall be as under: a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time. b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management.— The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.— The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.— The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic.— The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.— Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial units.— a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016 as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.— The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 37 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.— All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under and other notifications, laws and Acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely TABLE S. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-V, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
