1. (i) इन जनयमों को नई औषध और नैिाजनक परीक्षण (.... संिोधन) जनयमावली, 2026 कहा िा सकता ह।ै
(ii) ये जनयम सरकारी रािपत्र म ें जनयमों के अंजतम प्रकािन के समय सरकार द्वारा जनर्िडष्ट तारीख स े प्रवृत्त होंगे।
2. नई औषध और नैिाजनक परीक्षण जनयमावली, 2019 (जिसे इसम ेंआग े उि जनयम कहा गया ह)ै म,ें जनयम 31 म,ें ― i. उप-जनयम (2) म,ें परंतुक के अंतगडत, िब्ि और कोष्ठक “(केवल जनयाडत उद्देश्य के जलए)” को लोप कर दिया िाएगा।
3. उि जनयमों म,ें जनयम 34 के उप-जनयम (1) म,ें “प्रारूप सीिी-05” िब्ि के पश्चात, िब्ि, अंक और कोष्ठक “जनयम 31 के उप-जनयम (2) के परंतुक म ेंजनर्िडष्ट पूव ड सूचना के मामलों को छोड़कर” अंतःस्ट्थाजपत दकए िाएगं े।
4. उि जनयमों म,ें जनयम 35 म,ें i. “जनयम 34” िब्ि के पश्चात, िब्ि, अंक और कोष्ठक “या जनयम 31 के उप-जनयम (2) के परंतुक के अंतगडत पूवड सूचना की पावती या जनयम 34 के उप-जनयम (2क) के अंतगडत सम्यक अनुमोिन, िैसा भी मामला हो” अंतःस्ट्थाजपत दकए िाएगं े। ii. उि जनयमों म,ें जनयम 35 म,ें खंड (xiii) को हिा दिया िाएगा।
5. उि जनयमों म,ें जनयम 36 के उप-जनयम (1) म,ें “प्रारूप सीिी-07” िब्ि के पश्चात, िब्ि, अंक और कोष्ठक “या जनयम 31 के उप-जनयम (2) के परंतुक के अतं गतड पूव ड सूचना की पावती या जनयम 34 के उप-जनयम (2क) के अतं गतड सम्यक अनुमोिन” अंतःस्ट्थाजपत दकए िाएंगे। [फा. स.ं X.11014/09/2026-डीआर] पुष्पेंद्र रािपतू , संयुि सजचव नोि: नई औषध और निै ाजनक परीक्षण जनयमावली, 2019 को सरकारी रािपत्र में अजधसूचना संख्या फा.सं.

NOTIFICATION New Delhi, the 3rd September, 2026 G.S.R. 790(E).— The following draft of certain rules further to amend New Drugs and Clinical Trials Rules, 2019, which the Central Government proposes to make, in exercise of the powers conferred by sub-section (1) of section 12 and sub-section (1) of section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), with consideration that consultation with Drugs Technical Advisory Board, shall be held as per the provisions, is hereby published for information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of thirty days from the date on which the copies of the Gazette of India containing these draft rules are made available to the public.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 Objections and suggestions which may be received from any person within the period specified above will be considered by the Central Government.
Objections and suggestions, if any, may be addressed to the Under Secretary (Drugs), Ministry of Health and Family Welfare, Government of India, U-6, Work Hall- C Wing, First Floor, Kartavya Bhawan-1, New Delhi, 110001 or emailed at drugsdiv-mohfw@gov.in.
DRAFT RULES
1. (i) These rules may be called the New Drugs and Clinical Trials (.... Amendment) Rules, 2026.
(ii) These rules shall come into force from the date as specified by the Government at the time of final publication of the rules in the Official Gazette.
2. In the New Drugs and Clinical Trials Rules, 2019 (hereinafter referred to as the said rules), in rule 31, ― i. in sub-rule (2), under the proviso, the words and brackets “(for export purpose only)” shall be omitted.
3. In the said rules, in sub-rule (1) of rule 34, after the word “Form CT-05”, the words, figures and brackets “excluding the cases of prior intimation referred to in the proviso of sub-rule (2) of Rule 31” shall be inserted.
4. In the said rules, in rule 35, i. after the word “rule 34”, the words, figures and brackets “or the acknowledgement of prior intimation under the proviso of sub-rule (2) of rule 31 or deemed approval, under the sub-rule (2A) of Rule 34, as the case may be” shall be inserted.
ii. In the said rules, in rule 35, clause (xiii) shall be deleted.
5. In the said rules, in sub-rule (1) of rule 36, after the word “Form CT-07”, the words, figures and brackets “or the acknowledgement of prior intimation under the proviso of sub-rule (2) of rule 31 or deemed approval, under the sub-rule (2A) of Rule 34” shall be inserted.
