और धारा 137 (cid:29)ारा (cid:24)द(cid:30) त शि तय(cid:26) का (cid:24)योग करत े #ए, उ त अिधिनयम क(cid:27) धारा 212 क(cid:27) उपधारा (1) (cid:29)ारा यथा
अपेि(त, उन सभी * यि तय(cid:26) क(cid:27) जानकारी के िलए (cid:24)कािशत करती ह,ै िजनके उससे (cid:24)भािवत होन े क(cid:27) संभावना ह ै; और यह
सूचना दी जाती ह ै (cid:4)क उ त (cid:24)ा(cid:25)प िनयम(cid:26) पर उस तारीख स,े िजसको राजप2 म(cid:10) यथा(cid:24)कािशत उस अिधसूचना क(cid:27) (cid:24)ितया ं

1. (1) इन िनयम(cid:26) का संि(5 त नाम क(cid:10)(cid:11)ीय मोटर यान (....... संशोधन) िनयम, 2014 ह ै।
(2) य े िनयम राजप2 म (cid:10) अंितम (cid:24)काशन क(cid:27) तारीख को (cid:24)वृ(cid:30)त ह(cid:26)गे ।
2. क(cid:10)(cid:11)ीय मोटर यान िनयम, 1989 (िजसे इसम(cid:10) इसके पDच ात् उक्त िनयम कहा गया ह)ै म,(cid:10) िनयम 2 के
उपिनयम (गक) के पD चात्, िन(cid:20) निलिखत उपिनयम अंत:Eथ ािपत (cid:4)कया जाएगा, अथा?त ्:-
'(गख) "ई-=र शा" स े तीन पिहये वाला िवशेष (cid:24)योजन बैटरी (cid:24)चािलत यान अिभ(cid:24)ेत ह ै और िजससे सवा=रय(cid:26)
को भाड़े या पा=रGिमक पर ढ़ोने हते ु अंितम छोर तक प#चं ान ेका (cid:24)बंध करना आशियत ह,ै परंतु,—
(i) ऐसा यान चार से अनिधक सवा=रय(cid:26), िजसम(cid:10) चालक सि(cid:20)म िलत नहK ह,ै और कुल चालीस (cid:4)कलोLाम स े
अनिधक सामान को ल े जाने के िलए िनMमत या अनुकूिलत ह ै;
(ii) इसक(cid:27) मोटर क(cid:27) शि त 2000 वॉट से अिधक नहK ह ै;

(iii) यान क(cid:27) अिधकतम गित पO चीस (cid:4)कलो मीटर (cid:24)ित घंटे से अिधक नहK ह ै ।'।
3. उ त िनयम के िनयम 16 म,(cid:10) उपिनयम (5) के पDच ात,् िन(cid:20)न िलिखत उपिनयम अंत:Eथ ािपत (cid:4)कया जाएगा,
अथा?त ्:—
"(6) ई-=र शा चलान े के िलए अनुQि5त (cid:24)ािधकारी (cid:29)ारा जारी या नवीकृत (cid:24)(cid:30)य ेक चालन अनQु ि5त ,
यथािE थित, जारी (cid:4)कए जान े क(cid:27) तारीख स े तीन वष? स े अनिधक अविध या चालन अनुQि5त के िविधमाRय रहने
तक, जो भी पूव?तर हो, वैध रहगे ी ।"।
4. उ त िनयम के िनयम 50 म,(cid:10) उपिनयम (1) के खंड (vi) क(cid:27) सारणी म,(cid:10) "दपु िहया, ितपिहया और चौपिहया
साइ(cid:4)कल" श3द (cid:26) के E थान पर, "दपु िहया, ितपिहया, चौपिहया साइ(cid:4)कल और ई-=र श ा" श3द रखे जाएंग े ।
5. उ त िनयम के िनयम 51 क(cid:27) सारणी म,(cid:10) Uम स.ं 5 के सामने क(cid:27) (cid:24)िविBट के Eत भं 2 म,(cid:10) अंत म(cid:10) आन े वाल े "500
सीसी " श3 द(cid:26) के पD चात्, "और ई-=र शा" श3 द अंत:Eथ ािपत (cid:4)कए जाएंगे ।
6. उ त िनयम के िनयम 56 के उपिनयम (2) म,(cid:10)—
(i) खडं (ग) के अंत म(cid:10) आन े वाल े"और" श3द का लोप (cid:4)कया जाएगा ;
(ii) खंड (घ) म,(cid:10) "बीमा (cid:24)माणप2" श3द (cid:26) के Eथ ान पर, "बीमा (cid:24)माणप2 ; और" श3द रखे जाएंगे ;
(iii) खंड (घ) के पD चात,् िन(cid:20) निलिखत खडं अंत:Eथ ािपत (cid:4)कया जाएगा, अथा?त ्:-
"(ङ) ई-=र शा के मामले म (cid:10) चालन अनQु ि5त और परिमट ।"।
7. उ त िनयम के िनयम 57 के उपिनयम (1) म,(cid:10)—
(i) खडं (ग) के अंत म(cid:10) आन े वाल े"और" श3द का लोप (cid:4)कया जाएगा ;
(ii) खंड (घ) म,(cid:10) "(cid:24)मािणत (cid:24)ित" श3द (cid:26) के Eथ ान पर, "(cid:24)मािणत (cid:24)ित ; और" श3द रखे जाएगं े ;

8. उ त िनयम के िनयम 62 के उपिनयम (1) म,(cid:10)—
(i) सारणी म,(cid:10) मद (ख) और उससे संबंिधत (cid:24)िविBट य(cid:26) के पDच ात्, िन(cid:20)न िलिखत मद और (cid:24)िविBट अंत:Eथ ािपत क(cid:27)
जाएगी, अथा?त ्:—
"(खक) ई-=र शा के संबंध म(cid:10) ठीक हालत म(cid:10) होन े के (cid:24)माणप2 का नवीकरण तीन वष?।"।

9. उ त िनयम के िनयम 93 म,(cid:10)—
(क) उपिनयम (1) म,(cid:10) परंतुक के पDच ात् और Eप Bट ीकरण से पहले, िन(cid:20)न िलिखत परंतुक अंत:Eथ ािपत (cid:4)कया
जाएगा, अथात? ् :—
"परंत ु यह और (cid:4)क ई-=र शा क(cid:27) समL चौड़ाई 1.0 मीटर से अिधक नहK होगी ।"।
(ख) उपिनयम (2) म,(cid:10) खंड (vii) के पDच ात,् िन(cid:20)न िलिखत खडं अंत:Eथ ािपत (cid:4)कया जाएगा, अथा?त् :—
"(viii) ई-=र शा के मामल े म,(cid:10) 2.6 मीटर से अिधक नहK होगी ।"।
(ग) उपिनयम (4) म,(cid:10) खंड (iv) के पDच ात्, िन(cid:20)न िलिखत खंड अंत:Eथ ािपत (cid:4)कया जाएगा, अथा?त् :—
"(v) ई-=र शा के मामले म,(cid:10) 1.8 मीटर से अिधक नहK होगी ।"।
10. उ त िनयम के िनयम 94 म,(cid:10) उपिनयम (3) के खडं (iv) म,(cid:10) "दपु िहया, ितपिहया और चौपिहया साइ(cid:4)कल" श3द (cid:26)
के E थान पर, "दपु िहया, ितपिहया, चौपिहया साइ(cid:4)कल और ई-=र श ा" श3द रखे जाएगं े ।
11. उ त िनयम के िनयम 95 म,(cid:10) उपिनयम (1) के पहल े परंतुक म,(cid:10) "दपु िहया, ितपिहया और चौपिहया साइ(cid:4)कल
क(cid:27) दशा म"(cid:10) श3 द(cid:26) के Eथ ान पर, "दपु िहया, ितपिहया, चौपिहया साइ(cid:4)कल और ई-=र श ा क(cid:27) दशा म"(cid:10) श3द रख े जाएंगे ।
12. उ त िनयम के िनयम 96 म,(cid:10) उपिनयम (4) म,(cid:10)—
(क) खंड (i) म,(cid:10) "दपु िहया और ितपिहया" श3द (cid:26) के Eथ ान पर, "दपु िहया, ितपिहया और ई-=र श ा" श3द रख े
जाएंगे ।
(ख) खंड (ii) म,(cid:10) "सभी मोटर यान(cid:26)" श3द (cid:26) के Eथ ान पर, "सभी मोटर यान(cid:26), िजनम (cid:10) ई-=र श ा भी ह,ै" श3द रख े
जाएंगे ।
13. उ त िनयम के िनयम 117 के उपिनयम (1) म,(cid:10) "िबगड़ी #ई गाड़ी से िभW (cid:24)(cid:30)य के मोटर यान (िनमा?ण यान
उपE कर सिहत) या (cid:4)कसी यान, िजसक(cid:27) अिभकि(cid:6)प त गित (cid:24)ित घंटे तीस (cid:4)कलोमीटर से अिधक नहK ह"ै श3द (cid:26) के सथ ् ान पर,
"अवैध गाड़ी से िभW (cid:24)(cid:30) यके मोटर यान (िनमा?ण यान उपEक र सिहत) या ई-=र श ा या (cid:4)कसी यान," श3द रख े जाएंगे ।
14. उ त िनयम के िनयम 119 के उपिनयम (1) म,(cid:10) दसू रे परंतकु के पDच ात्, िन(cid:20)न िलिखत परंतुक अतं :Eथ ािपत
(cid:4)कया जाएगा, अथा?त ्:—
"परंत ु यह और (cid:4)क क(cid:10)(cid:11)ीय मोटर यान (.......... संशोधन) िनयम, 2014 के अंितम (cid:24)काशन क(cid:27) तारीख से ही, इस
िनयम के अधीन अपे(ाए ं (cid:24)(cid:30) यके ई-=र शा को लाग ू ह(cid:26)गी ।"।
15. उ त िनयम के िनयम 122 के उपिनयम (1) म,(cid:10)—
(क) परंतुक म,(cid:10) "एन वग ? के यान और मालवाहक चौपिहया साइ(cid:4)कल" अ(र और श3द (cid:26) के Eथ ान पर, "एन वग ? के
यान, मालवाहक चौपिहया साइ(cid:4)कल और ई-=र श ा" अ(र और श3द रखे जाएंग े;
(ख) दसू रे परंतुक के पD चात,् िन(cid:20)न िलिखत परंतुक अंत:Eथ ािपत (cid:4)कया जाएगा, अथा?त ्:—
"परंत ु यह और (cid:4)क क(cid:10)(cid:11)ीय मोटर यान (.......... संशोधन) िनयम, 2014 के अंितम (cid:24)काशन क(cid:27) तारीख से ही,
इस िनयम के अधीन अप(े ाएं (cid:24)(cid:30) यके ई-=र श ा को लागू ह(cid:26)गी ।"।
16. उ त िनयम के (cid:24)(cid:25)प 2 म,(cid:10) वग? "(छ)" के पDच ात्, और "आवेदक (cid:29)ारा दी जाने वाली िविशिBट यां" से पहल े
िन(cid:20) निलिखत मोटर यान वग? अतं :Eथ ािपत (cid:4)कया जाएगा, अथात? ् :—
"(ज) ई-=र शा ।"।
17. उ त िनयम के (cid:24)(cid:25)प 3 म,(cid:10) "एक िश(ाथX के (cid:25)प म"(cid:10) से (cid:24)ारंभ होने वाले और "अनुQा5त (cid:4)कया जाता ह"ै पर

"एक िश(ाथX के (cid:25)प म(cid:10) क(cid:10)(cid:11)ीय मोटर यान िनयम, 1989 के िनयम 3 के उपबंध(cid:26) के अधीन रहत े #ए,
िन(cid:20) निलिखत वग? के मोटरयान को भारत म(cid:10) सव?2 और ई-=र श ा के मामले म(cid:10) िविनAदBट (े2(cid:26) या (cid:25)ट(cid:26) पर,
चलाने के िलए अनQु ा5 त (cid:4)कया जाता ह"ै ।
18. उ त िनयम के (cid:24)(cid:25)प 4 म,(cid:10) वग? "(छ)" के पDच ात्, और "आवेदक (cid:29)ारा दी जाने वाली िविशिBट यां" से पहल े

19. उ त िनयम के (cid:24)(cid:25)प 6 म,(cid:10) "इस अनुQि5त के धारक(cid:26)" से (cid:24)ारंभ होने वाले और "अनुQि5त (cid:24)दान क(cid:27) जाती ह"ै पर
समा5 त होने वाले भाग के E थान पर िन(cid:20) निलिखत रखा जाएगा, अथा?त् :—
"इस अनQु ि5 त के धारक(cid:26) को िन(cid:20) निलिखत वण?न के मोटरयान को संपूण? भारत म(cid:10) और ई-=र श ा के मामले म (cid:10)
िविनAदB ट (े2(cid:26) या (cid:25)ट(cid:26) पर, चालन के िलए अनQु ि5त (cid:24)दान क(cid:27) जाती ह ै "।
20. उ त िनयम के (cid:24)(cid:25)प 7 म,(cid:10) "मशीन पठनयोYय (े2" शीष ? के अधीन, "बैज िववरण" उपशीष? स े पहल,े
िन(cid:20) निलिखत अंत:E थािपत (cid:4)कया जाएगा, अथा?त ्:—

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS
NOTIFICATION
New Delhi, the 17th September, 2014
G.S.R. 666(E).––The following draft of certain rules further to amend the Central Motor Vehicles
Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by Sections
27, 64, 110 and 137 of Motor Vehicles Act, 1988 (59 of 1988) is hereby published as required by
sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby; and
notice is hereby given that the said draft rules will be taken into consideration after expiry of a period of ten
days from the date on which the copies of this notification as published in the Official Gazette, are made
available to the public.
Objections or suggestions, if any, to these draft rules may be sent to the Joint Secretary (Transport),
Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110001, within
the period specified above.
The objections or suggestions which may be received from any person with respect to the said draft
rules within the expiry of the period aforesaid will be considered by the Central Government.
DRAFT RULES
1. (1) These rules may be called the Central Motor Vehicles (……..Amendment) Rules, 2014.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.¹Hkkx IIµ[k.M 3 (i)º Hkkjr dk jkti=k % vlk/kj.k 5
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the said rules), in rule 2, after
clause (ca), the following sub-rule shall be inserted, namely:—
“(cb) “E-rickshaw” means a special purpose battery operated vehicle having three wheels and
intended to provide last mile connectivity for transport of passengers for hire or reward,
provided,––
(i) such vehicle is constructed or adapted to carry not more than four passengers, excluding
the driver, and not more than forty kilogramms luggage in total;
(ii) the power of its motor is not more than 2000 W;
(iii) the maximum speed of the vehicle is not more than twenty-five kilometer per hour.”.
3. In the said rules, in rule 16, after sub-rule (5), the following sub-rule shall be inserted, namely:—
“(6) Every driving license issued or renewed by a licensing authority to drive an E-rickshaw shall
be valid for a period of not more than three years from the date of issue, as the case may be, or till
the validity of the driving licence, whichever is earlier.”.
4. In the said rules, in rule 50, in sub-rule (1), in clause (vi), in the Table, for the words “two
wheelers, three wheelers and quadricycles”, the words “two wheelers, three wheelers, quadricycles and
E-rickshaws” shall be substituted.
5. In the said rules, in rule 51, in the Table, in the entries against serial number 5, in column 2, at the
end, after the numerals and letters “500 cc”, the words “and E-rickshaws” shall be inserted.
6. In the said rules, in rule 56, in sub-rule (2),
(i) the word “and” occurring at the end of clause (c) shall be omitted;
(ii) in clause (d), at the end, for the word “insurance”, the words “insurance; and” shall be
substituted;
(iii) after clause (d), the following clause shall be inserted, namely:—
“(e) driving license and permit in case of E-rickshaw.”.
7. In the said rules, in rule 57, in sub-rule (1),—
(i) the word “and” occurring at the end of clause (c) shall be omitted;
(ii) in clause (d), at the end, for the word “vehicle”, the words “vehicle; and” shall be substituted;
(iii) after clause (d), the following clause shall be inserted, namely:—
“(e) driving licence and permit in case of transfer of ownership of E-rickshaw.”.
8. In the said rules, in rule 62, in sub-rule (1),—
(i) in the table, after item (b) and the entries relating thereto, the following items and entries shall
be inserted, namely:—
“(ba) renewal of certificate of fitness in respect of E-rickshaw three years”;
(ii) after the proviso and before the Explanation, the following shall be inserted, namely:—
“Provided further that in case of E-rickshaw, the renewal of fitness certificate shall be made
only after carrying out tests specified in the Table given below:—

9. In the said rules, in rule 93,—
(a) in sub-rule (1), after the proviso and before the Explanation, the following proviso shall be
inserted, namely:—
“Provided further that the overall width of an E-rickshaw shall not exceed 1.0 metres.”;
(b) in sub-rule (2), after clause (vii), the following clause shall be inserted, namely:—
“(viii) in the case of E-rickshaw, shall not exceed 2.6 metres.”;
(c) in sub-rule (4), after clause (iv), the following clause shall be inserted, namely:—
“(v) in the case of E-rickshaw, shall not exceed 1.8 metres.”.
10. In the said rules, in rule 94, in sub-rule (3), in clause (iv), for the words “two wheeler, three
wheeler and quadricycle”, the words “two wheeler, three wheeler, quadricycle and E-rickshaw” shall be
substituted.
11. In the said rules, in rule 95, in sub-rule (1), in the first proviso, for the words “in the case of two
wheeler, three wheeler and quadricycle”, the words “in the case of two wheeler, three wheeler, quadricycle
and E-rickshaw” shall be substituted.
12. In the said rules, in rule 96, in sub-rule (4),––
(a) in clause (i), for the words “two wheelers and three wheelers”, the words “two wheelers, three
wheelers and E-rickshaw” shall be substituted;
(b) in clause (ii), for the words “all motor vehicles”, the words “all motor vehicles including E-
rickshaw” shall be substituted.
13. In the said rules, in rule 117, in sub-rule (1), the words “other than an invalid carriage or a
vehicle, the designed speed of which does not exceed thirty kilometers per hour”, the words “other than an
invalid carriage or an E-rickshaw or a vehicle” shall be substituted.
14. In the said rules, in rule 119, in sub-rule (1), after the second proviso, the following proviso shall
be inserted, namely:—
“Provided also that on and after the date of final publication of the Central Motor Vehicles
(………………Amendment) Rules, 2014, the requirements under this rule shall be applicable to every
E-rickshaw.”.
15. In the said rules, in rule 122, in sub-rule (1),––
(a) in the proviso, for the letter and words “N category vehicle and Goods Quadricycle”, the letter
and words “N category vehicle, Goods Quadricycle and E-rickshaw” shall be substituted.”
(b) after the second proviso, the following proviso shall be inserted, namely:-
“Provided also that on and after date of final publication of the Central Motor Vehicles
(………………Amendment) Rules, 2014, the requirements under this rule shall be applicable to every
E-rickshaw.”.
16. In the said rules, in Form 2, after category “(g)” and before “PARTICULARS TO BE
FURNISHED BY APPLICANT”, the following motor vehicle category shall be inserted, namely:—
“(h) E-rickshaw.”.
17. In the said rules, in Form 3, for the portion beginning with “is licenced to drive” and ending with
“motor vehicle of the following description”, the following shall be substituted, namely:—
“is licensed to drive a motor vehicle of the following description throughout India and, in case of
E-rickshaw, in specified areas or routes, as a learner, subject to the provisions of rule 3 of the Central
Motor Vehicles Rules, 1989”.
18. In the said rules, in Form 4, after category “(g)” and before “PARTICULARS TO BE
FURNISHED BY APPLICANT”, the following motor vehicle category shall be inserted, namely:—
“(h) E-rickshaw.”.¹Hkkx IIµ[k.M 3 (i)º Hkkjr dk jkti=k % vlk/kj.k 7
19. In the said rules, in Form 6, for the portion beginning with “The holder of this licence” and
ending with “vehicles of the following description”, the following shall be substituted, namely:—
“The holder of this licence is licensed to drive vehicles of the following description, throughout India
and, in case of E-rickshaw, in specified areas or routes”.
20. In the said rules, in Form 7, under the heading “MACHINE READABLE ZONE”, before the
subheading “Badge Details”, the following shall be inserted, namely:––
“Authorisation to drive E-rickshaw in …………. (specify areas or routes)”.
21. In the said rules, in Form 8, after category “(j)”, the following motor vehicle category shall be
inserted, namely:—
“(k) E-rickshaw.”.
