Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be considered by the Central Government. 3. Objections or suggestions, if any, may be addressed to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi–110 001. Draft rules 1. (1) These rules may be called the Central Motor Vehicles (Amendment) Rules, 2014. (2) Save as otherwise specifically provided in these rules, they shall come into force on the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989, for rule 118 the following rule shall be substituted, namely:— “118. Speed governor.—(1) Every transport vehicle notified by the Central Government under sub-section (4) of section 41 of the Motor Vehicles Act, 1988 (59 of 1988), save as provided herein, and manufactured on or after the 1stOctober, 2014 shall be equipped or fitted by the vehicle manufacturer, either in the manufacturing stage or at the dealership stage, with a speed governor (speed limiting device or speed limiting function) having maximum pre-set speed of 80 kilometre per hour conforming to the Standard AIS 018/2001, as amended from time to time: Provided that the State Government may, by notification in the Official Gazette, specify the categories of transport vehicles registered prior to the 1st October, 2014 and not already fitted with a speed governor (speed limiting device or speed limiting function), shall be equipped or fitted by the operator of such transport vehicle with a speed governor (speed limiting device or speed limiting function) having maximum pre-set speed of 80 kilometre per hour conforming to the Standard AIS: 018/2001, as amended from time to time: Provided further that the transport vehicles that are,— (i) two wheelers; (ii) three wheelers; (iii) quadricycles; (iv) with four wheels used for carriage of passengers and their luggage, with seating capacity not exceeding eight passengers in addition to driver seat (M1 Category); (v) fire tenders; (vi) ambulances; (vii) police vehicles; (viii) operating on All India Tourist permit; (ix) with maximum rated speed as verified and certified by a testing agency specified in rule 126, does not exceed 80 kilometer per hour, shall not be required to be equipped or fitted with speed governor (speed limiting device or speed limiting function): Provided also that the transport vehicles being goods carriage operating on National Permit, as are not verified and certified by a testing agency specified in rule 126 to have design speed less than 90 kilometre per hour, shall be required to be fitted with speed governor (speed limiting device or speed limiting function) having maximum pre-set speed of 90 kilometre per hour conforming to the Standard AIS: 018/2001, as amended from time to time: Provided also that the transport vehicles such as dumpers, school buses and tankers shall be required to be fitted with speed governor (speed limiting device or speed limiting function) having maximum pre-set speed of 60 kilometre per hour conforming to the Standard AIS: 018/2001, as amended from time to time or such other lower speed limit specified by the State Government by notification in the Official Gazette conforming to the said Standard.
