नइ ददल्ली, 2 नवम्बर, 2022 सा.का.जन. 801(ऄ).—प्रारूप जनयम, ऄथाात् इ-ऄपजिष्ट (प्रबधं न) जनयम, 2022 भारत सरकार द्वारा पयाावरण, वन और जलवायु पररवतान मंत्रालय द्वारा भारत के राजपत्र, ऄसाधारण, भाग II, धारा 3, ईप-धारा (i) ऄजधसूचना संख्या का.अ. 360 (प्र.), तारीख 19 मइ, 2022 में प्रकाजित दकय े गय े थ,े जजसमें ईन सभी व्यजियों से जजनकी आनस े प्रभाजवत होने की संभावना ह ै ईस तारीख से जजसको ईि ऄजधसूचना में ऄंतर्ववष्ट राजपत्र की प्रजतयां जनता को ईपलब्ध कराइ गइ थी, साठ ददनों की ऄवजध की समाजि से पूवा अपजियां और सझु ाव मांगे गए थे; और ईि ऄजधसूचना वाल ेराजपत्र की प्रजतयां 19 मइ, 2022 को जनता को ईपलब्ध करा दी गइ थीं; और ईि ऄवजध के भीतर ईि प्रारूप ऄजधसूचना के संबंध म ें जनता से प्राि अपजियों और सुझावों पर केंद्रीय सरकार द्वारा सम्यकतः जवचार कर जलया गया ह;ै ऄतः ऄब केंद्रीय सरकार, पयाावरण (संरक्षण) जनयम 1986 के जनयम 5 के ईप-जनयम (3) के साथ परठत, पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 6, 8 और 25 द्वारा प्रदि िजियों का प्रयोग करते हुए और इ-ऄपजिष्ट (प्रबंधन) जनयम, 2016 के ऄजधक्रमण म,ें ईन बातों के जसवाए ऄजधकांत करत े हुए, जजन्ह ेंऐसे ऄजधक्रमण स े पूवा दकया गया ह ैया करने का लोप दकया गया हो, जनम्नजलजखत जनयम बनाती ह,ै ऄथाात्ः- ऄध्याय 1 प्रस्ट्तावना 1. संजक्षि नाम और प्रारंभ। (1) आन जनयमों का संजक्षि नाम इ-ऄपजिष्ट (प्रबंधन) जनयम, 2022 ह।ै (2) ये जनयम 1 ऄप्रैल, 2023 की तारीख से लागू होंगे। 7268 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. लाग ू होना - ये जनयम प्रत्येक जनमााता, आलेक्ट्रॉजनक ईपकरण (इइइ) के जवजनमााता, ईत्पादक, ररफर्वबिर, भंजक और पुनः चक्राणकताा पर लागू होंगे, जो ऄनुसूची-I में सूचीबद्ध इ-कचरे या जवद्युत (आलेजक्ट्रकल) और आलेक्ट्रॉजनक ईपकरणों के जवजनमााण, जबक्री, ऄतं रण, खरीद, ररफर्वबिरससग, भंजक करके और पुनः चक्रण करने और प्रसंस्ट्करण में सजम्मजलत ह,ैं जजनमें ईनके घटक, ईपभोज्य, वस्ट्तुए,ँ पार्टसा और पुजे सजम्मजलत ह,ैं जो ईत्पाद को संचाजलत करते ह ैं लेदकन जनम्नजलजखत पर लाग ूनहीं होंगे – (क) बैटरी ऄपजिष्ट प्रबंधन जनयमों, 2022 के ऄधीन कवर की गइ ऄपजिष्ट बैटरी; (ख) प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयमों, 2016 के ऄधीन कवर की गइ प्लाजस्ट्टक की पैकेसजग; (ग) सूक्ष्म, लघ ु और मध्यम ईद्यम जवकास ऄजधजनयम, 2006 (2006 का 27) में यथा पररभाजित सूक्ष्म ईद्यम (सेवा क्षेत्र); और (घ) परमाणु उजाा ऄजधजनयम, 1962 (1962 का 33) के ऄधीन और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄधीन और यथा कवर दकए गए रेजडयो-सदक्रय ऄपजिष्ट। 3. पररभािाए ँ - (1) आन जनयमों म,ें जब तक दक संदभा स ेऄन्यथा ऄपेजक्षत न हो, - (क) ‘ऄजधजनयम’ से पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) ऄजभप्रेत ह;ै (ख) ‘बडे ईपभोिा’ से कोइ भी ऐसी आकाइ ऄजभप्रेत ह ै जजसने जवजिष्ट जविीय विा में दकसी भी समय ऄनुसूची-I में सूचीबद्ध कम-स-े कम एक हजार जवद्युत और आलेक्ट्रॉजनक ईपकरणों की आकाआयों का ईपयोग दकया ह ै और आसमें इ-ररटेलर भी सजम्मजलत ह;ै (ग) ‘कारबार’ स े ऄनुसूची-I में सूचीबद्ध जवद्युत और आलेक्ट्रॉजनक ईपकरणों का जवजनमााण, ईत्पादन, संयोजन (ऄसेंबसलग) और अयात तथा इ-कचरे का नवीनीकरण, पुनचक्रा ण, जनपटान और पररिोधन ऄजभप्रेत ह;ै (घ) ‘घटक’ स े ईप-संयोजन (ऄसेंबसलग) या संयोजन के ईन जहस्ट्सों एव ं भागों म ें स े एक ऄजभप्रेत ह ै जजसमें सेएक जवजनर्वमत ईत्पाद बना ह ै और जजसमें आसे समाजधत (ररज़ाल््ड) दकया जा सकता ह ै और आसमें दकसी ऄन्य घटक के जलए ऄजतररि ईपस्ट्कर (एक्ट्सेसरी) या संयोजन सजम्मजलत ह;ै (ङ) ‘ईपभोज्य’ वस्ट्तु स े एक ऐसी वस्ट्तु ऄजभप्रेत ह,ै जो एक जवजनमााण प्रदक्रया या आलेजक्ट्रकल और आलेक्ट्रॉजनक ईपकरणों के कामकाज म ें अती ह ै या ऄपेजक्षत ह ै और ऄंजतम ईत्पाद औरवस्ट्तओंु का जहस्ट्सा हो भी सकती ह ै और नहीं भी हो सकती ह ै ऐसी वस्ट्तुएं, जो एक जवजनमााण प्रदक्रया के दौरान पयााि रूप से या पूरी तरह स े ईपभोग की जाती ह,ैं को ईपभोग्य समझा जाएगा; (च) ‘जवघटनकताा’ से ऐसे दकसी व्यजि या संस्ट्था ऄजभप्रते ह ै जो प्रयुि जवद्युत और आलेक्ट्रॉजनक ईपस्ट्करों को ईनके घटकों में नष्ट करन े में सलं ग्न हो और जजसे केन्द्रीय प्रदिू ण जनयंत्रण बोडा के ददिाजनदिे ों के ऄनुसार सम्बजन्धत राज्य प्रदिू ण जनयंत्रण बोडाया प्रदिू ण जनयंत्रण सजमजत से प्राजधकार प्राि हो; (छ) ‘जनपटान और पररिोधन’ से कोइ भी ऐसा संचालन (ऑपरेिन) ऄजभप्रेत ह ै जो पनु चाक्रण (रीसाआसक्ट्लग), ररकवरी या पनु ः ईपयोग नहीं करता ह ै या पुनः ईपयोग का कारण नहीं बनता ह ै और आसम ें दफजजयोकैजमकल या जैजवक ईपचार, भस्ट्मीकरण और सरु जक्षत लडैं दफल म ें ईतारना या ईलटना भी िाजमल ह;ै (ज) ईत्पाद के ‘ऄवजध समाजि’ स े वह समय ऄजभप्रेत ह ै जब ईत्पाद को ईपयोगकता ा द्वारा त्यागन े का अिय बन जाता ह;ै (झ) ‘इ-ऄपजिष्ट का पयाावरण की दजृ ष्ट से सुदढ़ृ प्रबंधन’ स े यह सुजनजित करने के जलए ऄपेजक्षत सभी कदम ईठाना ऄजभप्रेत ह ै दक इ-ऄपजिष्ट एवं कचरे का प्रबधं न आस तरह से दकया जाता ह ै जो स्ट्वास्ट््य और पयाावरण को दकसी भी प्रजतकूल प्रभाव से बचाएगा, जो ऐसे इ-कचरे या ऄपजिष्ट के पररणामस्ट्वरूप हो सकता ह;ै (ञ) ‘आलेजक्ट्रक और आलेक्ट्रॉजनक ईपकरण’ स े ऐस े ईपकरणों ऄजभप्रेत ह ै जो दक्रयािील एवं दक्रयात्मक होने के जलए जवद्युत प्रवाह या जवद्युत-चुंबकीय क्षेत्र पर जनभार ह,ैं और जबजली के ईत्पादन, हस्ट्तांतरण और माप के जलए ईपकरण भी ह;ैं[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (ट) ‘फुटकर जवक्रेता’ स े एक व्यजि या कंपनी या व्यावसाजयक आकाइ ऄजभप्रेत ह,ै जो ऄपने माल को बेचन े के जलए आंटरनेट, सोिल मीजडया, टेलीफोन या दकसी ऄन्य मीजडया जैसे आलेक्ट्रॉजनक नेटवका का ईपयोग करती ह;ै (ठ) ‘इ-ऄपजिष्ट’ स े सौर फोटोवोजल्टक मॉड्यलू या पैनल या सले सजहत जवद्युत और आलेक्ट्रॉजनक ईपकरण ऄजभप्रेत ह,ैं जो ऄपजिष्ट एवं कचरे के रूप में पूरे या अंजिक रूप से त्याग ददए गये हैं, साथ ही जजन्ह ें जवजनमााण, नवीनीकरण और मरम्मत प्रदक्रयाओं से खाररज एव ंऄस्ट्वीकार कर ददया जाता है; (ड) ‘जवस्ट्ताररत जनमााता ईिरदाजयत्व’ स े ऄनुसूची-I में यथा ददए गए जवद्युत या आलेक्ट्रॉजनक ईपकरण एव ं ईपस्ट्करों के दकसी भी जवजनमााता और ईत्पादक की ईिरदायी और जबाबदेही ऄजभप्रेत ह,ै जो ऄनुसूची-III और ऄनुसूची-IVके ऄनुसार पुनचाक्रण लक्ष्यों को परू ा करन े के जलए केवल इ-ऄपजिष्ट के पंजीकृत पुनचाक्रणकतााओं के माध्यम से ऐसे ऄपजिष्ट का पयाावरणीय रूप से सुदढ़ृ प्रबंधन सुजनजित करने के जलए है; (ढ) ‘प्रसुजवधा’ स े ऐसा कोइ स्ट्थान ऄजभप्रेत ह ै जजसमें इ-ऄपजिष्ट के संग्रहण, स्ट्वागत, भण्डारण, पृथक्करण, नवीनीकरण, पुनचाक्रण, जनपटान और ईपचार के अनुिंजगक प्रदक्रया की जाती है; (ण) ‘ऐजतहाजसक इ-ऄपजिष्ट’ स े ऄनसु ूची-I म ें जनर्ददष्ट जवद्युत और आलेक्ट्रॉजनक ईपकरणों एवं ईपस्ट्करों से ईत्पन्न इ-ऄपजिष्ट ऄजभप्रेत ह,ै जो आन जनयमों केलागऔू र प्रवृि होन ेकी तारीख को ईपलब्ध था; (त) ‘जवजनमााता’ स े एक व्यजि या आकाइ या कंपनी ऄजभप्रेत ह ै जसै ा दक कंपनी ऄजधजनयम, 2013 (2013 का 18) में पररभाजित दकया गया ह ै या कारखाना ऄजधजनयम, 1948 (1948 का 63) पररभाजित एक कारखाना या सूक्ष्म, लघु और मध्यम ईद्यम जवकास ऄजधजनयम, 2006 (2006 का 27) में पररभाजित लघ ु और मध्यम ईद्यमों से ह,ै जजसमें ऄनुसूची-I में जनर्ददष्ट जवद्युत और आलेक्ट्रॉजनक ईपकरणों के जवजनमााण की सुजवधाएं जवद्यमान ह;ैं (थ) ‘लावाररस ईत्पादों’ स े गैर-ब्ांडेड या समुच्चय दकए गए जवद्युत और आलेक्ट्रॉजनक ईपकरण ऄजभप्रेत ह ै जो ऄनुसूची-I में जनर्ददष्ट ह ैंया दकसी कंपनी द्वारा ईत्पाददत ह,ैं जजसने ऄपना संचालन बंद कर ददया है; (द) ‘भाग’ स े ईप-समुच्चय या समुच्चय के ऐसे तत्व ऄजभप्रेत ह ै जजसमें आसके घटक, पुजे या गौण िाजमल ह ैं जो सामान्य रूप से स्ट्वयं द्वारा ईपयोगी नहीं होते ह,ैं और रखरखाव प्रयोजनों के जलए अगे जवघटन के जलए ईिरदायी नहीं होते ह ैंएक जहस्ट्सा एक घटक, ऄजतररि या एक सहायक हो सकता ह;ै (ध) ‘पोटाल’ से आन जनयमों के प्रयोजनों के जलए केन्द्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जवकजसत ऑनलाआन प्रणाली ऄजभप्रेत ह;ै (न) ‘जवजनमााता’ से कोइ भी ऐसा व्यजि या आकाइ ऄजभप्रेत ह,ै जो- (i) ऄपन े स्ट्वय ं के ब्ांड के ऄधीन जवद्युत और आलेक्ट्रॉजनक ईपकरण और ईनके घटकों या ईपभोग्य सामजग्रयों या पुजों या पुजों का जवजनमााण और जबक्री के जलए प्रस्ट्थापना करता है; या (ii) ऄपन ेस्ट्वयं के ब्ाडं , समुच्चय दकए गए जवद्युत और आलेक्ट्रॉजनक ईपकरण और ईनके घटकों या ईपभोग्य सामजग्रयों या ऄन्य जवजनमााताओं या अपूर्वतकतााओं द्वारा ईत्पाददत पार्टसा पुजों या कलपुजों को जबक्री के जलए प्रस्ट्थापना करता ह;ै या (iii) अयाजतत जवद्युत और आलेक्ट्रॉजनक ईपकरण और ईनके घटकों या ईपभोग्य सामजग्रयों, पार्टसा या पुजों या कलपुजों को जबक्री के जलए प्रस्ट्थापना करता ह;ै या (iv) जो प्रयुि जवद्युत और आलेक्ट्रॉजनक ईपकरणों का अयात करता है; जबक्री की तकनीक की परवाह दकये जबना डीलर, ररटेलर, इ-ररटेलर, अदद के जलय े आस्ट्तेमाल दकया जाता ह।ै (प) ‘पुनः चक्रणकताा’ से ऐसा कोइ व्यजि या संस्ट्था ऄजभप्रेत ह ै जो दलु ाभ पृ्वी तत्वों और ऄन्य ईपयोगी वसूली योग्य सामजग्रयों सजहत कीमती, ऄधा कीमती धातओंु की वसूली के जलए ऄपजिष्ट जवद्युत और आलेक्ट्रॉजनक ईपकरणों या ऄसेंबली या ईनके घटकों या ईनके भागों के पनु चाक्रण और पुनसंसाधन में सलं ग्न ह ै जजससे4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जद्वतीयक खट्टे पदाथों को मजबतू दकया जा सके और आस संबंध म ें बनाए गए केंद्रीय प्रदिू ण जनयंत्रण बोड ा के ददिा-जनदेिों म ेंवर्वणत सुजवधाओं का ईपयोग दकया जा सके; (फ) ‘ररफर्वबिर’ से ऄनुसूची-I म ें सूचीबद्ध जवद्युत और आलेक्ट्रॉजनक ईपकरणों की मरम्मत या समच्चु य करन े वाल े ऐसे दकसी व्यजि या आकाइ ऄपने मलू रूप स े आजछछत जीवन पर ऄपन े कामकाजी जीवन का जवस्ट्तार करन े और मूल रूप से आजछछत ईपयोग करने तथा बेचने के जलए बाजार में मौजूद समान ऄजभप्रेत ह;ै (ब) ‘ऄनुसूची’ स े आन जनयमों से जुडी ऄनुसूची ऄजभप्रेत ह;ै (भ) ‘पुजों’ स े प्रजतस्ट्थापन के जलए एक भाग या ईप-समुच्चय (ऄसेंबली) या समुछ चय (ऄसेंबली) ऄजभप्रेत ह ै जो एक समान या समान भाग या ईप-समुच्चय या समुच्चय को बदलने के जलए तैयार होता ह ै जजसमें एक घटक या एक एक्ट्सेसरी िाजमल हों; और (म) ‘लक्ष्य’ स े ‘जवस्ट्ताररत जनमााता ईिरदाजयत्व’ की अपूर्वत में ईत्पादक द्वारा रजजस्ट्री पुनचाक्रण के माध्यम स े पुनचादक्रत दकए जान े वाले इ-ऄपजिष्ट की मात्रा ऄजभप्रेत ह;ै (2) ईन िब्दों और पदों के जो आसम ें प्रयुि ह ैऔर पररभाजित नहीं ह ै दकन्त ु ऄजधजनयम म ें पररभाजित ह ैंवहीं ऄथ ा होंग े जो ईस ऄजधजनयम म ेंह।ै ऄध्याय 2 जवस्ट्ताररत जनमाता ा ईिरदाजयत्व ढाचँ ा 4. रजजस्ट्री - (1) संस्ट्थाए ंपोटाल पर जनम्नजलजखत में से दकसी भी श्रेणी में रजजस्ट्री होंगी, ऄथाात:्- (क) जवजनमााता; (ख) ईत्पादक; (ग) ररफर्वबिर; या (घ) पुनः चक्रणकताा; (2) यदद कोइ आकाइ ईप-जनयम (1) के ऄधीन एक से ऄजधक श्रेजणयों में अती ह,ै तो आकाइ ईन श्रेजणयों के ऄधीन ऄलग स े रजजस्ट्री करेगी। (3) ईपजनयम (1) में संदर्वभत एवं जनर्ददष्ट कोइ भी संस्ट्था या आकाइ रजजस्ट्री के जबना कोइ व्यवसाय नहीं करेगी। (4) ईपजनयम (1) के ऄधीन रजजस्ट्री संस्ट्थाएं दकसी भी ऄरजजस्ट्रीकृत जवजनमााता, ईत्पादक, पुनचाक्रणकता ा (ररसाआदकलर) और नवीनीकरणकताा (ररफर्वबिर) के साथ कोइ सौदा या व्यवसाय नहीं करेंगी। (5) जहाँ कोइ रजजस्ट्रीकृत संस्ट्था रजजस्ट्रीकरण या ररटना या ररपोट ा या जानकारी प्राि करन े के जलए झूठी जानकारी एवं सूचनाए ं प्रस्ट्ततु करती ह ै या जानबूझकर छुपाती ह ै जो आन जनयमों के ऄधीन या दकसी भी ऄजनयजमतता के मामल े म,ें प्रदान/प्रस्ट्तुत करन े के जलए अवश्यक और महत्त्वपणू ा ह,ै ऐसी आकाइ का रजजस्ट्रीकरण केंद्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा सुनवाइ का ऄवसर देने के बाद तीन विा तक की ऄवजध रद्द दकया जा सकता है और आसके ऄजतररि, ऐसे मामलों में जनयम 22 के ऄनुसार पयाावरण क्षजतपर्वू त िुल्क भी लगाया जा सकता ह।ै (6) केन्द्रीय प्रदिू ण जनयंत्रण बोड ा संचालन सजमजत के ऄनुमोदन से केन्द्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जनधााररत इ- ऄपजिष्ट की क्षमता के अधार पर आन जनयमों के ऄधीन रजजस्ट्रीकरण चाहने वाली संस्ट्थाओं से ऐसा रजजस्ट्रीकरण िल्ु क और वार्विक रखरखाव प्रभार ले सकता ह।ै ऄध्याय 3 ईिरदाजयत्व 5. जवजनमाता ा की ईिरदाजयत्व - सभी जवजनमााताओं को, - (1) पोटाल पर रजजस्ट्रीकरण कराना होगा; (2) दकसी भी जवद्युत और आलेक्ट्रॉजनक ईपस्ट्कर के जवजनमााण के दौरान ईत्पन्न इ-कचरा और ऄपजिष्ट को एकत्र करना और ईसके पुनचाक्रण या जनपटान एवं पररिोधन को सुजनजित करना;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (3) पोटाल पर ऄजधकतजथ प्ररूप म ें वार्विक और जतमाही जववरणी फाआल करें, जतमाही या वि ा के बाद महीन े के ऄंत में या ईससे पहल,े जैसा भी मामला हो, जजससे जववरणी संबंजधत ह।ै 6. ईत्पादक का ईिरदाजयत्व –ऄनुसूची-I में सूचीबद्ध जवद्युत और आलक्ट्े रॉजनक ईपकरणों के जनमााता आसके जलए ईिरदायी होंगे – (1) पोटाल पर रजजस्ट्रीकरण करन ेके जलए; (2) पोटाल के माध्यम से ऄनुसूची-IIIऔर ऄनुसूची-IVके ऄनुसार जवस्ट्ताररत जवजनमााता ईिरदाजयत्व लक्ष्यों को हाजसल करन े और ईन्ह ेंकायााजन्वत करन े के जलए; परंत ु दक पूवावती इ-ऄपजिष्ट (प्रबंधन) जनयम, 2016 के ईपबंधों के ऄधीन जवस्ट्ताररत ईत्पादक ईिरदाजयत्व योजना रखने वाला ईत्पादक संचालन सजमजत के ऄनुमोदन से केंद्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जनधााररत प्रदक्रया के ऄनुसार आन जनयमों के ऄधीन पलायन करेगा। (3) मीजडया, प्रकािनों, जवज्ञापनों, पोस्ट्टरों या संचार के दकसी ऄन्य माध्यम से जागरूकता पदै ा करन े के जलए; (4) केंद्रीय प्रदिू ण जनयंत्रण बोडा के पोटाल पर ऄजधकजथत प्ररूप या प्रपत्र में वार्विक और जतमाही जववरणी ईस जतमाही या विा के बाद के महीने के ऄंत पर या ईससे पहले फाआल करने के जलए, जैसा भी मामला हो, जजससे जववरणी संबंजधत ह।ै 7. नवीनीकरणकता ा(ररफर्वबिर) का ईिरदाजयत्व - सभी नवीनीकरणकतााओं (ररफर्वबिर) को, - (1) पोटाल पर रजजस्ट्रीकरण कराना होगा; (2) नवीनीकरण की प्रदक्रया के दौरान ईत्पन्न इ-कचरे एवं ऄपजिष्ट को एकत्र करना और कचरे एवं ऄपजिष्ट को रजजस्ट्रीकृत पनु चाक्रणकताा को सौंपना और पोटला पर जानकारी ऄपलोड करना; (3) यह सुजनजित करना दक नवीनीकृत ईपकरण आलक्ट्े रॉजनक्ट्स और सूचना प्रौद्योजगकी मंत्रालय की ऄजनवाय ा रजजस्ट्रीकरण योजना और आस प्रयोजन के जलए तैयार दकए गए भारतीय मानक ब्यूरो के मानकों के ऄनुसार होंग;े (4) पोटाल पर ऄजधकजथत प्ररूप म ें वार्विक और जतमाही जववरणी फाआल करना, जतमाही या विा के बाद महीने के ऄतं म ेंया ईससे पहल,े जैसा भी मामला हो, जजससे जववरणी संबंजधत ह।ै 8. बडे ईपभोिाओं (बल्ककंज्यमू स)ा का ईिरदाजयत्व – ऄनुसूची-I म ें सूचीबद्ध जवद्युत और आलेक्ट्रॉजनक ईपकरणों के बडे ईपभोिा यह सुजनजित करेंग े दक ईनके द्वारा ईत्पन्न दकया गया इ-कचरा एवं ऄपजिष्ट केवल रजजस्ट्रीकृत ईत्पादक, नवीनीकरणकतााओं या पुनचाक्रणकताओंा को ही सौंपा जाऐगा। 9. पनु चक्रा णकता ा का ईिरदाजयत्व – सभी-सभी पुनचाक्रणकताओंा (रीसायकलसा) को, - (1) पोटाल पर रजजस्ट्रीकरण कराना होगा; (2) आस बारे में, यह सुजनजित करना दक सुजवधा और पुनचाक्रण प्रदक्रयाएँ समय-समय पर केंद्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा जनर्ददष्ट मानकों या ददिाजनदेिों के ऄनुसार ह;ैं (3) यह सुजनजित करना दक आसकी सुजवधा में पुननावीनीकरण नहीं दकए गए ऄंिों या सामग्री को संबंजधत रजजस्ट्रीकृत पुनचाक्रणकतााओं को भेजा जाता ह;ै (4) सुजनजित करना दक पुनचाक्रण प्रदक्रया के दौरान ईत्पन्न ऄवििे ों का जनपटान एवं पररिोधन एक ऄजधकृत ईपचार भंडारण जनपटान सुजवधा म ेंदकया जाता ह;ै (5) एकजत्रत, जवघरटत, पुनचादक्रत और रजजस्ट्रीकृत पुनचाक्रणकताा को भेजे गए ऄपजिष्ट के ररकॉडा को बनाए रखना और जब भी ऄपेजक्षत हो सत्यापन/लेखापरीक्षा के जलए सभी ररकॉडा ईपलब्ध कराना; (6) पोटाल पर ऄजधकजथत प्ररूप या प्रपत्र में वार्विक और जतमाही जववरणी ईस जतमाही या विा के बाद के महीने के ऄंत पर या ईससे पहल,े जैसा भी मामला हो, फाआल करना, जजससे जववरणी संबंजधत ह।ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (7) ऄपजिष्ट जवद्युत और आलेक्ट्रॉजनक ईपकरण या घटकों को पनु चाक्रणहते ू स्ट्वीकार करना, जो ऄनुसूची-I में सूचीबद्ध नहीं ह,ैं परंतु दक ईनम ेंकोइ रेजडयोधमी सामग्री न हो और आस ेपोटाल पर ऄपलोड दकया जाए; (8) मीजडया, प्रकािनों, जवज्ञापनों, पोस्ट्टरों या संचार के ऐसेऄन्य माध्यम से जागरूकता पदै ा करना। (9) दकसी भी गैर-पुननावीनीकरण योग्य इ-कचरे एवं ऄपजिष्ट या दकसी भी मात्रा के बारे में जानकारी एवं सूचनाओं का लेखा-जोखा ऄपलोडकरना जजसे पुननावीनीकरण नहीं दकया गया ह ैऔर जनपटाया नहीं गया ह;ै (10) पुनः चक्रण प्रयोजनों के जलए जडस्ट्मेंटलसा की मदद लेना: यह पुनः चक्रणकताा का ईिरदाजयत्व होगा दक वह ईन जडस्ट्मेंटलसा से ईजचत सामग्री प्रवाह सुजनजित करे। जडस्ट्मेंटलर केवल रजजस्ट्रीकृत पुनः चक्रणकता ा को जवघरटत सामग्री दगे ा और ईसी का ररकॉडा बनाए रखगे ा। 10. राज्य सरकार या सघं राज्य क्षत्रे का ईिरदाजयत्व – (1) यथाजस्ट्थजत, राज्य और संघ राज्य क्षेत्र म ें ईद्योग जवभाग या राज्य सरकार या संघ राज्य क्षेत्र द्वारा आस संबंध म ें प्राजधकृत कोइ ऄन्य सरकारी ऄजभकरण जवद्यमान और अगामी औद्योजगक पाका, संपदा और औद्योजगक समूहों में इ-ऄपजिष्ट के जनराकरण और पुनचाक्रण के जलए औद्योजगक स्ट्थान या िडे का जनधाारण या अबंटन सुजनजित करना; (2) राज्य और संघ राज्य क्षेत्र म ें श्रम जवभाग या राज्य सरकार या संघ राज्य क्षेत्र द्वारा आस सबं ंध म ें ऄजधकृत कोइ ऄन्य सरकारी ऄजधकरण, जैसा भी मामला हो, जनम्न काया करेगीः – क) जनराकरण और पनु चाक्रण में िाजमल श्रजमकों की मान्यता और रजजस्ट्रीकरण को सुजनजित करना; ख) जवघटन सुजवधाओं के स्ट्थापन को सुजवधाजनक बनाने हते ू ऐसे कामगारों के समूहों के गठन म ेंसहायता करना; ग) जवघटन, जनराकरण और पनु चाक्रण म ें िाजमल श्रजमकों के जलए औद्योजगक कौिल जवकास दक्रयाकलापों को िरूु करना; घ) वार्विक जनगरानी करना तथा जवघटन एवं जनराकरण और पुनचाक्रण में िाजमल श्रजमकों की सरु क्षा और स्ट्वास्ट््य को सुजनजित करना; ऄध्याय IV 11. इ-ऄपजिष्ट के भडं ारण करन े की प्रदक्रया - प्रत्येक जनमााता, जनमााता, नवीनीकरणकताा और पनु चाक्रणकताा इ-कचरे को एक सौ ऄस्ट्सी ददनों से ऄजधक की ऄवजध के जलए भडं ाररत कर सकते ह ैं और इ-ऄपजिष्ट की जबक्री, हस्ट्तांतरण और भंडारण का ररकॉड ा बनाए रखगें े और आन ऄजभलेखों को जनरीक्षण के जलए ईपलब्ध कराएगं े। और इ-कचरे का भंडारण तत्समय प्रवृि सुसंग लाग ूजनयमों/या ददिा-जनदेिों के ऄनुसार दकया जाएगा: परंत ु केन्द्रीय प्रदिू ण जनयंत्रण बोडा ईि ऄवजध को तीन सौ पैंसठ ददनों तक बढ़ा सकता ह ै यदद इ-कचरे को आसके पनु चाक्रण या पुनः ईपयोग के जलए एक प्रदक्रया के जवकास के जलए जविेि रूप से सग्रं हीत करन े की अवश्यकता होती ह।ै ऄध्याय V 12. सौर फोटो-वोल्टाआकमॉड्यलू या पनै ल या सले का प्रबधं न-। - (1) ये जनयम आस ऄध्याय के ईपबंधों के ऄधीन सौर फोटो-वोल्टाआक मॉड्यूल या पैनल या सेल पर लाग ूहोंग;े (2) सौर फोटो-वोल्टाआकमॉड्यूल या पैनल या सले के प्रत्येक जवजनमााता और जनमााताः (i) पोटाल पर रजजस्ट्रीकरण सुजनजित करना; (ii) आस संबंध म,ें केंद्रीय प्रदिू ण जनयंत्रण बोडा के ददिा-जनदेिों के ऄनुसार विा 2034-2035 तक ईत्पन्न सौर फोटो-वोल्टाआक मॉड्यूल या पैनल या सले ऄपजिष्ट का भंडारण करना; (iii) विा 2034-2035 तक जजस विा से जववरणी संबंजधत ह,ै ईसके ऄंत में या ईससे पहल े पोटाल पर ऄजधकजथत प्ररूप म ेंवार्विक जववरणी फाआल करना; (iv) सुजनजित करना दक सौर फोटो-वोल्टाआक मॉड्यलू या पैनल या सले के ऄजतररि ऄन्य ऄपजिष्ट का प्रसंस्ट्करण तत्समय प्रवृि संबंजधत लागू जनयमों या ददिाजनदेिों के ऄनुसार करना;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 (v) सुजनजित करना दक सौर फोटो-वोल्टाआकमॉड्यूल या पैनल या सेलों की सूची पोटाल पर स्ट्पष्ट रूप से रखी जाएगी; (vi) आस संबंध में केंद्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा जारी मानक संचालन प्रदक्रया और ददिाजनदेिों का पालन करना; (3) केंद्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जनर्ददष्ट सामग्री की वसूली के जलए सौर फोटो-वोल्टाआकमॉड्यूल या पैनल या सले ों के पुनचाक्रण को ऄजनवाया दकया जाएगा; ऄध्याय VI 13. जवस्ट्ताररत जनमाता ा ईिरदाजयत्व व्यवस्ट्था के तौर-तरीके – (1) सभी ईत्पादकों को ऄनुसूची-III और ऄनुसूची- IV के ऄनुसार ऄपने जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व को पूरा करेगा, ऐसा करने में वे तीसरे पक्ष के सगं ठनों जसै े ईत्पादक ईिरदाजयत्व संगठनों, संग्रह केंद्रों, डीलरों अदद की भी मदद ले सकत े ह।ैं बिते, जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व पूरी तरह स ेकेवल ईत्पादक पर ही होगा। (2) आस बारे म,ें प्रत्येक ईत्पाद के जलए जवस्ट्ताररत जनमााता ईिरदाजयत्व का जनधाारण पोटाल पर ईत्पादकों द्वारा प्रदान की गइ जानकारी और केन्द्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा यथा जवजनदष्ट व्यजिगत ईत्पाद की जीवन ऄवजध तथा ऄनुसूचीIII और ऄनुसूची-IV में जनर्ददष्ट लक्ष्यों के अधार पर दकया जाएगा। (3) (i) जवजनमााता केवल पंजीकृत पनु चाक्रणकतााओं स े जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्र की ऑनलाआन खरीद के माध्यम से ऄपने जवस्ट्ताररत जनमााता ईिरदाजयत्व के कताव्यों एवं दाजयत्वों को पूरा करेगा और जतमाही जववरणी फाआल करके आसे ऑनलाआन जमा करेगा। (ii) प्रोड्यूससा और रजजस्ट्टड ा समुच्चय द्वारा ईपलब्ध कराए गए जववरण की क्रॉस-चेककग की जाऐगी। (iii) कोइ ऄंतर जमलता ह ै तो दकसी भी ऄंतर के मामल े में, जवजनमााता के जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्वों एवं कताव्यों को पूरा करने के जलए जनम्न स्ट्तर के अंकडे पर जवचार दकया जाएगा। (iv) प्रमाणपत्र केंद्रीय प्रदिू ण जनयत्रं ण बोडा या आस संबंध में केंद्रीय प्रदिू ण जनयंत्रण बोडा द्वारा ऄजधकृत दकसी ऄन्य ऄजधकरण द्वारा पयाावरण लेखा परीक्षा के ऄधीन होंगे। 14. जवस्ट्ताररत जनमाता ा ईिरदाजयत्वप्रमाण पत्र बनाना - (1) पनु चक्रा ण (रीसाआदकसलग) (i) आस संबंध म ें केंद्रीय प्रदिू ण जनयंत्रण बोडा पोटाल के माध्यम स े एक रजजस्ट्रीकृत पनु चाक्रणकता ा के पक्ष म ें ऄजधकजथत प्ररूप के ऄधीन एक जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्र तैयार करेगा। (ii) (क) जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाण पत्र हते ू पात्र मात्रा की गणना जनम्नजलजखत सूत्र द्वारा की जाएगीःऄथाात ् * Q = Q × C EPR p f *क्ट्यूइपीअर (QEPR) प्रमाण पत्र के जनमााण के जलए योग्य मात्रा है, क्ट्यूपी (Q ) ऄंजतम ईत्पाद की मात्रा ह ै और सीएफ p (C) रूपांतरण कारक ह(ै अईटपुट की एक आकाइ के ईत्पादन के जलए अवश्यक आनपुट की मात्रा।) f (ख) प्रत्येक ऄंजतम ईत्पाद के जलए रूपांतरण कारक सीएफ (C) संचालन सजमजत के ऄनुमोदन से केंद्रीय प्रदिू ण f जनयंत्रण बोडा द्वारा जनधााररत दकया जाएगा। (iii) जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्र की वैधता ईस जविीय विा के ऄंत से दो विा होगी जजसमें आसे बनाया गया थाऔर समय सीमा या ऄवजध समाि होन े के पिात ् प्रमाण पत्र स्ट्वतः ही समाि हो जाता ह ै जब तक दक आन जनयमों के ईपबंधों के ऄनुसार पहल े समाि न हो जाए। (iv) प्रत्येक जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्र म ें एक जवजिष्ट संख्या होगी जजसमें ईत्पादन का विा, ऄंजतम ईत्पाद का कोड, पुनचाक्रणकोड और एक ऄजद्वतीय कोड होगा और जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाण पत्र 100, 200, 500 और 1000 दकलोग्राम या ऐसे ऄन्य मल्ू य वगां में होंगे या संचालन सजमजत के ऄनुमोदन से केंद्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जनजित दकए जा सकते ह।ैं8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) नवीनीकरण (ररफर्वबसिग) - (i) इ-कचरे को नवीनीकरण (ररफर्वबसिग) करने के जलए भी ऄनुमजत दी जाएगीऔरनवीनीकरणकताा को पोटाल पर रजजस्ट्रीकृत होना होगा और ईपलब्ध कराए गए अंकडों के अधार पर, आस संबंध में जनधााररत प्रारूप म ेंएक रजजस्ट्रीकृत नवीनीकरणकता ाके पक्ष में नवीनीकरण प्रमाणपत्र तैयार दकया जाएगा। (ii) रजजस्ट्रीकृत नवीनीकरणकतााओं (ररफर्वबिरों) स े खरीदे गए नवीनीकरण प्रमाणपत्रों के प्रस्ट्ततु करने पर, ईत्पादकों की जवस्ट्ताररत जनमााता ईिरदाजयत्व को इ-कचरे एवं ऄपजिष्ट की संगत मात्रा के जलए केंद्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जनर्ददष्ट ऄवजध तक स्ट्थजगत कर ददया जाऐगा और नवीनीकृत ईत्पाद के जवस्ट्ताररत जीवन की समाजि पर जनमााता के जवस्ट्ताररत जनमााता ईिरदाजयत्व में जोडा जाएगा। (iii) नवीनीकरण को प्रोत्साजहत करने के जलए अस्ट्थजगत मात्रा का केवल 75 प्रजतित, नवीनीकृत ईत्पाद के जवस्ट्ताररत जीवन की समाजि पर पुनचाक्रण के जलए जनमााता के जवस्ट्ताररत जनमााता ईिरदाजयत्व में जोडा जाएगा। ईदाहरण: - यदद दकसी जनमााता पर वि ा 2023-2024 म ें 100 टन की जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व ह ै और वह 60 टन का पुनचाक्रण प्रमाण पत्र और 40 टन का नवीनीकरण प्रमाण पत्र खरीदता है, और संबंजधत वस्ट्त ु न े नवीनीकरण के कारण पांच विा का जीवन बढ़ाया ह।ै आस मामले म ें ईत्पादक के जवस्ट्ताररत जनमााता ईिरदाजयत्व का 60 टन वि ा 2023-2024 में ही प्राि कर जलया जाएगा और 40 टन यानी 30 टन के 75 प्रजतित को ईस मद के जलए वि ा 2028-2029 के जलए ईस ईत्पादक के जवस्ट्ताररत जनमााता ईिरदाजयत्व में जोडा जाएगा। (iv) जवस्ट्ताररत जनमााता ईिरदाजयत्व केवल एक रजजस्ट्रीकृत पनु चाक्रणकताा के माध्यम से जीवन की समाजि के बाद और जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाण पत्र प्रस्ट्तुत करने के बाद ही समाि दकया जाऐगा, न दक नवीनीकरण प्रमाण पत्र द्वारा। 15. जवस्ट्ताररत ईत्पादक ईिरदाजयत्व प्रमाणपत्रों का लने देन - (1) एक ईत्पादक चालू वि ा (विा Y) की ऄपनी जवस्ट्ताररत जनमााता ईिरदाजयत्व के साथ-साथ जपछले विों की दकसी भी बची हुइ और िेि देयता और वतामान विा की देयता के 5प्रजतित तक सीजमत जवस्ट्ताररत ईत्पादक ईिरदाजयत्व प्रमाणपत्र खरीद सकता ह।ै (2) जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व को ईत्पादकों द्वारा जतमाही अधार पर अनुपाजतक रूप स े जवस्ट्ताररत जनमााता जजम्मेदारी प्रमाण पत्र खरीदकर परू ा करना होगा। (3) जैसे ही जनमााता जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाण पत्र खरीदता ह,ै आसे स्ट्वचाजलत रूप से ईसकी देयता के जवरुद्ध समायोजजत कर ददया जाएगा और समायोजन में प्राथजमकता पूवा एवं पहले की दये ता को ही दी जाऐगी और आस प्रकार समायोजजत दकया गया जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्र स्ट्वतः समाि हो जाएगा और रद्द हो जाएगा। (4) जैसे ही कोइ जनमााता नवीनीकरण प्रमाण पत्र खरीदता ह,ै ईसकी जवस्ट्ताररत जनमााता ईिरदाजयत्व देयता केंद्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जनधााररत ऄवजध के जलए ईत्पाद की प्रासंजगक मात्रा के जलए स्ट्वचाजलत रूप से स्ट्थजगत कर दी जाएगी। (5) प्रत्येक ईत्पादक या पुनः चक्रणकताा या नवीनीकरणकता ा (ररफर्वबिर) के जलए जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्र की ईपलब्धता, अवश्यकता और ऄन्य जववरण एवं ब्यौरों तथा नवीनीकरण प्रमाणपत्र को पोटाल पर ईपलब्ध करा ददया जाएगा। (6) आन जनयमों के ऄधीन सभी लेन-देन को जतमाही जववरणी फाआल करते समय जवजनमााता या पुनः चक्रणकताा द्वारा पोटाल पर ररकॉडा और प्रस्ट्तुत दकया जाएगा। ऄध्याय VII जवद्यतु और आलक्ट्े रॉजनक ईपकरणों और ईनके घटकों या ईपभोग्य सामजग्रयों या भागों या पजु ों के जवजनमाणा म ें खतरनाक पदाथों के ईपयोग म ेंकमी एव ंकटौती 16. जवद्यतु और आलक्ट्े रॉजनक ईपकरणों और ईनके घटकों या ईपभोग्य सामजग्रयों या पजु ों या पजु ों के जवजनमाणा म ें खतरनाक पदाथों के ईपयोग म ें कमी – (1) ऄनुसूची-I में सूचीबद्ध जवद्युत (आलेजक्ट्रकल्स) और आलेक्ट्रॉजनक ईपकरणों और ईनके घटकों या ईपभोग्य सामजग्रयों या पाटों या कलपुजों का प्रत्येक ईत्पादक यह सुजनजित करेगा दक, नए जवद्युत और आलेक्ट्रॉजनक ईपकरण और ईनके घटक या ईपभोज्य वस्ट्तुओं या पार्टसा या पुजे में सीसा, पारा, कैडजमयम, हक्ट्े सावलेंट क्रोजमयम, पॉलीब्ोजमनेटेड बाआदफनाआल िाजमल नहीं ह ै जो सीसा के जलए समरूप सामग्री में वजन स े 0.1 प्रजतित की[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 ऄजधकतम एकाग्रता मूल्य से परे ह,ैं पारा, हक्ट्े सावलेंट क्रोजमयम, पॉलीब्ोजमनेटेड बाआदफनाआल और पॉलीब्ोजमनेटेड जडपेजनल इथर और कैडजमयम के जलए समरूप सामग्री में वजन के ऄनुसार 0.01 प्रजतित ह।ै (2) तारीख 1 मइ, 2014 से पहल े बाजार में रख े गए आलेजक्ट्रकल और आलेक्ट्रॉजनक ईपकरणों के जलए अवश्यक घटकों या ईपभोग्य सामजग्रयों या पाटां या कलपुजों को ईप-जनयम (1) के ईपबंधों स े छूट दी जा सकती ह,ै बिते खतरनाक पदाथों के ऄनरूु प भागों की कमी और पुजे ईपलब्ध नहीं ह।ैं (3) ऄनुसूची-2 में सूचीबद्ध ऄनप्रु योगों को ईप-जनयम (1) के ईपबंधों से छूट दी जाएगी। (4) ऄनुसूची-2 में सूचीबद्ध ऄनुप्रयोगों का प्रत्येक ईत्पादक यह सुजनजित करेगा दक ऄनुसूची-2 में दी गइ खतरनाक पदाथों की सीमाओं का ऄनुपालन दकया जाना ह।ै (5) प्रत्येक ईत्पादक ईपकरण के घटकों और ईनके घटकों या ईपभोग्य वस्ट्तुओं या पुजों या पुजों या पुजों के बारे म ें जवस्ट्तृत जानकारी प्रदान करेगा, साथ ही ईत्पाद ईपयोगकताा प्रलेखन में खतरनाक पदाथों के ईपबंधों में कमी के ऄनुरूपता की घोिणा करेगा। (6) नए आलेजक्ट्रकल और आलेक्ट्रॉजनक ईपकरणों के जलए बाजार म ें अयात या प्लेसमेंट की ऄनुमजत केवल ईन लोगों के जलए होगी जो ईप-जनयम (1) और (4) के ईपबंधों के ऄनरूु प ह।ैं (7) रक्षा और ऄन्य समान सामररक ऄनुप्रयोगों के जलए ईपयोग दकए जाने वाले जवद्युत और आलक्ट्े रॉजनक ईपकरणों के जनमाणा और अपूर्वत को ईप-जनयम (1) के ईपबंधों से बाहर रखा जाएगा। (8) प्रत्येक ईत्पादक ईप-जनयम (1) के ईपबंधों के ऄनपु ालन करन े पर जानकारी प्रदान करेगा और यह जानकारी स्ट्व- घोिणा के संदभ ामें होगी। (9) जवजनमााता प्रौद्योजगकीयाजवजधयों का ईपयोग करेगा जजससे ऄजं तम ईत्पाद को पुनचाक्रण योग्य बनाया जा सके; (10) जवजनमााता यह सुजनजित करेगा दक जवजभन्न जवजनमााताओं द्वारा बनाए गए घटकया पुज़े इ-कचरे या ऄपजिष्ट की मात्रा को कम करने के जलए एक-दसू रे के ऄनुकूल हों। (11) केंद्रीय प्रदिू ण जनयंत्रण बोड ाखतरनाक पदाथों में कमी के ईपबधं ों के ऄनपु ालन की जनगरानी और सत्यापन के जलए बाजार में रखे गए जबजली और आलेक्ट्रॉजनक ईपकरणों के यादजृ छछक नमूने का संचालन एवं पररचालन करेगा और नमनू े तथा परीक्षण करन े की लागत जवजनमााता द्वारा वहन की जाएगीऔर आस संबंध में ऄचानक सपैं सलग केंद्रीय प्रदिू ण जनयंत्रण बोडा के ददिा-जनदेिों के ऄनुसार ही होगी। (12) यदद ईत्पाद खतरनाक पदाथों में कमी के ईपबंधों का ऄनुपालन नहीं करता ह,ै तो और आस संबंध म ें ईत्पादक केंद्रीय प्रदिू ण जनयंत्रण बोड ा के ददिाजनदेिों के ऄनुसार ईजचत ऄवजध के भीतर ईत्पाद को ऄनपु ालन में लान े और बाजार स े ईत्पाद को वापस लेन े या वापस करन े के जलए सुधारात्मक ईपाय करेंगे। (13) केंद्रीय प्रदिू ण जनयंत्रण बोडा ऄनुसूची-I और ऄनुसूची-II में सचू ीबद्ध वस्ट्तुओं के संबंध म ें ईप-जनयम (1) में सूचीबद्ध खतरनाक पदाथों के नमून े और जवश्लेिण के तरीकों को प्रकाजित करेगा और कजथत ईद्देश्य के जलए प्रयोगिालाओं को भी सूचीबद्ध करेगा। ऄध्याय VIII जवजवध (प्रकीण)ा 17. ऄजधकाररयों के कतव्या - आन जनयमों के ऄन्य ईपबंधों के ऄधीन, ऄजधकारी ऄनुसूची-V में जनर्ददष्ट कताव्यों का पालन करेंगे। 18. वार्विक ररपोटा - केंद्रीय प्रदिू ण जनयंत्रण बोड ा जविीय वि ा के ऄतं के एक महीने के भीतर ऄपनी जसफाररिों के साथ मात्रात्मक और गुणात्मक जवश्लेिण के साथ इ-ऄपजिष्ट प्रबंधन जनयमों के कायाान्वयन की जस्ट्थजत के संबंध में पयाावरण, वन और जलवायु पररवतान मंत्रालय को एक वार्विक ररपोटा प्रस्ट्ततु करेगा। 19. इ-ऄपजिष्ट का पररवहन (रास्ट्ं पोटेिन) - जवजनमााण या पनु चाक्रण से ईत्पन्न कचरे एवं ऄपजिष्ट का ऄंजतम जनपटानएवं पररिोधन करने के जलए कचरे को ईपचार, भंडारण और जनपटान सुजवधा में ल े जाने के जलए खतरनाक और ऄन्य ऄपजिष्ट (प्रबंधन और हथालन और सीमापारीय संचालन) जनयम, 2016 के ऄधीन ईपबंधों का पालन दकया जाएगा।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 20. दघु टा ना की ररपोर्टटग करना - जहाँ भी इ-कचरे और ऄपजिष्ट को संसाजधत करन े वाली सुजवधा म ें या इ-कचरे के पररवहन के दौरान दघु ाटना होती है, यथाजस्ट्थजत जवजनमाता ा, ईत्पादक, नवीनीकरणकताा, पररवहनकताा, भंजक, या पुनचाक्रणकता,ा दघु ाटना के बारे में संबंजधत राज्य प्रदिू ण जनयंत्रण बोड ा को तरु ंत टेलीफोन और इ-मेल के माध्यम से ररपोट ा करेगा। 21. ऄपील - (1) कोइ भी व्यजि केंद्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा पाररत रजजस्ट्रीकरण के जनलबं न या रद्द करन े या आनकार करन े या ईसके नवीकरण से व्यजथत कोइ भी व्यजि, अदेि को सूजचत करने की तारीख से तीस ददनों की ऄवजध के भीतर, और आस संबंध म ें केंद्रीय सरकार द्वारा जवजधवत नाजमत पयाावरण, वन और जलवायु पररवतान मंत्रालय के ऄजतररि सजचव या संयुि सजचव को ऄपील करने की वरीयता दे सकता ह।ै (2) ऄपील प्राजधकारी यदद संतुष्ट ह ैदक ऄपीलकताा को समय पर ऄपील दायर करन े से पयााि कारणों से रोका गया था तो वह तीस ददनों की ईि ऄवजध की समाजि के बाद ऄपील पर जवचार कर सकता ह।ै 22. पयाावरण क्षजतपर्वू त - (1) केंद्रीय प्रदिू ण जनयंत्रण बोडा यहा ँ जारी आन जनयमों और ददिाजनदेिों के दकसी भी ईपबंध के ईल्लंघन के मामल े में दकसी भी आकाइ पर पयाावरण क्षजतपतू ा के अरोपण और सग्रं ह करने के जलए ददिाजनदेि जनधााररत करेगा और ईि ददिाजनदेि आन जनयमों के ऄनुसार होंग े और पयाावरण, वन और जलवायु पररवतना मंत्रालय द्वारा ऄनुमोददत होंगे। (2) केंद्रीय प्रदिू ण जनयंत्रण बोडा आन जनयमों में ऄजधकजथत दाजयत्वों की पूर्वत न करन े और लेनदने या झूठे जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्र के ईपयोग के मामले में ईत्पादकों पर पयाावरण क्षजतपूर्वत के अरोपण और संग्रह के जलए ददिा-जनदेि भी ऄजधकजथत करेगा और ईि ददिाजनदेि आन जनयमों के ऄनुसार होंग े और जलवायु पररवतान मंत्रालय द्वारा ऄनुमोददत होंगे। (3) पयाावरण क्षजतपूर्वत ईन ऄरजजस्ट्रीकृत ईत्पादकों, जवजनमााताओं, ररफर्वबिरों, पुनचाक्रणकतााओं और दकसी भी आकाइ पर भी लगाया जाऐगा जो आन जनयमों के ईल्लघं न करने में सहयोग, सहायता या प्रोत्साहन देते ह।ैं (4) (i) पयाावरण क्षजतपूर्वत के भगु तान से ईत्पादकों और जवजनमााताओं को आन जनयमों म ें जनधााररत जवस्ट्ताररत जनमााता ईिरदाजयत्व से मुजि नहीं जमलेगी और दकसी जविेि विा के जलए ऄपणू ा जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व को ऄगले वि ा और आसी तरह तीन विा तक अग ेबढ़ाया जाएगा। (ii) यदद जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व की कमी को एक विा के बाद संबोजधत दकया जाता है, तो लगाए गए पयाावरण क्षजतपूर्वत का 85 प्रजतित ईत्पादकों एव ंजनमााताओं को वापस कर ददया जाएगा, (iii) यदद जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व की कमी को दो वि ा के बाद संबोजधत दकया जाता ह,ै तो लगाए गए पयाावरण क्षजतपूर्वत का 60 प्रजतित होगा जो जनमााताओं एव ं ईत्पादकों को वापस कर ददया जाएगा, और यदद जवस्ट्ताररत जनमााता ईिरदाजयत्व के दाजयत्व की कमी को 3 विों के बाद संबोजधत दकया जाता है, तो लगाए गए पयाावरणीय क्षजतपूर्वत का 30 प्रजतित ईत्पादकों एवं जनमााताओं को वापस कर ददया जाएगा, ईसके बाद जनमााता एवं ईत्पादक को दकसी भी पयाावरण क्षजतपूर्वत या क्षजतपूर्वत को वापस नहीं दकया जाऐगा। (5) गलत सूचना के कारण पुनचाक्रणकताा द्वारा जवस्ट्ताररत ईत्पादकों के ईिरदाजयत्व प्रमाण-पत्रों के ऄजधक ईत्पादन के पररणामस्ट्वरूप रजजस्ट्रीकरण का जनरसन और पयाावरणीय क्षजतपूर्वत का ऄजधरोपण होगा जो वापस करन े योग्य नहीं होगाऔर बार-बार ऄपराध, आन जनयमों का तीन या ऄजधक बार ईल्लघं न करने पर भी पयाावरणीय क्षजतपूर्वत िुल्क के ऄलावा रजजस्ट्रीकरण का स्ट्थायी जनरसन होगा। (6) (i) पयाावरण क्षजतपूत के ऄतं गता एकत्र की गइ जनजधयों को केंद्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा एक पृथक जनलंब लेख जहसाब म ें रखा जाएगा और एकत्र की गइ जनजधयों का ईपयोग सग्रं जहत, ऄसंग्रजहत, महत्त्वपूण,ा लावाररस इ-ऄपजिष्ट और गैर-पुननावीनीकरण या इ-ऄपजिष्ट का गैर-ऄंत, जजस पर पयाावरण क्षजतपतू लगाया जाता है, ऄनुसंधान और जवकास करन,े पुनचाक्रण करन े वालो को प्रोत्साहन करन े ऄपजिष्ट प्रबंधन पररयोजनाओं के प्रबंधन के जलए स्ट्थानीय जनकायों को जविीय सहायता और सजमजत द्वारा तय दकए गए ऄन्य मदों म ेंदकया जाएगा। (ii) पयाावरण, वन और जलवायु पररवतान मंत्रालय के ऄनुमोदन के साथ संचालन सजमजत द्वारा धन के ईपयोग के जलए जनिय मात्रा और प्रमुखों पर जनणाय जलया जाएगा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 11 23. ऄजभयोजन - कोइ भी व्यजि, जो जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाण पत्र प्राि करन े के जलए आन जनयमों के ऄधीन ऄपेजक्षत गलत जानकारी प्रदान करता ह,ै दकसी भी तरीके से झूठे या जाली जवस्ट्ताररत जनमााता ईिरदाजयत्व प्रमाणपत्रों का ईपयोग करता ह ै या जानबूझकर आन जनयमों के ऄधीन ददए गए जनदिे ों का ईल्लघं न करता ह ै या सत्यापन और लेखा परीक्षा कायावाही में सहयोग करन े में जवफल रहता है, ईस पर ऄजधजनयम, 1986 की धारा 15 के ऄधीन ऄजभयोजजत दकया जाएगा और यह ऄजभयोजन जनयम 22 के ऄधीन लगाए गए पयाावरण क्षजतपूत के ऄजतररि होगा। 24. सत्यापन और लखे ा परीक्षा - केंद्रीय प्रदिू ण जनयंत्रण बोड ा स्ट्वय ं या दकसी नाजमत ऄजभकरण के माध्यम स े ईत्पादकों, जनमााताओं, नवीनीकरणकतााओं, जडस्ट्मेंटलसा और पुनचाक्रणकतााओं द्वारा आन जनयमों के ऄनुपालन को यादजृ छछक जनरीक्षण और अवजधक लेखा परीक्षा के माध्यम से जैसा भी ईजचत एवं न्यायसंगत समझेगा, सत्याजपत करेगा जजससे लेन े के जलए आन जवजनयमों के ईपबंधों के ईल्लंघन के जवरूद्ध कारावाइ जनयम 22 के ऄनुसार होगी। 25. सचं ालन सजमजत - (1) आन जनयमों के समग्र कायाान्वयन की जनगरानी के जलए ऄध्यक्ष, केंद्रीय प्रदिू ण जनयंत्रण बोड ा की ऄध्यक्षता में एक संचालन सजमजत होगी संचालन सजमजत में ऄध्यक्ष के ऄलावा जनम्नजलजखत सदस्ट्य िाजमल होंगेः क) पयाावरण, वन और जलवायु पररवतान मंत्रालय, भारत सरकार का एक प्रजतजनजध; ख) आलेक्ट्रॉजनक्ट्स और सूचना प्रौद्योजगकी मंत्रालय, भारत सरकार का एक प्रजतजनजध; ग) नवीन और नवीकरणीय उजाा मंत्रालय का एक प्रजतजनजध; घ) अवास और िहरी काया मंत्रालय का एक प्रजतजनजध; ङ) आलेजक्ट्रकल और आलेक्ट्रॉजनक ईपकरण ईत्पादक और जवजनमााता संघ के ऄजधकतम दो प्रजतजनजध; च) इ-ऄपजिष्ट पुनचाक्रण संघों के ऄजधकतम दो प्रजतजनजध; छ) संचालन सजमजत के ऄध्यक्ष द्वारा सहयोजजत राज्य प्रदिू ण जनयत्रं ण बोडा या प्रदिू ण जनयंत्रण सजमजत का एक प्रजतजनजध; ज) केन्द्रीय प्रदिू ण जनयंत्रण बोड ाके संबंजधत प्रभाग के प्रमुख - सदस्ट्य संयोजक। (2) संचालन सजमजत आन जनयमों के समग्र कायाान्वयन, जनगरानी और पयावेक्षण के जलए ईिरदायी होगा और यह समय-समय पर ईत्पन्न होन े वाले जववादों, मतभेदों और आस सबं ंध में प्राि ऄभ्यावेदन पर भी जनणाय लेगी, और आन जनयमों से संबंजधत यादकसी भी महत्वपूणा मुद्दे को पयाावरण, वन और जलवायु पररवतान मंत्रालय को संदर्वभत करेगी। (3) संचालन सजमजत केन्द्रीय सरकार के ऄनुमोदन से तकनीकी प्रगजत और ऄन्य कारकों को ध्यान में रखते हुए ऄनुसूची-I म ें ददय े गय े ददिाजनदेिों या जवस्ट्ताररत जनमााता ईिरदाजयत्व के लक्ष्य या नए जवद्युत और आलेक्ट्रॉजनक ईपकरणों को जोडने की समीक्षा और संिोधन करेगी। (4) जलए ददिाजनदिे और मानक संचालन प्रदक्रयाएं तैयार करना और जारी करना और आनजनयमों के कायाान्वयन के जलए अवश्यक प्रपत्र/जववरणी भी जारी करना। (4) इ-ऄपजिष्ट जनयमों के ऄनुपालन का पता लगाने के जलए यादजृछछक जाँच करना और सीमा िुल्क / राज्य सरकार या दकसी ऄन्य ऄजधकरण (ओं) की मदद करना। (5) दस्ट्तावेज़ीकरण, इ-कचरे पर डाटा का संकलन और केंद्रीय प्रदिू ण जनयंत्रण बोडा की वेबसाआटों पर ऄपलोड करना। (6) आन जनयमों के ईल्लंघन के जवरुद्ध कारावाइ करना। (7) राज्य प्रदिू ण जनयंत्रण बोडा और िहरी स्ट्थानीय जनकायों के ऄजधकाररयों सजहत क्षमता जवकजसत करने के जलए प्रजिक्षण कायाक्रम अयोजजत करना। (8) इ-ऄपजिष्ट प्रबंधन, अरइ/सीइ ईद्योग के साथ बातचीत करना। (13) समय-समय पर जवद्युत और आलेक्ट्रॉजनक ईपकरणों के जनमााण म ें खतरनाक पदाथों के ईपयोग में कमी के ऄनुपालन के जलए लक्ष्य को जनधााररत और संिोजधत करना (14) दकसी मान्यता प्राि प्रयोगिाला और आसकी ऄजनवाया जांच के माध्यम सेघातक पदाथों पर प्रजतबन्ध(RoHS) का ऄनुपालन और आसके प्रमाणन सुजनजित करना। (15) आन जनयमों के ऄधीन समय-समय पर मंत्रालय द्वारा प्रत्यायोजजत कोइ ऄन्य काया करना।20 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2nd November 2022 G.S.R. 801(E).—Whereas the draft rules, namely the E-Waste (Management) Rules, 2022 were published by the Government of India in the Ministry of Environment, Forest and Climate Change, vide notification number S.O. 360 (E), dated the 19th May, 2022 in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, the copies of the Gazette containing the said notification were made available to the public on the 19th day of May, 2022; AND WHEREAS, the objections and suggestions received from the public in respect of the said draft notification within the said period have been duly considered by the Central Government; NOW, THEREFORE, in exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, and in supersession of the E-waste (Management) Rules, 2016, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely: - CHAPTER I PRELIMINARY 1. Short title and commencement. - (1) These rules may be called the E-Waste (Management) Rules, 2022. (2) They shall come into force from the 1st day of April, 2023. 2. Application. - These rules shall apply to every manufacturer, producer refurbisher, dismantler and recycler involved in manufacture, sale, transfer, purchase, refurbishing, dismantling, recycling and processing of e-waste or electrical and electronic equipment listed in Schedule I, including their components, consumables, parts and spares which make the product operational but shall not apply to - (a) waste batteries as covered under the Battery Waste Management Rules, 2022; (b) packaging plastics as covered under the Plastic Waste Management Rules, 2016; (c) micro enterprise as defined in the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006); and (d) radio-active wastes as covered under the provisions of the Atomic Energy Act, 1962 (33 of 1962) and rules made there under. 3. Definitions. (1) In these rules, unless the context otherwise requires, - (a) 'Act' means the Environment (Protection) Act, 1986 (29 of 1986); (b) 'bulk consumer' means any entity which has used at least one thousand units of electrical and electronic equipment listed in Schedule I, at any point of time in the particular Financial Year and includes e-retailer; (c) ‘business’ means manufacturing, production, assembling and import of electrical and electronic equipment as listed in Schedule I and refurbishing, recycling, disposal and treatment of e-waste; (d) ‘component’ means one of the parts of a sub-assembly or assembly of which a manufactured product is made up of and into which it may be resolved and includes an accessory or attachment to another component; (e) ‘consumables’ means an item, which participates in or is required for a manufacturing process or for functioning of the electrical and electronic equipment and may or may not form part of22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] end-product and Items which are substantially or totally consumed during a manufacturing process shall be deemed to be consumables; (f) 'dismantler' means any person or entity engaged in dismantling of used electrical and electronic equipment into their components and having authorisation from concerned State Pollution Control Board or Pollution Control Committee as per the guidelines of the Central Pollution Control Board; (g) 'disposal and treatment' means any operation which does not lead to recycling, recovery or reuse and includes physicochemical or biological treatment, incineration and deposition in secured landfill; (h) ‘end-of-life’ of the product means the time when the product is intended to be discarded by the user; (i) 'environmentally sound management of e-waste' means taking all steps required to ensure that e-waste is managed in a manner which shall protect health and environment against any adverse effects, which may result from such e-waste; (j) 'electrical and electronic equipment' means equipment which are dependent on electric current or electro-magnetic field in order to become functional and also the equipment for the generation, transfer and measurements of the electricity; (k) ‘e-retailer’ means an individual or company or business entity that uses an electronic network such as internet, social media, telephone or any other media, to sell its goods; (l) 'e-waste' means electrical and electronic equipment, including solar photo-voltaic modules or panels or cells, whole or in part discarded as waste, as well as rejects from manufacturing, refurbishment and repair processes; (m) ‘extended producer responsibility’ means responsibility of any producer of electrical or electronic equipment as given in Schedule-I for meeting recycling targets as per Schedule-III and Schedule-IV, only through registered recyclers of e-waste to ensure environmentally sound management of such waste; (n) 'facility' means any location wherein the process incidental to the collection, reception, storage, segregation, refurbishing, recycling, disposal and treatment of e-waste are carried out; (o) ‘historical e-waste’ means e-waste generated from electrical and electronic equipment as specified in Schedule-I which was available on the date from which these rules come into force; (p) ‘manufacturer’ means a person or an entity or a company as defined in the Companies Act, 2013 (18 of 2013) or a factory as defined in the Factories Act, 1948 (63 of 1948) or Small and Medium Enterprises as defined in the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), which has facilities for manufacture of electrical and electronic equipment as specified in Schedule-I; (q) ‘orphaned products’ means non-branded or assembled electrical and electronic equipment as specified in Schedule-I or those produced by a company which has closed its operations; (r) ‘part’ means an element of a sub-assembly or assembly including its component, spares or accessory not normally useful by itself and not amenable to further disassembly for maintenance purposes; (s) ‘portal’ means the online system developed by the Central Pollution Control Board for the purposes of these rules; (t) ‘producer’ means any person or entity who, - (i) manufactures and offers to sell electrical and electronic equipment and their components or consumables or parts or spares under its own brand; or (ii) offers to sell under its own brand, assembled electrical and electronic equipment and their components or consumables or parts or spares produced by other manufacturers or suppliers; or[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 23 (iii) offers to sell imported electrical and electronic equipment and their components or consumables or parts or spares; or (iv) who imports used electrical and electronic equipment; irrespective of the selling technique used such as dealer, retailer, e-retailer, etc.; (u) ‘recycler’ means any person or entity who is engaged in recycling and reprocessing of waste electrical and electronic equipment or assemblies or their components or their parts for recovery of precious, semi-precious metals including rare earth elements and other useful recoverable materials to strengthened the secondary sourced materials and having facilities as elaborated in the guidelines of the Central Pollution Control Board made in this regard; (v) 'refurbisher' means any person or entity repairing or assembling used electrical and electronic equipment as listed in Schedule-I for extending its working life over its originally intended life and for same use as originally intended, and selling the same in the market; (w) ‘Schedule’ means the Schedule appended to these rules; (x) ‘spares’ means a part or a sub-assembly or assembly for substitution which is ready to replace an identical or similar part or sub-assembly or assembly including a component or an accessory; and (y) ‘target’ means the quantity of e-waste to be recycled through registered recycler by the producer in fulfilment of extended producer responsibility. (2) Words and expressions used in these rules and not defined but defined in the Act shall have the same meanings as respectively, as assigned to them in the Act. CHAPTER II Extended Producer Responsibility Framework 4. Registration. - (1) The entities shall register on the portal in any of the following category, namely: - (a) manufacturer; (b) producer; (c) refurbisher; or (d) recycler. (2) In case any entity falls in more than one categories under sub-rule (1), then the entity shall register under those categories separately. (3) No entity referred in sub-rule (1) shall carry out any business without registration. (4) The entities registered under sub-rule (1) shall not deal with any unregistered manufacturer, producer, recycler and refurbisher. (5) Where any registered entity furnishes false information or willfully conceals information for getting registration or return or report or information required to be provided or furnished under these rules or in case of any irregularity, the registration of such entity may be revoked by the Central Pollution Control Board for a period up to three-years after giving an opportunity to be heard and in addition, environmental compensation charges may also be levied as per rule 22 in such cases. (6) The Central Pollution Control Board may charge such registration fee and annual maintenance charges from the entities seeking registration under these rules based on capacity of e-waste generated or recycled or handled by them as laid down by the Central Pollution Control Board with the approval of the Steering Committee.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] CHAPTER III RESPONSIBILITIES 5. Responsibilities of the manufacturer. – All manufacturer shall have to, - (1) register on the portal; (2) collect e-waste generated during the manufacture of any electrical and electronic equipment and ensure its recycling or disposal; (3) file annual and quarterly returns in the laid down form on the portal on or before end of the month succeeding the quarter or year, as the case may be, to which the return relates. 6. Responsibilities of the producer. - The producer of electrical and electronic equipment listed in Schedule I shall be responsible for - (1) registration on the portal; (2) obtaining and implementing extended producer responsibility targets as per Schedule-III and Schedule-IV through the portal: Provided that the producer having extended producer responsibility plan under the provisions of the erstwhile E-Waste (Management) Rules, 2016 shall migrate under these rules as per the procedure laid down by the Central Pollution Control Board with approval of Steering Committee; (3) creating awareness through media, publications, advertisements, posters or by any other means of communication; (4) file annual and quarterly returns in the laid down form on the portal on or before the end of the month succeeding the quarter or year, as the case may be, to which the return relates. 7. Responsibilities of the refurbisher. – All refurbisher shall have to, - (1) register on the portal; (2) collect e-waste generated during the process of refurbishing and hand over the waste to registered recycler and upload information on the portal; (3) ensure that the refurbished equipment shall be as per Compulsory Registration Scheme of the Ministry of Electronics and Information Technology and Standards of Bureau of Indian Standards framed for this purpose; (4) file annual and quarterly returns in the laid down form on the portal on or before the end of the month succeeding the quarter or year, as the case may be, to which the return relates. 8. Responsibilities of bulk consumer. - Bulk consumers of electrical and electronic equipment listed in Schedule I shall ensure that e-waste generated by them shall be handed over only to the registered producer, refurbisher or recycler. 9. Responsibilities of the recycler. - All recycler shall have to, - (1) register on the portal; (2) ensure that the facility and recycling processes are in accordance with the standards or guidelines laid down by the Central Pollution Control Board in this regard from time to time; (3) ensure that the fractions or material not recycled in its facility is sent to the respective registered recyclers; (4) ensure that residue generated during recycling process is disposed of in an authorised treatment storage disposal facility; (5) maintain record of e-waste collected, dismantled, recycled and sent to registered recycler on the portal and make available all records for verification or audit as and when required; (6) file annual and quarterly returns in the laid down form on the portal on or before the end of the month succeeding the quarter or year, as the case may be, to which the return relates;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 25 (7) accept waste electrical and electronic equipment or components not listed in Schedule-I for recycling provided that they do not contain any radioactive material and same shall be uploaded on the portal; (8) create awareness through media, publications, advertisements, posters or by such other means of communication; (9) account for and upload information about any non-recyclable e-waste or any quantity which is not recycled and disposed of; (10) take help of dismantlers for recycling purposes: Provided that it shall be the responsibility of recycler to ensure proper material flow to and from those dismantlers and the dismantler shall give dismantled material to registered recycler only and maintain record of the same. 10. Responsibilities of State Government or Union territories. - (1) The Department of Industry in the State and Union territory or any other government agency authorised in this regard by the State Government or the Union territory, as the case may be, shall ensure earmarking or allocation of industrial space or shed for e-waste dismantling and recycling in the existing and upcoming industrial park, estate and industrial clusters. (2) Department of Labor in the State and Union territory or any other government agency authorised in this regard by the State Government or the Union territory, as the case may be, shall, - (a) ensure recognition and registration of workers involved in dismantling and recycling; (b) assist formation of groups of such workers to facilitate setting up of dismantling facilities; (c) undertake industrial skill development activities for the workers involved in dismantling and recycling; (d) undertake annual monitoring and to ensure safety and health of workers involved in dismantling and recycling. CHAPTER IV 11. Procedure for storage of e-waste. - Every manufacturer, producer, refurbisher and recycler may store the e-waste for a period not exceeding one hundred and eighty days and shall maintain a record of sale, transfer and storage of e-wastes and make these records available for inspection and the storage of the e-waste shall be done as per the applicable rules or guidelines for the time being in force: Provided that the Central Pollution Control Board may extend the said period up to three hundred and sixty-five days in case the e-waste needs to be specifically stored for development of a process for its recycling or reuse. CHAPTER V 12. Management of solar photo-voltaic modules or panels or cells. – (1) These rules shall be applicable to solar photo-voltaic modules or panels or cells, subject to provisions of this chapter. (2) Every manufacturer and producer of solar photo-voltaic modules or panels or cells shall, - (i) ensure registration on the portal; (ii) store solar photo-voltaic modules or panels or cells waste generated up to the year 2034- 2035 as per the guidelines laid down by the Central Pollution Control Board in this regard; (iii) file annual returns in the laid down form on the portal on or before the end of the year to which the return relates up to year 2034-2035; (iv) ensure that the processing of the waste other than solar photo-voltaic modules or panels or cells shall be done as per the applicable rules or guidelines for the time being in force;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (v) ensure that the inventory of solar photo-voltaic modules or panels or cells shall be put in place distinctly on portal; (vi) comply with standard operating procedure and guidelines laid down by the Central Pollution Control Board in this regard. (3) Recycler of solar photo-voltaic modules or panels or cells shall be mandated for recovery of material as laid down by the Central Pollution Control Board in this regard. CHAPTER VI 13. Modalities of the extended producer responsibility Regime. – (1) All producers shall fulfil their extended producer responsibility obligation as per Schedule-III and Schedule-IV, in doing so they may also take help of third party organisations such as producer responsibility organisations, collection centres, dealers etc.: Provided that the extended producer responsibility shall lie entirely on the producer only. (2) The extended producer responsibility for each product shall be decided on the basis of the information provided by the producers on the portal and the individual product’s life period as laid down by the Central Pollution Control Board in this regard and the targets specified in Schedule-III and Schedule-IV. (3) (i) The producer shall fulfill their extended producer responsibility through online purchase of extended producer responsibility certificate from registered recyclers only and submit it online by filing quarterly return. (ii) The details provided by producer and registered recycler shall be cross-checked on the portal. (iii) In case of any difference, the lower figure shall be considered towards fulfilment of extended producer responsibility obligation of the producer. (iv) The certificates shall be subject to environmental audit by the Central Pollution Control Board or any other agencies authorized by the Central Pollution Control Board in this regard. 14. Extended producer responsibility Certificate Generation. – (1) Recycling. - (i) The Central Pollution Control Board shall generate extended producer responsibility certificate through the portal in favour of a registered recycler in the format laid down by it in this regard. (ii) (a) The quantity eligible for generation of extended producer responsibility certificate shall be calculated by the following formula namely: *Q = Q x C EPR p f *the Q is the quantity eligible for generation of the certificate, Q is the quantity of the end EPR p product and C is the conversion factor (quantity of inputs required for production of one unit of output) f (b) Conversion factor C for each end product shall be determined by Central Pollution f Control Board with the approval of the steering committee. (iii) The validity of the extended producer responsibility certificate shall be two years from the end of the financial year in which it was generated and the expired certificate automatically extinguished after the period unless extinguished earlier as per the provisions of these rules. (iv) Each extended producer responsibility certificate shall have a unique number containing year of generation, code of end product, recycler code and a unique code and the extended producer responsibility certificates shall be in the denominations of 100, 200, 500 and 1000 kg or such other denominations as may be laid down by the Central Pollution Control Board with the approval of the Steering Committee. (2) Refurbishing. – (i) The e-waste shall also be allowed for refurbishing and refurbisher shall have to get registered on the portal and based on the data provided, refurbishing certificate shall be generated in favour of a registered refurbisher in the format laid down by it in this regard.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 27 (ii) On production of the refurbishing certificates purchased from the registered refurbishers, the extended producer responsibility of the producers shall be deferred by the duration as laid down by the Central Pollution Control Board for the corresponding quantity of e-waste and shall be added to the extended producer responsibility of the producer upon expiry of the extended life of the refurbished product. (iii) To incentivise refurbishing, only 75 per cent of the deferred quantity shall be added to the extended producer responsibility of the producer for recycling upon expiry of the extended life of the refurbished product. Example: - If a producer has extended producer responsibility obligation of 100 tonnes in the year 2023-2024 and he purchases recycling certificate of 60 tonnes and refurbishing certificate of 40 tonnes and the concerned item has extended life of five years due to refurbishing. In this case 60 tonnes of the extended producer responsibility of the producer shall be achieved in the year 2023-2024 itself and 75 per cent of the reaming 40 tonne i.e. 30 tonnes shall be carried over and added to the extended producer responsibility of that producer for the year 2028-2029 for that item. (iv) The extended producer responsibility obligation shall be extinguished only after end of life disposal through a registered recycler and producing extended producer responsibility certificate and not by refurbishing certificate. 15. Transaction of extended producer responsibility certificates. - (1) A producer may purchase extended producer responsibility certificates limited to its extended producer responsibility liability of current year (Year Y) plus any leftover liability of preceding years plus 5 per cent of the current year liability. (2) The extended producer responsibility obligation shall have to be fulfilled by the producers by proportionately purchasing extended producer responsibility certificate on quarterly basis. (3) As soon as the producer purchases extended producer responsibility certificate, it shall be automatically adjusted against its liability and priority in adjustment shall be given to earlier liability and the extended producer responsibility certificate so adjusted shall be automatically extinguished and cancelled. (4) As soon as producer purchases refurbishing certificates its extended producer responsibility liability shall be deferred automatically for the relevant quantity of the product, for the duration as laid down by the Central Pollution Control Board. (5) The availability, requirement and other details of the extended producer responsibility certificate and refurbishing certificates for every producer or recycler or refurbisher shall be made available on the portal. (6) All the transactions under these rules shall be recorded and submitted by the producers or recyclers on the portal at the time of filing of quarterly returns. CHAPTER VII REDUCTION IN THE USE OF HAZARDOUS SUBSTANCES IN THE MANUFACTURE OF ELECTRICAL AND ELECTRONIC EQUIPMENT AND THEIR COMPONENTS OR CONSUMABLES OR PARTS OR SPARES 16. Reduction in the use of hazardous substances in the manufacture of electrical and electronic equipment and their components or consumables or parts or spares. – (1) Every producer of electrical and electronic equipment and their components or consumables or parts or spares listed in Schedule I shall ensure that, new electrical and electronic equipment and their components or consumables or parts or spares do not contain Lead, Mercury, Cadmium, Hexavalent Chromium, polybrominated biphenyls and polybrominated diphenyl ethers beyond a maximum concentration value of 0.1 per cent by weight in homogenous materials for lead, mercury, hexavalent chromium, polybrominated biphenyls and polybrominated diphenyl ethers and of 0.01 per cent by weight in homogenous materials for cadmium. (2) Components or consumables or parts or spares required for the electrical and electronic equipment placed in the market prior to the 1st May, 2014 may be exempted from the provisions28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] of sub-rule (1) provided reduction of hazardous substances compliant parts and spares are not available. (3) The applications listed in Schedule-II shall be exempted from provisions of sub- rule (1). (4) Every producer of applications listed in Schedule-II shall ensure that the limits of hazardous substances as given in Schedule-II are to be complied. (5) Every producer shall provide the detailed information on the constituents of the equipment and their components or consumables or parts or spares along with a declaration of conformance to the reduction of hazardous substances provisions in the product user documentation. (6) Imports or placement in the market for new electrical and electronic equipment shall be permitted only for those which are compliant to provisions of sub-rules (1) and (4). (7) Manufacture and supply of electrical and electronic equipment used for defence and other similar strategic applications shall be excluded from provisions of sub- rule (1). (8) Every producer shall provide information on the compliance of the provisions of sub-rule (1) and this information shall be in terms of self-declaration. (9) Manufacturer shall use the technology or methods so as to make the end product recyclable; (10) Manufacturer shall ensure that component or part made by different manufacturer are compatible with each other so as to reduce the quantity of e-waste. (11) The Central Pollution Control Board shall conduct random sampling of electrical and electronic equipment placed on the market to monitor and verify the compliance of reduction of hazardous substances provisions and the cost for sample and testing shall be borne by the producer and the random sampling shall be as per the guidelines laid down by the Central Pollution Control Board in this regard. (12) If the product does not comply with reduction of hazardous substances provisions, the producer shall take corrective measures to bring the product into compliance and withdraw or recall the product from the market, within a reasonable period as per the guidelines laid down by the Central Pollution Control Board in this regard. (13) The Central Pollution Control Board shall lay down the methods for sampling and analysis of hazardous substances as listed in sub-rule (1) with respect to the items listed in Schedule-I and Schedule-II and also enlist the labs for the said purpose. CHAPTER VIII MISCELLANEOUS 17. Duties of Authorities. - Subject to the other provisions of these rules, the authorities shall perform duties as specified in Schedule-V. 18. Annual Report. - The Central Pollution Control Board shall submit an annual report to the Ministry of Environment, Forest and Climate Change regarding status of implementation of the e-waste management rules with quantitative and qualitative analysis along with its recommendations, within one month of the end of the financial year. 19. Transportation of e-waste. - Transportation of waste generated from manufacturing or recycling destined for final disposal to a treatment, storage and disposal facility shall follow the provisions under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 20. Accident reporting. - Where an accident occurs at the facility processing e-waste or during transportation of e-waste, the producer, refurbisher, transporter, dismantler, or recycler, as the case may be, shall report immediately to the concerned State Pollution Control Board about the accident through telephone and e-mail. 21. Appeal. - (1) Any person aggrieved by an order of suspension or cancellation or refusal of registration or its renewal passed by the Central Pollution Control Board, within a period of thirty days[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 29 from the date on which the order is communicated to him, prefer an appeal to the Additional Secretary or Joint Secretary, Ministry of Environment, Forest and Climate Change duly nominated by the Central Government in this regard. (2) The Appellate Authority may entertain the appeal after expiry of the said period of thirty days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time. 22. Environmental Compensation. - (1) The Central Pollution Control Board shall lay down guidelines for imposition and collection of environmental compensation on any entity in case of violation of any of the provision of these rules and guidelines issued hereunder and the said guidelines shall be in accordance with these rules and shall be approved by the Ministry of Environment, Forest and Climate Change. (2) The Central Pollution Control Board shall also lay down guidelines for imposition and collection of environmental compensation on the producer in case of non-fulfilment of obligations set out in these rules and transaction or use of false extended producer responsibility certificate and the said guidelines shall be in accordance with these rules and shall be approved by the Ministry of Environment, Forest and Climate Change. (3) The environmental compensation shall also be levied on unregistered producers, manufacturer, refurbisher, recyclers and any entity which aids or abets the violation of these rules. (4) (i) Payment of environmental compensation shall not absolve the producer from the extended producer responsibility as specified in these rules and the unfulfilled extended producer responsibility for a particular year shall be carried forward to the next year and so on and up to three years. (ii) In case, the shortfall of extended producer responsibility obligation is addressed after one year, 85 per cent of the environmental compensation levied shall be returned to the producer. (iii) In case, the shortfall of extended producer responsibility obligation is addressed after two year, 60 per cent of the environmental compensation levied shall be returned to the producer, and in case, the shortfall of extended producer responsibility obligation is addressed after three year, 30 per cent of the environmental compensation levied shall be returned to the producer, thereafter no environmental compensation shall be returned to the producer. (5) False information resulting in over generation of extended producer responsibility certificates by recycler shall result in revocation of registration and imposition of environmental compensation which shall not be returnable and repeat offence, violation of these rules for three times or more shall also result in permanent revocation of registration over and above the environmental compensation charges. (6) (i) The funds collected under environmental compensation shall be kept in a separate Escrow account by the Central Pollution Control Board and the funds collected shall be utilizsed in collection and recycling or end of life disposal of uncollected, historical, orphaned e-waste and non-recycled or non-end of life disposal of e-waste on which the environment compensation is levied, research and development, incentivising recyclers, financial assistance to local bodies for managing waste management projects and on other heads as decided by the committee. (ii) The modalities and heads for utilisation of the funds shall be decided by the Steering Committee with the approval of the Ministry of Environment, Forest and Climate Change. 23. Prosecution. - Any person, who provides incorrect information required under these rules for obtaining extended producer responsibility certificates, uses or causes to be used false or forged extended producer responsibility certificates in any manner, willfully violates the directions given under these rules or fails to cooperate in the verification and audit proceedings, may be prosecuted under section 15 of the Act, 1986 and this prosecution shall be in addition to the environmental compensation levied under rule 22. 24. Verification and Audit. – The Central Pollution Control Board by itself or through a designated agency shall verify compliance of these rules by producers, manufacturer, refurbisher, dismantlers and30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] recyclers through random inspection and periodic audit, as deemed appropriate so as to take action against violations of the provisions of these rules as per rule 22. 25. Steering Committee. - (1) There shall be a Steering Committee under the Chairmanship of Chairman, Central Pollution Control Board to oversee the overall implementation of these rules and the Steering Committee shall comprise of following other members in addition to the chair, namely: - (a) one representative of the Ministry of Environment, Forest and Climate Change; (b) one representative of the Ministry of Electronics and Information Technology; (c) one representative of the Ministry of New and Renewable Energy; (d) one representative of the Ministry of Housing and urban Affairs; (e) a maximum of two representatives of electrical and electronic equipment Producer and Manufacturer Association; (f) a maximum of two representatives of E-Waste Recycler Associations; (g) one representative of State Pollution Control Board or Pollution Control Committee as co-opted by the Chairman of the Steering Committee; (h) Head of the Concerned Division of the Central Pollution Control Board – Member- Convener. (2) The steering committee shall be responsible for overall implementation, monitoring and supervision of these rules and it shall also decide upon the disputes arisen from time to time and on representations received in this regard, and shall refer to the Ministry of Environment, Forest and Climate Change any substantial issue arisen or pertaining to these rules. (3) The steering committee shall review and revise the guidelines or extended producer responsibility target or addition of new Electrical and Electronic Equipment in Schedule I, in view of the technological advancements and other factors with the approval of the Central Government. (4) The Steering Committee shall take all such measures as it deems necessary for proper implementation of provisions of these rules. Central Pollution (1) Operation and maintenance of Extended Producer Responsibility Portal and Control Board monitoring of Extended Producer Responsibility compliance. (2) Coordination with State Pollution Control Boards (3) Prepare and issue guidelines and Standard Operating procedures for collection, storage, transportation, segregation, refurbishment, dismantling, recycling and disposal of e-waste under these rules from time to time, and also issue necessary Forms/ Returns for implementation of these rules. (4) Conduct random check for ascertaining compliance of the e-waste rules and may take help of Customs/State Government or any other agency (ies). (5) Documentation, compilation of data on e-waste and uploading on websites of Central Pollution Control Board. (6) Actions against violation of these rules. (7) Conducting training programmes to develop capacity including State Pollution Control Boards and Urban Local Bodies officials. (8) Conducting awareness programmes on e-waste management, RE/CE label, legislation to make consumers responsible towards product usage and safe disposal. (9) Integrate all stakeholders with the centralized digital system. (10) Submit Annual Report to the Ministry. (11) Enforcement of provisions regarding reduction in use of hazardous substances in manufacture of electrical and electronic equipment. (12) Interaction with IT industry for reducing hazardous substances. (13) Set and revise targets for compliance to the reduction in use of hazardous substance in manufacture of electrical and electronic equipment from time to time. (14) Ensure RoHS compliance and its certifications through a recognized lab and its mandatory checks. (15) Any other function delegated by the Ministry under these rules from time to time. 2.
