महार्ोिना.–(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा स े और इस अजधसूचना म ें दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी जिसे राज्र् म ें सक्षम प्राजधकारी द्वारा जवजधवत अनुमोदित दकर्ा िाएगा। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना म ें जवजनर्िष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप और राज्र् सरकार द्वारा िारी दििा जनिेिों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) आंचजलक महार्ोिना उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को िाजमल करने के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ास े बनार्ा िाएगी, अथाात्:- I. पर्ाावरण; II. वन और वन्द्र्िीव; III. कृजि; IV. रािस्ट्व; V. िहरी जवकास;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] VI. पर्ाटन; VII. ग्रामीण जवकास; VIII. जसचांई और बाढ़ जनर्ंत्रण; IX. नगरपाजलका; X. पंचार्ती राि; और XI. लोक जन मााण जव भाग। (4) िब तक इस अजधसूचना म ें जवजनर्िष्टा न हो, आंचजलक महार्ोिना म ें वतामान म ें अनमु ोदित भ-ू उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना म ें सभी अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और वतामान एव ं प्रस्ट्ताजवत भू-उपर्ोग की जविेिताओं का ब्र्ौरा भी दिर्ा िाएंगा। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें जवकासात्मक दक्रर्ाकलापों को जवजनर्जमत करने के जलए प्रदक्रर्ा प्रिान की िाएगी और सारणी म ें र्थासूचीबद्ध पैरा 4 म ें प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसम ें स्ट् थानीर् िनता की आिीजवका की सरु क्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् एव ं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक सिं भा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपन े कतव्या ों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबधं ों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं दकर्ा िाएगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क), म ें जवजनर्िष्टा प्रर्ोिन स े जभन्न प्रर्ोिन के जलए कृजि और अन्द्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्रीर् सरकार एवं राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबधं ों के अनुसार सक्षम प्राजधकारी के पूवा अनुमोिन स ेस्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को परू ा करने के जलए अनुमत दकर्ा िाएगा िैसे:- (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ें सुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 म ें उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुज्ञात नहीं होगा: परंत ु र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े म,ें इस उप-पैरा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनुप्रर्िु र्ा अनुत् पािक कृजि क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सज‍ मजलत की िाएगी और राज्र् सरकार द्वारा दििा-जनिेि इस रीजत स े तैर्ार दकए िाएंगे दक उसम ें ऐस े क्षेत्रों म ें र्ा उसके पास जवकास दक्रर्ाकलापों िो ऐस े क्षेत्रों के जलए हाजनकारक ह,ैं को प्रजतजिद्ध दकर्ा िा सके। (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना, राज्र् के पर्ाावरण और वन जवभागों के परामि ा स े राज्र् के पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जन‍न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:्- (i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें स े िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉट ा का नर्ा सजन्नमाणा अनुमत नहीं दकर्ा िाएगाः परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजित और अभीजहत क्षेत्रों में पर्टा न महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िने े वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्टा न दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होटल, ररिॉटा र्ा वाजणजज्र्क प्रजतष्ठान का संजन्नमााण अनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाले बहुमल्ू र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ेंध्वजन प्रििू ण की रोकथाम और जनर्ंत्रण दकर्ा िाएंगा । (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रििू ण का जनवारण और जनर्ंत्रण, वार्ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें िोजधत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाल े पर्ाावरणीर् प्रििू कों के जनस्ट्सरण के जलए सामान्द्र् मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एव ं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना स.ं का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स े बाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत स े दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न अनुमत दकर्ा िार्ेगा। (10) िैव जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना स.ं सा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनकु ूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) सलाजस्ट्टक अपजिष्ट का प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन म ें सलाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना स.ं सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकाजित सलाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माच,ा 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जवििे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (15) वाहन िजनत प्रििू ण.- वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे । (16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रििू णकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर संिोजधत मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी संजनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बने जनर्मों जिसम ें तटीर् जवजनर्मन िोन, 2011 एव ं पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 िाजमल ह ै सजहत वन (सरं क्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) अन्द्र् लागू जनर्मों के उपबधं ों तथा उनम ें दकए गए संिोधनों के अनुसार िाजसत होंगे और नीच े िी गई सारणी म ें जवजनर्िष्टा रीजत स ेजवजनर्जमत होंगे, अथाात:्- सारणी क्रम स.ं दक्रर्ाकलाप रटसपणी क. प्रजतजिद्ध दक्रर्ाकलाप 1. वाजणजज्र्क खनन, पत्थर उत्खनन और (क) पाररजस्ट्थजतकी संवेिी िोन के अतं गता वास्ट्तजवक स्ट्थानीर् अपघिणा इकाइर्ां । जनवाजसर्ों की घरेल ू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मर‍मत के जलए धरती को खोिना सज‍मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघ ु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ा ं तत्काल प्रभाव स ेप्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की फाउंडेिन बनाम भारत संघ के मामले म ें तारीख 21 अप्रैल, 2014 के आिेि के अनुसरण म ेंहोगा । 2. प्रििू ण (िल, वार्,ु मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान उत्पन्न करन े वाल े उद्योगों की स्ट्थापना । प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगीः परन्द्त ु र्ह दक केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 म ें िारी, समर्-समर् पर संिोजधत माग ा ििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार िब तक दक अजधसूचना म ें ऐसा जवजनर्िष्टा न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके न और पोल्री फामा की स्ट्थापना। 9. िोस और िैव जचदकत्सा अपजिष्ट के जलए पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी नए िोस अपजिष्ट िोस अपजिष्ट जनपटान स्ट्थल और जनपटान स्ट्थल और िोस अपजिष्ट के अपजिष्ट उपचार/प्रसंस्ट्करण सामान्द्र् भस्ट्मीकरण सुजवधा की सुजवधा की अनुमजत नहीं ह।ै औद्योजगक प्रदक्रर्ा और स्ट्वास्ट््र् स्ट्थापना। प्रजतष्ठान/अस्ट्पतालों आदि स े उत्पन्न दकसी भी प्रकार के िोस अपजिष्ट के उपचार के जलए सामान्द्र् र्ा व्यजिगत भस्ट्मीकरण सुजवधा की स्ट्थापना जनजिद्ध ह।ै ख. जवजनर्जमत दक्रर्ाकलाप 10. होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु अस्ट्थार्ी संरचनाओं के स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना की अनुमजत नहीं होगी: परंत,ु संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू दििाजनिेिों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करन े की अनुज्ञा होगी । 11. संजनमााण दक्रर्ाकलाप । (क) सरं जक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क संजनमााण अनुमत नहीं दकर्ा िाएगा: परंतु स्ट्थ ानीर् लोगों को पैराग्राफ 3 के उप परै ाग्राफ (1) म ें सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम म ें स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करन े जलए संजनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िाएगी: परन्द्त ु ऐस े लघ ु उद्योगों िो प्रििू ण उत् बोड ा द्वारा िारी समर्- समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार गैर- प्रििू णकारी उद्योग और अपररसंकटमर्, लघ ु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन स ेिेिी सामग्री से उत्पािों को उत्पन्न करन े वाल े कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 13. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 14. वन सजमजत.- पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के तहत इस अजधसूचना के उपबंधों की प्रभावी जनगरानी के जलए केन्द्रीर् सरकार एतद्वारा एक जनगरानी सजमजत का गिन करती ह ैिो जनम्नजलजखत स े पर्ाावरण और वन मंत्रालर् की अजधसूचना स.ं का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची के अधीन सज‍मजलत दक्रर्ाकलापों और इस अजधसूचना के पैरा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजिद्ध गजतजवजधर्ों के जसवार् आने वाले ऐस े दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त लेने के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् को जनर्िष्टा की िाएगी। (4) इस अजधसूचना के परै ा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजिद्ध दक्रर्ाकलापों के जसवार्, भारत सरकार के तत्क ालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना की अनुसूची के अधीन ऐसे दक्रर्ाकलापों, जिन्द्ह ें सज‍मजलत नहीं दकर्ा गर्ा ह,ै परंतु िो पाररजस्ट्थजतकी संवेिी िोन म ें आत े ह,ैं ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा । (5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघं न करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि िार्र करने के जलए सक्षम होगा। (6) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संघों के प्रजतजनजधर्ों र्ा संबंजधत जहतधारकों को, प्रत्र्ेक मामले म े आवश्र्कता के अनुसार, अपने section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on spread over an area of 100 square kilometers and situated in West Kameng District of Arunachal Pradesh; AND WHEREAS, the Sessa Orchid Wildlife Sanctuary was given the status of Wildlife Sanctuary with effect from the 19th July, 1982 vide notification no. FOR.32/IND-1/82/17706-45; AND WHEREAS, the Sessa Orchid Sanctuary is known for indigenous Orchids available in the region. The Sanctuary plays an important role in protection, conservation of Orchids and development of in-situ Orchids. It also helps in protection of wildlife and the rich biodiversity found in the Sanctuary;20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the important tree species found in the top and middle storey in the Sessa Orchid Wildlife Sanctuary are Terminelia myriocarpa (Hollock), Phoebe goalparensis (Bonsum), Amora wallichii (Amari), Ailanthus grandis (Borpat), Alstonia scholaris (Satiana), Pterospermum acerifolium (Hatipoila), Artocarpus chaplasa (samkathal), Mesua ferrea (Nahar), Michelia champaca (Titasopa), Altingia excela (Jutuli), Magnolia species (Sopa), Chakrasia tabularis (Bogipoma), Toona ciliata (Poma), Sterculia villosa (Udal), Castenopsis species (Hingori), Terminelia chebula (Hilika), Canarium resniniferum (Dhuna), Cinnamomum cesicodaphne (Gonsoroi), Gmelina arboria (Gamari), Kydia calycina (Pichola), Terminelia belerica (Bohera) ,etc; AND WHEREAS, the common associated in the Middle Storey and undergrowth present in the Sessa Orchid Sanctuary include Dillinia indica (Owtenga), Syzygium cuminii (Jamun), Albizia lucida (Moj), Lagestroemia species (Ajar), Biscofia javanica (Uriam), etc. Clerodendrum viscosum, Laportia species, Costus species, Eupethorium odoretum, Coffea bangalensis, Alpinia species, Azeratum conizoides, Hibiscus cannnabinus, Polygonum chinensis, Oxyspora paniculata, Phyllanthus Species, Solanum toryum, etc; AND WHEREAS, the major fauna found in the area are Macaca mulatta (Rhesus macaque), Macaca assamensis (Assamese macaque), Trachpithecus pileatus (Capped langur ), Muntiacus muntjake (Barking deer or Indian muntjac), Cervus unicolor (Sambar), Naemorhedus sumatraensis (Serow), Sus scrofa (Wild boar), Elephas maximus (Asiatic elephant), Ursus thibitanus (Asiatic black bear), Cuon alpines (Wild dog), Panthara tigris (Tiger), Panther pardus (Common leopard), Neofelis nebulosa (Clouded leopard), Pardofelis marmorata (Marbled cat), Felis chaus (Jungle cat), Prionailurus bengalensis (Leopard cat), Prionailurus viverrinus (Fishing cat), Melogale personata (Ferret badger), Paradoxurus hermaphrodites (Common palm civet), Martes flavigula (Yellow throated marten), Herpestes javanicus (Small Asian mongoose), Harpestes edwardsii (Grey mongoose), Manis pentadactyla (Chinese pangolin), Eurosaptor micrura (Mole), Hystrix brachyuran (Himalaya crestless squirrel), Ratufa bicolor (Malayan giant squirrel), Callosciurus pygerythrus (Hoary bellied Himalayan squirrel), Callosciurus erythraeus (Pallas’s squirrel), Dremomyslokriah (Orange-belied Himalayan squirrel), Mus Pahari (Sikkim Mouse), Bats of Micro and Mega chiroptera group etc; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Sessa Orchid Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from Zero (0) to 1 kilometres around the boundary of Sessa Orchid Wildlife Sanctuary, in the State of Arunachal Pradesh as the Sessa Orchid Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: 1. Extent and boundaries of Eco-sensitive Zone. – (1)The Eco-sensitive Zone shall be to the extent of 0 to 1 kilometres around the boundary of Sessa Orchid Wildlife Sanctuary of the Eco-sensitive Zone is 16.9237 square kilometres. The extents of Eco-senstive zone in different directions are as follows: Directions Extent North 0.50 km North-East 0.50 km East 1 km South-East 0 South 0 South –West 0 West 0 North- West 0 The extent of Eco-sensitive Zone is zero on Southern and Western direction bordering Eagle Nest Wildlife Sanctuary and its Eco-sensitive Zone.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 (2) The boundary description of Eco-sensitive Zone around Sessa Orchid Wildlife Sanctuary is appended in Annexure-I. (3) The maps of the Sessa Orchid Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC and Annexure- IID. (4) Lists of geo co-ordinates of the boundary of Sessa Orchid Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) There are no villages falling under the Eco-sensitive Zone. 2. Zonal Master Plan for Eco-sensitive Zone. -(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- i. Environment; ii. Forest and Wildlife; iii. Agriculture; iv. Revenue; v. Urban Development; vi. Tourism; vii. Rural Development; viii. Irrigation and Flood Control; ix. Municipal; x. Panchayat Raj; and xi. Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. -The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.-(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.-Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.-Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.-Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the State Government, whichever is more stringent. (9) Solid wastes.-Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.–Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.-The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.-The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (15) Vehicular pollution.-Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non- polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Setting of industries causing New industries and expansion of existing polluting industries in the pollution (Water, Air, Soil, Noise, Eco-sensitive Zone shall not be permitted: etc.). Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of major Prohibited. hydroelectric project. 4. Use or production or processing Prohibited. of any hazardous substance. 5. Discharge of untreated effluents Prohibited. in natural water bodies or land area. 6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. 7. Setting up of brick kilns. Prohibited. 8. Establishment of solid waste No new solid waste disposal site and waste treatment/ processing disposal site and common facility of solid waste is permitted within Eco sensitive zone. Further incineration facility for solid and installation of common or individual incineration facility for bio medical waste. treatment of any form of solid waste generated from industrial process and health establishment / hospitals etc. is prohibited. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale non-polluting Non polluting industries as per classification of industries issued by industries. the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 14. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.-For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. No. Constituent of the Monitoring Committee Designation (i) Deputy Commissioner, West Kameng District, Bomdila, Arunachal Pradesh Chairman; A representative of Non-governmental Organisation working in the field of (ii) Environment (including heritage conservation) to be nominated by the State Member; Government (iii) Member Secretary, State Biodiversity Board Member; Representative from Urban Development Department, West Kameng (iv) Member; District, Bomdila, Arunachal Pradesh Representative from Public Works Department, West Kameng District, (v) Member; Bomdila, Arunachal Pradesh Representative from Rural Works Department, West Kameng District, (vi) Member; Bomdila, Arunachal Pradesh An expert in the area of Ecology and Environment from reputed institution or (vii) Member; university of the State Divisional Forest Officer, Khellong Forest Division incharge of Sessa Orchid (viii) Member Secretary. Sanctuary, Sessa 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures. - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders. -The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
