L.-33004/99 सी.जी.-डी.एल.-अ.-21042023-245304 xxxGIDHxxx CG-DL-E-21042023-245304 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (iii) PART II—Section 3—Sub-section (iii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 07] नइ ददल्ली, िुक्रर्ार, ऄप्रलै 21, 2023/र्िै ाख 1, 1945 No. 07] NEW DELHI, FRIDAY, APRIL 21, 2023/VAISAKHA 1, 1945 भारत जनर्ाचा न अयोग ऄजधसचू ना नइ ददल्ली, 21 ऄप्रलै , 2023 ऄ.अ. 7(ऄ).—यतः जनर्ााचन अयोग द्वारा ददनांक 29 माच,ा 2023 के प्रसे नोट सख्ं या इसीअइ/प्र.ेनो./24/2023 के तहत घोजित कनाटा क जर्धानसभा के साधारण जनर्ाचा न और प्रसे नोट सख्ं या इसीअइ/प्र.ेनो./25/2023 ददनाकं 29 माच,ा 2023 के तहत घोजित पजं ाब म ें 04-जालधं र (ऄ0जा) ससं दीय जनर्ाचा न क्षत्रे , ओजडिा के 07-झारसगु डु ा जर्धानसभा जनर्ाचा न क्षत्रे , ईत्तर प्रदेि के 395-छानब े (ऄ0जा0) और 34-सअु र जर्धानसभा जनर्ाचा न क्षत्रे ों और मघे ालय के 23-सोजहअगं (ऄ0ज0जा0) जर्धानसभा जनर्ाचा न क्षत्रे के जलए चल रह े ईप जनर्ाचा नों के कायाक्रमों की घोिणा कर दी गइ ह।ै 2. यतः, लोक प्रजतजनजधत्र् ऄजधजनयम 1951 (संक्षेप म ें लो.प्र.ऄजधजनयम, 1951) की धारा 126कम ें यह जनर्ददष्ट दकया गया ह ैदक " (1) कोइ भी व्यजि कोइ जनगाम मत सर्ेक्षण नहीं करेगा और दकसी जनगाम मत सर्ेक्षण के पररणाम का, ऐसी ऄर्जध के दौरान जो जनर्ााचन अयोग द्वारा आस संबंध म ेंऄजधसूजचत की जाए, प्रप्रट या आलैक्ट्रॉजनक मीजडया के माध्यम से प्रकािन या प्रचार या दकसी भी प्रकार की ऄन्य रीजत म ेंप्रसार नहीं करेगा। (2) जनर्ााचन अयोग, ईपधारा (1) के प्रयोजन के जलए, जनम्नजलजखत को ध्यान में रखत ेहुए साधारण अदेि द्वारा तारीख और समय ऄजधसूजचत करेगा, ऄथाात :- (क) साधारण जनर्ााचन की दिा में, र्ह ऄर्जध मतदान के पहले ददन को मतदान के जलए जनयत समय के अरंभ होने से प्रारंभ हो सकेगी और सभी राज्यों और संघ राज्य क्षेत्रों में मतदान समाप्त होने के अधे घंटे तक जारी रह सकेगी; 2616 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(iii)] (ख) दकसी ईप-जनर्ााचन या एक साथ कराए जाने र्ाले ऄनके ईप-जनर्ााचनों की दिा में र्ह ऄर्जध मतदान के पहले ददन से ही मतदान के जलए जनयत समय के अरंभ होन ेसे प्रारंभ हो सकेगी और मतदान समाप्त होने के पश्चात् अध े घंटे तक जारी रह सकेगी: परंतु जभन्न-जभन्न ददनों पर एक साथ कराए जाने र्ाले ऄनेक ईप-जनर्ााचनों की दिा में, र्ह ऄर्जध मतदान के पहले ददन को मतदान के जलए जनयत समय के अरंभ होन ेस ेप्रारंभ हो सकेगी और ऄंजतम मतदान समाप्त होन ेके पश्चात अधे घंटे तक जारी रह सकेगी। (3) ऐसा कोइ व्यजि, जो आस धारा के ईपबंधों का ईल्लंघन करेगा ऐसी ऄर्जध के कारार्ास से, जो दो र्िा तक की हो सकेगी या जुमाान ेसे या दोनों से, दंडनीय होगा। 3. ऄब, आसजलए, लोक प्रजतजनजधत्र् ऄजधजनयम, 1951 की धारा 126क की ईपधारा (1) के ऄधीन िजियों का प्रयोग करते हुए जनर्ााचन अयोग ईि धारा की ईप-धारा (2) के ईपबंधों के दजृ ष्टगत, 10 मइ, 2023 (बधु र्ार) को पर्ू ाहा न 7:00 बज े स े ऄपराह्न 6.30 बज े के बीच की ऄर्जध को, ऐसी ऄर्जध के रूप में ऄजधसूजचत करता ह ै जजसके दौरान ईपर ईजल्लजखत साधारण जनर्ााचन और ईप-जनर्ााचनों के संदभा में दकसी भी प्रकार के एजजजट पोल का अयोजन करने तथा प्रप्रट या आलेक्ट्रॉजनक मीजडया द्वारा आसके पररणाम के प्रकािन या प्रचार ऄथर्ा दकसी भी ऄन्य तरीके से ईसका प्रचार-प्रसार करने पर प्रजतबंध होगा। 4. यह भी स्ट्पष्ट दकया जाता ह ै दक लोक प्रजतजनजधत्र् ऄजधजनयम, 1951 की धारा 126 (1) (ख) के ऄधीन ईपयिुा साधारण और ईप-जनर्ााचनों के सबंधं में मतदान की समाजप्त के जलए जनयत समय पर समाप्त होने र्ाल े 48 घंटों के दौरान दकसी भी आलेक्ट्राजनक मीजडया में दकसी भी ओजपजनयन पोल या दकसी ऄन्य मतदान सर्ेक्षण के पररणामों सजहत दकसी भी प्रकार के जनर्ााचन संबंधी मामले के प्रदिना पर प्रजतबंध होगा। [स.ं 576/एजक्ट्जट/2023/एसडीअर/खण्ड–I] अदेि से, एस.बी.जोिी, प्रधान सजचर् ELECTION COMMISSION OF INDIA NOTIFICATION New Delhi, the 21st April, 2023 O.N. 7(E).—Whereas, the schedules for the General Election to the Legislative Assembly of Karnataka has been announced by the Commission vide Press Note No. ECI/PN/24/2023 dated 29th March, 2023 and Bye Elections to the 04-Jalandhar (SC) Parliamentary Constituency in Punjab, 07-Jharsuguda Assembly Constituency of Odisha, 395-Chhanbey (SC) & 34-Suar Assembly Constituencies of Uttar Pradesh and 23- Sohiong (ST) Assembly Constituency of Meghalaya have been announced by the Press Note No. ECI/PN/25/2023 dated 29th March, 2023. 2. Whereas, Section 126A of The Representation of the People Act, 1951(in short R.P. Act, 1951) specifies that “(1) No person shall conduct any exit poll and publish or publicise by means of the print or electronic media or disseminate in any other manner, whatsoever, the result of any exit poll during such period, as may be notified by the Election Commission in this regard. (2) For the purposes of sub-section (1), the Election Commission shall, by a general order, notify the date and time having due regard to the following, namely: — (a) in case of a general election, the period may commence from the beginning of the hours fixed for poll on the first day of poll and continue till half an hour after closing of the poll in all the States and Union territories; (b) In case of a bye-election or a number of bye-elections held together, the period may commence from the beginning of the hours fixed for poll on and from the first day of poll and continue till half an hour after closing of the poll; Provided that in case of a number of bye-elections held together on different days, the period may commence from the beginning of the hours fixed for poll on the first day of poll and continue till half an hour after closing of the last poll. (3) Any person who contravenes the provisions of this section shall be punishable with imprisonment for a term which may extend to two years or with fine or with both.”[भाग II—खण् ड 3(iii)] भारत का राजपत्र : ऄसाधारण 3 3. Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act, 1951, the Election Commission, having regard to the provisions of Sub-Section (2) of the said Section, hereby notifies the period between 7.00 A.M. and 6.30 P.M. on 10-05-2023(Wednesday), as the period during which conducting and publishing or publicizing exit poll by means of the print or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection with the aforesaid General Election and bye elections, shall be prohibited. 4. It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for the conclusion of the poll in connection with the aforesaid General and bye elections.
