(1) इन जनयमों का संजिप्त नाम जिद्युत (जिलंब भगु तान अजधभार और संबंजधत मामले) (संिोधन) जनयम, 2024 ह।ै (2) ये रािपत्र म ें इनके प्रकािन की तारीख स ेप्रिृत्त होंगे। 2. जिद्युत (जिलंब भुगतान अजधभार और संबंजधत मामले) जनयम, 2022 (जिसे इसके पश्चात उक्त जनयम कहा गया ह)ै के, जनयम 7 म,ें खंड (1) स े (6) तर्ा स्ट् पष्ट ीकरण के स्ट् र्ान पर, जनम्नजलजखत खंड तर्ा स्ट् पष्ट ीकरण रख े िाएंग,े अर्ाात:् - "(क) अल्पकाजलक संजििाओं या पािर एक्सचेंि के माध्यम स े जिद्युत के क्रय और जिक्रय के जलए, दकसी भी पूिा अनुमोदित पहुचं सजहत, पहुचं को परू ी तरह स े जिजनयजमत दकया िाएगा: 1386 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] परंतु यह दक राष्ट्रीय भार प्रेषण केंद्र, जिड सुरिा के जलए असाधारण पररजस्ट्र्जतयों म,ें कारणों को जलजखत रूप म ें अजभजलजखत करने के पश् चात,् इन जनयमों के अधीन पहुचं के जिजनयमन का अस्ट्र्ायी रूप स ेपुनरीिण कर सकता ह;ै (ख) पहुचं के जिजनयमन के प्रारंभ के एक माह पश् चात,् या यदि िोध् य राजि साढे तीन माह तक असंित् त रहती ह,ै तो पहल े स े ही मौिूि पहुचं के जिजनयमन के अजतररक्त , अल्पकाजलक संजििाओं स े जभन् न अन्य संजििाओं के माध्यम स े जिद्युत के क्रय और जिक्रय के जलए पहुचं को िस प्रजतित तक जिजनयजमत दकया िाएगा। (ग) अल्पकाजलक संजििाओं स े जभन् न संजििाओं के माध्यम स े जिद्युत के क्रय और जिक्रय के जलए पहुचं को ऐसी रीजत से कम दकया या िापस जलया िाएगा दक आहरण या अतं :िपे ण िेड्यूल म ें कमी की मात्रा व् यजतक्रम के प्रत् यके माह के जलए उत्तरोत्तर िस प्रजतित बढ िाए; (घ) बकाया िोध् यों के संिाय पर, इस जनयम के अधीन पहुचं का जिजनयमन समाप्त हो िाएगा, और संिाय करने के दिन को छोड़कर, िीघ्राजतिीघ्र, परंतु एक दिन के अपश् चात,् इस े प्रत् यािततात दकया िाएगा; (ङ) राष्ट्रीय भार प्रेषण केंद्र इन जनयमों के अनुसार पहुचं के जिजनयमन को लाग ू करने के जलए जिस्ट्तृत प्रदक्रया िारी करेगा; (च) आहरण िड्ये ूल म ें इस तरह की कमी के मामले म,ें उत्पािन स्ट्टेिन म ें अपने मलू जहस्ट्से के जलए िमता प्रभारों के संिाय के सार्-सार् अंतर-राज्यीय पारेषण प्रभारों के भुगतान का िाजयत्ि भी जिजनयजमत इकाईयों के पास रहगे ा; स्ट्पष्टीकरण: इस जनयम के प्रयोिनों के जलए, यह स्ट् पष्ट दकया िाता ह ैदक:- (i) अजभव्यजक्त "अल्पकाजलक संजििा" स े एक िष ा तक की अिजध के जलए जिद्युत के क्रय या जिक्रय की संजििा अजभप्रेत ह;ै (ii) 'पहुचं ' पि स े अतं र-राज्यीय पारेषण प्रणाली तक खुली पहुचं अजभप्रेत ह।ै 3. उक्त जनयमों के जनयम 9 म,ें (क) उप-जनयम (1) के स्ट् र्ान पर, जनम्नजलजखत उप जनयम रखा िाएगा अर्ाात-् “(1) एक जितरण अनज्ञु जप् तधारी प्रत्येक उत्पािन कंपनी स,े जिसके सार् उसने जिद्युत क्रय का करार दकया ह,ै प्रत्येक दिन के जलए जिद्युत की अध् यपेिा के जलए, अपने कायक्रा म की सूचना उस दिन के जलए ड े अहडे मार्काट म ें प्रस्ट्ताि या बोली लगाने के जलए समय समाप्त होने स े कम स े कम िो घंटे पहल े िगे ा, ऐसा न करन े पर उत्पािन कंपनी, समुजचत आयोग द्वारा यर्ा जनर्िष्टा रैंपपंग और स्ट्टाट-ा अप िमता की सीमा के अध् यधीन, पािर एक्स्ट्चेंि म ें िट-डाउन के अधीन इकाई की घोजषत िमता की तलु ना म ें उपलब्ध जिद्युत सजहत गैर- अध् यपेजित अजधिषे जिद्युत का प्रस्ट् ताि करेगी: परंतु यह दक यदि उत्पािन कंपनी द्वारा इस प्रकार प्रस्ट् ताजित की गई जिद्युत को ड-े अहडे माकेट म ें मंिूरी नहीं िी िाती ह,ै तो इसके जलए पािर एक्सचेंि म ें ररयल टाइम माकेट सजहत अन्य बािार िेत्रों म ें प्रस्ट्त ाि दिया िाएगा: परंतु यह और दक बािार म ें जिद्युत का ऐसा प्रस्ट् ताि समजु चत आयोग द्वारा यर्ाजनधााररत या अंगीकृत या अजधजनयम की धारा 11 के अधीन केंद्र सरकार द्वारा िारी जनििे ों के अधीन पररकजलत, यदि लाग ू ह,ै ऊिाा प्रभार के 120% के सार् प्रयोज्य पारेषण प्रभारों स े अजधक कीमत पर नहीं होगी: परंतु यह भी दक यदि उत्पािन कंपनी, पािर एक्सचेंि म ें ऐसी गैर-अध् यपेजित अजधिेष जिद्युत का प्रस्ट् ताि करने म ें असफल रहती ह,ै तो घोजषत िमता तक पािर एक्सचेंि म ें प्रस्ट्त ाि न की गई सीमा तक गैर-अध् यपेजित अजधिेष जिद्युत जनयत प्रभारों के संिाय के जलए उपलब्ध नहीं मानी िाएगी”[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ख) उप-जनयम (5) के पश्चात, जनम्नजलजखत उप-जनयम अंत:स्ट्र्ाजपत दकया िाएगा, अर्ाात्: “(6) जिद्युत (जिलंब भुगतान अजधभार और संबंजधत मामले) (संिोधन) जनयम, 2024 के प्रारंभ होने के पंद्रह दिनों के भीतर, राष्ट्रीय भार प्रषे ण केन्द्र, इस जनयम के उप-जनयम (1) के उपबंधों को कायााजन् ित करने के जलए एक जिस्ट्तृत प्रदक्रया िारी करेगा।" [फा. स.ं 23/22/2019-आर एडं आर] श्रीकांत नागलु ापल्ल ी, अपर सजचि रटप्प ण: मूल जनयम भारत के रािपत्र, भाग-II, खंड 3, उप-खंड (i) म ें सा.का.जन. सखं यांक 416 (अ) तारीख 3 िून, 2022 द्वारा प्रकाजित दकए गए र्े। MINISTRY OF POWER NOTIFICATION New Delhi, the 28th February, 2024 G.S.R. 146(E).—In exercise of the powers conferred by sub-section (1) of section 176 of the Electricity Act, 2003 (36 of 2003), the Central Government hereby makes the following rules to amend the Electricity (Late Payment Surcharge and Related Matters) Rules, 2022, namely:- 1. (1) These rules may be called the Electricity (Late Payment Surcharge and Related Matters) (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Electricity (Late Payment Surcharge and Related Matters) Rules, 2022 (hereinafter referred to as the said Rules), in rule 7, for clauses (1) to (6) and explanation, the following clauses and explanation shall be substituted, namely:- “(a) access, including any previously approved access, for the sale and purchase of electricity through short-term contracts or power exchange, shall be regulated entirely: Provided that the National Load Despatch Centre may, in exceptional circumstances for grid security, temporarily review the regulation of access under these rules, after recording the reasons, in writing; (b) one month after the commencement of regulation of access or if the dues remain unpaid for three and a half months, access for sale and purchase of electricity through contracts other than the short-term contracts shall be regulated by ten per cent, in addition to the regulation of access already in place; (c) the reduction or withdrawal of access for sale and purchase of electricity through the contracts other than the short-term contracts shall be in such manner that the quantum of reduction in drawl or injection schedule increases progressively by ten per cent for each month of default; (d) on payment of outstanding dues, the regulation of access under this rule shall end, and it shall be restored at the earliest, but not later than one day, excluding the day on which payment is made; (e) the National Load Despatch Centre shall issue the detailed procedure to implement the regulation of access according to these rules; (f) in case of such reduction of drawl schedule, the liability for payment of capacity charges for its original share in the generating station as also the inter-state transmission charges shall remain with the regulated entity. Explanation. - For the purposes of this rule, it is hereby clarified that, - (i) the expression “short - term contract” means the contract for sale or purchase of electricity for a period up to one year; (ii) the term “access” means the open access to Inter-State Transmission System.”4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. In said rules, in rule 9,- (a) for sub-rule (1), the following sub-rule shall be substituted, namely:- “(1) A distribution licensee shall intimate its schedule for requisitioning power for each day from each generating company with which it has an agreement for purchase of power at least two hours before the end of the time for placing proposals or bids in the day ahead market for that day, failing which the generating company, shall offer, the un- requisitioned surplus power including the power available against the declared capacity of the unit under shut down, in the power exchange, subject to the limitation of ramping and start up capability as specified by the Appropriate Commission: Provided that if the power so offered by the generating company is not cleared in Day-Ahead Market, it shall be offered in other market segments, including the Real Time Market, in the power exchange: Provided further that such offer of power, in the market shall be at a price not exceeding 120 per cent of its energy charge, as determined or adopted by the Appropriate Commission or calculated under the directions, issued by the Central Government, under section 11 of the Act, if applicable, plus applicable transmission charges: Provided also that if the generating company fails to offer such un-requisitioned surplus power in the power exchange, the un-requisitioned surplus power to the extent not offered in the power exchange up to the declared capacity shall not be considered as available for the payment of fixed charges.” (b) after sub-rule (5), the following sub- rule shall be inserted, namely:- “(6) Within fifteen days of commencement of the Electricity (Late Payment Surcharge and Related Matters) (Amendment) Rules, 2024, the National Load Despatch Centre shall issue a detailed procedure to implement the provisions of the sub-rule (1) of this rule."
