New Delhi, the 23rd December, 2022
S.O. 6027(E).—In exercise of the power conferred by clauses (i), (k) and (l) of sections 14, 26 and
52 of the Energy Conservation Act, 2001 (52 of 2001), the Central Government, in consultation with the
Bureau of Energy Efficiency (BEE) hereby direct:--
(a) that every Electricity Distribution Company shall designate or appoint energy manager and
accredited energy auditor and get periodic energy accounting conducted by the appointed energy
manager and annual energy audit conducted by the appointed accredited energy auditor and furnish
reports to the State Designated Agency (SDA) and Bureau in accordance with the Bureau of
Energy Efficiency (Manner and Intervals for Conduct of Energy Audit in electricity distribution
companies) Regulations, 2021 published vide notification No. 18/1/BEE/DISCOM/2021, dated the
7th October, 2021; as amended from time to time.
(b) that in case of non-compliance of these directions or and non-submission of periodic energy
accounting reports or annual energy audit reports or such other reports as required, submission of
incorrect data or misrepresentation of facts, the State Designated Agency or Bureau or any person
as designated by the Central Government shall file petition for non-compliance to the respective
State Electricity Regulatory Commission or Joint Electricity Regulatory Commission.

NOTIFICATION
New Delhi, the 23rd December, 2022
S.O. 6028(E).—In exercise of the power conferred by section 56 of the Energy Conservation Act,
2001 (52 of 2001), the Central Government hereby makes the following rules, to further amend the Energy
Conservation (Manner of holding inquiry) Rules, 2009, namely:--
1. (1) These rules may be called the Energy Conservation (Manner of Holding Inquiry) (Amendment)
Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Energy Conservation (Manner of holding inquiry) Rules, 2009, in rule 3,--
(A) for sub-rule (1), the following sub-rule shall be substituted namely:--
“(1) The State Commission shall appoint an adjudicating officer, within one month from date of
issuance of this notification, if not appointed already”;
(B) after sub-rule (1), the following clause (a) shall be inserted namely:--
“(a) in case any existing adjudicating officer, cease to hold office due to any reason such as
superannuation, transfer or proceeding on leave, the State Commission shall appoint an alternate
adjudicating officer within one week, from the date of occurrence of such an event.”
