के साथ परित उपधारा (1) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, िारी करने का प्रस्ट्ताव करती ह,ै को पर्ाावरण (सरं क्षण) जनर्मावली 1986 के जनर्म 5 के उपजनर्म (3) की अपेक्षानुसार, ऐस े िनसाधारण की िानकारी के जलए प्रकाजित दकर्ा िाता ह ै जिनके उसस े प्रभाजवत होने की संभावना ह,ै और र्ह सूजचत भी दकर्ा िाता ह ै दक उि प्रारूप अजधसूचना पर, उस तारीख स,े जिसको इस अजधसूचना को अंतर्वाष्ट करने वाले भारत के रािपत्र की प्रजतर्ां िनसाधारण को उपलब्ध करा िी िाती ह,ैं साि दिन की अवजध की समाजि पर र्ा उसके पश् चात् जवचार दकर्ा िाएगा; ऐसा कोई व्यजि, िो प्रारूप अजधसूचना म ें अंतर्वाष्ट प्रस्ट्तावों के संबंध म ें जनर्ंत्रण म ें आता ह ै और पंिाब और हररर्ाणा के साथ सीमा साझा करता ह।ै र्ह अभर्ारण्र् जिवाजलक तलहटी म ें जस्ट्थत ह ै िो पाररजस्ट्थजतकी रूप स े संवेिनिील और भौगोजलक रूप स े अजस्ट्थर ह।ै सुखना वन्द्र्िीव िाएाँ - 76.888207 पू, ऊपर - 30.809699 उ, नीच े- 30.742053 उ) के बीच जस्ट्थत ह।ै और िहा ाँ दक , संरजक्षत क्षत्रे में जवजभन्न प्रकार की स्ट्थलाकृजतक जविेषताए ं और वनस्ट्पजतर्ों और िीवों की समद्धृ जवजवधता मौिूि ह।ै इसके पाररजस्ट्थजतक, िीव-िंत,ु पुष्प, भ-ू आकृजत जवज्ञान, प्राकृजतक और भूवैज्ञाजनक महत्व के कारण, वन्द्र्िीवों और उनके आवास की रक्षा, प्रसार और जवकास के उद्देश्र् स,े इस क्षत्रे को चंडीगढ़ प्रिासन की अजधसूचना संख्र्ा 694, HII (4)-98/4519 दिनाकं 6 माच ा1998 के द्वारा वन्द्र्िीव अभर्ारण्र् घोजषत दकर्ा गर्ा था; और िहााँ दक, 2010 के िौरान भारतीर् वन्द्र्िीव संस्ट्थान, िहे रािनू के मागाििान म ें की गई वन्द्र्िीव गणना के अनुसार, वन्द्र्िीव (संरक्षण) अजधजनर्म 1972 की अनुसूची- I के तहत सूचीबद्ध कई प्रिाजतर्ों के सुखना वन्द्र्िीव अभर्ारण्र् म ें पार् े िाने की बात कही गई ह।ै इनम ें प्रमुख प्रिाजतर्ााँ ह:ैं- तेंिआु (पेंथरे ा पाडास), सांभर (रूसा र्ूजनकलर), भारतीर् साल (मैजनस क्रैजसकाउडाटा), गोल्डन िैकाल (कैजनस ऑररर्स), इंजडर्न पीफॉवल (पावो दक्रस्ट्टेटस), ककंग कोबरा (ओदफर्ोफैगस हन्ना), अिगर/इंजडर्न रॉक पार्थन (पार्थन मोलुरस) और मॉजनटर जलिाडा (वरनस बेंगालेंजसस) । सुखना वन्द्र्िीव अभर्ारण्र् म ें मौिूि वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 के तहत सूचीबद्ध अनुसूची- II प्रिाजतर्ों म ें रेड िंगल फाउल (गलै स गैलस), रसले वाइपर (िबोइर्ा रसेली) और ग्र ेलगं ूर (सम्ने ोजपथेकस एंटेलस) सजममजलत ह;ैं और िहााँ दक, इस अभर्ारण्र् म ें जवजभन्न प्रकार की जततजलर्ां और पतंग े भी पार्े िाते ह।ैं इस अभर्ारण्र् म ें िीमक एंजथल भी पार् े िाते ह ैं िो माइक्रोटर्मास और ओडोन्द्टोटर्मास िैसे िीमकों को आश्रर् िते े ह ैं - िो काबाजनक पिाथों के अपघटन के जलए आवश्र्क िीव ह।ैं क्षत्रे म ें मौिूि खाद्य कवक म ें पफ बॉल्स (लाइकोपडना पुजसलम) और टर्माटोमाइसेस भी ह;ैं और िहााँ दक, िैव-जवजवधता समृजद्ध की िजृ ष्ट स,े र्ह िन्द्तओंु की कई प्रिाजतर्ों का आवास ह ै जिसम ें संकटग्रस्ट्त भारतीर् पैंगोजलन और नािुक सामान्द्र् तेन्द्िर्ु े आते ह।ैं हालााँदक, इस क्षत्रे म ें कोई भी प्रिाजत गंभीर रूप स े लुिप्रार् र्ा स्ट्थाजनक नहीं ह,ै दफर भी संरजक्षत क्षत्रे म ेंमौिूि अविेष िैव जवजवधता के जलए क्षत्रे का संरक्षण और सुरक्षा करना आवश्र्क ह;ै और िहााँ दक, अभर्ारण्र् म ें पड़े ों, झाजड़र्ों, पवातारोजहर्ों और िड़ी-बूरटर्ों की कई प्रिाजतर्ााँ ह,ैं इसके अलावा थैलोफाइट्स, ब्रार्ोफाइट्स, टेररडोफाइट्स और लाइकेन की ष्टकोण स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें संरजक्षत और सुरजक्षत करना और उद्योगों को प्रजतबंजधत करना आवश्र्क ह ै र्ा उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों की श्रेणी और उनके संचालन और उनकी प्रदक्रर्ाओं पर भी प्रजतबन्द्ध लगाना आवश्र्क ह;ै और िहााँ दक, हररर्ाणा सरकार न े अपन े पत्र संख्र्ा 682, दिनांक 16 फरवरी, 2024 के माध्र्म स े र्ह जविेष रूप स े कहा ह ै दक हररर्ाणा की ओर के सुखना झील अभर्ारण्र् के आसपास पाररजस्ट्थजतकी सवं ेिी िोन की घोषणा के जलए र्ह प्रारुप अजधसूचना पंिाब और हररर्ाण उच्च न्द्र्ार्ालर् के दिनांक 02 माच,ा 2020 के उस आििे के अनरुु प ह ै िो उसन े ररट र्ाजचका (सी) स.ं 18253/2009 और 5809/2015 : न्द्र्ार्ालर् का स्ट्वर् ं का प्रस्ट्ताव बनाम चण्डीगढ़ प्रिासन म ेंदिर्ा ह।ै अतः अब, केन्द्र सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे एतजश्मन ् पश्चात पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उप-धारा (2) के खडं (v) और खंड (xiv) एव ं उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, हरर्ाणा राज्र् के सखु ना वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 1.0 दकलोमीटर स े 2.035 दकलोमीटर तक जवस्ट्तृत क्षत्रे को सुखना वन्द्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिस े एतजश्मन ् पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै र्था:- (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार और सीमा.- 1) र्ह पाररजस्ट्थजतकी संवेिी िोन (ईएसिडे ) सामान्द्र् तौर पर हररर्ाणा की ओर सुखना वन्द्र्िीव अभर्ारण्र् की सीमा स े 1000 मीटर तक फैला हुआ ह।ै उत्तरी भाग म ें र्ह आरजक्षत वन म ें 2 दकमी तक और बढ़ गर्ा ह।ै पूवी भाग म,ें पाररजस्ट्थजतकी सवं ेिी िोन सीमा लगभग 1000 मीटर ह,ै िो आरजक्षत वन की सीमा के साथ-साथ िाती ह।ै हालााँदक, इस े आरजक्षत वन की सीमा के साथ सह-सीमावती बनाने के जलए िजक्षण-पूवी भाग का जवस्ट्तार दकर्ा गर्ा ह।ै इस पाररजस्ट्थजतकी संवेिी िोन का कुल क्षेत्रफल 24.60 वगा दकलोमीटर ह।ै 2) इस पाररजस्ट्थजतकी संवेिी िोन को चार िोनों म ें बाटं ा गर्ा ह।ै िोन-I का जवस्ट्तार सुखना वन्द्र्िीव अभर्ारण्र् की सीमा स े 100 मीटर तक होगा, िबदक िोन-II म ें संरजक्षत क्षत्रे की सीमा स े 100 मीटर स े 300 मीटर के बीच का क्षत्रे आर्गे ा। िोन-III म ें संरजक्षत क्षत्रे की सीमा स े 300 मीटर स े 700 मीटर के अंतगात आन े वाला क्षत्रे आर्गे ा। इस संरजक्षत क्षत्रे की सीमा स े 700 मीटर स े 1000 मीटर तक के िषे क्षत्रे को िोन-IV के रूप म ें नाजमत दकर्ा िाएगा। (3) प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन के अंतगता िस गावं र्ानी प्रेमपुरा, सोखोमािरी, िामला, लोहगढ़, मानकपुर िाकरिास, सरू िपुर, चंडीमंदिर कोटला, िरा ा खरौनी, रामपुर और सकेतरी/महािेवपुर आते ह।ैं प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन का कुल क्षेत्रफल 6078.98 एकड़ (2460.07 हक्े टेर्र) होगा। प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन म ेंअन्द्र् बातों के साथ-साथ जनम्नजलजखत क्षत्रे िाजमल होंगे .- i) हररर्ाणा िहरी जवकास प्राजधकरण (एचएसवीपी) के तहत आने वाले सेक्टर 1, सेक्टर 2 का कुछ जहस्ट्सा और जिमखाना क्लब समेत सेक्टर 3 । ii) कुछ ट्यूबवले चैंबर, पैरा ग्लाइझडंग उद्यान और सेक्टर-1 एमडीसी के अंतगात आने वाला क्षत्रे ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART पंचकुला के अंतगात आने वाले क्षत्रे का भाग। v) प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाल े िस गांवों म ें स े िो गांव-सकेतरी और प्रेमपरु ा सुखना वन्द्र्िीव अभर्ारण्र् की सीमा स े 700 मीटर के िार्रे म ें आते ह।ैं िबदक सकेतरी गांव म ें घर सुखना वन्द्र्िीव अभर्ारण्र् की सीमा स े 0.00 मीटर की िरू ी पर जस्ट्थत ह,ैं िबदक प्रेमपुरा गांव की बस्ट्ती सुखना वन्द्र्िीव अभर्ारण्र् की सीमा स े 300 मीटर स े 700 मीटर की िरू ी पर ह।ै (4) ऐस ेक्षत्रे का सीमा जववरण अनलु ग्नक I म ेंदिर्ा गर्ा ह।ै (5) पाररजस्ट्थजतकी सवं िे ी िोन का मानजचत्र अनलु ग्नक II म ेंदिर्ा गर्ा ह।ै (6) सखु ना वन्द्र्िीव अभर्ारण्र् (सारणी क) और इसके पाररजस्ट्थजतकी सवं िे ी िोन (सारणी ख) के अक्षािं और िेिातं र को अनलु ग्नक III के रूप म ेंदिर्ा गर्ा ह।ै (7) प्रमुख झबंिओंु के समन्द्वर् के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची अनुलग्नक IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन की आचं जलक महार्ोिना.– 1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अंजतम अजधसूचना के प्रकािन की तारीख स े िो वष ा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा स े और इस अजधसूचना म ें दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी (2) आंचजलक महार्ोिना को राज्र् सरकार के सक्षम प्राजधकारी स े जवजधवत अनुमोदित कराना होगा। (3) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन की आचंजलक महार्ोिना को इस अजधसूचना म ें जवजनर्िाष् ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप और राज्र् सरकार द्वारा िारी दििा जनिेिों, र्दि कोई हों, के अनुसार तैर्ार दकर्ा िार्ेगा। (4) आंचजलक महार्ोिना को संबंजधत राज्र् के सभी जवभागों र्था:- (i) पर्ाावरण; (ii) वन; (iii) िहरी जवकास; (iv) पर्ाटन; (v) नगरपाजलका; (vi) रािस्ट्व; (vii) कृजष और (viii) हररर्ाणा राज्र् प्रिषू ण जनर्ंत्रण बोड ा के परामि ा स े तैर्ार दकर्ा िार्ेगा जिससे दक इसम ें पर्ाावरण और पाररजस्ट्थजतक जवचारों को समाजहत दकर्ा िा सके। (5) िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, आंचजलक महार्ोिना म ें वतामान म ें अनुमोदित भ-ू उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह ेअजधक कारगर और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (6) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मिृ ा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐस ेअन्द्र् पहलुओं की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (7) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों एव ं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का जनधाारण दकर्ा िाएगा। (8) आंचजलक महार्ोिना म ें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास सुजनजश्चत करन े के जलए पाररजस्ट्थजतकी संवेिी िोन म ेंहोने वाले जवकास का जवजनर्मन दकर्ा िाएगा। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसचू ना के उपबधं ों को प्रभावी बनान े के जलए जनम्नजलजखत उपार् करेगी, र्था:- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए अजभज्ञात उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा औद्योजगक संबंजधत जवकास दक्रर्ाकलापों के जलए प्रर्ोग र्ा इसके संपररवतान की अनुमजत नही होगी: बिते दक पाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्िुा भाग (क) म ें जवजनर्िाष्ट प्रर्ोिन स े जभन्न दकसी प्रर्ोिन के जलए कृजष और अन्द्र् भूजम का संपररवतान को जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्र सरकार र्ा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार सक्षम प्राजधकारी के पवू ा अनुमोिन स े स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को परू ा करने के जलए अनुमजत िी िा सकेगी:- i. जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; ii. बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; iii. प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; iv. कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और v. पैरा-4 म ेंर्था उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः बिते र्ह भी दक राज्र् सरकार के अनुमोिन के जबना एव ं भारत के संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी। बिते र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अंतगात आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िा सकेगा और उि त्रुरट को सुधारे िाने की सूचना केंर सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: बिते र्ह भी दक उपरोि त्रुरट को सुधारने म,ें इस उप-पैरा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा में भू-उपर्ोग का पररवतान िाजमल नहीं होगा। बिते र्ह भी दक हररत क्षत्रे , िैसे वन क्षत्रे और कृजष क्षत्रे म ें कोई पररणामी कमी नहीं आने िी िार्गे ी और अनुप्रर्िु र्ा अनुत् पािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पुन: वनीकरण दकए िान े के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- आंचजलक महार्ोिना म ें सभी प्राकृजतक िलमागों के आवाह क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम मजलत की िाएगी और राज्र् सरकार द्वारा िल आवाह प्रबंधन र्ोिना इस रीजत स े बनाई िाएगी दक इस क्षत्रे म ें र्ा इसके नििीक उन जनमाणा दक्रर्ाकलापों पर प्रजतबन्द्ध लगार्ा िार्गे ा िो इस क्षत्रे के जलए घातक हों। (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (i) पाररजस्ट्थजतकी संविे ी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार होगा। (क) पाररजस्ट्थजतकी पर्ाटन महार्ोिना, राज्र् के पर्ाावरण और वन जवभागों के परामिा स े राज्र् के पर्ाटन जवभाग द्वारा बनार्ी िाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (ग) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (घ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंग,े र्था:- (i) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्टा न दक्रर्ाकलापों का जवस्ट्तार, पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी पाररजस्ट्थजतकी पर्ाटन दििाजनिेिों तथा पाररजस्ट्थजतकी-पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाल े राष्ट्रीर् बाघ संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी-पर्ाटन दििाजनििे ों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (ii) िोन 1 (सुखना वन्द्र्िीव अभर्ारण्र् की सीमा स े हररर्ाणा की ओर 100 मीटर की िरू ी तक) और िोन 2 (सुखना वन्द्र्िीव अभर्ारण्र् की सीमा स े हररर्ाणा की ओर 100 स े 300 मीटर की िरू ी तक) के भीतर होटलों और ररसोटों के नर् ेजनमााण की अनुमजत नहीं होगी। (iii) िब तक इस आंचजलक महार्ोिना के अनुमोिन नहीं जमल िाता ह ै तब तक समबजन्द्धत जवजनर्ामक अजधकारी पर्ाटन के जवकास और वतामान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार के जलए कोई भी अनुमजत मानीटररंग कमेटी के द्वारा ऐस े स्ट्थल जविेष की गई िांच और उसकी जसफाररिो के आधार पर ही िगें े। (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाले बहुमल्ू र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररजव ा क्षत्रे , िैल सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि का पता लगार्ा िार्ेगा और उनकी सुरक्षा एव ं संरक्षण, के जलए आंचजलक महार्ोिना के भाग के रूप म,ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके सरं क्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रिषू ण.- पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसम ें संिोधन के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण दकर्ा िाएंगा । (7) वार् ु प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रिषू ण का जनवारण और जनर्ंत्रण भारत सरकार के पर्ाावरण एव ं वन मंत्रालर् द्वारा अजधसूचना क्रमांक िी.एस.आर. 351 (ई), दिनांक 15 मई, 1981 द्वारा िारी वार् ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 द्वारा प्रकाजित और उसके अधीन बनाए गए जनर्मों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण भारत सरकार के पर्ाावरण एव ं वन मंत्रालर् द्वारा अजधसूचना क्रमांक िी.एस.आर. 58(ई), दिनांक 27 फरवरी 1975 द्वारा िारी िल (प्रिषू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण (संरक्षण) अजधजनर्म, 1986 द्वारा प्रकाजित और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार होगा । (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एव ं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान समर्-समर् पर र्था संिोजधत िोस अपजिष्ट प्रबंधन जनर्म, 2016, िो भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना स.ं का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 द्वारा प्रकाजित दकए गए थ,े के उपबंधों के अनुसार दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट का सरु जक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनमु त दकर्ा िार्ेगा। (10) िवै जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ावा रण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना स.ं सा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत दकर्ा िार्गे ा। (11) ्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें ्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसचू ना स.ं सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकाजित ्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ावा रण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना स.ं सा.का.जन 317(अ), तारीख 29 माच,ा 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जविषे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण.- वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लाग ू जवजधर्ों के अनुसार दकर्ा िाएगा। स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे िैस-े सीएनिी, एलपीिी आदि । (16) औद्योजगक ईकाइर्ां.- (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा। इसके अजतररि, गैर प्रिषू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ैउनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी संवेिी िोन के भीतर प्रजतबंजधत र्ा जवजनर्जमत दकर्ा िाना ह ैउन दक्रर्ाकलापों की सूची- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) के उपबंधों और उसके अधीन बन े जनर्मों जिसम ें एव ं पर्ाावरणीर् प्रभाव आकलन अजधसूचना (ईआईए), 2006 िाजमल ह ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) अन्द्र् लाग ू जनर्मों के उपबंधों तथा उनम ें दकए गए सिं ोधनों के अनुसार िाजसत होंगे और नीच े िी गई सारणी म ें सभी प्रकार के नए और जवद्यमान खनन (लघ ु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां । इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी; (ख) खनन कार्ा टी. एन. गोिावमान जतरुमुलपाि बनाम भारत संघ 435/2012 में गोवा फाउडेिन बनाम भारत संघ के मामले में और आईए. सं. 1000/2003 के दिनांक 03.06.2022 के जनणार् में और उसके बाि आईए. सं. 131377/2022 के दिनांक 26.04.2023 और 28.04.2023 के जनणार् में माननीर् उच्चतम न्द्र्ार्ालर् के आर्े आिेिों के अनुसार ही दकर्े िार्ेगें। 2. नई आरा जमलों की स्ट्थापना। प्रजतजषद्ध। 3. प्रिषू ण (िल, वार्ु, मृिा, ध्वजन, प्रजतजषद्ध। आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । 4. दकसी पररसंकटमर् पिाथा का प्रजतजषद्ध। प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । 5. िलावन लकड़ी का उपर्ोग। प्रजतजषद्ध। 6. प्राकृजतक िल जनकार्ों र्ा भूजम प्रजतजषद्ध। क्षेत्र म ें अनुपचाररत बजहस्रावों का जनस्ट्सरण । 7. भूिल संचर्न सजहत वाजणजज्र्क पाररजस्ट्थजतकी संवेिी िोन में भूिल सजहत प्राकृजतक िल संसाधनों का िल संसाधन। व्यावसाजर्क उपर्ोग जनजषद्ध होगा और पानी के प्रिषू ण र्ा प्रिषू ण को रोकने के जलए सभी किम उिाए िाएंगे। 8. नए थमाल और बड़ी िल जवद्युत प्रजतजषद्ध। पररर्ोिनाओं की स्ट्थापना । 9. नए लकड़ी-आधाररत उद्योग। पाररजस्ट्थजतकी संवेिी िोन की सीमा के भीतर दकसी भी नए लकड़ी- आधाररत उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी: परंतु मौिूिा लकड़ी-आधाररत उद्योग कानून के अनुसार िारी रह सकता ह:ै परंतु मौिूिा आरा जमलों के लाइसेंस का नवीनीकरण उनकी समाजि पर नहीं दकर्ा िाएगा। 10. फमों, कॉपोरेट और की छोटे पैमाने के पोल्री फामा ही स्ट्थाजपत दकए िा सकें। स्ट्थापना। ख.जवजनर्जमत दक्रर्ाकलाप 11. होटलों और ररसोटों की 21.09.2004 में भारतीर् सवेक्षण द्वारा जचजत्रत मानजचत्र के अनुसार वाजणजज्र्क स्ट्थापना । और पंिाब और हररर्ाणा उच्च न्द्र्ार्ालर् के ररट में 02 माचा, 2020 के आिेि के अनुरूप, सुखना वन्द्र्िीव अभर्ारण्र् के िलग्रहण क्षेत्र में दकसी भी नए वाजणजज्र्क होटल और ररसॉटा की अनुमजत नहीं िी िाएगी। र्ाजचका (सी) संख्र्ा 18253/ 2009 और 5809/2015: कोटा अपने स्ट्वर्ं के प्रस्ट्ताव बनाम चंडीगढ़ प्रिासन पर। परंतु पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, सभी नई पर्ाटन[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 दक्रर्ाकलापों र्ा मौिूिा दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी-पर्ाटन महार्ोिना के अनुरूप होगा। 12. जनमााण दक्रर्ाकलाप । (क) 21.09.2004 में भारतीर् सवेक्षण द्वारा जचजत्रत मानजचत्र के अनुसार और पंिाब उच्च न्द्र्ार्ालर् के आिेि दिनांक 02 माचा, 2020 के अनरूु प सुखना वन्द्र्िीव अभर्ारण्र् के िलग्रहण क्षेत्र में दकसी भी प्रकार के नए जनमााण की अनमु जत नहीं िी िाएगी। हररर्ाणा ररट र्ाजचका (सी) संख्र्ा 18253 वषा 2009 और 5809 वषा 2015 में: न्द्र्ार्ालर् अपने स्ट्वर्ं के प्रस्ट्ताव बनाम चंडीगढ़ प्रिासन पर। परंतु, स्ट्थानीर् जनवाजसर्ों को स्ट्थानीर् जनवाजसर्ों की आवासीर् िरूरतों को पूरा करने के जलए भवन उपजनर्मों के अनुसार पैराग्राफ 5 के उप पैराग्राफ (1) में सूचीबद्ध गजतजवजधर्ों सजहत उनके वास्ट्तजवक आवासीर् उपर्ोग के जलए अपनी भूजम पर जनमााण करने की अनुमजत िी िाएगी। (ख) प्रिषू ण न फैलाने वाले लघु उद्योगों से संबंजधत जनमााण गजतजवजध को लाग ू जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकर्ा िाएगा। (ग) इसके अलावा, नागररक सुजवधाओं का जनमााण और संवद्धना लागू जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार जवजनर्जमत दकर्ा िाएगा। 13. जवद्युत और संचार टॉवर लगाने, हररर्ाणा राज्र् सरकार द्वारा जवजनर्जमत होगा; भूजमगत केबल जबछाने तारजबछाने तथा अन्द्र् बुजनर्ािी - को बढ़ावा दिर्ा िाएगा ढांचे की व्यवस्ट्था । 14. वृक्षों की कटाई । (क) पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के भीतर राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर प्रधान मुख्र् वन संरक्षक (वन बल प्रमुख) र्ा प्राजधकरण, जिसे िजिर्ां िी गई ह,ैं की पूव ा अनुमजत के जबना वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंरीर्/राज्र् कानूनों/वन कानूनों र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 15. जवद्यमान सड़कों को चौड़ा करना, पाररजस्ट्थजतकी संवेिी िोन में नई सड़कों का जनमााण और जवद्यमान उन्द्ह ें सुिढृ बनाना और नई सड़कों को चौड़ा करना र्ा सुिढ़ृ करना लाग ूजनर्मों और जवजनर्मों, र्दि सड़कों का जनमााण। कोई हो, के अधीन जवजनर्जमत होगा । 16. उच्च-तनाव पारेषण लाइनों का लागू जवजधर्ों के अधीन जवजनर्जमत होगा; भूजमगत केबल जबछाने को जनमााण। बढ़ावा दिर्ा िाएगा। 17. जविेिी प्रिाजतर्ों को लाना। पाररजस्ट्थजतकी संवेिी िोन में जवििे ी प्रिाजतर्ों को लाना लागू जवजधर्ों के अधीन जवजनर्जमत होगा । 18. होटल और लॉि के पररसर की पाररजस्ट्थजतकी संवेिी िोन में होटल और लॉि के पररसरों की बाड़ बाड़ लगाना। लगाना लागू कानूनों के अधीन जवजनर्जमत होगा । 19. वार्ु (ध्वजन सजहत) और वाहन लागू की खेती, बागवानी र्ा कृजष-आधाररत उद्योग िो उत्पािों का उत्पािन करते ह।ैं पाररजस्ट्थजतकी-संवेिी िोन से स्ट्विेिी सामग्री की अनुमजत सक्षम प्राजधकारी द्वारा िी िाएगी। 24. पर्ाटन से संबंजधत दक्रर्ाकलाप लागू जवजधर्ों के अधीन जवजनर्जमत होगा । िैसे दक राष्ट्रीर् उद्यान क्षेत्र के ऊपर से हवाई िहाि, गमा हवा के गुब्बारे से उड़ान भरना। 25. िोस अपजिष्ट प्रबंधन। लागू जवजधर्ों के अधीन जवजनर्जमत होगा । 26. ्लाजस्ट्टक कैरी बैग का उपर्ोग. लागू जवजधर्ों (अन्द्र्था प्रिान दकए गए को छोड़कर) के अधीन जवजनर्जमत होगा । 27. पाररजस्ट्थजतकी-पर्ाटन गजतजवजध। लागू जवजधर्ों के अधीन जवजनर्जमत होगा । ग.सवं र्धता दक्रर्ाकलाप 28. डेर्री, डेर्री फार्मिंग और मत्स्ट्र् पर्ाावरण-अनुकूल कृजष और बागवानी की अनुमजत िी िाएगी। पालन के साथ-साथ स्ट्थानीर् समुिार्ों द्वारा चल रही कृजष और बागवानी प्रथाएं। 29. वषाा िल संचर् । esz-mef@nic.in DRAFT NOTIFICATION WHEREAS, Sukhna Wildlife Sanctuary is under the administrative control of the Union Territory of Chandigarh and shares boundary with Punjab and Haryana. The Sanctuary is located in Shivalik foothills which are ecologically sensitive and geologically unstable. The total area of Sukhna Wildlife Sanctuary is 25.9849 sq. km. (6420.99 acres). It is situated in between the longitude and latitude (Left - 76.810241 E, Right - 76.888207 E, Top - 30.809699 N, Bottom - 30.742053 N). AND WHEREAS, the Protected Area contains variety of topographical features and rich diversity of flora and fauna. Due to its ecological, faunal, floral, geo-morphological, natural and geological significance, for the purpose of protecting, propagating and developing wildlife and its habitat, this area was declared as Wildlife Sanctuary vide Chandigarh Administration notification No. 694, HII (4)-98/4519 dated the 6th March, 1998; AND WHEREAS, as per wildlife census carried out under the guidance of Wildlife Institute of India, Dehradun during 2010, many species as listed under Schedule-I of the Wildlife (Protection) Act 1972, have been reported in Sukhna Wildlife Sanctuary. The prominent species among them includes common Leopard (Panthera pardus), Sambar (Rusa unicolor), Indian Pangolin (Manis crassicaudata), Golden Jackal (Canis aureus), Indian Peafowl (Pavo cristatus), King Cobra (Ophiophagus hannah), Ajgar/ Indian Rock Python (Python molurus) and Monitor Lizard (Varanus bengalensis). Schedule-II species listed under the Wildlife (Protection) Act, 1972, present in Sukhna Wildlife Sanctuary includes Red Jungle Fowl (Gallus gallus), Russell’s Viper (Daboia russelii) and Grey Langur (Semnopithecus entellus); AND WHEREAS, the sanctuary harbours a variety of butterflies and moths. The sanctuary inhabits termite anthills which harbour termites like Microtermes and Odontotermis- the organisms necessary for the decomposition of organic matter. The edible fungi present in the area include Puff Balls (Lycoperdon pusillum) and Termitomyces; AND WHEREAS, from biodiversity richness point of view, it is home to a number of faunal species including the endangered Indian Pangolin and vulnerable Common leopard. Although, no critically endangered or endemic species is found in the area, yet it is necessary to conserve and protect the area for the remnant biodiversity present in the Protected Area; AND WHEREAS, there are a number of species of trees, shrubs, climbers and herbs in the sanctuary besides a good representation of Thallophytes, Bryophytes, Pteridophytes and lichens. The prominent tree species are: Khair (Acacia catechu), Amla (Emblica officinalis), Baheda (Terminalia bellirica), Sain (Terminalia alata), Kachnar (Bauhinia variegata), Phulai (Acacia modesta), Kikar (Acacianilotica), Ronjh (Vachellia leucophloea), Shisham (Dalbergiasissoo), Chhal (Anogeissus latifolia), Neem (Azadirachtaindica), Semal (Bombaxceiba), Dhak (Buteamonosperma), Kachnar (Bauhinia variegata), Mulberry (Morus alba), Paper Mulberry (Brossounetia papyrifera), Jhingan (Lannea coromandelica), Tendu (Dyospyrosmontana), Karhi Patta (Murraya koenigii), Mesquite (Prosopisjuliflora), Amaltas(Cassia fistula), Ber/ Indian Jujube (Ziziphus jujube). The prominent shrubs are Adusa/Common Cough Cure (Justicia adhatoda), Karaunda (Carissa carandus), Kainth (Pyrus pashia) and Samhalu (Vitexnegundo) etc. Maljhan/Camel Foot Climber (Phanera vahlii) is the prominent climber of the sanctuary; AND WHEREAS, the main faunal species found in the area are Common Leopard (Panthera pardus), Sambar (Rusa unicolor), Barking Deer (Muntiacus muntjak), Indian Pangolin (Manis crassicaudata), Wild Boar (Sus scrofa), Jackal (Canis aureus indicus), Small Indian Civet (Viverricula indica), Jungle Cat (Felis chaus), Indian Crested Porcupine (Hystrix indica), Hanuman Langur (Semnopithecus entellus), Rhesus Macaque (Macaca mulatta),[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 Indian Hare (Lepus nigricollis), Common Mongoose (Urva edwardsii), Five Striped Squirel (Funambulus pennati) etc.; AND WHEREAS, there are more than 250 species of birds including aquatic water fowls. Prominent among them are: Common Crow (Corvus splendens), Indian Sparrow (Passer domesticus), Bee Eater (Merops orientalis), Purple Sunbird (Cinnyris asiaticus) Indian Peafowl (Pavo crsitatus), Red Jungle Fowl, Grey Partridge (Ortygornis pondicerianus), Cuckoos, Indian Night Jar (Caprimulgus asiaticus), Eurasian Golden Oriole (Oriolus oriolus), White Throated Kingfisher (Halcyon smyrnensis), Pied Kingfisher (Ceryle rudis), Indian Swift (Aerodramus unicolor), Common Hoopoe (Upupa epops), Hornbills, Coppersmith Barbet (Megalaima haemacephala), Brown Headed Barbet (Megalaima zeylanica), Black Rumped Flameback Woodpecker (Dinopium benghalense), Indian Roller (Coracias benghalensis), Barn Owl (Tyto alba), Rose Ringed parakeet (Psittacula krameri), Plum Headed Parakeet (Himalayapsitta cyanocephala) Alexandrine Parakeet (Psittacula eupatria) Ring Necked Dove (Streptopelia capicola), Spotted Dove (Spilopelia chinensis),Bronze-winged Jacana (Metopidius indicus), Pheasant-tailed Jacana(Hydrophasianus chirurgus), Red-wattled Lapwing (Vanellus indicus), Eurasian coot (Fulica atra), Shikra (Accipiter badius), Geese, Swan, Ducks etc.; AND WHEREAS, other important reptilian species in the sanctuary includes King Cobra (Ophiophagus hannah), Rat Snake (Ptyas mucosa), Common Krait (Bungarus caeruleus), Russell’s Viper (Daboia russelii), Indian Python and Common Monitor Lizard etc. It also harbours variety of Butterflies among which Plain Tiger (Danaus chrysippus), Stripped Tiger (Danaus genutia), Common sergent (Athyma perius), Common Jezebel (Delias eucharis), Peacock Pansy (Junonia almana), Lemon Butterfly (Papilio demoleus), Blue Tiger (Tirumala limniace), Common Leopard Butterfly (Phalanta phalantha) and Crow Butterfly (Euploea core) are very common in the area. The honey bees (Apidae) are represented by Indian Rock Bee (Apis dorsata), Indian Bee (Apis cerana indica), Italian Bee (Apis mellifera) and Little Bee (Apis florea); AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Sukhna Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; AND WHEREAS, the Government of Haryana vide its letter No. 682, dated 16th February, 2024 have specifically stated that this draft notification for declaration of Eco-sensitive Zone around Sukhna Lake Sanbctuary on the Haryana side is in conformity with the Order dated 02nd march, 2020 of the High Court of Punjab and Haryana in Writ Petition (C) No. 18253 of 2009 and 5809 of 2015: Court on its own motion Vs Chandigarh Administration. NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to extent varying from 1.0 km to 2.035 km from around the boundary of Sukhna Wildlife Sanctuary, in the State of Haryana as Sukhna Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: 1. Extent and Boundaries of Eco-sensitive Zone- (1) The Eco-sensitive Zone (ESZ) in general extends up to 1000 m from the boundary of the Sukhna Wildlife Sanctuary on the Haryana side. It is further extended to 2 km in the Reserved Forest on the northern side. On the eastern side, the ESZ boundary is mostly 1000 m, running along the boundary of the Reserved Forest. However, it is extended on the southeastern side to make it co-terminous with the boundary of the Reserved Forest. The total area of the Eco-Sensitive Zone is 24.60 sq. kms. (2) The Eco-sensitive Zone is divided into four zones. The extent of Zone-I will be 100 m from the boundary of the Sukhna Wildlife Sanctuary, while Zone-II will encompass the area falling between 100 m and 300 m from the boundary of the Protected Area. Zone-III will comprise the area falling within 300 m to 700 m from the boundary of the Protected Area. The remaining area from 700 m to 1000 m from the boundary of the Protected Area shall be designated as Zone-IV. (3) Ten villages namely Prempura, Sokhomajri, Damala, Lohgarh, Manakpur Thakardas, Surajpur, Chandimandir Kotla, Darra Kharauni, Rampur and Saketari/Mahadevpur fall within the proposed ESZ. The total area of proposed ESZ will be 6078.98 acres (2460.07 ha). The proposed ESZ will encompass and include, inter-alia, following areas.- i) Area comprising of Sector 1 and part of Sector 2 and 3 including Gymkhana Club under Haryana Shahari Vikas Pradhikaran (HSVP). ii) Some tube well chambers, Para Gliding Parks and area falling under Sector-1 MDC. iii) Area falling under Chandimandir Cantonment (area including small arms firing range of military station Chandimandir, Central Soil & Water Conservation Research Farm.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iv) Part of area falling under MC Panchkula. v) Out of ten villages falling in the proposed ESZ, two villages namely Saketri and Prempura fall within a radius of 700 meters from the boundary of Sukhna Wildlife Sanctuary. While the houses in Village Saketri are located along the boundary of Sukhna Wildlife Sanctuary at 0.00 m distance, the habitation of village Prempura is at a distance of 300 m to 700 m from the boundary of Sukhna Wildlife Sanctuary. (4) The boundary description of such zone is given in Annexure I. (5) The map of Eco sensitive Zone is appended as Annexure II. (6) The latitudes and longitudes of the Sukhna Wildlife Sanctuary (Table A) and its Eco-Sensitive Zone (Table B) is appended as Annexure III. (7) The list of villages falling within Eco-Sensitive Zone along with co-ordinates of prominent points is appended as Annexure IV. 2. Zonal Master Plan for the Eco-sensitive Zone- 1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of the final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely: - (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipality; (vi) Revenue; (vii) Agriculture; and (viii) Haryana State Pollution Control Board, for integrating environmental and ecological considerations into it. (5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendlier. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green areas, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities. 3. Measures to be taken by the State Government- The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities. Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) Promoted activities given under para 4; Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007); Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the respective State Governments, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change; Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph; Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Governments in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism: - (i) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; a) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests; b) the Tourism Master Plan shall form a component of the Zonal Master Plan; c) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; d) The activities of eco-tourism shall be regulated as under, namely: - (ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) New construction of hotels and resorts shall not be permitted within Zone 1 (upto a distance of 100 m from the boundary of Sukhna Wildlife Sanctuary towards Haryana side) and Zone 2 (100 to 300 m from the boundary of Sukhna Wildlife Sanctuary towards Haryana side). (iv) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) Noise pollution - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and as amendments thereto. (7) Air pollution- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981), published by the Government of India in the Ministry of Environment and Forests vide notification number G.S.R. 351 (E), dated the 15th May, 1981 and the Environment (Protection) Act, 1986 and the rules made there under. (8) Discharge of effluents- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), published by the Government of India in the Ministry of Environment and Forests vide notification number G.S.R. 58 (E), dated the 27th February, 1975 and the Environment (Protection) Act, 1986 and the rules made there under. (9) Solid wastes- Disposal and Management of solid wastes shall be as under: - a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste – Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 and as amended from time to time. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco- Sensitive Zone. (11) Plastic Waste Management - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016 and as amended from time to time. (12) Construction and demolition waste management - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016 and as amended from time to time. (13) E-waste - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units - (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 (17) Protection of hill slopes - The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. (3) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (4) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro- forma specified in Annexure-V, appended to this notification. (8) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The area consists of Reserve Forest. The habitation of village Prempura is located above the northern boundary of Sukhna Wildlife Sanctuary and falls within the proposed ESZ boundary.
