जिनके उससे प्रभाजवत होन े की संभावना ह,ै उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन े वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और, उि प्रारूप अजधसूचना को अंतर्वष्टा करन े वाली रािपत्र की प्रजतर्ां िनता को तारीख 23 अगस्ट्त, 2023 को उपलब्ध करा िी गई थी; और, उि प्रारुप अजधसूचना के उत्तर म ें व्यजिर्ों और पणधाररर्ों से कोई आक्षेप और सुझाव प्राप्त नहीं हुए थे; सेस्ट्सा ऑर्काड अभर्ारण्र् 100 वग ा दकलोमीटर के क्षेत्रफल म ेंफैला हुआ ह ैऔर अरुणाचल प्रिेि के पजिम कामेंग जिले में जस्ट्थत ह।ै अभर्ारण्र् को 19 िुलाई, 1982 को अजधसूचना सं. एफओआर.32/आईएनडी-1/82/17706-45 तारीख 19 िलु ाई,1982 द्वारा अजधसूजचत दकर्ा गर्ा था; और िहााँ दक, सेस्ट्सा ऑर्काड अभर्ारण्र् क्षेत्र म ें उपलब्ध स्ट्वििे ी आर्काडों के जलए िाना िाता ह।ै र्ह अभर्ारण्र् र्थास्ट्थान आर्काडों की सुरक्षा और संरक्षण जिसके अतं गता जवकास भी ह,ै के उद्देिर् के साथ अजधसूजचत दकर्ा गर्ा है के 2910 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जलए ह।ै ऑर्काड की सुरक्षा और संरक्षण के अलावा, र्ह अभर्ारण्र् में पाए िान े वाली वन्र्िीव और समृद्ध िैव जवजवधता के संरक्षण में मिि करता ह;ै और, ईगल नेस्ट्ट वन्र्िीव अभर्ारण्र् 217 वगा दकलोमीटर के क्षेत्र में फैला हुआ ह ै और अजधसूचना संखर्ा सीडब्ल्र्ूएल/डी/27/89/3101-3174, तारीख 18 अक्टूबर, 1989 को र्था अजधसूजचत के अधीन अरुणाचल प्रिेि राज्र् में पजिम कामगें जिल ेके ससगं चगुं प्रिासजनक सर्काल म ेंजस्ट्थत ह;ै और, पाक्के वन्र्िीव अभर्ारण्र् और बाघ आरजक्षत 861.95 वगा दकलोमीटर के क्षेत्र म ें फैला हुआ ह ै और अरुणाचल प्रिेि के पाक्के केसांग जिले म ें जस्ट्थत है, िो दक उत्तर म ें टेंगा आरजक्षत वन, पजिम म ें डोइमार आरजक्षत वन, िजक्षण म ें नामरे ी राष्ट्रीर् उद्यान और बाघ आरजक्षत (असम) और पूव ा में कृजि भूजम के साथ-साथ पापम आरजक्षत वन से जघरा हुआ ह।ै और, उत्तर-पूव ा भारत के िगं लों को उनकी पुष्प और िीव प्रिाजतर्ों की समृजद्ध के कारण 'वैजिक िैव जवजवधता हॉटस्ट्पॉट' और 'स्ट्थाजनक पक्षी क्षेत्र' के रूप म ें पहचाना िाता ह।ै इस पररिश्ृ र् में उच्च प्रिाजत जवजवधता और स्ट्थाजनकता है, चूंदक र्ह भारतीर् और मलार्न पाररजस्ट्थजतक-क्षेत्रों के बीच सक्रं मण क्षेत्र बनाता ह।ै और, उत्तर-पूवा भारतीर् बाघ पररिश्ृ र् के िो महत्वपूण ा भाग, ब्रह्मपुत्र बाढ़ के मैिान और उत्तर-पूवा भारतीर् पहाज़िर्ााँ ह ैं और पाक्के और नामेरी बाघ आरजक्षत असम के मिै ानी इलाकों और अरुणाचल प्रिेि के पहा़िी वनों के बीच संक्रमण क्षेत्र म ें ब्रह्मपुत्र निी के उत्तर म ें जस्ट्थत हैं, िो साथ में उत्तर-पूवा म ें अध-ा सिाबहार और सिाबहार वनों के सबसे ब़ि े ब्लॉकों में स ेएक ब्लॉक बनात ेह।ैं और, पाक्के बाघ आरजक्षत, ईगल नेस्ट्ट वन्र्िीव अभर्ारण्र् और सेस्ट्सा ऑर्काड अभर्ारण्र् के चारों ओर के सरं जक्षत क्षेत्र को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के पैराग्राफ 1 में जवजनर्िाष्ट ह,ैं पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव- जवजवधता की िजृ ष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप म ेंसुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रेजणर्ों और उनके प्रचालन तथा प्रसस्ट्ं करण को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केंद्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसमें इसके पिात ् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उप-धारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, अरुणाचल प्रिेि राज्र् के पाक्के वन्र्िीव अभर्ारण्र् और बाघ आरजक्षत, ईगल नस्ट्े ट वन्र्िीव अभर्ारण्र् और सेस्ट्सा ऑर्काड वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर िून्र् (0) दकलोमीटर स े 37.60 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को, पाक्के वन्र्िीव अभर्ारण्र् और बाघ आरजक्षत, ईगल नस्ट्े ट वन्र्िीव अभर्ारण्र् और सेस्ट्सा ऑर्काड वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन (जिसे इसम ें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै पर्ाावरण का गुणवत्ता की सुरक्षा और सुधार करने और पर्ाावरण प्रििू ण को रोकने और जनर्ंजत्रत करने और समाप्त करन े के प्रर्ोिन के जलए जिसके जववरण पैराग्राफ 1 म ें जवजनर्िाष्ट ह ैऔर जनम्नजलजखत उपार् करें, र्था:- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.-(1) पाक्के बाघ आरजक्षत, ईगल नेस्ट्ट वन्र्िीव अभर्ारण्र् और सेस्ट्सा ऑर्काड अभर्ारण्र् की सीमा के चारों ओर पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार िन्ू र् दकलोमीटर स े 37.60 दकलोमीटर तक की सीमा के साथ 766.20 वग ा दकलोमीटर के क्षेत्र को आच्छादित करता ह।ै पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार जवजभन्न दििाओं में जनम्न रुप से ह:ै दििाएं जवस्ट्तार उत्तर 1.0 दकलोमीटर उत्तर-पूव ा 1.0 से 2.5 दकलोमीटर पूवा 2.0 से 37.60 दकलोमीटर[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 िजक्षण-पूव ा 1.0 दकलोमीटर िजक्षण 0 दकलोमीटर िजक्षण-पजिम 1 दकलोमीटर पजिम 1 दकलोमीटर उत्तर-पजिम 1 दकलोमीटर रटप्पण: पाररजस्ट्थजतकी संवेिी िोन का िून्र् जवस्ट्तार असम के नामेरी राष्ट्रीर् उद्यान और बाघ आरजक्षत की सीमा के कारण ह,ै िो पाक्के वन्र्िीव अभर्ारण्र् और आरजक्षत ररज़वा के िजक्षणी भाग में जस्ट्थत ह।ै अभर्ारण्र् की सीमा चोरटर्ों और घारटर्ों, िलधाराओं और नालों िैसी प्रमुख और ध्र्ान िेन े र्ोग्र् जविेिताओं द्वारा आधार जचजन्हत ह।ैं (2) संरजक्षत क्षेत्र और उसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण अजधसूचना से संलग्न उपाबंध –I की सारणी क से घ म ेंजवजनिाष्ट ह।ै (3) सीमा जववरण और अक्षांि और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र उपाबंध –IIक, IIख और IIग के रूप म ेंसंलग्न ह।ैं (4) पाक्के वन्र्िीव अभर्ारण्र् और बाघ आरजक्षत, ईगल नस्ट्े ट वन्र्िीव अभर्ारण्र् और सस्ट्े सा ऑर्काड अभर्ारण्र् और उसके पाररजस्ट्थजतकी संवेिी िोन की सीमा सजहत मुखर् अवस्ट्थानों के भू-जनििे ांकों की सूची उपाबंध - III की सारणी क और सारणी ख में िी गई ह।ै (5) पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल े ग्रामों की सूची उपाबंध -IV के रूप म ेंसलं ग्न ह ै 2. पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ासे और आंचजलक महार्ोिना तैर्ार और अजधसूजचत करेगी। (2) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना, इस अजधसूचना म ें जवजनर्िाष् ट रीजत से तथा तत्समर् प्रवृत जवजधर्ों के अनुरूप और केन्द्रीर् सरकार द्वारा िारी दििा-जनििे ों, र्दि कोई हों, के अनुसार तर्ै ार की िाएगी। (3) आंचजलक महार्ोिना, उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को िाजमल करने के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे बनार्ा िाएगी, अथाात्:- (i) पर्ाावरण; (ii) वन और वन्र्िीव; (iii) कृजि; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) ससंचाई और बाढ़ जनर्ंत्रण; (ix) नगरपाजलका; (x) पंचार्ती राि; (xi) अरूणाचल प्रिेि प्रििू ण जनर्ंत्रण बोडा; (xii) लोक जनमााण जवभाग।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) िब तक इस अजधसूचना में जवजनर्िाष्ट न हो, तब तक आंचजलक महार्ोिना, जवद्यमान अनुमोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगा तथा आंचजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना में अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के सरं क्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ो की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्र् पहलूओं की व्यवस्ट्था की िाएगी, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजि क्षेत्रों, उपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों का सीमांकन दकर्ा िाएगा। र्ोिना की जवद्यमान और प्रस्ट्ताजवत भू-उपर्ोग की जविेिताओं का ब्र्ौरा िेने वाले मानजचत्रों द्वारा सहार्ता की िाएगी। (7) आंचजलक महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन में होने वाले जवकास का जवजनर्मन करेगी और पैरा 4 में सारणी म ें सूचीबद्ध प्रजतजिद्ध और जवजनर्जमत उपबंधों दक्रर्ाकलापों का पालन दकर्ा िाएगा और इसमें स्ट् थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) तैर्ार दकर्ा गर्ा और अजधसूजचत आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभ ा िस्ट्तावेि होगा वह इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कताव्यों का जनवाहन करने के जलए। (10) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होने तक, सभी नए जनमााण और अन्र् जवकासात्मक दक्रर्ाकलापों को मानीटरी सजमजत को जनर्िाष्ट दकर्ा िाएगा । 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबधं ों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भ-ू उपर्ोग.–(क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिन हते ु जचजन्हत उद्यानों और खलु े स्ट्थानों का वाजणजज्र्क र्ा प्रमुख आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान दकर्े िान े की अनुमजत नहीं होगी। परंतु र्ह दक पाररजस्ट्थजतकी संवेिी िोन के भीतर,इस खंड में जवजनर्िाष्ट प्रर्ोिनों से जभन्न के जलए कृजि और अन्र् भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा केन्द्रीर् सरकार और राज्र् सरकार के र्था लागू अन्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार, सक्षम प्राजधकारी के पूवा अनुमोिन से स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िाएगा, िैस:े- (i) जवद्यमान स़िकों को चौ़िा करना, उन्ह ेंसुिढ़ृ करना और नई स़िकों का जनमााण करना; (ii) अवसंरचनाओं और नागररक सुजवधाओं का जनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें समथाक सुजवधा भण्डार, और स्ट्थानीर् सुजवधाए ं जिसके अंतगता गृह वास भी ह;ै और (v) पैराग्राफ-4 में संवर्धात दक्रर्ाकलाप दिए गए ह:ैं परंत ु र्ह और दक क्षेत्रीर् िहरी र्ोिना अजधजनर्म तथा राज्र् सरकार के अन्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त दकसी जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (2007 का 2) भी ह,ै की अनपु ालन दकए जबना, वाजणजज्र्क और औद्योजगक जवकास के दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनज्ञु ा नहीं होगी। परंतु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर आने वाली भूजम के अजभलेखों म ें प्रतीत होती दकसी त्रुरट को, मानीटरी सजमजत के जवचार प्राप्त करन े के पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधार दकर्ा िाएगा और उि त्रुरट के सुधारे िान ेकी सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंतु र्ह भी दक त्रुरट को सुधारने म,ें इस उप-पैरा के अधीन र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू- उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनप्रु र्िु र्ा अनुत्प ािक कृजि क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के दक्रर्ाकलापों स े पुन: वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल जनकार्.-सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों को अजभज्ञात दकर्ा िाएगा और आंचजलक महार्ोिना में उनके संरक्षण और कार्ाकल्प की र्ोिना सज‍ मजलत की िाएगी और राज्र् सरकार द्वारा दििा-जनिेि इस रीजत से तैर्ार दकए िाएंग े दक उसमें ऐस े क्षेत्रों म ें र्ा उसके पास, जवकास दक्रर्ाकलापों िो ऐस े क्षेत्रों के जलए हाजनकारक ह,ैं को प्रजतजिद्ध दकर्ा िा सके। (3) पर्टा न र्ा6 पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना, राज्र् सरकार के पर्ाावरण और वन जवभागों के परामिा से पर्ाटन जवभाग द्वारा तैर्ार की िाएगी। (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का एक घटक होगा। (घ) पर्ाटन महार्ोिना को पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार दकर्ा िार्ेगा। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जन‍न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थ जतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाल े राष्ट्रीर् व्याघ्र सरं क्षण प्राजधकरण (समर्-समर् पर र्था संिोजधत) द्वारा िारी पाररजस्ट्थजतकी-पर्ाटन संबंधी दििाजनििे ों के अनुसार होगा; (ii) आंचजलक महार्ोिना तैर्ार होने और अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनज्ञु ात दकर्ा िाएगा । (4) प्राकृजतक जवरासत.–पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों, िैस े दक िीन पूल आरजक्षत क्षत्रे , िलै संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और आचं जलक महार्ोिना के भाग के रूप म ें उनके परररक्षण और संरक्षण के जलए जवरासत संरक्षण र्ोिना तैर्ार की िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत, क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के प्रसीमाओं की पहचान की िाएगी और आंचजलक महार्ोिना के भाग के रुप में उनके संरक्षण के जलए एक जवरासत संरक्षण र्ोिना तर्ै ार की िाएगी। (6) ध्व जन प्रििू ण.- ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 और समर् समर् पर र्थासंिोजधत के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण के जनवारण और जनर्ंत्रण की अनुपालना की िाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) वार् ु प्रििू ण.- वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और समर् समर् पर र्थासंिोजधत के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रििू ण के जनवारण और जनर्ंत्रण की अनुपालना की िाएगी। (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहःस्राव का जनस्ट्सारण, िल (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और समर् समर् पर र्थासंिोजधत के उपबंधों के अनुसार दकर्ा िाएगा। (9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबन्ध जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट का जनपटान और प्रबंध, ठोस अपजिष्ट प्रबंधन जनर्म, 2016 और समर् समर् पर र्थासंिोजधत के उपबंधों के अनुसार दकर्ा िाएगा। अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स े बाहर अजभज्ञात दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत स ेदकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें अनुज्ञात अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं की अनुमजत िी िा सकेगी। (10) िवै -जचदकत्सा अपजिष्ट.- िैव-जचदकत्सा अपजिष्ट का प्रबंध जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव-जचदकत्सा अपजिष्ट का जनपटान िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 और समर्-समर् पर र्था संिोजधत के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें अनज्ञु ात अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए, जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव जचदकत्सा अपजिष्ट का सरु जक्षत और पर्ाावरण अनुकूल प्रबंध की अनुमजत िी िा सकेगी। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं .- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबधं , प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 और समर् समर् पर र्थासंिोजधत के उपबंधो के अनुसार दकर्ा िाएगा। (12) सजन्नमाणा और जवध्वसं अपजिष्ट का प्रबधं .- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंध, संजनमााण और जवध्वंस अपजिष्ट प्रबंध जनर्म, 2016 और समर् समर् पर र्थासंिोजधत के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंध, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत, ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ान सबं धं ी-र्ातार्ात.- र्ान संबंधी-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जविेि उपबंध िाजमल दकए िाएंगे। आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होने तक, जनगरानी सजमजत प्रासंजगक सुसंगत और उनके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ान संबंधी-र्ातार्ात के अनुपालन की मानीटरी करेगी। (15) र्ान िजनत प्रििू ण.- र्ान िजनत प्रििू ण की रोकथाम और जनर्ंत्रण, लाग ू जवजधर्ों की अनुपालना के अनुसार दकर्ा िाएगा। स्ट्वच्छतर ईंधन उिाहरणाथ ाके जलए सीएनिी, एलपीिी, आदि के उपर्ोग के जलए प्रर्ास दकए िाएगं े । (16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात, पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रििू णकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (ख) केन्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रििू णकारी उद्योगों को अनुज्ञा िी िाएगी। इसके अजतररि, गरै प्रििू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहा़िी ढलानों का सरं क्षण.- पहा़िी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना पहा़िी ढलानों के उन क्षेत्रों को उपिर्िात करेगी, जिनमें दकसी भी जनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान ख़िी पहा़िी ढलानों में अत्र्जधक भू-क्षरण होता ह ै उनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के उपबधं ों और तद्धीन बनाए गए जनर्मों तथा पर्ाावरण, वन और वन्र्िीव से संबंजधत भारत के तत्कालीन पर्ाावरण और वन मंत्रालर् द्वारा संखर्ांक 1533 (अ), तारीक 14 जसतंबर, 2006 में भारत सरकार की अन्र् अजधसूचनाएं, जवजधर्ों और अजधजनर्म और तत्समर् प्रकृत जवजधर्ों द्वारा ऐसी रीजत के नए और जवद्यमान खनन (लघ ु और वृहत खजनि), पत्थर उत्खनन और भ्रिन इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) स.ं 202 म ें टी.एन. गौडाबमान जथरुमलू पाि बनाम जनणार् तारीख 03-06-2022 और उसके बाि आईए सं. 131377 का जनणार् तारीख 26-04-2023 और 28-04-2023 को हुआ। 2. प्रििू ण (िल, वार्,ु मृिा, ध्वजन, पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििू णकारी उद्योगों का जवस्ट्तार करन े की अनुमजत नहीं होगीः आदि) उत्पन्न करन े वाले उद्योगों की स्ट्थापना । परन्त ु र्ह दक केन्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी मागा ििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनसु ार िब तक दक अजधसूचना म ें ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गरै -प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गरै पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से गमा वार्ु के गुब्बारे, हले ीकाप्टर, ड्रोन, माइक्रोलाइट्स, आदि उ़िाना। 7. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की अनमु जत नहीं होगी और न ही वतामान आरा जमलों का जवस्ट्तार दकर्ा िा सकेगा। 8. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। ख.जवजनर्जमत दक्रर्ाकलाप 9. होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघ ु व अस्ट्थार्ी संरचनाओं के स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संविे ी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना की अनुमजत नहीं होगी: परंत,ु संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू दििाजनिेिों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करन े र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करन े की अनुमजत होगी । 10. जनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क सजन्नमााण अनुज्ञात नहीं दकर्ा िाएगा: परंत ु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप-परै ाग्राफ (1) म ें लघ ु उद्योगों िो प्रििू ण उत् पन् न नहीं करत े ह,ैं स े संबंजधत सजन्नमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंग े और लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनज्ञु ात से ही न् र्नू तम पर रख ेिाएंगे । (ख) एक दकलोमीटर से आगे आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 11. गैर प्रििू णकारी लघु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा िारी समर्- समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार गैर-प्रििू णकारी[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 12. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनज्ञु ात के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 13. वन उत्पािों और गैर काष्ठ वन लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । उत्पािों (एनटीएफपी) का संग्रहण । 14. जवद्युत और संचार टॉवर लगाने, लाग ू जवजधर्ों के अनुसार जवजनर्जमत published in the Gazette of India, Extraordinary, vide number S.O. 3780(E), dated the 22nd August, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 23rd August, 2023; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the said draft notification; WHEREAS, the Sessa Orchid Sanctuary is spread over an area of 100 square kilometer and situated in West Kameng District of Arunachal Pradesh. The Sanctuary was notified on 19th July, 1982 vide notification no. FOR.32/IND-1/82/17706-45, dated the 19th July, 1982. AND WHEREAS, the Sessa Orchid Sanctuary is known for indigenous Orchids available in the region. This sanctuary has been notified with the objective is for protection and Conservation, including development of in-situ Orchids. Apart from protection and conservation of Orchids, it helps in protection of wildlife and the rich biodiversity found in the Sanctuary. AND WHEREAS, the Eagle Nest Wildlife Sanctuary is spread over an area of 217 Square Kilometers and situated in the Singchung administrative circle of West Kameng district in the state of Arunachal Pradesh as notified on the 18th October, 1989 vide notification no. CWL/D/27/89/3101-3174. AND WHEREAS, the Pakke Wildlife Sanctuary and Tiger Reserve is spread over an area of 861.95 sq km and located in the Pakke Kessang district of Arunachal Pradesh which is surrounded by the Tenga Reserve Forest to the North, Doimara Reserve Forest on the West, Nameri National Park and Tiger Reserve (Assam) on the South and some agricultural land as well as Papum Reserve Forest on the East AND WHEREAS, the forests of North-East India are recognized as a ‘Global Biodiversity Hotspot’ and ‘Endemic Bird Area’ due to their richness in floral and faunal species. The landscape has high species diversity and endemicity as it forms the transition zone between the Indian and Malayan eco-regions. AND WHEREAS, the two important parts of the North-East Indian tiger landscape are the Brahmaputra flood plains and the North-East Indian hills and the Pakke and Nameri Tiger Reserves are situated North of the river Brahmaputra in the transition zone between the Assam plains and the hilly forests of Arunachal Pradesh forming one of the largest blocks of semi-evergreen and evergreen forests in the North-East. AND WHEREAS, it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the protected area of Pakke Tiger Reserve, Eagle nest Wildlife Sanctuary and Sessa Orchid Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 kilometers to 37.60 kilometers around the boundary of Pakke Wildlife Sanctuary and Tiger Reserve, Eagle Nest Wildlife Sanctuary and Sessa Orchid Sanctuary in the State of Arunachal Pradesh as the Pakke Wildlife Sanctuary and Tiger Reserve, Eagle Nest Wildlife Sanctuary and Sessa Orchid Wildlife Sanctuary Eco-sensitive Zone, (hereafter in this notification referred to as the Eco-sensitive Zone, the details of which are specified in paragraph1, for the purpose of protecting and improving the quality of environment and preventing and controlling and abating environment pollutions and take the following measures, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-Sensitive Zone shall cover an area of 766.20 square kilometers with an extent varying from zero kilometer to 37.60 kilometers around the Pakke Tiger Reserve, Eagle Nest Wildlife Sanctuary and Sessa Orchid Sanctuary. The Extent of Eco-Sensitive zone in different directions is given below: - DIRECTION EXTENT North 1.0 Km North-East 1.0 to 2.5 Km East 2.0 to 37.60 km South-East 1.0 Km South 0 Km South-West 1 Km West 1 Km North-West 1 Km Note: Zero extent of Eco-Sensitive Zone is due to the boundary of Nameri National Park and Tiger Reserve of Assam that lies in the southern part of Pakke Wildlife Sanctuary and Tiger Reserve. The boundary of the Sanctuary is base marked by prominent and noticeable features like ridges and gorges, streams & nallahs. (2) The boundary description of Protected Areas and its Eco-Sensitive Zone is specified in Tables A to D of Annexure- I appended to the notification. (3) The map of the Eco-Sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II A, II B and II C. (4) The geo-coordinates of prominent locations along the boundary of Pakke Wildlife Sanctuay and Tiger Reserve, Eagle Nest Wildlife Sanctuary and Sessa Orchid Sanctuary and its Eco-Sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling within the Eco-Sensitive Zone is appended as Annexure-IV. 2. Zonal Master Plan for Eco-Sensitive Zone - (1) The State Government shall, for the purposes of the Eco-Sensitive Zone, prepare and notify a Zonal Master Plan within two years from the date of publication of this notification in the Official Gazette, in consultation with local people. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared in the manner specified in this notification and also shall be in consonance with the relevant laws for the time being in force and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely: - (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (viii) Irrigation and Flood Control; (ix) Municipality; (x) Panchayati Raj; (xi) Arunachal Pradesh Pollution Control Board; (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in the improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for the restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of the local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and settlements, types and kinds of forests, agricultural areas, fertile lands, green areas such as parks and like places, horticulture areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for the security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so prepared and notified shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Until the preparation of the Zonal Master Plan for the Eco-sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee. 3. Measures to be taken by the State Government. -The State Government shall take the following measures for giving effect to the provisions of this notification. (1) Land use- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified in this clause, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and the provisions of this Notification, to meet the residential needs of the local residents and for activities, such as:- (i) widening and strengthening of existing roads and constructing of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including homestay; and (v) promoted activities are given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or any law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 (2) Natural water bodies-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Departments of Environment and Forests of the State Government. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of the carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely: - (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (ii) until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and a heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution- Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and as amended from time to time. (7) Air pollution- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and as amended from time to time. (8) Discharge of effluents- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and as amended from time to time. (9) Solid wastes- Disposal and Management of solid wastes shall be as under: - (a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and as amended from time to time. The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste – Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 and as amended from time to time. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 and as amended from time to time. (12) Construction and demolition waste management - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 and as amended from time to time.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (13) E-waste - The e- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units – a) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone on or after the publication of this notification in the Official Gazette, b) Only non-polluting industries shall be allowed within the ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes - The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 the rules made there under and other notifications, laws and acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely:- TABLE Sl. Construction activities. (a) No New commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Small scale nonpolluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco- sensitive Zone shall be permitted by the competent Authority. 12. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 13. Terms and Functions of the monitoring committee: (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Regulatory Authorities concerned. (3) The Member-Secretary of the Monitoring Committee or the Collector concerned or the Deputy Conservator of Forests concerned shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) The Monitoring Committee may invite representatives or experts from Departments concerned, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma appended at Annexure V. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.
