## Policy Analysis Report: Union Public Service Commission Exemption from Consultation Fifth Amendment Regulations, 2021 **1. Executive Summary:** This report analyzes the Union Public Service Commission (UPSC) Exemption from Consultation Fifth Amendment Regulations, 2021. This amendment modifies the Union Public Service Commission Exemption from Consultation Regulations, 1958, by introducing an exemption to complete one recruitment cycle for ten Deputy Superintendent of Police posts in the Delhi Special Police Establishment, Central Bureau of Investigation (CBI), through deputation (including short-term contract) against a vacancy circular from June 2021. The report details the specific change, its likely rationale, and the potential impact on recruitment procedures within the CBI for these specific positions. **2. Introduction:** This report aims to provide a clear and concise analysis of the Union Public Service Commission Exemption from Consultation Fifth Amendment Regulations, 2021, based solely on the information contained within the provided government policy text. It outlines the amendment's purpose, key changes, affected parties, and potential implications. **3. Policy Overview:** * **Original Policy:** The Union Public Service Commission Exemption from Consultation Regulations, 1958. * **Core Objective(s):** The original policy, inferred from the amendment’s title, likely defines circumstances under which consultation with the UPSC is not required. This amendment seeks to provide a specific exemption to that general framework. **4. Background and Rationale:** As this is an amendment, the focus is on the reason for *this specific change*. The amendment provides an exemption for a single recruitment cycle related to filling ten Deputy Superintendent of Police positions in the CBI via deputation. The rationale is likely to expedite the filling of these specific positions, potentially to address an urgent need or to test an alternative recruitment approach. The reference to a June 2021 vacancy circular suggests this process has been ongoing and perhaps requires a streamlined solution. **5. Key Provisions / Changes:** This section focuses on the changes introduced by the amendment: * **Specific Part of Original Policy Changed:** Schedule II of the Union Public Service Commission Exemption from Consultation Regulations, 1958. * **New Rule/Provision:** Item 8A is added to Schedule II, providing "exemption to complete one recruitment cycle to fill up ten posts of Deputy Superintendent of Police by deputation including short term contract in Delhi Special Police Establishment, Central Bureau of Investigation against vacancy circular of June, 2021." * **Difference/Effect of Change:** Previously, filling these positions likely required consultation with the UPSC. This amendment now exempts *this specific recruitment cycle* from that consultation requirement. This likely aims to speed up the recruitment process for these particular positions, potentially allowing the CBI to directly manage the deputation/contract process for this cycle. **6. Target Audience and Stakeholders:** The primary stakeholders directly affected by this amendment are: * The Delhi Special Police Establishment (Central Bureau of Investigation). * Individuals applying for the ten Deputy Superintendent of Police positions via deputation or short-term contract as per the June 2021 vacancy circular. * The Union Public Service Commission (impacted by the exemption from consultation in this specific case). * Department of Personnel and Training. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Delhi Special Police Establishment (CBI) is primarily responsible for implementing this exemption. The Department of Personnel and Training likely oversaw the drafting and approval of the amendment (given Rashmi Chowdhary's signature). * **Timelines/Procedures:** The amendment specifies "one recruitment cycle" related to the June 2021 vacancy circular. The implementation is time-bound and limited to this specific recruitment effort. There are no further procedures specified in the text. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome of this amendment is to expedite the recruitment of ten Deputy Superintendents of Police to the CBI via deputation or short-term contract. The impact of this change could include: * Faster deployment of personnel to these positions. * Potential for a more streamlined recruitment process, although the specific procedures used under the exemption are not detailed in the text. * A test case for potentially broader exemptions in the future, if the outcome is deemed successful. **9. Conclusion:** The Union Public Service Commission Exemption from Consultation Fifth Amendment Regulations, 2021, introduces a specific exemption for a limited recruitment effort within the CBI. This amendment likely seeks to expedite the filling of Deputy Superintendent of Police positions. While the text provides a clear outline of the exemption, the lack of specific procedural details leaves some ambiguity. Its significance lies in the potential for faster recruitment within the CBI for these positions and the precedent it sets for future exemptions from UPSC consultation requirements.
