(1) इन जनयमों का संजिप् त नाम केन्द्द्रीय मोटर यान (पांचवां संिोधन) जनयम, 2023 ह।ै (2) य ेरािपत्र म ेंउनके प्रकािन की तारीख को लागू होंगे। 5774 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केंद्रीय मोटर यान जनयम 1989 के जनयम 62 के, उप-जनयम (1) के खंड (ख) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा, अथागत ् :— "(ख) पररवहन वाहनों के संबंध में दिटनेस प्रमाण पत्र का आठ वर् ग तक परु ाने वाहनों के जलए िो वर् ग और आठ वर्ग स े नवीनीकरण अजधक परु ाने वाहनों के जलए एक वर्ग: परंतु यह दक भारी माल वाहन, भारी यात्री मोटर वाहन, मध्यम माल वाहन, मध्यम यात्री मोटर वाहन और हल्के मोटर वाहन प्रवग ग के वाहन की दिटनेस 01 अक्टूबर 2024 से जनयम 175 के अधीन रजिस्ट् रीकृत स्ट्वचाजलत परीिण स्ट्टेिन के माध्यम स ेही अजनवायग रूप से की िाएगी: परंत ु यह और दक िहा ं रजिस्ट् रीकरण प्राजधकरण की अजधकाररता म ें जनयम 175 के अधीन रजिस्ट् रीकृत स्ट्वचाजलत परीिण स्ट्टेिन पररचाजलत हैं, वहा ं वाहन की दिटनेस केंद्रीय मोटर यान (पांचवां संिोधन) जनयम, 2023 के प्रारंभ से प्रभारी होने पर केवल ऐसे स्ट्वचाजलत परीिण स्ट्टेिन के माध्यम से ही की िाएगी”। [िा.सं. आरटी-23013/2/2022-टी] महमूि अहमि, अपर सजचव रटप्प ण- मूल जनयम, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उप-खंड (i) में अजधसूचना संखयांक सा.का.जन. 590(अ), तारीख 02 िून, 1989 द्वारा प्रकाजित हुए थे और अंजतम बार अजधसूचना संखयांक सा.का.जन. 453(अ) तारीख 20 िून, 2023 के द्वारा संिोजधत दकए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 12th September, 2023 G.S.R. 663(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 233(E), dated the 29th March, 2023 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the official Gazette containing the draft rules were made available to the public; And whereas copies of the said Gazette notification were made available to the public on the 29th March, 2023; And whereas the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 56 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. (1) These rules may be called the Central Motor Vehicles (Fifth Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In rule 62 of the Central Motor Vehicles Rules, 1989, in sub-rule (1), for clause (b), the following shall be substituted, namely: - “(b) renewal of certificate of fitness in respect of Two years for vehicles up to eight years old and one transport vehicles year for vehicles older than eight years: Provided that the fitness of the vehicle of the category[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 heavy goods vehicle, heavy passenger motor vehicle, medium goods vehicle, medium passenger motor vehicle and light motor vehicle shall be done mandatorily only through an automated testing station registered under rule 175 with effect from 01st October 2024: Provided further that where the automated testing station registered under rule 175 is operational in the jurisdiction of a registering authority, the fitness of the vehicle shall be done only through such automated testing station with effect from the commencement of the Central Motor Vehicles (Fifth Amendment) Rules, 2023.”.
