के क्षेत्रफल म ें फैला हुआ ह ै और गुिरात राज्र् म ें बनासकांठा जिल े के ितं ा अमीरगढ़, पालनपुर, और वडगम तालुक म ें जस्ट्थत ह,ै और वन्र्िीव अभर्ारण्र् पजिम म ें िेस्ट्सोर वन्र्िीव अभर्ारण्र्, पूवा म ें साबरमती निी और उत्तर म ें जनकटस्ट्थ रािस्ट्थान सीमा के बीच बनासकांठा जिल े के उत्तर पजिमी भागों म ें जस्ट्थत ह;ै और, बलराम-अम्बािी वन्र्िीव अभर्ारण्र् अजधसूचना स.ंिीवीएन/27/डब्ल्र्एू लपी/1088/850-वी2, जवद्यमान ह;ैं और, बलराम-अम्बािी वन्र्िीव अभर्ारण्र् के चारों ओर के क्षत्रे को, जिसका जवस्ट्तार और सीमाए ं पाररजस्ट्थजतकी पर्ाावरणीर् स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें पैरा 1 म ें जवजनर्िष्टा ह,ैं िैव जवजवजधता की िजर ष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना म ें इसके पिात पर्ाावरण अजधजनर्म कहा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 गर्ा ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, गुिरात राज्र् के बलराम-अम्बािी वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर िून्र् (0) स े 3.519 दकलोमीटर जवजवध चौडाई वाले 282.18 वगा दकलोमीटर जवस्ट्ताररत क्षत्रे को बलराम-अम्बािी वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिसे इसम ें इसके पश् चात ् पाररजस्ट्थजतकी सवं ेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात् :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाए.ं- (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार बलराम-अम्बािी वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर िन्ू र् (0) स े लेकर 3.519 दकलोमीटर की जवजवध चौडाई वाला 282.18 वग ा दकलोमीटर क्षत्रे ह,ै और रािस्ट्थान के साथ अंत:राज्र्ीर् सीमा के कारण पाररजस्ट्थजतकी संवेिी िोन का िून्र् जवस्ट्तार ह।ै (2) बलराम-अम्बािी वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का वणान उपाबंध -I के रूप म ें संलग्न ह।ै (3) सीमा ब्र्ौरा और अक्षांि और ििे ांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करत े हुए वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबंध–IIक, उपाबंध–IIख, उपाबंध–IIग और उपाबंध-IIघ के रूप म ें सलं ग्न ह।ै (4) पाररजस्ट्थजतकी संवेिी िोन और बलराम-अम्बािी वन्र्िीव अभर्ारण्र् की सीमा के भ-ू जनिेिांकों की सूची उपाबंध-III की सारणी क और सारणी ख म ेंिी गई ह।ै (5) मुख्र् सबंिओंु के भ-ू जनिेिाकं ों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची उपाबंध -IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा स े और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसचू ना म ें दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी और राज्र् म ें सक्षम प्राजधकारी द्वारा सम्र्क रुप स ेअनुमोदित दकर्ा िाएगा। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत स े िो इस अजधसूचना म ें जवजनर्िष्ा ट दकए गए ह,ैं के अनुसार तथा सुसंगत केंरीर् और राज्र् जवजधर्ों के अनरुु प और केंरीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी। (3) आंचजलक महार्ोिना, उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ास े तैर्ार होगी:- (i) पर्ाावरण; (ii) वन और वन्र्िीव; (iii) करजि; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) ससंचाई और बाढ़ जनर्ंत्रण; (ix) नगरपाजलका; (x) पंचार्ती राि; (xi) लोक जनमााण जवभाग। (4) आंचजलक महार्ोिना अनमु ोदित जवद्यमान भ-ू उपर्ोग, अवसंरचना और दरर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना म ें इस प्रकार जवजनर्िष्ा ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दरर्ाकलापों म,ें िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (5) आंचजलक महार्ोिना म ें अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मरिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण स े संबंजधत ऐस ेअन्र् पहलओंु , जिन पर ध्र्ान िने ा आवश्र्क ह,ै के जलए उपबंध होंग े । (6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों स े अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, करजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षत्रे िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान करजि क्षत्रे , फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभर्ांकन करेगी। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें जवकासात्मक दरर्ाकलापों को जवजनर्जमत करन े के जलए प्रदरर्ा प्रिान की िाएगी और सारणी म ें र्थासूचीबद्ध पैरा 4 म ें प्रजतजिद्ध और जवजनर्जमत दरर्ाकलापों का पालन दकर्ा िाएगा। इसम ें स्ट् थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् और संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी। (9) राज्र् सरकार द्वारा इस प्रकार अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपन े करत्र्ों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबधं ों को प्रभावी करन े के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, उद्यान करजि क्षेत्रों, करजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दरर्ाकलापों के जलए उपर्ोग र्ा संपररवतना नहीं होगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर खंड (क) म ें जवजनर्िष्टा प्रर्ोिनों स े जभन्न प्रर्ोिनों के जलए करजि और अन्र् भूजम का संपररवतान जनगरानी सजमजत की जसफाररि पर और र्था लाग ू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स,े और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन े के जलए अनुज्ञात दकर्ा िाएगा, िैसे- (i) जवद्यमान सडकों को चौडा करना और उन्ह ेंसुिढ़र करना तथा नई सडकों का संजनमााण; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी ह;ैं सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगता गरह वास सजम्मजलत ह;ै और (v) पैरा 4 के अधीन दिए गए संवर्धात दरर्ाकलाप: परंत ु र्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूव ा अनुमोिन और संजवधान के अनुच्छेि 244 के उपबंधों र्ा तत्समर् प्रवरत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दरर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा: परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भ-ू अजभलेखों म ें उपसंिात कोई गलती, जनगरानी सजमजत के जवचार प्राप्त करन े के पिात ् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार ठीक होगी और उि गलती के सुधार की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंतु र्ह और भी दक गलती के सुधार म ें इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा। (ख) वनीकरण तथा वास िीणोद्धार दरर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत्प ािक करजि क्षत्रे ों म ें पुन: वनीकरण करन े के प्रर्ास दकए िाएंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (2) प्राकरजतक िल स्रोत.- आचंजलक महार्ोिना म ें सभी प्राकरजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज्र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दरर्ाकलाप प्रजतजिद्ध करन े के बारे म ें िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत स े मागाििाक जसद्धांत तैर्ार दकए िाएंगे। (3) पर्टा न र्ा पाररजस्ट्थजतकी पर्टा न.- (क) पाररजस्ट्थजतकी संविे ी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दरर्ाकलाप र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी सवं ेिी िोन के जलए होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामि ा स े तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप म ें होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दरर्ाकलाप जनम्नानुसार जवजनर्जमत होंग,े अथाात:्- (i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनम ें िो भी जनकट ह,ै नर् े वाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनज्ञु ात नहीं होंगे: परंत,ु संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉट ा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्िष्टा क्षेत्रों म ें पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दरर्ाकलापों र्ा जवद्यमान पर्टा न दरर्ाकलापों का जवस्ट्तार केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष्र ीर् व् र्ाघ्र सरं क्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेत े हुए (समर्- समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दरर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िष्टा संवीक्षा और जनगरानी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए होटल र्ा ररसोट ा र्ा वाजणजज्र्क स्ट्थापना का संजनमाणा अनुज्ञात नहीं दकर्ा िार्ेगा । (4) नसै र्गका जवरासत.- पाररजस्ट्थजतकी संवेिी िोन म ें महत्वपणू ा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत क्षत्रे , िैल जवरचनाए,ं िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप म ें परररक्षण और संरक्षण के जलए तैर्ार की िाएगी । (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्करजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप म ेंतर्ै ार की िाएगी। (6) ध्व जन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ेंध्वजन प्रििू ण के जनर्त्रं ण और जनवारण का अनपु ालन दकर्ा िाएगा। (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रििू ण के जनवारण और जनर्ंत्रण का वार्ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाल े पर्ाावरणीर् प्रििू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा। (9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पररवतान मंत्रालर् की अजधसूचना स.ं का.आ. 1357(अ), तारीख 8 अप्रलै , 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक सामग्री का जनपटान पाररजस्ट्थजतकी संवेिी िोन स े बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत स े दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा। (10) िवै जचदकत्सा अपजिष्ट .- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना स.ं सा.का.जन 343 (अ), तारीख 28 माच,ा 2016, के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबधं न अनुज्ञात दकर्ा िा सकेगा। (11) शलाजस्ट्टक अपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें शलाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना स.ं सा.का.जन 340(अ), तारीख 18 माच,ा 2016 द्वारा प्रकाजित शलाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माच,ा 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा । (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध म ें आंचजलक महार्ोिना म ें जविेि उपबंध सजम्मजलत दकए िाएंग े और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दरर्ाकलापों के अनुपालन को जनगरानी करेगी। (15) र्ानीर् प्रििू ण.- लाग ू जवजधर्ों के अनपु ालन म ें वाहन प्रििू ण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजू ित उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर र्था सिं ोजधत मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििू णकारी उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों को सरं क्षण.- पहाडी ढलानों का सरं क्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाडी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी; (ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनज्ञु ा नहीं िी िाएगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिद्ध और जवजनर्जमत दकए िान े वाल े दरर्ाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दरर्ाकलाप पर्ावा रण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसम ें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण)[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 अजधजनर्म, 1972 (1972 का 53) सजम्मजलत ह ैं पाि बनाम भारत संघ के मामले म ें माननीर् उच्चतम न्र्ार्ालर् के आिेि 4 अगस्ट्त ,2006 और 2012 की ररट र्ाजचका (जसजवल) स.ं 435 में गोवा फाउंडेिन बनाम भारत संघ के मामल े म ें तारीख 21 अप्रैल ,2014 के आिेि के अनुसरण म ेंहोगा । 2. प्रििू ण (िल, वार्ु, मरिा, पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी: ध्वजन, आदि) उत्पन करने वाले उद्योगों की परन्त,ु केन्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्समर् पर- स्ट्थापना । र्था संिोजधत मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर- प्रििू णकारी उद्योगों को अनज्ञु ात दकर्ा िाएगा और इसके अजतररि गैर- प्रििू णकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. ब रहत िल जवद्यतु प्रजतजिद्ध। पररर्ोिना की स्ट्थापना। 4. दकसी पररसंकटमर् प्रजतजिद्ध। पिाथ ा का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। 5. प्राकरजतक िल जनकार्ों प्रजतजिद्ध। र्ा क्षेत्र भूजम म ें अनुपचाररत बजहस्रााव का जनस्ट्सारण । 6. नई आरा जमलों की पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की स्ट्थापना और जवद्यमान स्ट्थापना। आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा। 7. ईंट भट्टों की स्ट्थापना प्रजतजिद्ध। करना। 8. फमों, जनगम और प्रजतजिद्ध। कंपजनर्ों द्वारा बडे पैमान े पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 9. ठोस अपजिष्ट जनपटान प्रजतजिद्ध। स्ट्थल और ठोस की स्ट्थापना और िैव जचदकत्सा अपजिष्ट के जलए सामान्र् भस्ट्मीकरण की सुजवधा। आ. जवजनर्जमत दरर्ाकलाप 10. वाजणजज्र्क होटलों और पाररजस्ट्थजतकी पर्ाटन दरर्ाकलापों लघ ु अस्ट्थार्ी सरं चनाओं के जसवार् संरजक्षत ररसोटों की स्ट्थापना । क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक नए वाजणजज्र्क होटल और ,इनम ें िो भी जनकट ह ै ,ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परंत,ु र्ह दक संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनम ें स,े िो भी जनकट हो सभी नए पर्ाटन दरर्ाकलाप र्ा जवद्यमान दरर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ूमागाििी जसद्धांतों के अनरुु प होगा। 11. संजनमााण दरर्ाकलाप । (क) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनम ें िो भी जनकट हो, दकसी भी प्रकार के नर् े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी: परंत ु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को परू ा करन े के जलए, पैरा 3 के उप परै ा (1) म ें सूचीबद्ध दरर्ाकलापों सजहत अपन े उपर्ोग के जलए, अपनी भूजम म ें भवन उप-जवजधर्ों के अनुसार, संजनमााण करन े की अनुज्ञा होगी: परंत ु र्ह दक गैर–प्रििू णकारी लघ ु उद्योगों स े संबंजधत संजनमााण दरर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत स ेजवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे । (ख) एक दकलोमीटर क्षत्रे स े परे र् े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 12. प्रििू ण उत्पन्न न करन े फरवरी, 2016 म ें केन्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योगों म ें वगीकरण के वाले लघ ु उद्योग। अनुसार समर्-समर् पर र्था संिोजधत गरै -प्रििू णकारी उद्योग और अपररसंकटमर् म,ें लघ ु और सेवा उद्योग, करजि, पुष्प करजि, उद्यान करजि र्ा पाररजस्ट्थजतकी संवेिी िोन स े िेिी सामग्री स े उत्पािों को उत्पन्न करन े वाल े करजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 13. वरक्षों की कटाई। (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों म ें वरक्षों की कटाई नहीं होगी । (ख) वरक्षों की कटाई संबंजधत केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होग े । 14. वन उत्पािों र्ा गैर काष्ठ लाग ू जवजधर्ों के अनुसार जवजनर्जमत होंगे । वन उत्पािों का संग्रहण । 15. जवद्युत और संचार टावरों लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े (भूजमगत केबल के जबछाए िान े को का पररजनमााण और बढ़ावा दिर्ा िा सकेगा)।[भाग II—खण् ड जवजनर्मनों और उपलब्ध चौडा करना और उन्ह ें मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा । सुिढ़र करना तथा नवीन सडकों का संजनमााण। 19. पर्टा न स े संबंजधत अन्र् लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । दरर्ाकलाप िैसे गम ा वार् ु गुब्बारें, हले ीकॉशटर, ड्रोन, माइरोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षत्रे के ऊपर स े उडना िैसे दरर्ाकलाप करना। 20. पहाडी ढालों और निी लाग ू जवजधर्ों के अनुसार जवजनर्जमत होंगे । तटों का संरक्षण । 21. राजत्र म ें र्ाजनक लाग ू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंग े । र्ातार्ात का संचलन । 22. स्ट्थानीर् समुिार्ों द्वारा स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ू जवजधर्ों के अधीन अनुज्ञात होंग े । चल रही करजि और बागवानी प्रथाओं के साथ िग्ु धिाला, िग्ु घ उद्योग, करजि और मछली पालन। 23. प्राकरजतक िल जनकार्ों िल जनकार्ों म ें उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण स े बचा र्ा सतही क्षत्रे म ें िाएगा और उपचाररत अपजिष्ट िल के पनु :चरण और पुन:उपर्ोग के जलए प्रर्ास उपचाररत बजहस्रााव का दकए िाएंगे। अन्र्था लाग ू जवजधर्ों के अनुसार उपचाररत परै ा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजिद्ध दरर्ाकलापों के, जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा दरलाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे सबं ंद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा। (5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघं न करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करन े के जलए सक्षम होगा। (6) जनगरानी सजमजत the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O 55 (E), dated the 5th January 2021, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 5th January 2021; AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the aforesaid draft notification were duly considered by the Central Government; AND WHEREAS, the Balaram-Ambaji Wildlife Sanctuary is spread over an area of 544.78 square kilometers and is located in Danta, Amirgadh, Palanpur and Vadgam Taluka of Banaskantha District in the State of Gujarat, and the Wildlife Sanctuary is situated in the North Western parts of Banaskantha District between Jessore Wildlife Sanctuary in the West, Sabarmati River in the East and adjoins Rajasthan border in the North; AND WHEREAS, the Balaram-Ambaji Wildlife Sanctuary was declared as Wildlife Sanctuary vide notification no. GVN/27/WLP/1088/850-V2, dated the 7th August 1989 with an area of 542.08 square kilometers which after rationalisation is 544.78 square kilometers; AND WHEREAS, the Sanctuary acts as a catchment area for two major rivers of North Gujarat-Banas and Sabarmati and the forests of the protected area play an important role in conservation of the Aravalli mountain range which offers a great landscape to unique and important biodiversity in the country, and it also helps in controlling the southward expansion of Thar Desert;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 AND WHEREAS, the Balaram-Ambaji Wildlife Sanctuary treasures many rare and endangered varieties of trees, herbs and shrubs alongwith rare and endangered species of wildlife, the Sanctuary is consisted of Southern Dry Mixed Deciduous and Desert Thorn forests and the total recorded floral species in the area include 101 species of trees, 86 species of shrubs, 67 species of climbers, 1 species of pteridophyte, 180 species of herbs and 49 species of sedges and grasses AND WHEREAS, the major vegetation recorded in the area are khair (Acacia catechu), haldu (Adina cordifolia), bili (Aegle marmelos), sitaphal (Annona squamosa), dhavado (Anogeissus latifolia), ingoriya (Balanites aegyptica), kachnar (Bauhinia purpurea), salai (Boswellia serrata), asan (Bridelia retusa), khakhro (Butea monosperma), kumbhio (Casearia elliptica), saru (Casuarina equisetifolia), gunda (Cordia dichotoma), sisam (Dalbergia latifolia), sandeshro (Delonix elata), timru (Diospyros melanoxylon), tambolia (Ehretia laevis), amla (Emblica officinalis), mokho (Schrebera swietenoides), kadayo (Sterculia urens), jambu (Syzygium cumuni), ragat roydo (Tecomella undulate), baheda (Terminalia bellarica), dudhi (Wrightia tomentosa), mindhal (Xeromorphis spinosa), bordi (Zizyphus mauritiana), etc; AND WHEREAS, the recorded faunal species from the area includes 12 species of amphibians, 21 species of reptiles, 202 species of birds and 23 species of mammals, and the endangered Sloth bear (Melursus ursinus) is considered to be the flagship species of the area and the Sanctuary marks the western most distribution of the sloth bear in the country. AND WHEREAS, the major fauna of the Balaram-Ambaji Wildlife Sanctuary are grey musk shrew (Sunchus murinus), bat (Cyanopterus sphinx), panther (Panthera pardus), ratel (Malivora capensis), common langur (Prebytis entellus), striped hyaena, (Hyaena hyaena), wild boar (Sus scrofa), jungle cat (Felis chans), palm squirrel (Funambulus pennant), Indian pangolian (Manis carassicata), field mouse (Mus booduga), Indian fox (Vulpes bengalensis), wolf (Camis lupus), common mangoose (Herpestes edwardsi), house rat (Rattus rattus), desert cat (Felis lybica), blue bull (Boselaphus tragocamelus), Indian hare (Lepus migricollis), Indian porcupine (Hystrix indica), pale hedgehog (Paraechinus micropus), jackal (Canis aureus), civet cat (Vivaricula indica, starred tortoise (Geochaloue elegans), Russel's viper (Vipera russelli), fan throated lizard (Sitana pomticeriana), etc; AND WHEREAS, the Balaram-Ambaji Wildlife Sanctuary is abode to many endangered, threatened and vulnerable avi-faunal species such as red spurfowl (Galloperdix spadicea), Osprey (Pandion haliaeatus), lndian black vulture (Sarcogyps calvus), grey junglefowl (Gallus sonneratii), white bellied minivet (Pericrocotus rythropygus), painted stork (Mvcturia leucocephala), white winged black tit (Parus nuchalis), red necked falcon (Falco chicquera) etc. Other avifaunal species present are Tickell’s blue flycatcher (Muscicapa ticlelliae), singing bush lark (Mirafra javanica), red winged bush lark (Mirafra crytyropetra), Nisht heron (Nycricorax nycricorax), white eye (Zosterops palpebrosa), purple heron (Ardea purpures), Franklin's wren warbler (Prinia hodgsonii), alpiue swift (Apus melba), griffon vulture (Gyps fulvus), glossy ibis (Plegadis falcinellus), marsh harrier (Circus aeruginosus), etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1, around Balaram-Ambaji Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 282.18 square kilometers to an extent varying from zero (0) to 3.519 kilometers around the boundary of Balaram-Ambaji Wildlife Sanctuary, in the State of Gujarat as the Balaram-Ambaji Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco- sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be of 282.18 square kilometres with an extent ranging from zero (0) to 3.519 kilometers around the boundary of Balaram-Ambaji Wildlife Sanctuary, and the zero extent of the Eco-sensitive zone is due to inter-State border with Rajasthan. (2) The boundary description of Balaram-Ambaji Wildlife Sanctuary and its Eco-sensitive Zone is appended as Annexure-I.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) The maps of the Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC and Annexure-IID (4) List of geo co-ordinates of the boundary of Balaram-Ambaji Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent. (9) Solid wastes.-Disposal and management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-medical waste.– Bio-medical waste management shall be as under:- (a) the Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. Setting of industries causing New industries and expansion of existing polluting industries in the pollution (Water, Air, Soil, Noise, Eco-sensitive Zone shall not be permitted:32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] etc.). Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of major Prohibited. hydroelectric project. 4. Use or production or processing Prohibited. of any hazardous substance. 5. Discharge of untreated effluents Prohibited. in natural water bodies or land area. 6. Setting up of new saw mills. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale non polluting Non polluting industries as per classification of industries issued by industries. the Central Pollution Control Board in February, 2016 as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority. 13. Felling of trees. Monitoring Committee for Monitoring Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification, under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. An expert in the area of Ecology and Environment to be nominated by the State (iii) Member; Government A representative of the department of Forests and Environment Department, Member; (iv) Government of Gujarat Regional officer, (District- Banaskantha, Palanpur), Gujarat State Pollution Member; (v) Control Board (vi) A representative of State Biodiversity Board Member; (vii) Deputy Conservator of Forests, Banaskantha Di vision, Palanpur. Member-Secretary. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 35 (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended as Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
