असाधारण म ें प्रकाजित की गई थी, जिसमें ऐस े सभी व्यजिर्ों स,े जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन े वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा ें चरूु जिल े के सुिानगढ़ तहसील म ें जस्ट्थत ह;ै और, ताल छापर वन्र्िीव अभर्ारण्र् अजधसूचना संख्र्ा एफ.7 (379) रािस्ट्व ए/59 तारीख 19 जसतम्बर, 1962 द्वारा 1962 में िंगली पिुओं और पजक्षर्ों के संरक्षण के जलए ‘ररज़वा क्षेत्र’ घोजित दकर्ा गर्ा था। र्ह क्षत्रे अंतत: 6287 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] रािस्ट्थान वन अजधजनर्म, 1953 की धारा 20 के अधीन आिेि एफ 7 (118) रािस्ट्व /66 तारीख 11.05.1966 द्वारा ‘ररिवा वन’ अजधसूजचत दकर्ा गर्ा था और 08.09.1966 को रािस्ट्थान रािपत्र में प्रकाजित दकर्ा गर्ा। अंजतम अजधसूचना की अवजध के िौरान खंड का कुल क्षेत्रफल 2014.25 एकड़ (815 हक्े टेर्र) था और रािपत्र अजधसूचना संख्र्ा एफ (379) रािस्ट्व /ए/71 तारीख 13 िुलाई, 1971 द्वारा सिं ोजधत दकर्ा गर्ा था। 1983 में कलेक्टर चुरू के द्वारा, कुल 815 ह.े क्षेत्रफल में से 96 हक्े टेर्र भूजम जनकटतम ग्राम के नमक खजनकों और दकसानों को आबंरटत की गई थी। क्रीड़ा क्षेत्र में प्रवेि जनर्म, 1958 के जनर्म 2क के अनुसार रािस्ट्थान वन्र्िीव और पक्षी संरक्षण अजधजनर्म, 1951 की धारा 5 के अंतगता ररिवा क्षेत्र के रूप में घोजित क्षेत्र को अभर्ारण्र् घोजित दकर्ा िा सकता ह।ै अभर्ारण्र् में 4500 से अजधक ब्लैकबक, चचंकारा और पजक्षर्ों की 250 से अजधक प्रिाजतर्ा ह।ै र्ह क्षेत्र प्रवासी पजक्षर्ों जविेितौर से रेप्टसा के जलए जवख्र्ात ह।ै और, ताल छापर वन्र्िीव अभर्ारण्र् म ें वनस्ट्पजत और िीविंतु की िलु ाभ, लुप्तप्रार् और संकटापन्न प्रिाजतर्ों िैसे मोथा ग्रास (साइपेरस रोटुंडुस), रेड फलारोपे (फलारोपुस फुजलकररउस), चीनी पोंड बगुला (अरिेओला बच्चुस), रेजगस्ट्तानी मॉजनटर जलिााड (वारानुस जग्रसेउस), स्ट्पाइनी टेल्ड जलिाडा (र्ूरोमैजस्ट्टक्स हाडाजवक्की),एडोसा (एधाटोडा वाजसका), लाल सट्टा सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आव‍र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण), 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की उपधारा (1) तथा धारा 3 की उपधारा (2) के खडं (v) और खंड (xiv) एवं उपधारा (3) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, रािस्ट्थान राज्र् म ेंताल छापर वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर तक जवस्ट्ताररत क्षेत्र को ताल छापर वन्र्िीव अभर्ारण्र्, पाररजस्ट्थजतकी सवं ेिी िोन (जिसे इसमें इसके पिात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ् :- 1. पाररजस्ट्थजतकी संविे ी िोन का जवस्ट्तार और सीमाए.ं - (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार ताल छापर वन्र्िीव अभर्ारण्र् के चारों ओर 1.0दकलोमीटर स े 3.4 दकलोमीटर तक जवस्ट्तृत ह।ै पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 22.45 वगा दकलोमीटर ह।ै जवजभन्न दििाओं में पाररजस्ट्थजतकी दकलोमीटर िजक्षण 3.4 दकलोमीटर िजक्षण-पजिम 1.2 दकलोमीटर पजिम 1.6 दकलोमीटर उत्तर-पजिम 1.3 दकलोमीटर (2) ताल छापर वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं -I म ें दिर्ा गर्ा ह।ै (3) पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल ेग्रामों की सूची उपाबंध-II के रुप म ेंसंलग्न ह।ै (4) सीमा जववरण और अक्षांि और ििे ांतर के साथ पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र उपाबधं –IIIक, उपाबधं –IIIख, उपाबधं –IIIग, उपाबधं –IIIघ, उपाबधं –IIIङ और उपाबधं –IIIच के रूप में सलं ग्न ह।ै (5) ताल छापर वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन के भू- जनिेिांक उपाबधं -IVक और उपाबधं - IVख में दिए गए ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट् थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर और स्ट्थानीर् लोगों के परामि ा स े तथा इस अजधसूचना म ेंदिए गए उपबंधों की पुजष्ट करते हुए, आंचजलक महार्ोिना तैर्ार करेगी। (2) पाररजस्ट् थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना, राज्र् सरकार द्वारा इस अजधसूचना में दिए गए उपबंधों के अनुसार और केंद्रीर् और राज्र् की सुसंगत जवजधर्ों और केंद्रीर् सरकार द्वारा िारी दििा-जनििे ों, र्दि कोई हो, के अनरूु प तैर्ार की िाएगी। (3) आंचजलक महार्ोिना, उि र्ोिना में पर्ाावरणीर् और पाररजस्ट्थ जतकी जवचारों को एकीकृत करन े के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार की िाएगी, अथाता ्:- (i) पर्ाावरण; (ii) वन एवं वन्र्िीव; (iii) कृजि; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) जसचाई एवं बाढ़ जनर्ंत्रण;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (ix) नगरपाजलका; (x) पंचार्ती राि; (xi) लोक जनमााण जवभाग; (xii) रािमाग;ा और (xiii) राज्र् प्रििू ण जनर्ंत्रण बोडा। (4) आंचजलक महार्ोिना में जवद्यमान अनुमोदित भ-ू उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं होगा िब तक दक ऐसा इस अजधसूचना म ें जवजनर्िष्टा न हो तथा आचंजलक महार्ोिना म ें सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्ह ें अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना में वनरजहत क्षेत्रों के प्रत्र्ावतान, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार् की आव‍र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आव‍र्क ह।ै (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एव ं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों और सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा। र्ोिना को जवद्यमान और प्रस्ट्ताजवत भू-उपर्ोग की जविेिताओं का ब्र्ौरा दिर्ा िाएगा। (7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन म ें होने वाले जवकास का जवजनर्मन करेगी और सारणी में सूचीबद्ध पैरा 4 में प्रजतजिद्ध और जवजनर्जमत उपबंधों दक्रर्ाकलापों का पालन दकर्ा िाएगा और इसमें स्ट् थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना क्षेत्रीर् जवकास र्ोिना के साथ सह-टर्मानस होगी। (9) इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपन े कार्ों को पूरा करन े के जलए इस प्रकार अनुमोदित आंचजलक महार्ोिना, मानीटरी सजमजत के जलए एक जनिेि िस्ट्तावेि होगी। (10) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होने तक, सभी नए जनमााण और अन्र् जवकासात्मक दक्रर्ाकलापों को मानीटरी सजमजत को जनर्िष्टा दकर्ा िाएगा । 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्-- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात् :- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थ जतकी संवेिी िोन म ें वनों, उद्यान-कृजि क्षेत्रों, कृजि क्षेत्रों, आमोि-प्रमोि के प्रर्ोिन के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक दक्रर्ाकलापों के जलए क्षेत्रों के रुप म ें उपर्ोग र्ा संपररवतान नहीं होगा : परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर इस खंड (क) म ें जवजनर्िष्टा प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजि और अन्र् भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्द्रीर् सरकार र्ा राज्र् सरकार के र्था लाग ू अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स,े और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आव‍र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िा सकेगा, िैस-े (i) जवद्यमान सड़कों को चौड़ा करना और मिबूत करना और नई सड़कों का जनमााण करना; (ii) अवसंरचनात्मक और नागररक सुजवधाओं का जनमााण और नवीनीकरण;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) प्रििू ण काररत न करन े वाले लघु उद्योग; (iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी ह;ैं सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं समर्थात पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगता गृह वास सजम्मजलत है; और (v) पैरा 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप: परंत ु र्ह और दक राज्र् सरकार के क्षेत्रीर् नगर र्ोिना अजधजनर्म और अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना तथा संजवधान के अनुच्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त दकसी जवजध की अनुपालन के जबना, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी िाजमल ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा : परंत ु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर भू-अजभलेखों म ें पाई गई कोई त्रुरट मानीटरी सजमजत के जवचार अजभप्राप्त करने के पिात ् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार संिोजधत की िाएगी और उि त्रुरट के संिोधन की सूचना केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी । परंत ु र्ह भी दक त्रुरट के संिोधन म ें इस उप-पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा । (ख) वनरोपण और पर्ाावरण पनु ः बहाली दक्रर्ाकलापों के माध्र्म से अनुप्रर्िु र्ा अनुत्पािक कृजि क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंग े । (2) प्राकृजतक िल जनकार्.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और नवीनीकरण की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा दििा-जनिेि इस रीजत से तैर्ार दकए िाएंग े दक उसमें ऐसे क्षेत्रों में र्ा उसके पास जवकास दक्रर्ाकलापों को प्रजतजिद्ध दकर्ा िा सके िो ऐसे क्षेत्रों के जलए हाजनकारक हों। (3) पर्टा न र्ा पाररजस्ट्थजतकी-पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन के अन्िर पर्ाटन स े संबंजधत जवद्यमान दक्रर्ाकलापों का जवस्ट्तार र्ा सभी नर्े पाररजस्ट्थजतकी-पर्ाटन दक्रर्ाकलाप पाररजस्ट् थजतकी संवेिी िोन के जलए पर्ाटन महार्ोिना के अनुसार होंगे । (ख) पाररजस्ट्थ जतकी-पर्टा न महार्ोिना, राज्र् के पर्ाावरण और वन जवभाग के परामिा से राज्र् पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप म ेंहोगी। (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट् थजतकी-पर्ाटन संबधं ी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थ जतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण (समर्-समर् पर र्था संिोजधत) द्वारा िारी पाररजस्ट्थजतकी-पर्ाटन संबंधी दििाजनिेिों के अनुसार होगा; (ii) आंचजलक महार्ोिना तैर्ार होने और अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िष्टा संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों, िैसे दक िीन पूल आरजक्षत क्षत्रे , िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी परररक्षण और संरक्षण के जलए जवरासत संरक्षण र्ोिना तैर्ार की िाएगी िो आंचजलक महार्ोिना का भाग होगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके सरं क्षण के जलए एक जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप तैर्ार की िाएगी। (6) ध्व जन प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण का जनवारण और जनर्ंत्रण भारत सरकार के पर्ाावरण और वन मंत्रालर् की समर् समर् पर र्थासंिोजधत अजधसूचना के द्वारा प्रकाजित, ध्वजन पििाू ण (जवजनर्म एवं जनर्ंत्रण) जनर्म, 2000, के उपबंधों के अनुसार दकर्ा िाएगा । (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन में वार्ु प्रििू ण का जनवारण और जनर्ंत्रण, के द्वारा प्रकाजित वार्ु (प्रििू ण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14), तथा पर्ाावरण अजधजनर्म तथा तद्धीन बनाए गए जनर्मों, के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, िल प्रििू ण) जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का (6 तथा पर्ाावरण अजधजनर्म और तद्धीन बनाए गए जनर्मों, के उपबंधों म ें बिलाव समर् समर् पर दकर्ा िाएगा। (9) ठोस अपजिष्ट-. ठोस अपजिष्ट का जनपटान और प्रबंध जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिस्ट्त, पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक सामग्री को पाररजस्ट्थजतकी संवेिी िोन के बाहर पहचान दकए गए स्ट्थलों पर पर्ाावरण की िजृ ष्ट स ेस्ट्वीकार् ा रीजत स े जनपटार्ा िा सकता ह ै। (ख) सरु जक्षत और पर्ाावरणीर् ठोस अपजिष्ट के जनपटान का प्रबंधन परु ाने जनर्मों के अनुसार जचजन्हत उपकरणों के माध्र्म स े पाररजस्ट्थजतकी संवेिी िोन म े दकर्ा िा सकता ह ै। (10) िैव-जचदकत्सा अपजिष्ट:- िैव जचदकत्सा अपजिष्ट का जनपटान और प्रबंध जनम्नानुसार दकर्ा िा (क) िैव जचदकत्सा अपजिष्ट का जनपटान, पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना के अधीन प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) सुरजक्षत और पर्ाावरणीर् िैव जचदकत्सा अपजिष्ट के जनपटान का प्रबंधन पुरान े जनर्मों के अनुसार जचजन्हत उपकरणों के माध्र्म स ेपाररजस्ट्थजतकी सवं ेिी िोन म े दकर्ा िा सकता ह ै। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं -.पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंध, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसचू ना के अधीन ,प्लाजस्ट्टक अपजिष्ट प्रबधं न जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं .- पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण और जवध्वंस अपजिष्ट का प्रबंध, पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना के अधीन प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनसु ार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंध, पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् द्वारा, समर्-समर् पर र्था संिोजधत, भारत सरकार के पर्ाावरण और वन मंत्रालर् की अजधसूचना द्वारा प्रकाजित ई– अपजिष्ट प्रबंधन जनर्म, 2016, के उपबंधों के अनुसार दकर्ा िाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (14) वाहन-र्ातार्ात.- वाहन-र्ातार्ात को पर्ाावास-अनुकूल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना में जवजनर्िष्टा उपबंध सजम्मजलत दकए िाएंगे तथा आंचजलक महार्ोिना के तैर्ार होने तक और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होन े तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और तद्धीन बनाए गए जनर्मों और जवजनर्मों के अधीन वाहन-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रििू ण.- वाहन िजनत प्रििू ण का जनवारण और जनर्ंत्रण लाग ू जवजधर्ों के अनुपालना में होगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे िैस े प्राकृजतक गैस इत्र्ादि । (16) औद्योजगक ईकाईर्ा:ं -(i) रािपत्र गिट म ें अजधसूचना के प्रकािन की तारीख से र्ा उसके पिात,् पाररजस्ट् थजतकी संवेिी िोन में नए प्रििू णकारी उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ii) फरवरी 2016 म ें केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी दििा जनिेिों म ें उद्योगों के वगीकरण के अनुसार पाररजस्ट् थजतकी संवेिी िोन में केवल गरै प्रििू णकारी उद्योगों को अनुमजत िी िाएगी िब तक इस अजधसूचना म ें जवजनर्िष्टा न हो, और इसके अजतररि गैर प्रििू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा । (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ईंजगत दकर्ा िाएगा िहां दकसी भी जनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी संविे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म के उपबंधों और तद्धीन अधीन बने जनर्मों, जिसम ें तटीर् जवजनर्मन िोन और भारत सरकार के तत्कालीन पर्ाावरण एव ं वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 के पर्ाावरणीर् समाघात जनधारा ण अजधसूचना अन्र् लागू जवजधर्ां भी ह,ैं िो समर् समर् पर र्था संिोजधत। नीच ेिी गई सारणी म ेंजवजनर्िष्टा रीजत स े जवजनर्जमत होंगे, अथाात:्- सारणी क्रम स.ं दक्रर्ाकलाप जववरण (1) (2) (3) क. प्रजतजिद्ध दक्रर्ाकलाप 1. सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघिणा इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका ररट र्ाजचका (सी) स.ं 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले म ें माननीर् उच्चतम न्र्ार्ालर् आिेि और 2012 की ररट र्ाजचका डब्ल.ूपी (सी ) स.ं 435 के 2012 और आई.ए. संख्र्ा 1000 के 2003 म ें गोवा फाउंडेिन बनाम भारत संघ के मामले म ें तारीख 03.06.2022 के आिेि के अनुसरण म ें होगा और इसी[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 क्रम म ें 26.04.2024 और 28.04.2024 का आिेि 2022, आई.ए. संख्र्ा 131377 का अनुसरण होगा । 2. प्रििू ण (िल, वार्ु, मृिा, ध्व जन पाररस् जथजतकी संवेिी िोन म ें नए उद्योगों और जवद्यमान प्रििू ण आदि) करने वाले उद्योगों की फैलाने वाल ेउद्योगों के जवस्ट्तार की अनुमजत नहीं िी िाएगी: स्ट् थापना । परन्त,ु दक गरै -प्रििू णकारी उद्योगों को फरवरी 2016 में केंद्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी दििा-जनिेिों म ें उद्योगों के वगीकरण के अनुसार पाररजस्ट् थजतकी संवेिी िोन के भीतर अनुमजत िी िाएगी, िब तक दक इस अजधसूचना में जवजनर्िष्टा न हो और इसके अजतररि गैर-प्रििू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। 3. मुख्र् िल जवद्युत पररर्ोिनाओं की प्रजतजिद्ध । स्ट्थापना । 4. दकसी पररसंकटमर् पिाथा का प्रजतजिद्ध। प्रर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। 5. प्राकृजतक िल जनकार्ों र्ा सतही प्रजतजिद्ध। क्षत्रे म ें अनुपचाररत बजहस्रााव का जनस्ट्सारण । 6. ठोस और िैव जचदकत्सा अपजिष्ट पाररजस्ट्थजतक संवेिी िोन के भीतर कोई ठोस अपजिष्ट जनपटान के जलए ठोस अपजिष्ट जनपटान स्ट्थल और ठोस अपजिष्ट उपचार/प्रसंस्ट्करण सुजवधा की अनुमजत स्ट्थल और सामान्र् भस्ट्मीकरण नहीं ह।ै आग े औद्योजगक प्रदक्रर्ा और स्ट्वास्ट्थ्यर् प्रजतस्ट्थान/ सुवउढ़ की स्ट्थापना । अस्ट्पताल आदि स े उत्पन्न दकसी भी प्रकार के ठोस अपजिष्ट के उपचार के जलए सामान्र् र्ा व्यजिगत भस्ट्मक सुजवधा की स्ट्थापना प्रजतजिद्ध ह।ै 7. फामों ,कॉपोरेट और कॉम्पजनर्ों प्रजतजिद्ध । द्वारा बड़े पैमान े पर वाजणजज्र्क पिुधन संपिा ओर कुक्कुट फॉमों की स्ट्थापना 8. आरा मीलों की स्ट्थापना । पाररजस्ट् थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा मीलों के जवस्ट् तार की अनुमजत नहीं िी िाएगी । 9. ईंट भट्टों की स्ट्थापना। प्रजतजिद्ध। ख.जवजनर्जमत दक्रर्ाकलाप 10. होटलों और ररसोटों की पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु अस्ट्थार्ी संरचनाओं वाजणजज्र्क स्ट्थापना। के जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना अनुज्ञात नहीं होगी: परन्तु र्ह, दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, पर्ाटन महार्ोिना और लागू दििाजनिेिों की अनुरुपता से इनमें िो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार होगा।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 11. संजनमााण दक्रर्ाकलाप। (अ)सरं जक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का नर्ा वाजणजज्र्क संजनमााण अनुज्ञात नहीं दकर्ा िाएगा: परन्त ु र्ह, दक स्ट् थानीर् लोगों को पैरा 3 के उप परै ा (1) म ें वर्णात दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आव‍र्कताओं को परू ा करने जलए संजनमााण करन े की अनुमजत भवन उपजवजधर्ों के अनुसार िी िाएगी: परन्त ु र्ह और दक ऐसे लघु उद्योगों िो प्रििू ण उत् पन् न नहीं करत े ह,ैं से संबंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लाग ूजनर्मों और जवजनर्मों, र्दि कोई हों, (ब) महा र्ोिना के एक दकलो मीटर के िार्रे के आगे लागू दकर्ा िाएगा । 12. लघु पैमाने के गरै -प्रििू णकारी फरवरी 2016 में केंद्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योगों उद्योग। के वगीकरण के तैर्ार करत े ह,ैं को सक्षम प्राजधकारी द्वारा अनुमजत िी िाएगी और समर् समर् पर र्था संभव । 13. वृक्षों की कटाई । (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई केंद्रीर् र्ा संबंजधत राज्र् के अजधजनर्म र्ा तद्धीन अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 14. वन उत्पािों संख्र्ांक का .आ.1553 (अ) ,तारीख 14 जसतंबर, 2006, और पर्ाावरण, वन मंत्रालर् म ें केन्द्रीर् सरकार को जनर्िष्टा करके और उसके पैरा 4 के अधीन सारणी में र्था जवजनर्िष्टा जनजिद्ध दक्रर्ाकलापों के जसवार्, पाररजस्ट्थजतकी संवेिी िोन में आते ह ैंऔर र्था जस्ट्थजत , िलवार्ु ,पररवतान र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरणीर् मंिूरी के जलए होंगे। (2) भारत सरकार के तत्कालीन पर्ाावरण एव ं वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची म ें न आने वाले दक्रर्ाकलाप और पाररजस्ट्थजतकी संवेिी िोन म ें आने वाल,े उसके पैरा 4 के अधीन सारणी म ें जवजनर्िष्टा प्रजतजिद्ध दक्रर्ाकलापों के जसवार्, जनगरानी सजमजत द्वारा वास्ट्तजवक साइट-जवजनर्िष्टा की जस्ट्थजतर्ों के आधार पर संवीक्षा की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को CLIMATE CHANGE NOTIFICATION New Delhi,the 27th September, 2024 S.O .4242 (E ).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 2000(E), dated the 2nd May, 2023 inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 3rd May, 2023; AND WHEREAS, objections and suggestions received from persons and stakeholders in respect of the said draft notification have been considered by the Central Government; AND WHEREAS, Tal Chhapar Wildlife Sanctuary is spread over an area of 7.1977 Square Kilometers and is located in Sujangarh Tehsil of Churu District in the state of Rajasthan ; AND WHEREAS, Tal Chhapar was declared a ‘Reserved Area’ for the protection of wild animals and birds in 1962, vide F.7 (379) Revenue A/ 59 dated the 19th September, 1962 and this area was finally notified as Reserved Forest vide F7 (118) Revenue/66 dated the 11th May, 1966 under section 20 of the Rajasthan Forest Act, 1953 (13 of 1953) and published in Rajasthan Gazette on the 8th September, 1966 and at the time of final notification, total area of the block was 2014.25 acre (815 Ha.) which was further amended vide Gazette Notification No. F (379) revenue /A/71 dated the 13 July, 1971 and out of the 815 ha, total area of about 96 ha of land was allotted to the salt miners and farmer of nearby village by the Collector Churu in 1983 and the area was declared as Wildlife Sanctuary as per the Entrance to Games Areas Rules, 1958 rule 2A, section 5 of the Rajasthan Wild Animals and Birds Protection Act, 1951(13 of 1951) and the sanctuary is home to more than 4500 individuals of Blackbucks, Chinkara and more than 250 species of birds and the area is widely popular for migratory birds especially raptors. AND WHEREAS, Tal Chhapar Wildlife Sanctuary provide habitat to rare, endangered and threatened species of flora and fauna such as motha grass (Cyperus rotundus), red phalarope (Phalaropus fulicarius), Chinese pond heron (Ardeola bacchus), desert monitor lizard (Varanus griseus), spiny tailed lizard (Uromastyx hardwickii), adoosa (Adhatoda vasica), lal satta (Boerhania diffusa), phog (Calligonum polygonoides), ban tulsi (Ocimum sanclum), red-necked falcon (Falco chicquera), lagger falcon (Falco jugger), Stoliczka’s bushchat (Saxicola macrorhynchus) and endemic species of Spotted Creeper (Salpornis spilonotus) is also present in the area; AND WHEREAS, the major vegetation present in the area includes grasses such as Baunli (Acacia iacquernonti), Jhar Ber (Ziziphus nummularia), Kair (Capparis deciduas), Adoosa (Adhatoda vasica, Nees.), Chonlai (Amaranthus viridis), Bui (Aerva tomentosa, burm), Bui (Aerva javanica), Satyanashi (Arqernone Mexica), Palak (Beta vulgarie, Linn), Lal Satta (Boerhania diffusa), Bokana (Commelina bengalensis), Dhatura (Datura metel), Sajee (Salsala griffithi), Kateli (Solenurn surattense), Gokhru (Tribuu_surattense), Dudhi (Vallatis solanace, roth), Hiran Khuri (Wattakaka volubilis), etc.; AND WHEREAS, Tal Chhapar Wildlife Sanctuary provides habitat to faunal species such as Black Buck (Antelope cervicapra), lndian gazzelIe (GazeIIa gazelIa), Blue Bull or Nilgai (Boselaphus tragocamelus), Desert Fox (Vulpes vulpes pusilla), Desert Cat (Felis Iibyca), Hare Desert (Lepus nigricollis dayanus), Indian Porcupine (Hystrise indica (Kerr), Indian Gerbille (Tatera indica), etc. along with important species of butterfly, insects and reptiles such as Predacious diving beetle (Agabus bicolor), Riffle beetle (Elmidae), Marsh beetle (Prionocyphon limbata), Dung beetle (Phanaeus vindex MacLachlan), Toilet beetle (Virginia scoffed), Honey bee (Apis mellifera), Mud wasp (Mud dauber), Sphinx moth (Sphingidae), Indian cobra (Naja naja), Russell's Viper (Vipera russelli), Saw-saled Viper (Echis Carinata), John Earth Boa (Eryx johnii), Spiny tailed lizard (Uromastyx hardwickii), Dhaman or Rat Snake (Ptyas mucosus), Brooks gecko (Hemidactylus brooki), House Gecko (Hemidactylus flaviviridis) etc.; AND WHEREAS, major avifaunal species present in the Wildlife Sanctuary are Demoiselle crane (Grus virgo), Common crane (Grus grus), Bar-headed Goose (Anser indicus), Ruddy Shellduck (Tadorna ferruginia), Common Teal (Anas crecca), Black-shouldred kite (Elanus caeruleus), Shikra (Accipiter badius), Tawny Eagle (Aquila rapax), Laggar falcon (Falco jugger), Red-headed Falcon (Falco chicquera), Merlin (Falco columbarius), Lesser Kestrel (Falco naumanni), Steppe eagle (Aquila nipalenses), Eastern Imperial Eagle (Aquila heliacal), Eurasian Eagle Owl (Bubo bubo), Short-eared Owl (Asio flammeus), Stoliczka's bushchat (Saxicola macrorhynchus), Hen Harrier (Circus cyaneus), Pallid Harrier (Circus macrourus), Yellow-wattled Lapwing (Vanellus malabaricus), Black-winged Stilt (Himantopus himantopus), Chestnut-bellied Sandgrouse (Pterocles exustus) , etc.; AND WHEREAS, it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the protected area of Tal Chhapar Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 NOW THEREFORE, in exercise of the powers conferred by sub-section (l) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act,1986 (29 of 1986) (hereinafter to be referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an Eco-sensitive Zone around the boundary of Tal Chhapar Wildlife Sanctuary in the State of Rajasthan (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of the Eco-sensitive Zone .- (1) The extent of Eco-sensitive Zone varies from 1.0 kilometre to 3.4 kilometre from the boundary of Tal Chhapar Wildlife Sanctuary and the area of Eco-sensitive Zone is 22.45 square kilometres and the extent of Eco-sensitive zone in different directions is given below: - DIRECTION EXTENT North 1.0 kilometre North-East 2.9 kilometre East 1.0 kilometre South-East 1.0 kilometre South 3.4 kilometre South-West 1.2 kilometre West 1.6 kilometre North-West 1.3 kilometre (2) The boundary description of Tal Chhapar Wildlife Sanctuary Eco-sensitive Zone is appended as Annexure- I. (3) The list of villages falling within the Eco-sensitive Zone is appended as Annexure-II. (4) The map of the Eco-sensitive Zone along with boundary details and geo-coordinates is appended as Annexure- III A, Annexure-III B, Annexure-III C, Annexure-III D, Annexure-III E and Annexure-III F. (5) The geo-coordinates of Tal Chhapar Wildlife Sanctuary and its Eco-sensitive Zone are given in Annexure-IV A and Annexure-IV B. 2. Zonal Master Plan for Eco-sensitive Zone. – (1) The State Government shall, for the purposes of the Eco- sensitive Zone, prepare and notify a Zonal Master Plan within two years from the date of publication of this notification in the Official Gazette, in consultation with local people and in conformity to the provisions of this notification. (2)The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in accordance with the provisions of this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3)The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan , namely:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipality; (x) Panchayati Raj; (xi) Public Works Department; (xii) Highways; and (xiii) State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local community’s livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Until the preparation of the Zonal Master Plan for the Eco-sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee. 3. Measures to be taken by the State Government. -The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use .- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities : Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents such as,- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4 : Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (a) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies .- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism .- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Departments of Environment and Forests of the State Government; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely: - (i) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (ii) until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage .- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites .- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution .-Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000. (7) Air pollution .-Prevention and control of air pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981). (8) Discharge of effluents .- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and as amended from time to time. (9) Solid wastes .- Disposal and Management of solid wastes shall be as under- (a)The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and as amended from time to time and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b) Safe and Environmentally Sound Management of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone . (10) Bio-medical waste.- Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 and as amended from time to time. (b) Safe and Environmentally Sound Management of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (11) Plastic waste management .- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016. (12) Construction and demolition waste management .- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 and as amended from time to time. (13) E-waste - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change . (14) Vehicular traffic .- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution .- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel such as Compressed Natural Gas ,etc. (16) Industrial units .- (a) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone on or after the publication of this notification in the Official Gazette. (b)Only non-polluting industries shall be allowed within the Eco senstive zone as per classification of industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes .- The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone .- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act, the rules made thereunder and other notifications, laws and acts of the Central Government, notification pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely: - TABLE Sl. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small-scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016, as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 13. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 14. Monitoring Committee .- The Central Government hereby constitutes a Monitoring Committee consisting of the following persons, namely: - (i) District Collector, Churu – Chairman, ex officio; (ii) One representative of Non-Governmental Organisation working in the – Member; field of Wildlife Conservation (including heritage conservation) to be nominated by the State Government from time to time every three years30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iii) One expert in the area of ecology and environment to be nominated by the – Member; State Government from time to time every three years (iv) One expert in Biodiversity from reputed Institution or University of the – Member; State to be nominated by the State Government from time to time every three years (v) A representative of the Public Works Department – Member, ex officio; (vi) A representative of the Town Planning Department – Member, ex officio; (vii) A representative of the Industry Department – Member, ex officio; (viii) Regional Officer of the State Pollution Control Board – Member, ex officio; (ix) Wildlife Warden, Churu – Member, ex officio; (x) Range Forest Officer, Tal Chhapar Wildlife Sanctuary – Member, ex officio; (xi) Assistant Conservator of Forests, Tal Chhapar Wildlife Sanctuary – Member, ex officio; (xii) Deputy Conservator of Forests, Churu – Member Secretary, ex officio; 6. Functions of Monitoring Committee.- (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinize the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities that are not covered in the Schedule to the notification referred to in sub-paragraph (1) and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (3) The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representatives or experts from the Departments concerned, representatives from industry associations or stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per proforma appended at Annexure V. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures .- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. ANNEXURE- I Boundary Description of Eco-Sensitive Zone around Tal Chappar Wildlife Sanctuary Eastern Boundary: Kishangarh-Hanumangarh Mega Highway from Railway station Chhapar to the point where Revenue village boundary of Dewani-Gulerian intersect the highway, except from Rampur village till junction of Devani Chhapar Road and mega highway where it is at less than 01 km distance from sanctuary, it passes through farms of Rampur village. Southern Boundary: Revenue village boundary of villages Dewani-Gulerian and Soorwas-Gulerian from the Megahighway to the point where village Soorwas-Sujangarh kattani Rasta intersect therevenue boundary; and, Soorwas-Sujangarh kattani Rasta upto its origin in the village Soorwas.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 Western Boundary: Village Soorwas to the first road curve on the Chadwas - Bidasar road to Chhapar town at a distance of 1 km from sanctuary boundary, passing through the agricultural fields of Charwas & Chhapar. Northern Boundary: From boundary of Charwas village to Chhapar town (at adistance of 1km from sanctuary). Land use pattern of the land included in Eco- Senstive Zone 1. Reserved Forest - 719 hectares notified and being managed as Tal Chhapar Wildlife Sanctuary. 2. Forest land – 78 hectares adjoining to the west boundary of the sanctuary. 3. Salt Pans - 450 hectares, adjoining to the west boundary of the sanctuary, being managed under control of Industrial Department; 4. Private Agricultural land, Revenue Lands, School, Gandhisagar, Royal Kothi and scattered residences etc.: - About 1710 hectares. 5.
