जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन े वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सझु ाव आमंजत्रत ह,ै और र्ह भारत के उत्तर पूवी भाग म ें अरूणाचल प्रिेि के चांगलांग जिले म ेंजस्ट्थत ह।ै और, कमलांग वन्र्िीव अभर्ारण्र् को अजधसूचना संखर्ा सीडब्ल्र्ूएल/डी/58/88/3175-3250, तारीख 18 अक्टूबर, 1989 के द्वारा वन्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा था और इसे अजधसूचना स.ं सीडब्ल्र्ूएल/डी/159/2014/680-1781 द्वारा तारीख 6 जसतबं र, 2016 स े बाघ ररज़व ा की प्रजस्ट्थजत प्रिान की गई थी और नमिफा को अजधसूचना संखर्ा सीएलडब्ल्र्ू/8/83/5284-5360 द्वारा राष्ट्रीर् उद्यान अजधसूजचत दकर्ा गर्ा था और इस े अजधसूचना स.ं एनओ एफओआर 482/डी-4/84 तारीख फरवरी 1987 द्वारा बाघ ररज़वा घोजित दकर्ा गर्ा था; और, कमलांग वन्र्िीव अभर्ारण्र् को नमिफा राष्ट्रीर् उद्यान, िो बाघ ररज़वा भी ह,ै का जवस्ट्तार करके उसमें िोडा गर्ा ह ै और र्ह िैव जवजवधता की िजृ ष्ट से समृद्ध ह ै िो जवजभन्न वनस्ट्पजत और िीविन्तुओं के जवकास के जलए आिि ा रूप से उपर्ुि ह;ै और, नमिफा राष्ट्रीर् उद्यान जवश्व का एकमात्र ऐसा संरजक्षत क्षत्रे ह ैजिसमें बडी जबल्ली की 4 प्रिाजतर्ां - िैसे तेंिआु , बाघ, स्नो-लपै ड ा और लमजचत् ता जनवास करती ह।ैं र्ह पूवी जहमालर्न िैव-जवजवधता हॉटस्ट्पॉट में आन े वाला सबसे बडा संरजक्षत क्षेत्र ह।ै क्षेत्रफल की िजृष्ट स े र्ह भारत में तीसरा सबसे बडा राष्ट्रीर् उद्यान ह।ै र्ह क्षत्रे जवस्ट्तृत जडप्टेरोकापा वनों के जलए भी िाना िाता ह ै जिसम ें ऑर्काड, फन ा और जलर्ानास प्रचुरता म ें पार् े िात े ह ै और र्ह एजिर्ा के अंजतम सुिरू वन क्षेत्रों म ें आता ह।ै और, कमलांग और नमिफा बाघ ररज़व ा म ें और इसके आस-पास मुखर् वनस्ट्पजत प्रिाजतर्ां िैस े दक जडप्रोकापास मैक्रोकारपस (होलोग), िोररर्ा असाजमका (साल), एलल्टंजगर्ा एक्सेल (िटली), मोरास लेजवगाता (बोला), जडलेजनर्ा इंजडका (आउटेंगा), टर्मानजलर्ा मेररर्ोकारपा (होलॉक), टूना जसजलएटा, जसनामोमम सीसीडोडाफन्ना, कास्ट्टानोजप्सस इंजडका (जहगोरी), कैनाररर्म रेसीजनफेरम, डुबांगा ग्रडैंफोजलर्ा (खोकान), जडक्सॉजक्सलोन हजैमल्टोजन (बंिरडीमा), दक्रप्टोमोररर्ा पेजनस्ट्र्ाटा, प्रिाजतर्ों िैस े दक जबस्ट्वामॉर्ोप्टेरस जबस्ट्वासी, ऐलुरस फुलगेंस, जप्रर्ोजनलरुस जववररनस, पथैं ेरा रटजग्रस, पथैं ेरा अनदकर्ा, एलेफस मैजक्समस, हुलॉक हुलॉक, एजक्सस पोरजसनस, मोस्ट्चस फस्ट्कस, मोस्ट्चस क्राइसोगास्ट्टर, हड्रैोजमस ह्र्ूमेई, मैजनस पेंटाडैक्टाइला और खतरे वाली प्रिाजतर्ां िसै े राकोफोरस नामिाफेजन्सस, ओटर (लुररना एसपीपी); आदि ह;ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, कमलागं बाघ ररज़वा एक िलु ाभ पुष्प प्रिाजत, साइलौम नडु म, और एक लुप्तप्रार् िीव प्रिाजत, हूलॉक जगब्बन का संरक्षण, सुरक्षा और आश्रर् भी प्रिान करता ह;ै और, कमलागं बाघ ररज़व ा और नमिफा बाघ ररज़वा के क्षेत्र, जवस्ट्तार और सीमाओं, जिन्ह ें परै ा 1 में पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव जवजवजधता की िजृ ष्ट स े पाररजस्ट्थजतकी संवेिी िोन के रूप में जवजनर्िाष्ट दकर्ा गर्ा ह,ैं को सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रणे ीर्ों के प्रचालन और प्रदक्रर्ाओं को प्रजतजिद्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसम ें इसके पश्चात ् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, अरुणाचल प्रििे राज्र् के कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा की सीमा के चारों ओर 0 (िून्र्) दकलोमीटर स े 11.92 दकलोमीटर तक जवस्ट्ततृ क्षेत्र को कमलागं बाघ ररज़वा और नमिफा बाघ ररज़वा पाररजस्ट्थजतकी संवेिी िोन (जिस े इसके पश्चात ् पाररजस्ट्थजतकी सवं ेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण पैरा 1 म ें जवजनर्िाष्ट ह,ै पर्ाावरण गुणवत्ता के संरक्षण और सधु ार तथा पर्ाावरणीर् जनवारण, जनर्ंत्रण और उपिमन के प्रर्ोिन के जलए और जनम्नजलजखत उपार् करती ह,ै अथाात्:- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाए.ं -(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार कमलांग बाघ ररज़व ा और नमिफा बाघ ररज़वा की सीमा के चारों ओर 0 से 11.92 दकलोमीटर तक होगा। इस पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 450.39 वगा दकलोमीटर ह।ै जवजभन्न दििाओं में पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार जनम्न रूप से हःै - दििाए ं जवस्ट्तार (दकलोमीटर म)ें उत्तर 1 दकलोमीटर उत्तर -पवू ा 1 दकलोमीटर पवू ा 0 (इंडो-म्र्ांमार सीमा) िजक्षण-पवू ा 1 दकलोमीटर िजक्षण 0 (इंडो-म्र्ांमार सीमा) िजक्षण –पजश्चम 1 दकलोमीटर पजश्चम 11.92 दकलोमीटर उत्तर - पजश्चम 1 दकलोमीटर रटप्पणः नमिफा राष्ट्रीर् उद्यान और बाघ ररिवा के पूवी और िजक्षणी दििा में िून्र् पाररजस्ट्थजतकी संवेिी िोन को प्रस्ट्ताजवत दकर्ा गर्ा ह ै चूंदक र्ह सीमा भारत-म्र्ांमार अंतराष्ट्रा ीर् सीमा से सटी हुई ह।ै (2) कमलांग टाइगर ररिव ा और नामिाफा टाइगर ररिवा के आसपास के पाररजस्ट्थजतकी संवेिी िोन के साथ-साथ कमलांग और नामिाफा टाइगर ररिव ाका सीमा जववरण उपाबधं -I के रूप में सलं ग्न ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) सीमा जववरण और भ-ू जनििे ांक के साथ इस पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए कमलांग बाघ ररज़व ा और नमिफा बाघ ररज़वा के मानजचत्रों को उपाबधं –IIक, उपाबधं –IIख और उपाबधं –IIग के रूप म ेंसंलग्न दकर्ा गर्ा ह।ै (4) कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा और उसके पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांकों की सूची उपाबंध-III की सारणी क, सारणी ख और सारणी ग में िी गई ह।ै (5) पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाल े ग्रामों की सूची, उनके मुखर् लबंिओंु के भ-ू जनिेिांकों सजहत उपाबधं -IV के रूप म ें सलं ग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.–(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रभावी प्रबंधन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वि ा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा से और आचं जलक महार्ोिना तैर्ार करेगी और इस अजधसूचना म ें िी गई ितों का राज्र् सरकार म ें सक्षम प्राजधकारी के अनुमोिन से पालन करती रहगे ी। (2) पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना राज्र् सरकार द्वारा ऐसी रीजत से िो इस अजधसूचना म ें जवजनर्िाष् ट की गई ह ैं तथा सुसगं त केंद्रीर् और राज्र् जवजधर्ों के अनुरूप तथा केंद्रीर् सरकार द्वारा िारी दकर् े गर्े मागाििाक जसद्धांतों, र्दि कोई हो, के अनसु ार तैर्ार होगी। (3) आंचजलक महार्ोिना, उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरणीर् संबंधी बातों को समाकजलत करने के जलए, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार होगी, अथाता ्:- (i) पर्ाावरण; (ii) वन और वन्र्िीव; (iii) कृजि; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) लसंचाई और बाढ़ जनर्ंत्रण; (ix) नगरपाजलका; (x) प्रििू ण जनर्ंत्रण बोड;ा (xi) पंचार्ती राि; और (xii) लोक जनमााण जवभाग। (4) आंचजलक महार्ोिना अनमु ोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबिंधन अजधरोजपत नहीं करेगी, िब तक इस अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो तथा आंचजलक महार्ोिना, सभी अवसंरचनाओं और दक्रर्ाकलापों में िो अजधक िक्षता और पाररजस्ट्थजतकी-अनुकूल हो, का संवधान करेगी। (5) आंचजलक महार्ोिना म ें अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मिृ ा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी एवं पर्ाावरण के ऐसे अन्र् पहलओंु , जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ैके जलए उपबंध होंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (6) आंचजलक महार्ोिना, जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरे से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों के प्रकार तथा दकस्ट् म, कृजि क्षेत्रों, ऊपिाऊ भूजम, िैसे उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, उद्यान कृजि क्षेत्रों, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का सीमांकन करेगी। (7) आंचजलक महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और परै ाग्राफ 4 में सूचीबद्ध सारणी म ें प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट्थ ानीर् समुिार्ों की आिीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी-अनुकूल जवकास को भी सुजनजश्चत और अजभवृजद्ध करेगी। (8) आंचजलक महार्ोिना, प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी । (9) र्था अनुमोदित आंचजलक महार्ोिना, मानीटरी सजमजत के जलए एक जनिेि िस्ट्तावेि होगा जिससे वह इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ो को कार्ााजन्वत कर सके । (10) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होने तक, सभी नए जनमााण और अन्र् जवकासात्मक दक्रर्ाकलापों को मानीटरी सजमजत को जनर्िाष्ट दकर्ा िाएगा। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार, इस अजधसूचना के उपबधं ों को प्रभावी करन े के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान नहीं होगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर, ऊपर भाग (क), में जवजनर्िाष्ट प्रर्ोिनों से जभन्न के जलए, कृजि और अन्र् भूजम के संपररवतान को मानीटरी सजमजत की जसफाररि पर और प्रािेजिक नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्रीर् सरकार और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स े तथा इस अजधसूचना के उपबंधों के द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को परू ा करने के जलए अनुज्ञात दकर्ा िाएगा, िैसे:- (i) जवद्यमान सडकों को चौडा करना, और उन्ह ें सुिढ़ृ करना तथा नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का जनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करन े वाले लघ ु उद्योग; (iv) कुटीर उद्योग जिनके अतं गात ग्राम उद्योग भी ह;ै पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाए ं जिसके अंतगात गृह वास भी ह;ैं और (v) पैरा-4 म ेंदिए गए संवर्धात दक्रर्ाकलाप: परंतु र्ह और दक प्रािेजिक िहरी र्ोिना अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन तथा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों और संजवधान के अनुच्छेि 244 तथा तत्समर् प्रवृत्त जवजध के उपबंधों, जिसके अंतगता अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै का अनुपालन दकए जबना, वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा। परंत ु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर भूजम के अजभलेखों म ें उपसंिात दकसी त्रुरट को, मानीटरी सजमजत के जवचार प्राप्त करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सधु ारा िाएगा और उि त्रुरट को सुधारे िाने की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े म,ें इस उपपैरा के अधीन र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा। (ख) अनप्रु र्िु र्ा अनुत् पािक कृजि क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के दक्रर्ाकलापों के द्वारा पुन: वनीकरण के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- आंचजलक महार्ोिना म ें सभी प्राकृजतक िलस्त्रोतों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरुज्जीवन की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा ऐसे क्षेत्रों म ें र्ा उनके जनकट जवकास दक्रर्ाकलापों प्रजतजिद्ध करने के बारे म ें िो ऐसे क्षेत्रों के जलए अजहतकर हो, ऐसी रीजत में मागाििाक जसद्धांत तैर्ार दकए िाएंगे। (3) पर्टा न र्ा पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा; (ख) र्ह पर्ाटन महार्ोिना, राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा तैर्ार की िाएगी; (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का ही एक घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िाएगी; (ङ) पाररजस्ट्थजतकी-पर्ाटन संबधं ी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट् थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाले राष्ट्रीर् व्याघ्र सरं क्षण प्राजधकरण (समर्-समर् पर र्था संिोजधत) द्वारा िारी पाररजस्ट्थजतकी-पर्ाटन संबधं ी मागाििाक जसद्धांतों के अनुसरण म ेंहोगा; (ii) आंचजलक महार्ोिना तैर्ार होने और अनुमोिन होन े तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा। (4) नसै र्गका जवरासत.– पाररजस्ट्थजतकी संवेिी िोन म ें बहुमल्ू र् नैसर्गाक जवरासत के सभी स्ट्थलों, िैस े दक िीन कोि आरजक्षत क्षत्रे , िलै जवरचनाए, िल प्रपात, झरने, धारा मागो, उपवन, गुफाए,ं स्ट्थल, वनपथ, अश्वरोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनके सरु क्षा और संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना भी तैर्ार की िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना भी तैर्ार की िाएगी। (6) ध्व जन प्रििू ण.- ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण के जनवारण और जनर्ंत्रण के जलए पालन दकर्ा िाएगा । (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रििू ण का जनवारण और जनर्ंत्रण, वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और तद्धीन बनाए गए जनर्मों के उपबधं ों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, िल (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) तथा तद्धीन बनाए गए जनर्मों, के उपबधं ों के अनसु ार दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट का जनपटान और प्रबंधन, ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण- अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनज्ञु ात दकर्ा िा सकेगा। (10) िवै जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान, िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा। (12) सजं नमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन, संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ानीर् गजतजवजधर्ा.ं - र्ातार्ात की र्ानीर् गजतजवजधर्ां पर्ाावास-अनुकूल रीजत से जवजनर्जमत की िाएगी और इस संबंध म ें आंचजलक महार्ोिना में जविेि उपबंध दकए िाएंगे और आंचजलक महार्ोिना के तर्ै ार होन े और राज्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और तद्धीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार र्ानीर् गजतजवजधर्ों के अनुपालन को मानीटर करेगी। (15) र्ानीर् प्रििू ण.- र्ानीर् प्रििू ण का जनवारण और जनर्ंत्रण लागू जवजधर्ों के अनपु ालन म ें दकर्ा िाएगा और सीएनिी, एलपीिी आदि िैस ेस्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगं े। (16) औद्योजगक ईकाइर्ा.ं - (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रििू णकारी उद्योग की स्ट्थापना अनुज्ञात नहीं होगी। (ख) केन्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर र्था सिं ोजधत मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर- प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी। (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों में अत्र्जधक भू-क्षरण होता ह ै उनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन के भीतर प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण (संरक्षण) अजधजनर्म के उपबंधों और तद्धीन बनाए गए जनर्मों और8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART भारत संघ के मामले म ें माननीर् उच्चतम न्र्ार्ालर् के आिेि और 2012 की ररट र्ाजचका (जसजवल) स.ं 435 म ें गोवा फाउंडेिन बनाम भारत संघ के मामले म ें आिेि का अनपु ालन होगा और 2003 के आईए सं. 1000 का जनणार् तारीख 03-06-2022 और तत्पश्चात आईए सं. 131377 का जनणार् तारीख 26-04-2023 और 28-04-2023 को हुआ, के अनसु रण म ें दकए िाऐंगे। 2. प्रििू ण (िल, वार्ु, मृिा, ध्वजन, पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगीः आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । परन्तु र्ह दक केन्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रििू णकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बृहत िल जवद्युत पररर्ोिनाओं की प्रजतजिद्ध। स्ट्थापना । 4. दकसी पररसंकटमर् पिाथ ा का प्रजतजिद्ध। उपर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । 5. नैसर्गाक िल जनकार्ों र्ा भूजम क्षेत्र प्रजतजिद्ध। में अनुपचाररत बजहस्रावों का जनस्ट्सारण ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों के जवस्ट्तार की अनुज्ञा नहीं होगी । 7. ईंट भट्टों की स्ट्थापना। प्रजतजिद्ध। 8. पर्ाटन से संबंजधत अन्र् लाग ू जवजधर्ों के अनुसार जवजनर्जमत। दक्रर्ाकलाप िैस े गम ा वार्,ु गुब्बारें, हले ीकॉप्टर, ड्रोन, माइक्रोलाइटस्, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर स े उडना िैसे दक्रर्ाकलाप करना। ख.जवजनर्जमत दक्रर्ाकलाप 9. होटलों और ररसोटों की पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु अस्ट्थार्ी संरचनाओं के वाजणजज्र्क स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संविे ी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना अनुज्ञात नहीं होगी: परन्त ु र्ह, दक संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, पर्ाटन महार्ोिना और लाग ू दििाजनिेिों की अनरुु पता से इनम ें िो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार होगा। 10. जनमााणकारी दक्रर्ाकलाप । संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का नर्ा वाजणजज्र्क संजनमााण अनज्ञु ात नहीं दकर्ा िाएगा: परन्त ु र्ह, दक स्ट्थ ानीर् लोगों को पैरा 3 के उप परै ा (1) म ें वर्णात दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को परू ा करन े जलए संजनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िाएगी: परन्त ु र्ह और दक ऐसे लघ ु उद्योगों िो प्रििू ण उत् पन् न नहीं करत े ह,ैं से संबंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से ही न् र्ूनतम पर रखे िाएंगे। एक दकलोमीटर से परे आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंग े। 11. गैर प्रििू णकारी लघ ु उद्योग। फरवरी, 2016 म,ें केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी, उद्योगों के वगीकरण के अनुसार गरै -प्रििू णकारी उद्योग और अपररसकं टमर्, लघ ु और सेवा उद्योग, कृजि, पष्ु प कृजि, बागवानी र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 12. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनज्ञु ा के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं हो सकेगी ।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 13. वन उत्पािों और गरै काष्ठ वन लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । उत्पािों का संग्रहण । 14. जवद्युत और संचार टॉवर लगाने, लागू जवजधर्ों के अधीन जवजनर्जमत होगा और भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाएगा। तार-जबछान े तथा अन्र् बुजनर्ािी ढांच े की व्यवस्ट्था । 15. नागररक सुजवधाओं सजहत लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक बुजनर्ािी ढांचा। जसद्धांतों के अनुसार िमन उपार् दकए िाएंगे। 16. जवद्यमान सडकों को चौडा करना, लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक उन्ह ें सुिढृ बनाना और नई सडकों वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा संचलन । । 19. स्ट्थानीर् समुिार्ों द्वारा अपनार्ी स्ट्थानीर् िनता के उपर्ोग के जलए लागू जवजधर्ों के अनुसार अनुज्ञात िा रही वतामान कृजि और होंगे। बागवानी पद्धजतर्ों के साथ िग्ु धिाला, िग्ु ध उत्पािन, िल कृजि और मत्स्ट्र् पालन। 20. फमों, कारपोरेट और कंपजनर्ों स्ट्थानीर् आवश्र्कताओं को परू ा करन े के जसवार् लाग ू जवजधर्ों के अनुसार जवजनर्जमत (जसवार् अन्र्था के उपबंजधत) होंग े । द्वारा बडे पैमाने पर वाजणजज्र्क पिुधन संपिा और कुक्कुट फामों की स्ट्थापना । 21. प्राकृजतक िल जनकार्ों र्ा भू क्षत्रे िल जनकार्ों में उपचाररत अपजिष्ट िल/बजहस्रााव के जनस्ट्सारण स े म ें उपचाररत अपजिष्ट बचा िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और िल/बजहस्रााव का जनस्ट्सारण । पुन:उपर्ोग के प्रर्ास दकए िाएंगे अन्र्था उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सारण लाग ू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। 22. सतही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । जनष्किाण । 23. कृजि और अन्र् उपर्ोग के जलए जवजनर्जमत और सम्बद्ध प्राजधकारी द्वारा ज्ञात एक सजमजत का गठन करेगी, िो जनम्नजलजखत स े जमलकर बनगे ी, अथाात:- (i) उपार्ुि, चागं लागं र्ा लोजहत जिला, अरुणाचल प्रिेि सरकार अध् र्क्ष, पिेन; (ii) सिस्ट्र् सजचव, अरुणाचल प्रिेि राज्र् प्रििू ण जनर्ंत्रण बोडा, ईटानगर सिस्ट्र्, पिेन; (iii) वन्र्िीव संरक्षण (जवरासत सरं क्षण सजहत) के क्षेत्र में काम करने वाले गैर-सरकारी सिस्ट्र्; संगठन का एक प्रजतजनजध जिसे प्रत्र्ेक तीन वि ा म ें समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। (iv) राज्र् के प्रजतजष्ठत संस्ट्थान र्ा जवश्वजवद्यालर् से िैव जवजवधता सजहत पाररजस्ट्थजतकी सिस्ट्र्; और पर्ाावरण के क्षेत्र में एक जविेिज्ञ जिसे प्रत्र्ेक तीन वि ा में समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। (v) उप जनिेिक, िहरी जवकास जवभाग, चागं लागं र्ा लोजहत जिला सिस्ट्र्, पिेन; (vi) कार्ाकारी अजभर्ंता, ग्रामीण कार्ा जवभाग, चांगलांग र्ा लोजहत जिला सिस्ट्र्, पिेन; (vii) कार्ाकारी अजभर्ंता, सावािजनक स्ट्वास्ट््र् इंिीजनर्ररंग जवभाग, चांगलांग र्ा लोजहत सिस्ट्र्, पिेन; जिला (viii) वन संरक्ष क और क्षेत्र जनिेिक, नामिाफा राष्ट्रीर् जनर्िाष्ट दकर्ा िाएगा। (2) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते ह ै जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमती द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरण को जनर्िाष्ट दकर्ा िाएगा। (3) मानीटरी सजमजत के सिस्ट्र्-सजचव र्ा संबद्ध कलेक्टर र्ा संबद्ध उप वन संरक्षक, पर्ावा रण (सरं क्षण) अजधजनर्म की धारा 19 के अधीन इस अजधसचू ना के उपबंधों का उल्लघं न करने वाले दकसी भी व्यजि के जवरुद्ध जिकार्त िि ा करने के जलए सक्षम होंगे। (4) मामल े िर मामल े के आधार पर, मानीटरी सजमजत, संबद्ध जवभागों के प्रजतजनजधर्ों र्ा CHANGE NOTIFICATION New Delhi, the 9th August, 2024 S.O. 3243(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 4893(E), dated the 10th November, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 10th November, 2023; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the said draft notification; AND WHEREAS, the Kamlang Tiger Reserve is spread over an area of 783 square kilometers and is located in the Lohit District in Arunachal Pradesh; AND WHEREAS, the Namdapha National Park and Tiger Reserve is spread over an area of 2230.245 square kilometer out of which 1985.235 square kilometer is core and 245 square kilometers is buffer zone, located in the Changlang district of Arunachal Pradesh in the North Eastern part of India; AND WHEREAS, the Kamlang Wildlife Sanctuary was notified as Wildlife Sanctuary vide notification number CWL//D/58/88/3175-3250 dated the 18th October, 1989 and was given the status of Tiger Reserve from the 6th September,2016 vide notification number CWL/D/159/2014/680-1781 and the Namdapha was notified as national park vide notification number CLW/8/83/5284-5360 and was declared as tiger reserve vide notification number NO FOR 482/D-4/84 dated February, 1987; AND WHEREAS, the Kamlang Wildlife Sanctuary has been added to the extension of Namdapha National Park, also a tiger reserve and holds a rich biodiversity ideally suited for the growth of various floral and faunal form; AND WHEREAS, the Namdapha National Park is the only protected area in the world which harbours four big cat species like leopard, tiger, snow-leopard and clouded-leopard and it is the largest protected area in the Eastern Himalayan Biodiversity Hotspot and in terms of area it is the 3rd largest National Park in India and the area is also known for the extensive dipterocarp forests, profusion of orchids, ferns and lianas among the last great remote wilderness areas of Asia; AND WHEREAS, the major floral species found in and around Kamlang and Namdapha Tiger Reserve are Diptrocarpus macrocarpus (Hollong), Shorea assamica (Sal), Altingia excela (Jutli), Moras levigata (Bola), Dillenia indica (Outenga), Terminalia myriocarpa (Hollock), Toona ciliata, Cinnamomum cecidodaphnnae, Castanopsis indica (Higori), Canarium resiniferum, Duabanga grandifolia (Khokan), Dixoxylon hamiltonii (Banderdima), Cryptomeria penicyata, Eleocarpus genitrus (Rudraksh), Acer oblongum (Himalayan maple), Arudinagramini folia (Bamboo orchid )etc.; AND WHEREAS, the Kamlang and Namdapha Tiger Reserves supports more than sixty faunal species, including Manis pentadactyla (Chinese Pangolin), Capricornis thar (Himalayan serow), Nycticebus coucang (Slow loris), Macaca assamensis (Assamese macaque), Trachypitchcus pipeatus (Capped langur), Cuon alpines (Wild Dog), Ursus thibetanus (Asiatic black bear), Lutra lutra (Common otter), Prionailurus bengalensis (Leopard cat), Pardofelis marmorata (Marbled cat), Panthera pardus (Leopard), Panthera tigris (Tiger), Panthera uncia (Snow leopard), Moschus focus (Black musk deer), Moschus chrysogaster (Himalayan musk deer), Muntiacus muntjak (Barking deer), Naemorhedus sumatraensis (Himalayan serow), Ratufa bicolor (Malayan giant squirrel), Callosciurus pygerythrus (Hoary-bellied squirrel), Dremomys lokriah (Orange bellied Himalayan squirrel), Petaurista petaurista (Common flying squirrel), Bandicota indica (Large bandicoot rat) and Hystrix brachyuran (Chinese porcupine) etc.; AND WHEREAS, the Namdapha Tiger Reserve conserves, protect and provides shelter to rare floral species such as Sapria himalayana, Pinus merkusii, rare faunal species such as Cuora mouhotii, Helarctos malayanus, Melogale species, Mustela flavigula, Aonyx cinerea, Prinodon pardicolor, endangered species such as Biswamoyopterus biswasi, Ailurus fulgens, Prionailurus viverrinus, Panthera tigris, Panthera uncia, Elephus maximus, Hoolock hoolock, Axis porcinus, Moschus fuscus, Moschus chrysogaster, Hadromys humei, Manis pentadactyla and threatened species such as Rhacophorus namdaphaensis, Otter (Lutrinae species); AND WHEREAS, the Kamlang Tiger Reserve also conserves, protect and provides shelter to one rare floral species, Psiloum nudum, and one endangered faunal species, Hoolock Gibbon; AND WHEREAS, it is necessary to conserve and protect the area, extent and boundaries of biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to extent ranging from zero to 11.92 kilometres around the boundary of Kamlang Tiger Reserve and Namdapha Tiger Reserve, in the State of Arunachal Pradesh as the Kamlang Tiger Reserve and Namdapha Tiger Reserve Eco-sensitive Zone (hereafter in this notification referred to as the Eco- sensitive Zone) details of which are specified in paragraph 1 , for the purpose of protecting and improving the quality of environment and preventing, controlling and abating environmental pollutions and takes the following measures, namely:- 1. Extent and boundaries of Eco-sensitive Zone– (1) The Eco-sensitive Zone shall be to the extent of 0 to 11.92 kilometres cover an area of 450.39 square kilometers around the boundary of Kamlang Tiger Reserve and Namdapha Tiger Reserve The extent of Eco-sensitive Zone in different directions is as follows:- Directions Extent (in kilometres) (1) (2) North 1 kilometers North- East 1 kilometers East 0 (Indo Myanmar Border) South- East 1 kilometers South 0 (Indo Myanmar Border) South -West 1 kilometers West 11.92 kilometers North- West 1 kilometers Note: Zero Eco-sensitive Zone has been proposed in Eastern and Southern direction of Namdapha National Park and Tiger Reserve as the boundary is contiguous with Indo-Myanmar International Boundary. (2) The boundary description of Kamlang and Namdapha Tiger Reserves along with the Eco-sensitive Zone around Kamlang Tiger Reserve and Namdapha Tiger Reserve is appended as Annexure-I. (3) The maps of the Kamlang Tiger Reserve and Namdapha Tiger Reserve demarcating Eco-sensitive Zone along with boundary details and geo-coordinates are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC. (4) Lists of geo coordinates of the boundary of Kamlang Tiger Reserve and Namdapha Tiger Reserve and its Eco- sensitive Zone are given in Table A, Table B and Table C appended as Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone (1) The State Government shall, for the purpose of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 27 (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely; – (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue;. (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipality; (x) Pollution Control Board; (xi) Panchayati Raj; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local community’s livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Until the preparation of the Zonal Master Plan for the Eco-Sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use .- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State government as applicable and vide provisions of this notification, to meet the residential needs of local residents and for activities such as :- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries, convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4:28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies .- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism .- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; 2) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Departments of Environment and Forests of the State Government; 3) the Tourism Master Plan shall form a component of the Zonal Master Plan; 4) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; 5) the activities of eco-tourism shall be regulated as under, namely: - i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; ii) until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage .- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites .- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution .- Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000. (7) Air pollution .- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents .- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under. (9) Solid wastes .- Disposal and management of solid wastes shall be as under :- (a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016. The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and environmentally sound management of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone (10) Bio-medical waste .– Bio medical waste management shall be as under:[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 29 (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016. (b) Safe and environmentally sound management of bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 . (12) Construction and demolition waste management .- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016. (13) E-waste.- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016. (14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units .– a) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within the Eco-sensitive zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes .- The protection of hill slopes shall be as under:- a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone .- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act, and the rules made thereunder and notification of the Government of India , in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely:- TABLE S. Setting of industries causing New industries and expansion of existing polluting industries in the Eco- pollution (Water, Air, Soil, Noise, sensitive Zone shall not be permitted: etc.). Provided that, non-polluting industries shall be allowed within Eco- sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of major Prohibited. hydroelectric project. 4. Use or production or processing of Prohibited. any hazardous substance. 5. Discharge of untreated effluents in Prohibited. natural water bodies or land area. 6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. 7. Setting up of brick kilns. Prohibited. 8. Regulated Activities 9. Commercial establishment of hotels No new commercial hotels and resorts shall be permitted within one and resorts. kilometer of the boundary of the protected area or upto the extent of Eco- sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities: Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 10. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any and beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 31 revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder . 13. Monitoring Committee .- There shall be a committee to be known as Monitoring Committee constituted by the Central Government which shall comprise of the following persons , namely: - (i) Deputy Commissioner, Changlang or Lohit District, Government of – Chairman, ex Officio; Arunachal Pradesh (ii) Member Secretary, Arunachal Pradesh State Pollution Control Board, – Member, ex Officio; Itanagar A representative of Non-Governmental Organisation working in the field (iii) of Wildlife Conservation (including heritage conservation) to be – Member; nominated by the State Government from time to time every three years An expert in the field of Ecology and Environment including Biodiversity (iv) from reputed Institution or University of the State to be nominated by the – Member; State Government from time to time every three years (v) Deputy Director, Urban Development Department, Changlang or Lohit – Member, ex Officio; District (vi) Executive Engineer, Rural works Department, Changlang or Lohit – Member, ex Officio; District (vii) Executive Engineer, Public Health Engineering Department, Changlang – Member, ex Officio; or Lohit District Conservator of Forests and Field Director, Namdapha National Park and (viii) Tiger Reserve, Miao and Divisional Forest Officer, Kamlang Wildlife Member-Secretary,ex Officio. Sanctuary Division, Wakro 6. Terms and Functions of the Monitoring Committee .- (1) The Monitoring Committee shall, based on the actual site- specific conditions scrutinise, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 33 Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma appended at Annexure-V. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders, Supreme Court, etc.:- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. Name: - Buffer area of Kamlang Tiger Reserve Area: - 112.0 Sq. km Boundary as below The boundary of buffer area starts from a point 1 km inside the southwest corner of Kamlang WLS (TR) at geo coordinates 27o39’13.108" N and 96o26'6.400" E, from thence, the boundary goes northwards 1 km parallel to reserve boundary passing through the point at geo – coordinates 27o44’27.244"N and 96o24’28.174”E. up to the point at geo- coordinates 27o53’52.998"N and 96o28'10.351"E. Thence, the boundary goes eastwards passing through the point at geo-coordinates 27°50"26.862"N and 96°35’1.165” E, upto to the point 27° 47’ 3. 304"N and 96°45'50.782" Thence, southwards passing through the point at geo - coordinates 27o41'58.164” N and 96°45’5.407” E upto the point 27°37'56.165"N and 96o49’36.606"E.
