नई दिल्ली, 7 िनवरी, 2026 का.आ. 119(अ).— एक प्रारुप अजधसूचना भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संखर्ांक का.आ. 2644 (अ), तारीख 13 िून 2025 के माध्र्म स ेभारत के रािपत्र, असाधारण भाग II, खंड 3, उपखंड (ii) में प्रकाजित की गई थी, जिसम ें उक्त अजधसूचना अंतर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध कराए िाने की तारीख से साठ दिनों की अवजध के भीतर उसके द्वारा प्रभाजवत होने वाले सभी संभाव्य व्यजक्तर्ों स े आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उक्त प्रारुप अजधसूचना को अतं र्वाष्ट करन े वाली रािपत्र की प्रजतर्ां िनता को तारीख तारीख 14 िून 2025 को उपलब्ध करा िी गई थी; और, उक्त प्रारुप अजधसूचना के संबंध में व्यजक्तर्ों और पणधाररर्ों स ेकोई आक्षेप, रिप्पणीर्ां और सुझाव प्राप्त नहीं हुए थ;े और जलप्पा-असरंग वन्र्िीव अभर्ारण्र्, जहमाचल प्रिेि राज्र् के दकन्नौर जिल े के पूह उप-मंडल की मूरंग तहसील म ेंआता ह।ै र्ह भ-ू जनिेिांक उत्तर (31° 44' 21" उत्तर और 77° 15' 00" पूवा), पूवा (31° 40' 32" उत्तर और 78° 18' 07" पूवा), िजक्षण (31° 39' 29" उत्तर और 78° 17' 24" पूवा) और पजिम (31° 41' 27" उत्तर और 78° 13' 09" पूवा) के बीच जस्ट्थत ह।ै र्ह तैती नाले के ऊपरी िलग्रहण क्षत्रे म ेंजस्ट्थत एक उच्च ऊंचाई वाला क्षत्रे ह,ै िो सतलुि निी की एक महत्वपूणा र् ििााता ह,ै जिसम ेंअजधकांि अभर्ारण्र् क्षत्रे काफी हि तक समतल और आंजिक रूप स े बंिर िीत्त रेजगस्ट्तान ह;ै और जलप्पा-असरंग को सवाप्रथम 1974 म ें जहमाचल प्रििे राज्र् सरकार की अजधसूचना संखर्ांक 5-11/70-एसपी, तारीख 27-04-1974 के माध्र्म से एक अभर्ारण्र् के रूप म ेंअजधसूजचत दकर्ा गर्ा था। तत्पिात,् अभर्ारण्र् को वन्र्िीव संरक्षण अजधजनर्म (1972) की धारा 26क के माध्र्म से तारीख 7 िनू , 2013 को अजधसूचना संखर्ा एफईई-बी-एफ(6)-11/2005- II/ जलप्पा आसरंग के माध्र्म स े र्ुजक्तसगं त बनान े के पिात ् अंजतम रूप स े अजधसूजचत दकर्ा गर्ा था। वन्र्िीव अभर्ारण्र् का क्षेत्रफल 31 वग ा दकलोमीिर ह;ै और अभर्ारण्र् और अजधकांि क्षत्रे भौगोजलक और िलवार्ु िोनों िजृ ष्ट स े अलग-थलग ह,ैं जिनम ें अल्पाइन झाज़िर्ााँ और अल्पाइन चरागाह िैसे वन के प्रकार सजममजलत ह।ैं अभर्ारण्र् म ें वनस्ट्पजतर्ों और िीवों की कई संकिग्रस्ट्त प्रिाजतर्ााँ पाई िाती ह।ैं अभर्ारण्र् म ें पाई िान े वाली आरईिी प्रिाजतर्ों सजहत प्रमुख प्रिाजतर्ों म ें जहमालर्न तहर (हजेमत्रागस िेमलाजहकस), जहमालर्ी भूरा भाल ू (उसास आकािोस इसाबेजलनस), जहमालर्ी काला भाल ू (उसास जथबेिानस लैजनगर), कस्ट्तूरी मगृ (मोस्ट्कस ल्र्ूकोगास्ट्िर), पहा़िी बकरी (कैप्रा आइबेक्स), नीली भ़िे (स्ट्र्डूोइस नार्ौर), गोराल (नेमोरहडेस गोरल) आदि सजममजलत ह।ैं र्ह अभर्ारण्र् िानिार जहम तेंिएु (पेंथरेा उजन्िर्ा) का घर ह ैिो जहमाचल प्रिेि का राज्र् पि ु ह ैऔर रांस-जहमालर्ी क्षत्रे के संरक्षण के जलए एक प्रमुख प्रिाजत ह;ै और र्ह अभर्ारण्र् एक महत्वपूणा पक्षी क्षत्रे ह ै िो अपन े जवजवध पक्षी िीवन के जलए प्रजसद्ध ह,ै िो पक्षी प्रेजमर्ों और पक्षीजवज्ञाजनर्ों को आकर्षात करता ह।ै र्ह अभर्ारण्र् कई प्रवासी पजक्षर्ों के जलए सर्िार्ों के जनवास स्ट्थान के रूप म ें ह।ै अभर्ारण्र् म ेंपाए िाने वाले पक्षी और अन्र् कीि प्रिाजतर्ों म ेंगोल्डन ईगल (एदिला क्राइसेिोस), जहमालर्न जग्रफ़ॉन वल्चर (जिप्स जहमालर्ेंजसस), स्नो पार्ट्राि (लेरवा लरेवा), जहमालर्न मोनाल (लोफोफोरस इमपेिानस), अल्पाइन एक्सेंिर (प्रुनले ा क़ॉलररस), लैमर्िार्र (जिपेिस बाबेिस), जहमालर्न स्नोक़ॉक (िेराओगलै स जहमालर्ेंजसस) जमस्र का जगद्ध (जनर्ोफ्ऱॉन पकानोप्िेरस), राम चकोर (एलेक्िोररस चुकार), व्हाइि कैप्ड रेडस्ट्िािा (फोजनकुरस ल्र्ूकोसेफालस), जहमालर्न बज़डा (ब्र्ूरिर्ो ररफेक्िस), क़ॉमन बैंडेड एवल (हसोरा क्रोमस), इंजडर्न दफ्ररिलरी (आर्गाजनस हाइपरजबर्स), पेंिेड लडे ी (वनैेसा काडुाई), इंजडर्न जस्ट्कपर (हस्ट्ेपेररर्ा क़ॉमा) आदि; सजममजलत ह।ैं और अभर्ारण्र् म ें कई तरह की वनस्ट्पजत प्रिाजतर्ााँ पाई िाती ह,ैं जिनम ें कई िलु ाभ और स्ट्थाजनक प्रिाजतर्ााँ भी िाजमल ह।ैं अल्पाइन घास के मैिानों स ेलेकर घन ेिगं लों तक के जवजवध आवासों म ेंवनस्ट्पजतर्ों की एक समृद्ध जवजवधता ह ैजिसम ेंबेतुला र्ूरिजलस, जपनस व़ॉजलजचर्ाना, आिेजमजसर्ा ब्रेजवफोजलर्ा, हरेाजक्लर्म कैंजडकन्स, थाइमस लीजनर्ररस, बगाजनर्ा स्ट्रेची, जबस्ट्िोिाा एदफजनस, रोडोडड्रेंोन एथं ोपोगोन, सेड्रस िेविारा, िुजनपरस कमर्ुजनस, जस्ट्कजमर्ा ल़ॉररर्ोला, एकोजनिम हिेरोदफलम, िेंरिर्ाना कुरू, ज्र्ूररजनर्ा मैक्रोसेफला, एफेड्रा िेरार्डार्ाना, आदि; सजममजलत ह।ैं और जलप्पा-असरंग वन्र्िीव अभर्ारण्र् के क्षत्रे , जवस्ट्तार और सीमा को, िो इस अजधसूचना म ें नीच े दिए गए पैरा 1 म ें पाररजस्ट्थजतकीर्, पर्ाावरणीर् और िैव जवजवधता के िजृ ष्टकोण स े पाररजस्ट्थजतक-संवेिी िोन के रूप म ें जवजनर्िाष्ट ह,ै संरजक्षत और सरु जक्षत रखना आवश्र्क ह ै और उक्त पाररजस्ट्थजतक-संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगा और उनके संचालन और प्रदक्रर्ाओं को प्रजतजषद्ध करना आवश्र्क ह;ै अतः अब, केन्रीर् सरकार, पर्ावा रण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उपधारा (2) के खण्ड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजक्तर्ों का प्रर्ोग करते हुए, जलप्पा-असरंग वन्र्िीव अभर्ारण्र् की सीमा के आसपास एक पाररजस्ट्थजतकी संवेिी िोन (जिसे इसम ेंइसके पिात् पाररजस्ट्थजतकी संवेिी िोन कहा िाएगा) के रूप म ेंअजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह,ै अथाात:् - (1) पाररजस्ट्थजतकी- सवं िे ी िोन का जवस्ट्तार और सीमा.- (1) पाररजस्ट्थजतकी संवेिी िोन जलप्पा-असरंग वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 1 दकलोमीिर से 20.527 दकलोमीिर तक फैला हुआ ह,ै जिसम ें 298.469 वगा दकलोमीिर का पाररजस्ट्थजतकी संवेिी िोन सजममजलत ह।ै इसम ें स े 125.68 वग ा दकलोमीिर भूजम बंिर भूजम ह,ै 156.08 वग ा दकलोमीिर बफा स े ढकी ह,ै 14.74 वगा दकलोमीिर घास का मैिान ह ैऔर 1.969 वगा दकलोमीिर म ें नदिर्ा ं ह।ैं (2) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण उपाबधं -I के रूप म ें संलग्न ह।ै (3) पाररजस्ट्थजतकी संवेिी िोन के जवजभन्न मानजचत्र उपाबधं -II क, उपाबधं -II ख और उपाबधं -II ग और उपाबधं -II घ के रूप म ेंसंलग्न ह ैं[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (4) जलप्पा असरंग वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी-संवेिी िोन की सीमा पर भू-जनिेिांक उपाबधं -III के रूप म ेंसंलग्न ह।ैं (5) पाररजस्ट्थजतकी-संवेिी िोन के भीतर कोई गांव नहीं ह।ै 2. पाररजस्ट्थजतकी-सवं िे ी िोन के जलए आचं जलक महार्ोिना –(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए इस अजधसूचना म ें दिए गए अनुबंधों का पालन करते हुए, रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वष ा के भीतर, स्ट्थानीर् लोगों के परामिा स ेऔर राज्र् सरकार म ेंसक्षम प्राजधकारी के अनुमोिन के जलए एक आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना को इस अजधसूचना में जवजनर्िाष् ि अनुसार ऐसी रीजत में, तथा सुसंगत केन्रीर् और राज्र् जवजधर्ों और केन्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों के भी अनुरूप र्दि कोई हों, तैर्ार दकर्ा िार्गे ा। (3) आंचजलक महार्ोिना को उक्त र्ोिना में पाररजस्ट्थजतकीर् तथा पर्ाावरणीर् जवचारों को एकीकृत करने के जलए, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ा स े तैर्ार दकर्ा िाएगा, अथाता :् (i) वन; (ii) रािस्ट्व; (iii). कृजष और बागवानी; (iv) पंचार्ती राि और ग्रामीण जवकास; (v) ससंचाई और बाढ़ जनर्ंत्रण; (vi) पर्ािन; (vii) नगर पाजलका और िहरी जवकास; (viii) लोक जनमाणा जवभाग और रािमाग;ा (ix) जहमाचल प्रििे राज्र् प्रिषू ण जनर्ंत्रण बोडा; और (x) पर्ाावरण; (4) आंचजलक महार्ोिना र्ह भी सुजनजित करेगी दक िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो तब तक अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं दकर्ा िाएगा तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके, उन्ह ें अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनार्ा िाएगा। (5) आंचजलक महार्ोिना, म ें वनरजहत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्र् पहलओंु का उपबंध दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट्थ लों, ग्रामों और िहरी बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, हररत क्षेत्रों, िैसे उद्यानों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेषताओं के ब्र्ौरों के साथ जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ेंपाररजस्ट्थजतकी-संवेिी िोन के जवकास को जवजनर्जमत दकर्ा िार्ेगा और पैरा 4 की सारणी म ें सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित भी दकर्ा िाएगा और उसका सवं धान दकर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस तरह अनुमोदित आंचजलक महार्ोिना म़ॉनीिरी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार अपन ेम़ॉनीिरी कृत्र्ों को दक्रर्ाजन्वत कर सके। (10) पाररजस्ट्थजतकी-संवेिी िोन के जलए आंचजलक महार्ोिना के लंबन और उसके अनुमोिन होन े तक, कोई भी नए जवकासात्मक दक्रर्ाकलाप पैरा 6 के उप-पैरा (1) और (2) म ें जवजनर्िाष्ट उपाबंध द्वारा िाजसत होंगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्. - राज्र् सरकार, इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें मनोरंिन के प्रर्ोिनों के जलए जचजन्हत वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों,बगीचों, उद्यानों, झीलों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान नहीं दकर्ा िाएगा; परंतु पाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजष और अन्र् भूजम, उपर्ुाक्त भाग (क) म ें जवजनर्िाष्ट प्रर्ोिनों से जभन्न अन्र् प्रर्ोिनों के जलए, म़ॉनीिरी सजमजत की जसफाररि पर तथा राज्र् सरकार र्ा केन्रीर् सरकार के अन्र् जनर्मों और जवजनर्मों तथा क्षेत्रीर् िहर जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स,े इस अजधसूचना के उपबंधों के अधीन र्था प्रर्ोज्र् स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्रर्ाकलापों को पूरा करने के जलए अनुमजत िी िा सकेगी, िैसे,- (i) जवद्यमान स़िकों को चौ़िा करना, उन्ह ेंसुिढ़ृ करना और नई स़िकों का जनमााण करना; (ii) अवसंरचना और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुिीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ािन सजहत गृहवास को समथान करन े वाले सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं; और (v) पैरा-4 म ेंदिए गए संवर्धात दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना तथा संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना, वाजणजज्र्क तथा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी: परंत ुर्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के भीतर आन ेवाली भूजम के अजभलेखों म ेंहुई दकसी त्रुरि को, म़ॉनीिरी सजमजत के जवचार प्राप्त करने के पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सही दकर्ा िाएगा और उक्त त्रुरि को सही करने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्ुाक्त त्रुरि को सही करन े म,ें इस उप-पैरा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजममजलत नहीं होगा: परंत ु र्ह भी दक हररत क्षेत्र, िैसे वन क्षेत्र तथा कृजष क्षेत्र म ें कोई पाररणाजमक कमी नहीं आएगी, अनुप्रर्क्तु र्ा अनुत् पािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के दक्रर्ाकलापों स े पुन: वनीकरण दकए िाने के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और पनु रुद्धार की र्ोिना सजम मजलत की िाएगी और राज्र् सरकार द्वारा मागाििाक जसद्धांत ऐसी रीजत स े तैर्ार दकए िाएगं े तादक इन क्षत्रे ों म ें र्ा उसके पास जवकास दक्रर्ाकलापों को प्रजतजषद्ध और जनबंजधत दकर्ा िा सके िो ऐस े क्षेत्रों के जलए हाजनकारक ह।ै (3) पर्िा न और पाररजस्ट्थजतकी पर्िा न. – (क) पाररजस्ट्थजतकी-सवं ेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ािन दक्रर्ाकलाप र्ा जवद्यमान पर्ािन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी-संवेिी िोन के जलए पर्ािन महार्ोिना के अनुसार अनुमत होगा,- (ख) पाररजस्ट्थजतकी पर्ािन, महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामि ास ेराज्र् पर्ािन जवभाग द्वारा तैर्ार की िाएगी। (ग) पर्ािन महार्ोिना, आंचजलक महार्ोिना के एक घिक के रूप म ें होगी। (घ) पर्ािन महार्ोिना, पाररजस्ट्थजतकी-संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ािन संबंधी दक्रर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् -[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा के जवस्ट्तार तक, इनम ें स े िो भी जनकि हो, दकसी होिल र्ा ररि़ॉिा का नर्ा सजन्नमााण अनुमत नहीं दकर्ा िाएगा: परंत ु र्ह दक, पाररजस्ट्थजतकी पर्ािन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा से एक दकलोमीिर की िरू ी स े परे पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, केवल पूवा पररभाजषत और अजभजहत क्षेत्रों म ें पर्ािन महार्ोिना के अनुसार, नए होिलों और ररि़ॉिा की स्ट्थापना अनज्ञु ात की िाएगी; (ii) पाररजस्ट्थजतकी-संवेिी िोन के भीतर सभी नए पर्ािन दक्रर्ा-कलापों र्ा जवद्यमान पर्ािन दक्रर्ाकलापों का जवस्ट्तार, केन्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ािन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर िोर िेने वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ािन संबंधी मागाििाक जसद्धांतों के अनुसार होगा; (iii) िब तक आंचजलक महार्ोिना को अनुमोिन नहीं जमल िाता, तब तक पर्ािन के जवकास और जवद्यमान पर्ािन दक्रर्ाकलापों के जवस्ट्तार को स्ट्थल-जवजनर्िाष्ट संवीक्षा और म़ॉनीिरी सजमजत की जसफाररि के आधार पर समबद्ध जवजनर्ामक प्राजधकरणों द्वारा अनज्ञु ात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर् े होिल,ररिािा र्ा वाजणजज्र्क स्ट्थापन के संजनमााण की अनुमजत नहीं िी िाएगी। (4) प्राकृजतक जवरासत. – पाररजस्ट्थजतकी-संवेिी िोन म ें आने वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा और संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी-संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण, ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म 2000 के उपबधं ों के अनुसरण म ें दकर्ा िाएगं ा। (7) वार् ुप्रिषू ण. - पाररजस्ट्थजतकी संवेिी िोन म ेंवार् ुप्रिषू ण का जनवारण और जनर्ंत्रण, वार्ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण ) अजधजनर्म 1986 और इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतकी संवेिी िोन म ेंउपचाररत बजहस्राव का जनस्ट्सारण; - िल (प्रिषू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण (संरक्षण) अजधजनर्म 1986 और इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (9) ठोस अपजिष्ट. - ठोस अपजिष्टों का जनपिान और प्रबंधन जनम्नजलजखत रूप म ेंहोगा-- (i) पाररजस्ट्थजतकी संवेिी िोन म ेंठोस अपजिष्ट का जनपिान और प्रबन्धन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संखर्ा का.आ. 1357 (अ), तारीख 8 अप्रलै , 2016 द्वारा प्रकाजित ठोस अपजिष्ि प्रबंधन जनर्म, 2016, के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक सामग्री का जनपिान पर्ाावरणीर् स्ट्वीकार् ा रीजत म ें पाररजस्ट्थजतकी संवेिी िोन स े बाहर अजभज्ञात स्ट्थल पर दकर्ा िाएगा । (ii) पाररजस्ट्थजतकी संवेिी िोन म ें अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न अनुज्ञात दकर्ा िार्ेगा। (10) िवै -जचदकत्सा अपजिष्ट. – िैव-जचदकत्सा अपजिष्ट का प्रबधं न जनम्नजलजखत रूप म ें होगा- (क) पाररजस्ट्थजतकी संवेिी िोन म ेंिैव जचदकत्सा अपजिष्ट का जनपिान भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की अजधसूचना संखर्ा सा.का.जन. 343 (अ), तारीख 28 माच,ा 2016 के माध्र्म से प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016, के उपबधं ों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरणीर् अनुकूल प्रबंधन अनुज्ञात दकर्ा िार्ेगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (11) प्लाजस्ट्िक अपजिष्ट का प्रबधं न. – पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्िक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संखर्ा सा.का.जन. 340 (अ), तारीख 18 माच,ा 2016, के माध्र्म स े प्रकाजित प्लाजस्ट्िक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा। (12) सजन्नमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी-संवेिी िोन म ेंसजन्नमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् की अजधसूचना संखर्ा सा.का.जन. 317 (अ), तारीख 29 माच,ा 2016 के माध्र्म स े प्रकाजित सजन्नमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी-संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ानीर् र्ातार्ात.- र्ातार्ात के र्ानीर् आवागमन को पर्ाावास-अनुकूल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जवजनर्िाष्ट उपबंध जनगजमत दकए िाएंग े और आंचजलक महार्ोिना के तैर्ार होन े के ऐस े समर् तक और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होन ेतक, म़ॉनीिरी सजमजत ससु ंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एवं जवजनर्मों के अधीन र्ानीर् आवागमन के अनपु ालन की म़ॉनीिरी करेगी। (15) र्ानीर् प्रिषू ण. – र्ानीर् प्रिषू ण का जनवारण और जनर्ंत्रण लाग ूजवजधर्ों के अनपु ालन म ेंदकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंग े । (16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात् पाररजस्ट्थजतकी-संवेिी िोन के भीतर दकसी भी नए प्रिषू णकारी उद्योग की स्ट्थापना की अनमु जत नहीं िी िाएगी। (ख) फरवरी, 2016 म ें केन्रीर् प्रिषू ण जनर्ंत्रण बोड,ा द्वारा िारी मागाििाक जसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै -प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अलावा, गरै प्रिषू णकारी कुिीर उद्योगों का संवधान दकर्ा िाएगा। (17) पहा़िी ढलानों का सरं क्षण. - पहा़िी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहा़िी ढलानों के उन क्षेत्रों को उपिर्िात दकर्ा िाएगा जिनम ें दकसी भी प्रकार के जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान ख़िी पहा़िी ढलानों म ेंअत्र्जधक भू-क्षरण होता ह ैउनम ें दकसी भी प्रकार के जनमााण कार् ा की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी-सवं िे ी िोन म ेंप्रजतजषद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचू ी- FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th January, 2026 S.O. 119(E).— WHEREAS a draft notification was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2644 (E), dated the 13th June, 2025, for inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS copies of the Gazette containing the said draft notification were made available to the public on 14th June, 2025; AND WHEREAS no objections, comments and suggestions were received from persons and stakeholders in respect of the said draft notification; AND WHEREAS the Lippa-Asrang Wildlife Sanctuary falls within the Moorang Tehsil of Pooh sub-division of Kinnaur district. It is situated between geo-coordinates North (31° 44' 21" N and 77° 15' 00" E), East (31° 40' 32" N and 78° 18' 07" E), South (31° 39' 29" N and 78° 17' 24" E) and West (31° 41' 27" N and 78° 13' 09" E). It is a high- altitude area situated in the upper catchment of Taiti stream, which is an important tributary of the Sutlej River. The altitude ranges from 3000 metre to 5122 metre and the sanctuary beholds the unique landscape of dry Trans-Himalayan region with most of the sanctuary area being largely flat and in part barren cold desert; AND WHEREAS the Lippa-Asrang was first notified as a sanctuary in 1974 vide Himachal Pradesh State Government notification number 5-11/70-SP, dated 27-04-1974. Thereafter, the sanctuary was finally notified after its rationalization under section 26A of the Wildlife Protection Act (1972) on 7 June, 2013, vide notification number FEE- B-F(6)-11/2005-II/Lippa Asrang. The area of the Wildlife Sanctuary is 31 square kilometres; AND WHEREAS the sanctuary and most the area are isolated both physio-graphically and climatically consisting of forest type like Alpine Scrubs and Alpine pastures. The Sanctuary harbour many threatened flora and fauna. The prominent species including RET species found in the sanctuary includes, Himalayan Tahr (Hemitragus jemlahicus), Himalayan Brown Bear (Ursus arctos isabellinus), Himalayan Black Bear (Ursus thibetanus laniger), Musk Deer (Moschus leucogaster), Ibex (Capra ibex), Blue Sheep (Pseudois nayaur), Goral (Naemorhedus goral) etc. The Sanctuary is home to the magnificent Snow Leopard (Panthera uncia) which is State Animal of Himachal Pradesh and a flagship species for conservation of Trans-Himalayan region; AND WHEREAS the sanctuary is an important bird area renowned for its diverse birdlife, attracting birdwatchers and ornithologists. The sanctuary serves as a wintering ground for several migratory birds. The avifauna and other insects species found in the sanctuary includes Golden Eagle (Aquila chrysaetos), Himalayan Griffon Vulture (Gyps himalayensis), Snow Partridge (Lerwa lerwa), Himalayan Monal (Lophophorus impejanus), Alpine Accentor (Prunella collaris), Lammergeier (Gypaetus barbatus), Himalayan Snowcock (Tetraogallus himalayensis), Egyptian vulture (Neophron percnopterus), Ram chakor (Alectoris chukar), White capped redstart (Phoenicurus leucocephalus),[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 Himalayan Buzzard (Buteo refectus), Common Banded Awl (Hasora chromus), Indian Fritillary (Argynnis hyperbius), Painted Lady (Vanessa cardui), Indian Skipper (Hesperia comma) etc.; AND WHEREAS the sanctuary supports a wide variety of plant species, including many rare and endemic ones. The varied habitats, from alpine meadows to dense forests, harbor a rich assortment of vegetation which includes Betula utilis, Pinus wallichiana, Artemisia brevifolia, Heracleum candicans, Thymus linearis, Bergenia stracheyi, Bistorta affinis, Rhododendron anthopogon, Cedrus deodara, Juniperus communis, Skimmia laureola, Aconitum heterophyllum, Gentiana kurroo, Jurinea macrocephalla, Ephedra gerardiana, etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary of Lippa-Asrang Wildlife Sanctuary which is specified in paragraph 1, given below in this notification as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an Eco-Sensitive Zone around the boundary of Lippa Asrang Wildlife Sanctuary (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-Sensitive Zone.- (1) The Eco-sensitive Zone is extends from 1 kilometre to 20.527 kilometre around the boundary of Lippa Asrang Wildlife Sanctuary encompassing Eco-sensitive Zone area of 298.467 square kilometre. Out of this 125.68 square kilometre land is waste land, 155.08 square kilometre is snow covered, 14.74 square kilometre is grassland and streams accounts for 1.969 square kilometre. (2) The boundary description of the Eco Sensitive Zone is appended as Annexure I. (3) The various maps of the Eco-sensitive Zone is appended as Annexure II A, Annexure II B and Annexure II C and Annexure II D (4) Geo Coordinates on the boundary of Lippa Asrang Wildlife Sanctuary and its Eco-sensitive zone are appended as Annexure –III. (5) There are no village within the Eco-sensitive Zone. 2. Zonal Master Plan for Eco-Sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Forest; (ii) Revenue; (iii) Agriculture and Horticulture; (iv) Panchayati Raj and Rural Development; (v) Irrigation and Flood Control; (vi) Tourism; (vii) Municipal and Urban Development; (viii) Public Works Department and Highways; (ix) Himachal Pradesh State Pollution Control Board; and (x) Environment.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) The Zonal Master Plan shall also ensure that no restrictions are imposed on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Pending the preparation of the Zonal Master Plan for Eco-sensitive Zone and approval these of, any new developmental activities shall be governed by provisions specified at sub-para (1) and (2) of paragraph 6. 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, orchards, parks, lakes and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as.- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.- (b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (ii) safe and Environmentally Sound Management of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive zone. (10) Bio-Medical Waste.– Bio-medical Waste Management shall be as under:- (a) the Bio-medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (c) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016 unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and be regulated in the manner specified in the Table below, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 TABLE S. (a) New commercial construction of any kind shall not be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 13. Monitoring Committee - The Central Government herby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely: S. Functions of the Monitoring Committee.- (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-IV, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures: The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. [F. Forest beats- It falls under the Lippa beat of Kinnaur Territorial Forest Division. Rivers- Gumjhang Nalla, Tepong Nalla, Ladsa Nalla, Wari Nalla and Taiti Khad. Glaciers- Metanglongpa Glacier, Gumjhang Glacier and Ladsa Glacier. Temporary Gaddi Deras- Dharwali, Dhar Ladsa, Dhar Tepong, Dhar Gumjhang, Dhar Metang and Dhar Kiyari. East: East Boundaries of the Eco sensitive Zone is aligned with Moorang Range of Kinnaur Territorial Forest Division and Rupi Bhaba Wildlife Sanctuary; some part of boundary with Proposed Eco sensitive Zone of Rupi Bhaba Wildlife Sanctuary.
