अजधसचू ना नई दिल्ली, 20 जसतम् बर, 2023 का.आ. 4132(अ).—पर्ाावरण, वन और िलवार्ु पररवतान मत्रं ालर् की अजधसूचना सं. का.आ. 612 (अ), तारीख 25 फरवरी, 2016 को, भारत सरकार के संखर्ांक का.आ. 876 (अ), तारीख 24 फरवरी, 2023 द्वारा प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन े वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सझु ाव आमंजत्रत दकए गए थे; और, उि रािपत्र अजधसूचना की प्रजतर्ां िनता को तारीख 24 फरवरी, 2023 को उपलब्ध करा िी गई थी; और, उि प्रारुप अजधसूचना के बाबत व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर केंद्रीर् सरकार द्वारा जवचार दकर्ा गर्ा था; और, नागिीरा वन् र्िीव अभर्ारण्र्, नर्ा नागिीरा वन् र्िीव अभर्ारण्र्, कोका वन् र्िीव अभर्ारण्र्, नवेगांव वन् र्िीव अभर्ारण्र् और नवेगांव रा्‍र ीर् उनान को, जिसे इसमें इसके पश् चात अभर्ारण्र् तथा उनान कहा गर्ा ह,ै िो महाराष्ट्र में गोंदिर्ा और भंडारा जिलों म ेंअवजस्ट्थ त ह ; और, अभर्ारण्र् तथा उनान, महाराष्ट्र की राज्र् सरकार की अजधसूचना सं. डब्ल्र्.ू एल. पी. 0913/सी. आर. 316/एफ-1, तारीख 12 दिसंबर, 2013 द्वारा र्था अजधसूजचत नवगे ांव-नागिीरा बाघ आरजक्षती के मलू र्ा संकटमर् बाघ जनवास को सजम्मजलत करत े ह ; 5972 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, अभर्ारण्र् और उनान समृद्ध पक्षी-िीव के साथ लगभग 312 पजक्षर्ों की प्रिाजतर्ां जिसमें प्रवासी और िल पक्षी सजम्मजलत ह ै के जलए िान े िात े ह,ै हर वर् ा भारतीर् मलू के क्षेत्रीर् पजक्षर्ों की संखर्ा र्हााँ आस-पास वास करत े ह,ै इस क्षेत्र के जलए सरस क्रेन्स का प्रिनन अजभजलजखत दकर्ा गर्ा ह,ै क्षेत्र म ें महत्वपूणा जिकारी पक्षी मधश्ु र्ेन, भुिंग गरुड़, बाज़, ग्रे हडे ेड मत्स्ट्र् गरुड़ ह ; और, क्षेत्र म ें अत्र्न्त उच्च िीव-िन्तु और वनस्ट्पतीर् जवजवधता के साथ लगभग 72 स्ट्तनधाररर्ों की प्रिाजतर्ां, लगभग 48 सरीसृपों की प्रिाजतर्ां और कई उभर्चरों की प्रिाजतर्ां पाई िाती ह ; और इस क्षेत्र की वनस्ट्पजत में िजक्षणी उ्‍ण करटबंधीर् िु्‍क पणापाती वनों का प्रजतजनजधत्व ह ै और, इस क्षेत्र म ें महत्वपूणा वन्र्िीव िैसे बाघ, तेंिआु , रीछ, िंगली कुत्ता, भारतीर् गौर (भैसा), चीतल, सांभर और नीलगार् का भी संभरण ह ै और, अभर्ारण्र् और उनान के समीप्र् के क्षेत्र में मानव बस्ट्ती और चल रही जवकासात्मक दक्रर्ाकलापों, इस तरह की दक्रर्ाकलापों पर उजचत सुरक्षा उपार्ों की आवश्र्कता और जनर्ंत्रण की िरुरत ह ै और, अभर्ारण्र्ों और उनानों से सटे भौगोजलक क्षेत्र को पाररजस्ट्थजतकी और पर्ाावरणीर् िजृ ष्टकोण से संरजक्षत करना और इस भौगोजलक क्षत्रे में उनोगों र्ा उनोगों के वगो के प्रचालन तथा प्रसंस्ट्करण करने को प्रजतजर्द्ध करना आवश्र्क ह ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, अजधसूचना सं. का.आ. 612 (अ), तारीख 25 फरवरी, 2016 को, उन बातों के जसवार् अजधक्रांत करत े हुए, जिन्ह ें ऐसे अजधक्रमण स े पहल े दकर्ा गर्ा ह ै र्ा करन े का लोप दकर्ा गर्ा ह,ै महाराष्ट्र राज्र् म ें क्षेत्र को नवेगांव – नागिीरा बाघ आरजक्षती पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह,ै अथाात ् :-- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और उसकी सीमाए-ं -(1) पाररजस्ट्थजतकी संवेिी िोन 2337.112 वग ा दकलोमीटर के क्षत्रे फल म ें आच्छादित ह,ै जिसकी सीमा अभर्ारण्र्ों और उनानों की सीमा से 2 दकलोमीटर से 15.3 दकलोमीटर तक होगी। (2) पाररजस्ट्थजतकी संवेिी िोन की सीमा जववरण उपाबधं -I म ेंह ै। (3) पाररजस्ट्थजतकी संवेिी िोन का मानजचत्र में अक्षांि और िेिान्तर के साथ उपाबधं -II म ें ह ै। (4) पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिाकं ों की सूची उपाबधं –III की सारणी क में ह।ै (5) अभर्ारण्र् और उनान की सीमा के भू-जनिेिाकं ों की सूची उपाबधं –IV की सारणी ख और सारणी ग म ेंह।ै (6) पाररजस्ट्थजतकी संवेिी िोन में आन े वाल ेग्रामों की सूची उपाबधं -V म ेंह।ै 2. पाररजस्ट्थजतकी संविे ी िोन के जलए आचं जलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन की प्रभावी प्रबंधन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वर्ा की अवजध के भीतर, इस अजधसूचना में दिए गए उपबंधों के अनुसार आंचजलक महार्ोिना तैर्ार करेगी। (2) नवगे ांव - नागिीरा बाघ आरजक्षती का पररक्षेत्र िोन पाररजस्ट्थजतकी संवेिी िोन का भागरूप होगा और आचंजलक महार्ोिना को तैर्ार करन े के िौरान मध् र्वतती बाघ आरजक्षती र्ोिना को भी जवचार म ेंजलर्ा िाएगा । (3) आंचजलक महार्ोिना, स्ट्थानीर् जनवाजसर्ों और सभी संबंजधत राज्र् जवभागों के परामिा से तैर्ार दकर्ा िाएगा, अथाात:्- (i) पर्ाावरण; (ii) वन; (iii) िहरी जवकास; (iv) पर्ाटन; (v) नगरपाजलका;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (vi) रािस्ट्व; (vii) कृजर्; (viii) महाराष्ट्र राज्र् प्रिर्ू ण जनर्ंत्रण बोडा; और (ix) राज्र् सरकार के कोई अन्र् संबजं धत अजभकरण इसमें पर्ाावरणीर् और पाररजस्ट्थजतकी जवचारों को एकीकृत करने के जलए। (4) आंचजलक महार्ोिना म ें जवनमान अनुमोदित भ-ू उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक दक इस अजधसूचना म ेंइस प्रकार जवजनर्िष्टा न हो तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्हें अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें अनाच्छादित क्षेत्रों के िीणती द्धार, जवनमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्र् पहलओंु के जलए उपबंध होंग े जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना में सभी जवनमान पूिा स्ट्थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों के प्रकार और दकस्ट्मों, िनिाजत क्षत्रे , कृजर् क्षेत्रों, घास भूजम, उपिाऊ भूजम, हररत क्षेत्र, िैसे उनान और समान स्ट्थान, बागवानी क्षेत्र, बगीचें, झीलें, आद्र ाभूजम और अन्र् िल जनकार् का अभ्र्कंन करेगी। (7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन म ें होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी में सूचीबद्ध पैराग्राफ 23 में प्रजतजर्द्ध, जवजनर्जमत एव ं संवर्धात दक्रर्ाकलापों का पालन करेगी और स्ट्थानीर् समुिार्ों की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित करेगी। (8) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होने तक, सभी नए संजनमााण और अन्र् जवकासात्मक दक्रर्ाकलापों को पैराग्राफ 24 के अधीन समुजचत कारावाई के जलए पैराग्राफ 23 के अधीन गरठत मानीटरी सजमजत को भेिा िाएगा। (9) अनुमोदित आंचजलक महार्ोिना, दकसी जवजनिर् जिसके अंतगात जिजथलीकरण, के जलए जवचारण भी ह,ै के जलए मीनीटरी सजमजत हते ु एक संिभा िस्ट्तावेि होगी । 3. राज्र् सरकार द्वारा दकए िान े वाल ेउपार्-- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए उपार् करेगी। 4. भ-ू उपर्ोग सबं धं ी उपार्.- (1) पाररजस्ट्थजतकी संवेिी िोन में आमोि-प्रमोि के प्रर्ोिनों के जलए जचजन्हत दकए गए वनों, उनान कृजर् क्षेत्रों, िनिाजत क्षेत्रों, कृजर् क्षेत्रों, पाकों और खुले स्ट्थानों का उपर्ोग वाजणजज्र्क र्ा औनोजगक संबंजधत जवकास दक्रर्ाकलापों के जलए क्षत्रे ों में उपर्ोग नहीं दकर्ा िाएगा र्ा संपररवतना नहीं होगा: परंत ु राज्र् सरकार स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करन े और जनम्नजलजखत दक्रर्ाकलापों के जलए मानीटरी सजमजत की जसफाररि पर पाररजस्ट्थजतकी संविे ी िोन के भीतर कृजर् भूजम के संपररवतान को पूरा करन े के जलए अनुज्ञात होंग,े अथाात:् - (i) पर्ाावरण के अनुकूल पर्ाटन दक्रर्ाकलापों के जलए पर्ाटकों के अस्ट्थार्ी आवास के जलए पर्ाावरण के अनकु ूल कॉटेि, िैसे तंब,ू लकड़ी के घर आदि की स्ट्थापना, (ii) जवनमान सड़कों को चौड़ा करना और उन्ह ेंसुिढ़ृ करना और नई सड़कों का संजनमााण, (iii) प्रिर्ू ण उत्पन्न न करने वाले लघु उनोग की स्ट्थापना। परंत ु र्ह और दक राज्र् सरकार वाजणजज्र्क र्ा औनोजगक जवकास दक्रर्ाकलापों के जलए िनिाजत क्षेत्र में भूजम के उपर्ोग र्ा भारत के संजवधान के अनच्ु छेि 244 के उपबंधों और तत्समर् प्रवृत्त जवजधर्ों का अनुपालन अनुज्ञात कर सकेगी, जिसमें अनुसूजचत िाजत और अन्र् पारंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) सजम्मजलत ह।;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) राज्र् सरकार पाररजस्ट्थजतकी संवेिी िोन के भीतर भ-ू अजभलेखों म ें उपसंिात कोई त्रुरट को प्रत्र्ेक मामल े म ें केवल एक बार मानीटरी सजमजत के परामिा पर संिोजधत होगी, और ऐसे सुधार के बारे में पररवतान के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को सूचना िेनी होगी: परंत ु र्ह और दक त्रुरट के संिोधन म ें इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा: परंत ु र्ह और भी दक जिससे हररत क्षेत्र में िैसे वन क्षेत्र, कृजर् क्षेत्र आदि में कोई पाररणाजमक कटौती नहीं होगी और नवेगांव-नागिीरा बाघ आरजक्षती के मध् र्वतती पररक्षेत्र प्रबंध र्ोिना के अनुसार अनप्रर्ु्‍ त र्ा अनुत् पािक कृजर् क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे । 5. प्राकृजतक िल जनकार् सबं धं ी उपार्.- राज्र् सरकार जनम्नजलजखत उपार् करेगी, अथाात्.- (i) सभी प्राकृजतक िलमागों के आवाह क्षेत्रों की पहचान की िाएगी; (ii) आंचजलक महार्ोिना में ऐसे आवाह क्षेत्रों संरक्षण और नवीकरण की र्ोिना सजम् मजलत की िाएगी; और (iii) आवाह क्षेत्रों में र्ा उसके पास प्रिर्ू क जवकास दक्रर्ाकलापों जनस्ट्सारण और की रीजत को प्रजतजर्द्ध दकर्ा िाएगा िो ऐसे क्षेत्रों के जलए हाजनकारक हों। 6. पर्टा न महार्ोिना.- (1) पाररजस्ट्थजतकी संवेिी िोन के अंतगता राज्र् सरकार का पर्टा न जवभाग, राज्र् सरकार के रािस्ट्व और वन जवभाग के परामिा से, पर्ाटन दक्रर्ाकलापों के प्रभावी प्रबंधन के प्रर्ोिन के जलए पर्ाटन महार्ोिना तैर्ार करेगी। (2) पर्ाटन महार्ोिना को आचं जलक महार्ोिना में सजम्मजलत दकर्ा िाएगा। 7. पर्टा न संबधं ी उपार्.– (1) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवनमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िने े वाले और पाररजस्ट्थजतकी संवेिी िोन की अध्र्र्न वहन क्षमता पर आधाररत राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्टा न संबंधी मागाििाक जसद्धांतों के अनुसार होगा। (2) पाररजस्ट्थजतकी अनुकूल पर्टा न दक्रर्ाकलाप से संबंजधत पर्ाटकों के अस्ट्थार्ी अजधभोग के जलए वास सुजवधा के जसवार् अभर्ारण्र् और उनान की सीमा से एक दकलोमीटर तक होटल और ररसोटा का स्ट्थापन अनुज्ञात नहीं होंगा। (3) अभर्ारण्र् और उनान की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटल और ररसॉट ा की स्ट्थापना केवल पाररजस्ट्थजतकी-पर्ाटन सुजवधाओं के जलए पूव-ा पररभाजर्त और नामजनर्िष्टा क्षेत्रों म ें पर्ाटन महार्ोिना के अनुसार अनुज्ञात होगा। (4) इस अजधसूचना के अधीन आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवनमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िष्टा संवीक्षा तथा मोनीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनज्ञु ात दकर्ा िाएगा। 8. प्राकृजतक जवरासत परररक्षण और सरं क्षण.– (1) राज्र् सरकार छह मास के भीतर प्राकृजतक जवरासत परररक्षण और संरक्षण र्ोिना तैर्ार करेगी और ऐसी र्ोिना को आंचजलक महार्ोिना में सजम्मजलत दकर्ा िाएगा। (2) राज्र् सरकार पाररजस्ट्थजतकी संवेिी िोन म ें बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन कोि आरजक्षत क्षत्रे , िैल जवरचनाए,ं िल प्रपातों, झरनो, घाटी मागो, उपवन, गुफाएं स्ट्थल भ्रमण, अश्व रोहण, उत्प्रपात आदि की पहचान की िाएगी और उनके परररक्षण और सरं क्षण की र्ोिना बनाएगी। 9. मानव जनर्मता जवरासत स्ट्थ ल का परररक्षण और सरं क्षण.– (1) राज्र् सरकार छह मास के भीतर मानव जनर्मात जवरासत स्ट् थल परररक्षण और संरक्षण र्ोिना तैर्ार करेगी और ऐसी र्ोिना को आंचजलक महार्ोिना में सजम्मजलत दकर्ा िाएगा। (2) राज्र् सरकार पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके परररक्षण और संरक्षण की र्ोिना बनाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 10. ध्व जन प्रिर्ू ण सबं धं ी उपार्.– राज्र् सरकार का पर्ाावरण जवभाग ध्वजन प्रिर्ू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिर्ू ण के जनर्ंत्रण के जलए मागाििाक जसद्धांत तैर्ार करेगा। 11. वार् ु प्रिर्ू ण सबं धं ी उपार्.– राज्र् सरकार का पर्ाावरण जवभाग वार् ु (प्रिर्ू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और इन अजधजनर्मों के तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रिर्ू ण के जनर्ंत्रण के जलए मागाििाक जसद्धांत तैर्ार करेगा। 12. बजहःस्राव का जनस्ट्सारण सबं धं ी उपार्.– पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहःस्राव का जनस्ट्सारण िल (प्रिर्ू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार होगा। 13. ठोस अपजिष्ट जनपटान सबं धं ी उपार्.– (1) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट जनपटान ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (2) स्ट्थानीर् प्राजधकरण ठोस अपजिष्ट को बार्ोजडग्रेडेबल और नॉन-बार्ोजडग्रेडेबल घटकों म ें अलग करन े के जलए र्ोिनाएं तैर्ार करेंग;े (3) बार्ोजडग्रेडेबल घटकों को अजधमानतः कंपोसस्ट्टंग र्ा वमती कल्चर र्ा बार्ोगैस संर्ंत्रों के माध्र्म स े पुननावीनीकरण दकर्ा िाएगा। (4) नॉन-बार्ोजडग्रेडेबल घटकों को पर्ाावरण की िजृ ष्ट स े स्ट्वीकार्ा रीजत स े पाररजस्ट्थजतकी संवेिी िोन के बाहर पहचाने गए स्ट्थान पर जनपटार्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट को िलाना र्ा भस्ट्मन अनुज्ञात नही दकर्ा िाएगी। 14. िैव जचदकत्सा अपजिष्ट जनपटान सबं धं ी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में िैव-जचदकत्सा अपजिष्ट जनपटान िैव- जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के प्रावधानों के अनुसार दकर्ा िाएगा। 15. प्लाजस्ट्टक अपजिष्ट प्रबधं न संबधं ी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ों के अनुसार दकर्ा िाएगा। 16. सजं नमाणा और जवध्वसं अपजिष्ट प्रबधं न सबं धं ी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन, संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। 17. ई–अपजिष्ट सबं धं ी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन, ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। 18. र्ानीर्-र्ातार्ात सबं धं ी उपार्.– राज्र् सरकार द्वारा र्ानीर्-र्ातार्ात को पर्ाावास-अनुकूल रीजत स े जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना म ें जवजनर्िष्टा उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होन े और अजधसूचना के अधीन अनुमोदित होने तक, मानीटरी सजमजत केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् के सुसंगत मागिा िाक जसद्धांतों के अधीन र्ानों की आवािाही के अनुपालन की मानीटरी करेगी। 19. र्ानीर् प्रिर्ू ण सबं धं ी उपार्.– राज्र् सरकार लागू जवजधर्ों के अनुसार र्ानीर् प्रिर्ू ण का जनवारण और जनर्ंत्रण करेगी और स्ट्वच्छ ईंधन के उपर्ोग के जलए प्रर्ास करेगी। 20. औनोजगक ईकाइर्ा ं सबं धं ी उपार्.– (1) पाररजस्ट्थजतकी-संवेिी िोन म ें काष्ठ आधाररत नर् े उनोगों की स्ट्थापना की अनुज्ञात नहीं दकर्ा िार्ेगा। परंतु र्ह दक जवनमान काष्ठ आधाररत उनोग तब तक िारी रह सकते ह ; िब तक दक तत्समर् प्रवृत जवजध के अधीन प्रजतजर्द्ध न दकए िाए। (2) पाररजस्ट्थजतकी संवेिी िोन म ें िल, वार्ु, मृिा र्ा ध्वजन प्रिर्ू ण करने वाले दकसी भी उनोग की स्ट्थापना को अनुज्ञात नहीं दकर्ा िाएगा। (3) अभर्ारण्र् और उनान की सीमा स े 1 दकलोमीटर के भीतर दकसी ईंट जनमााण उनोग की अनुमजत नहीं िी िाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 21. पहाड़ी ढलानों का सरं क्षण संबधं ी उपार्.– (1) आंचजलक महार्ोिना में पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनज्ञु ा नहीं होगी; (2) जिन ढलानों र्ा जवनमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 22. पाररजस्ट्थजतकी संविे ी िोन म ें प्रजतजर्द्ध, जवजनर्जमत र्ा संवर्धता दकए िान े वाल े दक्रर्ाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) के उपबंधों और तटीर् जवजनर्मन िोन, 2011 और अजधसूचना संखर्ाक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 सजहत तद्धीन बनाए गए जनर्मों द्वारा िाजसत होंगी और अन्र् लागू जवजधर्ों, जिनमें वन (सरं क्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म 1972 (1972 का 53), और तद्धीन बनाए गए जनर्म सजम्मजलत ह ; और नीचे िी गई सारणी में जवजनर्िष्टा रीजत से जवजनर्जमत दकए िाएंगे, अथाात.्- सारणी क्रम स.ं दक्रर्ाकलाप रटप्पणी (1) (2) (3) क. प्रजतजर्द्ध दक्रर्ाकलाप 1. वाजणजज्र्क खनन, पत्थर उत्खनन और (क) वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के अपघर्ाण इकाइर्ां । संजनमाणा र्ा मरम्मत के जलए धरती को खोिना, मकान बनाने और व्यजिगत उपर्ोग के जलए ििे ी टाइल्स र्ा ईंटो का संजनमााण करना भी सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवनमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघर्ाण इकाइर्ां तत्काल प्रभाव से प्रजतजर्द्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले म ें माननीर् उच्चतम न्र्ार्ालर् के आििे तारीख 4 अगस्ट्त ,2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामल े में तारीख 21 अप्रैल ,2014 के आििे के अनुसरण में होगा । 2. आरा मीलों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन के भीतर नई र्ा जवनमान आरा मीलों का जवस्ट्त ार अनुज्ञात नहीं होगा । 3. िल र्ा वार्ु र्ा मृिा र्ा ध्व जन प्रिर्ू ण पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उनोग लगाने और वतामान काररत करने वाले उनोगों की स्ट्थ ापना । प्रिर्ू णकारी उनोगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी। जवनमान उनोगों द्वारा प्रिर्ू ण जनवारण तकनीकों और ध्वजन अवरोधकों को स्ट्थाजपत दकर्ा िाना चाजहए। 4. िलावन लकड़ी का वाजणजज्र्क उपर्ोग । लागू जवजधर्ों के अनुसार प्रजतजर्द्ध (अन्र्था उपबंजधत के जसवार्) होंगे। 5. नए बृहत िल जवनुत पररर्ोिना की लागू जवजधर्ों के अनुसार प्रजतजर्द्ध (अन्र्था उपबंजधत के जसवार्) होंगे। स्ट्थापना । 6. दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा लागू जवजधर्ों के अनुसार प्रजतजर्द्ध (अन्र्था उपबंजधत के जसवार्) होंगे। उत्पािन । 7. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में लागू जवजधर्ों के अनुसार प्रजतजर्द्ध (अन्र्था उपबंजधत के जसवार्) होंगे। अनुपचाररत बजहःस्राव और ठोस अपजिष्टों का जनस्ट्सारण । 8. पर्ाटन से संबंजधत दक्रर्ाकलाप िैसे गमा राज्र् सरकार द्वारा मानीटरी/सवेक्षण/आपिा प्रबंधन िैसे आजधकाररक वार्ु गुब्बारों आदि द्वारा राष्ट्रीर् उनान सावािजनक प्रर्ोिन के जलए प्रजतबंजधत (अन्र्था उपबंजधत के जसवार्) होंगे। क्षेत्र के ऊपर से उड़ना िैसे दक्रर्ाकलाप करना। 9. ससंचाई जवभाग द्वारा िल पजल् वत क्षेत्र अभर्ारण्र्ों और उनान की सीमा से एक दकलोमीटर के भीतर सरकारी टेंकों के पट्टा । िल पजल् वत क्षेत्रों में कृजर् हते ु पट्टे का पूणा विान । 10. नए का्‍ ठ आधाररत उनोग। पाररजस्ट्थजतकी संवेिी िोन की सीमाओं के भीतर नए का्‍ ठ आधाररत उनोग की स्ट्थ ापना को अनुज्ञात नहीं दकर्ा िाएगा :[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 परंतु जवनमान का्‍ ठ आधाररत उनोग तब तक िारी रह सकेंगे िब तक दक उन् ह ेंतत् समर् प्रवृत् त दकसी जवजध के अधीन प्रजतजर्द्ध न दकर्ा िाए । 11. वाजणजज्र्क संकेत बोडा और होर्डिंग्स। लागू जवजधर्ों के अनुसार प्रजतजर्द्ध होंगे। गावठान कस्ट्बे को छोड़कर सभी िगहों पर रोिनी वाले संकेतबोडा और होर्डिंग पर प्रजतबंध लगार्ा िाए। 12. िकु ानिारों द्वारा पॉलीजथन की थैजलर्ों लागू जवजधर्ों के अनुसार प्रजतजर्द्ध होंगे। का प्रर्ोग। ख.जवजनर्जमत दक्रर्ाकलाप 13. होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी अनुकूल पर्ाटन दक्रर्ाकलापों से संबंजधत पर्ाटकों के अस्ट्थार्ी स्ट्थापना । उपिीजवका के जलए आवास के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर तक, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना अनुज्ञात नहीं होगी: परंतु दक एक दकलोमीटर से परे और पाररजस्ट्थजतकी संवेिी ज़ोन के जवस्ट्तार तक, सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवनमान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और राष्ट्रीर् बाघ संरक्षण प्राजधकरण के मागाििाक ससंद्धांत के अनुरूप होगा। 14. संजनमाणा दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर दकसी भी प्रकार का नर्ा वाजणजज्र्क संजनमााण अनुज्ञात नहीं दकर्ा िाएगा: परंतु स्ट् थानीर् लोगों को पैराग्राफ 4 में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए संजनमाणा करने की अनुज्ञा िी िाएगी। (ख) ऐसे लघु उनोगों िो प्रिर्ू ण उत् पन् न नहीं करते ह,; से संबंजधत संजनमाणा दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी का पूवा अनुज्ञा अनुज्ञात दकए िाएंगे । (ग) एक दकलोमीटर से परे और पाररजस्ट्थजतकी संवेिी िोन की सीमा तक वास्ट्तजवक स्ट्थानीर् आवश्र्कताओं के जलए संजनमााण की अनुज्ञा िी िाएगी और अन्र् वाजणजज्र्क संजनमााण दक्रर्ाकलाप आंचजलक महार्ोिना के अनुरूप होंगी। 15. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई केंद्रीर् र्ा सबं ंजधत राज्र् के अजधजनर्म र्ा तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 16. वाजणजज्र्क िल संसाधन जिसके अंतगात (क) भूजम के अजधभोगी के वास्ट्तजवक कृजर् और घरेलू उपर्ोग के जलए सतही भ-ू िल संचर्न भी ह ै। िल और भूजमगत िल का जन्‍कर्ाण अनुज्ञात होगा । (ख) औनोजगक, वाजणजज्र्क उपर्ोग के जलए सतही और भूजमगत िल के जन्‍कर्ाण के जलए संबंजधत जवजनर्ामक प्राजधकरण पूवा जलजखत अनुज्ञा अपेजक्षत होगी जिसके अंतगात दकतन ेपररणाम में वह जन्‍कर्ाण करेगा, भी ह।ै (ग) सतही िल र्ा भूिल का जवक्रर् अनुज्ञात नहीं होगा। (घ) िल के संिर्ू ण र्ा प्रिर्ू ण, जिसके अंतगात कृजर् भी ह,ै के जनवारण जलए सभी उपार् दकए िाएंगे । 17. जवनुत केबलों और िरू संचार टावरों का नागिीरा वन् र्िीव अभर्ारण्र्, नर्ा नागिीरा वन् र्िीव अभर्ारण्र्, कोका पररजनमााण । वन् र्िीव अभर्ारण्र्, नवेगांव वन् र्िीव अभर्ारण्र् और नवेगांव रा्‍ रीर् उनान की सीमा से 500 मीटर के भीतर नई उच् च टेंिन पारेर्ण लाइनों को जबछाने को अनुज्ञात नहीं दकर्ा िाएगा । 18. जवनमान सड़कों को चौड़ा करना और र्ह उजचत पर्ाावरण समाघात जनधाारण और न् र्ूनीकरण उपार् र्था लागू के उन्हें सुिढृ करना तथा नई सड़कों का अनुसार होंगे । संजनमाणा । 19. राजत्र में र्ानीर् र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे । 20. जवििे ी प्रिाजतर्ों को लाना। लागू जवजधर्ों के अधीन जवजनर्जमत होंग े। 21. पहाड़ी ढालों और निी तटों का संरक्षण और अबमल र्ा ठोस उपचाररत बजहःस्राव का जनस्ट्सारण । अपजिष्टों के जनपटान के जलए जवनमान जवजनर्मों का अनुपालन करना होगा । 23. प्रिर्ू ण उत्पन्न न करने वाले लघु उनोग । पाररजस्ट्थजतकी संवेिी िोन स े गैर प्रिर्ू ण, गैर पररसंकटमर्, लघ ु और सेवा उनोग, कृजर्, पु्‍पकृजर् उनान, कृजर् र्ा कृजर् आधाररत ििे ीर् माल से औनोजगक उत्पािों का उत्पािन उनोग और िो पर्ाावरण पर कोई जवपरीत प्रभाव नहीं डालते ह,; अनुज्ञात दकए िाएंगे । 24. वन उत्पािों और गैर काष्ठ वन उत्पािों लागू जवजधर्ों के अधीन जवजनर्जमत होंग े। का संग्रहण । 25. वार्ु और र्ानीर् प्रिर्ू ण । लागू जवजधर्ों के अधीन जवजनर्जमत होंग े। 26. नए होटलों और लॉिों के पररसरों म ें लागू जवजधर्ों के अधीन जवजनर्जमत होंग े। बाड लगाना । 27. मोबाइल टावर । िीर्ा पर संरक्षण प्रणाली के साथ अनुज्ञात दकर्ा िाएगा। 28. फनती चर माटा । वन जवभाग द्वारा जवजनर्जमत दकर्ा िाएगा । 29. मछली पकड़ना । कले्‍ टर और जिला स्ट् तरीर् िैव जवजवधता प्रबंधन सजमजत की अध्र् क्षता में की जसफाररिों के अनुसार ह।ै स्ट्थानीर् ग्रामों और संरजक्षत क्षेत्रों से पुनवााजसत लोगों को प्राथजमकता िी िा सकती ह।ै 30. पुराने टेंकों को गहरा करना। कले्‍टर और जिला स्ट्तरीर् िैव जवजवधता प्रबंधन सजमजत की अध्र्क्षता वाली सजमजत द्वारा जसफाररिों के अनुसार है। िंगली पिुओं के जलए आसान पहुचं की सुजवधा के जलए कोमल ढलान को बनाए रखा िाना चाजहए। 31. िलािर्ों र्ा टेंकों में न् र्ूनतम भंडारण । न् र्ूनतम भंडारण का अनुरक्षण दकर्ा िाएगा । 32. कृजर् प्रणाजलर्ों में आमूल पररवतान । लागू जवजधर्ों के अधीन जवजनर्जमत होंगे । 33. पवन चदिर्ां और टबााइन। लागू जवजधर्ों के अधीन जवजनर्जमत होंगे । ग.सवं र्धता दक्रर्ाकलाप: 34. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजर् लागू जवजधर्ों के अधीन अनुज्ञात होंगे । और बागवानी प्रथाओं के साथ िग्ुधिाला, िग्ुध उनोग, कृजर् और मछली पालन । 35. वर्ाा िल संचर् । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा । 36. िैजवक खेती। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा । 37. सभी गजतजवजधर्ों के जलए हररत सदक्रर् रूप से बढ़ावा दिर्ा िाएगा । प्रौनोजगकी का अंगीकरण । 38. ग्रामीण कारीगरों सजहत कुटीर उनोग सदक्रर् रूप से बढ़ावा दिर्ा िाएगा । आदि। 39. नवीकरणीर् ऊिाा स्त्रोत िैसे बार्ोगैस, बार्ोगैस, सौर प्रकाि क्र.स.ं मानीटरी सजमजत का गठन पि i. जिला कले्‍ टर, गोंदिर्ा अध्र्क्ष, पिने ; ii. जिला कले्‍ टर, भंडारा का प्रजतजनजध सिस्ट्र्, पिने ; iii. क्षेत्र जनििे क, नवेगांव- नागिीरा बाघ आरजक्षती सिस्ट्र्, पिने ;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 iv. समर्-समर् पर तीन वर्ा की अवजध के जलए महाराष्ट्र सरकार द्वारा नामजनर्िष्टा पर्ाावरण सिस्ट्र्; (जवरासत संरक्षण सजहत) के क्षेत्र में काम करने वाले भंडारा सिस्ट्र्, पिने ; x. उप वन संरक्षक, गोंदिर्ा सिस्ट्र्-सजचव, पिने ; 24. जनगरानी सजमजत के कार्.ा - (1) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का. आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची म ें सजम्मजलत ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन म ें आते ह,; जसवार् इसके परै ा 22 के अधीन सारणी म ें जवजनर्िष्टा प्रजतजर्द्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसचू ना के उपबंधों के अधीन पूव ा पर्ाावरण अनापजत्त के जलए, र्थाजस्ट्थजत, केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िष्टा दकर्ा िाएगा। (2) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्क ालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना सखं र्ाकं का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन म ें आत े ह,; जसवार् इसके पैरा 22 के अधीन सारणी म ें जवजनर्िष्टा प्रजतजर्द्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा । (3) मानीटरी सजमजत मामला-िर-मामला के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेर्ज्ञों, औनोजगक संगमों र्ा संबद्ध पणधारीर्ों के प्रजतजनजधर्ों को, अपन े जवचार-जवमि ा म ें सहार्ता के जलए आमंजत्रत कर सकेगी । (4) मानीटरी सजमजत प्रत्र्ेक वर्ा 31 माच ा तक के अपन े दक्रर्ाकलापों की वार्र्ाक कारावाई ररपोटा, राज्र् के मुखर् वन्र्िीव वाडान को, उपाबंध-VI म ें जवजनर्िष्टा जनििना पत्र म ें उस वर्ा के 30 िून तक प्रस्ट्तुत करेगी । (5) केन्द्रीर् सरकार का पर्ाावरण, वन और वपूणा मामला । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 20th September, 2023 S.O 4132.(E).—WHEREAS, in supersession of the notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 612(E), dated 25th February, 2016, a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 876 (E), dated the 24th February, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the said Gazette notification were made available to the public on the 24th February, 2023; AND WHEREAS, objections and suggestions received from persons and stakeholders in respect of the said draft notification have been considered by the Central Government; AND WHEREAS, the Nagzira Wildlife Sanctuary, New Nagzira Wildlife Sanctuary, Koka Wildlife Sanctuary, Navegaon Wildlife Sanctuary and Navegaon National Park hereinafter referred to as the Sanctuaries and Park, respectively are located in Gondia and Bhandara Districts in Maharashtra; AND WHEREAS, the Sanctuaries and Park comprise the core or critical tiger habitat of Navegaon –Nagzira Tiger Reserve as notified vide notification of the State Government of Maharashtra number WLP. 0913/C.R.316/ F-1 dated the 12th December, 2013; AND WHEREAS, the Sanctuaries and Park are known for rich avifauna with about 312 species of birds including migratory and water birds, a number of territorial birds of Indian origin stay here around the year, breeding of Saras Cranes have been recorded from this region, Honey Buzzard, Serpent Eagle, Hawk Eagle, Grey headed Fish Eagle are important raptors in the area; AND WHEREAS, the area has very high faunal and floral diversity with about 72 species of mammals, about 48 species of reptiles and many species of amphibian are found and the flora of this area is represented by Southern tropical Dry Deciduous Forests; AND WHEREAS, the area also supports important wildlife such as Tiger, Leoprad, Sloth Bear, Wild Dog, Indian Gaur (Bison), Cheetal, Sambhar and Neelgai; AND WHEREAS, the extremely close vicinity of the Sanctuaries and Park to human habitation and ongoing developmental activities necessitate the requirement of proper safeguards and control over such activities; AND WHEREAS, it is necessary to conserve and protect the geographical area adjoining the Sanctuaries and Park from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in this geographical area; NOW THEREFORE, in exercise of the powers conferred by sub section (1) clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub rule (3) of rule 5 of the Environment (Protection) Rules, 1986, and in supersession of notification number S.O. 612 (E), dated 25th February, 2016, except as respects things done or omitted to be done, the Central Government hereby notifies the area from the boundary of the Sanctuaries and the Park in the State of Maharashtra as the Navegaon – Nagzira Tiger Reserve Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone .- (1) The Eco-sensitive Zone shall cover an area of 2337.112 square kilometres with an extent varying from 2 kilometres to 15.3 kilometres from the boundary of the Sanctuaries and the Park.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) The boundary description of the Eco-sensitive Zone is in Annexure-I. (3) The maps of the Eco-sensitive Zone along with latitudes and longitudes are in Annexure-II. (4) The list of geo-coordinates of the boundary of the Eco-sensitive Zone are in Table A of Annexure-III. (5) List of geo-coordinates of the boundary of the Sanctuaries and Park are in Table B and Table C of Annexure-IV. (6) The list of the villages falling within Eco-sensitive Zone is in Annexure-V. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purposes of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of the this notification in the Official Gazette, in accordance with the provisions of this notification. (2) The buffer zone of the Navegaon-Nagzira Tiger Reserve which shall form part of the Eco-sensitive Zone and the Tiger Conservation Plan, shall be taken into consideration during the preparation of the Zonal Master Plan. (3) The Zonal Master Plan shall be prepared in consultation with the local residents and, all State Departments concerned, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipality; (vi) Revenue; (vii) Agriculture; (viii) Maharashtra State Pollution Control Board ; and (ix) any other concerned agency in the State Government for integrating environmental and ecological considerations. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal area, agricultural areas, grass lands, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes, wet lands and other water bodies. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated and promoted activities listed in the Table in paragraph 23 and shall ensure eco-friendly development for security of local communities’ livelihood. (8) Pending the preparation of the Zonal Master Plan for the Eco-sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee constituted under paragraph 23 for appropriate action under paragraph 24. (9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for any decision to be taken including consideration for relaxation. 3. Measures to be taken by State Government .- The State Governments shall take the measures for giving effect to the provisions of this notification. 4. Land use related measures:-(1) Forests, horticulture areas, tribal areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 Provided that the State Government may permit the conversion of agricultural lands within the Eco-sensitive Zone on the recommendation of the Monitoring Committee, to meet the residential needs of local residents, and for the following activities, namely:- (i) Establishment of eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities, (ii) Widening and strengthening of existing roads and construction of new roads, (iii) Setting up of small scale industries not causing pollution. Provided further that the State Government may permit the use of land in tribal area for commercial or industrial development activities or compliance of the provisions of article 244 of the Constitution of India and the laws for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007). (2) The State Government shall correct any error appearing in the records of the land within the Eco-sensitive Zone only once in each case, on consultation with the Monitoring Committee, and intimate the Central Government in the Ministry of Environment, Forest and Climate Change about such correction: Provided that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas as per buffer zone management plan of the Navegaon-Nagzira Tiger Reserve. 5. Natural springs related measures.- The State Government shall take the following measures, namely.- (i) Identification of the catchment area of all natural springs and natural bodies; (ii) Planning for conversion and rejuvenation of the catchment area and incorporation of such plans in the Zonal Master Plan; and (iii) Prohibit development activities and manner of discharge of pollutants at or near the catchment area which are detrimental to such areas. 6. Tourism Master Plan.- (1) The Department of Tourism of the State Government in consultation with the Department of Revenue and Forests of the State Government, shall prepare a Tourism Master Plan for the purpose of effective management of the tourism activities within the Eco-sensitive Zone. (2) The Tourism Master Plan shall be incorporated in the Zonal Master Plan. 7. Tourism related measures.- (1) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone. (2) Establishment of hotels and resorts shall not be permitted within one kilometer from the boundary of the Sanctuaries and Park except for temporary accommodation for tourists related to eco-friendly tourism activities. (3) Establishment of new hotels and resorts may be permitted by the State Government only in pre-defined and designated areas for eco-tourism beyond the distance of one kilometer from the boundary of the Sanctuaries and Park till the extent of the Eco-sensitive Zone, as per Tourism Master Plan. (4) The development for tourism and expansion of existing tourism activities may be permitted by the regulatory authorities concerned based on the actual site specific scrutiny and on the recommendations of the Monitoring Committee until the Zonal Master Plan is approved under this notification . 8. Natural heritage Protection and Conservation Plan.- (1) The State Government shall prepare a Natural Heritage Protection and Conservation Plan within six months and such plan shall be incorporated in the Zonal Master Plan. (2) The State Government shall identify and, plan to protect and conserve the valuable natural heritage sites in the Eco-sensitive Zone, including the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides and cliffs. 9. Man-made heritage Protection and Conservation Plan.- (1) The State Government shall prepare a Man-made Heritage Protection and Conservation Plan within six months and such plan shall be incorporated in the Zonal Master Plan.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) The State Government shall identify and, plan to protect and conserve the valuable Man-made heritage sites in the Eco-sensitive Zone, including the buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance. 10. Noise pollution related measures.- The Environment Department of the State Government shall make guidelines for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000. 11. Air pollution related measures.- The Environment Department of the State Government shall make guidelines for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981), the Environment (Protection) Act, 1986, and the rules made thereunder. 12. Discharge of effluents related measures:- The discharge of treated effluents in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. 13. Solid wastes disposal related measures.- (1) The solid waste disposal in Eco-sensitive Zone shall be in accordance with the provisions of the Solid Waste Management Rules, 2016. (2) The local authorities shall draw up plans for the segregation of solid waste into biodegradable and non- biodegradable components. (3) The biodegradable components shall be recycled preferably through composting or vermiculture or biogas plants. (4) The non-biodegradable components shall be disposed of in an environmentally acceptable manner at a site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco- sensitive Zone. 14. Bio-medical waste disposal related measures.- The bio-medical waste disposal in the Eco-sensitive Zone shall be in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016. 15. Plastic waste management related measures.- The plastic waste management in the Eco-sensitive Zone shall be in accordance with the provisions of the Plastic Waste Management Rules, 2016. 16. Construction and demolition waste management related measures.- The construction and demolition waste management in the Eco-sensitive Zone shall be in accordance with the provisions of the Construction and Demolition Waste Management Rules, 2016. 17. E-waste related measures.- The e-waste management in the Eco-sensitive Zone shall be in accordance with the provisions of the E-Waste Management Rules, 2016. 18. Vehicular traffic related measures.- The State Government shall regulate the vehicular movement of traffic in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved under the notification, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant guidelines of the Central Government in the Ministry of Environment, Forest and Climate Change. 19. Vehicular pollution related measures.- The State Government shall prevent and control vehicular pollution in accordance with the applicable laws and shall make efforts for use of cleaner fuels. 20. Industrial units related measures.- (1) Establishment of new wood based industries shall not be permitted within the Eco-sensitive Zone: Provided that the existing wood based industries may continue unless prohibited under any law for the time being in force. Functions of the Monitoring Committee.– (1) The Monitoring Committee shall, based on the actual site- specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 22 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 22 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and refer to the regulatory authorities concerned. (3) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (4) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro- forma specified in Annexure-VI, appended to this notification. (5) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 25. Complaints for non-compliance.- The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
