फरवरी, 2022 का.अ. 415(ऄ).— प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण, भारत सरकार के पयावा रण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 3876 (ऄ), तारीख 27 ऄक्टूबर, 2020 में प्रकाजित की गइ थी जजसमें ऐस े सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को ऄन्तर्ववष्ट करने वाली राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थ,, सा ददन की ऄवजध के भीतर अ्पे और सुझाव अमंजत्रत दकए गए थ;े और, ईि प्रारूप ऄजधसूचना को ऄन्तर्ववष्ट करन े वाली राजपत्र की प्रजतयां जनता को तारीख 28 ऄक्टूबर, 2020 को ईपलब्ध करा दी गइ थी; और, पूवोि प्रारुप ऄजधसूचना के प्रत्युत्तर म ेंव्यजियों और पणधाररयों से कोइ अ्ेप और सझु ाव प्राप्त नह, हुए; और, गमगलु -सीयाबेही वन्यजीव ऄभयारण्य जहमाचल प्रदेि राज्य के चम्बा जजल े के सलौनी ईप-संभाग म ें जस्ट्थत ह ै और चम्बा वन्यजीव संभाग के प्रिासजनक जनयंत्रण के ऄधीन अता ह।ै यह ऄभयारण्य मूलत: ऄजधसूचना स.ं एफटी.- 1/48, तारीख 1 जुलाइ, 1949 के द्वारा गेम ऄभयारण्य के रूप म ें ऄजधसूजचत दकया गया था। जनयम और जवजनयम 657 GI/2022 (1)2 THE GAZETTE 27 माचा, 1974 के द्वारा वन्यजीव ऄभयारण्य घोजित दकया गया था और यौजिकीकरण के बाद नवीनतम ऄजधसूचना स.ं एफएफइ-बी-एफ (6)-11/2005- II, तारीख 7 जून, 2013 को जारी की गइ थी; और, गमगलु -सीयाबेही वन्यजीव ऄभयारण्य ऄ्ांिों 32047’52”ई स े 32055’67”ई और दिे ांतरों 75047’88” पू स े 75058’44” पू के बीच जस्ट्थत ह ैजो दक भारतीय सवे्ण टोपोिीट सं. 43पी/13 पैमाना 1:50,000 के ऄंतगात अता ह।ै गमगलु -सीयाबेही वन्यजीव ऄभयारण्य चम्बा जजले के सलौनी ईप-संभाग म ें जस्ट्थत ह ै और चम्बा वन्यजीव संभाग के प्रिासजनक जनयंत्रण के ऄंतगात अता ह।ै संरज्त ्त्रे का कुल ्ेत्रफल 108.40 वग ा दकलोमीटर ह;ै और, यह ऄभयारण्य सीईल नाला (रावी नदी की सहायक नदी) के जलग्रहण ्त्रे म,ें पयाावास से दरू और दरू स्ट्थ ्त्रे म ें जस्ट्थत ह।ै आस ऄभयारण्य के अदि ा पयाावास के जलए आसम ें वनस्ट्पजत की प्रजाजतयों जसै े देवदार (सेडरूस देवदार), कैल (जपनस वाजल्लजचऄना), स्ट्प्रूस (जपकेया जस्ट्मथीऄना), जसल्वर फीर (एजबस पपड्रोव), बान (क्वेरकस सेमीकापोफोजलया), पपक बुरांस (रोडोडेंड्रोन कैम्पैनलु ैटम), अदद का वास ह;ै और, ऄभयारण्य स े मुख्य जीवजंतु कस्ट्तूरी जहरन (मोस्ट्चस मोस्ट्चीफेरूस), तेंदअु जबल्ली (जप्रयनलै ुरस बेंगालेंजसस), सामान्य तेंदअु (पथैं ेरा पाडास), काला भालू (ईरसुस जथबेटेनस), जहमालयन गोरल (नेमोरहडेस गोरल), येलो थ्रोटेड माटेन (माटेस फ्लाजवगलु ा), लाल लोमडी (वुलपेस वुलपस), कोकलास (पुकाराजसया मैक्रोलोफा), कालीज (लोफुरा ल्यूकोमेलानोस), चकोर (ऄलेक्टोररस चुकार), अदद ईपलब्ध ह।ै यहां वृ्ावृत ्ेत्रों का ऄच्छा आन्टरफेस और चरागाहों का बृहत् जवस्ट्तार ह ैजो पिुओं के साथ-साथ पज्यों के जलए अदि ापयाावास बनाता ह;ै और, उंचाइ और ऄवजस्ट्थजत के साथ वन फसल का संघटन जवजवध ह।ै बृहत ् पत्ती प्रजाजतयााँ िुद्ध और जमजित रूप में ईच्च उंचाइ िंकुवृ्ों जैसे दवे दार, कैल, फीर और स्ट्प्रूस के रूप म ें जनचला उंचाइ म ें समिीतोष्ण ्त्रे म ें ईग रह े ह।ैं दज्णी ऄवजस्ट्थजत म ें कैल प्रमुख ह,ै जबदक िीतलक स्ट्थानों म ें देवदार, फर और स्ट्प्रूस पाए जाते ह।ैं ऄल्पाआन ्त्रे म ें चरागाह और खडी चट्टानें जवद्यमान ह।ैं जैव-भौगोजलक रूप स,े ऄभयारण्य का ्त्रे जहमालयी पार ्त्रे के ऄंतगता अता ह;ै और, गमगलु -सीयाबेही वन्यजीव ऄभयारण्य एक तरफ से जहमाचल प्रदेि के चुराह वन संभाग और ऄन्य तरफ पर जम्मू और कश्मीर राज्य स े जघरा हुअ ह।ै ऄभयारण्य के समीपवती चुराह वन संभाग के ्त्रे म ें बत्तीस ग्राम ह ैं जबदक ऄभयारण्य का समीपवती जम्मू और कश्मीर का ्त्रे ईच्च पवात चोरटयों, बफा स े जघरा हुअ और पयाावास स े मुि ह।ै ऄतः ऄभयारण्य की सीमा स े एक दकलोमीटर की चौडाइ वाला 28.90 वगा दकलोमीटर (चुराह वन संभाग का ्त्रे ) स े युि पाररजस्ट्थजतकी संवेदी जोन प्रस्ट्ताजवत ह;ै और, गमगुल-सीयाबेही वन्यजीव ऄभयारण्य के चारों ओर के ्ेत्र को, जजसका जवस्ट्तार और सीमाएं आस ऄजधसूचना के पैराग्राफ 1 में जवजनर्ददष्ट ह,ैं पाररजस्ट्थजतकी, पयाावरणीय और जैव-जवजवधता की दजृ ष्ट स े पाररजस्ट्थजतकी संवेदी जोन के रूप म ें सुरज्त और संरज्त करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों की िेजणयों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना अवश्यक ह;ै ऄतः ऄब, केन्रीय सरकार, पयाावरण (संर्ण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ पर त पयाावरण (संर्ण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आसमें आसके पश्चात् पयाावरण ऄजधजनयम कहा गया ह)ै धारा 3 की ईपधारा (1) तथा ईपधारा (2) के खंड (v) और खंड (xiv) एवं ईपधारा (3) के द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, जहमाचल प्रदेि राज्य के जजला चम्बा म ें गमगुल-सीयाबेही वन्यजीव ऄभयारण्य की सीमा के चारों ओर िून्य स े 3.3 दकलोमीटर तक जवस्ट्ताररत ्ेत्र को पाररजस्ट्थजतकी संवेदी जोन (जजसे आसमें आसके पश् चात ् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप म ेंऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात:् -[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 1. पाररजस्ट्थजतकी सवं दे ी जोन का जवस्ट्तार और सीमा-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार गमगलु -सीयाबेही वन्यजीव ऄभयारण्य की सीमा के चारों ओर िून्य से 3.3 दकलोमीटर तक जवस्ट्तृत ह ै और पाररजस्ट्थजतकी संवेदी जोन का ्ेत्रफल 28.90 वगा दकलोमीटर ह।ै राज्य द्वारा पाररजस्ट्थजतकी संवेदी जोन का िून्य जवस्ट्तार ईजचत हराया गया ह ै दक “वन्यजीव ऄभयारण्य की सीमा ईत्तर-पूवी और ईत्तर-पजश्चमी भाग पर जम्मू और कश्मीर की सीमा के साथ सह समाप्त होती ह।ै ऄत:, आन ददिाओं म ेंपाररजस्ट्थजतकी संवेदी जोन को प्रस्ट्ताजवत नह, दकया गया ह।ै” (2) गमगलु -सीयाबेही वन्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबधं -I के रूप में संलग्न ह।ै (3) सीमा जववरण और ऄ्ांि और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन को सीमांदकत करते हुए गमगुल-सीयाबेही वन्यजीव ऄभयारण्य के मानजचत्र ईपाबधं –IIक, ईपाबधं -IIख और ईपाबधं -IIग के रूप म ें संलग्न ह।ै (4) पाररजस्ट्थजतकी संवेदी जोन और गमगलु -सीयाबेही वन्यजीव ऄभयारण्य की सीमा के भू-जनदेिांकों की सूची ईपाबधं - III की सारणी क और सारणी ख म ेंदी गइ ह।ै (5) मुख्य पबदओंु के भू-जनदेिाकं ों के साथ पाररजस्ट्थजतकी संवेदी जोन के ऄतं गता अन े वाले ग्रामों की सूची ईपाबधं -IV के रूप म ें संलग्न ह।ै 2. पाररजस्ट्थजतकी सवं दे ी जोन के जलए अचं जलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए राजपत्र म ें आस ऄजधसचू ना के प्रकािन की से दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और राज्य के स्म प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसचू ना में ददए गए ऄनुबधं ों का पालन करते हुए अंचजलक महायोजना तैयार करेगी और राज्य म ें स्म प्राजधकारी द्वारा सम्यक रुप से ऄनुमोददत दकया जाएगा। (2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना म ें जवजनर्ददष् ट दकए गए ह,ैं के ऄनुसार तथा सुसंगत केंरीय और राज्य जवजधयों के ऄनुरुप और केंरीय सरकार द्वारा जारी मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी । (3) अंचजलक महायोजना, ईि योजना म ें पाररजस्ट्थजतकी और पयाावरणीय जवचारों को समाकजलत करन े के जलए राज्य सरकार के जनम्नजलजखत जवभागों के परामि ासे तैयार होगी, ऄथाात्:- (i) पयाावरण; (ii) वन और वन्यजीव; (iii) कृजि; (iv) राजस्ट् व; (v) िहरी जवकास; (vi) पयाटन; (vii) ग्रामीण जवकास; (viii) पसचाइ और बाढ़ जनयंत्रण; (ix) नगरपाजलका; (x) पंचायती राज; (xi) जहमाचल प्रदेि राज्य प्रदिू ण जनयंत्रण बोड;ा और (xii) लोक जन मााण जव भाग।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) अंचजलक महायोजना ऄनमु ोददत जवद्यमान भ-ू ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन ऄजधरोजपत नह, करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और दक्रयाकलापों में, जो ऄजधक द्ता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी । (5) अंचजलक महायोजना म ें ऄनाच्छाददत ्ेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संर्ण, अवाह ्ेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संर्ण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलओंु , जजन पर ध्यान देना अवश्यक ह,ै के जलए ईपबंध होंगे । (6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेिताओं के ब्यौरों स े ऄनुसमर्वथत मानजचत्र के साथ सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजि ्ेत्रों, उपजाउ भूजम, हररत ्ेत्र जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजि ्ेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभयांकन करेगी। (7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करने के जलए प्रदकया प्रदान की जाएगी और सारणी म ें सूचीबद्ध पैरा-4 में प्रजतजिद्ध और जवजनयजमत दक्रयाकलापों का ऄनपु ालन करेगी और स्ट्थ ानीय समुदायों की जीजवका को सुरज्त करन ेके जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजश्चत और ईसकी ऄजभवृजद्ध भी करेगी। (8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह जवस्ट्तारी होगी । (9) राज्य सरकार द्वारा ऄनुमोददत अंचजलक महायोजना, मानीटरी सजमजत के जलए एक संदभा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना के ईपबंधों के ऄनुसार जनगरानी के ऄपन ेकतव्या ों का जनवाहन कर सके। 3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:- (1) भ-ू ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म ें वनों, ईद्यान कृजि ्ेत्रों, कृजि ्ेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दक्रयाकलापों के जलए ईपयोग या संपररवतान नह, होगा: परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर आसमें जवजनर्ददष्ट प्रयोजनों से जभ्न प्रयोजनों के जलए कृजि और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और ्ेत्रीय नगर योजना ऄजधजनयम और केन्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन स्म प्राजधकारी के पूवा ऄनुमोदन स,े और आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करने के जलए ऄनुज्ञात दकया जाएगा, जैस-े (i) जवद्यमान सडकों को चौडा करना और ईन्ह ेंसुदढ़ृ करना तथा नइ सडकों का संजनमााण; (ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रदिू ण ईत्प्न न करने वाल े लघ ुईद्योग; (iv) कुटीर ईद्योगों जजनके ऄंतगता ग्रामीण ईद्योग भी ह;ैं सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाए ं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄधीन गहृ वास सजम्मजलत ह;ै और (v) पैरा 4 म ें ददए गए संवर्वधत दक्रयाकलाप: परंत ु यह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन स्म प्राजधकारी के पूवा ऄनुमोदन और संजवधान के ऄनुच्छेद 244 के ईपबंधों या तत्समय प्रवृत्त जवजध के ईपबंधों के ऄनुपालन के जबना, जजसके ऄतं गात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता)[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नह, होगा: परंत ु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों म ें ईपसंजात कोइ गलती, मानीटरी सजमजत के जवचार प्राप्त करन े के पश्चात ् राज्य सरकार द्वारा प्रत्येक मामले म ें एक बार ीक होगी और ईि गलती के सुधार की सूचना केंरीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी: परंत ु यह और भी दक गलती के सुधार म ें आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा म ें भू-ईपयोग का पररवतान सजम्मजलत नह, होगा; (ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजि ्त्रे ों में पुन: वनीकरण करने के प्रयास दकए जाएंगे। (2) प्राकृजतक जल स्रोत.- अचंजलक महायोजना म ें सभी प्राकृजतक झरनों के अवाह ्ेत्रों की पहचान की जाएगी और ईनके संर्ण और नवीकरण के जलए योजना सजम् मजलत होगी और राज्य सरकार द्वारा ऐसे ्ेत्रों पर या ईनके जनकट जवकास दक्रयाकलाप प्रजतजिद्ध करन े के बारे म ें जो ऐस े ्ेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएंगे। (3) पयटा न या पाररजस्ट्थजतकी पयटा न.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा। (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामि ा स े तैयार होगी। (ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप म ें होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन ्मता के अधार पर तैयार की जाएगी। (ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंगे, ऄथाात:्- (i) संरज्त ्त्रे की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नये वाजणजज्यक होटल और ररजॉट ाके सज्नमााण ऄनज्ञु ात नह, होंग:े परंत,ु यह दक संरज्त ्त्रे की सीमा से एक दकलोमीटर की दरू ी स े परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉट ा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्ददष्ट ्ेत्रों म ें पयटा न महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनज्ञु ात होगा; (ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पयाटन दक्रयाकलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार केंरीय सरकार के पयाावरण, वन और जलवायु पररवतान मत्रं ालय के मागादिाक जसद्धांतों के द्वारा तथा राष्र ीय ा याघ्र संर्ण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जि्ा और पाररजस्ट्थजतकी-जवकास पर बल देते हुए (समय-समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा; (iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवी्ा और जनगरानी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नए होटल या ररसोट ा या वाजणजज्यक स्ट्थापना का संजनमाणा ऄनुज्ञात नह, दकया जायेगा । (4) नसै र्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन म ें महत्वपूणा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरज्त ्त्रे , िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पहचान की जाएगी और जवरासत संर्ण योजना अंचजलक महायोजना के भाग के रुप में पररर्ण और संर्ण के जलए तैयार की जाएगी । (5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के ्ेत्रों की और ईप्ेत्रों पहचान और ईनके संर्ण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तयै ार की जाएगी। (6) ध्व जन प्रदिू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिू ण (जवजनयमन और जनयंत्रण) जनयम, 2000 म ें ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिू ण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा। (7) वाय ु प्रदिू ण.- पाररजस्ट्थजतकी संवेदी जोन म,ें वाय ु प्रदिू ण के जनवारण और जनयंत्रण का वाय ु (प्रदिू ण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा। (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन म ें ईपचाररत बजहस्राव का जनस्ट्सारण, साधारण मानकों के ईपबंधों के ऄनुसार पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन े वाल े पयाावरणीय प्रदिू ण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक क ोर हो, के ईपबंधों के ऄनुसार होगा। (9) ोस ऄपजिष्ट.- ोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म ें ोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रलै , 2016 के द्वारा प्रकाजित ोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन स े बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करत े हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ोस ऄपजिष्ट का सुरज्त और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा। (10) जैव जचदकत्सा ऄपजिष्ट .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करत े हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरज्त और पयाावरण-ऄनुकूल प्रबधं न ऄनुज्ञात दकया जा सकेगा। (11) प्लाजस्ट्टक ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (12) जनमाणा और जवध्वसं ऄपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन म ें संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयावा रण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा । (13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतना मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबधं जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 (14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध म ें अंचजलक महायोजना म ें जविेि ईपबंध सजम्मजलत दकए जाएंग े और अंचजलक महायोजना के तैयार होने और राज्य सरकार के स्म प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दक्रयाकलापों के ऄनपु ालन को मानीटर करेगी। (15) यानीय प्रदिू ण.- लाग ू जवजधयों के ऄनुपालन म ें वाहन प्रदिू ण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधन अदद के ईपयोग के जलए प्रयास दकए जाएंगे। (16) औद्योजगक इकाआया.ं - (i) राजपत्र म ें आस ऄजधसूचना के प्रकािन पर या ईसके पश्चात ् पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजू ित ईद्योगों की स्ट्थापना की ऄनज्ञु ा नह, दी जाएगी; (ii) केन्रीय प्रदिू ण जनयंत्रण बोडा द्वारा फरवरी, 2016 म ें जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों म ें ईद्योगों के वगीकरण के ऄनुसार, जब तक ऄजधसूचना म ें आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदिू णकारी ईद्योगों को बढ़ावा ददया जाएगा। (17) पहाडी ढलानों को सरं ्ण.- पहाडी ढलानों का संर्ण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाडी ढलानों पर ्ेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनज्ञु ा नह, दी जाएगी; (ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनज्ञु ा नह, दी जाएगी। 4. पाररजस्ट्थजतकी संवदे ी जोन म ें प्रजतजिद्ध और जवजनयजमत दकए जान े वाल े दक्रयाकलापों की सूची.- पाररजस्ट्थजतकी संवेदी जोन म ें सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगता तटीय जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लाग ू जवजधयों के जजसमें वन (संर्ण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संर्ण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत ह ैं और दकये गये संिोधनों द्वारा िाजसत होंगे और नीचे दी गइ सारणी म ें जवजनर्ददष्ट रीजत म ेंजवजनयजमत होंगे, ऄथाात ्:- सारणी क्रम स.ं दक्रयाकलाप वणना (1) (2) (3) क. प्रजतजिद्ध दक्रयाकलाप 1. वाजणजज्यक खनन, पत्थर बनाम भारत संघ के मामल े म ें माननीय ईच्चतम न्यायालय के अदेि 4 ऄगस्ट्त, 2006 और 2012 की ररट याजचका (जसजवल) स.ं 435 म ें गोवा फाईंडेिन बनाम भारत संघ के मामले म ें तारीख 21 ऄप्रलै , 2014 के अदिे के8 THE की प्रदिू णकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नह, होगी: स्ट्थापना। परन्तु, केन्रीय प्रदिू ण जनयंत्रण बोडा द्वारा फरवरी, 2016 म ें जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों म ें ईद्योगों के वगीकरण के ऄनसु ार, जब तक ऄजधसूचना म ें ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गैर- प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि गैर-प्रदिू णकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा। 3. बृहत जल जवद्युत पररयोजना की प्रजतजिद्ध। स्ट्थापना । 4. दकसी पररसंकटमय पदाथ ा का प्रजतजिद्ध। ईपयोग या ईत्पादन या प्रसंस्ट्करण। 5. प्राकृजतक जल जनकायों या ्ेत्र प्रजतजिद्ध। भूजम म ें ऄनुपचाररत बजहस्रााव का जनस्ट्सारण । 6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ अरा जमलों की स्ट्थापना और जवद्यमान अरा जमलों का जवस् तार ऄनज्ञु ात नह, होगा। 7. ईंट भट्टों की ऄनुज्ञात नह, दकया जाएगा: परंत,ु संरज्त ्त्रे की सीमा स े एक दकलोमीटर के परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनम ें स,े जो भी जनकट हो सभी नए पयाटन दक्रयाकलाप या जवद्यमान दक्रयाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लागू मागदा िी जसद्धांतों के ऄनुरुप होगा। 11. संजनमााण दक्रयाकलाप। (क) संरज्त ्ेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो, दकसी भी प्रकार के नय ेवाजणजज्यक संजनमााण की ऄनुज्ञा नह, होगी: परंतु स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करन े के जलए, पैरा 3 के ईप पैरा (1) म ें सूचीबद्ध ईद्योगों से संबंजधत संजनमााण दक्रयाकलाप लागू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनसु ार स्म प्राजधकारी की पूवा ऄनुमजत से जवजनयजमत दकए जाएगं े और वे न्यूनतम होंगे। (ख) एक दकलोमीटर ्ेत्र स े परे य े अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे। 12. प्रदिू ण ईत्प्न न करन े वाले लघ ु फरवरी, 2016 में केन्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जारी ईद्योगों ईद्योग। में वगीकरण के ऄनुसार समय-समय पर यथा संिोजधत प्राजधकारी द्वारा ऄनुज्ञात होंगे। 13. वृ्ों की कटाइ। (क) राज्य सरकार म ें स्म प्राजधकारी की पूवा ऄनुज्ञा के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों म ें वृ्ों की कटाइ नह, होगी । (ख) वृ्ों की कटाइ संबंजधत केंरीय या राज्य ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होग े । 14. वन ईत्पादों या गैर काष् वन लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । ईत्पादों का संग्रहण । 15. होंगे । संर्ण । 20. राजत्र म ें याजनक यातायात का लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत संचलन । होंगे । 21. स्ट्थानीय समुदायों द्वारा चल रही स्ट्थानीय लोगों के ईपयोग के जलए लागू ें ईपचाररत ऄपजिष्ट जल या बजहस्रााव के ्त्रे म ें पुनःचक्रण/प्रवाह में जनस्ट्सारण से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के ईपचाररत बजहस्रााव का जनस्ट्तारण । पुन:चक्रण और पुन:ईपयोग के जलए प्रयास दकए जाएंगे। ऄन्यथा लाग ू जवजधयों के ऄनुसार ईपचाररत बजहस्रााव के पुनचक्रा ण या प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा। 24. सतही और भूजल का वाजणजज्यक लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । जनष्किाण । 25. Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 3876 (E), dated the 27thOctober, 2020 inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said draft notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 28thOctober, 2020; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the said draft notification; AND WHEREAS,the Gamgul-Siyabehi Wildlife Sanctuary is located in Salooni sub-division of Chamba district and falls under the administrative control of Wildlife Division Chamba in the State of Himachal Pradesh. This Sanctuary was originally notified as Game Sanctuary vide notification No.ft.-1/48, dated the 1st July 1949 and the rules and regulations had been framed under the Indian Forest Act, 1927 and Punjab Wildlife Preservation Act, 1959. The area was further declared as Wildlife Sanctuary under Wildlife (Protection) Act, 1972 vide No. 5-11/70-SF, dated the 27th March, 1974 and the latest notification after rationalisation was issued vide no. FFE-B-F (6)-11/2005- II, dated the 7th June, 2013; AND WHEREAS, the Gamgul Siyabehi Wildlife Sanctuary is situated between 320 47‘52‖ N to 320 55‘ 67‖ N Latitudes and 75047‘88‖ E to 75058‘44‖ E Longitudes which falls on Survey of India toposheet No.43P/13 Scale1:50,000. The Gamgul Siyabehi Wildlife Sanctuary is located in Saloni sub-division of Chamba district and falls under the administrative control of Wildlife Division Chamba. The total area of the Protected Area is 108.40 square kilometers; AND WHEREAS, the Sanctuary is located in the catchment of Siul nala, (a tributary of Ravi River) away from habitation and in the remote area. Thus the significance can be attributed to the ideal habitat of the Sanctuary, which harbors flora species such as deodara (Cedrus deodara), kail (Pinus wallichiana), spruce (Picea smithiana), silver fir (Abies pindrow), ban (Quercus semicarpofolia), pink burans (Rhododendron campanulatum), etc; AND WHEREAS, major fauna available from the Sanctuary are musk deer (Moschusmoschieferus), leopard cat (Prionailurus bengalensis), common leopard (Panthera pardus), black bear(Ursus thibetanus),Himalayan goral (Naemorhedus goral),yellow throated marten (Martes flavigula), red fox (Vulpes vulpus), koklash (Pucrasia macrolopha), kaleej (Lophura leucomelanos), chakor (Alectoris chukar), etc. There is a good interface of wooded areas and vast expenses of pastures that forms an ideal habitat for animals as well as birds; AND WHEREAS, the composition of the forest crop varies with altitude and aspect. The high altitude conifers like deodar, kail, fir and spruce in pure and mixed forms along with broad leaved species are growing in the temperate zone in the lower elevation. The kail is predominant in the southern aspect whereas deodar, fir and spruce are occupying the cooler locations. The pastures and rocky cliffs exist in the alpine zone. Bio-geographically, the area of the Sanctuary falls in the Trans - Himalayan zone; AND WHEREAS,Gamgul Siyabehi Wildlife Sanctuaryis surrounded by Churah forest Division of Himachal Pradesh from one side and state of Jammu and Kashmir on the another side. The area of Churah forest Division adjoining to the sanctuary is having thirty-two villages while the area of Jammu and Kashmir adjoining to the Sanctuary is having high mountain peaks,snow bound and free from habitation. Hence, Eco sensitive Zone comprising of 28.90 square kilometers (area of Churah Forest Division) having width of one kilometer from the boundary of the Sanctuary is proposed; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries ofGamgul- Siyabehi Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act)read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 3.3 kilometre around the boundary of Gamgul-Siyabehi Wildlife Sanctuary, in Chamba district in the State of Himachal Pradesh as the[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 19 Eco-sensitive Zone (hereafterin this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1)The Eco-sensitive Zone shall be to an extent of zero to 3.3 kilometre around the boundary of Gamgul-Siyabehi Wildlife Sanctuary and the area of the Eco-sensitive Zone is 28.90 square kilometres. Zero extent of the Eco-sensitive Zone was justified by the State as ―the boundary of the Wildlife Sanctuary is co-terminus with the boundary of the Jammu and Kashmir on the North-Eastern and North-Western side. Hence, no Eco-sensitive Zone has been proposed in these directions”. (2) The boundary description of the Gamgul-Siyabehi Wildlife Sanctuaryand its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Gamgul-Siyabehi Wildlife Sanctuary demarcating the Eco-sensitive Zone along with the boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure- IIC. (4) The list of geo-coordinates of the boundary of Gamgul-Siyabehi Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 1. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Himachal Pradesh State Pollution Control Board; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities‘ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified herein above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 21 (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 made under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.-Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed of in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale non polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority. 13. Felling of trees. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification. -For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. Member; (viii) Divisional Forest Officer (Wildlife), Chamba Member-Secretary. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders of Court and Tribunal.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon‘ble Supreme Court of India or High Court or the National Green Tribunal.
