असाधारण, भाग II, खडं 3, उपखंड (ii) में एक प्रारूप अजधसूचना प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और िबदक, उि रािपत्र अजधसूचना की प्रजतर्ां िनसाधारण को तारीख 30 दिसंबर, 2024 को संरक्षण और सुरक्षा के जलए, पाका की पररजध म ें मानविजनत िबाव की सीमा को जवजनर्जमत दकर्ा िाना चाजहए सर्ोंदक इस नािुक पाररजस्ट्थजतकी तंत्र स ेसिे तत्काल क्षत्रे पाररजस्ट्थजतकी संवेिी िोन ह ैऔर इस संरजक्षत क्षत्रे पर बहुत अजधक प्रभाव डालता ह;ै और िबदक, मुखर् निी सप्तमुखी निी के उत्तरी, पूवी और पजिमी दकनारों तथा िजक्षणी दकनारे बगं ाल की खाडी स े जिरे होन े के कारण इसकी गजतिील प्रकृजत उद्यान के वन्र्िीवों पर सीधा प्रभाव पडता ह;ै और िबदक, लोजथर्न द्वीप वन्र्िीव अभर्ारण्र् की सीमाओं के आसपास के क्षत्रे को संरजक्षत और सुरजक्षत रखना आवश्र्क ह,ै जिसे परै ा 1 म ें पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव जवजवधता के िजृ ष्टकोण स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें जवजनर्िाष्ट दकर्ा गर्ा ह ै और उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगा और उनके संचालन और प्रदक्रर्ाओं को प्रजतजिद्ध करना आवश्र्क ह;ै अब, अतः केन्रीर् सरकार पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के उपखंड (v) और उपखंड[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (xiv) तथा उपधारा (3) (जिसे इसमें इसके पिात ् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, पजिमी बंगाल राज्र् के िजक्षण 24 परगना जिले म ेंलोजथर्न द्वीप वन्र्िीव अभर्ारण्र् की सीमा स े1.0 दकलोमीिर स े 2.0 दकलोमीिर तक के क्षत्रे को लोजथर्न द्वीप वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिस े इसम ें इसके पिात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसके ब्र्ौरे जनम्नानसु ार ह,ैं अथाता ्:- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाएं- (1) पाररजस्ट्थजतकी संवेिी िोन लोजथर्न द्वीप वन्र्िीव अभर्ारण्र् की सीमा स े1.0 दकलोमीिर स े2.0 दकलोमीिर तक की सीमा तक होगा और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रिल लगभग 49.13 वग ा दकलोमीिर ह।ै (2) लोजथर्न द्वीप वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संविे ी िोन का सीमा जववरण उपाबधं -I के रूप म ें सलं ग्न ह।ै (3) लोजथर्न द्वीप वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संविे ी िोन के मानजचत्र उपाबधं - II क और उपाबधं - II ख के रूप म ें सलं ग्न ह।ैं (4) लोजथर्न द्वीप वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा पर भू-जनिेिांक की सूची उपाबधं -III के रूप में सलं ग्न ह।ै (5) कोई भी रािस्ट्व गांव पाररजस्ट्थजतकी संवेिी िोन के भीतर जस्ट्थत नहीं ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना – (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख स े िो वि ा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा स े और इस अजधसूचना म ें दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी जिस पर राज्र् सरकार म ेंसक्षम प्राजधकारी का अनुमोिन प्राप्त करना होगा। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िाष् ि रीजत स े तथा सुसंगत केंरीर् और राज्र् जवजधर्ों के अनुरूप और केन्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) इस आंचजलक महार्ोिना को राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ा स े तैर्ार दकर्ा िाएगा जिससे दक उि महार्ोिना में पाररजस्ट्थजतकी और पर्ाावरण सम्बंधी जविर्ों को सजम्मजलत दकर्ा िा सके, अथाात:् - (i) वन; (ii) पर्ाावरण; (iii) कृजि; (iv) मत्स्ट्र्-पालन; (v) पर्ािन; (vi) लसंचाई एवं िलमाग;ा (vii) आपिा प्रबधं न और नागररक सरु क्षा; (viii) अंतिेिीर् िलमागा जवभाग, पजिमी बंगाल सरकार; (ix) पंचार्त और ग्रामीण जवकास; (x) सुंिरबन मामले।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) िब तक इस अजधसूचना म ेंजवजनर्िाष्ट न हो, आंचजलक महार्ोिना म ेंजवद्यामान अनुमोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबधं न नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना म ेंसभी अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्ह ेअजधक कारगर और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) इस आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐस े अन्र् सन्िभो के जलए उपबंध दकर् े िार्ेंगे जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) इस आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट्थ लों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस्ट् मों, कृजि क्षेत्रों, उद्यानों एव ंउद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और प्रस्ट्ताजवत भू-उपर्ोग की जविेिताओं का ब्र्ौरा भी दिर्ा िाएगा। (7) इस आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और परै ा 4 की सारणी में र्थासूचीबद्ध प्रजतजिद्ध, जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा और इसमें स्ट्थ ानीर् िनता की आिीजवका की सरु क्षा के जलए पाररजस्ट्थजतकी-अनकु ूल जवकास का भी सुजनिर्न एव ं संवधान दकर्ा िाएगा। (8) र्ह आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी। (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि का काम करेगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके। (10) आंचजलक महार्ोिना की तैर्ारी और अनुमोिन लंजबत रहते हुए, कोई नर्ा जवकासात्मक दक्रर्ाकलाप उप-पैरा (1) और (2) के पैरा 6 में जवजनर्िाष्ट उपबंधों द्वारा िाजसत होंगे। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार् - राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, र्था :- (1) भउू पर्ोग- – पाररजस्ट्थजतकी संवेिी िोन में वनों, बागवानी क्षत्रे ों, कृजि क्षेत्रों, मनोरंिन के जलए अजभज्ञात उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा इसके संपररवतान की अनुमजत नही होगी: परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर उपरोसत म ेंजवजनर्िाष्ट प्रर्ोिन स े जभन्न दकसी अन्र् प्रर्ोिन के जलए कृजि और अन्र् भूजम के संपररवतान को जनगरानी सजमजत की जसिाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार सक्षम प्राजधकारी के पूवा अनुमोिन स े स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करने और जनम्न जलजखत दक्रर्ाकलापों के जलए अनुमजत िी िा सकेगी :- (i) ति जस्ट्थरीकरण र्ा सुरक्षा संरचना एव ं उपार्; (ii) जवद्यमान सडकों र्ा िािों का चौडीकरण और सुिढृ ीकरण और पलु , पुजलर्ा आदि सजहत नई सडक, िाि का संजनमााण; (iii) निी की ड्रेलिगं और िलमागों की ड्रेलिंग; (iv) सामाजिक रूप स े वांिनीर् सावािजनक अवसंरचना, जबिली, पेर्िल, लसंचाई और अन्र् आधारभूत नागररक सुजवधाओं का संजनमााण और नवीनीकरण; (v) लोगों को प्राकृजतक आपिा अथाात चक्रवात, तूफान, आदि स े बचाने के जलए आपिा आश्रर् और संबंजधत कार्ों का जनमााण और नवीनीकरण; (vi) सीजमत प्रििू ण उत्पन्न करने वाले लि ु उद्योग;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (vii) ग्रामीण कारीगरों सजहत कुिीर उद्योग; आदि (viii) गृह वास सजहत पाररजस्ट्थजतकी-पर्ािन म ेंसहार्क स्ट्थानीर् सुजवधाएं; (ix) सुरक्षा बलों के जिजवर र्ा गश्त जिजवरों का संजनमााण एव ं नवीनीकरण, और (x) पैरा 4 म ेंउजल्लजखत संवर्धात दक्रर्ाकलापः परंत ुर्ह और दक क्षेत्रीर् नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन् र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एव ं संजवधान के अनुच्िेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी। परंतु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के अंतगात आन ेवाली भूजम के अजभलेखों में हुई दकसी त्रुरि को, जनगरानी सजमजत के जवचार प्राप्त करन े के पिात्, राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िा सकेगा और उि त्रुरि को सुधारे िाने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंतु र्ह भी दक उपर्ुाि त्रुरि के संिोधन में इस उप-परै ा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा : परंतु र्ह भी दक हररत क्षत्रे , िसै े वन क्षत्रे और कृजि क्षत्रे म ें कोई पररणामी कमी नहीं होगी और वनीकरण और पर्ाावास पुनबाहाली दक्रर्ालापों के साथ अप्रर्ुसत र्ा अनुत्प ािक कृजि क्षत्रे ों म ें पुन: वनीकरण करने के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत - सभी प्राकृजतक झरनों के िल-स्रोतों की पहचान की िाएगी और उनके संरक्षण और पुनरुद्धार की र्ोिनाओं को आंचजलक महार्ोिना म ें सजम्मजलत दकर्ा िाएगा और राज्र् सरकार द्वारा इस रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंग े दक इन क्षेत्रों म ें र्ा इनके जनकि ऐसी जवकास दक्रर्ाकलापों को प्रजतजिद्ध दकर्ा िा सके िो इन क्षेत्रों के जलए हाजनकारक ह।ैं (3) पर्िा न र्ा पाररजस्ट्थजतकी पर्िा न – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ािन दक्रर्ाकलाप र्ा जवद्यमान पर्ािन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ािन महार्ोिना के अनुसार होगा। (ख) पर्ािन महार्ोिना, राज्र् के पर्ाावरण और वन जवभागों के परामिा से राज्र् के पर्ािन जवभाग द्वारा बनार्ी िाएगी; (ग) पर्ािन महार्ोिना, आंचजलक महार्ोिना का ििक होगी; (ि) पर्ािन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी; (ङ) पाररजस्ट्थजतकी पर्ािन संबंधी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) वन् र्िीव अभर्ारण्र् की सीमा से एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें से िो भी अजधक जनकि हो, दकसी होिल र्ा ररिॉिा के नए सजं नमााण को अनुमत नहीं दकर्ा िाएगा: परंतु र्ह दक, इस संरजक्षत क्षेत्र की सीमा रेखा से एक दकलोमीिर की िरू ी से परे और पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, दकसी नर् ेहोिल और ररिॉिा के सजं नमााण की कोई भी अनुमजत पर्ािन महार्ोिना के अनुसार पाररजस्ट्थतकी पर्ािन सुजवधाओं के जलए केवल पूव ा पररभाजित और अजभजहत क्षेत्रों म ेंिी िाएगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्िर सभी नए पर्ािन दक्रर्ाकलापों र्ा जवद्यमान पर्िा न दक्रर्ाकलापों का जवस्ट्तार, केन्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थतकी पर्ािन, पाररजस्ट्थतकी जिक्षा और पाररजस्ट्थतकी जवकास पर बल िेने वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थतकी पर्ािन संबंधी मागाििाक जसद्धांतों के अनुसार होगा; (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ािन के जवकास और जवद्यमान पर्ािन दक्रर्ाकलापों के जवस्ट्तार की कोई भी अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों के द्वारा ही िी िाएगी िो6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दक जनगरानी सजमजत की वास्ट् तजवक स्ट्थल जवजिष्ट वास्ट्तजवक िांच और संस्ट् तुजत पर आधाररत होगी और पाररजस्ट्थजतकी संवेिी िोन म ेंदकसी नए होिल, ररिॉिा र्ा वाजणजज्र्क स्ट्थापना के जनमाणा की अनुमजत नहीं होगी। (4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अधीन आन ेवाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररजव ा क्षत्रे , िलै सरं चना, िल प्रपात, झरने, िरे, उपवन, गुिाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रििू ण – पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रििू ण की रोकथाम और जनर्ंत्रण पर्ाावरण अजधजनर्म के अधीन बनाए गए ध् वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार दकर्ा िाएंगा। (7) वार् ु प्रििू ण - पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रििू ण का जनवारण और जनर्ंत्रण, वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण अजधजनर्म और इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण - पाररजस्ट्थजतकी संवेिी िोन म ें िोजधत बजहस्राव का जनस्ट्सरण, िल (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण अजधजनर्म, और इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (9) ठोस अपजिष्ट - ठोस अपजिष्ट का जनपिान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा, - (क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट का जनपिान और प्रबंधन भारत सरकार द्वारा पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की अजधसूचना स. ं का.आ. 1357(अ), तारीख 08 अप्रैल, 2016 के अधीन प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथों का जनपिान पाररजस्ट्थजतकी संवेिी िोन स ेबाहर अजभज्ञात दकए गए स्ट्थान पर पर्ाावरण स्ट् वीकार्ा रीजत से दकर्ा िाएगा; (ख) स्ट् थानीर् प्राजधकरण, ठोस अपजिष्ि ों का िैवअवक्रमणीर् और गैर िैवअवक्रमणीर् संििकों म ें पृथसक रण करने के जलए र्ोिनाएं बनाएगं े; (ग) िैवअक्रमणीर् सामग्री का पनु चक्रा ण अजधमानतः कम्पोलस्ट्िंग र्ा वमीकल्चर के माध्र्म स ेदकर्ा िाएगा; (ि) अिैजवक सामग्री का जनपिान पाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात स्ट्थलों म ेंपर्ाावरणीर् स्ट्वीकार्ा रीजत स े दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्टों को िलान े र्ा भस्ट्मीकरण की अनुमजत नहीं होगी। (10) िवै जचदकत्सा अपजिष्ट- िैव जचदकत्सा अपजिष्ि का प्रबंधन जनम्नानुसार दकर्ा िाएगा,- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपिान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसचू ना स.ं सा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के अधीन प्रकाजित िैव- जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनकु ूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) प्लाजस्ट्िक अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्िक अपजिष्ट का प्रबधं न, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा अजधसूचना स.ं सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के अधीन प्रकाजित प्लाजस्ट्िक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) सजं नमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन म ें संजनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा अजधसूचना स.ं सा.का.जन 317(अ), तारीख 29 माच,ा 2016 के अधीन प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सडक-र्ातार्ात - सडक-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध िाजमल दकए िाएंगे और आंचजलक महार्ोिना के तर्ै ार होने और राज्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होने तक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रििू ण - वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लाग ूजवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्ितर ईधनों के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा ं- (क) रािपत्र म ेंइस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रििू णकारी उद्योग की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा िरवरी, 2016 म ेंिारी मागाििी जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििू णकारी कुिीर उद्योगों को बढावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण - पहाडी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििार्ा ा िाएगा जिनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनज्ञु ा नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंप्रजतजिद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचू ी - पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म एव ं पर्ाावरणीर् समािात जनधारा ण अजधसूचना (ईआईए), 2006 सजहत उसके अधीन बनाए गए जनर्मों तथा वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजहत अन्र् लाग ू जवजधर्ों के उपबंधों अनुसार िाजसत होंग े और नीच े िी गई सारणी म ें जवजनर्िाष्ट रीजत स े जवजनर्जमत होंग,े र्था :- सारणी क्र.स ं. दक्रर्ाकलाप रिप्पणी क. प्रजतजिद्ध जथरुमलु पाि बनाम र्ूओआई के डब्ल्र्.ू पी.(सी) संखर्ा 202/1995 के मामल ेम;ें तारीख 21 अप्रैल, 2014 के आिेि (आिेिों) के अनुसार गोवा िाउंडेिन बनाम र्ूओआई के डब्ल्र्.ू पी.(सी) संखर्ा 435/2012 के मामल े म ें दिए गए थ;े और आईए संखर्ा 1000/2003 दिनांक 03 िून, 2022 और उसके बाि आईए संखर्ा 131377/2022 जनणार् तारीख 26 अप्रैल, 2023 और 28 अप्रलै , 2023, माननीर् उच्चतम न्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के र्ा उत्पन्न करन े वाल े उद्योगों की स्ट्थापना। उसके जवस्ट्तार की अनुमजत नहीं िी िाएगी। जवद्यमान उद्योगों द्वारा प्रििू ण जनवारण प्रौद्योजगदकर्ां और ध्वजन अवरोधक संस्ट्थाजपत दकए िाने चाजहए। 3. बडी िल जवद्युत पररर्ोिनाओं की प्रजतजिद्ध। स्ट्थापना। 4. दकसी पररसंकिमर् पिाथा का प्रर्ोग र्ा प्रजतजिद्ध। उत्पािन र्ा प्रस्ट्संकरण। 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षत्रे म ें प्रजतजिद्ध। अिोजधत बजहस्रावों का जनस्ट्सरण। 6. नई सॉ जमलों की स्ट्थ ापना । पाररजस्ट्थजतकी संवेिी िोन के भीतर नई र्ा जवद्यमान सॉ जमलों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। 7. ईंि भट्टों की स्ट्थापना। प्रजतजिद्ध। 8. पॉलीथीन बैग और प्लाजस्ट्िक का प्रर्ोग। पर्ािन कार्ाकलाप के जलए प्रजतजिद्ध। अन्र् वाजणजज्र्क प्रजतष्ठान के जलए 50 माइक्रोन से कम आकार का प्लाजस्ट्िक प्रजतजिद्ध रहगे ा। 9. िलावन लकडी का वाजणजज्र्क उपर्ोग। प्रजतजिद्ध। 10. सतही एवं भूिल का वाजणजज्र्क प्रजतजिद्ध। जनष्किाण। 11. जविेिी प्रिाजतर्ों को लाना। प्रजतजिद्ध। 12. ठोस अपजिष्ट िोधन सुजवधा की स्ट् थापना (क) पाररजस्ट्थजतकी संवेिी िोन में िैव-अवक्रमणीर् ठोस अपजिष्ट का जनपिान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा तारीख 08 अप्रलै , 2016 की अजधसूचना संखर्ा का.आ. 1357 (अ) द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा; अिैजवक सामग्री का जनपिान पाररजस्ट्थजतकी संवेिी िोन के बाहर जचजन्हत स्ट्थल पर पर्ाावरण की िजृ ष्ट से स्ट्वीकार्ा रीजत से दकर्ा िा सकता ह।ै (ख) पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी ठोस अपजिष्ट को पाररजस्ट्थजतकी संवेिी िोन के भीतर िोजधत र्ा प्रसंस्ट्कृत करने की अनुमजत नहीं िी िाएगी। 13. िैव-जचदकत्सा अपजिष्ट की िोधन (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव-जचदकत् सा अपजिष्ट का सुजवधा की स्ट्थापना जनपिान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की तारीख 28 माच,ा 2016 की अजधसूचना संखर्ा सा.का.जन. 343(अ) द्वारा प्रकाजित िैव-जचदकत् सा अपजिष्ट प्रबंधन, जनर्म, 2016 के अनुसार दकर्ा िाएगा। पाररजस्ट्थजतकी संवेिी जोन के भीतर कोई िैव-जचदकत् सा अपजिष्ट िोधन सुजवधा जस्ट्थत नहीं होगी। (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर िैव-जचदकत्सा इकाइर्ों से उत् सर्िात सभी अपजिष्ि को िोधन और जनपिान के जलए पाररजस्ट्थजतकी संवेिी िोन के बाहर ल े िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी िैव-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 जचदकत्सा अपजिष्ट का पाररजस्ट्थजतकी संवेिी िोन के अंिर हथालन, प्रसस्ट्ं करण र्ा िोधन करन े की अनुमजत नहीं िी िाएगी। 14. प्लाजस्ट्िक अपजिष्ट की िोधन सुजवधा की (क) पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्िक अपजिष्ट का प्रबंधन, स्ट्थापना। भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा तारीख 18 माचा, 2016 की अजधसूचना संखर्ा सा.का.जन. 340(अ) के अधीन प्रकाजित प्लाजस्ट्िक अपजिष्ट प्रबंधन जनर्म, 2016, के उपबधं ों के अनुसार दकर्ा िाएगा। आंचजलक महार्ोिना म ें अजतररि स्ट्थ ान-जवजिष्ट प्रजतबंध जवजहत दकए िा सकत ेह।ैं पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई भी प्लाजस्ट्िक अपजिष्ट िोधन सुजवधा जस्ट्थत नहीं होनी चाजहए। (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर उत् सर्िात सभी प्लाजस्ट्िक अपजिष्ि को ईएसिेड के बाहर ल े िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी प्लाजस्ट्िक अपजिष्ि का पाररजस्ट्थजतकी संवेिी िोन के अंिर हथालन, प्रसस्ट्ं करण र्ा िोधन करन े की अनुमजत नहीं िी िाएगी। 15. ई-अपजिष्ट की िोधन सुजवधा की (क) पाररजस्ट्थजतकी संवेिी िोन म ें ई-अपजिष्ि का प्रबंधन, भारत स्ट्थापना। सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित ई-अपजिष्ि प्रबधं न जनर्म, 2016, के उपबंधों के अनुसार दकर्ा िाएगा। आंचजलक महार्ोिना म ें जवजिष्टताएं और अजतररि स्ट्थ ान-जवजिष्ट प्रजतबंध जनधााररत दकए िा सकते ह।ैं पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई ई-अपजिष्ि िोधन सुजवधा जस्ट्थत नहीं होनी चाजहए। (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर उत् सर्िात सभी ई- अपजिष्ट को ईएसिेड के बाहर ल े िार्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन के बाहर उत् सर्िात दकसी भी ई- अपजिष्ट का पाररजस्ट्थजतकी सवं ेिी िोन के अंिर हथालन, प्रसंस्ट् करण र्ा िोधन करने की अनुमजत नहीं िी िाएगी। ख. जवजनर्जमत दक्रर्ाकलाप 16. होिलों और ररजॉिों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ािन दक्रर्ाकलापों हते ु लि ुअस्ट्थार्ी संरचनाओं के स्ट्थापना। जनमााण के जसवार्, सरं जक्षत क्षत्रे की सीमा स े एक दकलोमीिर के करने की अनुज्ञा होगी। 17. जनमााण दक्रर्ाकलाप। (क) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीिर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, िो भी जनकि हो, दकसी भी प्रकार के वाजणजज्र्क जनमाणा को पैमान े के और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन की िेिि सामग्री स ेउत्पािों का उत् पािन करन ेवाल ेकृजि आधाररत उद्योग को अनुमजत होगी। 19. वृक्षों की किाई। (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की किाई नहीं की िा सकेगी। (ख) वृक्षों की किाई संबंजधत केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी। 20. वन उत्पािों और गैर काष्ठ वन उत्पािों लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (एनिीएिपी) का सग्रं हण। 21. जवद्युत और संचार िॉवर लगाने, It is bounded by the Saptamukhi River in northern, eastern and western sides and the Bay of Bengal from the southern side; AND WHEREAS Lothian Island Wildlife Sanctuary is a part of the Sundarbans, which is the largest single chunk of deltaic mangrove forest and provides shelter to animals of schedule - I of the Wildlife Protection Act, 1972 which includes the Gangetic Dolphin (Platinista gangetica), Water Monitor Lizard (Varanus salvator), etc.; AND WHEREAS Lothian Island Wildlife Sanctuary supports a number of faunal species specified under the Red Data Book of the International Union for Conservation of Nature that inter alia includes Fishing Cat (Felis viverrina Bennett), Estuarine otter (Lutra lutra), Bengal Monitor Lizard (Varanus18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] bengalis), Estuarine Crocodile (Crocodylus porosus), Olive Ridley Turtle (Lepidochelys olivacea), Civet Cat (Vivera zibetha), Jacal (Coins aureus), Irrawaddy Dolphin (Oracella brevirostris), Indian Python (Python molurus), Rhesus macaque (Macaca speciosa), Chital (Axix axix), Wild pig (Sus scrofa) etc.; AND WHEREAS Lothian Island Wildlife Sanctuary is a paradise for birds such as Fulvous Breasted Woodpecker (Dendrocopos macei), Stripe Breasted Woodpecker (Dendrocopos atratus), Blackrumped Flameback (Dinopium benghalense), Blue Throated Barbet (Psilopogon asiaticus), Stork billed Kingfisher (Pelargopsis capensis), White Throated Kingfisher (Halcyon smyrnensis), Yellow Wagtail (Motacilla flava), Black Redstart (Phoenicurus ochruros), Tickell's Flowerpecker (Dicaeum erythrorhynchos), Paradise Flycatcher (Terpsiphone), Ashy Swallow Shrike (Artamus fuscus), Long-tailed Nightjar (Caprimulgus climacurus), Swamp Patridge (Resident) (Francolinus gularis), Eurasian Eagle Owl (Bubo bubo), Greyheaded Fish Eagle (Ichthyophaga ichthyaetus), Cotton pygmy goose (Nettapus Coromandelianus), Eurasian Wigeon (Anas Penelope), Lesser Whistling Teal (Dendrocygna javanica), White-eyed Pochard (Aythya nyroca) etc.; AND WHEREAS the fish species found in the area includes Ganges Shark (Glyphis gangeticus) , Hammer head Shark (Sphyrna blochi), Guitar fish (Rhinobatos annandalei), Hangar (Dasyatis sephors), Butter Fish (Stromateus sinensis), Silver Pomfret ( Pampus chirensis), Bengal Tongue Fish (Cynoglossus cynoglossus), Gangetic Hairfin Anchovy (Setipinna phasa (Hamilton), Mottled Eel (Anguilla bengalensis), Blackfin Sea Cat Fish (Arius jella), Spot Tail Needle Fish (Strongylura strongylura), Kalagachhi Bhagone (Liza tade (Forsskal), Chanda ( Etroplus suratensis (Bloch) etc.; AND WHEREAS Lothian Island Wildlife Sanctuary is having the wide bio-diversities of floral species. The floral species recorded from the area includes Harguza (Acanthus ilicifolius L) , Lata Harguza (A.volubilis), Tora (Aegialitis rotundifolia), Khalsi (Aegiceras carniculatum), Piara Baen (Avicennia alba (Blume), Kala Baen (A. marina), Jat Baen (A. officinalis), Amur (Aglaie cuculata), Hodo (Acrostichum aureum), Bakul (Brugruiera cylindrical), Kankra (B. gymnorhiza), Kankra (B. sexangula (Lour) Poirot), Lata Sundari (B. parviflora), Bakul (Brownlowia tersa (L)), Dakor (Cerbera manghas Geartn), Banjai (Clerodendrum inerme), Nate (Caesalpinia bunducella), Jhamti (Ceriops decandra), Math Goran (C. Tagal (Prrottet) C.S. Robinson ) , Singra Kalilata ( Cynometra iripa kostel ) , Dalbergia spinosa, Kalilata (D. heterophylia), Gila Entada scandens, Genwa (Excoecaria agollocha), Dudhilata (Finlaysonia obovata), Fimbristylis ferruginea, Garjan (Rhizophora apiculata Blume) etc.; AND WHEREAS for effective conservation and protection of floral and faunal biodiversity of Lothian Island Wildlife Sanctuary, the extent of anthropogenic pressure in the periphery of the park has to be regulated as the immediate area adjoining this fragile ecosystem is ecologically sensitive and exert great impact on this Protected Area; AND WHEREAS the dynamic nature of main river Saptamukhi River in northern, eastern and western sides and southern side is bounded by the Bay of Bengal has a direct impact on the wildlife in the park; AND WHEREAS it is necessary to conserve and protect the area, surrounding the boundaries of Lothian Island Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) (herein after referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 kilometer to 2.0 kilometers from the boundary of Lothian Island Wildlife Sanctuary in South 24 Parganas District, in the State of West Bengal as Lothian Island Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 1. Extent and boundaries of Eco-Sensitive Zone. - (1) The Eco-sensitive Zone shall be to an extent varying from 1.0 kilometer to 2.0 kilometers from the boundary of Lothian Island Wildlife Sanctuary and the area of the Eco-sensitive Zone is approximately 49.13 square kilometer. (2) The boundary description of the Eco-sensitive Zone of Lothian Island Wildlife Sanctuary is appended as Annexure-I. (3) The Maps of the Eco-sensitive Zone of Lothian Island Wildlife Sanctuary with geo-coordinates of the important points are appended as Annexure- II A and Annexure-II B. (4)The list of Geo-coordinates on the boundary of Lothian Island Wildlife Sanctuary and its Eco-sensitive zone is appended as Annexure- III. (5) No revenue villages are located within the Eco-sensitive Zone. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely: - (i) Forest; (ii) Environment; (iii) Agriculture; (iv) Fisheries; (v) Tourism; (vi) Irrigation and Waterways; (vii) Disaster Management and Civil defence; (viii) Inland Waterways Department, Government of West Bengal; (ix) Panchayats and Rural Development; (x) Sundarban Affairs. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified in sub-paragraph (1) and (2) of paragraph 6. 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use.– Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) bank stabilization or protection structure and measures; (ii) widening and strengthening of existing roads or jetty and construction of new road, jetty including bridges, culverts etc; (iii) river dredging and dredging of waterways; (iv) construction and renovation of socially desirable public infrastructure, electricity, drinking water, irrigation and other basic civic amenities; (v) construction and renovation of disaster shelter and related works to protect people from natural disaster viz. cyclone, storm, etc.; (vi) small scale industry with limited pollution potential; (vii) cottage industries including village artisans etc., (viii) local amenities supporting eco-tourism including home stay; (ix) construction and renovation of security forces camp and patrolling camps; (x) Promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 Provided also that there shall be no consequential reduction in green area, such as forest area and agriculture area and Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone: (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; (c) The Tourism Master Plan shall form a component of the Zonal Master Plan; (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone; (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendations of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco- sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.-The buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 made under the environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the Environment Act and the rules made under these Acts. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the Environment Act and the rules made under these Acts. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under, -22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (c) the biodegradable material shall be recycled preferably through composting or vermiculture; (d) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall he permitted in the Eco-sensitive Zone. (10) Bio-medical waste.– Bio-medical waste Management shall be as under. - (a) the Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016. (12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016. (13) E-waste. - The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, new polluting industries shall not be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under, - (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 4. List of activities prohibited or to be regulated within Eco-sensitive Zone- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and be regulated in the manner specified in the Table below, namely:- TABLE S. Establishment of Solid (a) The bio-degradable solid waste disposal and waste treatment facility. management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco- Sensitive Zone. (b) No solid waste generated outside the Eco-sensitive Zone will be allowed to be treated or processed within the Eco-sensitive Zone 13. Establishment of Bio- (a) The Bio-Medical Waste disposal in the Eco-sensitive Medical waste treatment Zone shall be carried out in accordance with the Bio- Facility. Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016. No Bio Medical Waste treatment facility shall be located within the Eco- sensitive Zone (b) All waste generated from bio-medical units within the Eco-sensitive Zone shall be taken outside the Eco- sensitive Zone for treatment and disposal. No Bio-medical waste generated outside the Eco-sensitive Zone will be allowed to be handled, processed or treated inside the Eco- sensitive Zone. 14. Establishment of Plastic (a) The Plastic waste management in the Eco-Sensitive waste treatment facility. Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. Additional site-specific restrictions may be prescribed in the Zonal Master Plan. No plastic waste treatment facility should be located inside the Eco- sensitive Zone (b) All plastic waste generated inside the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone. No plastic waste generated outside the Eco-sensitive Zone shalll be allowed to be handled, processed or treated inside the Eco-sensitive Zone . 15. Establishment of E-waste (a) The e-waste management in the Eco-Sensitive Zone waste treatment facility. shall be carried out as per the provisions of the e-waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, Specifications and additional site-specific restrictions may be prescribed in the Zonal Master Plan. No e-waste treatment facility should be located inside the Eco- sensitive Zone. (b) All e-waste generated inside the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone. No e-waste generated outside the Eco-sensitive Zone shall be allowed to be handled, processed or treated inside the Eco-sensitive Zone.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 B. Construction activities. (a) New commercial construction of any kind shall not be 17. permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. Monitoring Committee- For effective monitoring of the provisions of this notification, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. (v) A representative from Irrigation and Waterways Department, Member, ex officio; Government of West Bengal. (vi) A representative from Sundarban Affairs Department. Member, ex officio; (vii) A representative from West Bengal State Pollution Control Board. Member, ex officio; (vii) A representative from Fisheries Department. Member, ex officio; (viii) Representative of Panchayats and Rural Development Member, ex officio; Department, Government of West Bengal. (x) The Divisional Forest Officer, 24 Parganas (South) Division Member-Secretary ex officio. 6. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests published vide number S.O. 1533 (E), dated the 14th28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment Act against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-IV, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures: The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. [F.
