अजधसूचना प्रकाजित की गई थी, जिसम ें ऐसे सभी व्यजिर्ों स,े जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख स,े जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना अंतर्वाष्ट करन े वाली रािपत्र की प्रजतर्ां िनता को तारीख 22 माच,ा 2024 को उपलब्ध करा िी गई थी; और, उि प्रारुप अजधसूचना की बाबत व्यजिर्ों स ेप्राप्त आक्षेपों और सुझावों पर केंद्रीर् सरकार द्वारा जवचार दकर्ा गर्ा था; और, सुखना वन्र्िीव अभर्ारण्र्, सघं राज्र् क्षेत्र चंडीगढ़ के प्रिासजनक जनर्ंत्रण म ें आता ह ै और पंिाब और हररर्ाणा के साथ सीमा साझा करता ह।ै र्ह अभर्ारण्र् जिवाजलक तलहटी म ेंजस्ट्थत ह ैिो पाररजस्ट्थजतकी रूप से संवेिनिील और भौगोजलक रूप स े अजस्ट्थर ह।ै सुखना वन्र्िीव अभर्ारण्र् का कुल क्षेत्रफल 25.9849 वगा दकमी (6420.99 एकड़) ह।ै िेिांतर और अक्षांि के अनुसार स े र्ह (बाएँ - 76.810241पू, िाएँ - 76.888207 प,ू ऊपर - 30.809699 उ, नीचे - 30.742053 उ) के बीच जस्ट्थत ह।ै 7265 GI/2024 (1)2 THE पाररजस्ट्थजतक, िीव-िंतु, पुष्प, भू-आकृजत जवज्ञान, प्राकृजतक और भूवैज्ञाजनक महत्व के कारण, वन्र्िीवों और उनके आवास की रक्षा, प्रसार और जवकास के प्रर्ोिन स,े र्ह क्षेत्र चडं ीगढ़ प्रिासन की अजधसूचना संखर्ांक 694, एचआईआई (4)-98/4519 तारीख 6 माचा 1998 के द्वारा वन्र्िीव अभर्ारण्र् घोजषत दकर्ा गर्ा था; और, 2010 के िौरान भारतीर् वन्र्िीव संस्ट्थान, िेहरािनू के मागाििान में की गई वन्र्िीव गणना के अनुसार, वन्र्िीव (संरक्षण) अजधजनर्म 1972 की अनुसूची- I के अधीन सूचीबद्ध कई प्रिाजतर्ों के सुखना वन्र्िीव अभर्ारण्र् म ें पार्े िाने की बात कही गई ह।ै इनमें प्रमुख प्रिाजतर्ाँ ह:ैं- तेंिआु (पेंथरेा पाडास), सांभर (रूसा र्ूजनकलर), भारतीर् साल (मैजनस क्रैजसकाउडाटा), गोल्डन िैकाल (कैजनस ऑररर्स), इंजडर्न पीफॉवल (पावो दक्रस्ट्टेटस), ककंग कोबरा (ओदफर्ोफैगस हन्ना), अिगर/इंजडर्न रॉक पार्थन (पार्थन मोलुरस) और मॉजनटर जलिाडा (वरनस बेंगालेंजसस) । सुखना वन्र्िीव अभर्ारण्र् में मौिूि वन्र्िीव (संरक्षण) अजधजनर्म, 1972 के अधीन सूचीबद्ध अनुसूची- II प्रिाजतर्ों में रेड िंगल फाउल (गलै स गैलस), रसले वाइपर (िबोइर्ा रसेली) और ग्रे लगं ूर (सम्ने ोजपथेकस एंटेलस) सजम्मजलत ह;ैं और, इस अभर्ारण्र् में जवजभन्न प्रकार की जततजलर्ां और पतगं े भी पार्े िाते ह।ैं इस अभर्ारण्र् में िीमक एंजथल भी पार्े िाते ह ैंिो माइक्रोटर्मास और ओडोन्टोटर्मास िैसे िीमकों को आश्रर् िते े ह,ैं िो काबाजनक पिाथों के अपघटन के जलए आवश्र्क िीव ह।ैं क्षेत्र में मौििू खाद्य कवक में पफ बॉल्स (लाइकोपडान पुजसलम) और टर्माटोमाइसेस भी ह;ैं और, िैव-जवजवधता समृजद्ध की िजृ ष्ट स,े र्ह िन्तओंु की कई प्रिाजतर्ों का आवास ह ै जिसमें संकटग्रस्ट्त भारतीर् पैंगोजलन और नािुक सामान्र् तेन्िएु आते ह।ैं हालाँदक, इस क्षत्रे में कोई भी प्रिाजत गंभीर रूप से लुप्तप्रार् र्ा स्ट्थाजनक नहीं ह,ै दफर भी संरजक्षत क्षेत्र म ेंमौिूि अविेष िैव जवजवधता के जलए क्षेत्र का संरक्षण और सुरक्षा करना आवश्र्क है; और, अभर्ारण्र् में पड़े ों, झाजड़र्ों, पवातारोजहर्ों और िड़ी-बूरटर्ों की कई प्रिाजतर्ाँ ह,ैं इसके अलावा थलै ोफाइट्स, ब्रार्ोफाइट्स, टेररडोफाइट्स और लाइकेन की अच्छी संखर्ा ह।ै प्रमुख वृक्ष प्रिाजतर्ा ँ ह;ैं खैर (अकादकर्ा कैटेचु), आंवला (एजम्ब्लका ऑदफजसनाजलस), बहड़े ा (टर्मानजलर्ा बेजलररका), सेन (टर्मानजलर्ा अल्ता), कचनार (बौजहजनर्ा वेररएगाटा), फुलाई (अकादकर्ा मोडेस्ट्टा), कीकर (अकाजसर्ाजनलॉरटका), रोंझ (वचेजलर्ा ल्र्ूकोफ्लोआ), िीिम (डाल्बर्गार्ाजसस्ट्सू), छाल (एनोिीसस लैरटफोजलर्ा), नीम (अजादिराचटेजन्डका), सेमल (बॉम्बैक्सेइबा), ढाक (ब्र्ूटेमोनोस्ट्पमाा), कचनार (बौजहजनर्ा वेररएगाटा), िहतूत (मोरस अल्बा), पेपर िहततू (ब्रोसोनेरटर्ा मेजलफेरा) और जलरटल बी (एजपस फ्लोररर्ा) पार्ी िाती ह;ैं और, सुखना वन्र्िीव अभर्ारण्र् के सरं जक्षत क्षत्रे के आसपास इस अजधसूचना के पैरा 1 म ेंजवजनर्िाष्ट क्षत्रे के जवस्ट्तार और सीमा को पाररजस्ट्थजतक और पर्ाावरणीर् िजृष्टकोण से पाररजस्ट्थजतकी संवेिी िोन के रूप म ें संरजक्षत और सुरजक्षत करना और उद्योगों को प्रजतजसद्ध करना आवश्र्क ह ैर्ा उि पाररजस्ट्थजतकी संवेिी िोन म ेंउद्योगों की श्रेणी और उनके प्रचालन और उनकी प्रदक्रर्ाओं को भी प्रजतजसद्ध करना आवश्र्क ह;ै और, हररर्ाणा सरकार न े अपन े पत्र संखर्ांक 682, दिनांक 16 फरवरी, 2024 के माध्र्म से र्ह जवजनर्िाष्ट रूप स े कहा ह ै दक हररर्ाणा की ओर के सुखना झील अभर्ारण्र् के आसपास पाररजस्ट्थजतकी संवेिी िोन की घोषणा के जलए र्ह पंिाब और हररर्ाण उच्च न्र्ार्ालर् के तारीख 02 माच,ा 2020 के उस आिेि के अनरुु प ह ै िो उसने ररट र्ाजचका (सी) सं. 18253/2009 और 5809/2015 : न्र्ार्ालर् का स्ट्वर्ं का प्रस्ट्ताव बनाम चण्डीगढ़ प्रिासन और अन्र् सम्बद्ध जवषर् में दिर्ा ह।ै और, हररर्ाणा सरकार न े अपने पत्र संखर्ांक 682, तारीख 16 फरवरी, 2024 के द्वारा जवजनर्िाष्ट रूप स े कहा ह ै दक जनकटवती राज्र् पंिाब और सघं राज्र् क्षेत्र, चडं ीगढ़ को हररर्ाणा राज्र् द्वारा सुखना वन्र्िीव अभर्ारण्र् (हररर्ाणा की ओर) के आसपास पाररजस्ट्थजतकी संवेिी िोन जनधााररत करने पर कोई आपजत्त नहीं ह।ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे एतजश्मन् पश्चात पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खडं (xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, हररर्ाणा राज्र् के सुखना वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 1.0 दकलोमीटर स े 2.035 दकलोमीटर तक जवस्ट्तृत क्षत्रे को सुखना वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिसे इसम े इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका ब्र्ौरा, पर्ावा रण की गुणवत्ता म ेंसुधार तथा सुरक्षा, और पर्ाावरण प्रिषू ण के जनवारण, जनर्ंत्रण और उसके उपिमन के प्रर्ोिन के जलए पैरा 1 म ें जवजनर्िाष्ट ह,ै तथा जनम्नजलजखत उपार् दकए गए ह,ैं अथाात:् - 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.- (1) पाररजस्ट्थजतकी संवेिी िोन (ईएसिेड) साधारण तौर पर हररर्ाणा की ओर सुखना वन्र्िीव अभर्ारण्र् की सीमा स े 1 दकलो मीटर तक फैला हुआ ह।ै उत्तरी भाग में र्ह आरजक्षत वन म ें 2.0 दकमी तक और जवस्ट्ताररत हुआ ह।ै पूवी भाग पर, पाररजस्ट्थजतकी संवेिी िोन सीमा लगभग 1.0 दकलो मीटर ह,ै िो आरजक्षत वन की सीमा के साथ-साथ िाती ह।ै हालाँदक, इस े आरजक्षत वन की सीमा के साथ सह- जवस्ट्तारी बनाने के जलए िजक्षण-पूवी भाग का जवस्ट्तार दकर्ा गर्ा ह ैऔर इस पाररजस्ट्थजतकी संवेिी िोन का कुल क्षेत्रफल 24.60 वगा दकलोमीटर ह।ै (2) प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन के अंतगात िस गांव अथाात प्रेमपरु ा, सोखोमािरी, िामला, लोहगढ़, मानकपुर ठाकरिास, सूरिपुर, चंडीमंदिर कोटला, िरा ा खरौनी, रामपरु और सकेतरी और महािेवपुर आत े ह।ैं प्रस्ट्ताजवत कुल क्षेत्रफल 6078.98 एकड़ (2460.07 हक्े टेर्र) होगा और प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन म ें अन्र् बातों के साथ-साथ जनम्नजलजखत क्षत्रे िाजमल होंगे.- i) हररर्ाणा िहरी जवकास प्राजधकरण (एचएसवीपी) के अधीन आने वाल े सेक्टर 1, सेक्टर 2 का कुछ भाग और जिमखाना क्लब सजहत सेक्टर 3 ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ii) कुछ ट्यूबवले चैंबर, पैरा ग्लाइझडंग उद्यान और सेक्टर-1 एमडीसी के अधीन आने वाला क्षत्रे । iii) चंडीमंदिर छावनी के अधीन आने वाला क्षत्रे (सैन्र् स्ट्टेिन चंडीमंदिर की छोटे आर्धु ों की फार्ररंग रेंि, केंद्रीर् मृिा और िल संरक्षण अनुसंधान फामा सजहत क्षत्रे )। iv) नगर जनगम (एमसी), पंचकुला के अधीन आने वाल ेक्षेत्र का भाग। v) प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन म ेंआन ेवाले िस गांवों म ेंस ेिो गांव-सकेतरी और प्रेमपरु ा सुखना वन्र्िीव अभर्ारण्र् की सीमा स े 700 मीटर के िार्रे के भीतर आत े ह।ैं िबदक सकेतरी गांव के घर सुखना वन्र्िीव अभर्ारण्र् की सीमा पर जस्ट्थत ह,ैं प्रेमपुरा गांव की बस्ट्ती सुखना वन्र्िीव अभर्ारण्र् की सीमा स े 300 मीटर स े 700 मीटर की िरू ी पर ह।ै (3) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण उपाबधं I म ेंसंलग्न ह।ै (4) पाररजस्ट्थजतकी संवेिी िोन का मानजचत्र उपाबधं II म ेंदिर्ा संलग्न ह।ै (5) सुखना वन्र्िीव अभर्ारण्र् (सारणी क) और इसके पाररजस्ट्थजतकी संवेिी िोन (सारणी ख) के अक्षांि और िेिांतर को उपाबधं III के रूप म ें सलं ग्न ह।ै (6) प्रमुख झबंिओंु के जनिेिांक के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल े ग्रामों की सूची उपाबधं IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन की आचं जलक महार्ोिना. – (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए इस अजधसूचना म ेंदिए गए उपबंधों के अनुसरण में रािपत्र में इस अजधसूचना के प्रकािन की तारीख स े िो वष ा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा से और म ें आंचजलक महार्ोिना तैर्ार और अजधसूजचत करेगी। (2) राज्र् सरकार आंचजलक महार्ोिना में सक्षम प्राजधकारी द्वारा अनुमोदित की िाएगी। (3) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना को इस अजधसूचना में जवजनर्िाष् ट ऐसी रीजत में तथा तत्समर् प्रवृत जवजध के जलए सुसंगत जवजधर्ों तथा केन्द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों के अनुरूप र्दि कोई हों, तैर्ार दकर्ा िार्ेगा। (4) आंचजलक महार्ोिना को उि र्ोिना म ेंपाररजस्ट्थजतकी तथा पर्ाावरण जवचारों को समाजहत करन ेके जलए, राज्र् सरकार जनम्नजलजखत जवभागों के साथ परामिा तैर्ार दकर्ा िाएगा, अथाात्-: (i) पर्ाावरण; (ii) वन; (iii) िहरी जवकास; (iv) पर्ाटन; (v) नगरपाजलका; (vi) रािस्ट्व; (vii) कृजष और (viii) हररर्ाणा राज्र् प्रिषू ण जनर्ंत्रण बोड ा (5) िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, आंचजलक महार्ोिना म ें तब तक जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन तब तक नहीं अजधरोजपत दकर्ा िाएगा तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (6) आंचजलक महार्ोिना में, वनरजहत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्र् पहलओंु की, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह,ै का उपबंध दकर्ा िाएगा ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (7) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रजे णर्ों और दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा का, सहार्क मानजचत्रों के साथ जिनमें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेषताओं का ब्र्ैरा हो, जनधाारण दकर्ा िाएगा। (8) आंचजलक महार्ोिना म ें स्ट्थ ानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास सुजनजश्चत करने के जलए पाररजस्ट्थजतकी सवं ेिी िोन में होन े वाले जवकास का जवजनर्मन दकर्ा िाएगा। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भ. ू उपर्ोग- – पाररजस्ट्थजतकी संवेिी िोन में वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए अजभज्ञात उद्यानों और खुले स्ट्थानों का वृहि वाजणजज्र्क र्ा औद्योजगक संबंजधत जवकास दक्रर्ाकलापों के जलए प्रर्ोग र्ा इसके संपररवतान की अनुमजत नही होगी: परंतुक दक पाररजस्ट्थजतकी सवं ेिी िोन के भीतर, इस खंड म ें जवजनर्िाष्ट प्रर्ोिन से जभन्न दकसी प्रर्ोिन के जलए कृजष और अन्र् भूजम के संपररवतान को मॉनीटरी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ूकेन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार सक्षम प्राजधकारी के पूवा अनुमोिन से स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करने के जलए अनुमजत िी िा सकेगी, िैसे दक:- (i) जवद्यमान सड़कों को चौड़ा करना, उन्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैरा-4 म ेंअधीन संवर्धात दक्रर्ाकलापः परंतु र्ह भी दक राज्र् सरकार के पूवा अनुमोिन के जबना और भारत के संजवधान के अनच्ु छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी। परंतु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के अंतगता आने वाली भूजम के अजभलेखों में हुई दकसी त्रुरट को, मॉनीटरी सजमजत के जवचार प्राप्त करन े के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िा सकेगा और उि त्रुरट को सुधारे िाने की सूचना केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक त्रुरट को सुधारने म,ें इस उप-पैरा म ें अधीन र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान िाजमल नहीं होगा। परंत ु र्ह भी दक हररत क्षत्रे , िसै े वन क्षत्रे और कृजष क्षत्रे म ें कोई पररणाजमक कमी नहीं आन ेिी िार्ेगी । (ख) अनप्रु र्ुि र्ा अनुत्पािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ावा ासों की बहाली के दक्रर्ाकलापों से पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत. - आचं जलक महार्ोिना म ें सभी प्राकृजतक िलमागों के आवाह क्षत्रे ों की पहचान की िाएगी और उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा मागिा िाक जसद्धांत इस रीजत स ेबनाए िाएंगे दक इस क्षेत्र म ेंर्ा इसके नििीक उन जवकास दक्रर्ाकलापों पर प्रजतजषद्ध दकर्ा िार्ेगा िो इस क्षेत्र के जलए घातक हों। (3) पर्टा न र्ा पाररजस्ट्थजतकी-पर्टा न. – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर पर्ाटन स े संबंजधत जवद्यमान दक्रर्ाकलापों का जवस्ट्तार र्ा सभी नर्े पाररजस्ट्थजतकी-पर्ाटन दक्रर्ाकलाप; पाररजस्ट् थजतकी संवेिी िोन के जलए पर्ाटन महार्ोिना के अनुसार होंगे । (ख) पाररजस्ट्थ जतकी-पर्ाटन महार्ोिना, राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िाएगी। (ड.) पाररजस्ट् थजतकी-पर्ाटन संबधं ी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् -6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार द्वारा िारी पाररजस्ट्थजतकी पर्ाटन मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट् थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण (समर्- समर् पर र्था संिोजधत) द्वारा िारी पाररजस्ट्थजतकी-पर्ाटन संबंधी मागाििाक जसद्धांतों के अनसु ार होगा; (iii) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकट हो, होटल और ररसॉटा के नए जनमााण की अनुमजत नहीं िी िाएगी; परंतुक दक सरं जक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, आंचजलक महार्ोिना के अनुसार नए होटलों और ररसॉट्सा की स्ट्थापना केवल पाररजस्ट्थजतकी-पर्ाटन सुजवधाओं के जलए पूवा-पररभाजषत और अजभजहत क्षेत्रों म ेंही अनुज्ञात की िाएगी; (iv) िब तक इस आंचजलक महार्ोिना के अनुमोिन नहीं जमल िाता ह ै तब तक सम्बजन्धत जवजनर्ामक प्राजधकारी पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार के जलए कोई भी अनुमजत मानीटरी सजमजत के द्वारा वास्ट्तजवक स्ट्थल जवजनर्िाष्ट की संवीक्षा और उसकी जसफाररिो के आधार पर ही िेंगे। (4) प्राकृजतक जवरासत. – पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाले बहुमल्ू र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररजव ा क्षेत्र, िलै संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि का पता लगार्ा िार्ेगा और उनकी सुरक्षा और सरं क्षण, के जलए आंचजलक महार्ोिना के भाग के रूप में, एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, सरं चनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रिषू ण.- ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म 2000 के अनुसरण म ें पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण दकर्ा िाएंगा । (7) वार् ुप्रिषू ण. - पाररजस्ट्थजतकी संवेिी िोन में वार्ु प्रिषू ण का जनवारण और जनर्ंत्रण वार् ु(प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण अजधजनर्म, और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण िल (प्रिषू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार होगा । (9) ठोस अपजिष्ट- . ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट का जनपटान और प्रबन्धन ठोस अपजिष्ट प्रबंधन जनर्म, 2016, अनुसार दकर्ा िाएगा, अकाबाजनक सामग्री का जनपटान पर्ाावरणीर् रीजत म ें पाररजस्ट्थजतकी संवेिी िोन स े बाहर अजभज्ञात स्ट्थल पर दकर्ा िाएगा । (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न (ईएसएम) अनज्ञु ात दकर्ा िार्ेगा। (10) िवै जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न (ईएसएम) अनज्ञु ात दकर्ा िार्ेगा। (11) ्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें्लाजस्ट्टक अपजिष्ट का प्रबधं न, ्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके स ेजवजनर्जमत दकर्ा िाएगा और इस संबंध म ेंआंचजलक महार्ोिना म ें जवजनर्िाष्ट उपबधं िाजमल दकए िाएगं े। आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स ेअनुमोदित होन ेतक, मॉनीटरी सजमजत सुसगं त अजधजनर्मों और उनके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की मॉनीटरी करेगी। (15) वाहन िजनत प्रिषू ण- वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण, लागू जवजधर्ों के अनुसार दकर्ा िाएगा। स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे िैसे- सपं ीजड़त प्राकृजतक गैस, द्रजवत परै ोजलर्म गैस आदि । (16) औद्योजगक ईकाइर्ा ं- . (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी मागाििाक जसद्धान्तों म ेंउद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ेंइस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रिषू णकारी उद्योगों को अनज्ञु ात दकर्ा िाएगा। और केवल, गैर प्रिषू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण-. पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ेंपहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन के भीतर प्रजतजषद्ध र्ा जवजनर्जमत दकर्ा िाना ह ै उन दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म (संरक्षण), 1986(29 का 1986) के उपबंधों और उसके अधीन बन े जनर्मों, जिसमें पर्ाावरणीर् प्रभाव आकलन अजधसूचना (ईआईए), िाजमल 2006 ह,ै सजहत वन अजधजनर्म (संरक्षण), 1980 (69 का 1980), भारतीर् वन अजधजनर्म, 1927(16 का 1927), वन्र्िीव ,अजधजनर्म (संरक्षण)1972 )1972 का 53) अन्र् लाग ू जवजधर्ों के उपबंधों तथा उनम ें दकए गए संिोधनों के अनुसार िाजसत होंग े और नीचे िी गई सारणी म ें जवजनर्िाष्ट रीजत स े जवजनर्जमत होंग,े अथाात्:- सारणी प्रजतजषद्ध होंगी; (ख) खनन प्रचालन कार्ा टी. एन. गोिावमान जतरुमलु पाि बनाम भारत संघ ररट र्ाजचका स.ं 202/1995 म ेंगोवा फाउडेिन बनाम भारत संघ ररट र्ाजचका 435/2012 के मामले म ेंऔर आईए. सं. 1000/2003 के तारीख 03.06.2022 के जनणार् म ें और उसके पश्चात ् आईए. स.ं 131377/2022 के तारीख 26.04.2023 और 28.04.2023 के जनणार् म ें माननीर् उच्चतम न्र्ार्ालर् के आर् े आििे ों के अनसु ार ही दकर्े िार्ेगें।8 THE पररसंकटमर् पिाथ ाका प्रर्ोग प्रजतजषद्ध। र्ा उत्पािन र्ा प्रस्ट्संकरण । 5. िलावन लकड़ी का वाजणजज्र्क प्रजतजषद्ध। उपर्ोग। 6. प्राकृजतक िल जनकार्ों र्ा भजू म प्रजतजषद्ध। क्षत्रे म ें अनुपचाररत बजहस्रावों का जनस्ट्सारण । 7. भूिल संचर्न सजहत वाजणजज्र्क पाररजस्ट्थजतकी संवेिी िोन म ें भिू ल सजहत प्राकृजतक िल संसाधनों िल संसाधन। का व्यावसाजर्क उपर्ोग प्रजतजषद्ध होगा और पानी के संिषू ण र्ा प्रिषू ण को रोकन े के जलए सभी किम उठाए िाएंगे। 8. नए थमला और बड़ी िल जवद्युत प्रजतजषद्ध। पररर्ोिनाओं की स्ट्थापना । 9. नए लकड़ी-आधाररत उद्योग। पाररजस्ट्थजतकी संवेिी िोन की सीमा के भीतर दकसी भी नए लकड़ी- आधाररत उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी: परंत ु दक जवद्यमान लकड़ी-आधाररत उद्योग जवजध के अनुसार िारी रह सकता ह:ै परंतु र्ह और दक जवद्यमान आरा जमलों की अनज्ञु जप्त का नवीनीकरण उनकी समाजप्त पर नहीं दकर्ा िाएगा। 10. फमों, कॉपोरेट और कंपजनर्ों द्वारा लाग ू कानूनों के अनुसार जनजषद्ध (अन्र्था उपबंजधत के जसवार्)। परंतु बड़े पैमाने पर वाजणजज्र्क पिधु न दक स्ट्थानीर् दकसानों द्वारा अपनी आिीजवका के जनवााह के जलए केवल और पोल्री फामा की स्ट्थापना। छोटे पैमान े के पोल्री फामा ही स्ट्थाजपत दकए िा सकें। ख.जवजनर्जमत दक्रर्ाकलाप 11. होटलों और ररसोटों की वाजणजज्र्क 21.09.2004 म ें भारतीर् सवेक्षण द्वारा जचजत्रत मानजचत्र के अनुसार स्ट्थापना । और पंिाब और हररर्ाणा उच्च न्र्ार्ालर् के ररट म ें02 माच,ा 2020 के आिेि के अनरूु प, सुखना वन्र्िीव अभर्ारण्र् के िलग्रहण क्षत्रे म ें दकसी भी नए वाजणजज्र्क होटल और ररसॉटा की अनुमजत नहीं िी िाएगी। र्ाजचका (सी) संखर्ा 18253/ 2009 और 5809/2015: कोटा अपने स्ट्वर् ं के प्रस्ट्ताव बनाम चंडीगढ़ प्रिासन तथा पुनर्वालोकन र्ाजचका सी एम-14026- सी डब्लू पी -2021 के साथ आर ए -सी डब्ल ू -259 -2020, आर ए- सी डब्ल ू-252-2020, आर ए- सी डब्ल ू-261- 2020, आर ए- सी डब्ल ू -268-2020 तथा आर ए- सी डब्लू 69- 2021, जसजवल ररट र्ाजचका -18253-2009 िहाँ तक सुखना वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन को लाग ूहो । परंतु दक, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर स े परे र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकट हो, सभी नए पर्ाटन जवकसात्मक दक्रर्ाकलाप र्ा अनुसार और पंिाब और हररर्ाणा उच्च न्र्ार्ालर् के आििे तारीख 02 माच,ा 2020 के अनुरूप सुखना वन्र्िीव अभर्ारण्र्[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 के िलग्रहण क्षत्रे म ें दकसी भी प्रकार के नए जनमााण की अनुमजत नहीं िी िाएगी। हररर्ाणा ररट र्ाजचका (सी) संखर्ा 18253 वषा 2009 और 5809 वषा 2015 म:ें न्र्ार्ालर् अपन ेस्ट्वर् ंके प्रस्ट्ताव बनाम चंडीगढ़ प्रिासन तथा पुनर्वालोकन र्ाजचका सी एम- 14026- सी डब्ल ू पी -2021 के साथ आर ए -सी डब्ल ू -259 - 2020, आर ए- सी डब्लू -252-2020, आर ए- सी डब्लू -261- 2020, आर ए- सी डब्ल ू-268-2020 तथा आर ए- सी डब्ल ू69- 2021, जसजवल ररट र्ाजचका -18253-2009 िहा ँ तक सुखना वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन को लाग ूहो। परंतु दक स्ट्थानीर् जनवाजसर्ों को स्ट्थानीर् जनवाजसर्ों की आवासीर् िरूरतों को परू ा करने के जलए भवन उपजनर्मों के अनुसार वास्ट्तजवक आवासीर् उपर्ोग के जलए अपनी भूजम पर जनमााण करने की अनुमजत िी िाएगी। (ख) प्रिषू ण न फैलाने वाले लघ ुउद्योगों स ेसंबंजधत जनमााण दक्रर्ाकलाप को लाग ू जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत स ेजवजनर्जमत दकर्ा िाएगा। (ग) एक दकलोमीटर स े परे इस े आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा िाएगा। 13. जवद्युत और संचार टॉवर लगाने । हररर्ाणा राज्र् सरकार द्वारा जवजनर्जमत होगा; भूजमगत केबल जबछान े को बढ़ावा दिर्ा िाएगा 14. वृक्षों की कटाई । (क) पाररजस्ट्थजतकी संवेिी िोन क्षत्रे के भीतर प्रधान मुखर् वन संरक्षक (वन बल प्रमुख) र्ा तत्समर् प्रवृत जवजध के अधीन प्राजधकारी जिसे िजिर्ां प्रत्र्ार्ोजित की गई ह ै की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई सुसंगत जवजधर्ों र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 15. जवद्यमान सड़कों को चौड़ा करना, पाररजस्ट्थजतकी संवेिी िोन म ें नई सड़कों का जनमााण और जवद्यमान उन्ह ें सुिढृ बनाना और नई सड़कों सड़कों को चौड़ा करना र्ा सुिढ़ृ करना लागू जनर्मों और जवजनर्मों, का जनमााण। र्दि कोई हो, के अनुसार जवजनर्जमत होगा । 16. उच्च-तनाव पारेषण लाइनों का लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा; भूजमगत केबल जबछान े को जनमााण। बढ़ावा दिर्ा िाएगा। 17. जविेिी प्रिाजतर्ों को लाना। पाररजस्ट्थजतकी संवेिी िोन म ेंजविेिी प्रिाजतर्ों को लाना लागू जवजधर्ों के अनुसार जवजनर्जमत होगा । 18. होटल और लॉि के पररसर की बाड़ पाररजस्ट्थजतकी संवेिी िोन म ें होटल और लॉि के पररसरों की बाड़ लगाना। लगाना लागू जवजधर्ों के अनुसार जवजनर्जमत होगा । 19. वार् ु (ध्वजन सजहत) और वाहन लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । प्रिषू ण। 20. वाजणजज्र्क संकेत बोडा और होर्डंग लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । का प्रर्ोग । 21. पाररजस्ट्थजतकी-अनुकूल पर्ाटन लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । दक्रर्ाकलाप के जलए पर्ाटकों के10 उद्योग िो पाररजस्ट्थजतकी-संवेिी िोन स े स्ट्विेिी सामग्री से उत्पािों का उत्पािन करत े ह।ैं की अनुमजत सक्षम प्राजधकारी द्वारा िी िाएगी। 24. पर्ाटन स ेसंबंजधत दक्रर्ाकलाप िैसे लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । दक राष्ट्रीर् उद्यान क्षत्रे के ऊपर स े हवाई िहाि, गमा हवा के गुब्बारे से उड़ान भरना। 25. ठोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । 26. ्लाजस्ट्टक कैरी बगै का उपर्ोग। लाग ूजवजधर्ों (अन्र्था उपबंजधत के जसवार्) के अनुसार जवजनर्जमत होगा । 27. पाररजस्ट्थजतकी-पर्ाटन दक्रर्ाकलाप। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । ग.सवं र्धता दक्रर्ाकलाप 28. डेर्री, डेर्री New Delhi,the 11th November, 2024 S. O. 4874(E).––– WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification number S.O. 1523(E), dated the 22nd March, 2024, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 22nd March, 2024; AND WHEREAS, objections and suggestions received from persons in response to the said draft notification have been considered by the Central Government; AND WHEREAS, Sukhna Wildlife Sanctuary is under the administrative control of the Union territory of Chandigarh and shares boundary with Punjab and Haryana and located in Shivalik foothills which are ecologically sensitive and geologically unstable. The total area the Sukhna Wildlife Sanctuary of 25.9849 sq. km. (6420.99 acres) situated in between the longitude and latitude (Left - 76.810241 E, Right - 76.888207 E, Top - 30.809699 N, Bottom - 30.742053 N). AND WHEREAS, Sukhna Wildlife Sanctuary has a variety of topographical features and rich diversity of flora and fauna and due to its ecological, faunal, floral, geo-morphological, natural and geological significance, and for the purpose of protecting, propagating and developing wildlife and its habitat, this area was declared as Wildlife Sanctuary vide Chandigarh Administration notification No. 694, HII (4)-98/4519, dated the 6th March, 1998; AND WHEREAS, as per wildlife census carried out under the guidance of Wildlife Institute of India, Dehradun during 2010, many species as listed under Schedule-I of the Wildlife (Protection) Act 1972, have been reported in Sukhna Wildlife Sanctuary. The prominent species among them includes common Leopard (Panthera pardus), Sambar (Rusa unicolor), Indian Pangolin (Manis crassicaudata), Golden Jackal (Canis aureus), Indian Peafowl (Pavo cristatus), King Cobra (Ophiophagus hannah), Ajgar/ Indian Rock Python (Python molurus) and Monitor Lizard (Varanus bengalensis). Schedule-II species listed under the Wildlife (Protection) Act, 1972, present in Sukhna Wildlife Sanctuary includes Red Jungle Fowl (Gallus gallus), Russell’s Viper (Daboia russelii) and Grey Langur (Semnopithecus entellus); AND WHEREAS, the sanctuary harbours a variety of butterflies and moths. The sanctuary inhabits termite anthills which harbour termites like Microtermes and Odontotermis- the organisms necessary for the decomposition of organic matter. The edible fungi present in the area include Puff Balls (Lycoperdon pusillum) and Termitomyces; AND WHEREAS, from biodiversity richness point of view, it is home to a number of faunal species including the endangered Indian Pangolin and vulnerable Common leopard. Although, no critically endangered or endemic species is found in the area, yet it is necessary to conserve and protect the area for the remnant biodiversity present in the Protected Area; AND WHEREAS, there are a number of species of trees, shrubs, climbers and herbs in the sanctuary besides a good representation of Thallophytes, Bryophytes, Pteridophytes and lichens. The prominent tree species are: Khair (Acacia catechu), Amla (Emblica officinalis), Baheda (Terminalia bellirica), Sain (Terminalia alata), Kachnar (Bauhinia variegata), Phulai (Acacia modesta), Kikar (Acacianilotica), Ronjh (Vachellia leucophloea), Shisham (Dalbergiasissoo), Chhal (Anogeissus latifolia), Neem (Azadirachtaindica), Semal (Bombaxceiba), Dhak (Buteamonosperma), Kachnar (Bauhinia variegata), Mulberry (Morus alba), Paper Mulberry (Brossounetia papyrifera), Jhingan (Lannea coromandelica), Tendu (Dyospyrosmontana), Karhi Patta (Murraya koenigii), Mesquite (Prosopisjuliflora), Amaltas(Cassia fistula), Ber/ Indian Jujube (Ziziphus jujube). The prominent shrubs are Adusa/Common Cough Cure (Justicia adhatoda), Karaunda (Carissa carandus), Kainth (Pyrus pashia) and Samhalu (Vitexnegundo) etc. Maljhan/Camel Foot Climber (Phanera vahlii) is the prominent climber of the sanctuary;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 AND WHEREAS, the main faunal species found in the area are Common Leopard (Panthera pardus), Sambar (Rusa unicolor), Barking Deer (Muntiacus muntjak), Indian Pangolin (Manis crassicaudata), Wild Boar (Sus scrofa), Jackal (Canis aureus indicus), Small Indian Civet (Viverricula indica), Jungle Cat (Felis chaus), Indian Crested Porcupine (Hystrix indica), Hanuman Langur (Semnopithecus entellus), Rhesus Macaque (Macaca mulatta), Indian Hare (Lepus nigricollis), Common Mongoose (Urva edwardsii), Five Striped Squirel (Funambulus pennati) etc.; AND WHEREAS, there are more than 250 species of birds including aquatic water fowls. Prominent among them are: Common Crow (Corvus splendens), Indian Sparrow (Passer domesticus), Bee Eater (Merops orientalis), Purple Sunbird (Cinnyris asiaticus) Indian Peafowl (Pavo crsitatus), Red Jungle Fowl, Grey Partridge (Ortygornis pondicerianus), Cuckoos, Indian Night Jar (Caprimulgus asiaticus), Eurasian Golden Oriole (Oriolus oriolus), White Throated Kingfisher (Halcyon smyrnensis), Pied Kingfisher (Ceryle rudis), Indian Swift (Aerodramus unicolor), Common Hoopoe (Upupa epops), Hornbills, Coppersmith Barbet (Megalaima haemacephala), Brown Headed Barbet (Megalaima zeylanica), Black Rumped Flameback Woodpecker (Dinopium benghalense), Indian Roller (Coracias benghalensis), Barn Owl (Tyto alba), Rose Ringed parakeet (Psittacula krameri), Plum Headed Parakeet (Himalayapsitta cyanocephala) Alexandrine Parakeet (Psittacula eupatria) Ring Necked Dove (Streptopelia capicola), Spotted Dove (Spilopelia chinensis),Bronze-winged Jacana (Metopidius indicus), Pheasant-tailed Jacana(Hydrophasianus chirurgus), Red-wattled Lapwing (Vanellus indicus), Eurasian coot (Fulica atra), Shikra (Accipiter badius), Geese, Swan, Ducks etc.; AND WHEREAS, other important reptilian species in the sanctuary includes King Cobra (Ophiophagus hannah), Rat Snake (Ptyas mucosa), Common Krait (Bungarus caeruleus), Russell’s Viper (Daboia russelii), Indian Python and Common Monitor Lizard etc. It also harbours variety of Butterflies among which Plain Tiger (Danaus chrysippus), Stripped Tiger (Danaus genutia), Common sergent (Athyma perius), Common Jezebel (Delias eucharis), Peacock Pansy (Junonia almana), Lemon Butterfly (Papilio demoleus), Blue Tiger (Tirumala limniace), Common Leopard Butterfly (Phalanta phalantha) and Crow Butterfly (Euploea core) are very common in the area. The honey bees (Apidae) are represented by Indian Rock Bee (Apis dorsata), Indian Bee (Apis cerana indica), Italian Bee (Apis mellifera) and Little Bee (Apis florea); AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Sukhna Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; AND WHEREAS, the Government of Haryana vide its letter No. 682, dated 16th February, 2024 have specifically stated that the declaration of Eco-sensitive Zone around Sukhna Lake Sanctuary on the Haryana side is in conformity with the Order dated 02nd March, 2020 of the High Court of Punjab and Haryana in Writ Petition (C) No. 18253 of 2009 and 5809 of 2015: Court on its own motion Vs Chandigarh Administration and other connected matters; AND WHEREAS, the Government of Haryana vide its letter No. 682, dated 16th February, 2024 has specifically stated that the adjoining State of Punjab and Union territory of Chandigarh do not have any objection to the State of Haryana delineating Eco-Sensitive Zone around Sukhna Wildlife Sanctuary (towards Haryana Side); NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 km to 2.035 km from the boundary of the Sukhna Wildlife Sanctuary, in the State of Haryana as Sukhna Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone, the details of which are specified in paragraph 1 for the purpose of protecting and improving the quality of environment and preventing, controlling and abating environment pollutions and taken the following measures, namely:- 1. Extent and boundaries of Eco-sensitive Zone- (1) The Eco-sensitive Zone in general extends up to 1.0 kilometre from the boundary of the Sukhna Wildlife Sanctuary on the Haryana side. It is further extended to 2.0 kilometres in the Reserved Forest on the northern side. On the eastern side; the Eco-sensitive Zone boundary is mostly 1.0 kilometre, running along the boundary of the Reserved Forest; it is extended on the south-eastern side to make it co-terminous with the boundary of the Reserved Forest and the total area of the Eco-Sensitive Zone is 24.60 sq. kms.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) Ten villages namely Prempura, Sokhomajri, Damala, Lohgarh, Manakpur Thakardas, Surajpur, Chandimandir Kotla, Darra Kharauni, Rampur, Saketari and Mahadevpur fall within the proposed Eco- sensitive Zone, the total area proposed will be 6078.98 acres (2460.07 ha) and will encompass and include, inter-alia, following areas namely.- (i) area comprising of Sector 1 and part of Sector 2 and sector 3 including Gymkhana Club under the Haryana Shahari Vikas Pradhikaran(HSVP). (ii) some tube well chambers, Para Gliding Parks and area falling under Sector-1, MDC. (iii) area falling under Chandi mandir Cantonment (area including small arms firing range of military station Chandi mandir, Central Soil and Water Conservation Research Farm. (iv) part of area falling under Municipal Corporation (MC), Panchkula; (v) out of ten villages falling in the proposed Eco-Sensitive Zone, two villages namely, Saketri and Prempura fall within a radius of 700 meters from the boundary of Sukhna Wildlife Sanctuary. While the houses in Village Saketri are located along the boundary of Sukhna Wildlife Sanctuary, the habitation of village Prempura is at a distance of 300 m to 700 m from the boundary of Sukhna Wildlife Sanctuary. (3) The boundary description of Eco-Sensitive Zone is appended Annexure I. (4) The map of Eco sensitive Zone is appended as Annexure II. (5) The latitudes and longitudes of the Sukhna Wildlife Sanctuary (Table A) and its Eco-Sensitive Zone (Table B) is appended as Annexure III. (6) The list of villages falling within Eco-Sensitive Zone along with co-ordinates of prominent points is appended as Annexure IV. 2. Zonal Master Plan for the Eco-sensitive Zone- (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare and notify a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people in accordance with the provisions of this notification. (2) The Zonal Master Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant laws for the time being in force and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with the following departments of the state government, for integrating the ecological and environment consideration into the said plan, namely: - (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipality; (vi) Revenue; (vii) Agriculture; and (viii) Haryana State Pollution Control Board. (5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green areas, such as, parks and like places, horticultural areas,[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for the security of local communities livelihood. 3. Measures to be taken by the State Government- The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - 1. Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified in this clause, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and the provisions of this notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under para 4; Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the respective State Governments, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area. (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies. - The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Governments in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism: - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with Departments of Environment and Forests of the State Government. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely: - (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the central government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco- tourism, eco-education and eco-development;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) All new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution. - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation and Control) Rules, 2000. (7) Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981 and the Environment Act, and the rules made there under. (8) Discharge of effluents. - The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the Environment Act, and the rules made there under. (9) Solid wastes. - Disposal and management of solid wastes shall be as under: - (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and environmentally sound management of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste – Bio medical waste management shall be as under: a. the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016. b. safe and environmentally sound management of bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic Waste Management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016. (12) Construction and demolition waste management - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016. (13) E-waste. - The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016. (14) Vehicular traffic – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution - Prevention and control of vehicular pollution shall be complied with in accordance with applicable laws and efforts shall be made for use of cleaner fuel such as Compressed Natural Gas, Liquified Petroleum Gas, etc.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 (16) Industrial units - (a) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone on or after the publication of this notification in the Official Gazette. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board unless so specified in this notification. and only, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes - The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely: TABLE S No. Activity Description 1. 2. 3. Construction activities. (a) No new constructions of any kind shall be permitted within the catchment of the Sukhna Wildlife Sanctuary as per map delineated by the Survey of India on 21.09.2004 and in conformity with the Order dated 02nd March, 2020 of the High Court of Punjab and Haryana in Writ Petition (C) No. 18253 of 2009 and 5809 of 2015 title Court on its own motion Vs Chandigarh Administration and also in conformity with the final judgment of the High Court in review petition CM-14026- CWP-2021 with RA-CW-259-2020, RA-CW-252-2020, RA- CW-261-2020, RA-CW-268-2020 and RA-CW-69-2021 IN CWP-18253-2009 in so far as its applicability to the Eco- sensetive Zone of the Sukhna Wildlife Sanctuary: Provided that, local residents shall be permitted to undertake construction in their land for their bonafide residential use as per building bye-laws to meet the residential needs of the local residents. (c) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 13. (b) The felling of trees shall be regulated in accordance with the provisions of the relevant laws for the time being in force. 15. Widening and strengthening of Construction of new roads and widening or repair of existing existing roads and construction of roads in the Eco-sensitive Zone shall be regulated as per rules new roads. and regulations applicable, if any. 16. Haryana Member; ex-officio; 6 Representative of Ministry of Environment, Forest & Climate Change, Member; ex-officio; Government of India 7 Representative of M.C. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring Committee shall be till further orders provided that the non-official members of the committee shall be nominated by Government of Haryana from time to time every three years. (3) The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (4) The activities not covered in the Schedule to the notification referred to in sub-paragraph (3) and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Regulatory authorities concerned. (5) The Member Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests concerned shall be competent to file complaint under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representative or expert from Department representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in form specified in Annexure-V, appended to this notification. (8) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
