L.-33004/99 सी.जी.-डी.एल.-अ.-02052023-245571 xxxGIDHxxx CG-DL-E-02052023-245571 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 267] नई दिल्ली, सोमवार, मई 1, 2023/विै ाख 11, 1945 No. 267] NEW DELHI, MONDAY, MAY 1, 2023/VAISAKHA 11, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 28 अप्रलै , 2023 सा.का.जन. 337(अ).—केंद्रीय मोटर जनयम, 1989 का और संिोधन करने के जलए कजतपय जनयमों का प्रारूप मोटरयान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथाअपेजित भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में, भारत सरकार के पररवहन और रािमाग ग मंत्रालय की अजधसूचना सा.का.जन. 49(अ), तारीख 24 िनवरी, 2023 द्वारा प्रकाजित दकया गया था, जिसमें ऐसे सभी व्यजियों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिनको उि अजधसचू ना को अंतर्वगष्ट करने वाले रािपत्र की प्रजतयां िनता को उपलब्ध करा िी गई थी, तीस दिन की अवजध के भीतर आिेप और सुझाव आमंजत्रत दकए गए थे ; और, उि अजधसूचना वाली रािपत्र की प्रजतयां िनता को तारीख 24 िनवरी, 2023 को उपलब्ध करा िी गई थी ; और, उि प्रारूप जनयम के संबधं में िनता स े प्राप्त आिेपों और सुझावों पर केन्द्द्रीय सरकार द्वारा सम्यक् रूप से जवचार कर जलया गया ह ै; अतः, अब, केंद्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केंद्रीय मोटरयान जनयम, 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागत ् :- 1. सजं िप्त नाम और प्रारंभ.—(1) इन जनयमों का संजिप्त नाम केंद्रीय मोटर यान (चौथा संिोधन) जनयम, 2023 ह ै। 2846 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) य ेरािपत्र म ेंअंजतम प्रकािन की तारीख को प्रवृत् त होंगे । 2. केंद्रीय मोटर यान जनयम, 1989 के जनयम 125ग में,- (क) उपजनयम (1) के िसू रे परंतुक के स्ट्थ ान पर जनम्न जलजखत परंतुक रखा िाएगा, अथागत:् -- “परंत ु यह दक एआईएस-135 के उपबंध एआईएस-052 (आरईवी.1) म ें यथा जवजनर्िगष् ट टाईप III बसों पर लागू होंग,े जिनका जवजनमागण 1 अक्त ूबर, 2023 को और उसके पश् चात् दकया गया ह ै।”; (ख) उपजनयम (2) के परंतुक के स्ट् थान पर जनम्न जलजखत परंतुक रखा िाएगा, अथागत:् -- “परंत ु एआईएस-135 के अजधभोगी कि म ें अज‍न सरु िा के उपबंध एआईएस-063 म ें यथा जवजनर्िगष् ट स्ट् कूल बसों पर लाग ू होंगे, जिनका जवजनमागण 1 अक्त ूबर, 2023 को और उसके पश्च ात् दकया गया ह ै।”; (ग) उपजनयम (7) की सारणी 1 में क्रम संख यांक 7क और उससे संबंजधत प्रजवजष्ट यों के स्ट्थ ान पर जनम्न जलजखत क्रम संख या और प्रजवजष्ट यां रखी िाएंगी, अथागत्:- (1) (2) (3) (4) (5) “7क अजधभोगी कि में अज‍न एम 3 प्रवग ग की टाईप एआईएस-135 1 अक् तूबर, 2023”। संचेतक और सुरिा प्रणाली III बसें और स्ट् कूल बस ें [फा. स.ं आरटी-11016/37/2021-एमवीएल] महमूि अहमि, अपर सजचव रटप्प ण : मलू जनयम, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खडं (i) की अजधसूचना संखया सा.का.जन. 590(अ), तारीख 2 िून, 1989 द्वारा प्रकाजित दकए गए थे और अंजतम संिोधन अजधसूचना सखं या सा.का.जन. 289(अ), तारीख 13 अप्रलै , 2023 द्वारा दकया गया था । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 28th April, 2023 G.S.R. 337(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways vide number G.S.R. 49(E), dated the 24th January, 2023, in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the draft rules were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 24th January, 2023; And whereas, objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. (1) These rules may be called the Central Motor Vehicles (Fourth Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989, in rule 125C,- (a) in sub-rule(1), for the second proviso, the following proviso shall be substituted, namely:-[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 “Provided further that the provisions of AIS-135 shall be applicable to Type III buses, as specified in AIS-052(Rev.1), which are manufactured on and after the1st October, 2023.”; (b)in sub-rule(2), for the proviso, the following proviso shall be substituted, namely:- “Provided that the provisions on fire protection in occupant compartment of AIS-135 shall be applicable to school buses ,as specified in AIS-063, which are manufactured on and after the1st October, 2023.”; (c) in sub-rule (7), in Table 1, for serial number 7A and the entries relating thereto, the following serial number and entries shall be substituted, namely:- (1) (2) (3) (4) (5) “7A Fire Alarm and Protection system in Type III buses of AIS-135 1 st October 2023.”. occupant compartment category M3 and school buses [F.
