Executive Summary & Key Takeaways

Okay, I'm ready to analyze the policy text and generate the report. **Report: Analysis of the Reserve Bank of India's Sixth Amendment to Foreign Currency Account Regulations, 2025** **1. Executive Summary:** This report analyzes the Reserve Bank of India's (RBI) Notification No. FEMA 10 R6/2025RB, dated April 29, 2025, which constitutes the "Foreign Exchange Management (Foreign Currency Accounts by a Person Resident in India) Sixth Amendment Regulations, 2025." The amendment modifies Schedule II of the principal regulations, specifically extending the eligibility period for the "Application for Opening Diamond Dollar Accounts" from two to three years. This change aims to likely impact diamond traders, allowing potentially more businesses to qualify for and maintain Diamond Dollar Accounts. **2. Introduction:** The purpose of this report is to provide an informative analysis of the Reserve Bank of India's Sixth Amendment Regulations, 2025, pertaining to Foreign Currency Accounts held by Resident Indians. This analysis is based solely on the information provided within the official notification text. **3. Policy Overview:** * **Amendment:** This notification amends the "Foreign Exchange Management (Foreign Currency Accounts by a Person Resident in India) Regulations, 2015" (Notification No. FEMA 10R/2015-RB dated January 21, 2016). * **Core Objective(s):** Based on the provided text, the objective of the original policy is to manage and regulate foreign currency accounts held by individuals residing in India. The specific objective of *this amendment* appears to be related to facilitating or adjusting the requirements for opening and maintaining Diamond Dollar Accounts. **4. Background and Rationale:** The rationale for this specific amendment (extending the period from two to three years) is not explicitly stated in the provided text. However, we can infer that the RBI has likely identified that the previous two-year requirement was either too restrictive or did not adequately serve the needs of the diamond trading industry. It's possible that a longer period allows for a more accurate assessment of a business's eligibility or that the previous shorter period was creating undue hardship or administrative burden. The extension could also be intended to align with broader economic goals related to the diamond industry. **5. Key Provisions / Changes:** This notification introduces *one* key change: * **Specific Part of Original Policy Changed:** Schedule II, within the Annex titled "Application for Opening Diamond Dollar Accounts" of the principal regulations. * **New Rule/Provision:** The phrase "2 years" is replaced with "three years" in the first paragraph of the aforementioned Annex. * **Effect of the Change:** This extends the time period used for eligibility criteria in the application process for opening Diamond Dollar Accounts. It can be inferred that the extension will likely allow more diamond businesses to qualify for Diamond Dollar Accounts as a longer period of consideration will be in effect. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders directly affected by this amendment are: * Diamond traders and businesses in India who are either current holders of or potential applicants for Diamond Dollar Accounts. * Banks authorized to deal in foreign exchange, as they will need to adjust their application procedures and eligibility assessments for Diamond Dollar Accounts. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Reserve Bank of India (RBI) is the responsible agency, specifically the Foreign Exchange Department. * **Timelines or Procedures:** The amendment comes into force from the date of its publication in the Official Gazette. Banks need to update their operational procedures and application forms to reflect this change immediately after publication. The diamond industry may need to re-evaluate its eligibility based on the new three-year period. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome of this amendment is to broaden access to Diamond Dollar Accounts for diamond traders. This may lead to: * Increased use of Diamond Dollar Accounts. * Potentially increased efficiency in diamond trading transactions involving foreign currency. * Possible positive impact on the diamond industry's contribution to the Indian economy. **9. Conclusion:** The Sixth Amendment Regulations, 2025, to the Foreign Exchange Management (Foreign Currency Accounts by a Person Resident in India) Regulations, 2015, represent a targeted adjustment to the eligibility criteria for Diamond Dollar Accounts. By extending the period from two to three years, the RBI likely intends to facilitate broader access to these accounts, potentially benefiting the diamond trading industry and related economic activities. This adjustment should be carefully monitored to assess its impact on the volume of transactions and overall efficiency in the sector.
