In exercise of the powers conferred under Section 45 of the Tamil Nadu Lokayukta Act, 2018 the Tamil Nadu Lokayukta hereby makes the following regulations:- 1. Short title and commencement.— (a) These regulations may be called the Tamil Nadu Lokayukta Regulations, 2022. (b) They shall come into force on the date of publication in the Official Gazette of Government of Tamil Nadu. 2. Definitions.— In these regulations unless the context otherwise requires- (a) "Act" means the Tamil Nadu Lokayukta Act, 2018 (Tamil Nadu Act No. 33/2018). (b) "Rules" means the Tamil Nadu Lokayukta Rules, 2018. (c) Words and expressions used in these Regulations and not defined herein but defined either in the Act or in the Rules shall have the same meaning respectively assigned to them either in the Act or in the Rules, as the case may be. 3. Language of the Lokayukta.— (a) The complaint may be in English or Tamil. Where a document is in a language other than in English or Tamil, its translated version in English or Tamil shall be filed along with the original. The same shall also apply to petitions, counters, rejoinders, replies or any other document to be filed before the Lokayukta. (b) The proceedings of the Lokayukta shall be conducted in English or Tamil. 4. Affidavit to accompany the complaint.— Every complaint shall be supported by an affidavit by the complainant. 5. Copies of the complaint, etc.— Every complaint, affidavit and documents attached to it shall be in duplicate accompanied by as many number of copies as there are respondents. 6. The affidavit shall be sworn before any of the following persons.— (a) Any Judicial or Executive Magistrate; (b) A Notary appointed under the Notaries Act, 1952 or Commissioner of Oaths appointed under the Oaths Act, 1969; (c) An Advocate other than the Advocate engaged in the proceedings; (d) An Officer belonging to Group A or Group B of the Government of Tamil Nadu.348 TAMIL NADU GOVERNMENT GAZETTE [Part VI—Sec. 1 7. Certificate of attendance.— When a public servant attends the Lokayukta for giving evidence or to produce any document officially, a certificate of attendance shall be issued to him. 8. Power to correct errors and mistakes.— Any clerical, arithmetical errors or mistakes in a report, declaration, decision or order arising therein from any accidental slip or omission may at any time be corrected either suo moto or on application of any of the parties. 9. Communication of orders.— Orders shall be communicated to the complainant, respondents and others concerned by registered post or by any other mode of service. 10. Certified Copy.— (a) A copy of the order is to be given to the parties to the proceedings free of cost. (b) Where a party to the proceedings requires an extra copy, on application, the extra copy shall be issued to him duly certified by the Registrar on payment of Rs. 5/- for each page. (c) Such party shall deposit the charges for preparing copies within a week from the date of call for necessary charges, failing which it shall be struck off. (d) A certified copy of an order shall specify the date of application, date when the copy was made ready and date when it was delivered. . (e) Copies made ready shall be displayed in the Notice Board giving a week's time, failing to receive the same, it will be sent to the party concerned by ordinary post. 11. Authentication of orders.— Any order passed by the Lokayukta shall be authenticated by the Registrar affixing the Round seal. The Round seal shall be under the custody of the Registrar. 12. Website.— The number of complaints pending, status and disposal of the complaints shall be displayed on the website of the Lokayukta. 13. Consignment of Records.— Records of all cases finally disposed of shall be consigned to the Record Section after making necessary entries in the relevant Registers. 14. Destruction of Records.— (a) The records of a case shall be destroyed after the expiry of three years from the date of final disposal after displaying the same in the official Website of Lokayukta for a period of 15 days. The original complaint and every final order passed shall be preserved permanently. (b) A separate register shall be maintained containing the list of ripe cases for destruction. (c) Entries shall be made in the prescribed Registers mentioning the date of destruction. 15. Copies of Documents.— Unless any document is classified as confidential, a copy of the same may be made available to the parties to the proceedings on payment of Rs.5/- for each page as copying charges. 16. Return of Documents.— Before destruction of records, if an application is filed to return the original documents, orders will be passed by the Registrar as he deems fit.Aug. 30, 2023] TAMIL NADU GOVERNMENT GAZETTE 349 17. Forms and Annexure.— The forms and annexures referred to in these regulations will be published separately as required. 18. Suits or Legal Proceedings by or against the Lokayukta.— Lokayukta may sue or be sued and shall be represented by the Registrar. 19. Restriction of use of mobile phones and electronic devices.— In the Inquiry Hall or any adjacent place before the Lokayukta, the use of mobile phones or any other electronic gadgets is strictly prohibited. 20. Dress code.— (a) Before Lokayukta, Advocates shall wear the same professional dress as prescribed for appearance before a Court; (b) All other persons appearing before the Lokayukta shall be properly dressed. 21. Sitting.— Lokayukta shall ordinarily hold its sittings at Chennai. However, in case of necessity, at such place/places as may be determined by the Chairperson. 22. Cause List.— There shall be a cause list of cases posted containing the name of the counsels representing the parties and the same shall be uploaded on the website and also affixed on the Notice Board. 23. Vacation.— (a) Summer vacation as notified by the High Court, Madras shall be applicable to Lokayukta; (b) The office of the Lokayukta, however, will remain open during vacation except on Public holidays. 24. Saving of inherent power of Lokayukta.— Nothing in these Regulations shall be deemed to limit or otherwise affect the inherent power of the Lokayukta to pass such orders as may be necessary to meet the ends of justice or to prevent abuse of the process of Lokayukta. 25. Amendment and Additions.— It shall be competent for the Lokayukta to add, delete or amend the Regulations from time to time and to make appropriate directions on matters not covered by these Regulations.
