21 जून, 2024 सा.का.जन. 340)अ(.—राष्ट्रपजत, संजिधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त िजियों का प्रयोग करते हुए, माल और सेिा कर अपील अजधकरण में समूह “ग” के पदों पर भती की पद्धजत को जिजनयजमत करने के जलए जनम्नजलजखत जनयम बनाती ह,ैं अथाात्:- 1. संजिप्त नाम और प्रारंभ.- )1( इन जनयमों का संजिप्त नाम माल और सेिा कर अपील अजधकरण )समूह "ग" कमाचाररयों की भती, िेतन और सेिा के अन्य जनबंधन और ितें( जनयम, 2024 ह ै । (2) ये राजपत्र में उनके प्रकािन की तारीख से प्रिृत्त होंगे। 2. पररभाषाएं. )1( इन जनयमों में, जब तक दक संदभा से अन्यथा अपेजित न हो,- (क( "अजधजनयम" स े केंद्रीय माल और सेिा, अजधजनयम 2017 )2017 का 12( अजभप्रेत ह;ै (ख( "जनयुि प्राजधकारी" स े केंद्रीय सरकार या िह प्राजधकारी अजभप्रेत ह,ै जजसमें अजधसूचना द्वारा अपील अजधकरण में अजधकाररयों और कमाचाररयों की जनयुजि करने की िजियां केंद्रीय सरकार म ें प्रत्यायोजजत ह;ैं (ग( "अपीलीय अजधकरण या जीएसटीएटी" स े अजधजनयम की धारा 109 के अधीन गरित माल और सेिा कर अपील अजधकरण अजभप्रेत ह;ै 3698 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (घ( "अध्यि" से अजधजनयम की धारा 110 के अधीन जनयुि दकया गया अपील अजधकरण का अध्यि अजभप्रेत ह;ै (ङ( "अनुसूची" से इन जनयमों से उपाबद्ध अनुसूजचयां अजभप्रेत हैं। (2) उन िब्दों और पदों के, जो इसमें प्रयुि ह ैं और इन जनयमों में पररभाजषत नहीं ह,ैं ककतु अजधजनयम में पररभाजषत ह,ैं िही अथा होंगे जो उस अजधजनयम म ें हैं। 3. आिेद.- ये जनयम इन जनयमों से उपाबद्ध अनुसूची-1 के स्ट्तंभ )1) में जिजनर्ददष्ट पदों को लागू होंगे । 4. पद सख्ं या, िगीकरण और िते न मरै रक्स का स्ट्तर: उक्त पद की संख्या, उनका िगीकरण और िेतन मैररक्स म ें स्ट्तर िह होगा, जो इन जनयमों स े उपाबद्ध अनुसूची के स्ट्तंभ )2) स े स्ट्तभं )4) म ें जिजनर्ददष्ट ह।ैं 5. भती की पद्धजत, आय-ु सीमा, अहता ाएं आदद -भती की पद्धजत, आय-ु सीमा, अहता ाएं और उससे संबंजधत अन्य बातें िे होंगी जो उि अनुसूची के स्ट्तंभ )5( स े )13( म ें जिजनर्ददष्ट ह।ैं 6. जनयुजि -.अपील अजधकरण के सभी समूह "ग" कमाचाररयों की जनयुजि जनयुि प्राजधकारी द्वारा की जाएगी । 7. सीधी भती द्वारा जनयुजि के जलए प्रदक्रया.-जनयुि प्राजधकारी, अपील अजधकरण म ें समूह "ग" कमाचाररयों के पदों के जलए और केंद्रीय सरकार, सािाजजनक िेत्र के उपक्रमों, अजधकरणों और इस तरह के जिजनश्चय के अनुसार पयााप्त अनुभि रखने िाली एक मान्यताप्राप्त िृजत्तक अजभकरण के माध्यम से अजखल भारतीय आधार पर जिज्ञापन द्वारा आिेदन को आमंजत्रत करेगी । 8. प्रजतजनयुजि के आधार पर जनयुजि की प्रदक्रया.-जनयुि प्राजधकारी व्यापक जिज्ञापन के माध्यम स े पदों को आमंजत्रत करेगा जजसके अंतगात रोजगार समाचार म ें अजनिाया रूप से प्रकािन और संबंजधत पदों के के जलए अनुसूची- I में जिजहत चयन सजमजत की जसफाररि के आधार पर चयन दकया जाएगा । 9. प्रजतजनयुजि पर जनयुि कमाचाररयों का आमेलन.-)1( इन जनयमों के उपबंधों में अंतर्विष्ट दकसी बात के होते हुए, प्रजतजनयुजि के आधार पर ऐसा जनयुि दकया गया व्यजि, जो इन जनयमों म ें अजधकजथत की गई अहता ाओं और अनुभि को पूणा करते हों और जजन्ह ें जिभागीय प्रोन्नजत सजमजत द्वारा उपयुि माना जाता ह,ै उस िता के अध्यधीन जो आमेलन के जलए उसके जिकल्प पर ऐसे व्यजि का अनुभि हो, संबंजधत ग्रेड म ें आमेलन के जलए पात्र होगा । (2) ऐसा आमेलन इस िता के अधीन होगा दक उनके मूल जिभाग या काडर जनयंत्रण प्राजधकाररयों के अध्यधीन होगा और उन्हें अपील अजधकरण में समाजहत दकये जाने पर कोई आपजत्त नहीं होती है । (3) उपजनयम )1) में उजल्लजखत कमाचाररयों की िररष्ठता संबंजधत पद पर उनके आमेलन की तारीख के प्रजत जनदेि को अिधाररत करेगी । (4) एक बार जब ऐसे कमाचारी आमेलन के जलए अपने जिकल्प का प्रयोग करते ह,ैं िे इसके पश्चात् दकसी बबद ुपर अपने मूल जिभाग या काडर म ें िापस आने के जलए पात्र नहीं होंगे । 10. प्रोन्नजत, पुजष्टकरण या प्रजतजनयुजि के जलए सजमजतयां.- )1( केन्द्रीय सरकार, अनुसूची-1 में यथाजिजहत जिभागीय प्रोन्नजत सजमजत, चयन सजमजत और पुजष्टकरण सजमजत का गिन करेगी । (2) जहां अनुसूची-1 म ें यथाजिजहत उि सजमजतयों का अध्यि या सदस्ट्य नहीं उपलब्ध ह,ै केंद्रीय सरकार, यथाजस्ट्थजत, जो िह उजचत समझे, संयुि सजचि के पद स े अन्यून दकसी व्यजि को सजमजत के अध्यि या सदस्ट्य के रूप म ें नाम जनदेजित करेगी । (3) उपजस्ट्थजत सजमजतयों के कोई दो सदस्ट्य प्रत्येक बैिक के जलए कोरम का गिन करेंगे और सजमजतयों का प्रत्येक जिजनश्चय बैिक म ें उपजस्ट्थत सदस्ट्यों की बहुमत के आधार पर दकया जाएगा । (4) सजमजत का अध्यि, मतदान का प्रयोग नहीं करेगा तथा जिजनश्चय से जिरत होने के मामले म,ें समुजचत जनदेि के जलए केंद्रीय सरकार को जिजनर्ददष्ट दकया जा सकता ह ै ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (5) उि सजमजतयों का कोई भी जिजनश्चय उि सजमजतयों के गिन म ें केिल दकसी ररजि या त्रुरट के कारण अमान्य नहीं होगा । 11. सेिा की ितें.-)1( िेतन, भत्ते, छुट्टी और सेिा की अन्य ितों के मामले म,ें अपाल अजधकरण के समूह "ग" के कमाचाररयों की सेिा ितें, उन जनयमों और जिजनयमों के अनुसार जिजनयजमत की जाएंगी जो केंद्रीय सरकार के िेतन मैररक्स में तत्स्ट्थानी स्ट्तर के कमाचाररयों पर लागू होती ह ैं । (2) भजिष्य जनजध योजना, समूह बीमा या कोई अन्य बीमा स्ट्कीम से संबंजधत मामलों में सेिाजनिृजत्त, पेंिन और सेिाजनिृजत्त लाभ, प्रजतजनयुजि के आधार पर काम करने िाले अजभकरण के कमाचारी अपने मूल मंत्रालय या जिभाग या संगिन में उन पर लागू सुसंगत जनयमों द्वारा िाजसत होंगे । (3) अपील अजधकरण, उनके िेतन स े ऐसी स्ट्कीम के जलए योगदान की िसूली करेगा और ब्याज की दकसी भी हाजन के संबंध म ें तुरंत ऋण देने िाले मंत्रालय या जिभाग या संगिन को भेजें और अपील अजधकरण द्वारा उसका िहन दकया जाएगा। (4) अजधकरण के कमाचाररयों के पास मूल संगिन या इन जनयमों से उपाबद्ध अनुसूची-2 में यथाजिजनर्ददष्ट उनकी पात्रता के अनुसार जचदकत्सा प्रसुजिधाओं का लाभ उिाने का जिकल्प होगा । (5) अजधकरण के कमाचाररयों को ररजि के अधीन, या तो प्रधान पीि में या चयन सजमजत के जनदेि पर दकन्हीं राज्य न्यायपीिों में तैनात दकया जाएगा । 12. आिासन -अपील अजधकरण के कमाचाररयों के पास केंद्रीय सरकार द्वारा जिजहत दर के अनुसार भत्ते का दािा करन े का जिकल्प होगा जैसा दक केंद्रीय सरकार के िेतनमान के अनुरूप तत्स्ट्थानी िेतन के कमाचाररयों को लागू होता हो : परंतु िे मकान दकराया भत्ते के जलए पात्र नहीं होंगे यदद उन्हें पात्र साधारण पूल की आिासन घोजषत दकया जाता ह ै और उनके द्वारा आिंरटत सरकारी आिास पर कब्जा कर जलया जाता ह ै । 13.अनुिासजनक कायािाही- अपीलीय अजधकरण के समूह "ग" कमाचाररयों को िेतनमान म ें संबंजधत स्ट्तर के कमाचाररयों पर लागू जनयमों और जिजनयमों के अनुसार उप कायािाही की जाएगी। 14. जनरहता ा -िह व्यजि- (क) जजसने ऐसे व्यजि से जजसका पजत या जजसकी पत्नी जीजित ह,ै जििाह दकया ह ैया जििाह की संजिदा की है; (क) जजसने अपने पजत या अपनी पत्नी के जीजित रहत े हुए दकसी व्यजि से जििाह दकया ह ै या जििाह की संजिदा की ह!ै उि पद पर जनयुजि का पात्र नहीं होगा : परन्त ु यदद केन्द्रीय सरकार का यह समाधान हो जाता ह ै दक ऐसा जििाह ऐसे व्यजि और जििाह के अन्य पिकार को लागू स्ट्िीय जिजध के अधीन अनुज्ञेय ह ै और ऐसा करने के जलए अन्य आधार ह ैं तो िह दकसी व्यजि को इस जनयम के प्रितान से छूट दे सकेगी। 15. सेिा की अन्य ितें.- अपील अजभकरण के समूह "ग" कमाचाररयों की सेिा की अन्य ितें, जजसके जलए इन जनयमों म ें कोई जिजिष्ट उपबंध या अपयााप्त उपबंध प्रदान नहीं दकया गया ह,ै िह ऐसे जनयमों और आदेिों के अनुसार ह,ै जो समय- समय पर उनके कमाचाररयों पर लागू होते हैं। 16. जिजथल करने की िजि - जहां केन्द्रीय सरकार की यह राय ह ै दक ऐसा करना आिश्यक या समीचीन ह,ै िहां िह उसके जलए जो कारण ह,ैं उन्ह ें लेखबद्ध करके, तथा अपील अजभकरण के अध्यि स े परामिा करके इन जनयमों के दकसी उपबंध को दकसी िगा या प्रिगा के व्यजियों की बाबत, आदेि द्वारा जिजथल कर सकेगी। 17. व्यािृजत्त -इन जनयमों की कोई बात, ऐसे आरिण, आय-ु सीमा म ें छूट और अन्य ररयायतों पर प्रभाि नहीं डालेगी, जजनका केन्द्रीय सरकार द्वारा इस संबंध म ें समय-समय पर जारी दकए गए आदेिों के अनुसार अनुसूजचत जाजतयों,4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अनुसूजचत जनजाजतयों, अन् य जपछडे िगों, भूतपूिा सैजनकों और अन्य जििेष प्रिगा के व्यजियों के जलए उपबंध करना अपेजित है। अनुसूची-I [जनयम 3, 4 और 5 देखें] पद का नाम पदों की सख्ं या िगीकरण िते न मरै रक्स का क्या चयन आय-ु सीधी भती हते ुआयु सीमा स्ट्तर पद ह ै अथिा गरै - चयन पद (1) (2) (3) (4) (5) (6) 1. आिुजलजपक 128* साधारण केंद्रीय िेतन मैररक्स लागू नहीं 18 िषा से 27 िषा के बीच ग्रेड- 2 सेिा, समूह ‘ग’ )25500- होता (2024)* रटप्पण 1: केन्द्रीय सरकार द्वारा अराजपजत्रत 81100 रु.( में कायाभार के जारी दकए गए अनुदिे ों या आदिे ों अनुसजचिीय आधार पर स्ट्तर-4 के अनुसार जिभागीय अभ्यर्वथयों के पररितान दकया जलए ऊपरी आयु सीमा 40िषा तक जा सकता है जिजथल की जा सकती ह ै। रटप्पण 2: आयु-सीमा अिधाररत करने के जलए जनणाायक तारीख भारत में अभ्यर्वथयों से आिेदन प्राप्त करने के जलए जनयत की गई अंजतम तारीख होगी और न दक िह अंजतम तारीख जो असम, मेघालय, अरूणाचल प्रदिे , जमजोरम, मजणपुर, नागालैंड, जसदिम, लद्दाख संघ राज्यिेत्र, जहमाचल प्रदिे के लाहोल और स्ट्पीजत जजले तथा चम्बा-जजले के पांगी उपखंड, अंदमान और जनकोबार द्वीप या लिद्वीप के अभ्यर्वथयों के जलए जिजहत की गई ह ै। सीधी भती हते ु अपजे ित िजै िक क्या सीधी भती के पररिीिा अिजध, यदद कोई भती की पद्धजत, सीधी भती द्वारा या प्रोन्नजत और अन्य अहता ा जलए जनधारा रत हो। स ेअथिा प्रजतजनयजु ि अथिा आमले न द्वारा आय ुऔर िजै िक तथा जिजभन्न पद्धजतयों स ेभरी जान ेिाली अहता ा प्रोन्नजत ररजियों की प्रजतितता। िाल ेमामल ेम ें लाग ूहोगी। (7) (8) (9) (10) (i) दकसी मान्यताप्राप्त लागू नहीं होता सीधी भती के जलए दो िषा जलजखत परीिा और जनधााररत गजत से जिश्वजिद्यालय या संस्ट्थान से अंग्रेजी िॉटाहैंड में सीधी भती कौिल दकसी जिधा में जडग्री; और परीिा के आधार पर सीधी भती के जलए दो (ii) कौिल परीिण मानदंड: िषा, जजसके न होने पर प्रजतजनयुजि द्वारा। श्रुतलेख: 10 जमनट @80 डब्ल्यू.पी.एम. )अंग्रेजी(। प्रजतलेखन: कंप्यूटर पर 40 जमनट।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 प्रोन्नजत अथिा प्रजतजनयजुि अथिा आमले न द्वारा भती के मामल ेम ेंि ेश्रजे णया ंजजनस ेप्रोन्नजत अथिा प्रजतजनयजु ि अथिा आमले न दकया जाएगा। (11) प्रजतजनयजु ि:- केन्द्रीय सरकार या राज्य सरकार या संघ राज्यिेत्र या स्ट्िायत्त संगिन या ़ाानूनी या सािाजजनक िेत्र के उपक्रम या न्यायालय या अजधकरण के अजधकारी:- क. (i) मूल संिगा या जिभाग में जनयजमत आधार पर अनुरूप पद धारण करना; या )ii) ग्रेड में पांच िषा की जनयजमत सेिा के साथ सातिें केंद्रीय िेतन आयोग के िेतन मैररक्स में स्ट्तर -3 में एक पद, या )iii) आि िषा की जनयजमत सेिा के साथ सातिें केंद्रीय िेतन आयोग के िेतन मैररक्स में स्ट्तर -2 में एक पद ग्रेड में जनयजमत सेिा. (ख( स्ट्तंभ )7) में सीधी भती के जलए आिश्यक िैिजणक अहता ा और जिजहत अनुभि रखने िाले । (ग( सीमा िुल्क, केंद्रीय उत्पाद िुल्क, सेिा कर या मूल्य िर्वधत कर या राज्य कर या माल और सेिा कर जिभाग में अनुभि को प्राथजमकता दी जा सकती है। रटप्पण 1: प्रजतजनयुजि की अिजध, जजसके अंतगात केन्द्रीय सरकार के उसी या दकसी अन्य संगिन / जिभाग म ें इस जनयुजि से िीक पहले धाररत दकसी अन्य काडर बाह्य पद पर प्रजतजनयजु ि की अिजध ह ैसाधारणतया पांच िषा से अजधक नहीं होगी । रटप्पण 2: प्रजतजनयुजि पर जनयुजि (जजसके अतंगात अल्पकाजलक संजिदा भी ह)ै के जलए अजधकतम आयु सीमा आिेदन प्राप्त करने की अंजतम तारीख को 58 िषा से अजधक नहीं होगी । रटप्पण 3: प्रजतजनयुजि पर जनयुजि के प्रयोजन के जलए, दकसी अजधकारी द्वारा 01 जनिरी, 2016 से पहले या सातिें केंद्रीय िेतन आयोग की जसफाररिों के आधार पर संिोजधत िेतन संरचना को बढाए जाने की तारीख से पहले जनयजमत आधार पर प्रदान की गई सेिा को सातिें केंद्रीय िेतन आयोग के िेतन मैररक्स में संबंजधत स्ट्तर पर प्रदान की गई सेिा माना जाएगा। यदद जिभागीय प्रोन्नजत सजमजत ह,ै तो उसकी संरचना । भती करने में दकन पररजस्ट्थजत यों में संघ लोक सेिा आयोग से परामिा दकया जाएगा। )12( )13( चयन सजमजत)प्रजतजनयजुि पर जिचार करन े के जलए( और पुजष्टकरण सजमजत)पजु ष्टकरण पर लागू नहीं होता जिचार करने के जलए( जो जनम्नजलजखत स ेजमल कर बनेगी 1. अपील अजधकरण रजजस्ट्रार - अध्यि 2. सजचि का नामांदकत व्यजि,राजस्ट्ि जिभाग, जित्त मंत्रालय )अिर सजचि के पद से नीचे नहीं( सदस्ट्य; और 3. जीएसटीएटी के उप रजजस्ट्रार )अध्यि, जीएसटीएटी द्वारा नाजमत( सदस्ट्य। पद का नाम पदों की सख्ं या िगीकरण िते न मरै रक्स का क्या चयन पद ह ै आय-ु सीधी भती स्ट्तर अथिा गरै -चयन हते ु आय ुसीमा पद (1) (2) (3) (4) (5) (6) 2. उच्च श्रेणी 40* (2024) साधारण केंद्रीय िेतन मैररक्स अचयन लागू नहीं होता जलजपक सेिा, समूह ‘ग’ )2,5500रु. – कायाभार के अराजपजत्रत 81100 रु.( में आधार पर अनुसजचिीय स्ट्तर-4 पररितान दकया जा सकता है6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] सीधी भती हते ु अपजे ित िैजिक क्या सीधी भती के जलए पररिीिा अिजध, यदद कोई हो। भती की पद्धजत, सीधी भती और अन्य अहता ा जनधारा रत आय ुऔर िजै िक द्वारा या प्रोन्नजत स ेअथिा अहता ा प्रोन्नजत िाले मामल ेम ें प्रजतजनयजु ि अथिा आमले न लाग ूहोगी। द्वारा तथा जिजभन्न पद्धजतयों स े भरी जान ेिाली ररजियों की प्रजतितता। (7) (8) (9) (10) लागू नहीं होता लागू नहीं होता लागू नहीं होता प्रोन्नजत द्वारा जजसके न हो सकने पर प्रजतजनयुजि द्वारा, प्रोन्नजत अथिा प्रजतजनयजुि अथिा आमले न द्वारा भती के मामल ेम ेंि ेश्रजे णया ंजजनस ेप्रोन्नजत अथिा प्रजतजनयजु ि अथिा आमले न दकया जाएगा। (11) प्रोन्नजत: ऐसा जनम्न श्रेणी जलजपक जजसने सातिें िेतन आयोग के िेतन मैररक्स स्ट्तर 2 में आि िषा जनयजमत सेिा की हो। रटप्पण 1: जहां ऐसे कजनष्ठ व्यजियों के संबंध में जजन्होंने अपनी अहाक या पात्रता सेिा पूरी कर ली ह,ै प्रोन्नजत के जलए जिचार दकया जा रहा हो जहां उनस े ज्येष्ठ व्यजियों के संबंध में भी जिचार दकया जाएगा परंतु यह तब जब दक उसके द्वारा की गई ऐसी अहका या पात्रता सेिा, अपेजित अहका या पात्रता सेिा के आध ेसे अजधक से या दो िषा से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कजनष्ठ व्यजियों सजहत जजन्होंने ऐसी अहका / पात्रता सेिा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी म ें प्रोन्नजत के जलए अपनी पररिीिा की अिजध सफलतापूिाक पूरी कर ली हो । रटप्पण 2: प्रजतजनयुजि पर जनयुजि के प्रयोजन के जलए, दकसी अजधकारी द्वारा 01 जनिरी, 2016 से पहले या सातिें केंद्रीय िेतन आयोग की जसफाररिों के आधार पर संिोजधत िेतन संरचना को बढाए जाने की तारीख से पहले जनयजमत आधार पर प्रदान की गई सेिा को सातिें केंद्रीय िेतन आयोग के िेतन मैररक्स में संबंजधत स्ट्तर पर प्रदान की गई सेिा माना जाएगा। प्रजतजनयजु ि: केन्द्रीय सरकार या राज्य सरकार या संघ राज्यिेत्र या स्ट्िायत्त संगिन या ़ाानूनी या सािाजजनक िेत्र के उपक्रम या न्यायालय या अजधकरण के अजधकारी:- क. (i) मूल संिगा या जिभाग में जनयजमत आधार पर अनुरूप पद धारण करना; या )ii) ग्रेड में पांच िषा की जनयजमत सेिा के साथ सातिें केंद्रीय िेतन आयोग के िेतन मैररक्स में स्ट्तर -3 में एक पद, या )iii) आि िषा की जनयजमत सेिा के साथ सातिें केंद्रीय िेतन आयोग के िेतन मैररक्स में स्ट्तर -2 म ें एक पद ग्रेड में जनयजमत सेिा. Short title and commencement.—(1) These rules may be called the Goods and Services Tax Appellate Tribunal (Recruitment, Salary and other Terms and Conditions of Service of Group ―C" Employees) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.—(1) In these rules, unless the context otherwise requires, - a) "Act" means the Central Goods and Services, Act 2017 (12 of 2017); b) ―Appointing Authority‖ means the Central Government or the Authority to whom the powers are delegated by the Central Government for making appointments of officers and employees in the Appellate Tribunal by a notification; c) "Appellate Tribunal or GSTAT" means the Goods and Services Tax Appellate Tribunal constituted under section 109 of the Act; d) ―President‖ means the President of the Appellate Tribunal appointed under section 110 of the Act;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 13 e) ―Schedule‖ means the Schedules annexed to these rules. Procedure for appointment on deputation basis.—The Appointing Authority shall invite applications for the posts through wide advertisement including publishing invariably in Employment News and selection shall be made on the basis of recommendation of the Selection Committee prescribed in Schedule-I for the respective posts. 9. Absorption of employees on appointment on deputation.—(1) Notwithstanding anything contained in the provisions of these rules, the persons appointed on deputation basis, who fulfill the qualifications and experience laid down in these rules and who are considered suitable by Departmental Promotion Committee, shall be eligible for absorption, in respective grade subject to the condition that such persons exercise their option for the absorption (2) Such absorption shall also be subject to the condition that their parent departments or cadre controlling authorities do not have any objection to their being absorbed in the Appellate Tribunal. (3) Seniority of employees mentioned in sub-rule (1) shall be determined with reference to the date of their absorption to the post concerned. (4) Once such employees exercise their option for absorption, they shall not be eligible to return to their parent departments or cadre at any point thereafter. 10. Committees for promotion, confirmation or deputation.- (1) The Central Government shall constitute Departmental Promotion Committee, Selection Committee and Confirmation Committee as prescribed in Schedule-I. (2) Where the Chairperson or Member of the said Committees as prescribed in Schedule-I is not available, the Central Government may nominate a person, not lower than the rank of Joint Secretary, as Chairperson or Member of the Committee, as the case may be, as it may deem appropriate. (3) Any two Members of the Committees present shall constitute a quorum for any meeting and every decision of the Committees shall be based on majority of the Members present in the meeting. (4) The Chairperson of the Committees shall not have a casting vote and in case of a tie in decision, the matter may be referred to the Central Government for appropriate directions. (5) No decision of the said Committees shall be invalid merely by reason of any vacancy or defect in the constitution of the said Committees. 11. Conditions of service.—(1) The conditions of service of the Group ―C‖ employees of the Appellate Tribunal in matters of pay, allowances, leave and other conditions of service shall be regulated in accordance with such rules and regulations as are for the time being applicable to employees of the corresponding level in pay matrixof the Central Government. (2) In matters relating to Provident Fund Scheme, Group Insurance or any other Insurance Scheme, age of superannuation, pension and retirement benefits, the employees of the Tribunal working on deputation basis shall continue to be governed by the relevant rules as applicable to them in their parent Ministry or Department or organisation. (3) The Appellate Tribunal shall recover contributions toward such schemes from their salary and remit the amount immediately to the lending Ministry or Department or organisation and any loss of interest on account of late remittance shall be borne by the Appellate Tribunal.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) The employees of the Tribunal shall have the option to avail medical facilities as per their entitlement in the parent organisation or as specified in Schedule-II annexed to these rules. (5) The employees of the Tribunal shall be posted, subject to vacancy, either in the Principal Bench or any of the State Benches at the discretion of the Selection Committee. 12. Accommodation.—The employees of the Appellate Tribunal shall have the option of claiming House Rent Allowance in accordance with the rate prescribed by the Central Government as applicable to employees of the corresponding scales of pay of the Central Government: Provided that they shall not be eligible for House Rent Allowance in case they are declared eligible for general pool residential accommodation and occupies such a Government accommodation allotted to them. 13. Disciplinary proceedings.—The Group ―C‖ employees of the Appellate Tribunal shall be subject to disciplinary proceedings as per rules and regulations applicable to employees of the corresponding level in pay matrix of the Central Government. 14. Disqualification.—No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post: Provided that the Central Government may, if satisfied the such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 15. Other conditions of service.—Other conditions of service of the Group ―C‖ employees of the Appellate Tribunal, for which no specific provision or insufficient provision has been provided in these rules, shall be regulated in accordance with such rules and orders, as are, from time to time, applicable to employees of the corresponding level in pay matrix of pay of the Central Government stationed at those places. 16. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, in consultation with the President of the Appellate Tribunal by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 17. Saving.—Nothing in these rules shall effect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Schedules Tribes, Other Backward Classes, Ex- servicemen and other special categories of persons in accordance with the rules and orders issued by the Central Government from time to time in this regard. (2) The reimbursement of outdoor medical expenses during the year shall be limited to the actual expenses or one month‗s pay on the 1st January of the year (Basic pay + Dearness Allowance) whichever is less. (3) The claim should be supported by doctor‗s prescription and the original cash memos or bills for treatment by the doctor and purchase of medicines and the release of increment or promotion during the year shall not affect the reimbursement limit as on the 1st January. (4) For the employees joining during the year, the annual entitlement shall be restricted on pro-rata basis. (5) The outdoor treatment shall be taken from the authorised medical attendants from the panel to be maintained by the Tribunal. 2. Indoor treatment.- (1) For the purpose of indoor treatment, employees of the Tribunal shall be entitled for medical treatment at hospitals authorised by the Tribunal in this behalf, and for this purpose, the cost of treatment including hospital accommodation, nursing home facility shall be as per the provisions of the Central Services (Medical Attendance) Rules, 1944 as applicable to the Central Government employees drawing equivalent pay. (2) The authorised hospitals for the purpose of clause (1) above shall be the same as are available to the Central Government employees regulated by Central Services (Medical Attendance) Rules, 1944.
