And whereas, the Central Government, in exercise of the powers conferred by Section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838 (E), dated 05.12.2008 and amended vide G.S.R. 950(E) dated 03.12.2010, G.S.R 15(E), dated 12.01.2011, G.S.R. 756(E), dated 12.10.2011, G.S.R. 778(E), dated 16.12.2013 and G.S.R. 26(E), dated 16.01.2014 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels. Ltd., Nagpur for levying and collecting fee on mechanical vehicles for the use of the stretch from Jalandhar to end of Jammu Bypass Section from km. 4.230 to km. 117.750/4.000, km. 4.000 to km. 97.200/0.000 and km. 0.000 to km. 15.000 on National Highway No. 1A in the States of Punjab, Himachal Pradesh and Jammu & Kashmir on OMT basis on and from the Date of Commercial Operation declared by the Authority and till the termination date as specified in the Agreement superseding the Notifications published vide S.O. No. 764 (E). dated 10.04.2012 and S.O. No. 1593 (E), dated 16.07.2012. And whereas, the Date of Commercial Operation has not been declared so far. To ensure, that there is no loss to the public exchequer in this intervening period, in exercise of the powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length of 125.870 km. (including 123.154 km road and 2716.33 m of structures having length more than 60 m) for use of the four and more lane sections (hereinafter referred to as “base rate”) of the stretch from km. 4.230 to km. 117.750/4.000, km. 4.000 to km. 16.350 (Jalandhar to Pathankot Section) of National Highway No. 1A in the States of Punjab and Himachal Pradesh on the Type of Vehicles specified in column (1) of the Table 1 below and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:— TABLE 1 Type of vehicle Base rate of fee per km. for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three – axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle 3.45 Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14, and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 4. For multiple journey on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one way journeys Period of validity allowed One and half times of the fee for one way Two Twenty four hours from the time of journey payment Two-third of amount of the fee payable for Fifty One month from date of payment fifty single journeys 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle. 6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall not be permitted to use the National Highway or crossing the Toll Plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the Toll Collecting agency, equal to 10 times of the fee applicable to such category of mechanical vehicles under the rules. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules. 8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules. 9. Based on the Base Rate of Fee per km. for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 10. The present value of Capital Cost of the Project is Rs. 743.72 Crore (for influence length of Chollang Toll Plaza) + Rs. 679.61 Crore (for influence length of Harsa Mansar Toll Plaza) = Rs. 1423.33 Crore (Rupee One Thousand Four Hundred Twenty Three Crore Thirty Three Lakhs only). The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules. 11. This arrangement of fee collection by the Authority will continue till the commercial operation date gets declared under the Concession Agreement dated 16.05.2013 on OMT basis entered into between the Authority and the Concessionaire, M/s.
