(1) इन दििाजनिेिों का संजिप्त नाम िल कृजि इनपुट अनुपालन प्रमाणपत्र दििाजनिेि ह ै। (2) य ेरािपत्र म ेंउनके प्रकािन की तारीख से प्रिृत्त होंगे। िल कृजि इनपटु अनपु ालन प्रमाणपत्र दििाजनिेि 1. अनपु ालन प्रमाणपत्र- (1) िल कृजि इनपुट अनुपालन प्रमाणपत्र िारी दकया िाएगा, यदि - 2068 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) यह ऐस े औिधीय रूप स े सदिय पिाथच, रोगाणरु ोधी एिेंट या अन्द्य सामग्री से मक्तु ह ै िो तटीय िलकृजि प्राजधकरण अजधजनयम, 2005 की धारा 12 क और तटीय िलकृजि प्राजधकरण जनयम, 2024 के जनयम 18 के अधीन प्राजधकरण के आिेि द्वारा जनर्िष्टच मानि स्ट्िास्ट््य को नुकसान पहचं ा सकता ह।ै (ख) उक्त जनयमों के जनयम 18 के अधीन प्राजधकरण द्वारा जनर्िष्टच मानकों का अनुपालन करता है, (जिसे इसमें इसके पश्चात उक्त जनयमों कहा गया ह)ै । (2) तटीय िल कृजि गजतजिजधयों में उपलब्ध कराए गए या उपयोग दकए गए सभी तटीय िल कृजि इनपुट, प्रमाणीकरण की आिश्यकता से प्राजधकरण द्वारा जििेि रूप स ेछूट प्राप्त लोगों को छोड़कर, उक्त जनयमों के जनयम 18 के उप-जनयम (6) के अधीन िारी अनुपालन का िैध प्रमाण पत्र होना चाजहए। (3) सभी तटीय िलकृजि इनपटु जिन्द्होंने अनपु ालन का प्रमाण पत्र प्राप्त नहीं दकया है, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से छह महीने के भीतर प्रमाण पत्र प्रिान करने के जलए आिेिन िमा करेंगे और ऐसी तारीख स े एक ििच के भीतर सभी आिश्यकताओं का अनुपालन करेंगे। (4) जििेिी िलकृजि इनपुट और िलकृजि उपयोग के जलए अन्द्य अनुपूरकों के भारतीय जिजनमाचताओं और आयातकों या जितरकों िोनों को प्राजधकरण से अनुपालन प्रमाणपत्र प्राप्त करना होगा । (5) अनपु ालन प्रमाणपत्र हस्ट्तातं रणीय नहीं होगा। (6) अनपु ालन प्रमाणपत्र िारी होने की तारीख स े पांच साल की अिजध के जलए िैध होगा िो पैरा (8) म ें जनर्िष्टच तरीके से समान अिजध के जलए निीकरणीय होगा। (7) प्रत्सयेक आिेिन के जलए िस हिार रुपय े (10,000/- रुपये) का गरै -िापसी योग्य प्रसंस्ट्करण िुल्क या तो इलेक्ट्रॉजनक रूप स ेया तटीय िलकृजि प्राजधकरण के पि में तैयार जडमांड ड्राफ्ट के रूप में भगु तान दकया िाएगा। 2. लबे ललगं मानक - (1) लेबललंग पर अन्द्य िैधाजनक आिश्यकताओं के अजतठरक्त िल कृजि इनपुट के पैकेि या कंटेनरों पर लेबल, जबना दकसी िोहराि के, उप-पैरा (4) में जनर्िष्टच जििरण िाजमल होंगे, और एक जिजिष्ट स्ट्थान पर प्रिर्ितच होंगे िह कंटेनर जिसमें पिाथच पकै दकया िाता ह ैऔर प्रत्सयेक अन्द्य आिरण जिसमें िह कंटेनर पैक दकया िाता ह।ै (2) लेबल स्ट्पष्ट रूप स े िल कृजि इनपुट की मलू संरचना, खुराक, बैच संख्या, समाजप्त तारीख और उप-पैरा (4) म ें जनर्िष्टच अन्द्य महत्सिपूण च जििरणों को इंजगत करेगा, परन्द्त ु दक लेबल म ें सीजमत िानकारी होन े की जस्ट्थजत म ें ब्रोिर अजनिायच होंगे। (3) लेबल में सामग्री दिखान े िाले जहस्ट्से में सामान्द्य िब्ि िैसे जिटाजमन, खजनि, आिश्यक पोिक तत्सि आदि नहीं होंगे, इसके बिाय, जिटाजमन, खजनि, आदि के जिजिष्ट िैज्ञाजनक नाम का उल्लेख दकया िाएगा; (4) लेबल म ेंजनम्नजलजखत जििरण िाजमल होंगे, लेदकन इन्द्हीं तक सीजमत नहीं होंग,े अथाचत्: - (क) िलकृजि इनपटु का नाम: िल कृजि इनपुट का व्यापार नाम बड़े अिरों या प्रमुख फॉन्द्ट म ें होगा िैसा दक प्राजधकरण द्वारा िारी अनपु ालन प्रमाणपत्र में उजल्लजखत ह;ै (ख) सामग्री की िद्धु मात्रा : (i) ििन, माप, मात्रा, सामग्री :इकाइयों की संख्या और गजतजिजध की इकाइयों की संख्या, िसै ा भी मामला हो, के संिभच म ेंिुद्ध सामग्री का सही जििरण ििाचया िाएगा। (ii) संकेजतत मान मीठरक प्रणाली में होंगे;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (ग) अियिों का नाम और सरं चना : िलकृजि इनपुट के सभी प्रमुख अियिों का िैज्ञाजनक नाम अनुमाजनत सांरता, उपयुक्त इकाई में व्यक्त संरचना, िैसा लागू हो, के साथ उजल्लजखत दकया िाएगा; (घ) उपयोग के जलए जसफाठरिें : लबे ल में िांजछत लाभ प्राप्त करन े के जलए इजछछत लाभ, जनधाचठरत खुराक और आिेिन की अनुसूची स्ट्पष्ट रूप से इंजगत की िाएगी; ड. आििे न की जिजध : (i) फीड टॉप ड्रेलसंग के रूप में िल कृजि इनपुट के अनुप्रयोग की जिजध, पूरे तालाब में प्रसारण या कोई अन्द्य जिजध प्रिान की िाएगी; (ii) आिेिन से पहले पूि-च उपचार िसै े, पानी में जभगोना या रात भर दकण्िन, यदि कोई हो, का स्ट्पष्ट रूप स े उल्लेख दकया िाएगा; (iii) लेबल में िगह बचाने के जलए इसे ब्रोिर तक सीजमत दकया िा सकता ह ै और ऐसे िलकृजि इनपुट के साथ ब्रोिर अजनिायच ह;ै (ङ) मतभिे (यदि कोई हो) : दकसी भी अन्द्य िल कृजि इनपुट के साथ उपयुक्त नहीं होने िाली या जििेि संस्ट्कृजत प्रणाजलयों, प्रिाजतयों या जिकास चरणों में उपयोग नहीं की िाने िाली िानकारी को लेबल में सजचत्र प्रजतजनजधत्सि के साथ स्ट्पष्ट रूप से ििाचया िाना चाजहए। (छ) बचै सख्ं या : (i) एक जिजिष्ट रेस करने योग्य बैच नंबर जिसमें जिजनमाचण इकाई में िल कृजि इनपुट का उत्सपािन दकया गया था, लेबल पर ििाचया िाएगा; (ii) ऐसे बैचों और प्रजतधारण नमून े का जििरण पता लगाने के जलए जिजनमाचण सुजिधा या जितरण इकाई या गोिाम सुजिधा पर उपलब्ध होगा; (iii) बैच नंबर का प्रजतजनजधत्सि करन े िाला आंकड़ा 'बैच नंबर' से पहले लगाया िाएगा; (ि) आयात दकया गया लाइससें नबं र (यदि आयात दकया िाता ह)ै : आयाजतत सामग्री और भारत म ें आयाजतत और जिपणन दकए गए संपूण च िल कृजि इनपुट के साथ जनर्मचत िल कृजि इनपुट लेबल, लाइसेंस नंबर या सेनेटरी आयात परजमट नंबर, िहां भी लागू हो, पर अंदकत होगा, जिसके अधीन िल कृजि इनपुट ह ै आयाजतत, पहले 'आयात लाइसेंस नंबर' या सेनेटरी आयात परजमट नंबर िुड़ा होना चाजहए और िल कृजि इनपुट का आयात और जिपणन करन े िाली कंपनी के संपकच जििरण का भी स्ट्पष्ट रूप से उल्लेख दकया िाना चाजहए; (झ) जनमाणच की तारीख: जनमाणच की तारीख महीन े और िि च के अनसु ार होगी; (ञ) समाजप्त की तारीख : (i) समाजप्त की तारीख महीने और ििच के संिभच में होगी और इसका मतलब यह होगा दक महीन े के आजखरी दिन तक िल कृजि इनपुट की जसफाठरि की िाती ह।ै (ii) समाजप्त की तारीख के पहले 'समाजप्त तारीख' लगाई िाएगी। (iii) यह आिश्यक ह ै दक, िल कृजि इनपुट के आधार पर महीने और ििच के संिभच म ें "बस्ट्े ट जबफोर" ििाचया िाएगा; (ट) भडं ारण की जस्ट्थजत: समाजप्त तारीख तक िल कृजि इनपुट की िमता को बनाए रखन े के जलए आिश्यक उजचत भंडारण की जस्ट्थजत िैसे िंडी, अंधेरी िगह, सूरि की रोिनी से बचना आदि का स्ट्पष्ट रूप से उल्लेख दकया िाना चाजहए; (ि) 'मानि उपभोग के जलए नहीं' का सकं ेत: मनुष्यों द्वारा दकसी भी संभाजित उपभोग स े बचन े के जलए लेबल म ें नीचे की पट्टी म ेंबड़े फॉन्द्ट आकार के साथ 'मानि उपभोग के जलए नहीं' जलखा होना चाजहए;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ड) 'केिल िलीय िीि के उपयोग के जलए' का संकेत: लेबल पर िलीय िंतओंु की उजचत छजि ििाचने िाला एक प्रतीक होना चाजहए जिसके जलए िल कृजि इनपुट प्रिाजसत दकया िाना है; (ढ) जनमातच ा और आयातक का नाम और पता: जनमाचता और आयातक का पूरा नाम और पता तटीय िलकृजि प्राजधकरण को प्रस्ट्तुत दकया िाएगा, जिसमें स्ट्थान या गांि, तालुक, जिला, राज्य और जपन कोड का नाम िाजमल होगा; (ण) संकेत 'इसम ें एंटीबायोठटक्ट्स नहीं हैं' या 'एंटीबायोठटक्ट्स से मुक्त': लेबल पर नीचे की पट्टी म ें 'इसमें एंटीबायोठटक्ट्स नहीं ह'ै या 'एंटीबायोठटक्ट्स से मुक्त' जलखा होना चाजहए, जिसमें बड़े फॉन्द्ट आकार स्ट्पष्ट रूप से एक बॉक्ट्स में अलग रंग के साथ प्रिर्िचत होंगे; (त) प्रमाणीकरण सख्ं या: उक्त जनयमों के जनयम 18 के उप-जनयम (3) के अधीन प्राजधकरण द्वारा छूट प्राप्त लोगों को छोड़कर, भारत म ें जनर्मचत या जिपणन दकए गए प्रत्सयेक िल कृजि इनपुट को अपन े लबे ल पर उस िल कृजि इनपुट के जलए प्राजधकरण द्वारा िारी प्रमाणन संख्या अंदकत करनी होगी। मोटे अिरों म ें "सीएए प्रमाजणत एक िलकृजि इनपुट" या प्राजधकरण द्वारा जनर्िष्टच कोई भी िल जचह्न जलखें। 3. प्रमाणन प्रदिया. - (1) प्रत्सयके िल कृजि इनपुट के जलए अलग-अलग आिेिन उस िल कृजि इनपुट के अनुपालन का प्रमाण पत्र प्रिान करने के जलए उक्त जनयमों के प्ररूप-III में दकया िाएगा, जिसे प्राजधकरण की िेबसाइट - www.caa.gov.in से डाउनलोड दकया िा सकता ह।ै उक्त जनयमों की अनुसूची-III में जनर्िष्टच सभी आिश्यक िस्ट्तािेिों के साथ प्रस्ट्ततु दकया गया। (2) केिल िल कृजि इनपुट और िल कृजि उपयोग के जलए अन्द्य परू कों के जनमाचता अनुपालन प्रमाणपत्र के जलए आिेिन करन े के पात्र होंग,े यदि ऐसे िल कृजि इनपुट भारत म ेंजनर्मचत होते ह।ैं (3) केिल िल कृजि इनपुट और िल कृजि उपयोग के जलए अन्द्य परू कों के आयातक ही अनुपालन प्रमाणपत्र के अनुिान के जलए आिेिन करने के पात्र होंगे। (4) प्राजधकरण द्वारा अपेजित सभी िस्ट्तािेि प्राजधकरण द्वारा आिेिन प्राप्त होन े की तारीख से साि कैलडें र दिनों के पूरा होन े से पहल ेिमा दकए िाएंगे, ऐसा न करने पर आिेिक को सूजचत करन ेऔर िस रुपये के प्रसंस्ट्करण िुल्क के साथ आिेिन को िोिपणू च मानकर बंि कर दिया िाएगा। हिार िब्त कर प्राजधकरण के खाते में िमा करा दिए िाएंगे। (5) यदि जपछला आिेिन िोिपणू च मानकर बंि कर दिया गया ह ैतो आिेिन नये जसरे से प्रस्ट्तुत दकया िायेगा। 4. अनसु चू ी III के अधीन आिश्यक िस्ट्ताििे ों का जििरण - (1) जनमाचताओं और आयातकों िोनों के जलए आमतौर पर जनम्नजलजखत िस्ट्तािेिों की आिश्यकता होगी, अथाचत:् - क. परीिण और अंिांकन टेलस्ट्टंग एंड केजलब्रेिन प्रयोगिालाओं के जलए दकसी भी राष्ट्रीय प्रत्सयायन बोड च से प्राजधकरण द्वारा जनर्िष्टच एंटीबायोठटक ििाओं, उनके मलू यौजगकों और मेटाबोलाइट्स की उपजस्ट्थजत के जलए आिेिन िमा करन े की तारीख से एक महीने स े पहल े नहीं दकए गए परीिण के जलए िल कृजि इनपुट की मलू एंटीबायोठटक परीिण ठरपोट च टेंडेम मास स्ट्पेक्ट्रोमेरी जिजध के साथ तरल िोमटै ोग्राफी का उपयोग करके उक्त एंटीबायोठटक अििेिों के परीिण की गुंिाइि िाली मान्द्यता प्राप्त सरकारी या जनिी प्रयोगिाला; ख् . जनमाचण या आयात के प्रत्सयेक बैच से प्रत्सयेक िल कृजि इनपुट के कम स े कम 500 ग्राम या 500 जमलीग्राम का प्रजतधारण नमनू ा ऐस े िल कृजि इनपुट की समाजप्त की अिजध से अजधक की अिजध के जलए जिजनमाचण या जितरण इकाई म ें रखा िाएगा और िस्ट्तािेिी साक्ष्य िैसे स्ट्कैन की गई कॉपी प्रत्सयेक िल कृजि इनपुट के जलए नमूना प्रजतधारण ठरकॉडच के निीनतम पृष्ठ का, िो संग्रहीत निीनतम नमूने का जििरण और ऐसी भडं ारण सुजिधा की तस्ट्िीरें दिखाता ह ैऔर प्ररूप-ड.-1 में घोिणा प्रस्ट्ततु करता ह।ै (2) सभी प्रमाजणत िलकृजि इनपुट को उसके प्रमाणीकरण की समाजप्त से पहल े कम स ेकम एक बार प्राजधकरण द्वारा यािजृ छछक परीिण के अधीन दकया िाएगा;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (3). यह सुजनजश्चत करन े के जलए दक दकसी अन्द्य पि द्वारा इसकी नकल न की िाए, जनमाचता अपनी स्ट्ियं की सील या छेड़छाड़ रोधी तंत्र जडिाइन कर सकता ह ै और नमूना लते े समय िल कृजि इनपुट की िास्ट्तजिकता की पुजष्ट करने के जलए आिेिक द्वारा प्राजधकरण को दिए गए आिेिन में इसका उल्लेख दकया िाएगा। (4) भारत में जनर्मचत िलकृजि इनपुट के मामल े म,ें अनुपालन प्रमाणपत्र के जलए दकसी भी आिेिन के साथ उप- पैरा (1) म ेंजनर्िष्टच िस्ट्तािेिों के अजतठरक्त जनम्नजलजखत िस्ट्तािेि भी संलग्न होन े चाजहए, अथातच ्: - (क) कंपनी/फमच का जििरण जनम्नानुसार ह:ै- (i) कंपनी जनगमन प्रमाण (कंपनी के जलए पता प्रमाण); (ii) सूक्ष्म, लघु और मध्यम उद्यम; और (iii) िस्ट्तु एिं सेिा कर प्रमाणपत्र। (ख) जिजनमाचण सुजिधा का जििरण जनम्नानुसार ह:ै- (i) सिम प्राजधकारी से जिजनमाचण इकाई या कारखाने आदि के रजिस्ट्री का प्रमाण पत्र; (ii) कारखाने के रूप म ेंकाम करन ेका लाइसेंस; (iii) दकसी भी सुजिधा प्रमाणन का प्रमाण; (iv) कोई भी प्रदिया प्रमाणन िैसे अंतराष्ट्रच ीय मानकीकरण संगिन या सिोत्तम एक्वाकल्चर प्रैजक्ट्टस या गुड मैन्द्युफैक्ट्चररंग प्रैजक्ट्टस या खतरा जिश्लेिण महत्सिपूण च जनयत्रं ण लबंि ुआदि। (ग) अन्द्य िस्ट्तािेज़ जनम्नानुसार ह:ैं- (i) जिस्ट्तृत प्रदिया फ़्लोचाटच िो उत्सपािन म ें जनमाचता द्वारा अपनाई गई इन-प्रोसेस गुणित्ता जनयत्रं ण प्रणाली के एक भाग के रूप म ेंपरीिण प्रदिया से िुड़े चेकपॉइंट्स तक सीजमत नहीं होगा; (ii) प्रदिया प्रमाणन िो एंटीबायोठटक मुक्त उत्सपािन या एंटीबायोठटक मुक्त सामग्री के साथ-साथ उत्सपािन प्रदिया के जलए प्ररूप-ङ-2 में नोटरीकृत स्ट्ि-घोिणा सुजनजश्चत करता ह;ै (iii) िल कृजि इनपुट और उत्सपािन प्रदिया से संबंजधत इकाई म ेंबनाए गए ठरकॉडच की सूची; (iv) यदि एक्वाकल्चर इनपुट समझौते (3) के अधीन व्यापारी जनमातच ा के रूप में जनर्मचत दकया िाता है, आिेिक के स्ट्िाजमत्सि िाली सुजिधा में नहीं, तो ऐसे समझौत े की प्रजत प्रस्ट्ततु की िाएगी और ऐसे मामल े म,ें अनुपालन की जिम्मेिारी िोनों पिों पर होगी। (5) जििेि से आयाजतत िलकृजि इनपुट के मामले में, अनुपालन प्रमाणपत्र के जलए प्रत्सयेक आिेिन के साथ उप-पैरा (1) में जनर्िष्टच िस्ट्ताििे ों के अजतठरक्त जनम्नजलजखत िस्ट्तािेि भी संलग्न होन े चाजहए, अथाचत:् - (i) भारत म ें आयात करन े िाली कंपनी के रजिस्ट्री का प्रमाण िैस े जनगमन का प्रमाण पत्र, आयातक लाइसेंस, सूक्ष्म, लघ ुऔर मध्यम उद्यम, माल और सेिा कर, आदि; (ii) आयात करत े समय िल कृजि इनपुट की एंटीबायोठटक-मुक्त जस्ट्थजत दिखाने िाले सिम प्राजधकारी से स्ट्िास्ट््य प्रमाण पत्र या पिु जचदकत्ससा प्रमाण पत्र या मूल िेि के सिम प्राजधकारी स े कोई एंटीबायोठटक-मुक्त प्रमाण पत्र और ऐसे प्रमाण पत्र के अभाि में प्ररूप-ङ-2 में जनमाचता से जिजधित नोटरीकृत घोिणा; (iii) आयाजतत िलकृजि इनपुट पर आयातक द्वारा बनाए गए ठरकॉडच का जििरण या सूची, जिसकी मूल प्रजत मांग पर प्रस्ट्तुत की िा सकती है; (iv) िल कृजि इनपुट जितठरत करने के जलए प्राजधकरण की प्रजत या जििेिी प्रमुख जनमाचता और भारतीय आयातक के बीच समझौते की प्रजत; (v) इकाई के भीतर पालन की िान े िाली परीिण प्रदियाओं या जििेिी जनमाचता से ऐसे दकसी भी प्रासंजगक िस्ट्तािेि के साथ जिजनमाचण प्रदिया चरणबद्ध (फ्लो चाटच);6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (vi) दकसी भी प्रदिया प्रमाणन िसै े दक अंतराष्ट्रच ीय मानकीकरण संगिन या सिोत्तम एक्वाकल्चर प्रैजक्ट्टस / गुड मैन्द्युफैक्ट्चररंग प्रैजक्ट्टस या जििेिी जनमाचता से खतरा जिश्लेिण महत्सिपूणच जनयंत्रण लबंि;ु (vii) दकसी भी सुजिधा प्रमाणीकरण का प्रमाण। 5. अनपु ालन प्रमाणपत्र का निीनीकरण.- (1) उक्त जनयमों के प्रारूप -III में आिेिन ऐसे प्रमाण पत्र की समाजप्त से तीन महीने पहले िल कृजि इनपुट के अनुपालन के प्रमाण पत्र के निीनीकरण के जलए प्रस्ट्तुत दकया िाएगा, जिसमें िस हिार रुपय े (रु. 10,000/-) के गरै -िापसी योग्य प्रसंस्ट्करण िुल्क का भगु तान दकया िाएगा, भुगतान या तो इलेक्ट्रॉजनक रूप से या तटीय िलकृजि प्राजधकरण के पि में तैयार दकए गए जडमांड ड्राफ्ट के रूप में , उक्त जनयमों की अनुसूची-III में जनर्िष्टच जनम्नजलजखत िस्ट्तािेिों के साथ दिया िाएगा , अथाचत;् - (i) दकसी भी राष्ट्रीय परीिण और अंिांकन (टेलस्ट्टंग एडं केजलब्रेिन) प्रयोगिाला प्रत्सयायन बोडच से मान्द्यता प्राप्त सरकारी या जनिी प्रयोगिाला से एंटीबायोठटक, उनके माता-जपता और मेटाबोलाइट्स की उपजस्ट्थजत के जलए आिेिन िमा करने की तारीख से एक महीने स े पहले दकए गए परीिण के जलए िल कृजि इनपुट की मलू एंटीबायोठटक परीिण ठरपोटच टेंडेम मास स्ट्पेक्ट्रोमेरी जिजध के साथ तरल िोमैटोग्राफी का उपयोग करके उक्त एंटीबायोठटक अििेिों के परीिण की गुंिाइि के साथ; (ii) पैरा (5) म ें जनर्िष्टच आिश्यकताओं के अनपु ालन में, पठरितचन के मामल े म,ें यदि कोई हो, संिोजधत लेबल और ब्रोिर; (iii) प्रारूप -ड.-3 म ें नोटरीकृत स्ट्ि-घोिणा । (2) यदि प्राजधकरण द्वारा आिेिन में कोई कमी पाई िाती है, तो सुधार या अजतठरक्त िस्ट्तािेिी आिश्यकताएं ऐसे प्रमाणीकरण की समाजप्त से पहले पतैं ालीस कैलेंडर दिनों के भीतर प्रस्ट्तुत की िाएंगी, ऐसा न करने पर आिेिन िोिपणू च के रूप में बंि कर दिया िाएगा और प्रसंस्ट्करण िल्ु क िस हिार रुपय े (10,000/-), िब्त कर जलए िाएंग े और आििे क को सूजचत करते हए प्राजधकरण के खाते म ेंिमा कर दिए िाएंगे। (3) इस पैरा की आिश्यकताओं के संतोििनक अनुपालन पर, प्राजधकरण आिेिन प्राप्त होन े की तारीख स े साि दिनों की अिजध के भीतर अनुपालन प्रमाणपत्र को निीनीकृत करेगा। 6. प्रितनच तत्रं .- (1) प्राजधकरण के तकनीकी जनिेिक की अध्यिता म ें एक जनरीिण सजमजत होगी जिसमें जनम्नजलजखत संस्ट्थानों के प्रजतजनजध िाजमल होंगे, अथाचत:्- (i) उपमंडल या जिला स्ट्तरीय सजमजतयााँ या संबंजधत राज्य का मत्सस्ट्य पालन जिभाग; (ii) केंरीय ओिजध मानक जनयंत्रण संगिन का प्रजतजनजध िो सहायक ओिजध जनरीिक के पि से नीच ेन हो; (iii) समुरी उत्सपाि जनयाचत जिकास प्राजधकरण के प्रजतजनजध; (iv) िेत्र में दकसी भी भारतीय कृजि अनुसंधान पठरिि, मत्सस्ट्य पालन संस्ट्थान से प्रजतजनजध, भारतीय कृजि अनुसंधान पठरिि-केंरीय खारा िल िलकृजि संस्ट्थान, केंरीय समुरी मात्सस्ट्यकी पालन अनुसंधान संस्ट्थान और केंरीय मात्सस्ट्यकी पालन जििा संस्ट्थान। (2) सजमजत अनुपालन के अनरूु प जनमाचताओं या आयातकों की भंडारण या जिजनमाचण सुजिधाओं का यािजृ छछक जनरीिण करेगी। (3) भारत में जनर्मचत या जिपणन दकए गए िल कृजि इनपुट की जनगरानी के जलए प्राजधकरण द्वारा एक टास्ट्क फोसच का गिन दकया िाएगा जिसमें प्राजधकरण, जिला स्ट्तरीय सजमजतयों और समुरी उत्सपाि जनयातच जिकास प्राजधकरण के प्रजतजनजध िाजमल होंगे। (4) प्राजधकरण द्वारा गठित टास्ट्क फोसच जिजनमाचण सुजिधा या भंडारण सुजिधा, एक्वा िकु ानों, फामच, अंडि उत्सपजत्त िाला (हचै री) इत्सयादि से यािजृछछक रूप स े िल कृजि इनपुट नमून े एकत्र करेगा और जनमाचता या आयातक कंपनी िह सुजिधा िहां से नमूना एकत्र दकया िाता ह ैप्राजधकरण द्वारा एकत्र दकए गए नमून े की लागत की प्रजतपूर्तच करेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (5) िलकृजि इनपुट के मामल े में, जिसके जलए सील या छेड़छाड़ रोधी तंत्र जनमाचता द्वारा घोजित दकया गया है, टास्ट्क फोसच नमूना लेन े के िौरान, पैकेलिंग के साथ समामेजलत सील या छेड़छाड़ रोधी तंत्र की अिण्ु णता सुजनजश्चत करने के जलए इनपुट की पैकेलिंग को खोलगे ा िैसा दक आिेिन में उजल्लजखत ह ैऔर परीिण के जलए प्रस्ट्तुत करते समय िल कृजि इनपुट की िास्ट्तजिकता सुजनजश्चत करने के जलए नमूनों को टास्ट्क फोसच की उपजस्ट्थजत में सील कर दिया िाएगा। (6) प्राजधकरण िल कृजि इनपटु के परीिण के जलए प्रयोगिालाओं को सूचीबद्ध करेगा। (7) प्राजधकरण टास्ट्क फोसच का प्रजतजनजधत्सि करने िाला व्यजक्त टास्ट्क फोसच द्वारा एकत्र दकए गए नमनू ों को प्राजधकरण द्वारा सूचीबद्ध और अनुमोदित प्रयोगिालाओं म ें प्रस्ट्तुत करेगा और प्रयोगिालाएं आिश्यक कारचिाई के जलए ठरपोट चसीधे प्राजधकरण को प्रस्ट्तुत करेंगी। (8) यदि िल कृजि इनपुट लगातार िो ििों की अिजध में प्राजधकरण द्वारा दकए गए कई परीिणों में एंटीबायोठटक- मुक्त जस्ट्थजत बनाए रखता ह,ै तो नमून े के संग्रह और परीिण की आिृजत्त कम हो िाएगी। (9) प्राजधकरण एक आििे द्वारा, टास्ट्क फोसच की भूजमकाओं को रेखांदकत करते हए, नमूनाकरण और परीिण के जलए एक प्रोटोकॉल जनर्िष्टच करेगा। (10) यदि दकसी िल कृजि इनपुट का परीिण सकारात्समक पाया िाता ह ै या दकसी राष्ट्रीय जनयामक कायचिम िैस े दक एंटीबायोठटक अििेिों के जलए राष्ट्रीय अििेि जनयंत्रण योिना के अधीन टास्ट्क फोसच या दकसी सिम प्राजधकारी द्वारा ठरपोटच दकया िाता ह,ै तो ऐसे िल कृजि इनपुट का प्रमाण पत्र तत्सकाल प्रभाि से जनलंजबत कर दिया िाएगा। िल कृजि इनपुट को प्रमाजणत िल कृजि इनपुट की सदिय सूची से हटा दिया िाएगा। (11) प्राजधकरण, ऐसे िल कृजि इनपुट के जनमाचता या आयातक स े सुनिाई के जलए उजचत अिसर प्रिान करन े के बाि, उक्त अजधजनयम की धारा 14 के अधीन प्रिान दकए गए िडं लगाएगा प्ररुप -ड.-1 [पैरा 4 (1) (ख) िेखें] [100 रु/- गैर-न्द्याजयक स्ट्टाम्प पेपर पर मुदरत होन े के जलए] तारीख: घोिणा हम - Short title and commencement. – (1) These guidelines may be called the Guidelines for certificate of compliance for aquaculture inputs. (2) They shall come into force from the date of their publication in the Official Gazette. Guidelines for Certificate of Compliance for Aquaculture Inputs 1. Certificate of compliance.- (1) The certificate of compliance for aquaculture inputs shall be issued, if - (a) it is free from such pharmacologically active substance, antimicrobial agent or other material which may cause harm to human health as specified by an order of the Authority under section 12A of the Coastal Aquaculture Authority Act, 2005 and rule 18 of Coastal Aquaculture Authority Rules, 2024; (b) complies with the standards specified by the Authority under rule 18 of the said rules, (hereinafter referred to as the said rules). (2) All coastal aquaculture inputs made available or used in coastal aquaculture activities, except those specifically exempted by the Authority from the requirement of certification shall have valid certificate of compliance issued under sub-rule (6) of rule 18 of the said rules.. (3) All coastal aquaculture inputs that have not obtained certificate of compliance, shall submit the application for grant of certificate within six months from the date of publication of this notification in the official Gazette and shall comply with all requirements within one year from such date. (4) Both Indian manufacturers and importers or distributors of overseas aquaculture inputs and other supplements for aquaculture use shall obtain a certificate of compliance from the Authority. (5) A certificate of compliance shall not be transferrable.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) The certificate of compliance shall be valid for a period of five years from the date of issue which shall be renewable for a similar period in the manner specified in paragraph (8). (7) A non-refundable processing fee of ten thousand rupees (Rs. 10,000/-) for each application shall be paid either electronically or in the form of demand draft drawn in favour of the Coastal Aquaculture Authority. 2. Labelling standards,- (1) The labels on packages or containers of aquaculture inputs in addition to other statutory requirements on labelling, without any duplication, shall contain particulars specified in sub-paragraph (4), and displayed at a conspicuous position on the container in which the substance is packed and every other covering in which that container is packed. (2) The labels shall clearly indicate the basic composition of the aquaculture input, dosage, batch number, expiry date and other important details as specified in sub-paragraph (4), provided that brochures shall be mandatory in case the label has limited information. (3) The portion in the label showing content shall not contain generic terms like, vitamins, minerals, essential nutrients etc., instead, specific scientific name of vitamins, minerals, etc., shall be mentioned; (4) The label shall contain but not limited to the following particulars, in the following manner namely:- (a) name of the aquaculture input: Trade name of the aquaculture input shall be in capital letters or prominent font as mentioned in the certificate of compliance issued by the Authority; (b) net quantity of contents: (i) A correct statement of the net content in terms of weight, measure, volume, number of units of contents and number of units of activity, as the case may be, shall be indicated. (ii) The indicated values shall be in Metric system; (c) name and composition of ingredients: Scientific name of all major ingredients of the aquaculture input shall be mentioned with approximate concentration, composition expressed in appropriate unit, as applicable; (d) recommendations for use: The label shall clearly indicate the intended benefit, prescribed dosage and schedule of application to achieve the desired benefit; (e) method of application: (i) Method of application of aquaculture input as feed top dressing, broadcasting throughout the pond or any other method shall be provided; (ii) Pre-treatments like, soaking in water or overnight fermentation, if any before application shall be clearly mentioned; (iii) This can be limited to brochure to save space in the label and brochure is compulsory with such aquaculture input; (f) contraindications (if any): Information not suitable with any other aquaculture input or not to be used in particular culture systems, species or growth stages shall be clearly indicated with pictorial representation in the label. (g) batch number: (i) A distinctive traceable batch number in which the aquaculture input was produced at the manufacturing unit shall be indicated on the label; (ii) The details of such batches and retention sample shall be available at the manufacturing facility or distribution unit or warehouse facility for traceability; (iii) The figure representing the batch number shall be prefixed with ‘Batch No’; (h) import licence number (if imported): Aquaculture inputs manufactured with imported ingredients and aquaculture inputs as a whole imported and marketed in India shall bear on the label, the license number or Sanitary Import Permit number, wherever applicable, under which the aquaculture input is imported, prefixed with ‘Import License Number’ or Sanitary Import Permit number and contact details of the company importing and marketing the aquaculture input shall also be clearly mentioned; (i) manufacture date: The date of manufacture shall be in terms of month and year; (j) expiry date: (i) The date of expiry shall be in terms of month and year and it shall mean that the aquaculture input is recommended till the last day of the month. (ii) The date of expiry shall be prefixed with ‘Expiry date’. (iii) It required, “Best Before” in terms of month and year shall be indicated depending on the aquaculture inputs; (k) storage conditions: Appropriate storage conditions like cool, dark place, avoiding from sun light etc., required to maintain the potential of the aquaculture input till the expiry date shall be mentioned clearly; (l) indication of ‘Not for Human Consumption’: The label shall have ‘Not for Human Consumption’ in the bottom strip with bigger font size to avoid any possible consumption by humans; (m) indication of ‘Aquatic Animal Use Only’: The label shall bear a SYMBOL depicting an appropriate image of the aquatic animals for which the aquaculture input is to be administered;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 (n) name and address of manufacturer and Importer: Complete name and address of the manufacturer and importer shall be provided as submitted to the Coastal Aquaculture Authority including the name of the place or village, taluk, district, state and the PIN code; (o) Indication ‘Does not contain antibiotics” or “Free from Antibiotics” : The label shall have ‘ Does not contain antibiotics’ or ‘Free from Antibiotics’ in the bottom strip with bigger font size conspicuously displayed in a box with distinct colour; (p) certification number: Every aquaculture input except those exempted by the Authority under sub-rule (3) of rule 18 of the said rules, manufactured or marketed in India shall bear on its label the certification number issued by the Authority for that aquaculture input with a caption in bold letters as “CAA Certified Aquaculture Input” or any water mark as may be specified by the Authority. 3. Certification process. – (1) Separate application for each aquaculture input shall be made in Form-III of the said rules for grant of certificate of compliance for that aquaculture input, which may be downloaded from Authority website – www.caa.gov.in and shall be submitted along with all required documents as specified in Schedule-III of the said rules. (2) Only the manufacturers of aquaculture inputs and other supplements for aquaculture use shall be eligible to apply for the certificate of compliance, if such aquaculture inputs are manufactured in India. (3) Only the importer of the aquaculture inputs and other supplements for aquaculture use shall be eligible to apply for grant of certificate of compliance. (4) All documents as required by the Authority shall be submitted before completion of sixty calendar days from the date of receipt of application by the Authority failing which the application shall be closed as defective under intimation to the applicant and the processing fee of rupees ten thousand shall be forfeited and deposited in the Authority’s accounts. (5) The application shall be submitted afresh, if the earlier application is closed as defective. 4. Details of documents required under Schedule III,- (1) The following documents shall be commonly required for both manufacturers and importers, namely: - (a) antibiotic test report of the aquaculture input in ORIGINAL for test done not earlier than a month from the date of submission of application, for the presence of antibiotics, their parent compounds and metabolites specified by the Authority from any National Accreditation Board for Testing and Calibration Laboratories accredited Government or private laboratory with a scope for testing said antibiotic residues using Liquid Chromatography with tandem mass spectrometry method; (b) retention sample of not less than 500 grams or 500 milligram of each aquaculture input from each batch of manufacturing or importing shall be retained at the manufacturing or distribution unit for a period not exceeding the expiry of such aquaculture input and the documentary evidence such as scanned copy of the latest page of the sample retention record for each aquaculture input which shows the details of the latest sample stored and photographs of such storage facility and furnish declaration in Form-E-1. (2) All the certified aquaculture inputs shall be subjected to a random testing by Authority at least once before the expiry of its certification; (3). The manufacturer may design their own seal or tamper proof mechanism to ensure the same is not duplicated by any other party and it shall be mentioned in the application to the Authority by the applicant to confirm the genuineness of the aquaculture input while sampling. (4) In the case of aquaculture inputs manufactured in India, any application for certificate of compliance shall be accompanied with the following documents in addition to those specified in sub-paragraph (1), namely: - (a) Details of company/firm, as under: - (i) company incorporation proof (Address proof for company); (ii) Micro, Small and Medium Enterprises; and (iii) Goods and Services Tax certificate. (b) Details of the manufacturing facility, as under:- (i) certificate of registration of the manufacturing unit or factory etc., from the competent authority; (ii) licence to work as factory; (iii) proof of any facility certification; (iv) any process certification such as International Organization for Standardization or Best Aquaculture Practices or Good Manufacturing Practice or Hazard Analysis Critical Control Points etc. (c) other documents, as under:-12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) detailed process flowchart which shall be, but not limited to the checkpoints that are linked with testing process as a part of the in-process quality control system adopted by the manufacturer in the production (ii) process certification that ensures antibiotic free production or a notarised self-declaration in Form-E-2 for antibiotic free ingredients as well as production process; (iii) list of records maintained in the unit pertaining to the aquaculture input and production process; (iv) in case the aquaculture input is manufactured under an agreement (3) as merchant manufacturer, in a facility not owned by the applicant, copy of such agreement shall be submitted and in such case, the responsibility of compliances shall be on both the parties. (5) In the case of aquaculture inputs imported from abroad, every application for certificate of compliance shall be accompanied with the following documents in addition to those specified in sub- paragraph (1), namely: - (i) proof of registration of the importing company in India such as certificate of incorporation, importer licence, Micro, Small and Medium Enterprises, Goods and Services Tax, etc.; (ii) health certificate or veterinary certificate from the competent authority showing antibiotic- free status of the aquaculture input while importing or any antibiotic-free certificate from competent authority of the country of origin and in the absence of such certificate, a duly notarised declaration from the manufacturer in Form-E-2; (iii) details or list of records maintained by the importer on the imported aquaculture inputs, the originals of which may be produced on demand; (iv) copy of authorisation for distributing the aquaculture input or copy of the agreement between the overseas principal manufacturer and Indian importer; (v) manufacturing process stepwise (Flow chart) along with testing procedures followed within the unit or any such relevant document from the overseas manufacturer; (vi) any process certification such as International Organization for Standardization or Best Aquaculture Practices or Good Manufacturing Practice or Hazard Analysis Critical Control Points from the overseas manufacturer; (vii) proof of any facility certification. 5. Renewal of certificate of compliance .- (1) Application in Form-III of the said rules shall be submitted for renewal of certificate of compliance for aquaculture inputs three months before the expiry of such certificate with a non-refundable processing fee for ten thousand rupees (Rs. 10,000/-) shall be paid either electronically or in the form of demand draft drawn in favour of the Coastal Aquaculture Authority, along with the following documents as specified in Schedule-III of the said rules, namely;- (i) antibiotic test report of the aquaculture input in ORIGINAL for test done not earlier than a month from the date of submission of application, for the presence of antibiotic, their parent and metabolites from any National Accreditation Board for Testing and Calibration Laboratories accredited Government or private laboratory with a scope for testing said antibiotic residues using Liquid Chromatography with tandem mass spectrometry method; (ii) revised labels and brochures, in case of change, if any, in compliance with the requirements specified in paragraph (5); (iii) a notarised self-declaration in Form-E-3. (2) In case any deficiency in the application is observed by the Authority, the rectification or additional documentary requirements shall be submitted within forty-five calendar days before the expiry of such certification failing which the application shall be closed as defective and the processing fee of ten thousand rupees (Rs. 10,000/-) shall be forfeited and deposited with the Authority’s account under intimation to the applicant. (3) Upon satisfactory compliance with the requirements of this paragraph, the Authority shall renew the certificate of compliance within a period of sixty days from the date of receipt of the application by it. 6. Enforcement mechanism.- (1) There shall be an inspection committee headed by the Director Technical of the Authority including representatives from the following institutions, namely:- (i) Sub Divisional or District Level Committees or Department of Fisheries of State concerned; (ii) representative for Central Drugs Standard Control Organisation not below the rank of Assistant Drug Inspector; (iii) representative from Marine Products Export Development Authority; (iv) representative from any Indian Council of Agriculture Research Fisheries Institute in the region Central Institute of Brackishwater Aquaculture, Central Marine Fisheries Research Institute and Central Institute of Fisheries Education.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13 (2) The committee shall randomly inspect the storage or manufacturing facilities of the manufacturers or importers for conforming the compliance. (3) A task force shall be constituted by the Authority including representatives from the Authority, District Level Committees and the Marine Products Export Development Authority, for monitoring of aquaculture inputs manufactured or marketed in India. (4) The Task Force constituted by the Authority shall collect aquaculture input samples randomly from manufacturing facility or storage facility, aqua shops, farms, hatcheries, etc. and the manufacturer or importer company shall reimburse the cost of the sample collected by the Authority to the facility from where the sample is collected. (5) In case of aquaculture inputs for which the seal or tamper proof mechanism is declared by the manufacturer, the task force shall during sampling, open the packaging of the input for ensuring the intactness of the seal or tamper proof mechanism amalgamated with the packaging as mentioned in the application and samples shall be sealed in the presence of the task force to ensure the genuineness of the aquaculture input at the time of submission for testing. (6) The Authority shall empanel laboratories for testing the aquaculture inputs. (7) The person representing the Authority the task force shall submit the samples collected by task force to the laboratories empanelled and approved by the Authority and the laboratories shall submit the report to the Authority directly for necessary action. (8) The frequency of collection of sample and testing of a aquaculture input shall be reduced if it maintains antibiotic-free status in multiple tests conducted by the Authority over a period of two consecutive years. (9) The Authority shall specify by an order, a protocol for sampling and testing, outlining the roles of the task force. (10) In case any aquaculture input is tested positive or reported by the task force or any competent authorities under any National Regulatory Programme such as National Residue Control Plan for antibiotic residues, the certificate of such aquaculture input shall stand suspended with immediate effect and such aquaculture input shall be delisted from the active list of certified aquaculture inputs. (11) The Authority shall, after providing reasonable opportunities for being heard from manufacturer or importer of such aquaculture input , impose the penalties as provided under section 14 of the said Act.
