L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअID.-E2x3xx0 72021-228437 CG-DL-E-23072021-228437 ऄसाधारण EXTRAORDINARY भाग I—खण्ड 1 PART I—Section 1 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 202] नइ ददल्ली, िक्रु वार, जलु ाइ 23, 2021/श्रावण 1, 1943 No. 202] NEW DELHI, FRIDAY, JULY 23, 2021/SHRAVANA 1, 1943 वाजणज्य और ईद्योग मत्रं ालय (वाजणज्य जवभाग) (व्यापार ईपचार महाजनदिे ालय) समाजि अदिे (जिपक्षीय रक्षोपाय जाचं ) नइ ददल्ली, 23 जुलाइ, 2021 मामला स.ं (एस जी) 6/2020 जवषयः भारत-जापान व्य ापक अथथक साझदे ारी समझाता (जिपक्षीय रक्षोपाय ईपाय) जनयमावली, 2017 के तहत जापान स ेभारत म ें‘’पीवीसी सस्ट्प िें न ेडे रेजजन’’ के अयातों के सबं धं म ेंजिपक्षीय रक्षोपाय जाचं की समाजि। क. प्रस्ट्त ावना फा. स.ं 20/6/2020-डीजीटीअर.—भारत गणराज्य और जापान के बीच व् यापक अथथक साझेदारी समझाता (सीइपीए) के ऄनच्ु छेद 23 और ईसके भारत-जापान व् यापक अथथक साझेदारी समझाता (जिपक्षीय रक्षोपाय ईपाय) जनयमावली, 2017 (जजन् ह ें यहां अग े ‘’जिपक्षीय रक्षोपाय जनयमावली’’ या ‘’जनयमावली’’ कहा गया ह)ै के संबंध म,ें मै. डी सी डब ल यल ू जलजमटेड, मै. डीसीएम श्रीराम जलजमटेड और मै. केमप्ल ास्ट् ट कुडालार जवनाआल् स जलजमटेड (जजन् ह ें यहा ं ‘’अवेदक’’ या घरेल ू ईद्योग कहा गया ह)ै ने जापान (जजसे यहां संबद्ध देि भी कहा गया ह)ै से ‘’पीवीसी सस्ट् पेंिन रेजजन’’ (जजसे यहां ‘’जवचाराधीन ईत् पाद’’ या ‘’पीयसू ी’’ या ‘’संबद्ध वस्ट् तु’’ कहा गया ह)ै के कजथत बढे हुए अयातों के संबंध में जिपक्षीय रक्षोपाय जांच की िरूु अत करने के जलए सीइपीए और जिपक्षीय रक्षोपाय जनयमों के ऄनुसरण में महाजनदिे क, व् यापार ईपचार (जजन् ह ेंयहां ‘’महाजनदेिक’’ भी कहा गया ह)ै के समक्ष एक अवेदन दायर दकया था । 4023 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 2. यह जनश् चय करन े के बाद दक रक्षोपाय जांच की िुरूअत का औजचत् य जसद्ध करने के जलए, प्रथम दष्ृ ट या सा्य माजूद ह;ैं महाजनदेिक ने यह जनधाारण करन े हते ु रक्षोपाय जांच की िुरूअत की थी दक क्य ा जापान स े जवचाराधीन ईत् पाद का अयात अयातों में वृजद्ध को स्ट्थ ाजपत करता ह ै और क्य ा बढे हुए अयातों से घरेल ू ईद्योग को गंभीर क्षजत हुइ ह ैया होन ेका खतरा ह ै। 3. तद्नुसार, महाजनदेिक न े भारत-जापान व् यापक अथथक साझदे ारी करार (जिपक्षीय रक्षोपाय ईपाय) जनयमावली, 2017 के तहत जापान स े भारत म ें ‘’पीवीसी सस्ट् पेंिन ेडे रेजजन’’ के अयातों के संबंध में जिपक्षीय रक्षोपाय जांच की िुरूअत करत े हुए, जांच िरूु अत ऄजधसूचना सं. 20/6/2020-डीजीटीअर, ददनांक 8 जसतंबर, 2020 जारी की । ख. प्रदक्रया 4. जांच िुरूअत के पश् चात, महाजनदेिक ने ईक्त जनयमावली के जनयम 5(2) के ऄनुसरण म,ें जैसादक अवेदन म ें ईल् लेख था, वाजणज् य और ईद्योग मंत्रालय और ऄन् य संबंजधत मंत्रालयों में केन् रीय सरकार; भारत में जापान के दतू ावास के जररए जापान की सरकार; संबद्ध देि में ज्ञात ईत् पादकों और जनयाातकों एवं ज्ञात अयातकों व ऄन् य जहतबद्ध पक्षकारों को जांच िरूु अत ऄजधसूचना की प्रजतया ं ऄेेजषत की थी और ईनसे जाचं िुरूअत ऄजधसूचना की तारीख से 30 ददनों के भीतर जलजखत में ऄपन ेजवचारों से ऄवगत करान े का ऄनुरोध दकया । 5. महाजनदेिक ने वाजणज् य एवं ईद्योग मंत्रालय और ऄन् य संबंजधत मंत्रालयों म ें केन् रीय सरकार, भारत में आसके दतू ावास के जररए जापान सरकार को और संबद्ध दिे म ें ज्ञात ईत् पादकों और जनयाातकों को ईक्त जनयमावली के जनयम 5(3) के ऄनुसरण म ेंअवेदन के ऄगोपनीय पाठ की एक प्रजत भेजी । 6. महाजनदेिक न े 1 नवंबर, 2020 तक प्रश् नावली ईत् तर को प्रस्ट् तुत करने के जलए समय सीमा में जवस्ट् तार प्रदान दकया जजसे डी जी टी अर की वेबसाआट के माध् यम से पजबलक डोमेन म ेंरखा गया । 7. जांच िुरूअत ऄजधसूचना के प्रत् युत् तर म,ें संबद्ध देि से जनयाातकों/ईत् पादकों और भारत म ें अयातकों/प्रयोक्त ाओं न न े प्रश् नावली का ईत् तर और कानूनी ऄनरु ोधों को प्रस्ट्त ुत कर महाजनदेिक को ऄपनी प्रजतदक्रया दी । 8. महाजनदेिक ने जहतबद्ध पक्षकारों से ईनके ईत् तर और ऄनरु ोधों के ऄगोपनीय पाठ को ऄन् य जहतबद्ध पक्षकारों को पररचाजलत करन े का ऄनरु ोध दकया । 9. महाजनदेिक न े सभी जहतबद्ध पक्षकारों के जवचारों को सुनन े के जलए ददनांक 10 माचा, 2021 को एक माजखक सुनवाइ जनधााररत की । ग. घरेल ूईद्योग (डीअइ) स ेप्राप्त ऄनरु ोध 10. ददनांक 8 माचा, 2021 की मेल के ऄनुसार, डी अइ ने महाजनदेिक को सूजचत दकया दक अवेदक कंपजनयों न े भजवष्य में दबु ारा अवेदन दायर करने की घरेल ू ईद्योग को स्ट् वतंत्रता के साथ हाल की ऄवजध में बाजार की जस्ट्थजत में महत् वपूणा पररवतानों को ध् यान में रखत े हुए वतामान अवेदन को वापस लने े का जनणाय दकया ह ै। 11. अवेदन को वापस लेने का ऄनरु ोध प्राप् त होने पर, महाजनदेिक ने ददनांक 09 माचा, 2021 के नोरटस के ऄनुसार माजखक सुनवाइ को रद्द कर ददया । घ. महाजनदिे क िारा जाचं 12. घरेलू ईद्योग िारा आसकी ददनांक 8 माचा, 2021 की मेल के ऄनुसार दकए गए ऄनरु ोध की जांच की गइ ह ै । महाजनदेिक नोट करत े ह ैं दक दकसी जांच की समाजि के जलए जिपक्षीय रक्षोपाय जनयमावली म ें कोइ जवजिष्ट प्रावधान नहीं ह ै । जांच की समाजि के जलए ऄनुरोध प्रभाजवत घरेलू ईद्योग की ओर स े प्राप् त हुअ ह ै जजसके अेह पर जांच अरंभ की गइ थी । ड. जनष्क ष:ा 13. अवेदकों िारा दकए गए ईपयुाक् त ऄनुरोध को ध् यान में रखते हुए, महाजनदेिक एतद्द्वारा ऄजधसूचना स.ं 20/6/2020-डीजीटीअर के ऄनुसार ददनांक 8 जसतंबर, 2020 को अरंभ की गइ जांच को समाप् त करते ह ैं। ऄनंत स्ट् वरूप, महाजनदेिक[भाग I—खण् ड 1] भारत का राजपत्र : ऄसाधारण 3 MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) (DIRECTORATE GENERAL OF TRADE REMEDIES) TERMINATION ORDER (Bilateral Safeguard Investigation) New Delhi, the 23rd July, 2021 Case No. (SG) 6/2020 Subject : Termination of Bilateral Safeguard Investigation concerning imports of ―PVC Suspension Grade Resin‖ into India from Japan under India-Japan Comprehensive Economic Partnership Agreement (Bilateral Safeguard Measures) Rules, 2017- Reg. A. Introduction F. No. 20/6/2020–DGTR.—Having regard to the Article 23 of the Comprehensive Economic Partnership Agreement between the Republic of India and Japan (CEPA) and India-Japan Comprehensive Economic Partnership Agreement (Bilateral Safeguard Measures) Rules, 2017 (hereinafter referred to as the "Bilateral Safeguard Rules" or the “Rules) thereof, M/s DCW Limited, M/s DCM Shriram Limited and M/s Chemplast Cuddalore Vinyls Limited (hereinafter referred to as the “applicants” or the “Domestic Industry”) had filed an application before the Director General of Trade Remedies (hereinafter referred to as “Director General”) in accordance with CEPA and Bilateral Safeguard Rules for initiation of bilateral safeguard investigation concerning alleged increased imports of “PVC Suspension Grade Resin” (hereinafter also referred to as the “product under consideration” or the “PUC” or the “subject goods”) from Japan (hereinafter also referred to as the subject country). 2. After determining that there is prima facie evidence to justify initiation of the safeguard investigation, the Director General had initiated the safeguard investigation in order to determine whether the imports of the product under consideration from Japan constitute increased imports and whether the increased imports have caused or are threatening to cause serious injury to the Domestic Industry. 3. The Director General accordingly issued an Initiation Notification No. 20/6/2020-DGTR dated 8th September, 2020, initiating Bilateral Safeguard investigation concerning imports of “PVC Suspension Grade Resin” into India from Japan under India-Japan Comprehensive Economic Partnership Agreement (Bilateral Safeguard Measures) Rules, 2017. B. Procedure 4. Post initiation, the Director General had sent copies of the initiation notification to the Central Government in the Ministry of Commerce and Industry and other Central Ministries concerned; Government of Japan through the Embassy of Japan in India; the known producers and exporters in the subject country and known importers and other interested parties as mentioned in the application, in accordance with Rule 5(2) of the said Rules and requested them to make their views known in writing within 30 days from the date of initiation notification. 5. The Director General provided a copy of the non-confidential version of the application to the Central Government in the Ministry of Commerce and Industry and other Central Ministries concerned; Government of Japan through its Embassy in India and the known producers and exporters in the subject country in accordance with the Rule 5(3) of the said Rules. 6. The Director General granted extension to file questionnaire response by 1st November, 2020, which was placed in the public domain through DGTR's website. 7. In response to the initiation notification, exporters/producers from the subject country and importers/users in India responded to the Director General by filing questionnaire response and legal submissions. 8. The Director General requested the interested parties to circulate the non-confidential version of their responses and submissions to the other interested parties.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 9. The Director General scheduled an Oral Hearing on 10th March, 2021 to hear the views of all the interested parties. C. Request received from the Domestic Industry (DI) 10. Vide mail dated 8th March, 2021, the DI informed the Director General that the applicant companies have decided to withdraw the present application in view of material changes in market situation in the recent period with a liberty to the domestic industry to file the application again in future. 11. On receipt of the request to withdraw the application, the Director General cancelled the Oral Hearing vide notice dated 9th March, 2021. D. Examination by the Director General 12. The request made by the domestic industry, vide its mail dated 8th March, 2021, has been examined. Director General notes that there is no specific provision in the Bilateral Safeguard Rules for termination of an investigation. Request for termination of the investigation has been received from the affected domestic industry at whose instance the investigation was initiated. E. Conclusion 13. In view of the aforesaid request made by the applicants, the Director General hereby terminates the investigation initiated on 8th September, 2020 vide Notification No. 20/6/2020- DGTR.
