प्रारुप अजधसूचना म ें जनजहत प्रस्ट्तावों पर कोई आपजत्त र्ा सुझाव िेने म ें रुजच रखन े वाला कोई भी व्यजि उस े सजचव, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्, इंदिरा पर्ाावरण भवन, िोर बाग रोड, अलीगंि, नई दिल्ली–110003 को डाक के माध्र्म से र्ा इलक्ट्े रॉजनक रूप स े ईमेल पत:े mishra.vp@gov.in र्ा vinodsingh.77@gov.in पर जनर्िष्टा अवजध के भीतर जलजखत रूप में संपका कर सकता ह।ै प्रारूप अजधसचू ना तेिी से बिलती िजु नर्ा म ें आि सबसे बडी चचंता प्रिषू ण और संसाधनों की कमी ह।ै प्रर्ुि तले का एक लीिर एक जमजलर्न लीिर ताि े पानी को िजू षत कर सकता ह ै – जिससे 50 लोगों के जलए एक वषा की िलापूर्ता हो सकती ह,ै क्ट्र्ोंदक इसम ें गंिगी, धात ु के जहस्ट्सों और पानी िैसी अिुजिर्ों के अलावा बेंिीन, सीसा, िस्ट्ता और कैडजमर्म िैसे िहरील े पिाथ ा होते ह।ैं 2861 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] और, जवश्व स्ट्तर पर, पृथ्वी स े जनष्कषाण के बाि तेल की बडे पमै ाने पर खपत, प्रसंस्ट्करण, जनमााण, पररवहन और जनपिान, ग्रीनहाउस गैसों को वातावरण म ेंछोडन े म ेंमहत्वपूणा र्ोगिान िेती ह ैजिससे प्रिषू ण बढ़ता ह।ै और, इस चचंता को कम करन े के जलए, प्रर्ुि तेल के क्षेत्र में सकुालर इकोनॉमी की अवधारणा न े जपछल े िो ििकों म ें गजत प्राि की ह,ै जिसमें हम न केवल स्नेहक (लुजिकैंि) के जवजनमााण के जलए इस्ट्तेमाल दकए गए तेल स े प्राि पुनः पररष्कृत (रर- ररफाइंड) तेल का उपर्ोग करत े ह,ैं बजल्क सुरजक्षत और स्ट्वस्ट्थ कल के जलए बहुमूल्र् पेरोजलर्म भंडार का संरक्षण भी करते ह।ैं और, पनु :चक्रीकरण’ म ें जनष्कषाण और जनमााण प्रदक्रर्ाओं म ें िलन े वाले िीवाश्म ईंधन की मात्रा को कम करके वैजश्वक िलवार्ु पररवतान की िर को कम करन े की क्षमता ह।ै र्ह पाररजस्ट्थजतकी तंत्र म ें काबान फुिचप्रंट्स को कम करन े म ें मिि करता ह।ै और, इस्ट्तेमाल दकए गए लुजिकेंि को दफर से पररष्कृत (ररफाइन) करन े स े पर्ाावरणीर् और आर्थाक िोनों तरह के फार्ि े हो सकते ह।ैं बेस ऑर्ल के जनमााण के जलए प्रर्ुि तेल को दफर स े पुनः पररष्कृत करन े स े ईंधन के रूप म ें उपर्ोग दकए िाने वाले तेल के पुनसंसाधन की तलु ना में अजधक ऊिाा की बचत होती ह।ै प्रर्ुि तेल स े पुनः पररष्कृत बेस ऑर्ल के जनमााण के जलए आवश्र्क ऊिाा वर्िान बेस ऑर्ल के उत्पािन के जलए कच्चे तेल को ररफाइन करन े के जलए आवश्र्क ऊिाा का केवल एक-जतहाई ह।ै इसजलए, संसाधनों के संरक्षण के साथ-साथ कचरे को कम करन े और पर्ाावरण को होने वाले नुकसान को कम करन ेके मामले म ें कई लोगों द्वारा पुनः पररष्कृत को पसंिीिा जवकल्प माना िाता ह।ै अत:, अब, केंद्रीर् सरकार, समर्-समर् पर र्थासंिोजधत, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप जनर्म (3) के तहत प्रित्त िजिर्ों का प्रर्ोग करत े हुए, पररसंकिमर् और अन्र् अपजिष्ट (प्रबंधन और सीमापारीर् सचं लन) जनर्म, 2016 के तहत प्रर्ुि तले के जलए जवस्ट्ताररत उत्पािक उत् तरिाजर्त् व को अजधसूजचत करती ह,ै अथाात:् 1. सजं क्षप्त नाम और प्रारंभ. - (1) इन जनर्मों को पररसंकिमर् और अन्र् अपजिष्ट (प्रबंधन और सीमापारीर् संचलन) संिोधन जनर्म, 2023 कहा िाएगा ह ै। (2) वे 1 अप्रैल, 2024 से प्रवृत् त होंग े । 2. पररसंकिमर् और अन्र् अपजिष्ट (प्रबंधन और सीमापारीर् संचलन) जनर्म, 2016 (इसमें इसके पश् चात ् उि जनर्मों के रूप म ें संिर्भात) म,ें जनर्म 9 म,ें उप-जनर्म (4) के बाि, जनम्नजलजखत उप-जनर्म अंत:स्ट्थ ाजपत दकर्ा िाएगा, अथाात:् - ''(5) प्रर्ुि तेल का उपर्ोग और प्रबंधन अनुसूची X म ेंजनजहत प्रावधानों के अनुसार होगा।‘’ 3. उि जनर्मों म,ें अनुसूची IX के बाि, जनम्नजलजखत अनुसूची अंत:स्ट् थाजपत की िाएगी, अथाता ्: - 'अनसु चू ी X [जनर्म 9 (5) िेख]ें प्रर्िु तले के जलए जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व (ईपीआर)। 1. पररभाषाएँ. – इस अनसु चू ी के प्रर्ोिनों के जलए, – (क) 'अजधजनर्म' का अथ ाह ैपर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29); (ख) 'बेस ऑर्ल' का अथ ा ह ैपररष्कृत स्नेहन (लुजिकेिन) तले के उत्पािन के जलए उपर्ोग दकर्ा िाने वाला तेल; (ग) ' बडे उत्पािक' का अथ ा ऑिोमोबाइल उद्योग, रेलवे, रक्षा प्रजतष्ठानों, पररवहन कंपजनर्ों, औद्योजगक इकाइर्ों, जबिली पारेषण कंपजनर्ों आदि िैसी कोई भी इकाई ह ैिो प्रजत वषा 100 मीररक िन स े अजधक प्रर्ुक्ट्त तेल का उत्पािन कर रही ह;ै (घ) 'व्यवसार्' का अथ ा बेस ऑर्ल र्ा लुजिकेिन ऑर्ल के उत्पािन र्ा जनमााण र्ा जबक्री, बेस ऑर्ल के आर्ात, प्रर्ुक्ट् त तेल के पुनः चक्रीकरण की कोई गजतजवजध ह;ै (ड.) 'सग्रं ह स्ट्थल' का अथ ाउन क्षेत्रों और केन् द्रों स ेह ैिहां अजधकृत संग्रह अजभकता ा प्रर्ुि तेल एकत्र करेगा; (च) ‘सग्रं ह अजभकता ा ' का अथ ा दकसी भी व्यजि र्ा संस्ट्था स े ह,ै जिसने पोिाल पर पंिीकरण करार्ा ह ै और प्रर्ुक्ट् त तेल को एकत्र करता ह ैऔर पंिीकृत पुनचाक्रक को इसकी आपूर्त ा करता ह;ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (छ) प्रर्िु तले का 'पर्ावा रण की िजृ ष्ट स े अनकु ूल प्रबधं न' का अथ ा ह ै सभी आवश्र्क किम उठाना तादक सुजनजित हो सके दक प्रर्ुक्ट् त तले का प्रबंधन इस तरह स े दकर्ा िाए दक स्ट्वास्ट्थ्र् और पर्ाावरण को ऐसे दकसी भी प्रजतकूल प्रभाव से बचार्ा िा सके िो जनधााररत दििा-जनिेिों का पालन करत े हुए प्रर्ुि तेल के संग्रह, पररवहन और पुनः चक्रीकरण के िौरान हो सकते ह;ैं (ि) 'जवस्ट्ताररत उत्प ािक उत्त रिाजर्त् व का अथ ा प्रर्क्ट्ु त तले के पर्ाावरण के अनरूु प प्रबधं न सुजनजित करन े के जलए केवल पिं ीकृत पनु चक्रा कों के माध्र् म स े ही पनु ः चक्रीकरण ल्र् ों को परू ा करन े के जलए' इस अनुसूची के अनुच्छेि 3 के उप-अनुच्छेि (2) के प्रावधानों के अनुसार बेस ऑर्ल र्ा लुजिकेिन तेल के दकसी भी उत्पािक र्ा प्रर्ुि तेल के आर्ातक के उत् तरिाजर्त् व से ह;ै (झ) ‘मागिा िका जसिातं ’ का अथ ा केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा तैर्ार दकर्ा गर्ा एक िस्ट्तावेि ह ै जिसमें प्रर्ुि तेल के हथालन, संग्रह, पररवहन, भंडारण और पुनः चक्रीकरण सजहत प्रर्ुक्ट् त तेल के पर्ाावरण के अनकु ूल प्रबंधन के जलए, न्र्ूनतम आवश्र्कता का जववरण दिर्ा गर्ा ह;ै (ञ) ‘पोिाल’ का अथा इस अनुसूची के कार्ाान्वर्न के जलए केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा जवकजसत ऑनलाइन प्रणाली से ह;ै (ि) ‘उत्प ािक’ का अथा दकसी व्यजि र्ा इकाई से ह ैिो- i. अपन े स्ट्वर् ं के िांड के तहत घरेल ू स्ट्तर पर बेस ऑर्ल र्ा लुजिकेिन तेल का जनमााण और जबक्री की पेिकि करता ह ै; र्ा ii. अन्र् जनमााताओं र्ा आपूर्ताकतााओं द्वारा जनर्मात बेस ऑर्ल का उपर्ोग करत े हुए, अपन े स्ट्वर्ं के िांड के तहत घरेल ू स्ट्तर पर लुजिकेिन तेल बेचने की पेिकि करता ह ै; र्ा iii. घरेल ू स्ट्तर पर आर्ाजतत बेस ऑर्ल र्ा लुजिकेिन तेल बेचने की पेिकि करता ह ै; र्ा प्रर्ुक्ट् त की गई जबक्री तकनीक की अपेक्षा जबना दकर्ा िैसे दक डीलर, ररिेलर, ई-ररिेलर, ; (ठ) ‘पन ु :चक्रीकरण’ का अथ ा पर्ाावरण के अनुकूल तरीके से बेस तेल र्ा लुजिकेिन तले का उत् पािन करने के जलए प्रर्ुक् त तेल के पुनिोधन की प्रदक्रर्ा और केन् द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा जनर्िष्ा ि मानक प्रचालन प्रदक्रर्ा (एसपपी) र्ा दििाजनिेिों में दिए अनुसार केन् द्रों का होना ह।ै (ड) ‘पनु ः पररष्कृत’ का अथ ा प्रर्ुि तले स े अवांजछत अिुजिर्ों को हिाने और अंजतम उत्पाि बेस ऑर्ल र्ा लुजिकेिन तेल बनाने की दकसी प्रदक्रर्ा से ह।ै (ढ) ‘पनु ः चक्रणकता’ा का अथ ाप्रर्ुि तेल के पुनः चक्रीकरण की प्रदक्रर्ा में लग े दकसी व्यजि र्ा संस्ट्था स े ह;ै (ण) ‘पनु :चक्रीकरण ल्र्' का अथ ा इस अनुसूची के अनुच्छ ेि 3 के उप-अनच्ु छेि (2) के प्रावधानों के अनुसार पुनचादक्रत दकए िाने वाले प्रर्ुि तेल की मात्रा से ह;ै (त) 'मानक सचं ालन प्रदक्रर्ा' का अथ ा केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा उपकरण और प्रदक्रर्ाओं की न्र्ूनतम आवश्र्कता को जवस्ट् तार से बतान ेवाल ेजनर्िष्टा िस्ट्तावेज़ से ह;ै (थ) 'प्रर्क्ट्ु त तले ' का अथ ा खतरनाक और अन्र् अपजिष्ट (प्रबंधन और सीमापारीर् संचलन) जनर्म, 2016 के जनर्म 3 के उप-जनर्म (36) के तहत र्था पररभाजषत दकसी तेल स े ह;ै (ि) 'प्रर्क्ट्ु त तले के आर्ातक' का अथ ादकसी ऐसे व्यजि र्ा संस्ट्था स े ह ैिो प्रर्ुि तले का आर्ात करता ह।ै 2. पिं ीकरण. - (1) जनम्नजलजखत इकाइर्ां पोिाल पर पंिीकृत होंगी। (क) उत् पािक (ख) सग्रं ह अजभकताा (ग) ‘पुनः चक्रणकताा’ (घ) प्रर्िु तेल आर्ातक (2) र्दि कोई इकाई उप-अनुच्छेि (1) के तहत एक स े अजधक श्रेजणर्ों म ें आती ह,ै तो उि इकाई उन श्रेजणर्ों के तहत अलग स ेपंिीकृत होगी। (3) उपर्ुाक्ट् त उप-अनुच्छेि (1) म ें संिर्भात कोई भी संस्ट्था पंिीकरण के जबना व्यवसार् नहीं करेगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) उप-अनुच्छेि (1) के तहत पंिीकृत इकाइर्ा ं पोिाल पर पंिीकृत नहीं होने वाली दकसी भी इकाई के साथ कार्-ा व् र्ापार नहीं करेंगी। (5) िहा ं कोई पंिीकृत संस्ट्था पंिीकरण के जलए र्ा जववरण र्ा ररपोिा र्ा िानकारी जिसे इस अनुसूची के तहत प्रिान करना र्ा प्रस्ट्तुत करना आवश्र्क ह,ै के संबंध में गलत सूचना िेती ह ै र्ा सूचना िानबूझकर छुपाती ह ै र्ा दकसी भी अजनर्जमतता के मामले म,ें केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा ऐसी इकाई का पंिीकरण सुनवाई का अवसर िेने के बाि पांच वषा तक की अवजध के जलए रद्द दकर्ा िा सकता ह ै और इसके अलावा, ऐसे मामलों म ें अनुच्छ ेि 15 के अनुसार पर्ाावरण क्षजतपर्ू ता िुल्क भी लगार्ा िा सकता ह।ै (6) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा इस अनुसूची के तहत पंिीकरण की मांग करने वाली इकाइर्ों से इस तरह के पंिीकरण िुल्क और वार्षाक अनुरक्षण िुल्क ले सकता ह,ै िो उनके द्वारा र्थाजनधााररत उत् पादित र्ा पुनचादक्रत र्ा उनके द्वारा संभाले गए प्रर्ुक्ट् त तले की मात्रा के आधार पर हो सकता ह।ै 3. जवस्ट्त ाररत उत्प ािक उत्त रिाजर्त् व व्र् वस्ट्थ ा की पिजतर्ा.ं - (1) ईपीआर जवजनर्म प्राथजमकता के क्रम म ें प्रर्ुक्ट् त तेल के प्रबंधन के जलए जनम्नजलजखत तरीकों को िाजमल करता ह ै: (i) पुन: पररष्कृत बेस तेल र्ा लुजिकेिन तेल का उत्पािन (ii) ऊिा ाकी पुनःप्राजि (2) ईपीआर ल्र्:- (I) सभी उत्पािक और प्रर्ुि तेल के आर्ातक अपन ेजवस्ट्ताररत उत्पािक उत्तरिाजर्त्वों को जनम्न ानुसार पूरा करेंग:े (क) बेस ऑर्ल र्ा लजु िकेिन तले के उत्पािकों के जलए क्र.स.ं वष ा प्रर्िु तले पनु ः चक्रीकरण ल्र् (i) वषा 2022-23 म ें बेच े र्ा आर्ात दकए गए बेस वषा 2024-25 के ईपीआर िाजर्त्व (वह वष ा जिसम ें र्े जनर्म प्रवृत् त होत े ह)ैं ऑर्ल र्ा लुजिकेिन तेल का 10% । (ii) वषा 2025-26 के ईपीआर िाजर्त्व वषा 2023-24 म ें बेच े र्ा आर्ात दकए गए बेस ऑर्ल र्ा लुजिकेिन तेल का 20%। (iii) वषा 2026-27 का ईपीआर िाजर्त्व वषा 2024-25 म ें बेच े र्ा आर्ात दकए गए बेस ऑर्ल र्ा लुजिकेिन तेल का 30% (iv) वषा 2027-28 का ईपीआर िाजर्त्व वषा 2025-26 म ें बेचे र्ा आर्ात दकए गए बेस ऑर्ल र्ा लुजिकेिन तेल का 40% (v) वषा 2028-29 का ईपीआर िाजर्त्व वषा 2026-27 म ें बेच े र्ा आर्ात दकए गए बेस ऑर्ल र्ा लुजिकेिन तेल का 50% (vi) वषा 2029-30 (Y) के बाि के संग्रह और पुनः चक्रीकरण ल्र् का ईपीआर वषा (Y-2) म ें बेचे र्ा आर्ात दकए गए बेस ऑर्ल र्ा लुजिकेिन तले का 60% होगा। (vii) 1 अप्रलै 2024 के बाि स्ट् थाजपत ईकाइर्ों के जलए जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व, जवत् तीर् वषा, जिसमें ईकाई स्ट् थाजपत की गई थी, के अंत से िो वषों की समाजि पर िरूु होगा और उपर्ुाक्ट् त जनधााररत ल्र् के अनुसार होगा। (ख) प्रर्िु तले आर्ातकों के जलए (i) वषा (Y) म ें प्रर्ुि तेल आर्ातकों के जलए जवस्ट्ताररत उत्पािक उत्तर िाजर्त्व संबंधी बाध्र्ता वषा (Y-1) म ें आर्ाजतत प्रर्ुि तेल का 100% होगा। (ii) केवल पुन: पररष्कृत उद्देश्र् के जलए प्रर्ुक्ट् त तेल के आर्ात की अनमु जत ह ै।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (II) उत्पािकों का जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी ल्र् बेस ऑर्ल के पररचालन हाजन के कारण केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा जनधााररत कारक के आधार पर कम दकर्ा िाएगा। (III) (i) उत् पािक केवल पंिीकृत पुनः चक्रणकता ा स े जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाणपत्रों की ऑनलाइन खरीि के माध्र्म स े अपनी जवस्ट्ताररत उत्पािक जिम्मेिारी पूरी करेंगे। (ii) उत्पािकों और पंिीकृत पुनः चक्रणकता ा द्वारा प्रिान दकए गए जववरणों को पोिाल पर पुनः िांच की िाएगी । (iii) अंतर होने के मामले में उत्पािक के जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी बाध्र्ता की पूताा के जलए जनम्नतर अंक पर जवचार दकर्ा िार्ेगा। (iv) प्रमाण पत्र केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा र्ा इस सबं ंध म ें उनके द्वारा अजधकृत दकसी अन्र् एिेंजसर्ों द्वारा पर्ाावरण लेखापरीक्षा के अधीन होंगे। 4. जवस्ट्ताररत उत्प ािक उत्तरिाजर्त्व प्रमाणपत्र का सिृ न. - (1) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा इस संबंध म ें अपन े द्वारा जनधााररत प्रारूप म ें पंिीकृत पुनः चक्रणकताा के पक्ष में पोिाल के माध्र्म स े जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाणपत्र सृजित करेगा जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व संबंधी प्रमाणपत्र का सृिन करने के जलए पात्र मात्रा के जनम्नानुसार सारणी की संगणना की िाएगी अथाात:् क्र.स.ं रीसाइचक्ट्लंग का अंजतम उत्पाि अंजतम उत्पाि केंद्रीर् प्रिषू ण अंजतम उत् पाि जवस्ट् ताररत उत् पािक की मात्रा जनर्ंत्रण बोडा द्वारा को आवंरित उत् तरिाजर्त् व (Q ) जनधााररत रूपांतरण अजधमान प्रमाणपत्र के सृिन p कारक (C ) (Wp) हते ु पात्र मात्रा (Q F = Qp X C X EPR F W ) p 1. पुन: पररष्कृत बेस तेल र्ा ररसाइदकलसा द्वारा 1.0 उपर्ोग की गई लुजिेकिन तेल का उत्पािन तकनीकों के आधार करना पर रूपांतरण कारक तर् दकर्ा िाएगा। 2. प्रर्ुक्ट् त तेल के जलए सह- 0.25 प्रसंस्ट्करण/उपर्ोग/ऊिाा वसूली रीसाइचक्ट्लंग के जलए उपर्ुि नहीं ह,ै अजधकतम अनुमर्े प्रजतित सीपीसीबी द्वारा जनधााररत दकर्ा िाएगा। (2) जवचाराथ ाजवषर् - उप-परै ाग्राफ (1) म ेंजनर्िष्टा ताजलका के प्रर्ोिन के जलए, (i) जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाणपत्र के सृिन के जलए पात्र मात्रा की गणना जनम् नजलजखत सूत्र के अनुसार संगणना की िाएगी अथाात:् Q = Q X C X W ; EPR p F p * Q प्रमाण पत्र के सृिन के जलए पात्र मात्रा ह,ै Q अंजतम उत्पाि की मात्रा ह ैऔर C रूपांतरण कारक ह ै EPR p F (आउिपुि की एक इकाई के उत्पािन के जलए आवश्र्क इनपुि की मात्रा) और W जविेष अजंतम उत्पाि के जलए P अजधमान ह ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] उिाहरण: र्दि एक ररसाइकलर अंततः 100 िन पुनः पररष्कृत (रर-ररफाइंड) तेल का उत्पािन करता ह,ै और रूपांतरण कारक 1.5 ह,ै तो उस वषा म ेंउस ररसाइकलर के जलए र्ोग्र् EPR (ईपीआर) प्रमाणपत्र जनम्नानुसार होगा: Q = 1001.5 1 (अजधमान) = 150.0 िन EPR x x (ii) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा प्रत्र्ेक अंत उत्पाि संपररवतान कारक C जनधााररत दकर्ा िाएगा; F (iii) अजधमान W तकनीकी प्रगजत, उपलब्धता सामग्री का और अन्र् कारकों के मद्देनिर केंद्रीर् प्रिषू ण जनर्ंत्रण P बोडा द्वारा समर्-समर् पर समीक्षा की िाएगी; (3) जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाणपत्र की वैधता उस जवत्तीर् वषा की समाजि से िो वषा होगी जिसम ें वह सृजित हुआ था और समाि प्रमाण पत्र स्ट्वतः समाि हो िाएगा िब तक पैरा 7 के उप-अनुच्छेि (2) के अनुसार अवजध पहल े समाि न हो िाए। (4) प्रत्र्ेक जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाणपत्र म ें एक अजद्वतीर् संख्र्ा होगी जिसमें उत्पािन का वषा, अंजतम उत्पाि का कोड, पुनचाक्रकताा कोड और एक अजद्वतीर् कोड िाजमल होगा और जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व प्रमाणपत्र 100, 200, 500, 1000 और 10,000 दकलोग्राम के मूल्र्वग ा म ें होंगे र्ा िैसा पैरा 18 के तहत गरठत संचालन सजमजत के अनुमोिन से केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा जनधााररत दकर्ा िाए। 5. जवस्ट्त ाररत उत्प ािक उत्त रिाजर्त् व प्रमाण-पत्रों का सव्ं र् वहार. - (1) एक उत् पािक अपनी वतामान वषा (वष ा Y) की जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व िेर्ता के साथ-साथ जपछले वषा की िेष िेर्ता तथा वतमा ान वषा की िेर्ता के 10 प्रजतित की सीमा तक जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाणपत्र खरीि सकता ह।ै (2) उत् पािकों और प्रर्ुक्ट् त तेल आर्ातकों द्वारा जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व बाध् र्ता को जतमाही आधार पर जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाणपत्रों को उजचत अनुपात में खरीि कर परू ा दकर्ा िाना होगा। (3) िैसे ही उत् पािक और प्रर्ुक्ट् त तेल के आर्ातक जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाणपत्र खरीिता ह,ै र्ह स्ट् वत: ही उसकी िेर्ता के जवरूि समार्ोजित हो िाएगा। पूवा िेर्ता को प्राथजमकता िी िाएगी और इस प्रकार समार्ोजित दकर्ा गर्ा जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाणपत्र स्ट् वर्ं समाप् त और रद्द हो िाएगा। (4) प्रत् र्के उत् पािक र्ा प्रर्ुक्ट् त तले के आर्ातक र्ा पुनचाक्रणकताा के जलए जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाणपत्र की उपलब् धता, आवश् र्कता और अन् र् ब् र्ौरे पोिाल पर उपलब्ध कराए िाएंगे। (5) उत् पािकों र्ा प्रर्ुक्ट् त तेल के आर्ातकों र्ा पुनचाक्रणकतााओं द्वारा इस अनुसूची के तहत सभी लेने-िेन का ररकाडा रखा िाएगा और इसे पोिाल पर प्रस्ट् तुत दकर्ा िाएगा। 6. पिं ीकरण, वार्षका जववरण एव ंररिन ािि ाकरन,े ईपीआर प्रमाणपत्र और सामग्री का पता लगान ेके जलए पोिाल. - (1) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा पिं ीकरण के साथ-साथ जतमाही और वार्षाक ररिना को िज़ा करन,े ईपीआर प्रमाणपत्र और जहतधारकों द्वारा उत् पादित र्ा उत् पन् न तले का पता लगान े के जलए एक ऑनलाइन प्रणाली स्ट् थाजपत करेगा। ऐसी प्रणाली एक ऐसे तंत्र को सुजनजित करेगी जिसमें दकसी जवत् तीर् वषा में उत् पािकों द्वारा बािार में लाए गए ल् र्ुजिकेिन ऑर्ल का पिाथा संतलु न पररलजक्षत होता हो; (2) र्ह वेब-पोिाल प्रर्ुक्ट् त तले के जलए ईपीआर के कार्ाान् वर्न स ेसंबंजधत जवजनर्मों और दििा-जनिेिों के संबंध में एकल चबंि ुआंकडा भडं ार के रूप म ेंकार्ा करेगा। (3) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा इस अनुसूची को अजधसूजचत करन े की तारीख स ेछह महीने के भीतर इस ऑनलाइन वेब-पोिाल को सचं ाजलत दकर्ा िाएगा और ईपीआर के कार्ाान् वर्न से संबंजधत सभी कार्ाकलाप ऑनलाइन तरीके स ेदकए िाएंगे। 7. उत्प ािकों की जिम्म िे ारी. - बेस ऑर्ल र्ा ल् र्ुजिकेिन ऑर्ल के उत् पािक जनम्न जलजखत के जलए जिम् मेिार होंगे - (1) पोिाल पर पंिीकरण। (2) इस अनुसूची के पैरा 3 के उप-पैरा (2) के अनुसार जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व के ल्र् ों को परू ा करना। (3) प्रर्ुक्ट् त तले के संग्रह और पररवहन के जलए, उत् पािक और अन्र् संस्ट् थाएं िो र्ा िो से अजधक उत् पािकों द्वारा एकीकृत प्रर्ुक्ट् त तेल प्रबधं न प्रणाजलर्ों के सृिन सजहत अपनी सुजवधानुसार समुजचत व्र् वस्ट् था कर सकती ह।ैं (4) अपनी वेबसाइि के माध् र्म से र्ा प्रलेखन के माध् र्म से उपभोक्ट्त ा (ओं) को संपका जववरण िसै े दक पता,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 ई-मेल पता, िोल-फ्री िेलीफोन नंबर र्ा हल्े पलाइन नंबर प्रिान करना तादक प्रदक्रर्ा को सजु वधािनक बनार्ा िा सके। (5) दकसी जवत् तीर् वषा से संबंजधत वार्षाक ररिना उस जवत् तीर् वष ा की समाजि के बाि 30 िनू को र्ा उससे पहले पोिाल पर जनधााररत प्रपत्र में िि ाकरना। (6) मीजडर्ा, प्रकािनों, जवज्ञापनों, पोस्ट् िरों र्ा संचार के दकसी अन्र् माध् र्म से िागरूकता सृजित करना। 8. प्रर्क्ट्ु त तले के आर्ातक का उत्त रिाजर्त्व . – प्रर्ुक्ट् त तले के आर्ातक जनम्न जलखत के जलए उत् तरिार्ी होंग-े (1) पोिाल पर पंिीकरण। (2) पोिाल के माध् र्म से इस अनुसचू ी के पैरा 3 के उप-पैरा (2) के अनुसार जवस्ट् ताररत उत् पाि क उत् तरिाजर्त् व के ल्र् ों को परू ा करना। (3) दकसी जवत् तीर् वषा से संबंजधत वार्षाक ररिना उस जवत् तीर् वष ा की समाजि के बाि 30 िून को र्ा उससे पहल े पोिाल पर जनधााररत प्रपत्र म ेंििा करना। 9. सग्रं ह अजभकता ा का उत्त रिाजर्त् व. - सभी संग्रह अजभकता ाको - (1) पोिाल पर पंिीकरण करना ह।ै (2) उत् पािकों से प्रर्ुक्ट् त तले का संग्रह करके पंिीकृत पुनचाक्रणकताा र्ा उत् पािक को आपूर्ता करना एवं पोिाल पर िानकारी अपलोड करनी ह।ै (3) दकसी जतमाही से संबंजधत ररिना को उसके बाि के महीने के अंत में र्ा उससे पहले पोिला पर जनधााररत प्रपत्र में िज़ा करना ह।ै (4) दकसी जवत् तीर् वषा से संबंजधत वार्षाक ररिना उस जवत् तीर् वष ा की समाजि के बाि 30 िून को र्ा उससे पहल े पोिाल पर जनधााररत प्रपत्र म ेंििा करना ह।ै 10. पनु चक्राणकता ाके उत्त रिाजर्त् व. - सभी पनु चक्राणकतााओं को - (1) पोिाल पर पंिीकरण करना ह;ै (2) र्ह सुजनजित करना ह ै दक सुजवधाएं तथा पुनः चक्रीकरण प्रदकर्ाएं केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा समर्- समर् पर जनधााररत एसपपी र्ा मागाििाक जसिांत के अनुसार ह;ैं (3) र्ह सुजनजित करना ह ै दक प्रर्ुक्ट्त तले के भडं ारण, पररवहन और पुनः चक्रीकरण के िौरान पर्ाावरण को कोई हाजन न पहुचं ;े (4) र्ह सुजनजित करना ह ै दक पनु ः चक्रीकरण की प्रदक्रर्ा के िौरान उत् पन् न अवजिष्ि का ‘खतरनाक और अन् र् अपजिष्ि ’ (प्रबंधन और सीमापार संचलन) जनर्म, 2016 के अनुसार ही जनपिान दकर्ा िाता ह;ै (5) दकसी जतमाही से संबंजधत ररिना को उसके बाि के महीने के अंत में र्ा उससे पहले पोिला पर जनधााररत प्रपत्र में िज़ा करना ह।ै (6) दकसी जवत् तीर् वषा से संबंजधत वार्षाक ररिना उस जवत् तीर् वष ा की समाजि के बाि 30 िून को र्ा उससे पहल े पोिाल पर जनधााररत प्रपत्र म ेंििा करना ह।ै 11. बडे उत्पािक के उत्त रिाजर्त्व . - (1) थोक उत् पािक, संग्रह अजभकताा की सुजवधा के जलए अपन े पररसरों स े प्रर्ुि तेल के संग्रहण और पररवहन हते ु संग्रह स्ट्थल स्ट्थाजपत करेंग;े (2) र्ह सुजनजित करेंग े दक उनके द्वारा उत्पन्न प्रर्ुक्ट् त तले को केवल पंिीकृत पुनचाक्रणकतााओं र्ा उत्पािकों र्ा संग्रह अजभकताा को ही सौंपा िाए; 12. केन्द्रीर् प्रिषू ण जनर्त्रं ण बोड ाके उत्तरिाजर्त्व. - (1) जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व पोिाल का संचालन और रखरखाव और ईपीआर अनुपालन की जनगरानी; (2) राज्र् प्रिषू ण जनर्ंत्रण बोडों (एसपीसीबी) के साथ समन्वर्; (3) समर्-समर् पर इस अनुसूची के तहत प्रर्ुक्ट् त तले के सग्रं ह, भंडारण, पररवहन, पुनः चक्रीकरण और जनपिान के जलए दििाजनिेि और मानक संचालन प्रदक्रर्ा तैर्ार करना और िारी करना; (4) इस अनुसूची के कार्ाान्वर्न के जलए आवश्र्क प्रपत्र र्ा ररिना र्ा दििाजनिेि र्ा मानक संचालन प्रदक्रर्ा तैर्ार करना और िारी करना; (5) जनर्मों के तहत ईपीआर के अनपु ालन का पता लगान े के जलए र्ािजृ च्छक िांच करना और इसके जलए सीमा िुल्क/राज्र् सरकार र्ा दकसी अन्र् एिेंसी/एिेंजसर्ों की मिि ले सकता ह;ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (6) प्रर्ुक्ट् त तले पर डेिा का प्रलेखन, संकलन और केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा की वेबसाइिों पर अपलोड करना; (7) इन जनर्मों के उल्लंघन के जवरुि कारावाई; (8) एसपीसीबी और िहरी स्ट्थानीर् जनकार् अजधकाररर्ों सजहत क्षमता जनमााण के जवकास के जलए प्रजिक्षण कार्ाक्रम आर्ोजित करना; (9) िागरूकता कार्ाक्रम आर्ोजित करना; (10) सभी जहतधारकों को केंद्रीकृत जडजििल प्रणाली से िोडना; (11) मंत्रालर् को वार्षाक ररपोिा प्रस्ट्तुत करना; (12) इस अनुसूची के तहत मंत्रालर् द्वारा समर्-समर् पर सौंपा गर्ा कोई अन्र् कार्ा। 13. राज्र् सरकारों र्ा सघं राज्र्-क्षत्रे ों/ नगर पाजलकाओं / स्ट्थानीर् जनकार्ों / राज्र् प्रिषू ण जनर्त्रं ण बोडा के उत्तरिाजर्त्व. - (1) राज्र् और सघं राज्र्-क्षत्रे में उद्योग जवभाग र्ा राज्र् सरकार र्ा संघ राज्र्-क्षत्रे द्वारा इस संबंध में अजधकृत कोई अन्र् सरकारी एिेंसी, िैसा भी मामला हो, मौिूिा और जनमााणाधीन औद्योजगक पाकों, औद्योजगक क्षेत्रों और औद्योजगक समूहों में प्रर्ुक्ट् त तले के संग्रह और पनु ः पररष्कृत इकाइर्ों के जलए औद्योजगक स्ट्थान र्ा िेड का जनधाारण र्ा आवंिन सुजनजित करेगा। (2) राज्र् और संघ राज्र्-क्षत्रे म ें श्रम जवभाग र्ा राज्र् सरकार र्ा संघ राज्र्-क्षत्रे द्वारा इस संबंध में अजधकृत कोई अन्र् सरकारी एिेंसी, िैसा भी मामला हो, - (क) पुनः पररष्कृत और पुनः चक्रीकरण म ेंिाजमल श्रजमकों की पहचान और पंिीकरण सुजनजित करेंग;े (ख) प्रर्ुक्ट् त तेल के पुनः चक्रीकरण में िाजमल श्रजमकों के जलए औद्योजगक कौिल जवकास गजतजवजधर्ों का संचालन करेंग;े (ग) प्रर्ुक्ट् त तले के पनु ः चक्रीकरण में िाजमल श्रजमकों की सुरक्षा और स्ट्वास्ट्थ्र् सुजनजित करने के जलए वार्षाक जनगरानी करेंग े (3) नगरपाजलकाएं और स्ट्थानीर् जनकार् अपने अजधकार क्षेत्र में प्रर्ुक्ट् त तले के सग्रं ह के जलए बडी संख्र्ा में संग्रह स्ट्थल स्ट्थाजपत करन े के जलए उत्पािकों और बडे उत्पािक र्ा संग्रह अजभकताा को सहार्ता प्रिान करेंगे। इस प्रकार सग्रं हीत दकए गए प्रर्ुक्ट्त तले को अजधकृत पनु चाक्रकों को नीलाम दकर्ा िा सकता ह ै र्ा बेचा िा सकता ह।ै (4) राज्र् प्रिषू ण जनर्ंत्रण बोड ा र्ा संघ राज्र्-क्षेत्रों की प्रिषू ण जनर्त्रं ण सजमजतर्ां, - (i) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा के समन्वर् से इस अनुसूची का उजचत कार्ाान्वर्न सुजनजित करेंग;े (ii) संग्रह अजभकताा द्वारा संग्रह अजभकताा स्ट्थाजपत करन े में सुजवधा प्रिान करेंग;े (iii) केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा जनिेजित दकए अनुसार, जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व की जनगरानी और अनुपालन करेंग;े (iv) पुनचाक्रणकतााओं का औचक जनरीक्षण करेंग;े (v) इस अनुसूची के तहत मंत्रालर्/केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा सौंपा गर्ा कोई अन्र् कार्ा। 14. भारतीर् मानक ब्र्रू ो (बीआईएस) के उत्तरिाजर्त्व. - बीआईएस इन जनर्मों की अजधसूचना की जतजथ स े 6 महीने के भीतर ल् र्जू िक तले के उत्पािकों के जलए बेस ऑर्ल के रूप में इस्ट्तेमाल दकए िा सकने वाले पुनः पररष्कृत तेल हते ु आवश्र्क मानक िारी करेगा। 15. पर्ाावरणीर् क्षजतपर्ू त.ा - (1) केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा र्हाँ िारी इन जनर्मों और दििाजनिेिों के दकसी भी उपबंध के उल्लंघन के मामले में दकसी भी इकाई पर पर्ाावरण क्षजतपूर्ता ఀ के आरोपण और संग्रह करने के जलए दििाजनिेि जनधााररत करेगा और उि दििाजनिेि इन जनर्मों के अनुसार होंग े और पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा अनुमोदित होंगे। (2) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा इस अनुसूची के दकसी भी प्रावधान और इसके तहत िारी दकए गए दििाजनिेिों के उल्लंघन के मामल े में दकसी भी इकाई पर पर्ाावरणीर् क्षजतपूर्त ा लगान े और इसके संग्रह के सबं धं म ें दििाजनििे जनधारारत करेगा तथा उि दििाजनििे इन अनसु चू ी के अनसु ार होंग े एव ं इन्ह ें पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा अनुमोदित दकर्ा िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 (3) गलत जवस्ट्ताररत उत्पािक जिम्मेिारी प्रमाणपत्र िारी करने और गलत िानकारी िेने के जलए पुनचाक्रणकतााओं से पर्ाावरणीर् क्षजतपूर्त ाभी वसूली िाएगी। (4) र्ह दकसी अपंिीकृत उत्पािकों, पुनचाक्रणकताओंा और दकसी भी ऐसी संस्ट्था स े वसूली िाएगी िो इन जनर्मों के उल्लंघन म ेंसहार्ता करते ह ैंइसके जलए प्रेररत करते ह।ैं (5) (i) पर्ाावरणीर् क्षजतपूर्ता का भुगतान इन जनर्मों में जवजनर्िष्टा जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व से उत्पािक को मुि नहीं करेगा और दकसी जविेष वष ा के जलए अपूण ा जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व को अगले वष ा के जलए बढ़ार्ा िाएगा और इसी प्रकार इसे तीन वषा तक आगे बढ़ार्ा िाएगा; (ii) र्दि एक वषा के बाि जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व बाध् र्ता की कमी को संबोजधत दकर्ा िाता ह,ै तो वसूली गई पर्ाावरणीर् क्षजतपूर्ता का 85 प्रजतित उत्पािक को वापस कर दिर्ा िाएगा; (iii) र्दि जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व बाध् र्ता की कमी को िो वषों के बाि संबोजधत दकर्ा िाता ह,ै तो वसूली गई पर्ाावरणीर् क्षजतपूर्ता का 60 प्रजतित उत्पािक को वापस कर दिर्ा िाएगा, र्दि जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व बाध् र्ता की कमी को तीन वषों के बाि संबोजधत दकर्ा िाता ह,ै तो वसूली गई पर्ाावरणीर् क्षजतपर्ू ता का 30 प्रजतित उत्पािक को वापस कर दिर्ा िाएगा, इसके बाि उत् पािक को कोई भी क्षजतपूर्त ावापस नहीं की िाएगी। (6) ऐसी गलत सूचना, जिसके पररणामस्ट् वरूप पुनचाक्रणकता ा द्वारा वास्ट् तजवक रूप स े पुनचादक्रत अपजिष्ि की मात्रा स े 5 प्रजतित स े अजधक जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व प्रमाण-पत्रों का सृिन होता ह,ै िेने के फलस्ट् वरूप पंिीकरण रद्द हो िाएगा और पर्ाावरणीर् क्षजतपूर्ता लगाई िाएगी, िो वापसी र्ोग्र् नहीं होगी और इस अपराध को िोहराने पर इस अनुसूची का तीन बार र्ा उससे अजधक उल्लघं न करने के पररणामस्ट्वरूप पर्ाावरण क्षजतपूर्ता प्रभारों को लगाने के अलावा पंिीकरण भी स्ट्थार्ी रूप स े रद्द कर दिर्ा िाएगा। (7) (i) पर्ाावरण क्षजतपूर्ता के अधीन एकत्र की गई जनजध को केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा एक अलग एस्ट्क्रो खाते म ें रखा िाएगा। एकत्र की गई जनजध का उपर्ोग पर्ाावरणीर् क्षजतपूर्ता वसूल े गए प्रर्ुक्ट् त तले के एकत्रण और पनु ः चक्रीकरण अथवा गरै -एकजत्रत और गरै -पुनचादक्रत प्रर्ुक्ट् त तले के अजं तम जनपिान अथवा अनंजतम जनपिान के जलए तथा सजमजत द्वारा जलए गए जनणार् के अनुसार अन् र् िीषों पर दकर्ा िाएगा। (ii) पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् के अनमु ोिन के साथ संचालन सजमजत द्वारा धन के उपर्ोग के जलए जनिर् मात्रा और प्रमुखों पर जनणार् जलर्ा िाएगा। 16. अजभर्ोिन. – कोई भी व्यजि, िो जवस्ट्ताररत जनमााता उत्तरिाजर्त्व प्रमाण पत्र प्राि करन े के जलए इन जनर्मों के अधीन अपेजक्षत गलत िानकारी प्रिान करता ह,ै दकसी भी तरीके से झूठे र्ा िालीजवस्ट्ताररत जनमााता उत्तरिाजर्त्व प्रमाणपत्रों का उपर्ोग करता ह ै र्ा िानबूझकर इन जनर्मों के अधीन दिए गए जनिेिों का उल्लघं न करता ह ै र्ा सत्र्ापन और लेखा परीक्षा कार्ावाही में सहर्ोग करने म ें जवफल रहता ह,ै उस पर अजधजनर्म, 1986 की धारा 15 के अधीन अजभर्ोजित दकर्ा िाएगा। र्ह अजभर्ोिन इस अनुसूची पैरा 15 के तहत वसूली गई पर्ाावरणीर् क्षजतपूर्त ा के अजतररक्ट्त होगा। 17. सत्र् ापन एव ं लखे ा परीक्षा. – केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा स्ट्व र्ं अथवा दकसी नामोदिष्ृ ि एिेंसी के माध् र्म से जनरीक्षण तथा आवजधक लेखा परीक्षा, िैसादक उजचत समझा गर्ा ह,ै के माध् र्म स े उत् पािकों, थोक उत् पािकों, एकत्रण एिेंिों और पुनचाक्रणकतााओं द्वारा इन जनर्मों के अनुपालन का सत् र्ापन करेगा तादक इस अनसु ूची के पैरा 15 के प्रावधानों के उल्ल ंघनों के जवरूि कारावाई की िा सके। 18. सचं ालन सजमजत. – (1) प्रर्ुक्ट् त तले /अथवा उपर्ोग अवजध समाप् त हो चुके ल् र्ूब तले हते ु जवस्ट् तारर त उत् पािक उत् तरिाजर्त् व व् र्वस्ट् था के समग्र कार्ाान् वर्न का अधीक्षण करन े के जलए अध् र्क्ष, केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा की अध् र्क्षता म ें एक संचालन सजमजत (एससी) होगी। अध् र्क्ष के अजतररक्ट्त इस संचालन सजमजत में जनम् नजलजखत सिस्ट् र् होंग,े अथाात:् - (i) पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् का एक प्रजतजनजध; (ii) पेरोजलर्म एवं प्राकृजतक गैस मत्रं ालर् का एक प्रजत जनजध; (iii) बेस ऑर्ल र्ा ल् र्ूिीकेिन ऑर्ल उत् पािकों का एक प्रजतजनजध; (iv) ऑिो मोबाइल जवजनमााण संघों का एक प्रजत जनजध.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (v) पुनचाक्रणकताा संघों का एक प्रजतजनजध; (vi) राज्र् प्रिषू ण जनर्ंत्रण बोड ा र्ा प्रिषू ण जनर्ंत्रण सजमजत का एक प्रजतजनजध िैसादक के संचालन सजमजत के अध् र्क्ष द्वारा सहर्ोजित दकर्ा िाए; (vii) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा का सिस्ट् र् सजचव (viii) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा के संबंजधत प्रभाग का अध् र्क्ष – सिस्ट् र् संर्ोिक (2) संचालन सजमजत आवश् र्कता के अनुसार दकसी अन् र् सिस्ट् र् को सहर्ोजित कर सकती ह।ै (3) संचालन सजमजत इस अनुसूची के समग्र कार्ाान् वर्न, जनगरानी और अधीक्षण के जलए उत् तरिार्ी होगी और इस संबंध म ें प्राप् त अ्‍ र्ावेिनों पर समर्-समर् पर उठने वाले जववािों के संबंध म ें जनणार् भी करेगी, और उठाए गए दकसी ऐसे महत् वपूण ा मुद्दों को पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् संिर्भात करेगी िो इस अनुसूची से संबंजधत हों। (4) जवषर् जनवााचन सजमजत केन् द्रीर् सरकार के अनुमोिन स े प्रौद्योजगक उन् नजत और अन् र् कारकों को ध् र्ान म ें रखत े पुनचाक्रण के तरीकों के ल्र् , महत् व और अनुमेर्ता का पुनर्वालोकन और संिोधन करेगी। (5) संचालन सजमजत इस अनुसूची के प्रावधानों के उजचत कार्ाान् वर्न के जलए उसके द्वारा आवश् र्क समझे िाने वाले सभी उपार् करेगी। 19. करठनाइर्ों को िरू करना. - Draft Notification Whereas, in a rapidly changing world, the utmost concern today is pollution and scarcity of resources. One litre of used oil can contaminate one million litres of fresh water - a year’s supply for 50 people, as it contains toxic substances such as benzene, lead, zinc, and cadmium, in addition to impurities such as dirt, metal parts and water.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 And whereas, globally, the massive consumption of oil after extraction from the earth, processing, manufacturing, transportation and disposal contributes substantially to release of greenhouse gases into the atmosphere thereby increasing pollution. And whereas, to mitigate this concern, concept of Circular Economy in used oil has gained momentum in past two decades, wherein we not only use the re-refined oil, obtained from used oil for manufacture of lubricants, but also conserve the precious petroleum reserves for safer and healthier tomorrow. And whereas, recycling has potential to reduce the rate of global climate change by reducing the extraction and the amount of fossil fuels burnt in the manufacturing processes. This helps in lowering carbon footprints in the ecosystem. And whereas, re-refining of used lubricants could result in both environmental and economic benefits. Re-refining of used oil to manufacture base oil conserves more energy than reprocessing the used oil for use as fuel. The energy required to manufacture re-refined base oil from used oil is only one-third of the energy required to refine crude oil to produce virgin base oil. Therefore, re-refining is considered by many as a preferred option in terms of conserving resources as well as minimizing waste and reducing damage to the environment. Now therefore, in exercise of powers conferred under sub rule (3) of the rule 5 of the Environment (Protection) Rules, 1986, the Central Government, hereby notifies the extended producer responsibility for Used Oil under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, as amended from time to time, namely: 1. Short title and commencement. - (1) These rules may be called the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2023. (2) They shall come into force from the 1st Day of April, 2024. 2. In the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (hereinafter referred to as the said rules), in rule 9, after sub-rule (4), the following sub-rule shall be inserted, namely: - ‘‘(5) The utilization and management of used oil shall be in accordance to the provisions contained in Schedule X’’. 3. In the said rules, after Schedule IX, the following Schedule shall be inserted, namely: - ‘SCHEDULE X [See rule 9 (5)] Extended Producer Responsibility (EPR) for Used Oil 1. Definitions. – For the purposes of this Schedule, - (a) 'Act' means the Environment (Protection) Act, 1986 (29 of 1986); (b) ‘base oil’ means oil used for production of finished lubrication oil; (c) ‘bulk generator’ means any entity like automobile industry, railways, defence establishments, transport companies, industrial units, power transmission companies etc which are generating more than 100 Metric Tonnes per annum of used oil; (d) ‘business’ means any activity of production or manufacturing or sale of base oil or lubrication oil, import of base oil, recycling used oil; (e) ‘collection points’ means the areas and the facilities where the authorized collection agent would collect the used oil; (f) ‘collection agent’ means any person or entity who has registered on the portal and collects used oil and supplies it to the registered recycler; (g) ‘environmentally sound management of Used oil’ means taking all steps required to ensure that used oil is managed in a manner so as to protect health and environment against any adverse effects which may result during collection, transportation and recycling of used oil following the prescribed guidelines; (h) ‘extended producer responsibility’ means responsibility of any producer of base oil or lubrication oil or importer of used oil in accordance with the provisions of sub-paragraph (2) of paragraph 3. of this Schedule for meeting recycling targets only through registered recyclers to ensure environmentally sound management of used oil; (i) ‘guidelines’ means a document prepared by Central Pollution Control Board elaborating minimum requirement for achieving environmentally sound management of used oil including handling, collection, transportation, storage and recycling of used oil; (j) ‘portal’ means the online system developed by the Central Pollution Control Board for implementation of this schedule; (k) ‘producer’ means any person or entity who, -12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] i. manufactures and offers to sell base oil or lubrication oil domestically under its own brand; or ii. offers to sell lubrication oil domestically under its own brand, using the base oil manufactured by other manufacturers or suppliers; or iii. offers to sell imported base oil or lubrication oil domestically; or irrespective of the selling technique used such as dealer, retailer, e-retailer, etc.; (l) ‘recycling’ means any process of re-refining of used oil to produce base oil or lubrication oil in an environmentally sound manner and having facilities as elaborated in the standard operating procedure (SOP) or guidelines specified by the Central Pollution Control Board. (m) ‘re-refining’ means any process of removing undesirable impurities from used oil and making the end product base oil or lubrication oil. (n) ‘recycler’ means any person or entity engaged in the process of recycling of used oil; (o) ‘recycling target’ means the quantity of used oil to be recycled as per the provisions of sub-paragraph (2) of paragraph 3 of this Schedule; (p) ‘standard operating procedure’ means the document specified by the Central Pollution Control Board elaborating minimum requirement of equipment and processes; (q) ‘used oil’ means any oil as defined under sub-rule (36) of Rule 3 of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016; (r) ‘used oil importers’ means any person or entity who imports used oil. 2. Registration. - (1) The following entities shall register on the portal. (a) Producers (b) Collection agents (c) Recyclers (d) Used Oil importers (2) In case any entity falls in more than one categories under sub-paragraph (1), then the said entity shall register under those categories separately. (3) No entity referred in sub-paragraph (1) above shall carry out business without registration. (4) The entities registered under sub-paragraph (1) shall not deal with any entity not registered on the portal. (5) Where any registered entity furnishes false information or willfully conceals information for getting registration or return or report or information required to be provided or furnished under this schedule or in case of any irregularity, the registration of such entity may be revoked by the Central Pollution Control Board for a period up to five-years after giving an opportunity to be heard and in addition, environmental compensation charges may also be levied as per paragraph 15 in such cases. (6) The Central Pollution Control Board may charge such registration fees and annual maintenance charges from the entities seeking registration under this schedule based on volume of used oil generated or recycled or handled by them as laid down by them. 3. Modalities of extended producer responsibility regime. - (1) The EPR regulation covers the following modes for managing the used oil in order of priority: (i) Producing re-refined base oil or lubrication oil (ii) Energy Recovery (2) EPR Targets: - (I) All producers and used oil importers shall fulfill their extended producer responsibility obligations as under: (a) For producers of base oil or lubrication oil Sl. No. Year Used oil Recycling Target (i) EPR obligation of the Year 2024-25 (The 10% of the base oil or lubrication year in which these rules comes into force) oil sold or imported in the Year 2022-23.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 (ii) EPR obligation of the Year 2025-26. 20% of the base oil or lubrication oil sold or imported in the year 2023-24. (iii) EPR obligation of the Year 2026-27. 30% of the base oil or lubrication oil sold or imported in the year 2024-25. (iv) EPR obligation of the Year 2027-28. 40% of the base oil or lubrication oil sold or imported in the year 2025-26. (v) EPR obligation of the Year 2028-29. 50% of the base oil or lubrication oil sold or imported in the year 2026-27. (vi) EPR of collection and recycling target for the year 2029-30 (Y) onwards will be 60% of the base oil or lubrication oil sold or imported in the year (Y-2) (vii) For units established after 1st April, 2024, the extended producer responsibility obligation will start after two years from the end of the financial year in which the unit was established and will be as per the target prescribed above. (b) For used oil importers (i) The extended producer responsibility obligation for used oil importers in year (Y) shall be 100% of the used oil imported in year (Y-1) (ii) The import of used oil is permitted for the purpose of re-refining only. (II) The extended producer responsibility target of the producers would be reduced by a factor laid down by Central Pollution Control Board on account of operational loss of base oil. (III) (i) The Producers shall fulfil their extended producer responsibility through online purchase of extended producer responsibility certificates from registered recyclers only. (ii) The details provided by producers and registered recyclers shall be cross-checked on the portal. (iii) In case of any difference, the lower figure shall be considered towards fulfilment of the extended producer responsibility obligation of the producer. (iv) The certificates shall be subject to environmental audit by the Central Pollution Control Board or any other agencies authorized by them in this regard. 4. Extended producer responsibility certificate generation. - (1) The Central Pollution Control Board shall generate extended producer responsibility certificate through the portal in favor of a registered recycler in the format laid down by it in this regard. The quantity eligible for generating extended producer responsibility Certificates shall be calculated as under: Sl. Co-processing/ 0.25 utilization/ energy recovery for used oil not suitable for recycling, maximum permissible percentage to be prescribed by CPCB. (2) Term of Reference. - For the purpose of the Table referred to in sub-paragraph (1), (i) the quantity eligible for generation of extended producer responsibility certificate shall be calculated as per the following formula, namely: - Q = Q x C x W ; EPR P F P *the Q is the quantity eligible for generation of the certificate, Qp is the quantity of the end EPR product and Cf is the conversion factor (quantity of inputs required for production of one unit of output) and Wp is the weighatge for particular end product Example: If a recycler finally produces 100 Tonnes of re-refined oil, and conversion factor is 1.5 then, the eligible EPR certificate for that recycler in that year shall be as follows: Q = 100 x 1.5 x 1 (weighatge)= 150.0 Tonnes EPR (ii) Conversion factor C for each end product shall be determined by the Central Pollution Control Board; F (iii) The weightage W shall be reviewed by the Central Pollution Control Board from time to time in view of the P technological advancements, availability of material and other factors; (3) The validity of the extended producer responsibility certificate shall be two years from the end of the financial year in which it was generated and the expired certificate will automatically extinguish after the period unless extinguished earlier as per sub-paragraph (2) of paragraph 7. (4) Each extended producer responsibility certificate shall have a unique number containing year of generation, code of end product, recycler code and a unique code and the extended producer responsibility certificates shall be in the denominations of 100, 200, 500, 1000 and 10,000 kilograms or as may be laid down by the Central Pollution Control Board with the approval of the Steering Committee constituted under paragraph 18. 5. Transaction of extended producer responsibility certificate. - (1) A producer may purchase extended producer responsibility certificates limited to its extended producer responsibility liability of current year (Year Y) plus any leftover liability of preceding years plus 10% of the current year liability. (2) The extended producer responsibility obligation shall have to be fulfilled by the producers and used oil importers by proportionately purchasing extended producer responsibility certificates on a quarterly basis. (3) As soon as the producer and used oil importer purchases the extended producer responsibility certificate, it will be automatically adjusted against his liability, priority in adjustment shall be given to earlier liability and the extended producer responsibility certificate so adjusted shall be automatically extinguished and cancelled. (4) The availability, requirement and other details of the extended producer responsibility certificate for every producer or used oil importer or recycler shall be made available on the portal. (5) All the transactions under this schedule shall be recorded and submitted by the producers or used oil importers or recyclers on the portal. 6. Portal for registration, filing of annual returns, EPR Certificate and tracing of Materials. - (1) Central Pollution Control Board shall establish an online system for the registration as well as for filing of quarterly and annual returns, EPR certificate and tracing of oil produced or generated by the stake holders. Such a system shall ensure a mechanism wherein the material balance of the lubrication oil introduced in the market by Producers in a financial year is reflected; (2) The web portal would act as the single point data repository with respect to regulations and guidelines related to implementation of EPR for used oil (3) The online web portal shall be operationalized by Central Pollution Control Board within[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 six months from the date of notification of this schedule and all activities related to the implementation of the EPR will be done in online manner. 7. Responsibility of Producers. - The producers of base oil or lubrication oil shall be responsible for - (1) Registration on the portal. (2) Fulfilling extended producer responsibility targets as per sub-paragraph (2) of paragraph 3 of this schedule. (3) For collection and transport of used oil, producers and other entities may make suitable arrangements as convenient to them including the formation of integrated used oil management systems by two or more producers. (4) Provide the contact details such as address, email address, toll free telephone numbers or helpline numbers to consumers(s) through their website or through advertisements or documentation so as to facilitate the process. (5) Filing annual returns in the laid down form on the portal on or before 30th June following the financial year to which that return relates. (6) Creating awareness through media, publications, advertisements, posters, or by any other means of communication. 8. Responsibility of Used Oil importer. - The Used Oil importers shall be responsible for- (1) Registration on the portal. (2) Fulfilling extended producer responsibility targets as per sub-paragraph (2) of paragraph 3 of this schedule through the portal. (3) Filing annual returns in the laid down form on the portal on or before 30th June following the financial year to which that return relates. 9. Responsibility of Collection agent. - All collection agent shall have to, - (1) Register on the portal. (2) Collect used oil from the generators and supply to the registered recycler or producer and upload information on the portal. (3) Filing quarterly returns in the laid down form on the portal on or before the end of the month succeeding the quarter to which the returns relate. (4) Filing annual returns in the laid down form on the portal on or before 30th June following the financial year to which that return relates. 10. Responsibilities of the recycler. - All recycler shall have to, - (1) Register on the portal; (2) Ensure that the facility and recycling processes are in accordance with the SOP or guidelines prescribed by the Central Pollution Control Board from time to time; (3) Ensure that no damage is caused to the environment during storage, transportation and recycling of used oil; (4) Ensure that the residue generated during the recycling process is disposed of in accordance to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules 2016; (5) Filing quarterly returns in the laid down form on the portal on or before the end of the month succeeding the quarter to which the returns relate. (6) Filing annual returns in the laid down form on the portal on or before 30th June following the financial year to which that return relates. 11. Responsibilities of the bulk generators. - (1) Bulk generators shall set up collection points to facilitate collection agents for collection and transportation of used oil from their premises; (2) Shall ensure that used oil generated by them be handed over only to the registered recyclers or producer or collection agents. 12. Responsibilities of the Central Pollution Control Board. - (1) Operation and maintenance of Extended Producer Responsibility Portal and monitoring of EPR compliance; (2) Coordination with State Pollution Control Boards (SPCB); (3) Prepare and issue Guidelines and Standard Operating Procedures for collection, storage, transportation,16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] recycling and disposal of used oil under this schedule from time to time; (4) Prepare and issue necessary Forms or Returns or Guidelines or Standard Operating Procedures for implementation of this schedule; (5) Conduct random checks for ascertaining compliance of the EPR under rules and may take help of Customs/State Govt or any other agency (ies); (6) Documentation, compilation of data on used oil and uploading on websites of Central Pollution Control Board; (7) Actions against violation of these rules; (8) Conducting training programmes to develop capacity building including SPCB and Urban Local Bodies officials; (9) Conducting awareness programmes; (10) Integrate all stakeholders with the centralized digital system; (11) Submit an Annual Report to the Ministry; (12) Any other function delegated by the Ministry under this schedule from time to time. 13. Responsibilities of the State Governments or Union territories /Municipalities/ Local Bodies/ State Pollution Control Board. - (1) The Department of Industry in the State and Union territory or any other government agency authorised in this regard by the State Government or the Union territory, as the case may be, shall ensure earmarking or allocation of industrial space or shed for collection of used oil and for re-refining units in the existing and upcoming industrial parks, estates and industrial clusters. (2) Department of Labour in the State and Union territory or any other government agency authorised in this regard by the State Government or the Union territory, as the case may be, shall,- (a) ensure recognition and registration of workers involved in re refining and recycling; (b) undertake industrial skill development activities for the workers involved in re-cycling of used oil (c) undertake annual monitoring and to ensure safety & health of workers involved in re-cycling of used oil (3) Municipalities and Local Bodies shall facilitate Producers and Bulk generators or collection agents to set up large number of collection points for collection of used oils in their jurisdictional areas. The used oils so collected can be auctioned or sold to the authorised recyclers. (4) State Pollution Control Boards or Pollution Control Committees of Union territories, shall, - (i) ensure proper implementation of this schedule in coordination with Central Pollution Control Board; (ii) facilitate the setting up collection points by the collection agents; (iii) monitoring and compliance of Extended Producer Responsibility as directed by Central Pollution Control Board; (iv) Conduct random inspection of recycler; (v) Any other function delegated by the Ministry/ Central Pollution Control Board under this Schedule. 14. Responsibilities of the Bureau of Indian Standards (BIS). - BIS shall issue necessary standards for re- refined oil, which could be used as base oil for producers of lubrication oil within 6 months from the date of notification of these rules. 15. Environmental Compensation. - (1) Central Pollution Control Board shall lay down guidelines for imposition and collection of environmental compensation on the Producers in case of non-fulfilment of obligations set out in these rules and transaction or use of false extended producer responsibility Certificates and the said guidelines shall be in accordance with these schedule and will be approved by the the Ministry of Environment, Forest and Climate Change. (2) The Central Pollution Control Board shall lay down guidelines for imposition and collection of environmental compensation on any entity in case of violation of any of the provision of this schedule and guidelines issued hereunder and the said guidelines shall be in accordance with these schedule and will be approved by the the Ministry of Environment, Forest and Climate Change.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17 (3) The Environmental Compensation shall also be levied on the recyclers for issue of false extended producer responsibility Certificates and providing false information. (4) It shall also be levied on unregistered producers, recyclers and any entity which aids or abets the violation of these rules. (5) (i) Payment of environmental compensation shall not absolve the producer from the extended producer responsibility as specified in these rules and the unfulfilled extended producer responsibility for a particular year shall be carried forward to the next year and so on and up to three years; (ii) In case, the shortfall of extended producer responsibility obligation is addressed after one year, 85 percent of the environmental compensation levied shall be returned to the producer; (iii) In case, the shortfall of extended producer responsibility obligation is addressed after two year, 60 per cent of the environmental compensation levied shall be returned to the producer, and in case, the shortfall of extended producer responsibility obligation is addressed after three year, 30 percent of the environmental compensation levied shall be returned to the producer, thereafter no EC will be returned to the producer. (6) False information resulting in over generation of extended producer responsibility certificates by recycler above 5 percent of the actual recycled waste shall result in revocation of registration and imposition of EC which shall not be returnable and repeat offence, violation of this schedule for three times or more shall also result in permanent revocation of registration over and above the environmental compensation charges. (7) (i) The funds collected under environmental compensation shall be kept in a separate Escrow account by Central Pollution Control Board and the funds collected shall be utilized in collection and recycling or end of life disposal of uncollected and non-recycled or non-end of life disposal of used oil on which the environmental compensation is levied, and on other heads as decided by the committee. (ii) Modalities and head for utilization of the funds shall be decided by the Steering Committee with the approval of the Ministry of Environment, Forest and Climate Change. 16. Prosecution. - Any person, who provides incorrect information required under these rules for obtaining extended producer responsibility certificates, uses or causes to be used false or forged extended producer responsibility certificates in any manner, wilfully violates the directions given under these rules or fails to cooperate in the verification and audit proceedings, may be prosecuted under section 15 of Environment Protection Act, 1986. This prosecution will be in addition to the EC levied under para 15 of this schedule. 17. Verification and Audit. - Central Pollution Control Board by itself or through a designated agency shall verify compliance of these rules by the producers, bulk generators, collection agents and recyclers through inspection and periodic audit, as deemed appropriate so as to take actions against violations of the provisions of para 15 of this schedule. 18. Steering Committee. - (1) There shall be a Steering Committee (SC) under the Chairmanship of Chairman, Central Pollution Control Board to oversee the overall implementation of EPR regime for used oil/ or end of life lube oil. The Steering Committee will comprise of following other members in addition to the chair, namely:- (i) one representative of the Ministry of Environment, Forest and Climate Change; (ii) one representative of the Ministry of Petroleum and Natural Gas; (iii) one representative of base oil or lubrication oil Producers; (iv) one representative of Automobile Manufacturer Associations. (v) one representative of Recycler Associations; (vi) one representative of State Pollution Control Board or Pollution Control Committee as co-opted by the Chairman of the Steering Committee; (vii) Member Secretary of Central Pollution Control Board. (viii) Head of the Concerned Division of Central Pollution Control Board - Member Convener. (2) Steering Committee may co-opt any other member as per requirement. (3) The steering committee shall be responsible for overall implementation, monitoring and supervision of this schedule and it shall also decide upon the disputes arisen from time to time on the representations received in this regard, and shall refer to the Ministry of Environment, Forest and Climate Change any substantial issue arisen or pertaining to this schedule.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) The Steering Committee shall review and revise the targets, weightage and permissibility of modes of recycling in view of the technological advancements and other factors with the approval of the Central Government. (5) The Steering Committee shall take all such measures as it deems necessary for proper implementation of the provisions of this Schedule. 19. Removal of difficulties. - The Central Pollution Control Board shall have powers to take any measures for removal of difficulties in implementation of this schedule. [F.
