जम.स.ं10-2/हो.जच.आ.ंएव ं श्र.ेबो/रा.हो.आ/2023-24– राष्ट्रीय होम्योपैथी आयोग,2020 (2020 का 15) के साथ पठित धारा (28) की धारा 55 की उप - धारा (2) की उप-धारा (1) तथा खण् ड (फ),(ब), (भ), (म), (य), (य)(ख) और (य)(ग) म ें प्रदत् त िजियों का प्रयोग करत े हुए तथा होम् योपैथी केन्‍द रीय पठरषद ् (जनरीक्षक तथा आगंतुक) जवजनयम,1982 के अजधक्रमण म,ें उनको जो दक इन जवजनयमों स े पहले जनकाले अथवा रखे जान े थ,े को छोड़ कर, राष्‍टर ीय होम् योपैथी आयोग जनम्नजलजखत जवजनयम बनाती ह ैअथाचत:- 1. संजक्षप्त िीषकच और प्रारंभ-(1) इन जवजनयमों का नाम राष्ट्रीय होम्योपैथी आयोग (आयर्वु वज्ञान प्रजिक्षण संस्ट्थ ान आंकलन एव ंश्रेणी जनधाचरण) जवजनयम, 2024 होगा। (2) ये राजपत्र म ें इनके प्रकािन की तारीख स े प्रभावी होंगे। 2. पठरभाषाए–ं (1) इन जवजनयमों म,ें जब तक दक संदभ च स े अन्‍दयथा अपेजक्षत न हो,- (क) "अजधजनयम" स ेतात् पयच राष्ट्रीय होम्योपैथी आयोग अजधनयम, 2020 (2020 का 15) ह;ै (ख) "सम्बद्ध अस्ट् पताल" का तात्पय च होम्योपैथी आयुर्ववज्ञान िैक्षजणक महाजवद्यालय संस्ट्थ ान के साथ सम्बद्ध अस्ट् पताल ह;ै (ग) "पाठ्यक्रम स ेतात् पयच होम् योपैथी अध् ययन पाठ्यक्रम, अथातच :- 1886 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (i) होम् योपैथी औषध एव ं िल् य दक्रया स्ट् नातक, स े तात् पयच अजधजनयम के प्रावधानों के तहत मान्‍द यता प्राप् त एक होम् योपैथी स्ट्न ातक अहतच ा, (ii) "आयुर्ववज्ञान वाचस्ट् पजत (होम् योपैथी) अथवा होम् योपैथी म ें स्ट् नातकोत् तर" जडग्री स े तात् पयच इस अजधजनयम के प्रावधानों के तहत मान्‍द यता प्राप् त एक होम् योपैथी स्ट् नातकोत् तर अहतच ा, (iii) अन्‍द य कोई आयुर्ववज्ञानी अहता च पाठ्यक्रम जो दक होम् योपैथी जिक्षा बोडच द्वारा होम् योपैथी म ें स्ट् नातक स्ट् तर स े ऊपर की मान्‍द यता प्राप् त अहतच ा जजसम ें प्रजिक्षण अथवा अजध- सदस्ट् यता (फैलोजिप) िाजमल ह।ै (घ) "प्रपत्र " स ेतात् पयच इस अजधजनयम स ेसंलग् न प्रपत्र ह;ै (ङ) "योजना" स े तात् पय चदकसी आयुर्ववज्ञान संस्ट् थान के जलए मान्‍द यता तथा श्रणे ी जनधारच ण के जलए सूचना प्रदान करने हते ु व्यवजस्ट्थत योजना, (च) न्‍दयूनतम आवश्यक मानकों' का अथच होम्योपैथी जिक्षा सस्ट्ं थान म ें होम्योपैथी जिक्षा बोडच द्वारा पाठ्यक्रमों, परीक्षाओं के सचं ालन के जलए जनधाचठरत मानकों स े ह ै और इसम ें जचदकत्सा संस्ट्थानों म ें बुजनयादी ढांच,े संकाय और जिक्षा और अनुसंधान की गुणवत्ता के मानदडं िाजमल ह;ैं (छ) 'जनरीक्षक' का अथच होम्योपैथी जचदकत्सा आंकलन एव ं श्रेणीजनधाचरण बोड च द्वारा जनयिु या होम्योपैथी जचदकत्सा आंकलन एवं श्रेणीजनधाचरण बोडच द्वारा अजधकृत तीसरे पक्ष की एजेंसी के द्वारा जनधाचठरत जविेषज्ञों की एक टीम स े ह,ै जो होम्योपैथी जिक्षा बोडच द्वारा जनर्ददष्ट न्‍दयनू तम आवश्यक मानकों के परीक्षण कर आंकलन एव ं श्रेणीजनधाचरण और रखरखाव के जलए जचदकत्सा संस्ट्थानों का जनरीक्षण करता ह।ै (2) यहााँ प्रयुि िब्द और अजभव्यजियााँ जोदक यहााँ पठरभाजषत नहीं ह,ैं ककतु अजधजनयम म ें पठरभाजषत ह,ैं उनके वही अथ च होंगे जो दक अजधजनयम म े समनुदेजित दकए गए ह।ैं 3. आयर्वु वज्ञान सस्ट्ं थ ान का आकं लन एव ं श्रणे ीजनधारच ण प्रदक्रया – (1) प्रत्येक वतचमान जचदकत्सा संस्ट्थान को न्‍दयूनतम आवश्यक मानकों के रखरखाव के मूल्यांकन के जलए "होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोडच को जनर्ददष्ट िुल्क के साथ वार्वषक आधार पर प्रासंजगक अनुबंधों के साथ ऑफ़लाइन अथवा ऑनलाइन जवजध द्वारा, संरजचत प्रारूप म ें जानकारी जमा करने के जलए आमंजत्रत दकया जाएगा, जैसा दक जवजनयम के माध्यम स े श्रेणीजनधाचरण के जलए जनर्ददष्ट दकया गया ह ै। (2) आवश्यक िल्ु क के साथ जमा करने की जनर्ददष्ट केवल अंजतम जतजथ अथवा उससे पहले प्राप्त आवेदन ही स्ट्वीकार दकए जाएंगे। (3) जचदकत्सा संस्ट्थान आवेदन के साथ जवश्वजवद्यालय का जवगत वषच का संबद्धता जनरंतरता प्रपत्र प्रस्ट्ततु करेगा। (4) सभी योग् य जचदकत्सा संस्ट्थानों को खोलन े हते ु पांच वष च की अवजध के बाद तथा तत्प श्च ात प्रत् यके वष,च जनर्ददष्ट न्‍दयूनतम आवश्यक मानकों के अधीन रखरखाव हते ु आंकलन अथवा श्रेणीजनधारच ण दकया जाएगा। (5) ऐस े सभी दस्ट्तावेज़ जो अग्रं ेजी अथवा हहदी म ें नहीं ह,ैं उनका अनुवाद दकया जाएगा और आवेदन पत्र के साथ संलग् लन दकया जाएगा। (6) होम्योपैथी जचदकत्सा आंकलन एव ं श्रेणीजनधारच ण बोड च ऐसे संस्ट्थान का आंकलन के पश्च ात आवश्यक मानकों को बनाए रखन े के अनुपालन के संदभच म ें जचदकत्सा संस्ट्थान की पूर्वत का सत्यापन करेगा । (7) होम्योपैथी जचदकत् सा आंकलन एव ं श्रणे ीजनधाचरण बोड,च आंकलन एव ं श्रेणीजनधारच ण के उद्देश्य स े दकसी भी समय दकसी भी आयुर्ववज्ञान महाजवद्यालय अथवा आयुर्ववज्ञान संस्ट्थान स े कोई जानकारी, स्ट्पष्टीकरण, दस्ट्तावेज अथवा जडजजटल सामग्री मागं सकता ह ै। 4. आवदे न के साथ जमा दकया जान े वाला िल्ु क - जवजनयमानसु ार जमा दकए गए आवेदन के साथ जनम्न जलजखत ताजलका- 1 म ें जनर्ददष्ट िल्ु क का भगु तान मांग पत्र (जडमांड ड्राफ्ट) अथवा ऑनलाइन भगु तान के माध्यम स े राष्ट्रीय होम्योपैथी आयोग, नई ददल्ली को दये होगा।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 ताजलका-1 वतमच ान होम्य ोपथै ी आयर्वु वज्ञान महाजवद्यालय िल्ु क राजि (रू०) स्ट् नातक पाठ्यक्रम केवल स्ट् नातकोत् तर पाठ्यक्रम दोनों स्ट् नातक तथा स्ट् नातकोत् तर पाठ्यक्रम आकं लन हते ुिल्ु क दो लाख तीन लाख चार लाख प्रसस्ट्ं क रण नय े होम्य ोपथै ी आयर्वु वज्ञान महाजवद्यालय की स्ट्थ ापना हते ु िल्ु क राजि (रू०) आकं लन हते ुिल्ु क स्ट् नातक पाठ्यक्रम स्ट् नातकोत् तर पाठ्यक्रम (प्रजत जवषय) प्रसस्ट्ं क रण पॉच लाख दो लाख सीटों की वजृ द्ध हते ु आकं लन हते ुिल्ु क चार लाख पच् चीस हजार प्रजत सीट प्रसस्ट्ं क रण 5. स्ट्व-प्रकटीकरण के आधार पर वतमच ान सस्ट्ं थानों म ें प्रविे हते ु मान्‍दय ता जवस्ट्तारण- (1) सभी मान्‍दयता प्राप्त मौजूदा होम्योपैजथक जचदकत्सा संस्ट्थान जो दक जजनकी स्ट्थापना को पाचं साल स ेअजधक ह ैतथा जजन्‍द ह ेंहोम्योपैथी या आयोग या भारत सरकार, जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोडच स े जपछल े तीन वषों स े लगातार अनुमजत प्राप् त हो, उन्‍द ह ें स्ट्व-प्रकटीकरण के आधार पर आयोग के वेब पोटचल के माध्यम से न्‍दयूनतम आवश्यक मानकों के पूणच अनुपालन के संदभ च म ें िपथ पत्र के साथ इन जवजनयमों म ें अजधसूजचत जवगत वष च की स्ट्वीकृत प्रवेि क्षमता के अनसु ार अगल े वषच हते ु प्रविे के जलए मान्‍द यता का जवस्ट्तार जमलेगा । ऐस े महाजवद्यालयों का जवजनयमों की आवश् यक अनुपालन के सत् यापन हते ु जनरीक्षण दकया जा सकता ह ै। प्रवेि की अनुमजत के जवस्ट्तार की सूचना जारी की जाएगी; (i) यदद संस्ट्थान पर राष्ट्रीय होम्योपैथी अजधजनयम की धारा 28 के खंड (च) उप-धारा (1) के प्रावधानों के तहत होम्योपैथी अथवा आयोग अथवा भारत सरकार आयर्वु वज्ञान आंकलन एव ं श्रेणीजनधाचरण बोड च द्वारा कारचवाई नहीं की गई ह।ै (ii) यदद संस्ट्थान के जखलाफ कोई कानूनी अथवा अनुिासनात्मक मुद्दा लंजबत अथवा जवचाराधीन न हो । (iii) यदद संस्ट्थान ने जनर्ददष्ट जवजनयमों अनुसार छात्रों के प्रवेि पर जवजनयमों के प्रावधानों का उल्लंघन नहीं दकया ह ै। (2) वतचमान महाजवद्यालय जो उपरोक्त उप जवजनमय (1) की श्रेणी म ें नहीं आत े ह,ैं उन्‍दह ें जनरीक्षण के पश् चात ही आगामी िैक्षजणक वषच के जवधार्वथयों के प्रवेि हते ु अनुमजत दी अथवा अस्ट्वीकृत दकया जाएगा । (3) होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोडच जनरीक्षण के पश् चात यदद संस्ट्थान को जनयमों के माध्यम स े जनर्ददष्ट न्‍दयनू तम आवश्यक मानकों का अनुपालन नहीं करता हुआ पाता ह,ै तो इस जवजनयमन की धारा 8 और 9 के तहत कारचवाई की जाएगी । (4) जो संस्ट्थान प्रविे हते ु अनमु जत नहीं मागं रह े ह ैं अथवा जजन्‍द ह ें जवगत पांच वषों के दौरान लगातार अनुमजत नहीं प्रदान की गई ह,ै उन्‍दह ें नवीन कॉलेज के रूप म ें माना जाएगा, एव ं वे संबंजधत जवजनयमों के अन्‍द यत्र अजधसूजचत प्रावधानों के अनुसार नया महाजवद्यालय खोलन े की योजना के अंतगचत अनुमजत प्राप्त करन े के जलए आवेदन कर सकते ह ैं।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 6. आकं लन एव ं श्रणे ीजनधारच ण हते ु जनरीक्षक अथवा स्ट्वतत्रं श्रणे ीजनधारच ण एजजें सयों की जनयुजि प्रदक्रया - (1) होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोडच के अध्यक्ष, जचदकत्सा िैक्षजणक संस्ट्थान द्वारा जनर्ददष्ट न्‍दयनू तम आवश्यक मानकों की पूर्वत के जनरीक्षण हते ु आवश् यक संख्या म ेंजनरीक्षकों, प्राजधकृत तृतीय पक्ष एजेंसी की जनयुजि करेंग े । (2) दकसी भी व्यजि को जनरीक्षक के रूप म ें तब तक जनयुि नहीं दकया जाएगा जब तक दक वह जनम्नजलजखत योग्यताधारी न हो; (i) आयोग के होम्योपैथी जिक्षा बोडच द्वारा मान्‍दयता सूची म ेंिाजमल एक मान्‍दयता प्राप्त स्नातकोत्तर जचदकत्सा जडग्री योग्यता तथा (ii) केंर सरकार, राज्य सरकार अथवा स्ट्वायत्त संस्ट्थान म ें कम स े कम पांच वष च का व् यावसाजयक अनुभव होना । (3) होम्योपैथी जचदकत्सा आंकलन एव ं श्रेणीजनधारच ण बोड च पारस्ट्पठरक रूप स े सहमत ितों और रुजच की अजभव्यजि तथा आयोग की मंजरू ी के पश् चात, जचदकत्सा अथवा गरै - जचदकत्सा संस्ट्थानों के स्ट् वतंत्र आंकलन एव ं श्रेणीजनधारच ण हते ु समान काय च का अनुभव रखने वाली सावचजजनक क्षत्रे की एजेंसी की सेवाए ं भी ले सकता ह,ै (4) जविेषज्ञों की टीम अथवा स्ट्वतंत्र आंकलन एव ं श्रेणीजनधाचरण एजेंसी न्‍दयूनतम आवश्यक मानकों के आंकलन तथा संस्ट्थानों के श्रेणीजनधाचरण हते ु जारी ददिाजनदेिों का पालन करेगी । 7. जचदकत्सा सस्ट्ं थानों का आकं लन एव ं श्रणे ीजनधारच ण हते ु जनरीक्षण प्रदक्रया – आंकलन एव ं श्रेणीजनधाचरण हते ु जचदकत्सा संस्ट्थानों का जनरीक्षण जनम्नानुसार दकया जाएगा: (क) होम्योपैथी जचदकत्सा आकं लन बोड च जनर्ददष्ट न्‍दयनू तम आवश्यक मानक को बनाए रखने हते ु आंकलन एव ं श्रेणीजनधाचरण हते ु जचदकत्सा संस्ट्थानों का जनरीक्षण करन े हते ु जनरीक्षकों की इतनी संख्या अथवा प्राजधकृत तृतीय पक्ष की स्ट्वतंत्र श्रणे ीजनधाचरण एजेंसी के माध्यम स े जजतनी आवश् यक हो, जनयुि करेगा। (ख) जनरीक्षण भौजतक अथवा ऑनलाइन अथवा हाईजिड पजद्धजत स े दकया जाएगा, (ग) संस्ट्थान का अवलोकन इन जवजनयमों म ें जनर्ददष्ट श्रेणीजनधारच ण मानदंडों के अनुसार दकया जाएगा। (घ) जचदकत्सा संस्ट्थानों की श्रणे ीजनधाचरण प्रजत वष च राष्ट्रीय होम्योपैथी आयोग की वेबसाइट पर उपलब्ध कराई जाएगी। (ङ) जनरीक्षण दल अथवा श्रणे ीजनधाचरण एजेंसी को संस्ट्थानों के प्राजधकारी द्वारा सभी आवश्यक दस्ट्तावेज जवजधवत हस्ट्ताक्षठरत, उपलब्ध कराए जाएंग,े जजन्‍दह ें जनरीक्षण के दौरान प्रस्ट्तुत करन े के जलए कहा जा सकता ह,ै (च) जचदकत्सा संस्ट्थान आंकलन एवं श्रेणीजनधाचरण हते ु जनरीक्षण ठरपोटच को संलग्नकों सजहत अथवा वीजडयो ठरकॉर्डडग की जानकारी गोपनीय रखा जाएगा । इसे एक सीलबंद जलफाफे म ें टीम के सभी सदस्ट्यों के हस्ट्ताक्षर के साथ होम्योपैथी जचदकत्सा आंकलन एवं श्रणे ीजनधाचरण बोड च को प्रस्ट्ततु दकया जाएगा, ठरपोटच की प्रजत उसी ददन बोड चके आजधकाठरक ईमेल पर ऑनलाइन जमा की जाएगी- । (छ) होम्योपैथी जचदकत्सा एवं श्रेणीजनधाचरण बोड च द्वारा अंजतम जनणचय के पश् चात अवलोकन एव ं श्रेणीजनधारच ण जनरीक्षण की ठरपोट च संबंजधत संस्ट्थान को उपलब्ध कराई जाएगी; और (ज) यदद होम्योपैथी जचदकत्सा आंकलन एव ं श्रेणीजनधाचरण बोडच अथवा आयोग द्वारा आवश्यक पाया गया, तो एक िैक्षजणक वष च के दौरान एक महाजवद्यालय का एक स े अजधक जनरीक्षण दकए जा सकते ह।ैं 8 न्‍दयूनतम आवश्यक मानकों को बनाए रखने म ें जवफलता- अवलोकन पर, यदद कोई संस्ट्थान होम्योपैथी जचदकत्सा आंकलन एव ं श्रेणीजनधाचरण बोड च द्वारा जनर्ददष्ट न्‍दयनू तम आवश्यक मानकों का अनुपालन नहीं कर रहा ह,ै तो सीटों की संख् या को कम करेगा अथवा प्रवेि की अनुमजत प्रदान करने से इंकार करेगा अथवा उस जविेष िैक्षजणक वषच अथवा उसके पश् चात के वष,च जैसा भी मामला हो, की मान्‍दयता वापस लेन े हते ु आयोग को जसफाठरि करेगा । 9. जिक्षा के न्‍दयूनतम आवश्यक मानकों को बनाए रखन े म ें जवफलता हते ु दण्ड प्रभार- होम्योपैथी जचदकत्सा आंकलन एव ं श्रेणीजनधाचरण बोडच जनम्नजलजखत कारणों स े जचदकत्सा संस्ट्थान के जवरूद्ध दण्ड अथवा कारचवाई करने की चेतावनी जारी करेगा:[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5 (i) न्‍दयूनतम मानक स्ट्त र बनाये रखने के दाव े के समथनच म ें फजी दस्ट्तावेज प्रस्ट्ततु करन े के जलए जचदकत्सा संस्ट्थान पर आर्वथक जुमाचना लगाया जाएगा, (ii) दकसी जिक्षक अथवा दकसी अन्‍दय कमचचारी को झूिा िैक्षजणक अनुभव प्रदान करने हते ु जचदकत्सा संस्ट्थान पर आर्वथक जुमाचना लगाया जाएगा, और (iii) ऐसे जचदकत्सा संस्ट्थानों पर आर्वथक दडं लगाया जाएगा जजनकी पूणचकाजलक जिक्षकों के रूप म ें जनयुि संकाय सूची म ें फजी जिक्षक ह।ैं (iv) होम्योपैथी के जलए जचदकत्सा आंकलन एव ं श्रेणीजनधाचरण बोड,च जनर्ददष्ट समयबद्ध रूप म ें न्‍दयूनतम आवश्यक मानक स्ट् तर बनाए रखने हते ु कजमयों को दरू करने के जनदिे ों के अजतठरक्त जचदकत्सा संस्ट्थान को चेतावनी भी जारी कर सकता ह;ै (v) यदद पाया गया दक जनर्ददष्‍ट ट समयावजध के अन्‍दद र कजमयों को दरू करने म ें संस्ट्थ ान असफल रहता ह ैतो जचदकत्सा संस्ट्थान पर आयोग द्वारा अनिु जं सत आर्वथक दडं लगाया जाएगा; (vi) जचदकत्सा संस्ट्थान पर लगाए जाने वाले दण्ड प्रभार की राजि राष्ट्रीय होम् योपैथी आयोग के खाते म ें जमा की जाएगी; (vii) यदद आर्वथक दण्ड समय पर आयोग म ें जमा नहीं कराया जाता ह,ै तो आगामी वषच हते ु जचदकत्सा संस्ट्थान को अनुमजत प्रदान नहीं की जायेगी । 10. नय े जचदकत्सा सस्ट्ं थान की स्ट्थापना हते ु योजना के मल्ू याकं न हते ु जनरीक्षण-(1) नय े जचदकत्सा संस्ट्थान की स्ट्थापना हते ु जनधाचठरत मानदंडों के अनुसार होम्योपैथी जिक्षा बोड च द्वारा स्नातक और स्नातकोत्तर पाठ्यक्रम हते ु जनधाचठरत योग् यता आवश्यकताओं का मल्ू यांकन के पश् चात (प्रपत्र-1) म ें अपेजक्षत िुल्क के साथ आवश्यक जानकारी तथा दस्ट्तावेज जमा करने के उपरांत एक जनरीक्षण पर जवचार दकया जाएगा। (2) नय े संस्ट्थान को आिय पत्र जारी करने स े पहल े जनम्नजलजखत आवश्यकताओं को ध्यान म ेंरखते हुए मल्ू यांकन दकया जाएगा, अथाचत; - (क) होम्योपैथी जिक्षा बोडच द्वारा जनधाचठरत मानदंडों और न्‍दयनू तम आवश्यक मानक स्ट् तर के अनुसार पयाचप्त बुजनयादी ढांचा और जवत्तीय संसाधन; (ख) आवश्यक योग्यता तथा अनुभव को पूरा करने वाले आवश् यक संकाय की जलजखत सहमजत, गैर-जिक्षण कमचचाठरयों की उपलब्धता; (ग) वतचमान होम्योपैथी अस्ट्पताल के समुजचत कामकाज को सुजनजित करन े हते ु अन्‍दय आवश्यक सुजवधाएं जैसा दक जचदकत्सा संस्ट्थान के जलए आवश्यक हों, प्रदान की गई ह;ैं (घ) आयोग के प्रारूप के अनुसार पठरसर का जनरीक्षण करन े के पश् चात राज्य सरकार स े वैध अनापजत्त प्रमाण पत्र, (ङ) जनरीक्षण ठरपोट च के साथ आयोग के प्रारूप म ेंजारी सम्बद्ध जवश्वजवद्यालय स े सम्बद्धता की वैध सहमजत। (3) नई योजना का आवेदन, यदद आवश्यक दस्ट्तावेजों के अनुसार तथा उप-जवजनयम (2) के तहत परू ा प्रदान नहीं दकया गया ह,ै तो वापस कर ददया जाएगा । (4) होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोडच जनरीक्षण के माध्यम स े नई योजना के जलए होम्योपैथी जिक्षा बोडच द्वारा जनर्ददष्ट आवश्यक दस्ट्तावेजों तथा सुजवधाओं के जनरीक्षण के पश् चात आिय पत्र जारी करेगा । (5) नय े जचदकत्सा संस्ट्थान की स्ट्थापना के प्रथम वषच स े पांच वषच के दौरान एव ं उसके पश् चात प्रत्येक वषच अजनवाय च रूप स े आवश्यक िुल्क के साथ आकं लन, न्‍द यनू तम आवश् यक मानक तथा श्रेणीजनधारच ण के मल्ू यांकन हते ु जनरीक्षण दकया जायेगा । (6) नय े संस्ट्थान का होम्योपैथी जिक्षा बोडच द्वारा जनर्ददष्ट आवश्यकताओं के अनुसार चरणबद्ध जवकास का मल्ू यांकन दकया जाएगा। (7) अस्ट् पताल सजहत जचदकत्सा संस्ट्थान के सुचारू कामकाज हते ु जनर्ददष्‍ट ट बुजनयादी ढांच,े जिक्षण तथा गैर-जिक्षण संकाय, जचदकत्सा तथा परै ा-मेजडकल स्ट्टाफ, तथा अन्‍द य उपयुक् त आवश्यक सुजवधाओं के अनुपालन हते ु जनधाचठरत6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] मानदंडों के अनुसार जैसा दक आिय पत्र म ें उल् लेजखत हो तथा होम्योपैथी राष्ट्रीय आयोग के पक्ष में बैंक गारंटी की प्राजप्त के पश् चात अनुमजत पत्र जारी दकया जाएगा। (8)होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोड च महाजवद्यालय के भौजतक जनरीक्षण के पश् चात सभी सुजवधाओं का सत्यापन करेगा, यदद महाजवद्यालय म ें स्ट्थाजपत सुजवधाओं स े संतुष्ट ह ैंतो वह महाजवद्यालय एव ं संलग्न अस्ट्पताल को एक िैक्षजणक वष च हते ु अनुमजत जारी करेगा । यदद कोई आवश्यक सुजवधाओं को संबोजधत दकया गया नहीं पाया गया, तो आगामी िैक्षजणक वष च के जलए अनुमजत पत्र, जैसा भी मामला हो, जारी नहीं दकया जाएगा, अथवा रद्द कर ददया जाएगा । (9) अनुमजत पत्र उस जविेष िक्षै जणक वषच हते ु ही जारी दकया जाएगा जजसके जलए आवेदन प्राप्त हुआ ह ै। (10) नय े जचदकत्सा संस्ट्थानों का मूल्यांकन, आवश्यक िुल्क के साथ खलु न े की जतजथ एव ं वष च स े पांच वष च तक अजनवाय च रूप स े दकया जायगे ा। (11) नए संस्ट्थान का आंकलन, न्‍द यनू तम आवश् यक मानक तथा श्रेणीजनधाचरण हते ु नई योजना के चरणबद्ध जवकास के अनुसार होम्योपैथी जिक्षा बोड चद्वारा जनर्ददष्ट नयी योजना की आवश्यकता के अनुसार दकया जाएगा। 11. नया अथवा उच्चतर अध्ययन पाठ्यक्रम एव ं प्रजिक्षण हते ु नई योजना का आकं लन - (1) एक जचदकत्सा संस्ट्थान द्वारा एक नया उच्चतर पाठ्यक्रम अथवा प्रजिक्षण खोलन े हते ु जनरीक्षण, होम्योपैथी जिक्षा बोड च द्वारा जवजनयम के माध्यम स े जनर्ददष्ट आवेदन की पात्रता की आवश्यकता के अनुसार आंकलन के पश् चात जवचार दकया जाएगा। (2) संस्ट्थान का आंकलन आिय पत्र जारी करन े स े पहले जनम्नजलजखत को ध्यान म ेंरखत े हुए दकया जाएगा: (क) होम्योपैथी जिक्षा बोडच द्वारा जनर्ददष्ट नई योजना के जलए न्‍दयूनतम आवश्यक मानक स्ट्त र, 2024 के अनुसार बुजनयादी ढांच े और जवत्तीय संसाधनों की पयाचप्तता। (ख) जचदकत्सा संस्ट्थान के समुजचत कामकाज को सुजनजित करन े हते ु पयाचप्त िैक्षजणक संकाय, गैर-जिक्षण तथा सहायक कमचचारी, पुस्ट्तकालय तथा प्रयोगिालाओं म ें अजतठरि सुजवधाएं व अन्‍दय सभी आवश्यक सुजवधाएं प्रदान की गई हों। (ग) जनरीक्षण के माध्यम स े आकं लन के अनुसार पयाचप्त एव ं दक्रयािील अस्ट्पताल जजसम ें सुजवधाएं तथा कामकाज हो रहा हो; (घ) जवगत दो वषों के जलए जवश् वजवद्यालय द्वारा जनरीक्षण के पश् चात जवश्वजवद्यालय द्वारा जनरंतरता हते ु जारी संबद्धता प्रमाण पत्र सजहत, संकायों और गाइडों की सूची, (ङ) स्नातक पाठ्यक्रम को प्रभाजवत दकए जबना जवश्वजवद्यालय द्वारा उच्चतर पाठ्यक्रम के जलए संकायों को मंजूरी; तथा (च) राज्य सरकार स े वैध अनापजत्त प्रमाण पत्र। (3) होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोड,च जचदकत्सा संस्ट्थान का जनरीक्षण करेगा, यदद आवेदक संस्ट्थान योग् य पाया गया तो इस हते ु आिय पत्र जारी करेगा । एक जचदकत्सा संस्ट्थान द्वारा एक नया उच्चतर पाठ्यक्रम अथवा प्रजिक्षण िरूु करन े हते ु आिय पत्र म ें जनरीक्षक द्वारा अवलोकन के अनुसार भवन, ढांचागत सुजवधाओं, जचदकत्सा और संबद्ध उपकरण, संकाय तथा अन्‍दय श्रमिजि की आवश्यकता की पणू चता के संबंध म ें एक सूची िाजमल होगी। (4) नए स्नातकोत्तर पाठ्यक्रम अथवा अध्ययन के उच्चतर पाठ्यक्रम अथवा प्रजिक्षण आरंभ करन े हते ु आवश्यकताओं को पूरा करन े म ें जवफलता के मामले म ें होम्योपैथी जचदकत्सा आंकलन एव ं श्रेणीजनधाचरण बोड च द्वारा जनर्ददष्ट समय अवजध के भीतर कजमयों सुधारने का एक अवसर ददया जाएगा। (5) कजमयों को दरू न दकए जाने की जस्ट्थजत म,ें होम्योपैथी जचदकत्सा आंकलन एव ंश्रेणीजनधारच ण बोड च द्वारा योजना को अस्ट्वीकृत कर ददया जाएगा। (6) मूल्यांकन के पश् चात अनमु जत पत्र जारी दकया जाएगा तथा आिय पत्र म ें इंजगत ितों और आवश्यकताओं के अनुपालन व आयोग के पक्ष म ें आवश्यक प्रदिनच बैंक गारंटी अथवा सुरक्षा जमा की प्राजप्त तथा नए स्नातकोत्तर पाठ्यक्रम अथवा उच्चतर पाठ्यक्रम अथवा प्रजिक्षण आरंभ करने के जनयमों के अनुसार आवश्यक संकाय, अन्‍दय श्रमिजि तथा सुजवधाओं की जनयुजि।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 7 (7) होम्योपैथी जचदकत्सा आंकलन एव ंश्रेणीजनधाचरण बोडच द्वारा अनुमोदन स े पहले सभी सुजवधाओं का सत्यापन दकया जाएगा। 12. वतमच ान जचदकत्सा सस्ट्ं थान म ें प्रविे क्षमता म ें वजृ द्ध के जलए योजना का आकं लन- (1) वतचमान जचदकत्सा संस्ट्थान की प्रवेि क्षमता म ें वृजद्ध हते ु जनरीक्षण, होम्योपैथी जिक्षा बोडच द्वारा जनर्ददष्ट न्‍दयनू तम आवश्यक मानक स्ट् तरों के अनुसार आवेदन पात्रता की आवश्यकताओं के आंकलन व अपेजक्षत िल्ु क के साथ आवश्यक जानकारी और दस्ट्तावेज जमा करन े के पश् चात जवचार दकया जाएगा। (2) प्रवेि क्षमता म ें वृजद्ध हते ु आवेदन करने वाले वतचमान जचदकत्सा प्रजिक्षण संस्ट्थान को आिय पत्र जारी करने स े पूवच जनम्नजलजखत को ध्यान म ेंरखते हुए आंकलन दकया जाएगा, अथाचत :- (क) जवजभन्‍द न जनयमों द्वारा अजधसूजचत प्रवेि क्षमता म ें वृजद्ध हते ु न्‍दयनू तम आवश्यक मानक स्ट्त र, 2024 के अनुसार बुजनयादी ढाचं े और जवत्तीय संसाधनों की पयाचप्तता; (ख)योजना म ें जनर्ददष्ट जचदकत्सा संस्ट्थान म ें उजचत कामकाज को सुजनजित करने के जलए आवश्यक िक्षै जणक संकाय, गैर-तकनीकी और सहायक कमचचारी और अन्‍दय आवश्यक सुजवधाएं प्रदान की गई ह;ैं तथा (ग) पयाचप्त अस्ट्पताल सुजवधाएं अजस्ट्तत्व म ें कायचरत ह।ैं (3) होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोड च जचदकत्सा संस्ट्थान का जनरीक्षण करेगा और यदद आवेदक संस्ट्थान योग् य पाया जाता ह,ै तो आिय पत्र जारी करेगा। (4) दकसी जचदकत्सा संस्ट्थान म ें प्रवेि क्षमता बढाने के आिय पत्र म ें भवन, बुजनयादी सुजवधाओं, जचदकत्सा और संबद्ध उपकरण, संकाय तथा अन्‍दय श्रमिजि के संबंध म ें परू ी की जान ेवाली आवश्यकताओं का जववरण िाजमल होगा। (5) प्रवेि क्षमता म ें वृजद्ध के जलए आवश्यकताओं को परू ा करने म ें जवफलता के मामले म,ें होम्योपैथी जचदकत्सा आंकलन एव ंश्रेणीजनधाचरण बोड च द्वारा जनर्ददष्ट समय अवजध के भीतर त्रुठट जनवारण का अवसर ददया जाएगा। (6) त्रुठट जनवारण न दकए जान े की जस्ट्थजत म ें योजना को जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोड च द्वारा अस्ट्वीकृत कर ददया जाएगा। (7) जपछले पांच वषों के दौरान न्‍दयूनतम आवश्यक मानक स्ट्त र के रखरखाव पर जवचार करन े व आिय पत्र म ें इंजगत आवश्यकताओं के अनुपालन तथा पूर्वत के मल्ू यांकन के पश् चात ही अनुमजत पत्र जारी दकया जाएगा। (8) आयोग के पक्ष म ें आवश्यक जनष्‍टपादन बैंक गारंटी अथवा सुरक्षा जमा करने और आवश्यक संकाय तथा अन्‍दय श्रमिजि की जनयुजि। (9) जचदकत् सा आंकलन एव ं श्रणे ीजनधाचरण बोडच द्वारा अवलोदकत आवश्यकताओं को परू ा करने म ें जवफलता के मामल े म,ें प्रवेि क्षमता म ें वृजद्ध की योजना अस्ट्वीकृत कर दी जाएगी। 13. जचदकत्सा सस्ट्ं थानों हते ु श्रणे ीजनधारच ण मापदडं - (1) श्रेणीजनधाचरण के उद्देश्य हते ु जचदकत्सा संस्ट्थानों का आंकलन जनम्नजलजखत मापदंडों पर दकया जाएगा: (i) बुजनयादी ढांचा तथा उपकरण; (ii) मानव तथा जवत्त संसाधन; (iii) अस्ट्पताल संचालन तथा कायचप्रणाली; (iv) जिक्षण-प्रज्ञता कायचक्रम तथा प्रौद्योजगकी; (v) जिक्षा कायचक्रम का मूल्यांकन (पाठ्यक्रम पठरणाम); (vi) अनुसंधान और प्रकािन (vii) समाज तक पहुचाँ ने हते ु कायचक्रम; (viii) कमचचारी अथवा छात्र कल्याण; (ix) राष्ट्रीय आंकलन और प्रत्यायन पठरषद, अस्ट्पतालों के जलए राष्ट्रीय प्रत्यायन बोड,च परीक्षण और अंििोधन प्रयोगिालाओं हते ु राष्ट्रीय प्रत्यायन बोड,च मानकीकरण हते ु अतं राचष्ट्रीय सगं िन;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (x) गुणवत्ता आश्वासन और प्रजतपुजष्ट; और (xi) संकाय और कमचचाठरयों की क्षमता जनमाणच । (2) औसत अंक प्राप्त करने के जलए, जवजनयमों म ें लाग ू आवश्यकताओं की जवजिष्टताओं के अनसु ार, जचदकत्सा संस्ट्थानों द्वारा बुजनयादी ढांच े तथा श्रमिजि के संबंध म ेंघटकों को पूरा दकया जाना आवश्यक ह।ै (3) उच्चतम अंक ऐस े संस्ट्थानों को ददए जाएंग,े जजन्‍दहोंने होम्योपैथी जिक्षा बोडच द्वारा जनर्ददष्ट न्‍दयूनतम आवश्यक मानक स्ट् तर तथा प्रत् यायन, अनुसंधान व प्रकािन, जिक्षा गुणवत्ता पहल तथा अर्वजत उच्च िैजक्षक सुजवधाओं जैसे अन्‍दय घटकों को हाजसल कर जलया ह।ै (4) संस्ट्थानों का श्रेणीजनधारच ण संबंजधत वषच म ेंप्रवेि आरंभ स े पूवच राष्ट्रीय होम्योपैथी आयोग की वेबसाइट पर उपलब्ध कराया जाएगा। (5) जचदकत्सा संस्ट्थानों की वेबसाइट, राष्ट्रीय होम्योपैथी आयोग की वेबसाइट पर उल्लेजखत संस्ट्थानों का श्रेणीजनधाचरण का हलक अपलोड करेगी। (6) आंकलन एव ं श्रणे ीजनधाचरण प्रजतवषच दकया जायेगा। (7) जचदकत्सा संस्ट्थानों को मूल्यांकन के दौरान प्राप्त अंकों के आधार पर वगीकृत दकया जाएगा। अंकों के आधार पर कॉलेजों को 'क ++' श्रेणी, ' क+' श्रेणी, ख+' श्रेणी, ' ख ' श्रेणी स े लेकर ' ग ' श्रेणी तक वगीकृत दकया जाएगा। श्रणे ी आवलोकन अकं क ++ 80% स े अजधक कुल अंक क+ 70% स े 80% तक के कुल अंक ख+ 60% स े 70% तक के कुल अंक ख 50% स े 60% तक के कुल अंक ग कुल अंकों के 50% से कम 14. होम्योपैथी जचदकत्सा आंकलन एव ं श्रणे ीजनधाचरण बोडच द्वारा दकसी योजना की अस्ट्वीकृजत तथा मौजूदा जचदकत्सा संस्ट्थानों को प्रवेि अनुमजत दने े स े इंकार करन े पर अपील - (1) जहां प्रस्ट्ताव प्राप्त होन े के छह महीन े के अंदर अथवा योजना की अस्ट्वीकृजत पर जचदकत्सा अवलोकन एव ंश्रेणीजनधारच ण बोड च द्वारा दकसी योजना पर कोई आदेि पाठरत नहीं दकया जाता ह,ै तो संबंजधत व्यजि ऐसी अस्ट्वीकृजत के तीस ददनों के अंदर आयोग म ेंअपील कर सकता ह।ै (2) आयोग द्वारा जवचार की जाने वाली अपील की प्रजवजध, राष्ट्रीय होम्योपैथी आयोग (सामान्‍दय) जवजनयम, 2023 म ें प्रदान की XBZ ह,ै अपील पर जवचार करत े समय आयोग उसी का पालन करेगा। (3) जहां आयोग न े योजना को अस्ट्वीकृत कर ददया ह ै अथवा इन जवजनयमों के अतं गतच अपील की जतजथ स े पंरह ददनों के अंदर कोई आदेि पाठरत नहीं दकया गया ह,ै संबंजधत व्यजि ऐसे अस्ट् वीकृजत की सूचना के सात ददनों के अंदर केंर सरकार को दसू री अपील कर सकता ह।ै 15. अहतच ा की मान्‍दयता वापस लेना अथवा मान्‍दयता रद्द करना- (1) जनरीक्षण अथवा मूल्यांकन पर, होम्योपैथी जचदकत् सा आंकलन एव ं श्रणे ीजनधाचरण बोडच जचदकत् सा संस्ट्थान को दी गई, दकसी जवश्वजवद्यालय अथवा जचदकत्सा संस्ट्थान द्वारा प्रदत् त अहतच ा की मान्‍दयता वापस लने े अथवा मान्‍दयता रद्द करने के जलए आयोग को जनम्नजलजखत कारणों स े ठरपोट च भेजेगा, अथाचत:- (क) दकसी जवश्वजवद्यालय अथवा जचदकत्सा संस्ट्थान द्वारा आयोजजत दकसी परीक्षा हते ु अध्ययन पाठ्यक्रम तथा परीक्षा अथवा उम्मीदवारों स े अपेजक्षत दक्षता, होम्योपैथी जिक्षा बोड च द्वारा जनर्ददष्ट न्‍दयनू तम आवश्यक मानकों के अनुरूप नहीं ह;ै अथवा (ख) होम्योपैथी जिक्षा बोड च द्वारा जनधाचठरत जचदकत्सा संस्ट्थानों म ें बुजनयादी ढांच,े संकाय और जिक्षा की गुणवत्ता के मानकों और मानदडं ों का दकसी जवश्वजवद्यालय अथवा जचदकत्सा संस्ट्थान द्वारा अनुपालन नहीं दकया जाता ह,ै तथा ऐसा जवश्वजवद्यालय अथवा जचदकत्सा संस्ट्थान जनर्ददष्ट न्‍दयनू तम आवश्यक मानकों को बनाए रखने म ें आवश्यक सुधारात्मक[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 9 कारचवाई करने म ेंजवफल रहा ह,ै आयोग उप-धारा (2) के प्रावधानों के अनुसार कारचवाई आरंभ कर सकता ह:ै (ग) आयोग स्ट् वत: संज्ञान लेकर जुमाचना लगान े अथवा दकसी जवश्वजवद्यालय द्वारा प्रदत् त जचदकत्सा अहतच ा की मान्‍दयता को वापस हते ु कारचवाई आरंभ करेगा। (घ) आयोग, संस्ट् तुजत पर राज्य की सरकार को जजसम ें दक जवश्वजवद्यालय अथवा जचदकत्सा संस्ट्थान जस्ट्थत ह,ै जलखेगा। राज्य सरकार संबद्ध जवश्वजवद्यालय स े स्ट्पष्टीकरण मांगगे ी तथा स्ट्पष्टीकरण प्राप्त होने पर आयोग को संस्ट् तुजत प्रजषत करेगी। (ङ) आयोग, जांच करने के पश्च ात, जैसा उजचत हो, तथा राज्य सरकार अथवा केंर िाजसत प्रदेि अथवा प्रिासन व संबंजधत जचदकत्सा संस्ट्थान, जवश्वजवद्यालय के प्राजधकारी के साथ परामि च करन े के पश् चात, इस जनष्‍टकषच पर पहुचं े दक ऐसी अहतच ा को मान्‍दयता प्रदान की गई ह,ै जचदकत्सा अहतच ा व होम्योपैथी जिक्षा बोड,च संबंजधत जवश्वजवद्यालय अथवा जचदकत्सा संस्ट्थान के जखलाफ बोडच द्वारा रखी गई सूची की प्रजवजष्टयों म ें संिोधन करन े का जनदेि दगे ा तादक ऐसी अह ता च की मान्‍दयता उस आदेि म ें जनर्ददष्ट जतजथ स े वापस ले ली जाए। (च) यदद उजचत पाया गया, तो आयोग जिक्षा आयोग को जनदजे ित करेगा दक प्रदत्त अजधकारों के अनुसार सूची म ें संसोधन कर जनधाचठरत आदेि द्वारा प्रदत् त मान्‍दयता को वापस ले सकता ह ै तथा इस े आम जनता के जलए अपनी वेबसाइट पर अपलोड कर सकता ह।ै 16. होम्योपथै ी जचदकत्स ा महाजवद्यालयों के बदं होन ेकी जस्ट्थजत - (1) आवश्यकता एंव पात्रता,- (क) क्रजमक बंदी अथवा पणू च संवरण की मांग करने वाले वतचमान संस्ट्थान, संबंजधत राज्य और संबद्ध जवश्वजवद्यालय की जसफाठरिों के साथ होम्योपैथी जचदकत् सा आंकलन एव ंश्रेणीजनधाचरण बोडच पर आवेदन करेंगे। (ख) क्रजमक बंदी के मामले म,ें प्रथम स्ट्तर पर बंदी के आरंभ की अनुमजत वतचमान िक्षै जणक वषच म ें दी जाएगी तथा बाद के वषों के कामकाज को प्रत्येक िैक्षजणक वषच के अतं म ें क्रजमक रूप से बंद कर ददया जाएगा। यद्यजप, अंजतम समापन आदिे सभी िैक्षजणक कोस च के पणू च होने तथा कॉलेज द्वारा िपथ पत्र/वचनपत्र (प्रपत्र 1) म ें जमा करन े के पश् चात जारी दकया जाएगा। (ग) पणू च बंद होने की जस्ट्थजत म,ें संस्ट्थान को एक बार म ें परू ी तरह से बंद कर ददया जाएगा। (घ) क्रजमक संवरण या पूण च संवरण, आयोग अथवा राज्य सरकार अथवा केंर सरकार द्वारा संस्ट्थान के जखलाफ दायर दकसी लंजबत अदालती मामले के अधीन नहीं होना चाजहए। (ङ) बंद महाजवद्यालय न्‍दयूनतम आवश्यक जिक्षा जवजनयमों म ें सूचीबद्ध अन्‍दय पाठ्यक्रमों म ें आवेदन करन े का पात्र नहीं होगा। (च) महाजवद्यालय बंद करन े के जलए प्रस्ट्तुत दकया जाने वाला िपथ पत्र जवजनयम के (प्रपत्र 2) के अनुसार होगा। (2) प्रदक्रया: (क) महाजवद्यालय को जवजनयमों के अनुसार होम्योपैथी जचदकत् सा आंकलन एव ं श्रेणीजनधाचरण बोड च को आवेदन करना होगा। (ख) जचदकत् सा आंकलन एव ं श्रणे ीजनधाचरण बोडच अथवा जांच हते ु गठित सजमजत महाजवद्यालय द्वारा प्रस्ट्तुत दस्ट्तावेजों का सत्यापन करेगी। (ग) महाजवद्यालय का बंद होना, आयोग द्वारा अनुमोदन प्राप्त होने पर ही प्रभावी होगा। (3) वतचमान संस्ट्थानों के आवेदन जजन्‍दहोंने संस्ट्थान को बंद करने हते ु आवेदन दकया ह,ै उन्‍दह ें संबद्ध जवश्वजवद्यालय की जनरीक्षण ठरपोट च प्रस्ट्तुत करन े के जलए वतचमान िैक्षजणक वष च के जलए िून्‍दय छात्र प्रवेि के साथ अनुमजत का जवस्ट्तार ददया जाएगा। ऐसे संस्ट्थानों को सभी छात्रों के उत्तीणच होन े (या) के बाद सभी प्रासंजगक दस्ट्तावेज जमा करन े चाजहए अथवा संबद्ध जवश्वजवद्यालय के माध्यम से राष्ट्रीय होम्योपैथी आयोग द्वारा मान्‍दयता प्राप्त नजदीकी होम्योपैजथक महाजवद्यालयों म ें March, 2024 File No. 10-2/MARBH/NCH/2023-24.—In exercise of the powers conferred by sub-section (1) and clauses (v), (w), (x), (y), (z), z(b) and z(c) of sub-section (2) of section 55 read with section 28 of the National Commission for Homoeopathy Act, 2020 (15 of 2020) and in supersession of the Homoeopathy Central Council (Inspectors and Visitors) Regulations, 1982, except as respects things done or omitted to be done before such supersession, the National Commission for Homoeopathy hereby makes the following regulations namely: - 1. Short title and commencement. - (1) These regulations may be called the National Commission for Homoeopathy (Assessment and Rating of Medical Institutions)Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette 2. Definitions. - (1) In these regulations, unless the context otherwise requires- (a) "Act‖ means the National Commission for Homoeopathy Act, 2020 (15 of 2020); (b) ―attached hospital‖ means a teaching homoeopathic collegiate hospital attached to the medical institution; (c) ―course‖ means the courses of study in homoeopathy, namely :- (i) Bachelor of Homoeopathic Medicine and Surgery, means an Undergraduate qualification in Homoeopathy recognised as per the provisions of the Act; (ii) ―Doctor of Medicine (Homoeopathy) or Post Graduation in Homoeopathy‖ a Post Graduate qualification in Homoeopathy recognised as per the provisions of the Act; (iii) any other course with medical qualification recognised by the Homoeopathy Education Board and shall also include trainings or fellowship in Homoeopathy above graduate level. (d) ―Form‖ means a Form annexed to these regulations;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (e) ―Scheme‖ means an organised plan of furnishing information about the Medical Institution for achieving permission and rating; (f) ‗Minimum essential standards‘ means standards laid down by the Homoeopathy Education Board for conducting course(s), examinations and includes norms for infrastructure, faculty and quality of education and research in medical institutions; (g) ‗Inspector‘ means a team of experts appointed by the Medical Assessment and Rating Board or hired through authorised third-party agency by the Medical Assessment and Rating Board for Homoeopathy for carrying out inspection of medical institutions for assessment and rating and maintenance of minimum essential standards as specified by the Homoeopathy Education Board. (2) words and expressions used herein and not defined in the regulations, but defined in the Act, shall have the same meanings respectively as assigned to them in the Act. 3. Procedure of assessment and rating of Medical Institutions. – (1) Each existing medical institution will be invited to submit information in structured format by offline or online mode with relevant annexures on annual basis along with the specified fees to the ‗Medical Assessment and Rating Board for Homoeopathy' for assessment of maintenance of minimum essential standards as specified through regulation and for the rating. (2) Applications received on or before the specified last date of submission along with the required fees shall only be accepted. (3) The medical Institution shall submit continuance of affiliation certificate from the University for the preceding year along with application. (4) All the eligible medical Institution shall be rated by assessment after a period of five years of opening and every year thereafter, subject to maintenance of minimum essential standards as specified. (5) All such documents with are not in English or Hindi shall be translated and annexed certified with the Application form. (6) The Medical Assessment and Rating Board for Homoeopathy shall verify the fulfillment of the medical institutions in terms of compliance of maintaining minimum essential standards followed by rating of such Institutions. (7) The Medical Assessment and Rating Board for Homoeopathy may seek any information, clarification, documents or digital material from any Medical College or Medical Institution at any time for the purpose of assessment and rating. 4. Fee to be submitted along with application.- The application submitted under regulations shall be accompanied by the fee as specified in the Table-1, below by way of a demand draft or online payment, payable to the National Commission for Homoeopathy, New Delhi, namely: - Table No. 1 For existing Homoeopathic Medical Colleges Fees Amount (Rs.) Extension of approval for admissions for existing Institutions based on self-disclosure.–(1) All recognised existing homoeopathic medical Institutions with more than five years of establishment and having permission from Medical Assessment and Rating Board for Homoeopathy or Commission or Government of India continuously during last three years shall get extension of approval for admissions for the subsequent year based on self-disclosure through web portal of the Commission, with an affidavit stating full compliance to Minimum Essential Standards as notified, as per the sanctioned intake capacity of the preceding year of notification of this regulation. Such colleges may be inspected for necessary verification of compliance of regulation during the course of academic year. Extension of approval for admissions shall be conveyed. (i) Provided that the Institution is not acted upon by Medical Assessment and Rating Board for Homoeopathy or Commission or Government of India under the provisions of clause (f) sub-section (1) of section 28 of the National Commission for Homoeopathy Act. (ii) Provided further that no legal or disciplinary issues pending or contemplated against the Institution. (iii) Provided further that the Institution has not violated the provisions of regulations on admission of students as specified through regulations. (2) The existing colleges which do not fall in category as per sub regulation (1) above, shall be given permission or denial for admission in subsequent year only after conducting the inspection. (3) The Medical Assessment and Rating Board for Homoeopathy upon inspection if finds institution not having compliances to Minimum essential standards as specified through regulations shall be acted upon sections 8 and 9 of this regulation. (4) Institutions not seeking permission for admissions or are denied permission, consecutively during last five years, shall be considered fresh, if applies to get permission under scheme of opening of opening of new colleges shall apply under scheme of opening of new colleges as per provisions of the related regulation notified elsewhere. 6. Manner of appointment of inspectors or independent rating agencies for assessment and rating.– (1)The President of Medical Assessment and Rating Board for Homoeopathy shall appoint such number of inspectors, authorised third party agency to inspect the medical institution for assessment and rating for maintenance of minimum essential standards as specified. (2) No person shall be appointed as an inspector unless he or she possesses the following qualification, namely: - (i) a recognised Post Graduate medical qualification in Homoeopathy included in the Degree Recognition List maintained by the Homoeopathy Education Board of the Commission; and (ii) having at least five years professional experience in a Central Government or State Government or Autonomous Institution. (3) The Medical Assessment and Rating Board for Homoeopathy may also hire services of public sector agency, having experience of similar work of assessment or rating of Medical or Non-medical Institutions as independent assessment and rating agency by calling Expression of Interest on mutually agreed terms and conditions after approval of the Commission. (4) The team of experts or independent assessment and rating agency shall follow the guidelines for assessment of Minimum Essential Standards and or rating of the institutions. 7. Manner of carrying out Inspections for Assessment and Rating of Medical Institutions. – The Medical Institutions, shall be inspected for assessment and rating as under: (a) the Medical Assessment Board of Homoeopathy shall authorise such number of Inspectors or through authorised third-party independent rating agency as deemed necessary to inspect Medical Institutions for assessment and rating to maintain the minimum essential standards as specified; (b) inspections shall be carried out in physical or online or hybrid mode. (c) institutions shall also be assessed as per rating criteria specified in these regulations; (d) rating of medical Institutions shall be made available on the website of the National Commission for Homoeopathy every year; (e) inspection teams or Rating Agency shall be provided all the required documents duly signed by the authority of the Institutions as may be asked to submit during inspection; (f) the information and reports with annexures or video recording of inspection for assessment and rating of a Medical Institution shall be kept confidential. It shall be submitted to the Medical14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Assessment or Rating Board for Homoeopathy with signatures of all team members in a sealed cover. Copy of the report to be submitted online to official e-mail of the Board on the same day. (g) the report of inspection for rating and assessment shall be made available to the concerned Institution after final decision has been taken by the Medical Assessment and Rating Board for Homoeopathy; and (h) more than one inspection for a college can be conducted during an academic year, if found necessary by the Medical Assessment and Rating Board for Homoeopathy or by the Commission. 8. Failure to maintain minimum essential standards. - Upon assessment, if any Institution is not maintaining the minimum essential standards as specified, the Medical Assessment and Rating Board for Homoeopathy, shall reduce the intake of seats or deny permission for admissions and recommend to the Commission for withdrawal of recognition in that particular academic year or subsequent year as the case may be. 9. Imposition of penalty for failure to maintain minimum essential standards of education. – The Medical Assessment and Rating Board for Homoeopathy shall issue warning, impose penalty or to take action against the medical Institution for the following reasons namely:- (i) monetary penalty shall be imposed on the Medical Institution for submitting forged documents in support of claim for maintenance of minimum essential standards; (ii) monetary penalty shall be imposed on the Medical Institution in case of providing false teaching experience to a teacher or to any other staff; and (iii) monetary penalty shall be imposed on the Medical Institution having ghost teachers on their faculty list appointed by them as full-time teachers. (iv) the Medical Assessment and Rating Board for Homoeopathy, may issue warning to the Medical Institution with the directions to rectify the deficiencies in maintaining the Minimum Essential Standards in time bound manner as specified ; (v) failure to rectify the deficiencies within the time period given, if noticed monetary penalty as recommended by the Medical Assessment and Rating Board for Homoeopathy and approved by the Commission shall be imposed on the Medical Institution; (vi) amount of penalty shall be deposited in the Account of the National Commission for Homoeopathy; (vii) permission to the Medical institution shall be denied in the subsequent year if monetary penalty is not deposited to the Commission in time; 10. Inspection for Assessment of scheme for establishment of new medical institution. – (1) Inspection for establishing a new Medical Institution shall be considered after assessment of eligibility requirements as per the norms laid down by the Homoeopathy Education Board for imparting Under Graduate and Post Graduate courses on submission of required information, and documents along with requisite fee as per the norms as prescribed in the (Form-1). (2) New Institution shall be assessed keeping in view of the following requirements before issuing letter of Intents, namely:- (a) adequacy of infrastructure and financial resources as per norms and minimum essential standards laid down by the Homoeopathy Education Board; (b) written consent of the required faculty fulfilling the essential qualification and experience, availability of non-teaching staff; (c) other necessary facilities have been provided to ensure proper functioning of the existing Homoeopathy Hospital and as may be required for the Medical Institution; (d) valid No Objection Certificate from the State Government after holding inspection of the premises as per the format of the Commission; (e) valid consent of affiliation from the affiliating University issued in the format of the Commission with the report of inspection; (3) The application of new scheme shall be returned, if the same is not completed in terms of the required documents and provided under sub-regulation (2).[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 15 (4) The Medical Assessment and Rating Board for Homoeopathy shall issue Letter of Intent after verification of required documents and facilities as specified by the Homoeopathy Education Board for new scheme through inspection. (5) The new Medical Institution shall be inspected for assessment for Minimum Essential Standards and rating compulsorily every year after five years from the date and year of establishment, with required fee. (6) Assessment of the new Institution shall be carried out according to phase wise requirements for development for new Scheme as specified by the Homoeopathy Education Board. (7) A Letter of Permission shall be issued after assessment of compliance of minimum essential standards as per the criteria laid down for infrastructure, teaching and non-teaching faculty, medical and para- medical staff, and other adequate facility required and specified for proper functioning of Medical Institution including hospital and specific requirements as indicated in the Letter of Intent and receipt of the required Performance Bank Guarantee in favor of the National Commission for Homoeopathy. (8) The Medical Assessment and Rating Board for Homoeopathy shall verify all facilities after physical inspection of the College, if satisfied on the facilities established in the College and Collegiate Hospital shall issue for permission for one academic year. If any essential facilities are found as not addressed, Letter of Permission for subsequent academic year, as the case may be, shall not be issued, or cancelled. (9) Letter of Permission shall be issued for the particular academic year for which the application is received. (10) New Medical Institution shall be assessed compulsorily every year for five years from the date and year of opening with required fee. (11) Assessment for Minimum Essential Standards and Rating of the new Institution shall be carried out according to requirements of phase wise development as per the new scheme as specified by the Homoeopathy Education Board. 11. Assessment of new scheme for opening new or higher course of study or training. -(1) Inspection for opening a new higher course or training by a medical institution shall be considered after assessment of eligibility requirements for application as specified by the Homoeopathy Education Board through regulation. (2) The Institution shall be assessed keeping in view of the following before issuing Letter of Intent, namely :- (a) adequacy of infrastructure and financial resources as per Minimum Essential Standards, 2024 for new scheme as specified by the Homoeopathy Education Board; (b) adequate academic faculty, non-teaching and supportive staff, additional facilities in Library and Laboratories and all other necessary facilities have been provided to ensure proper functioning of medical institution; (c) adequate hospital facilities and functioning are in existence as assessed through inspection; (d) The continuance of Affiliation Certificate with list of faculties and guides issued by the University after the University inspections for the last two years; (e) approval of faculties for higher course by the University without affecting Under Graduate course; and (f) valid No Objection Certificate from the State Government (3) The Medical Assessment and Rating Board for Homoeopathy shall inspect the Medical Institution and issue Letter of Intent, if the applicant institution is found eligible. The Letter of Intent to start a new higher course or training by a Medical Institution shall include a statement of requirements to be met in respect of buildings, infrastructural facilities, medical and allied equipment, faculty, and other manpower as assessed by the Inspector. (4) In case of failure to fulfill the requirements for opening new Post Graduate Course or higher course of study or training, an opportunity to rectify the defects, within a time period as specified by the Medical Assessment and Rating Board for Homoeopathy, shall be given. (5) In the case of defects not removed, the scheme shall be disapproved by the Medical Assessment and Rating Board for Homoeopathy.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (6) Letter of Permission shall be issued after assessment of compliance of the conditions and requirements indicated in the Letter of Intent and on receipt of the required Performance Bank Guarantee or security deposit in favour of the Commission and appointment of required faculty, other manpower and facilities as per regulations for opening new Post Graduate Course or Higher Course of study or training. (7) All the facilities shall be verified before approval by the Medical Assessment and Rating Board for Homoeopathy. 12. Assessment for scheme for increase in seating capacity in the existing medical institution. – (1) Inspection for increase in intake capacity in existing Medical Institution shall be considered after Assessment of Eligibility Requirements for application as per Minimum Essential Standards as specified by the Homoeopathy Education Board and on submission of required information and documents along with requisite fee. (2) The existing medical institution applying for increase in seating capacity shall be assessed keeping in view of the following, before issuing Letter of Intent, namely:- (a) adequacy of infrastructure and financial resources as per Minimum Essential Standards, 2024 for increase in seating capacity as notified by separate regulations; (b) required academic faculty, non-teaching and supportive staff and other necessary facilities have been provided to ensure proper functioning of Medical Institution as specified in the scheme; and (c) adequate hospital facilities and functioning are in existence. (3) The Medical Assessment and Rating Board for Homoeopathy shall inspect the Medical Institution and issue Letter of Intent, if the applicant Institution is found eligible. (4) The Letter of Intent to increase in seating capacity in a Medical Institution shall include a statement of requirements to be met in respect of buildings, infrastructural facilities, Medical and allied equipment, faculty, and other manpower. (5) In case of failure to fulfill the requirements for increase in seating capacity, an opportunity to rectify the defects, within a time period as may be specified by the Medical Assessment and Rating Board for Homoeopathy, shall be given. (6) In case of defects not removed, the scheme shall be disapproved by the Medical Assessment and Rating Board for Homoeopathy. (7) Letter of Permission shall be issued only after considering the maintenance of Minimum Essential Standards during the last five years and also after assessment of compliance and fulfillment of requirements indicated in the Letter of Intent. (8) Submission of required performance Bank Guarantee or security deposit in favor of the Commission and appointment of required faculty and other manpower. (9) In case of failure to fulfill the requirements as assessed by the Medical Assessment and Rating board, the scheme for increase in seating capacity shall be disapproved. 13. Rating criteria for the Medical Institutions. - (1) The Medical Institutions shall be assessed on the following parameters for rating purpose: (i) infrastructure and equipment; (ii) human and finance resources; (iii) hospital operations and functionalities; (iv) teaching-learning program and technology; (v) evaluation of education program (Course outcome); (vi) research and publications; (vii) community outreach program; (viii) staff or student welfare; (ix) accreditation like National Assessment and Accreditation Council, National Accreditation Board for Hospitals, National Accreditation Board for Testing and Calibration Laboratories, International Organisation for Standardization; (x) quality assurance and feedback; and (xi) capacity building of the faculty and staff.[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 17 (2) The components in respect of infrastructure and manpower are required to be fulfilled by the Medical Institutions, as per the specifications of requirement of applicable in regulations, to have an average score. (3) The higher score shall be given for such Institutions, who have achieved minimum essential standards as specified by the Homoeopathy Education Board and other components like accreditation, research and publications, quality education initiatives and higher educational facility acquired. (4) The rating of Institutions shall be made available on the website of the National Commission for Homoeopathy before the admissions are open in the respective year. (5) The website of Medical Institutions shall publish the link on rating of institutions mentioned on the website of the National Commission for Homoeopathy. (6) Assessment and Rating shall be done annually. (7) The Medical Institutions shall be graded based on the scores obtained during the assessment. Based on the scores, colleges will be rated from ‗A+‘ Grade, ‗A‘ Grade, ‗B+‘ Grade, ‗B‘ Grade up to ‗C‘ Grade. Appeals on disapproval of a scheme and denial of permission to existing medical institutions for admissions by the Medical Assessment and Rating Board for Homoeopathy. – (1) where no order is passed by the Medical Assessment and Rating Board on a scheme within six months of receiving the proposal or on disapproval of the scheme, the person concerned may prefer an appeal to the Commission within thirty days of such disapproval. (2) Manner of appeal to be considered by the Commission has been provided in the National Commission for Homoeopathy (General) Regulations, 2023. The Commission shall follow the same while considering appeal. (3) where the Commission has disapproved the scheme or no order has been passed within fifteen days from the date of preferring appeal under these regulations, the person concerned may prefer a second appeal to the Central Government, within seven days of the communication of such disapproval. 15. Withdrawal of recognition or de-recognition of qualification.- (1)Upon inspection or assessment, the Medical Assessment and Rating Board for Homoeopathy shall send report to the Commission for withdrawal of recognition or de-recognition of qualification granted to the Medical Institution by a University or Medical Institution on the following reasons, namely :- (a) the courses of study and examination to be undergone in, or the proficiency required from candidates at any examination held by a University or Medical Institution do not conform to the minimum essential standards specified by the Homoeopathy Education Board; or (b) the standards and norms for infrastructure, faculty and quality of education in medical institutions as determined by the Homoeopathy Education Board are not adhered to by any University or Medical Institution, and such University or Medical Institution has failed to take necessary corrective action to maintain specified minimum essential standards, the Commission may initiate action in accordance with the provisions of sub-section (2): (c) the Commission shall initiate action to impose penalty or take action for suo-moto withdrawal of recognition granted to the medical qualification awarded by a University. (d) The Commission on the recommendation shall write to the Government of the State in which the University or Medical Institution is situated. The State Government shall seek explanation from the affiliating University and upon receiving such explanation shall make the recommendations to the Commission. (e) the Commission shall, after making such further inquiry as it deems fit, and after holding consultations with the State Government or Union territory administration and the authority of the18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] concerned University of Medical Institution, comes to the conclusion that the recognition granted to such medical qualification ought to be withdrawn and by order, shall withdraw recognition granted and upload it on its website for general public (f) The Commission shall direct the Homoeopathy Education Board to amend the entries against the University or Medical Institution concerned in the list maintained by that Board to the effect that the recognition granted to such qualification is withdrawn with effect from the date specified in that order. 16. Closure of Homoeopathy Medical Colleges. - (1) Requirement and eligibility,- (a) The existing Institution seeking for progressive closure or complete closure shall apply to the Medical Assessment and Rating Board for Homoeopathy with the recommendations of the concerned State and from the affiliating University. (b) In case of progressive closure, closure at first level shall be allowed in the current academic year and the subsequent years of working shall be closed at the end of each academic year progressively. However, final closure order shall be issued after completion of the program(s) and submission of Affidavit/Undertaking (Form 1) by the College. (c) In case of complete closure, the institution shall be closed completely in one instance. (d) Progressive closure or complete closure is subject to no pending court case filed against the Institution by the Commission or State Government or Central Government. (e) College shall not be eligible to apply to other courses listed in Minimum Essential Education regulation. (f) The affidavit to be submitted for closure of the College shall be as per (Form 2) of the regulation. (2) Procedure: (a) The College has to apply to Medical Assessment and Rating Board for Homoeopathy as per the Regulations. (b) Medical Assessment and Rating board or Committee constituted for scrutiny shall verify the documents submitted by the college. (c) The closure of College shall be effected only on receipt of approval by the Commission. (3) Applications of existing institutions which have applied for closure of the institution, shall be given an extension of permission with zero student intake for the current academic year, for submission of Inspection report of affiliated University. Such institutions should submit all relevant documents after all students passed out (or) redistributed or transferred through affiliated University to nearby Homoeopathic Medical Colleges as recognised by the National Commission for Homoeopathy and seek official closure of the college. (4) The application for closure of the College shall be valid for the duration of the course within which the Institution should submit the required mandatory documents. Medical Assessment and Rating Board for Homoeopathy may close the College after approval of the Commission with the intimation to the affiliating University and State Government or Union territory Administration and shall issue a Public Notice regarding the same. In case of such institutions where Bank Guarantee is to be released, a penalty of the value of security deposit as may be decided by the Commission shall be imposed before the release of same. 17. Criteria for relaxation.- The Commission upon consultation with the Central Government shall relax Minimum Essential Standards as specified by the Homoeopathy Education Board for medical institutions which are set up in such areas like Hills, Tribal, North-Eastern States, or as deemed necessary by the Commission in consultation with the Central Government subject to the condition that quality of education and health care services shall not be affected seriously.
