(Medi)/2013.- In exercise of its power conferred under sub-section [1] of Section 23 of the All India Council for Technical Education Act, 1987 (52 of 1987), All India Council for Technical Education hereby notifies the following Medical Reimbursement Scheme for the superannuated employees and their dependent family members of AICTE namely: 1. Short Title The scheme may be called “All India Council for Technical Education (AICTE) Medical Scheme, 2017 for superannuated employees of AICTEand their dependent family members”. 2. Extent of Application 2.1 They shall come into force from the date of their notification. 2.2 They shall apply to the all superannuated employees of AICTE and their dependent family members, except: (a) The superannuated employees drawing salary and/or covered under a medical or reimbursement scheme elsewhere by virtue of the office which they are holding after retirement from the AICTE till their continuance as such. (b) The superannuated employees who are re-employed by AICTE in continuation of regular employment and continue to get benefit like a regular employee during the period of re-employment, till they continue in re-employment. 2.3 The scheme shall also apply to the employees, already retired but the benefit will be extended from the date of the scheme is adopted by the AICTE. 2.4 The benefit of this scheme shall also be extended to the dependent family members of any employee of AICTE who dies either during service period or after superannuation. 3. Definitions 3.1 “Controlling officer” means an officer designated by the Competent Authority to be a Controlling Officer. 3.2 “Competent Authority” means the Chairman of the Council and may include any other officer so designated by him in this behalf. 3.3 “Superannuated Employees” means employeeswho have superannuated from AICTE having rendered a continuous service of not less than 5 years after being appointed/absorbed by and the roll of the AICTE, who is allowed to avail the benefit under the AICTE Medical Attendance Scheme, 1994, amended from time to time. 3.4 “Government”means the Government of India. 3.5 “Empaneled Hospitals and Diagnostic Centers” means the Government Hospitals/Diagnostic Centers including all recognized Private Hospitals/Diagnostic Centers under CGHS for Specialized and General Purpose Treatment/Diagnostic Procedures recognized vide Ministry of Health and Family Welfare O.M. No.S.11045/36/2012-CGHS (HEC) dated 01.10.2014 as amended from time to time or any Private Hospital/Diagnostic Centers notified/authorized by the AICTE. Any changes subsequently made shall automatically apply to the AICTE. 3.6 “Beneficiary” means any retired employee of the AICTE and their dependent family members as defined in the Central Service (Medical Attendance) Rules, 1944 as amended from time to time and the dependent family members of any employee of AICTE who dies either during service period or after superannuation. 3.7 The dependent members of the family shall also be entitled to medical treatment even if they do not stay with the superannuated employee of AICTE. 3.8 The members of the family are treated as dependent only if their income including pension and pension equivalent to gratuity is less than Rs. 9,000/- p.m. 3.9 “Pay”means Basic Pay plus Grade Pay plus Non Practicing Allowances, if any, as per the revised pay applicable to the various posts in the AICTE consequent upon implementation of the recommendation of the Sixth Central Pay Commission. For employees who have superannuated and are eligible for facilities under these schemes, pay means the last pay drawn before the superannuation.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 15 3.10 “Residence”means the place of residence where the retired employee or member of his family ordinarily resides. 3.11 “Authorized/Notified Medical Practitioner” means a registered medical practitioner having a degree recognized under the Indian Medical Council Act, 1956 as amended from time to time, or a Registered Medical Practitioner holding Degree or Diploma in Ayurveda/Unani/Siddha/Homeopathy of not less than 04 years’ duration from a University/Statutory Board/Council/Faculty of Indian Medicine Central Council Act, 1970/Homeopathy Central Council Act, 1973, as the case may be. A list of Authorized Medical Practitioners will be prepared and maintained by the Council, area wise on the requests of the employees based on relevant documentary proof including prescription with registration number of the concerned Registered Medical Practitioners. If an employee is receiving treatment from the OPD of an empaneled hospital/CGHS recognized hospital the attending physician will be treated as deemed authorized/Notified Medical Practitioner for the AICTE. 4. Admission to the scheme 4.1 Admission to the Scheme is not automatic. An employee who is willing to avail the medical benefits for self/spouse/dependents after retirement shall submit an option within a period of three months prior to the date of superannuation from the AICTE as formats specified in Annexure-I(A) & Annexure-I(B) to the Director (Admn), AICTE. 4.2 The Administration Wing shall process the case and register such employee by issuing Medical Booklet/card as per format specified in Annexure-II. 4.3 The retired employee opting to avail the facilities of this shall not be eligible to draw the medical allowance. 4.4 In the event of death of the employee after retirement, the spouse and other eligible dependent member of the family may continue to avail the facility. 4.5 The Medical Card/Book shall be rendered invalid from the date of any of the eligibility conditions ceases to be fulfilled by the employee or his/her dependent. 4.6 No expenses incurred by the retired employee on treatment prior to his admission to the scheme shall be reimbursed 5. Income of Dependents 5.1 The declaration about income of dependent family members as defined in Rules 3.8 shall be furnished (in the prescribed from given at Annexure-III) INDOOR TREATMENT 6. Entitlement 6.1 The entitlement for room facility i.e. General Ward, Semi-Private Ward, Private Ward, Day Care (6-8 hrs. admission) in case of hospitalization shall be same as may be proscribed by the Central Government Health Scheme from time to time. 6.2 The entitlement for room rent for General Ward, Semi-Private Ward, Private Ward and Day care is as per CGHS rates as amended from time to time. 6.3 The superannuated employees of the AICTE shall be entitled for medical treatment including the cost of treatment, pathological, radiological, scanning, hospital accommodation, nursing home facilities etc. as per the package rates prescribed vide Ministry of Health and Family Welfare O.M. No.S.11045/36/2012-CGHS (HEC) dated 01.10.2014 as amended from time to time. 6.4 The superannuated employees of the AICTE may get medical treatment in any of the empaneled hospital/diagnostic centre on the advice of Authorised/Notified Medical Practitioner/attending physician. However, in case of emergency they may go to any private or recognized private hospital/diagnostic centre nearest to their place of residence. 6.5 The charges paid for clinical test, etc., to a private non-recognized hospitals/diagnostic centre shall be reimbursable as per the rate prescribed for CGHS beneficiaries. Where there are no rates prescribed, the expenses incurred shall be reimbursed on actual basis. 6.6 If during treatment in an empanelled hospital/diagnostic centre, special nursing becomes necessary, the employee or a member of his family shall be entitled to such special nursing as may be deemed essential for the recovery or for the prevention of serious deterioration in the condition of the patient having regard to the nature of the disease. The amount to be reimbursed for such special nursing shall be limited to the amount,16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] which is in excess of 25% of the pay of the employee concerned for the period for which special nursing was necessary. For this purpose, a certificate from the Medical Officer-in-charge countersigned by the Medical Superintendent shall be produced. 6.7 Package rates for duration of indoor treatment shall be the same as prescribed by the CGHS from time to time. 7. Submission of claims 7.1 Final claims for reimbursement (indoor treatment) of medical expenses for a particular spell of illness shall ordinarily be preferred within Six (6) months, from the date of completion of the treatments shown in the last Essentiality Certificate issued by the attending physician. 7.2 All claims for reimbursement (indoor treatment) should accompany with an Essentiality Certificate and Cash Memos/vouchers duly signed by the Medical Officer indicating the Registration number. 7.3 The application for medical claims shall be submitted in the prescribed form given at Appendix ‘A’. 7.4 The Essentiality Certificate (for indoor treatment) shall be given in the prescribed form given at Appendix ‘B’. 7.5 All the expenses on indoor treatment shall initially be met by the superannuated employee and shall claim for medical reimbursement on completion of the treatment. 7.6 Normally the recognized private hospitals/diagnostic centres who entered into agreement with the AICTE shall charge the rates approved for the package rate. They shall also extend credit facility in emergency cases as specified in Memorandum of Agreement signed with Private Hospitals/diagnostic centers to the retired employee of the AICTE undertaking treatment in their hospital/diagnostic centre and submit the bill for reimbursement as per approved rates to the AICTE. However, in case of hospitals/diagnostic centre insisting for immediate payment of the cost of treatment, room rent, medicines, various tests, etc., the AICTE may sanction advance payment to the extent of 90% of approximate expenses as per package rate prescribed for CGHS beneficiaries and issue an account payee cheque in the name of the hospital concerned. The balance payment shall be made on submission of final claim by the beneficiary. OUTDOOR TREATMENT 8. The superannuated employee of the AICTE, shall be entitled for non-hospitalization cases, for themselves and their dependent family members on production of prescription from Authorised/notified Medical Practitioners along with bills/cash memos of medicines/tests, etc. The cost of Consultation Fees/test prescribed by Authorised/notified Medical Practitioners shall be reimbursement as per CGHS rates. The cost of admissible medicines prescribed by Authorised/notified Medical Practitioners shall be reimbursed on actual basis. 9. Submission of claims 9.1 The superannuated employee of the AICTE, who opted these scheme is required to prefer the claim within six (6) months from the date of completion of treatment in the prescribed form given in Appendix ‘C’. 9.2 The superannuated employee of the AICTE who opted these scheme is also required to submit: - (i) Original Prescription with Registration Number of the Authorized/ Notified Medical Practitioner; and (ii) Original Bills/Cash Memos of medicines/tests. 10. Other conditions 10.1 Inadmissible medicines as specified in schedules of I and II of Rules 2(h) of the CS(MS) Rules, 1944 are not reimbursable. 10.2 The Competent Authority in the AICTE shall be empowered to disallow any claim or part of the claim which does not satisfy the required conditions for such claim. 11. Interpretation Whenever clarification/interpretation/relaxation and extension of any of the provision of the scheme arises, the decision of the Chairman, AICTE shall be final in such matters.
