L.-33004/99 सी.जी.-डी.एल.-अ.-02012024-251056 xxxGIDHxxx CG-DL-E-02012024-251056 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 01] नइ ददल्ली, सोमिार, जनिरी 1, 2024/पौर् 11, 1945 No. 01] NEW DELHI, MONDAY, JANUARY 1, 2024/PAUSHA 11, 1945 राष्ट्रीय अयर्वु िज्ञान अयोग ऄजधसचू ना नइ ददल्ली, 29 ददसम् बर, 2023 स.ं सीडीएन-19012/5/2023-समन्िय-एनएमसी-(i).—राष्ट्रीय अयुर्विज्ञान अयोग के साथ जनजित, और जिजिष्ट रूप से राष्ट्रीय अयुर्विज्ञान अयोग ऄजधजनयम, 2019 (2019 का ऄजधजनयम 30) की धारा 35, 36, 37, 38, 39 और 40 के साथ पठित धारा 57 की ईपधारा (2) की ईपधारा (जेडपी), (जेडक्यू), (जडे अर), (जडे एस), (जडे टी), धारा 24 की ईपधारा (1ज)े , धारा 25 की ईपधारा (1अइ), धारा 26 की ईपधारा (1एफ) के माध्यम से प्रदत्त समग्र प्राजधकार का प्रयोग करते हुए राष्ट्रीय अयर्वु िज्ञान अयोग जनम्नजलजखत जिजनयम बनाता ि ै – ऄध्याय I - प्रारंजभक, सजं िप्त िीर्कष , पठरभार्ाएँ 1. नामािली - आन जिजनयमों को राष्ट्रीय अयर्वु िज्ञान अयोग (जचदकत्सा योग्यता की मान्यता) जिजनयम, 2023 और संजिप्त रूप में आसे "एनएमसी मान्यता" जिजनयम किा जाएगा। 2. जिजनयमों का प्रारंभ - ये सभी जिजनयम राजपत्र में ऄजधसूचना के माध्यम से प्रकािन के जतजथ से प्रिृत्त िोंगे। 3. पठरभार्ाएं - आन जिजनयमों में, जब तक दक संदभष से ऄन्यथा ऄपेजित न िो, आसमें पठरभाजर्त िब्दों का ििी ऄथष िोगा, जो नीचे ददया गया ि ैऔर आनकी सजातीय ऄजभव्यजियों और जिजिधताओं का ऄथष तदनुसार समझा जाएगा – क. "ऄजधजनयम" से राष्ट्रीय अयुर्विज्ञान अयोग ऄजधजनयम, 2019 (2019 का ऄजधजनयम संख्या 30) ऄजभप्रेत िोगा। 22 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ख. "अयोग" से राष्ट्रीय अयर्वु िज्ञान अयोग ऄजधजनयम, 2019 की धारा 3 के ऄधीन स्ट्थाजपत राष्ट्रीय अयुर्विज्ञान अयोग ऄजभप्रेत िोगा। ग. "जिदिे ी प्राजधकरण" से भारत के बािर दकसी भी दिे में ऐसा प्राजधकरण ऄजभप्रते िोगा, जजसे भारत में ऄपनी जचदकत्सा योग्यता या योग्यताओं की मान्यता के जलए अयोग के पास अिेदन करने के जलए ईस दिे के काननू द्वारा ईस दिे में जचदकत्सा योग्यता को मान्यता देने की िजि सौंपी गइ ि ैया दी गइ ि।ै घ. "सचू ी" से भारत में मान्यता प्राप्त जचदकत्सा योग्यताओं की सूची ऄजभप्रेत िोगी, जजसे संबंजधत बोडष द्वारा ऄजधजनयम की धारा 35 के ऄनसु ार तैयार दकया गया ि।ै ङ. "जचदकत्सा सस्ट्ं थान" से राष्ट्रीय अयुर्विज्ञान अयोग ऄजधजनयम, 2019 की धारा 2 की ईपधारा (i) म ें पठरभाजर्त जचदकत्सा संस्ट्थान ऄजभप्रेत िोगा और आसमें अम तौर पर समझे जाने िाले रूप में मेजडकल कॉलजे भी िाजमल िोगा। च. "पीजीएमइबी" से राष्ट्रीय अयर्वु िज्ञान अयोग ऄजधजनयम, 2019 की धारा 16 के ऄधीन जिजधित रूप से गठित स्नातकोत्तर जचदकत्सा जििा बोडष ऄजभप्रते ि।ै छ. "जनरीिण" - जनरीिण की ऄजभव्यजि या गजतजिजध में िास्ट्तजिक और/या जडजजटल ठरकॉडष या जानकारी का िचुषऄल और/या भौजतक जनरीिण और/या मूल्याकं न िाजमल िोगा। ज. "एमएसअर" से समय-समय पर यथाजस्ट्थजत दकसी भी बोडष (यजू ीएमइबी या पीजीएमइबी) द्वारा ऄजधसूजचत अिश्यकताओं के न्यूनतम मानक ऄजभप्रते िोंगे, जजसमें आन बोडों या अयोग द्वारा जारी दकए गए व्याख्यात्मक नोट, पठरपत्र, एडिाआजरी अदद भी िाजमल िोंगे। झ. "यजू ीएमइबी" से राष्ट्रीय अयुर्विज्ञान अयोग ऄजधजनयम की धारा 16 की ईपधारा (1)(क) के तित जिजधित रूप से गठित स्नातक जचदकत्सा जििा बोडष ऄजभप्रेत िोगा। 4. व्याख्या - आन जिजनयमों में प्रयिु िब्दों और िाक्यांिों जजन्ि ें यिां पठरभाजर्त निीं दकया गया ि,ै लेदकन राष्ट्रीय अयुर्विज्ञान अयोग ऄजधजनयम, 2019 में पठरभाजर्त दकया गया ि,ै का ििी ऄथष िोगा जो ििां ददया गया ि।ै ऄध्याय II - भारत म ेंमान्यता प्राप्त जचदकत्सा योग्यताओं की व्यापक सचू ी 5. मान्यता प्राप्त जचदकत्सा योग्यताओं की सचू ी का रखरखाि – स्नातक जचदकत्सा योग्यता के संबंध में स्नातक जचदकत्सा जििा बोडष और स्नात्कोत्तर जचदकत्सा योग्यता के संबंध में स्नात्कोत्तर जचदकत्सा जििा बोडष द्वारा बनाए रखी जान े िाली भारत में मान्यता प्राप्त जचदकत्सा योग्यताओं की सूची रखी जाएगी। I. मान्यता प्राप्त स्नातक योग्यताओं की सूची: एम.बी.बी.एस.(बैचलर ऑफ मजे डजसन और बैचलर ऑफ सजरष ी) II. मान्यता प्राप्त स्नात्कोत्तर योग्यताओं की सचू ी: क. स्नात्कोत्तर बोडष जििेर् योग्यता [एम.डी.(डॉक्टर ऑफ मजे डजसन)/ एम.एस.(मास्ट्टर ऑफ सजषरी)] - पीजीएमइअर-2023 का ऄनलु ग्नक-I ख. स्नात्कोत्तर ऄजत जििेर् पाठ्यक्रम [डी.एम.(डॉक्टरेट ऑफ मेजडजसन)/ एम.सीएच.(मास्ट्टर ऑफ जचरूगी)] - पीजीएमइअर-2023 का ऄनलु ग्नक-II ग. स्नात्कोत्तर जडप्लोमा पाठ्यक्रम-पीजीएमइअर-2023 का ऄनलु ग्नक-III घ. पोस्ट्ट-डॉक्टोरल प्रमाणपत्र पाठ्यक्रम(पीडीसीसी) -पीजीएमइअर-2023 का ऄनलु ग्नक-IV ङ. पोस्ट्ट-डॉक्टोरल ऄजधछात्रिजृ त्त(पीडीएफ)- पीजीएमइअर-2023 का ऄनलु ग्नक-V च. डी.एम./एम.सीएच. छः िर्ष की ऄिजध के पाठ्यक्रम- पीजीएमइअर-2023 का ऄनलु ग्नक-VI III. एनएमसी ऄजधजनयम,2019 के ऄनुसार भारत में िैधाजनक जनकाय या ऄन्य जनकाय द्वारा दी गइ जचदकत्सा योग्यता की श्रेजणयों की सूची IV. भारतीय जचदकत्सा पठरर्द ऄजधजनयम, 1956 की तीसरी ऄनसु ूची के भाग-I के ऄनुसार योग्यताओं की सूची[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 V. भारतीय जचदकत्सा पठरर्द ऄजधजनयम, 1956 की दसू री ऄनुसूची और तीसरी ऄनुसचू ी के भाग-II के ऄनुसार योग्यताओं की सूची परंतु, ईपरोि पर प्रजतकूल प्रभाि डाले जबना भारत में जचदकत्सा योग्यताओं की तैयार की गइ ऐसी सूची को जनयजमत रूप से ऄद्यतन दकया जाएगा और संबंजधत बोडों द्वारा प्रकाजित दकया जाएगा। ऄनुमोददत पाठ्यक्रमों की सूची (ऄनुसचू ी-I) संबंजधत बोडों (यजू ीएमइबी और पीजीएमइबी) द्वारा रखी जाएगी और समय-समय पर ऄद्यतन की जाएगी। ऄध्याय III - नइ जचदकत्सा योग्यताओं को िाजमल करना 6. नइ जचदकत्सा योग्यता को िाजमल करन े के जलए अिदे न – नइ योग्यता को िाजमल करने के जलए अिेदन की स्ट्िीकृजत संबंजधत बोड षद्वारा तत्संबंधी अिश्यकता पर सोच-जिचार के ऄधीन िोगी। स्नातक या स्नातकोत्तर या सुपर-स्ट्पेजियजलटी जचदकत्सा योग्यता प्रदान करने िाला कोइ भी जचदकत्सा संस्ट्थान दकसी भी नइ जचदकत्सा योग्यता को िाजमल करने के जलए ऐसे दस्ट्तािेजों और सूचना के साथ संबंजधत बोडष के पास अिेदन कर सकता ि,ै जो पिले से सूची में िाजमल निीं ि।ै परंतु कोइ जिदिे ी प्राजधकरण दकसी भी जचदकत्सा योग्यता को िाजमल करने के जलए ऐसे दस्ट्तािेजों और सूचना के साथ संबंजधत बोडष के पास ऄपना अिेदन जमा करेगा, जो पिले से सूची में िाजमल निीं ि।ै 7. अिदे न िल्ु क – धारा 8 में दिाषए गए ऐसे दकसी भी अिेदन पर संबंजधत बोडों द्वारा तब तक जिचार निीं दकया जाएगा जब तक दक िुल्क के रूप में प्रजत योग्यता 2,50,000/- रूपये (दो लाख पचास िजार रूपये मात्र) जमा न दकए जाए।ं परंतु भारत के बािर दकसी भी दिे में कोइ भी जिदिे ी प्राजधकरण, जजसे मान्यता सौंपी गइ ि,ै एक प्रोफामाष में ऄपना अिेदन जमा करते समय अयोग को िुल्क के रूप में प्रजत योग्यता $ 10,000 (केिल दस िजार ऄमठे रकी डॉलर) भजे ेगा। 8. सचू ना, ऄजतठरि सचू ना अदद प्रस्ट्ततु करना - धारा 8 के तित जमा दकए गए दकसी भी अिेदन पर संबंजधत बोड ष द्वारा तब तक जिचार निीं दकया जाएगा जब तक दक आसके साथ संबंजधत बोडष द्वारा प्रोफामाष के रूप में या ऄन्यथा मांगी गइ सभी ऄजनिायष सूचना संलग्न निीं की जाएगी। परंतु, आसके सिारे से ऐसा कुछ भी निीं पढा जाएगा जो अिेदन जमा करते समय या अिेदन जमा करने के बाद अिेदक से ऄजतठरि सूचना मागं ने के जलए संबंजधत बोडष को बाध्य करेगा या प्रजतबजं धत करेगा। यदद संबंजधत बोडष द्वारा ऄजतठरि सूचना मांगी जाती ि,ै तो अिेदक का यि कतषव्य िोगा दक िि ऐसी सूचना यथािीघ्र या संबंजधत बोडष द्वारा जनर्ददष्ट समय के भीतर प्रस्ट्ततु करे। 9. सबं जं धत बोडष द्वारा अिदे न की जाचं - ऄजधजनयम के समग्र ईद्देश्य को ध्यान में रखते हुए, आन जिजनयमों में ऄन्यत्र किी गइ दकसी भी बात पर प्रजतकूल प्रभाि डाले जबना, संबंजधत बोडष ईपरोि धारा 8 के तित प्राप्त अिेदन का मूल्याकं न जनम्नजलजखत में से सभी या दकसी भी व्यापक मानदडं के अधार पर करेगा – क. भारत में ऐसी प्रस्ट्ताजित जचदकत्सा योग्यता को मान्यता दने े की िांछनीयता और व्यििायषता के संदभष में समग्र प्रभाि। ख. क्या मान्यता के जलए प्रस्ट्ताजित जचदकत्सा योग्यता पयाषप्त िैिजणक तपस्ट्या, गुणित्ता, मानक जििण दजृ ष्टकोण अदद का पठरणाम ि।ै ग. एक बार मान्यता जमल जाने के बाद प्रस्ट्ताजित जचदकत्सा योग्यता जचदकत्सा सेिाओं की मांग करते समय जनता के मन में भ्रम पैदा निीं करेगी। घ. भारत में सािजष जनक नीजत पर ऐसी मान्यता का समग्र प्रभाि। ङ. आस संबंध में ऐसे दकसी भी ऄन्य सोच-जिचार को संबंजधत बोडों द्वारा ऄजधसूजचत दकया जाना ि।ै 10. आन जिजनयमों की धारा 8 या ऄन्यत्र पर प्रजतकूल प्रभाि डाले जबना, संबंजधत बोडष प्रस्ट्ताजित जचदकत्सा योग्यताओं को मान्यता दने े के जलए अिेदन पर जिचार करते समय अिेदक से कोइ ऄजतठरि सूचना या स्ट्पष्टीकरण या ऄजतठरि दस्ट्तािेज मांग सकता ि।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 11. संबंजधत बोडष से संचार प्राप्त िोने की तारीख से जनर्ददष्ट समय या 30 ददन के भीतर, जो भी पिले िो, अिेदक ईपरोि मांगी गइ ऐसी सूचना या स्ट्पष्टीकरण या ऄजतठरि दस्ट्तािजे प्रदान या प्रस्ट्ततु करेगा। परंतु जनर्ददष्ट समय के भीतर बोडष द्वारा यथाऄपेजित कमी को दरू करने या िीक करने या ऐसी सूचना या स्ट्पष्टीकरण प्रस्ट्तुत करने या ऄजतठरि दस्ट्तािजे अदद प्रदान करने में जिफलता का पठरणाम ऄस्ट्िीकृजत िोगी। 12. आन जिजनयमों में या ऄन्यत्र किी गइ दकसी भी बात के बािजूद, सूची में िाजमल करने के जलए प्रस्ट्ताजित जचदकत्सा योग्यता को मान्यता देने से पिले संबंजधत बोडष ऄपने जििके से मूल्यांकन की ईपयुि पद्धजत का जनधारष ण करेगा। परंतु मूल्याकं न की ऐसी ईपयुि पद्धजत में जडजजटल या भौजतक रूप में दस्ट्तािजे ों का सत्यापन, लाआि िीजडयो फीड, फोटोग्राफ या भौजतक जनरीिण, जैसा भी मामला िो, के माध्यम से सत्यापन िाजमल िोगा, लेदकन यि आतने तक िी सीजमत निीं िोगा। 13. मल्ू याकं न का पठरणाम और जचदकत्सा योग्यता की मान्यता - दकए गए मूल्यांकन के ऄनुसार, संबंजधत बोडष नइ मान्यता प्राप्त जचदकत्सा योग्यता को सूची में िाजमल करेगा, और छि मिीने के भीतर अिेदक को आसकी सूचना दगे ा। परंतु यि दक यदद संबंजधत बोडष ईजचत मूल्याकं न के बाद जचदकत्सा योग्यता को मान्यता दने े के जलए प्रस्ट्ततु अिेदन को ऄस्ट्िीकार करना चािता ि,ै तो िि अिेदक को सुनिाइ का ईजचत ऄिसर ददए जाने के बाद ऐसा कर सकता ि,ै और अिेदक को यथािीघ्र सूजचत करेगा। 14. अयोग के समि ऄपील - कोइ जचदकत्सा संस्ट्थान या जिदिे ी प्राजधकरण जचदकत्सा योग्यता को मान्यता दने े के जलए ऄपने अिेदन के संबंध में संबंजधत बोडष के जनणषय की सचू ना प्राप्त िोने की तारीख से साि ददन के भीतर दकसी भी जनणषय के जखलाफ अयोग के समि ऄपील दायर कर सकता ि।ै 15. केंद्र सरकार के समि ऄपील - जिां कोइ अिेदक आन जिजनयमों की धारा 16 के तित अयोग के जनणषय से व्यजथत ि,ै या जिां अयोग ऐसे अिेदन की प्राजप्त की तारीख से साि ददन के भीतर ऄपना जनणषय देने में जिफल रिता ि,ै पीज़ित पि ऐसे अदिे की तारीख या समय व्यतीत िोने की तारीख, जैसा भी मामला िो, से तीस ददन के भीतर केंद्र सरकार के समि ऄपील कर सकता ि।ै ऄध्याय IV - योग्यता की मान्यता को िापस लने ा 16. यदद स्नातक जचदकत्सा जििा बोडष या स्नातकोत्तर जचदकत्सा जििा बोडष, जैसा भी मामला िो, यूजीएमइअर या पीजीएमइअर में ईजल्लजखत योग्यताओं की ऄनुसचू ी या सूची से दकसी योग्यता को िापस लेने का जनणषय लते ा ि,ै तो ऄनुसचू ी में सूचीबद्ध योग्यताए ंिापस ली जाएगं ी; संबंजधत बोडष जनम्नजलजखत अधारों पर ऐसा कर सकता ि:ै 1) पूिषिती एमसीअइ/एनएमसी द्वारा जनधाषठरत मानकों के अधार पर िुरू में ऄनुमोददत योग्यताए ंिापस ली जा सकती ि,ैं यदद ऐसी योग्यता ऄब प्रासंजगक निीं ि;ै 2) िैकजल्पक पाठ्यक्रम ईपलब्ध ि;ै 3) भारतीय या ऄतं रराष्ट्रीय जनकायों से योग्यताएं, जो कोइ भी मानक जनधाषठरत दकए जबना पूिषिती एमसीअइ/एनएमसी द्वारा स्ट्िीकार की गइ ि,ैं यदद एनएमसी के तित जनधाषठरत मानकों के साथ िैकजल्पक पाठ्यक्रम ि।ैं 17. अयोग को िापस लने ेकी जसफाठरि करना - जचदकत्सा योग्यता की मान्यता िापस लेने के जलए बोडों में से दकसी एक या जचदकत्सा मूल्याकं न और रेटटग बोडष की जसफाठरि प्राप्त िोने पर अयोग पिली बार में आसकी जाचं करेगा और यदद अिश्यक िोगा तो संबंजधत जचदकत्सा संस्ट्थान से ऄजतठरि सूचना भी मांग सकता ि ैऔर यदद आस जनष्कर्ष पर पहुचँ े दक - क. ऄध्ययन के पाठ्यक्रम और अयोजजत की जाने िाली परीिा या जचदकत्सा संस्ट्थान द्वारा अयोजजत दकसी भी परीिा में ईम्मीदिारों से ऄपेजित दिता स्नातक जचदकत्सा जििा बोडष या स्नातकोत्तर जचदकत्सा जििा बोडष, जैसा भी मामला िो, द्वारा जनर्ददष्ट मानकों के ऄनुरूप निीं ि।ै ख. जचदकत्सा संस्ट्थान में ऄिसरं चना, संकाय और जििा की गुणित्ता के संबंध में यथाजस्ट्थजत स्नातक जचदकत्सा जििा बोडष या स्नातकोत्तर जचदकत्सा जििा बोडष द्वारा जनधाठष रत मानकों और मानदडं ों का जचदकत्सा संस्ट्थान द्वारा पालन निीं दकया जाता और ऐसा जचदकत्सा संस्ट्थान जनर्ददष्ट न्यूनतम मानकों को बनाए रखने के जलए अिश्यक[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 सुधारात्मक कारषिाइ करने में जिफल रिा ि ै और जचदकत्सा संस्ट्थान ईि जचदकत्सा योग्यता प्रदान करने के जलए जनधाठष रत मानकों को बनाए रखने में जिफल रिा ि।ै 18. अयोग द्वारा मान्यता को िापस लने े का जनणयष लने ा - ईपरोि धारा 18 के ऄनुसार जनष्कर्ष जनकालने में मदद के जलए, अयोग संबंजधत जचदकत्सा संस्ट्थान या जिदिे ी प्राजधकरण के संबंध में ठरपोटष तुरंत संबंजधत बोडष (स्नातक या स्नातकोत्तर) को ऄग्रेजर्त करेगा और जचदकत्सा योग्यता की मान्यता को िापस लेने की ऄजधसचू ना जनकालने के जलए ऐसे बोडष को जनदिे दगे ा। परंतु यि दक अयोग के अदिे की प्राजप्त पर, यथाजस्ट्थजत स्नातक जचदकत्सा जििा बोडष या स्नातकोत्तर जचदकत्सा जििा बोडष जचदकत्सा संस्ट्थान या जिदिे ी प्राजधकरण के नाम के सामने की गइ संबंजधत प्रजिजष्ट में संिोधन करेगा, जजसम ें यि दिाषया जाएगा दक ईि जचदकत्सा योग्यता की मान्यता को ईत्तरव्यापी प्रभाि से िापस जलया जा रिा ि।ै 19. मान्यता िापस लने े स े पिल े सनु िाइ का ईजचत दने ा - Nomenclature – These Regulations may be called the National Medical Commission (Recognition of Medical Qualification) Regulations, 2023; and in its abbreviated form as ―NMC Recognition‖ Regulations. 2. Commencement of the Regulations – All these Regulations shall come into force from the day of publication. 3. Definitions – In these Regulations, unless the context otherwise requires the terms defined herein shall bear the meaning assigned to them below and their cognate expressions and variations shall be construed accordingly – a. ―Act‖ shall mean the National Medical Commission Act, 2019 (Act No. 30 of 2019). b. ―Commission‖ shall mean National Medical Commission established by Section 3 of the National Medical Commission Act, 2019. c. ―Foreign Authority‖ shall mean an authority in any country outside India, which by the law of that country is entrusted or endowed with the power of recognition of medical qualifications in that country, making an application to the Commission seeking recognition of their medical qualification or qualifications in India. d. ―List‖ shall mean the list of recognized medical qualifications in India, prepared as per Section 35 of the Act, by the concerned Board. e. ―Medical Institution‖ shall mean a medical institution as defined in subsection (i) of Section 2 of the National Medical Commission Act, 2019 and shall also include medical college in its commonly understood form. f. ―PGMEB‖ shall mean the Post Graduate Medical Education Board, duly constituted under Sec. 16 of National Medical Commission Act.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] g. ―Inspection‖ – the expression or activity of inspection shall include virtual and/or physical inspection and/or evaluation of actual and/or digital records or information. h. ―MSR‖ shall mean the Minimum Standards of Requirements as Notified by either of the Boards (UGMEB or PGMEB) as the case may be from time to time, which shall also include explanatory notes, circulars, advisories etc., issued by these Boards or Commission. i. ―UGMEB‖ shall mean the Under Graduate Medical Education Board, duly constituted under Sub-section (1)(a) of Section 16 of the National Medical Commission Act. 4. Interpretation – Words and phrases used in these Regulations which are not defined here, but defined in the National Medical Commission Act, 2019 shall have the same meaning assigned to them there. CHAPTER II –COMPREHENSIVE LIST OF RECOGNISED MEDICAL QUALIFICATIONS IN INDIA 5. Maintenance of list of recognized medical qualifications– List of recognised medical qualifications in India to be maintained by the Under Graduate Medical Education Board (UGMEB) in respect of undergraduate medical qualifications and the Post Graduate Medical Education Board (PGMEB) for the post-graduate medical qualification. i. List of Recognised Under Graduate qualifications: M.B.B.S. (Bachelor of Medicine and Bachelor of Surgery) ii. List of Recognised Post-Graduate qualifications: a. Post-graduate Broad Speciality Qualifications [M.D. (Doctor of Medicine)/ M.S. (Master of Surgery)] – Annexure-I of the PGMER-2023 b. Post-graduate Super Speciality Courses [ D.M. (Doctorate of Medicine)/ M.Ch (Master of Chirurgie)]- Annexure-II of the PGMER-2023 c. Post-graduate Diploma Courses - Annexure-III of the PGMER-2023 d. Post-Doctoral Certificate Courses (PDCC)- Annexure-IV of the PGMER-2023 e. Post-Doctoral Fellowship (PDF)- Annexure-V of the PGMER-2023 f. D.M./M.Ch. Courses of six years duration - Annexure-VI of the PGMER-2023 iii. List of the categories of Medical qualifications granted by Statutory Body or Other body in India as per the Schedule to NMC Act, 2019 iv. List of qualifications as per Part-I of the Third Schedule of the Indian Medical Council Act, 1956 v. List of qualifications as per Second Schedule and Part-II of the Third Schedule of the Indian Medical Council Act, 1956 Provided, without prejudice to the above such prepared list of medical qualifications in India shall be updated regularly and published by the respective Boards. The list of approved courses (Schedule- I) will be maintained by the respective Boards (UGMEB and PGMEB) and will be updated from time to time. CHAPTER III – INCLUSION OF NEW MEDICAL QUALIFICATIONS 6. Application for inclusion of new medical qualification – Acceptance of an application for a new qualification shall be subject to consideration of necessity by the respective Board. Any medical institution conferring an undergraduate or postgraduate or super-speciality medical qualification may apply to the concerned Board, along with such documents and information, for inclusion of any new medical qualification, which is not already included in the list. Provided a foreign authority shall submit its application to the concerned Board along with such documents and information for inclusion of any medical qualification, which is not already included in the list. 7. Application fee – No such application indicated in Section 8 shall be considered by the concerned Board unless submitted with INR 2,50,000/- (Rupees two lakh and fifty thousand only) per qualification as fees. Provided any foreign authority in any country outside India, entrusted with the recognition shall remit $10,000 (US dollars ten thousand only) per qualification as fees to the Commission while submitting its application in a proforma. 8. Furnishing of information, additional information etc. – No application submitted under Section 8 shall be entertained by the respective Board unless it is appended with all mandated information sought by way of proforma or otherwise by the respective Board.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7 Provided, nothing shall be read herewith, to constrain or restrict the respective Board to seek additional information from the applicant while submitting the application or after submitting the application. If asked for additional information by the respective Board, it shall be the duty of the applicant to submit such information as early as possible or within the time specified by the respective Board. 9. Examination of the application by the respective Board – Keeping in mind the overall objective of the Act, without prejudice to anything stated elsewhere in these Regulations, the respective Board shall evaluate the application received under Section 8 above, based on all or any of the following broad criteria – a. the overall impact in terms of desirability and feasibility of recognition of such proposed medical qualification in India. b. Whether the proposed medical qualification for recognition is the outcome of sufficient academic rigour, quality, standard learning approaches etc., c. Once given recognition the proposed medical qualification would not create confusion in the mind of the public while seeking medical services. d. The overall impact of such recognition upon the public policy in India. e. Any such other considerations are to be Notified by the respective Boards in this regard. 10. Without prejudice to section 8 or elsewhere in these Regulations, the respective Board may seek any additional information or clarification or additional documents from the applicant while considering the application for a grant of recognition to the proposed medical qualifications. 11. The applicant shall provide or furnish such information or clarification or additional documents sought above, within a specified time or 30 days, whichever is earlier, from the date of receipt of communication from the respective Board. Provided failure to remove or correct the deficiency or submit such information or clarification or provide additional documents etc., as required by the Board within a specified time shall result in the rejection. 12. Notwithstanding anything stated in these Regulations or elsewhere, the respective Board at its sole discretion determine the appropriate method of evaluation before grant of recognition of the proposed medical qualification to be included in the list. Provided such appropriate method of evaluation shall include, but not be limited to verification of documents in digital or physical form, verification through a live video feed, photographs, or physical inspection as the case may be. 13. Evaluation result and recognition of medical qualification – As per the evaluation carried out, the respective Board shall include the newly recognized medical qualification into the list, and communicate the same to the applicant within six months. Provided that, if the respective Board after due evaluation, rejects the application submitted to it for recognition of a medical qualification, may do so after the grant of reasonable opportunity of being heard to the applicant, and shall communicate to the applicant at the earliest. 14. Appeal to the Commission – A medical institution or a foreign authority may file an appeal before the Commission against any decision regarding their application for a grant of recognition to the medical qualification, within sixty days from the date of receipt of communication of the decision by the respective Board. 15. Appeal to the Central Government – Where an applicant is aggrieved by the decision of the Commission under Section 16 of these Regulations, or where the Commission fails to give its decision within sixty days from the date of receipt of such an application, the aggrieved party may prefer an appeal before the Central Government within thirty days from the date of such order or lapse of time, as the case may be. CHAPTER IV – WITHDRAWAL OF RECOGNITION OF QUALIFICATION 16. The qualifications listed in the schedule to be withdrawn if the Undergraduate Medical Education Board or the Post Graduate Medical Education Board, as the case may be, decides to withdraw a qualification from the schedule or the list of qualifications mentioned in the UGMER or PGMER, the respective Board may do so on the following grounds; 1) Qualifications initially approved by the erstwhile MCI/ NMC, based on the set of standards prescribed by them can be withdrawn, if such qualification is no more relevant; 2) Alternative course is available; 3) Qualifications from Indian or international bodies, accepted by erstwhile MCI/ NMC without prescription of any standards, if there are alternative courses prescribed with standards, under NMC.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 17. Recommending withdrawal to the Commission – The Commission on receipt of the recommendation of either of the Boards or Medical Assessment and Rating Board for withdrawal of recognition of medical qualification, shall examine the same in the first instance and may also seek further information from the concerned medical institution, if required and if arrives at the conclusion that – a. The courses of study and examination to be undergone or the proficiency required from candidates at any examination held by the medical institution does not conform to the standards specified by the Undergraduate Medical Education Board or the Post Graduate Medical Education Board, as the case may be b. The standards and norms for infrastructure, faculty and quality of education in the medical institution as determined by the Undergraduate Medical Education Board or the Postgraduate Medical Education Board, as the case may be, are not adhered to by the medical institution, and such medical institution has failed to take necessary corrective action to maintain specified minimum standards and the medical institution has failed to maintain the prescribed standards for imparting of the said medical qualification. 18. Commission deciding the withdrawal of recognition – In furtherance of forming a conclusion as per section 18 above, the Commission shall forthwith forward the report in respect of the concerned medical institution or a foreign authority to the respective Board (undergraduate or postgraduate) and direct such Board to Notify the withdrawal of recognition of medical qualification. Provided that the Undergraduate Medical Education Board or the Postgraduate Medical Education Board, as the case may be, on receipt of the Order of the Commission, shall amend the concerned entry made against the name of the medical institution or a foreign authority indicating that the said medical qualification’s recognition is being withdrawn prospectively. 19. Reasonable audience prior to the withdrawal of recognition – Without prejudice to anything stated above, no withdrawal of recognition of a medical qualification vis-à-vis a medical institution or a foreign authority shall happen without the grant of a reasonable opportunity to the medical institution or a foreign medical authority concerned.
