This order shall be called the Central Electricity Regulatory Commission (Miscellaneous Provisions) Order, 2016. 2. This shall come into force from the date of publication in Official Gazette. 3. The words and expressions used in this order shall have the same meaning as defined in the Electricity Act, 2003 and the Central Electricity Regulatory Commission (Conduct of Business) Regulations 1999, as amended from time to time.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 9 Place of Office and working hours of the Commission 4. The Head Office of the Commission, until further order shall be located at 3rd Floor, Chanderlok Building, 36, Janpath, New Delhi - 110 001. The working hours of the Commission on all working days shall be between 9.30 a.m. to 6.00 p.m., with lunch break from 1.30 p.m. to 2.00 p.m. Authentication of Orders 5. In addition to the Secretary, the Bench Officer or any other officer authorized by the Chairperson shall be competent to authenticate the judicial orders of the Commission. Seal of the Commission 6. The official seal of the Commission shall be as under: Presentation of petitions, applications, replies etc. 7. All petitions, applications, replies, rejoinders, written submissions and other documents shall be filed in the Registry of the Commission from 10.00 A.M. till 4.00 P.M. on all working days. The hard copies shall be accompanied by a compact disc (CD) / Digital Video Disc (DVD) (containing the soft copy) in PDF as well as doc format and in excel form, wherever applicable. The Petitioners and Respondents may also mail the soft copy in doc form as well as excel form to the cr@cercind.gov.in. 8. From a date to be notified by the Commission, all petitions, applications, replies, rejoinders, written submission and other documents shall be filed in electronic form through the e-filing application on CERC website. 9. The Petitioners/ Applicants/ Respondents shall submit the names of at least two authorized officers of their organizations along with their phone numbers and e-mail addresses for correspondence in connection with the proceedings in the petition or application. Authority to represent before the Commission 10. A party to any proceedings before the Commission may either appear in person or may authorize a legal practitioner or an authorized representative to present its case before the Commission and to do all or any of the acts for the purpose. Explanation: Authorized Representative shall include professional viz. a practising Chartered Accountant or Company Secretary or Cost and Works Accountant or any of the officers of the party concerned. 11. The person whether a company or Joint Venture Company or any other body shall nominate one or more officers as authorized signatories who shall sign the pleadings to be filed before the Commission. The names of the authorized signatories shall be sent to the Secretary of the Commission for record. 12. A legal practitioner appearing and acting on behalf of any person in the proceedings before the Commission shall file a Vakalatnama in the form in Annexure I, duly executed by the authorized signatory of the person for whom he appears. The Vakalatnama shall bear full address, phone number and the e-mail ID of the legal practitioner. 13. Any authorized representative appearing and acting on behalf of any party before the Commission shall file a Memorandum of Appearance, in the form in Annexure II, duly signed by the authorized signatory of the person for10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] whom he appears. The Memorandum of Appearance shall bear the address, phone number e-mail ID of both the authorized signatory and the representative who files the Memorandum of Appearance. 14. The Vakalatnama or Memo of Appearance duly signed by Authorized Signatory is mandatory for appearing before the Commission and it should be filed in the Registry of the Commission at least two days prior to the date of hearing of the petition. 15. In case of change of the legal practitioner or authorized representative during the course of the proceedings in a petition, the concerned person shall execute the new Vakalatnama or authorization letter before the Commission. Seal of the Commission with receipt stamp 16. The staff member in the Registry of the Commission receiving the petition, application, reply or other documents, shall affix the receipt stamp with the seal of the Commission on the first page of all the copies and put his initials on the stamp. Listing of cases for hearing 17. The information regarding the listing of the petitions or applications for hearing shall be posted on the website of the Commission for the information of all concerned. The notice for hearing shall be communicated to the parties by post as well as through e-mail. Communication of notice through e-mail shall be considered as sufficient proof of service. Grant of Certified copies 18. Every Record of Proceedings, order granting, refusing or modifying interim relief and final order shall be communicated to the parties to the petition free of cost. Provided that these documents may also be communicated to the parties through e-mail which will be considered as sufficient proof of service 19. Any person desirous of obtaining a certified copy of any Record of Proceedings or order of the Commission or any document forming part of the record before the Commission may submit an application in the prescribed form as per Annexure III. 20. The application for certified copy shall be accompanied by a payment advance for payment of ` 20 per page through NEFT in the Account No. 209914801140001, Corporation Bank, K.G. Marg, New Delhi – 110001 (IFSC Code CORP0002099 and Bank Code 2099). 21. As far as practicable, the certified copies shall be prepared in the seriatim in which the applications are entered in Register of Copy Applications. 22. The certified copies shall be prepared by photocopying process or generating copies from the word file of the computer and when the copy is so made, it shall be compared by the person preparing the copy, to satisfy himself that the copy has been prepared faithfully and legibly reproduces the document desired. 23. An endorsement as under shall be affixed on the reverse of the last page of the document: (i) Sl. No. of the application (ii) Name of the applicant (iii) Date of presentation of the application (iv) No. of pages (v) Copying fee charged (vi) Date on which copy is ready (vii) Date of delivery 24. The Bench Officer and in his absence, any other officer authorized by the Chairperson shall be authorized to issue the certified copies. He shall affix his signature below the endorsement on the reverse of the last page of the certified copy. 26. In all cases of supplying certified copies, whether supplied free of cost or on the basis of the application submitted by the party, the Bench Officer or any other officer authorized shall cause to affix the seal of the Commission on all pages of the copy. He shall also append a certificate as under and affix his initials on the last page of the document: “Certified True Copy” 27. The copying fee payable for obtaining a certified copy shall be `20/- per page irrespective of number of words / lines in each page. Inspection of Records 28. The application for inspection of documents shall be in the form in Annexure IV and shall be accompanied by a fee of `500/- for each inspection for one day as per the details given in Rule 24 of this order. 29. The inspection of records shall be allowed on working days during working hours in the presence of an officer authorized for that purpose, ordinarily during 1430 hours to 1630 hours on any working day of the Commission. 30. The person inspecting the records shall not in any manner cause dislocation, mutilation, tampering or damage to records in the course of inspection. 31. The officer supervising the inspection may at any time prohibit further inspection, if in his opinion any of the records are likely to be damaged in the process of inspection and shall immediately, make a report about the matter to the Chief(Legal) / Secretary and seek further orders on the matter. Fee on petitions, applications, etc. 32. Every petition/application filed before the Commission shall be accompanied by fee specified in the Central Electricity Regulatory Commission (Payment of Fees) Regulations, 2012, as amended from time to time. Provided that NLDC / RLDCs and the Consumer Groups registered with the Government of India or with the Commission are exempt from payment of fee prescribed. 33. The fee shall be payable through NEFT or RTGS in accordance with the Public Notice dated 28.1.2015 as per the details given in Rule 24 of this order. 34. The details of the fee remitted shall be furnished to the Commission as per the format in Annexure V within three days of the remittance of fees for reconciliation of the account and record.
