1. संजिप्त नाम एि ं प्रारम्भ.—(1) इन जिजनयमों को जिश्वजिद्यालय अनुदान आयोग (समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान) (संिोधन) जिजनयम, 2021 कहा िाएगा। (२) ये जिजनयम िासकीय रािपत्र में उनके प्रकािन की जतजथ से लाग ूहोंग े। 2. जिश्वजिद्यालय अनुदान आयोग (समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान) जिजनयम 2017 (इसके पश्चात इन्ह ें उिजिजनयम कहा गया ह)ै के जिजनयम 2.0 ( पररभाषाएं ) में - (क) खंड 2.10 के जलए जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा अथाात:् - "2.10 मंत्रालय का अजभप्राय “जििा मंत्रालय”। 01 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) खंड 2.12 के जलए जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा अथाात:् - “ 2.12 ऑफ कैंपस सेंटर का अजभप्राय समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान के भारत के भीतर पररसर से अलग जस्ट्थत सरकार द्वारा अनुमोददत पररसर से ह”ै । (ग) खंड 2.13 के जलए जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “2.13 ऑफ-िोर कैंपस का अजभप्राय समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान के भारत के बाहर इसके पररसर से परे जस्ट्थत सरकार द्वारा अनुमोददत सेंटर से है”। (घ) खंड 2.15 म ें “भारतीय आयुर्िाज्ञान पररषद (एमसीआई) िब्दों के जलए “"राष्ट्रीय आयुर्िाज्ञान आयोग”” िब्द प्रजतस्ट्थाजपत दकए िाएंग"े । 3. उि जिजनयमों के जिजनयम 4.0, उप-जिजनयम 4.2 म,ें ) खंड 4.2.7 के जलए, जनम्नजलजखत उप-जनयम को प्रजतस्ट्थाजपत दकया िाएगा, अथाात: - "4.2.7 जििक - छात्र अनपु ात की गणना के प्रयोिन के जलए संकाय म ेंजनयजमत जििक, सहायक जििक, जिदेिी जििक, अजतजथ जििक, संजिदात्मक जििक, उद्योग जििक और सीजमत अिजध जििक (Tenure Track faculty) या संबंजधत व्यािसाजयक जनयामक पररषद द्वारा अनमु ोददत संकाय। तथाजप, कम से कम 60% जििक को स्ट्थायी/ जनयजमत आधार पर जनयिु दकया गया हो और इस प्रयोिन के जलए अंिकाजलक जििक की गणना नहीं की िाएगी। इसके अजतररि, 60% स्ट्थायी/ जनयजमत जििको को दकसी भी समय जििक छात्रों के 1:10 अनुपात को भगं नहीं होना चाजहए।" 4. उि जिजनयमों के उप-जिजनयम 5.2 म,ें “मानि संसाधन जिकास मंत्रालय” िब्दों के जलए जनम्नजलजखत िब्द “मंत्रालय” प्रजतस्ट्थाजपत दकया िाएगा। 5. उि जिजनयमों के जिजनयम 6 म,ें उप-जिजनयम 6.1 म ें खंड (iii) के जलए जनम्नजलजखत खंड प्रजतस्ट्थाजपत दकया िाएगा। "(iii) ग्रीनफील्ड संस्ट्थानों के जलए प्रायोजित संगठन म ें िे सदस्ट्य होने चाजहए जिनकी सामूजहक रूप से कुल जनिल संपजत्त कम से कम पांच हिार करोड़ रुपए हो। मौिूदा संस्ट्थानों के जलए, प्रायोिक संगठन की कुल जनिल संपजत्त कम से कम तीन हिार करोड़ रुपये होनी चाजहए। इस प्रयोिन के जलए, सदस्ट्यों अथिा संगठन, िैसा भी मामला हो, की जपछल ेतीन जित्तीय िषों की जनिल संपजत्त के औसत को ध्यान में रखा िाएगा "। 6. उि जिजनयमों के जिजनयम 8.0 म-ें (क) उप-जिजनयम 8.1 म,ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए दोनों स्ट्थानों पर िहां िे हैं, जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा; (ख) उप-जिजनयम 8.2 के खंड 8.2.1 म,ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए, जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा; (ग) उप-जिजनयम 8.4 म;ें - (i) खंड (क) म,ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए, जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा; (ii) खंड (घ) म,ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए, जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (iii) खंड (ङ) के जलए, जनम्नजलजखत खंड को प्रजतस्ट्थाजपत दकया िाएगा, अथाात्: - “(ङ) मंत्रालय खडं (घ) के अधीन जसफाररिों के प्राप्त होन े के दो सप्ताह के भीतर एक आिय पत्र िारी करेगा, या अन्यथा आिेदन को अस्ट्िीकार कर दगे ा। यदद संस्ट्थान दकसी भी समय अपने आिय पत्र (LoI) को अभ्यर्पात कर देता ह,ै तो संस्ट्थान के आिेदन को जनिर्तात माना िाएगा और आिेदन/प्रसंस्ट्करण िल्ु क को िब्त कर जलया िाएगा। " (iv) खंड (छ) म,ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए, जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा; (v) खंड (ि) म,ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए, िहां भी िे ह,ैं जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा; (vi) खंड (i) म,ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए, जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा; 7. उि जिजनयमों के जिजनयम 11.0 के उप-जनयम 11.2, में - (क) खंड 11.2.4 के जलए, जनम्नजलजखत खडं प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - "11.2.4 समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान को अपन ेकायाक्रमों के भाग के रूप म ेंऑनलाइन पाठ्यक्रम प्रदान करने की स्ट्ितंत्रता होगी। यदद दकसी कायाक्रम के सभी पाठ्यक्रमों की ऑनलाइन संचाजलत/ प्रदान दकया िाता ह,ै तो इसका उल्लेख संबंजधत प्रमाणपत्र/ जडग्री म ेंभी दकया िाना चाजहए।” (ख) खंड 11.6.2 के पश्चात जनम्नजलजखत खडं ों को िाजमल दकया िाएगा, अथाात:् - " 11.7 ऑफ कैंपस सटें र (सटें रों) की स्ट्थापना- समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थानों को नए ऑफ कैंपस सेंटर (सेंटरों) (5 िषों में अजधकतम 3 और एक िैिजणक िषा म ें 1 से अजधक नहीं) को आरंभ करने की अनुमजत होगी, इसके नीचे उजल्लजखत प्रदक्रया का पालन करना होगा: 11.7.1- समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान अपने आिेदन को जनधााररत प्रोफामाा में जिस्ट्तृत पररयोिना ररपोट ा (डीपीआर) के साथ मंत्रालय को प्रस्ट्ततु करेंग े जिसमें 10 िषा की नीजतगत जििन योिना और 5 िषा की प्रिाही (रोललगं ) कायाान्ियन योिना अथाात अकादजमक योिना, जििक भती योिना, छात्र प्रिेि योिना, अनुसंधान योिना, अिसंरचना ढांचा जिकास योिना, जित्तीय योिना, प्रिासजनक योिना, स्ट्पष्ट िार्षाक उपलजब्ध और काया योिना सजहत जनजहत होगी दक ऑफ-कैंपस सेंटर आरंभ करने/ स्ट्थाजपत करने के अनुमोदन के जलए पहचान योग्य पररणामों के साथ प्रस्ट्ताजित ऑफ-कैंपस सेंटर दकस प्रकार स े स्ट्थाजपत दकया िाना ह।ै मंत्रालय आिेदन प्राप्त होन े के 10 ददनों के भीतर आयोग के परामिा के जलए आयोग को आिेदन अग्रेजषत करेगा। 11.7.2- ऑफ-कैंपस सेंटर (सेंटरों) के जलए आिेदन करन े िाल े समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान को प्रस्ट्ताजित ऑफ-कैंपस सेंटर में जनम्नजलजखत अनुबंध को उजचत समयािजध के भीतर परू ा करना होगा, िो पांच साल से अजधक नहीं होनी चाजहए: - i. जििक छात्र अनुपात 1:20 से अजधक नहीं होगा अथिा संबंजधत व्यािसाजयक जनयामक पररषद (पररषदों) की आिश्यकता के अनुसार होना चाजहए। पााँच िषों के अतं म ेंजििक छात्र का अनपु ात 1:10 होना चाजहए । इस प्रयोिन के जलए संकाय म ेंजनयजमत जििक, सहायक जििक , जिदेिी जििक, अजतजथ जििक, संजिदा जििक, उद्योग जििक और पूणाकाजलक सीजमत अिजध जििक (Tenure Track Faculty), अथिा संबंजधत व्यािसाजयक जनयामक पररषद (पररषदों) द्वारा अन्यथा अनुमजत4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] प्रदान दकए गए संकाय रूप म ेंिाजमल होंगे।हालांदक कम से कम 60% जििको को स्ट्थायी/ जनयजमत आधार पर जनयुि होना चाजहए: ii. एक जतहाई स्नातकोत्तर/अनुसंधान छात्रों के साथ जनयजमत किा पद्धजत के अंतगात न्यूनतम 500 छात्र पंिीकृत; iii. कम से कम 5 स्नातकोत्तर कायाक्रम; iv. अनुसंधान कायाक्रम; v. प्रजत छात्र जनर्मात िेत्र 30 िग ा मीटर स े कम न हो जिसमें अकादजमक (अकादजमक भिन, पुस्ट्तकालय, व्याख्यान कि, प्रयोगिालाए,ं आदद), प्रिासजनक (छात्रािास, सकं ाय जनिास, स्ट्िास्ट््य देखभाल), सामान्य और मनोरंिक सुजिधाएं िाजमल होंगी। तथाजप, कायाक्रम आरंभ करने के समय, प्रस्ट्ताजित ऑफ-कैंपस सेंटर ( सेंटरों) में अकादजमक और भौजतक अिसंरचना यूिीसी/ संबंजधत व्यािसाजयक जनयामक पररषद (पररषदों) द्वारा जनधााररत मानदंडों/ मानकों के अनुसार होनी चाजहए। इस तरह के कायाक्रम के जलए, िहां भी आिश्यक हो, संबंजधत व्यािसाजयक जनयामक पररषद (पररषदों) का अनुमोदन होना चाजहए। समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान यह सुजनजश्चत करेगा दक ऑफ- कैंपस सेंटर के मानदंड और मानक िहीं होंगे िैसा दक इस तरह के पाठ्यक्रमों के जलए मुख्य पररसर में चालू ह,ैं और ऑफ-कैंपस सेंटर समान प्रिेि मानदंड, पाठ्यक्रम, परीिा प्रणाली और मल्ू यांकन प्रणाली का भी पालन करेगा। ऑफ-कैंपस सेंटर के बारे में सारी सूचना समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान की िेबसाइट पर बताई िाएगी। तथाजप, यह भी दक समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान को अन्तररम पररसर म ें इस ित ा पर ऑफ-कैंपस सेंटर आरंभ करने की अनुमजत होगी दक स्ट्थायी पररसर उजचत समय अिजध के भीतर तैयार हो िाएगा िो पााँच िषों स े अजधक नहीं हो। तथाजप, और यह दक समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान यह सुजनजश्चत करेंग े दक ऑफ-कैंपस सेंटर आरंभ होने के 10 िषों के अतं तक, ऑफ-कैंपस सेंटर 3 संकायों िाले एक बहु जिषयक अनुसंधान एिं जििण पररसर के रूप म ें जिकजसत हो गया ह ैजिसमें न्यनू तम 300 जििक और 3000 छात्र हों। 11.7. 3 - आयोग परीिण के जलए ईईसी के समि आिेदन प्रस्ट्तुत करेगा और ईईसी आिेदन पर अपनी जसफाररिें देगा। िास्ट्तजिक जनरीिण की कोई आिश्यकता नहीं होगी। यह प्रदक्रया मंत्रालय से आिेदन प्राप्त होने के 30 ददनों के भीतर परू ी की िाएगी। 11.7. 4 - आयोग के अध्यि, आयोग की ओर स,े ईईसी की जसफाररिें प्राप्त होन े के 10 ददनों के भीतर आयोग के परामिा के साथ ईईसी की जसफाररिों को मंत्रालय को अग्रेजषत करेंग े। 11.7. 5 – ईईसी की जसफाररिों और आयोग के परामि ा पर जिचार करने के पश्चात, और सामान्यतया इस तरह का परामिा प्राप्त होने की तारीख से 15 ददनों की अिजध के भीतर, या तो ऑफ-कैंपस सेंटर आरंभ करन,े या नया ऑफ-कैंपस सेंटर स्ट्थाजपत करने, िैसा भी मामला हो, हते ु आिय-पत्र (LoI) िारी करने के जलए अजधसूचना िारी करे अथिा कारण बतात ेहुए प्रस्ट्ताि को अस्ट्िीकार कर दे। मंत्रालय का जनणाय अंजतम और मान्य होगा। 11.7.6- ऑफ-कैंपस सेंटर (सेंटरों) के कामकाि की समीिा ईईसी द्वारा स्ट्ितंत्र रूप स े और/या समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान के साथ इन जिजनयमों के खंड 13.0 (जनगरानी और समीिा) के अधीन उपलब्ध प्रािधानों के अनुसार की िाएगी। ऑफ-कैंपस सेंटर की समीिा के बाद, यदद ईईसी ऑफ-कैंपस सटें र के प्रदिान स े संतुष्ट नहीं ह,ै तो िह केंद्र सरकार को ऑफ-कैंपस सेंटर बंद करने की जसफाररि कर सकता ह।ै ऐसे मामलों म ें ऑफ-[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 कैंपस सेंटर म ें नामांदकत छात्रों के जहत की रिा की िाएगी और समित जिश्वजिद्यालय श्रष्ठे संस्ट्थानों को िेत्रीय िेत्राजधकार िाल े राज्य जिश्वजिद्यालय से ऑफ-कैंपस सेंटर की संबद्धता लेन ेके जलए कहा िाएगा। “11.8 ऑफ-िोर कैंपस की स्ट्थापना 11.8.1- समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थानों को जिदेि मंत्रालय और गृह मंत्रालय स े अनापजत्त प्रमाणपत्र प्राप्त करन े के बाद मंत्रालय की पूिा स्ट्िीकृजत स े नए ऑफ-िोर कैम्पस िुरू करने की अनुमजत होगी समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान को यह सुजनजश्चत करना होगा दक ऑफ-िोर कैंपस के मानदंड और मानक िही हों, िो समान पाठ्यक्रमों के जलए मुख्य पररसर म ें चालू ह,ै और ऑफ-िोर कैंपस भी समान प्रिेि मानदंडों, पाठ्यक्रम परीिा प्रणाली और मूल्यांकन प्रणाली का पालन करेगा। ऑफ-िोर कैम्पस के बारे म ें सारी िानकारी समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान की िेबसाइट पर बताई िाएगी। 11.8.2- ऑफ-िोर कैंपस (कैंपसों) के कामकाि की समीिा ईईसी द्वारा स्ट्ितंत्र रूप स े और/या समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान के साथ इन जिजनयमों के खंड 13.0 (जनगरानी और समीिा) के अधीन उपलब्ध प्रािधानों के अनुसार की िाएगी। ऑफ-िोर कैंपस (कैंपसों) की समीिा के बाद, यदद ईईसी ऑफ-िोर कैंपस के प्रदिान स े संतुष्ट नहीं ह,ै तो यह केंद्र सरकार को ऑफ़-िोर कैंपस को बंद करने की जसफाररि कर सकता ह।ै ऐसे मामलों म ें ऑफ-िोर कैंपस म ें नामांदकत छात्रों के जहतों को समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान द्वारा संरजित दकया िाएगा। “11.9 समझौता/व्यिस्ट्था करना (क) समित जिश्वजिद्यालय श्रष्ठे संस्ट्थान, संस्ट्थान की स्ट्थापना, रखरखाि या संचालन के जलए समझौता या व्यिस्ट्था कर सकता ह,ै तथा- (I) इस तरह के समझौते या व्यिस्ट्था को संसद के दकसी अजधजनयम या उसके अधीन बनाए गए जनयमों या जिजनयमों के अधीन अनुमजत दी गई ह;ै तथा- (II) जिजनयम 11.7 में जनर्दष्टा प्रदक्रया, जिजनयम 11.7.2 को छोड़कर, का पालन करत े हुए आिेदन दकया ह,ै और इस तरह के समझौते या व्यिस्ट्था के अधीन स्ट्थाजपत दकया िाने िाला कैंपस - (क) समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान के ऑफ कैंपस सेंटर के रूप म ें माना िाता ह ै िब तक दक इस तरह के समझौते या व्यिस्ट्था ऐस े कानून के अधीन िैध बना रहता ह;ै तथा- (ख) ‘लाभाथा इकाई नहीं’ के रूप में लेखा परीिा और प्रकटीकरण के मानक िही होंगे िैसे समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान म ेंह।ैं (ख) समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान कौिल उन्मुख व्यािसाजयक पाठ्यक्रम के छात्रों के व्यािहाररक प्रजििण के जलए समझौता या व्यिस्ट्था कर सकता ह ै यदद इस तरह के पाठ्यक्रम को जिश्वजिद्यालय अनुदान आयोग या संसद के दकसी अन्य अजधजनयम के अधीन स्ट्थाजपत दकसी अन्य जनकाय द्वारा अनुमोददत दकया गया ह।ै 8. उि जिजनयमों के जिजनयम 13.0 के उप-जनयम 13.1 म ें "मानि संसाधन जिकास मंत्रालय" िब्दों के जलए, जनम्नजलजखत िब्द "मंत्रालय" प्रजतस्ट्थाजपत दकया िाएगा; 9. उि जिजनयमों के जिजनयम 16.0 म ें जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकया िाएगा; “16.0 समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान एक एकात्मक संस्ट्थान समित जिश्वजिद्यालय श्रेष्ठ संस्ट्थान होगा, जिसमें ऑफ-कैंपस सेंटर और ऑफ-िोर कैंपस िाजमल होंग,े यदद कोई हो, एि ं दकसी अन्य संस्ट्थान को संबद्ध नहीं करेगा।"6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 10. उि जिजनयमों के जिजनयम 19.0 (दरू स्ट्थ जििा) के जलए जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकया िाएगा; अथाात:् - No.- 1-4/2016(IoE).—In exercise of powers conferred by clauses (f) and (g) of sub-section (1) of section 26 of the University Grants Commission Act, 1956 (3 of 1956), the University Grants Commission hereby makes the following regulations to amend the UGC (Institutions of Eminence Deemed to be Universities) Regulations, 2017, namely:- 1. Short title and Commencement.—(1) These regulations may be called the UGC (Institutions of Eminence Deemed to be Universities) (Amendment) Regulations, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the UGC (Institutions of Eminence Deemed to be Universities) Regulations, 2017 (hereinafter referred to as the said regulations); in regulation 2.0.,- (a) for sub-regulation 2.10, the following sub-regulation shall be substituted, namely:- ‘2.10 “Ministry” means the Ministry of Education’; (b) for sub-regulation 2.12, the following sub-regulation shall be substituted, namely:- ‘2.12 “Off Campus Centre” means a centre of the Institution of Eminence Deemed to be University, approved by the Government, and situated beyond its Campus within India.’; (c) for sub-regulation 2.13, the following sub-regulation shall be substituted, namely:- ‘2.13 “Off-shore Campus” means a centre of the Institution of Eminence Deemed to be University, approved by the Government, and situated beyond its Campus outside India.’; (d) in sub-regulation 2.15, for the words, brackets and letters “Medical Council of India (MCI)” the following words “National Medical Commission” shall be substituted. 3. In the said regulations, in regulation 4.0, in sub-regulation 4.2, for clause 4.2.7, the following sub-regulation shall be substituted, namely:- “4.2.7 The faculty student ratio should be not less than 1:20 at the time of notification issued declaring an institution as an Institution of Eminence and should increase over time so as not to be less than 1:10 after five years of this date. The faculty for the purpose of calculating the teacher-student ratio shall include the regular faculty, adjunct faculty, overseas faculty, visiting faculty, contractual faculty, industry faculty and tenure track faculty, or faculty as otherwise permitted by the Statutory Council(s) concerned-:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 Provided, that 60 per cent of the faculty shall be appointed on permanent/regular basis and part-time faculty shall not be counted for this purpose. Moreover, 60 per cent of the permanent/ regular faculty shouldn’t breach 1:10 faculty student ratio at any point of time. 4. In the said regulations, in sub-regulation 5.2, for the words “MHRD” the following word “Ministry” shall be substituted. 5. In the said regulations, in regulation 6.0, in sub-regulation 6.1, for clause (iii) the following clause shall be substituted, namely:- “(iii) The sponsoring organisation for greenfield institutions should have members whose total networth is at least rupees five thousand crores collectively. For existing institutions, the total networth of the sponsoring organization should be at least rupees three thousand crores. For this purpose, the average of the net-worth of the members or organization, as the case may be, for the last three financial years shall be taken into consideration.” 6. In the said regulations, in regulation 8.0:- (a) in sub-regulation 8.1, for the words “Ministry of Human Resource Development” at both the places where they occur, the following word “Ministry” shall be substituted; (b) in sub-regulation 8.2, in clause 8.2.1, for the words “Ministry of Human Resource Development”, the following word “Ministry” shall be substituted; (c) in sub-regulation 8.4.,- (i) in clause (a), for the words “Ministry of Human Resource Development”, the following word “Ministry” shall be substituted; (ii) in clause (d), for the words “Ministry of Human Resource Development”, the following word “Ministry” shall be substituted; (iii) for clause (e), the following clause shall be substituted, namely:- “(e) the Ministry will issue a Letter of Intent (LoI), or otherwise reject the application, within two weeks of receipt of the recommendations under Clause (d). In case the institute surrenders its Letter of Intent (LoI) at any time, the application of the institute shall be treated as withdrawn and the application/processing fee shall stand forfeited.”. (iv) in clause (g), for the words “Ministry of Human Resource Development”, the following word “Ministry” shall be substituted; (v) in clause (h), for the words “Ministry of Human Resource Development”, wherever they occur, the following word “Ministry” shall be substituted; (vi) in clause (i), for the words “Ministry of Human Resource Development”, the following word “Ministry” shall be substituted; 7. In the said regulations, in regulation 11.0, in sub-regulation 11.2.,- (a) for clause 11.2.4, the following clause shall be substituted, namely:- “11.2.4 The Institution of Eminence Deemed to be University shall have the freedom to offer online courses as part of its programmes. If all the courses of any programme are offered online, it should also be mentioned in the respective certificate/ degree.” (b) after clause 11.6.2, the following sub-regulations shall be inserted, namely:- “11.7 Establishment of Off-campus centre(s): Institutions of Eminence Deemed to be Universities shall be permitted to start new off-campus centre(s) (maximum of 3 in 5 years and not more than 1 in one academic year), by following the procedure mentioned hereunder:- 11.7.1– Institutions of Eminence Deemed to be Universities shall submit their application to the Ministry by way of an Affidavit in the prescribed proforma along with the Detailed Project Report (DPR) containing its 10 year Strategic Vision Plan and a five year rolling implementation plan viz. academic plan, faculty recruitment plan, student admission plan, research plan, infrastructure development plan, financial plan, administrative plan, governance plan with clear annual milestones and action plan on how the proposed off- campus is to be set up with identifiable outcomes for approval to start/establish an Off-Campus Centre. The Ministry shall forward the application to the Commission for its advice within ten days of the receipt of the application. 11.7.2– The Institutions of Eminence Deemed to be Universities applying for off-campus centre(s) shall have to meet the following stipulations in the proposed off-campus centre(s) within a reasonable time period not exceeding five years:-8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (i) teacher student ratio shall not be more than 1:20 OR shall be as per the requirement of the concerned Statutory Council(s). The teacher student ratio shall be 1:10 at the end of the five years. The faculty for this purpose shall include the regular faculty, adjunct faculty, overseas faculty, visiting faculty, contractual faculty, industry faculty and tenure track faculty, or faculty as otherwise permitted by the Statutory Council(s) concerned-: Provided, however, that at least sixty per cent. of the faculty shall be appointed on permanent/regular basis; (ii) a minimum of five hundred students on its rolls under regular class room mode with one third PG/Research students; (iii) five PG programmes; (iv) research Programmes; (v) built up area of not less than thirty square metres per student which shall include academic (academic buildings, library, lecture hall, laboratories, etc.), administrative (hostels, faculty residences, health care), common and recreational facilities. Provided that at the time of starting the programme(s), the academic and physical infrastructure at the proposed off-campus centre(s) shall be in accordance with the norms/standards prescribed by the UGC/concerned Statutory Council(s). Such programme shall have the approval of the relevant Statutory Council(s), wherever required. The Institutions of Eminence Deemed to be Universities shall ensure that the norms and standards of the Off-Campus Centre shall be the same as that maintained in the main campus for similar courses, and the Off-Campus Centre shall also follow similar admission criteria, curriculum, examination system and evaluation system. All the information about the off-campus centre shall be disclosed on the website of the Institution of Eminence Deemed to be University: Provided further that the Institutions of Eminence Deemed to be Universities shall be permitted to start an Off-Campus Centre(s) in an interim campus subject to the condition that the permanent campus shall be ready within a reasonable time period not exceeding five years. Provided also that the Institutions of Eminence Deemed to be Universities shall ensure that by the end of ten years of the starting of the Off-Campus Centre, the Off-Campus Centre is evolved as a multi-disciplinary research and teaching campus having at least 3 faculties with a minimum of 300 teachers and 3000 students. 11.7.3- The Commission shall place the application before the Empowered Experts Committee for examination and its recommendations on the application. There shall be no requirement of physical inspection. This process shall be completed within thirty days of the receipt of the application from the Ministry. 11.7.4- The Chairman of the Commission, on behalf of the Commission, shall forward the recommendations of the Empowered Experts Committee along with the advice of the Commission to the Ministry within ten days of the receipt of the Empowered Experts Committee recommendations. 11.7.5- The Ministry shall, after taking into the consideration the recommendations of the Empowered Experts Committee and advice of the Commission, and ordinarily within a further period of fifteen days from the date of receipt of such advice, either issue a notification for starting of off-campus centre(s) or, as the case may be, a Letter of Intent (LoI) for setting up of new off-campus centre or reject the proposal stating the reasons thereto. The decision of the Ministry shall be final and binding. 11.7.6- The functioning of the off-campus centre(s) shall be reviewed by the Empowered Experts Committee independently and/or along with the Institution of Eminence Deemed to be Universities in accordance with the provisions available under regulation 13.0. After review of the off-campus centre, if the Empowered Experts Committee is not satisfied with the performance of the off-campus centre, it may recommend discontinuation of the off-campus centre to the Central Government. In such cases the interest of the students enrolled at the off-campus centre shall be protected and the Institution of Eminence Deemed to be University shall be asked to seek affiliation of the Off-campus centre to the State University having territorial jurisdiction. 11.8 Establishment of an Off-shore campus 11.8.1- Institutions of Eminence Deemed to be Universities shall be allowed to start new off-shore campuses with the prior approval of the Ministry after receiving No Objection Certificate from Ministry of External Affairs and Ministry of Home Affairs. The Institutions of Eminence Deemed to be Universities shall ensure that the norms and standards of the Off-shore campus shall be the same as that maintained in the main campus for similar courses, and the Off-shore campus shall also follow similar admission criteria, curriculum, examination system and evaluation system. All the information about Off-shore campus shall be disclosed on the website of the Institution of Eminence Deemed to be University.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9 11.8.2- The functioning of the off-shore campus(s) shall be reviewed by the Empowered Experts Committee independently and/or along with the IoE Deemed to be Universities in accordance with the provisions available under regulation 13.0. After review of the off-shore campus, if the Empowered Experts Committee is not satisfied with the performance of the off-shore campus, it may recommend discontinuation of the off- shore campus to the Central Government. In such cases the interest of the students enrolled at the off-shore campus shall be adequately protected by the Institution of Eminence Deemed to be University. 11.9 Entering in to the agreement/arrangement (a) The Institution of Eminence Deemed to be University may enter into an agreement or arrangement for the establishment, maintenance or operation of an institution, if - (I) Such agreement or arrangement is permitted under any Act of Parliament or the rules or regulations made thereunder; and (II) It has made an application following the procedure specified in regulation 11.7, except the procedure in sub-regulation 11.7.2, and the campus to be established under such agreement or arrangement shall be- (A) treated as an Off-Campus Centre of the Institution of Eminence Deemed to be University as long as such agreement or arrangement remains valid under such law; and (B) subject to similar standard of audit and disclosure as a ‘not-for-profit’ entity as that of the Institution of Eminence Deemed to be University. (b) The Institution of Eminence Deemed to be University may enter into an agreement or arrangement for practical training of students of a skill oriented vocational course if such course is approved by the University Grants Commission or any other body established under any Act of Parliament.”. 8. In the said regulations, in regulation 13.0, in sub-regulation 13.1, for the words “Ministry of Human Resource Development”, the following word “Ministry” shall be substituted. 9. In the said regulations, for regulation 16.0, the following regulation shall be substituted, namely:- “16.0 The Institution of Eminence Deemed to be University shall be a unitary Institution Deemed to be University, which shall include its Off-Campus Centre(s) and Off-shore campus(s), if any, and shall not affiliate any other institution.”. 10. In the said regulations, for regulation 19.0, the following regulation shall be substituted, namely:- “19.0 Distance and online education:- The Institutions of Eminence Deemed to be Universities may offer courses under distance mode and online mode, without any approvals, in accordance with the minimum standards laid down by the Commission. This provision shall also apply to Government owned and controlled Deemed to be Universities which have been declared Institutions of Eminence under UGC (Declaration of Government Educational Institutions as Institutions of Eminence) Guidelines, 2017.”. 11. In the said regulations, in regulation 21.0, in sub-regulation 21.1, for the words “Ministry of Human Resource Development” the following word “Ministry” shall be substituted.
