मामल)े (पाँचवा संशोधन) िविनयम, 2019 ह,ै 1.2 ये िविनयम 03.06.2019 क(cid:16) तारीख स े(cid:17)वृ(cid:18) ह(cid:21)गे। 2222.... ममममललललूूूू ििििववववििििननननययययमममम ककककेेेे ििििववववििििननननययययमममम िविनयम(cid:21) के िविनयम 5 के अधीन यथा िनधाD(cid:27) रत िवचलन के िलए (cid:17)भार(cid:21) के अितDर(cid:20), िवचलन के िलए अितDर(cid:20) (cid:17)भार Tेता/िवTेता _ारा यथाि+थित (cid:17)[यके टाईम Jलॉक के िलए िव(cid:13)ुत के अिधक अंतः4ेपण/कम आहरण के िलए लागू होगा जब िiड (cid:1)jkhसी 50.01 हट(cid:27)ज ल(cid:1)े कन ‘50.0 हट(cid:27)ज से कम नह‘’ या 303.04 पसै े/(cid:1)कलोवाट घंटा के िवचलन के िलए कैप दर जो भी कम हो के िiड (cid:1)jkhसी के तदनुeपी िवचलन के (cid:17)भार(cid:21) के समतु(cid:3)य दर(cid:21) पर 50.10 हlज(cid:27) और अिधक ह।ै ‘’ 4.4 मूल िविनयम के िविनयम 7 के खंड (6) के परंतकु म,G "पूव(cid:27)वतd माह के िलए (cid:1)कए गए िबल के eप मG ऊजा(cid:27) (cid:17)भार(cid:21) को समतु(cid:3)य कैप दर" शJद(cid:21) को "303.04 पसै /े(cid:1)कलोवाट घंटा क(cid:16) कैप दर" शJद(cid:21) _ारा (cid:17)ित+थािपत (cid:1)कया जाएगा। 4.5 मूल िविनयम के िविनयम 7 के खंड (10) को िन1ानसु ार (cid:1)कया जाएगाः- "(cid:1)कसी (cid:17)ादिे शक ईकाई (Tेता या िवTेता) _ारा एक (cid:1)दशा म G (सकारा[मक या नकारा[मक) म G अनुसूची स े सतत िवचलन क(cid:16) ि+थित मG, इस (cid:17)कार क(cid:16) ईकाई इस िविनयम के खंड (क) और (ख) के अधीन यथािविनMदN(cid:27) रीित स े इसक(cid:16) ि+थित म Gसशं ुि0 करेगी। (क) 31.03.2020 तक क(cid:16) अविध के िलए: य(cid:1)द अनुसूची स ेसतत िवचलन 12 टाईम Jलॉक(cid:21) के िलए एक (cid:1)दशा मG (सकारा[मक या नकारा[मक) जारी रहता ह,ै तो (cid:17)ादिे शक ईकाई (Tेता या िवTेता) पDरवSतत(cid:27) अनसु ूची स े इसके िवचलन के िचnन बनात े ए या इन िविनयम(cid:21) के िविनयम 7(1) और 7(2) के अधीन यथािविनMद(cid:27)N मा.ा सीमा के सबसेट क(cid:16) इस (cid:17)कार क(cid:16) रGज, 13 टाईम Jलॉक तक कम स े कम एक बार, इसक(cid:16) अनुसचू ी के संदभ(cid:27) म G+/- 20 मेगावाट क(cid:16) रGज म Gबनाए रखत े ए, ि+थित क(cid:16) संशिु 0 करेगा। बशतp (cid:1)क इस खंड के अधीन अपे4ा का (cid:17)[येक उ(cid:3)लघंन (cid:17)ितदये या/(cid:17)ाFय जैसी भी 6 टाईम Jलॉक(cid:21) के िलए एक (cid:1)दशा म G (सकारा[मक या नकारा[मक) जारी रहता ह,ै तो (cid:17)ादिे शक ईकाई (Tेता या िवTेता) पDरवSत(cid:27)त अनसु ूची स े इसके िवचलन के िचnन बनात े ए या इन िविनयम(cid:21) के िविनयम 7(1) और 7(2) के अधीन यथािविनMद(cid:27)N मा.ा सीमा के सबसेट क(cid:16) इस (cid:17)कार क(cid:16) रGज, 7 टाईम Jलॉक तक कम से कम एक बार, इसक(cid:16) अनसु ूची के संदभ(cid:27) म G+/- 20 मेगावाट क(cid:16) रGज म Gबनाए रखत े ए, ि+थित क(cid:16) संशिु 0 करेगा। बशतp (cid:1)क इस िविनयम के खंड (ख) के अधीन अपे4ा का उ(cid:3)लघंन म G नीचे दी गई सारणी मG यथािविनMदN(cid:27) अितDर(cid:20) (cid:17)भार होगा। एक (cid:1)दवस म Gउ(cid:3)लंघन(cid:21) क(cid:16) संqया (cid:17)ितदये अितDर(cid:20) (cid:17)भार (cid:17)थम स ेपांचवां उ(cid:3)लंघन (cid:17)[यके उ(cid:3)लंघन के िलए, दिै नक बेस डीएसएम (cid:17)भार (cid:17)ितदये या (cid:17)ाFय के 3 (cid:17)ितशत क(cid:16) दर पर अितDर(cid:20) (cid:17)भार छठे स ेदसवा ंउ(cid:3)लंघन (cid:17)[यके उ(cid:3)लंघन के िलए, दिै नक बेस डीएसएम (cid:17)भार (cid:17)ितदये या (cid:17)ाFय के 5 (cid:17)ितशत क(cid:16) दर पर अितDर(cid:20) (cid:17)भार sयाहरव Gस ेआग ेउ(cid:3)लंघन (cid:17)[यके उ(cid:3)लंघन के िलए, दिै नक बेस डीएसएम (cid:17)भार (cid:17)ितदये या (cid:17)ाFय के 10 (cid:17)ितशत क(cid:16) दर पर अितDर(cid:20) (cid:17)भार बशतp यह (cid:1)क इस िविनयम के खंड (क) और (ख) के अधीन िचnन पDरवत(cid:27)न उ(cid:3)लघनं (cid:21) क(cid:16) संqया क(cid:16) गणना (cid:17)[यके (cid:1)दन के िलए 00.00 घंटो पर नए िसरे से आरंभ क(cid:16) जाएगी। बशतp यह (cid:1)क इस िविनयम के खंड (क) और (ख) के अधीन यथािविनMदN(cid:27) पDरवSत(cid:27)त अपे4ाt के अनुपालन न होने के िलए अितDर(cid:20) (cid:17)भार का भुगतान िन1िलिखत के िलए लागू नह‘ होगाः- (क) नवीकरणीय ऊजा (cid:27)उ[पादक जो (cid:17)ादेिशक इकाइया ँह h (ख) पuडजे के िबना रन ऑफ Dरवर पDरयोजनाएं (ग) संयोजकता िविनयम(cid:21) के अनसु ार परी4ण और आरंभ क(cid:16) जा रही गितिविधय(cid:21) के दौरान यिू नट के सीओडी के पूव(cid:27) उ[पादन कG(cid:9) के _ारा िव(cid:13)तु के कोई इ(cid:8)फम(cid:27) अंतः4पे ण (घ) यूिनट के +टाट(cid:27)अप गितिविधय(cid:21) के िलए उ[पादन कG(cid:9) _ारा िव(cid:13)ुत का कोई आहरण (ङ) कोई अंतः(cid:17)ादिे शक िवचलन (च) पावर एUसचGज(cid:21) पर सामिू हक सं*वहार(cid:21) के मामले म Gउ[पादन कG(cid:9) क(cid:16) फो+ड (cid:27)आउटेज िनदश(cid:27)न- i) 7(10)(क) के िनदशन(cid:27) ः 31.3.2020 तक क(cid:16) अविध के िलए: टाईम Jलॉक टी-1 से टी-12 तक सतत िवचलन वाली (cid:17)ादिे शक ईकाई को इसके िवचलन के िचnन को पDरवSत(cid:27)त करते ए (सकारा[मक स े नकारा[मक या नकारा[मक स े सकारा[मक जैसी भी ि+थित हो) या तो इसक(cid:16) ि+थित मG संशिु 0 होगी या टाईम Jलॉक टी-13 के अंत तक इसक(cid:16) अनसु ूची के संदभ (cid:27) म G +/- 20 मेगावाट क(cid:16) रGज म G वापस आना चािहए। य(cid:1)द, इस (cid:17)कार के िचnन पDरवत(cid:27)न नह‘ होते या समय Jलॉक टी-13 के अंत तक +/- 20 मगे ावाट क(cid:16) रGज म G वापस नह‘ आते परंतु ि+थित के इस (cid:17)कार के शिु 0 टाईम Jलॉक टी-14 स े टाईम Jलॉक टी-24 तक होत े ह,h तब अितDर(cid:20) (cid:17)भार एक उ(cid:3)लंघन तक समतु(cid:3)य पर उyगृहीत होगा। उ(cid:20) उ(cid:3)लंघन म G टी-13 के िलए टाईम Jलॉक डीएसएम (cid:17)भार के 10 (cid:17)ितशत क(cid:16) दर पर अितDर(cid:20) (cid:17)भार होगा। इसके अलावा, य(cid:1)द िचnन म G पDरवतन(cid:27) नह‘ होता या टी-25 के अंत तक भी उ(cid:20) रGज म G वापस नह‘ आता परंत ु ि+थित उ(cid:20) उ(cid:3)लघं न, टी-13 और टी-25 के िलए टाईम Jलॉक डीएसएम क(cid:16) 10 (cid:17)ितशत क(cid:16) दर पर अितDर(cid:20) (cid:17)भार होगा। ii) 7(10)(ख) के िनदशन(cid:27) ः 01.04.2020 स े अविध के िलए: य(cid:1)द टाईम Jलॉक टी-1 से टी-7 तक सतत िवचलन वाली एक (cid:17)ादिे शक ईकाई को इसके िवचलन के िचnन को पDरवSतत(cid:27) करते ए (सकारा[मक से नकारा[मक या नकारा[मक से सकारा[मक जसै ी भी ि+थित हो) या तो इसक(cid:16) ि+थित मG संशिु 0 करनी होगी या टाईम Jलॉक टी-7 के अंत तक इसक(cid:16) अनसु ूची के संदभ(cid:27) म G +/- 20 मेगावाट क(cid:16) रGज म Gवापस आना चािहए। य(cid:1)द, इस (cid:17)कार के िचnन पDरवत(cid:27)न नह‘ होत ेया टाईम Jलॉक टी-7 के अंत तक उ(cid:20) रGज म G वापस नह‘ आते परंतु ि+थित के इस (cid:17)कार के शिु 0 टाईम Jलॉक टी-8 से टाईम Jलॉक टी-12 तक होत े ह,h तब अितDर(cid:20) (cid:17)भार एक उ(cid:3)लंघन तक समतु(cid:3)य पर उyगृहीत होगा। इसके अितDर(cid:20), य(cid:1)द िचnन पDरवतन(cid:27) नह‘ होता या टी-13 के अतं तक यथो(cid:20) रGज म G वापस नह‘ आता परंतु ि+थित क(cid:16) शु0ता टाईम Jलॉक टी-14 स ेटाईम Jलॉक टी-18 तक होता ह,ै तो अितDर(cid:20) (cid:17)भार दो उ(cid:3)लंघन(cid:21) के समतु(cid:3)य उyगृहीत होगा। अितDर(cid:20) (cid:17)भार इस िविनयम के खंड (ख) मG यथािविनMदN(cid:27) दर पर होगा। 4.6 मूल िविनयम के िविनयम 7 के खंड (11) को िन1ानसु ार (cid:1)कया जाएगाः- "िविनयम 5 के अधीन िवचलन के िलए (cid:17)भार(cid:21) का भुगतान और इस िविनयम क(cid:16) धारा (3), (4) और (10) के अधीन िवचलन के िलए अितDर(cid:20) (cid:17)भार(cid:21) को (cid:1)कसी कार(cid:27)वाई के पूवा(cid:27)iह के िबना उyगृहीत (cid:1)कया जाएगा िजसे उ(cid:20) िविनयम(cid:21) के उपबंध(cid:21) के ख{डन के िलए अिधिनयम क(cid:16) धारा 142 के अधीन आयोग _ारा उपयु(cid:20) समझा जाता ह।ै " 4.7 मूल िविनयम के िविनयम 7 के खंड 11(क) को समा5 (cid:1)कया जाएगा। 5. मूल िविनयम(cid:21) के अनुबंध-I (Tेता/िवTेता [नवीकरणीय समृ0 रा}य(cid:21) को छोड़कर] _ारा अिधक आहरण/कम अंतः4ेपण के िलए िविनMदN(cid:27) मा.ा सीमाt को पार करन े के िलए (cid:17)[यके (cid:17)ादेिशक ईकाई के िलए िवचलन के (cid:17)भार(cid:21) क(cid:16) संगणना के िलए प0ितयाँ) का संशोधनः 5.1 मूल िविनयम के अनुबधं 1 के उपखंड ख (3) मG िनदश(cid:27)न ख के अधीन नोट म,G "पूव(cid:27)वतd माह के िलए (cid:1)कए गए िबल के eप म G ऊजा (cid:27) (cid:17)भार(cid:21) के समतु(cid:3)य कैप दर" (असाधारण) भाग- III, ख{ड 4, सqं या 444 मG (cid:17)कािशत (cid:1)कए गए।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 CENTRAL ELECTRICITY REGULATORY COMMISSION AMENDMENT New Delhi, Dated 28th May, 2019 No. L-1/132/2013-CERC.—In exercise of powers conferred by Section 178 of the Electricity Act, 2003 and all other powers enabling it in this behalf and after previous publication, the Central Electricity Regulatory Commission, hereby makes the following regulations, to amend the Central Electricity Regulatory Commission (Deviation Settlement Mechanism and related matters) Regulations, 2014 (hereinafter referred to as the "Principal Regulations") namely:- 1. Short Title and Comments 1.1 These regulations may be called the Central Electricity Regulatory Commission (Deviation Settlement Mechanism and related matters) (Fifth Amendment) Regulations, 2019. 1.2 These regulations shall come into force with effect from 3rd June, 2019. 2. Amendment to Regulation 2 of the Principal Regulations: 2.1 A new sub-clause shall be added after sub-clause (ga) of clause (1) of Regulation 2 of the Principal Regulations, as under:- “(gb) “Daily Base DSM Charge” means the sum of charges for deviations for all time blocks in a day payable or receivable as the case may be, excluding the additional charges under Regulation 7”. 2.2 A new sub-clause shall be added after sub-clause (q) of clause (1) of Regulation 2 of the Principal Regulations, as under :- “(qa) “Time Block DSM Charge” means the charge for deviation for the specific time block in a day payable or receivable as the case may be, excluding the additional charges under Regulation 7” 3. Amendment of Regulation 5 (Charges for Deviations) of the Principal Regulations: 3.1 The following new sub-clauses after sub-clause (d) in clause (2) of Regulation 5 of the Principal Regulations shall be inserted as under :- “(e) The charges for inter-regional deviation and for deviation in respect of cross-border transactions shall be computed on the basis of the unconstrained market clearing price in Day Ahead Market. (f) The charges for deviation in respect of an entity falling in different bid areas, shall be computed on the basis of the daily average ACP of the bid area in which such entity has largest proportion of its demand.” 3.2 Clause (3) of Regulation 5 of the Principal Regulations shall be substituted as under :-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC4] “The Cap rate for the charges for deviation for the generating stations, irrespective of the fuel type and whether the tariff of such generating station is regulated by the Commission or not, shall not exceed 303.04 Paise/kWh.” 4. Amendment of Regulation 7 (Limits on Deviation volume and consequences of crossing limits) of the Principal Regulation: 4.1 The following proviso under clause (1) of Regulation 7 of the Principal Regulations shall be deleted. 4.2 In Table-II of clause (3) of Regulation 7 of the Principal Regulations, the words “Cap Rate being equivalent to the energy charges as billed for the previous month” wherever they occur, shall be substituted by the words “Cap Rate for Deviation of 303.04 Paise/kWh”. 4.3 The clause 4 of Regulation 7 of the Principal Regulations shall be substituted as under: “(4) In addition to Charges for Deviation as stipulated under Regulation 5 of these regulations, Additional Charge for Deviation shall be applicable for over-injection/under-drawal of electricity for each time block by a buyer/seller as the case may be when grid frequency is 50.10 Hz and above’ at the rates equivalent to charges of deviation corresponding to the grid frequency of ‘below 50.01 Hz but not below 50.0 Hz’, or cap rate for deviation of 303.04 Paise/kWh whichever is lower." 4.4 In Proviso to clause (6) of Regulation 7 of the Principal Regulations, the words “Cap Rate equivalent to the energy charges as billed for the previous month” shall be substituted by the words “Cap Rate of 303.04 Paise/kWh”. 4.5 Clause (10) of Regulation 7 of the Principal Regulations shall be substituted as under: "In the event of sustained deviation from schedule in one direction (positive or negative) by any regional entity (buyer or seller), such entity shall correct its position in the manner as specified under clauses (a) and (b) of this Regulation. (a) For the period up to 31.03.2020: If the sustained deviation from schedule continues in one direction (positive or negative) for 12 time blocks, the regional entity (buyer or seller), shall correct its position by making the sign of its deviation from schedule changed or by remaining in the range of +/- 20 MW with reference to its schedule, at least once, latest by 13th time block, such range being a subset of volume limit as specified under Regulations 7(1) & 7(2) of these Regulations. Provided that each violation of the requirement under this clause shall attract an additional charge of 10% of the time block DSM charge payable or receivable as the case may be. (b) For the period from 01.04.2020: If the sustained deviation from schedule continues in one direction (positive or negative) for 6 time blocks, the regional entity (buyer or seller), shall correct its position, by making the sign of its deviation from schedule changed or by remaining in the range of +/- 20 MW with reference to its schedule, at least once, latest by 7th time block such range being a subset of volume limit as specified under Regulations 7(1) & 7(2) of these Regulations.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7 Provided that violation of the requirement under clause (b) of this Regulation shall attract an additional charge as specified in the table below: No. of violations in a Day Additional Charge Payable From first to fifth violation For each violation, an additional charge @ 3% of daily base DSM charge payable or receivable From sixth to tenth violation For each violation, an additional charge @ 5% of daily base DSM charge payable or receivable From eleventh violation onwards For each violation, an additional charge @ 10% of daily base DSM charge payable or receivable Provided further that counting of number of sign change violations under clauses (a) & (b) of this Regulation shall start afresh at 00.00 Hrs. for each day. Provided also that payment of additional charge for failure to adhere to sign change requirement as specified under clauses (a) & (b) of this regulation shall not be applicable to: a. renewable energy generators which are regional entities b. run of river projects without pondage c. any infirm injection of power by a generating station prior to CoD of a unit during testing and commissioning activities, in accordance with the Connectivity Regulations. d. any drawal of power by a generating station for the start-up activities of a unit. e. any inter-regional deviations. f. forced outage of a generating station in case of collective transactions on Power Exchanges. Illustrations:- (1) Illustration to 7(10)(a):-, For the period up to 31.03.2020: A regional entity having a sustained deviation from time blocks t to t shall correct its position either by changing the sign of its deviation (from 1 12, positive to negative or negative to positive as the case may be) or come back in the range of +/- 20 MW with reference to its schedule latest by the end of time block t . In case, such 13 sign change does not take place or it fails to come back in the range of +/- 20 MW by the end of time block t , but such correction of position takes place from time block t up to time 13 14 block t , then the additional charge shall be levied equivalent to one violation. The above 24 violation shall attract an additional charge at the rate of 10% of the time block DSM charge for t Further, in case, sign change does not take place or it fails to come back to the range 13. as aforesaid even latest by the end of t , but correction of position takes place from time 25 block t up to time block t , then the additional charge shall be levied equivalent to two 26 36 violations. The above violation shall attract an additional charge at the rate of 10% of the time block DSM for t andt and so on. 13 25 , (2) Illustration to 7(10)(b):-, For the period from 01.04.2020: A regional entity having a sustained deviation from time blocks t to t shall correct its position either by changing the sign of its deviation (from 1 7, positive to negative or negative to positive as the case may be) or come back in the range of +/- 20 MW with reference to its schedule latest by the end of time block t . In case, such sign 7 change does not take place or it fails to come back in the aforesaid range by the end of time block t , but such correction of position takes place from time block t up to time block t , 7 8 12 then additional charge shall be levied equivalent to one violation. Further, in case, sign change does not take place or it fails to come back in the range as aforesaid latest by the end8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC4] of t , but correction in position takes place from time block t up to time block t , then the 13 14 18 additional charge shall be levied for two violations and so on. The additional charge shall be at the rate as specified in clause (b) of this Regulation. 4.6 The Clause 11 of the Regulation 7 of the Principal Regulations shall be substituted as follows: “Payment of Charges for Deviation under Regulation 5 and the Additional Charges for Deviation under Clauses (3), (4) and (10) of this regulation, shall be levied without prejudice to any action that may be considered appropriate by the Commission under Section 142 of the Act for contravention of the provisions of the said regulations.” 4.7 The Clause 11(a) of the Regulation 7 of the Principal Regulations shall be deleted. 5. Amendment of Annexure-I (Methodologies for the computation of Charges of Deviation for each regional entity for crossing the volume limits specified for the over-drawal / under- injection by Buyer / Seller [except Renewable Rich State]) of the Principal Regulations:- 5.1 In Note under Illustration B in sub-clause (B)(iii) of clause 1 of Annexure-I to the Principal Regulations, the words “Cap Rate being equivalent to the energy charges as billed for the previous month” shall be substituted by the words “Cap Rate for Deviations of 303.04 Paise/kWh”.
