No. 3-1/D-SDC/NEEM/2017.—In exercise of powers conferred by sub-section (1) and (2) of Section 23 read with sub-section (1) & (2) of Section 8 of the All India Council for Technical Education Act, 1987 (52 of 1987), the All India Council for Technical Education hereby frames following Regulations amending the “All India Council for Technical Education (National Employability Enhancement Mission (NEEM) Regulation, 2017”. These Regulations may be called the “All India Council for Technical Education (National Employability Enhancement Mission (NEEM) Regulations, 2017” (1st Amendment) and will deem to have come into force with effect from the date of publication in the Gazette of India.III 3 The provisions contained in Article 1 and 3 of “All India Council for Technical Education (National Employability Enhancement Mission (NEEM) Regulations, 2017” shall stand amended and be substituted with the following Clause : Clause 1.2 : These Regulation shall apply to any Society/Trust/Company registered under Section 25 of Companies Act, 1956 /Section 8 of Company Act, 2013 or relevant act as amended from time to time/ Bodies of Central Government/ Bodies of State Government / Government Institutions/ Universities as defined under UGC Act/ Start-Up established under Section 8 of Company Act, 2013 and recognized by Department of Policy and Promotion (DIPP), Govt. of India as a start-up. Clause 3.1 : Any Society/Trust/Company registered under Section 25 of Companies Act, 1956 /Section 8 of Company Act, 2013 or relevant act as amended from time to time/ Bodies of Central Government/ Bodies of State Government / Government Institutions/ Universities as defined under UGC Act / Start-Up established under Section 8 of Company Act, 2013 and recognized by Department of Policy and Promotion (DIPP), Govt. of India as a start-up, shall be eligible to apply for registration as NEEM Facilitator. Clause 3.3 : NEEM Facilitator shall have turnover and capacity to place students in registered companies/industries as per following table or the parent company under which Section 25 of Companies Act, 1956/ Section 8 of Company Act, 2013 or relevant act as amended from time to time, is formed to meet the objective of NEEM shall have turnover and capacity to place students in registered company/industry as per following table: S.No. Turnover (in Crores) per year for the previous Training Capacity Per three financial years Year 1 25 and above 5,000 2 15 – 25 3,000 3 5 - 15 1,000 Clause 3.6 : Society/Trust/Company registered under Section 25 of Companies Act, 1956 / Section 8 of Company Act, 2013 or relevant act as amended from time to time/ Bodies of Central Government/Bodies of State Government /Government Institutions/ Universities as defined under UGC Act / Start-Up established under Section 8 of Company Act, 2013 and recognized by Department of Policy and Promotion (DIPP), Govt. of India as a start-up, seeking registration as NEEM Facilitator shall submit an affidavit in the proforma appended to these Regulations stating that the information submitted by it in the application for registration is correct and if any information submitted by the applicant found incorrect in future, the NEEM Facilitator so registered on the basis of such information shall be liable for revocation or withdrawal of its registration and also penal and civil action. Clause 3.8 : Clause 3.2 and 3.3 will not be applicable for Government Institutes/ Government Universities /Government Centres/Sector Skill Councils approved by Ministry of Skill Development and Entrepreneur, Government of India/ Start-Up Companies. Start-up Companies shall submit detailed project report comprising how and where training will be provided, source of funding etc. as per the requirement of Council. Prof. A. P.
