Definitions.– The words and expressions used in this notification shall have the meaning respectively assigned to them in the Terrestrial Animal Health Code of World Organisation for Animal Health. 2. Regulation of import.- (1) The import of poultry and poultry products into India shall be done in accordance with the provisions and the product-specific recommendations related to avian influenza in the Terrestrial Animal Health Code of World Organisation for Animal Health. (2) For the purposes of this notification, the recognition of zones or compartments, when requested by the exporting country, shall be subject to the fulfilment of the requirements contained in paragraph 3. (3) The avian influenza status of a country, zone or compartment shall be determined on the basis of most recent status of the exporting country, zone or compartment as reported by the country to the World Organisation for Animal Health in accordance with the requirements of the Terrestrial Animal Health Code of World Organisation for Animal Health. (4) A country, zone or compartment may be considered free from avian influenza when it has been shown that infection with avian influenza viruses in poultry has not been present in the country, zone or compartment for the past twelve months, based on surveillance in accordance with the provisions of the Terrestrial Animal Health Code of World Organisation for Animal Health. (5) If infection has occurred in poultry in a previously free country, zone or compartment, avian influenza free status can be regained,- (a) in the case of infections with high pathogenicity avian influenza viruses, three months after a stamping-out policy (including disinfection of all affected establishments) is applied, provided that surveillance in accordance with the provisions of the Terrestrial Animal Health Code of World Organisation for Animal Health has been carried out during that three-month period; (b) in the case of infections with low pathogenicity avian influenza viruses, poultry may be kept for slaughter for human consumption subject to conditions specified in the Terrestrial Animal Health Code of World Organisation for Animal Health or a stamping-out policy may be applied, in either case, three months after the4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] disinfection of all affected establishments, providing that surveillance in accordance with the provisions of the Terrestrial Animal Health Code of World Organisation for Animal Health has been carried out during that three- month period. (6) A country, zone or compartment may be considered free from infection with high pathogenicity avian influenza viruses in poultry when,- (a) it has been shown that infection with high pathogenicity avian influenza viruses in poultry has not been present in the country, zone or compartment for the past twelve months, although its status with respect to low pathogenicity avian influenza viruses may be unknown; or (b) based on surveillance in accordance with the provisions of the Terrestrial Animal Health Code of World Organisation for Animal Health, it does not meet the criteria for freedom from avian influenza but any virus detected has not been identified as high pathogenicity avian influenza virus. (7) The surveillance may need to be adapted to parts of the country or existing zones or compartments depending on historical or geographical factors, industry structure, population data, or proximity to recent outbreaks. (8) If infection has occurred in poultry in a previously free country, zone or compartment, high pathogenicity avian influenza free status can be regained three months after a stamping out policy (including disinfection of all affected establishments) is applied, providing that surveillance in accordance with the provisions of the Terrestrial Animal Health Code of World Organisation for Animal Health has been carried out during that three-month period. 3. Recognition of zones and compartments.- (1) For the purpose of recognition of zones or compartments, the appropriate authority of the exporting country shall make a written request along with the necessary evidence to Government of India in the Ministry of Fisheries, Animal Husbandry and Dairying, Department of Animal Husbandry and Dairying. (2) The adaptation to the sanitary regional characteristics of the exporting country shall be made in accordance with guidelines issued by the Central Government from time to time and this notification shall be read in consonance with the extant guidelines.
