L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx II—[k.M 3—mi&[k.M (i) PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 373] ubZ fnYyh] eaxyokj] ebZ 16] 2017@oS'kk[k 26] 1939 No. 373] NEW DELHI, TUESDAY, MAY 16, 2017/VAISAKHA 26, 1939 सामािजक न्याय और अिधकािरता म(cid:7074)ं ालय (सामािजक न् याय और अिधकािरता िवभाग) (राष्(cid:7069) ीय िपछड़ा वग र्आयोग) अिधसचू ना नई िदल् ली, 15 मई, 2017 सा.का.िन. 468(अ).—केन् (cid:7076)ीय सरकार, एत(cid:7375)ारा राष् (cid:7069)ीय िपछड़ा वगर् आयोग अिधिनयम, 1993 (1993 का 27) की धारा 5 की उप-धारा (2) के साथ पिठत घारा 17 की उप-धारा (2) के खडं (क) (cid:7367)ारा (cid:7079)दत् त शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए और राष् (cid:7069)ीय िपछड़ा वग र् आयोग (अनुसधं ान अिधकारी) भत(cid:7278) िनयम, 2014 तथा राष् (cid:7069)ीय िपछड़ा वग र् आयोग (अनुसंधान अन् वषे क) भत(cid:7278) िनयम, 2014 को उन बात(cid:7298) के िसवाए अिध(cid:7059)ातं करत े हुए, िजन् ह (cid:7286) ऐसे अिध(cid:7059)मण से पवू र् िकया गया ह ै या करने का लोप िकया गया ह,ै सामािजक न् याय और अिधकािरता मं(cid:7074)ालय के अधीन राष् (cid:7069)ीय िपछड़ा वगर् आयोग म(cid:7286) अनसु ंधान अिधकारी और अनुसंधान अन् वषे क के पद(cid:7298) पर भत(cid:7278) करन े की प(cid:7373)ित को िविनयिमत करने के िलए िनम्न िलिखत िनयम बनाती ह ै:— 1. सिंक्षप्त नाम और (cid:7079)ारंभ (1) इन िनयम(cid:7298) को राष् (cid:7069)ीय िपछड़ा वग र्आयोग (अनुसधं ान अिधकारी और अनसु ंधान अन् वषे क) भत(cid:7278) िनयम, 2017 कहा जाएगा । (2) ये राजप(cid:7074) म (cid:7286)(cid:7079)काशन की तारीख को (cid:7079)वृत ह(cid:7298)ग े। 2. पद सख्ं य ा, वग(cid:7278)करण और प-े मैि(cid:7069)क्स म (cid:7286)लवे ल : उक् त पद(cid:7298) की सख्ं या, उनका वग(cid:7278)करण, प-ेमैि(cid:7069)क् स म(cid:7286) उनका लेवल वही होगा जो इन िनयम(cid:7298) से उपाब(cid:7373) अनसु ूची के स् तंभ (2) से स् तंभ (4) म(cid:7286) िविन(cid:7416)दष्र् ट ह ै। 3. भत(cid:7278) की प(cid:7373)ित, आय-ु सीमा, अहतर् ाएं आिद : उक् त पद(cid:7298) पर भत(cid:7278) की प(cid:7373)ित, आयु-सीमा, अहतर् ाएं और उनसे संबंिधत अन् य बात(cid:7286) व ेह(cid:7298)गी जो उक् त अनुसूची के स् तभं (5) से स् तभं (13) म(cid:7286) िविन(cid:7416)दष्र् ट ह (cid:7289)। 3166 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. िनरहतर् ा : वह (cid:7390)ि(cid:7334), — (क) िजसन ेऐस े(cid:7390)ि(cid:7334) स ेिजसका पित या िजसकी प(cid:7360)ी जीिवत ह,ै िववाह िकया ह;ै या (ख) िजसन ेअपन ेपित या अपनी प(cid:7360)ी के जीिवत रहत ेहुए िकसी (cid:7390)ि(cid:7334) से िववाह िकया ह,ै उ(cid:7334) पद पर िनयिु(cid:7334) का पा(cid:7074) नह(cid:7277) होगा : परन्त ुयिद केन्(cid:7076)ीय सरकार का यह समाधान हो जाता ह ैिक ऐसा िववाह ऐस े(cid:7390)ि(cid:7334) और िववाह के अन्य पक्षकार को लाग ूस्वीय िविध के अधीन अनुज्ञेय ह ैऔर ऐसा करन ेके िलए अन्य आधार ह (cid:7289)तो वह िकसी (cid:7390)ि(cid:7334) को इस िनयम के (cid:7079)वतर्न स ेछूट द ेसकेगी। 5. िशिथल करन ेकी शि(cid:7334) : जहां केन्(cid:7076)ीय सरकार की यह राय ह ै िक ऐसा करना आवश्यक या समीचीन है, वहा ं वह उसके िलए जो कारण ह,(cid:7289) उन्ह (cid:7286)लेखब(cid:7373) करके तथा संघ लोक सवे ा आयोग स ेपरामशर् करके, इन िनयम(cid:7298) के िकसी उपबंध को िकसी वगर् या (cid:7079)वगर् के (cid:7390)ि(cid:7334)य(cid:7298) की बाबत, आदेश (cid:7367)ारा िशिथल कर सकेगी। 6. (cid:7390)ाविृ(cid:7275) : इन िनयम(cid:7298) की कोई बात, ऐसे आरक्षण, आय-ु सीमा म(cid:7286) छूट और अन् य िरयायत(cid:7298) पर (cid:7079)भाव नह(cid:7277) डालगे ी, िजनका केन्(cid:7076) ीय सरकार (cid:7367)ारा इस सबं धं म(cid:7286) समय-समय पर िनकाले गए आदशे (cid:7298) के अनुसार अनुसूिचत जाितय(cid:7298), अनुसूिचत जनजाितय(cid:7298), भूत-पवू र् सैिनक(cid:7298) और अन् य िवशेष (cid:7079)वग र्के व्य ि(cid:7334)य(cid:7298) के िलए उपबंध करना अपेिक्षत ह ै। अनसु चू ी पदनाम पद संख्या वग(cid:7278)करण वेतन बड(cid:7289) और (cid:7061)डे चयन अथवा सीधी भत(cid:7278) के िलए आय-ु सीमा वेतन/ वेतनमान अचयन पद 1 2 3 4 5 6 1. अनसु ंधान 2* लागू नह(cid:7277) प-े मैि(cid:7069)क्स अचयन अिधकतम 35 (पत(cid:7289) ीस) वषर् (2017) (56100- (केन्(cid:7076) सरकार (cid:7367)ारा जारी अनुदशे (cid:7298) या आदशे (cid:7298) के अिधकारी (* कायर्भार के 177500 रुपए) म(cid:7286) अनुसार सरकारी कमर्चारी को 5 वषर् तक की आधार पर लेवल 10 ढील दी जा सकती ह)ै पिरवतनर् के िटप्पणी : आय ु िनधार्िरत करन े की िनणार्यक अध्यधीन) तारीख आवेदन-प(cid:7074)(cid:7298) की (cid:7079)ाि(cid:7385) की अंितम तारीख होगी, न िक असम, मेघालय, अरुणाचल (cid:7079)दशे , िमजोरम, मिणपुर, नागालड(cid:7289) , ि(cid:7074)पुरा, िसि(cid:7333)म, जम्मू और कश्मीर राज्य का ल(cid:7374)ाख िडवीजन, िहमाचल (cid:7079)दशे का लहोल व स्पीित िजला और चबं ा िजल े का पगं ी सब-िडवीजन, अंडमान िनकोबार (cid:7367)ीप समूह संघ राज्य क्षे(cid:7074) या लक्ष(cid:7367)ीप संघ राज्य क्षे(cid:7074) के अभ्यिथर्य(cid:7298) के िलए िनधार्िरत अंितम तारीख । सीधी भत(cid:7278) के िलए अपेिक्षत शैिक्षक और अन्य अहतर् ाए ं सीधी भत(cid:7278) िकए जान े वाल े पिरवीक्षा की (cid:7390)ि(cid:7334)य(cid:7298) के िलए िविहत आय ु अविध, यिद और शैिक्षक अहतर् ाए ं (cid:7079)ो(cid:7382)त कोई हो (cid:7390)ि(cid:7334)य(cid:7298) की दशा म(cid:7286) लाग ू ह(cid:7298)गी या नह(cid:7277) 7 8 9 अिनवाय र्: जी, नह(cid:7277)। दो वषर्। मान्यता(cid:7079)ा(cid:7385) िव(cid:7393)िव(cid:7378)ालय अथवा संस्थान से मानव िवज्ञान अथवा समाज-िवज्ञान अथवा सामािजक कायर् म(cid:7286) िनष्णात उपािध। वाछं नीय :¹Hkkx IIμ[k.M 3 (i)º Hkkjr dk jkti=k % vlk/kj.k 3 (i) केन्(cid:7076)ीय सरकार अथवा राज्य सरकार अथवा सघं राज्य क्षे(cid:7074) अथवा िव(cid:7393)िव(cid:7378)ालय अथवा मान्यता(cid:7079)ा(cid:7385) अनुसधं ान सस्ं थान अथवा स्वाय(cid:7275) संगठन अथवा सांिविधक सगं ठन अथवा सावर्जिनक क्षे(cid:7074) के उप(cid:7059)म म(cid:7286), िनष्णात उपािध के प(cid:7391)ात,् समाज कल्याण तथा िवकास के क्ष(cid:7074)े म(cid:7286) सामािजक अनुसधं ान अथवा सामािजक आयोजना अथवा सामािजक काय,र् िशक्षा एव ं(cid:7079)िशक्षण म(cid:7286) दो वषर् का अनुभव। (ii) समाज िवज्ञान िवषय म(cid:7286) डॉक्टरेट। िटप्पणी 1 : अन्यथा उ(cid:7340) अहतर् ा (cid:7079)ा(cid:7385) अभ्यिथर्य(cid:7298) के मामले म,(cid:7286) कारण िलिखत म(cid:7286) दज र् करके, सिचव, सामािजक न्याय और अिधकािरता िवभाग के िववेकािधकार पर अहर्ता(cid:7312) म(cid:7286) ढील दी जा सकती ह।ै िटप्पणी 2 : यिद चयन की िकसी भी अवस्था म(cid:7286) सक्षम (cid:7079)ािधकारी का यह अिभमत हो िक अनुसूिचत जाित या अनुसूिचत जनजाित के अभ्यिथर्य(cid:7298) के िलए आरिक्षत पद(cid:7298) को भरने के िलए इन समुदाय(cid:7298) से पयार्(cid:7385) सख्ं या म(cid:7286) अपेिक्षत अनुभव वाले अभ्यिथर्य(cid:7298) के उपलब्ध होन े की संभावना नह(cid:7277) ह,ै तो िलिखत म(cid:7286) कारण दज र् करके इन समुदाय(cid:7298) के अभ्यिथर्य(cid:7298) के मामले म(cid:7286) सिचव, सामािजक न्याय और अिधकािरता िवभाग के िववके ािधकार पर अनुभव के सबं धं म(cid:7286) अहतर् ा(cid:7312) म(cid:7286) ढील दी जा सकती ह।ै भत(cid:7278) की प(cid:7373)ित : (cid:7079)ो(cid:7382)ित अथवा (cid:7079)ितिनयुि(cid:7334)/ आमेलन (cid:7367)ारा भत(cid:7278) की यिद िवभागीय (cid:7079)ो(cid:7382)ित सिमित ह,ै तो भत(cid:7278) करने म(cid:7286) भत(cid:7278) सीध े होगी या दशा म (cid:7286) व े (cid:7088)ेिणयां िजनस े (cid:7079)ो(cid:7382)ित अथवा िकन उसकी संरचना (cid:7079)ो(cid:7382)ित (cid:7367)ारा या (cid:7079)ितिनयुि(cid:7334)/आमले न िकया जाएगा। पिरिस्थितय(cid:7298) म(cid:7286) (cid:7079)ितिनयुि(cid:7334)/आमले न संघ लोक सेवा (cid:7367)ारा तथा िविभ(cid:7382) आयोग से प(cid:7373)ितय(cid:7298) (cid:7367)ारा भरी परामशर् िकया जाने वाली िरि(cid:7334)य(cid:7298) जाएगा। की (cid:7079)ितशतता (10) (11) (12) (13) (cid:7079)ो(cid:7382)ित (cid:7367)ारा ऐसा न (cid:7079)ो(cid:7382)ित िवभागीय (cid:7079)ो(cid:7382)ित सिमित ((cid:7079)ो(cid:7382)ित पर लागू नह(cid:7277)। होने पर (cid:7079)ितिनयुि(cid:7334) प-े मैि(cid:7069)क्स के लेवल-6 (35400-112400 रुपए) म (cid:7286) िवचार करन े के िलए), िजसम (cid:7286) (cid:7367)ारा (अल्पाविध अनुसधं ान अन्वषे क के (cid:7061)डे म(cid:7286) आठ वष र्की िनयिमत िन(cid:7388)िलिखत शािमल ह(cid:7298)ग े:- संिवदा सेवा। (i) िनदशे क अथवा उप सिचव, सिहत)/आमेलन और िटप्पणी : जहां किन(cid:7399) (cid:7390)ि(cid:7334) न े अपनी अहतर् ा या िपछड़ा वग र् (cid:7079)भाग, सामािजक न्याय दोन(cid:7298) के न होने पर पा(cid:7074)ता सेवा पूरी कर ली ह ै और उसकी (cid:7079)ो(cid:7382)ित के सीधी भत(cid:7278) (cid:7367)ारा। बारे म(cid:7286) िवचार िकया जा रहा ह,ै की सेवा पर भी और अिधकािरता िवभाग – अध्यक्ष (ii) उप सिचव, रा(cid:7398)ीय िपछड़ा िवचार िकया जाएगा, बशत(cid:7287) िक उनकी अपेिक्षत वग र्आयोग - सदस्य; अथवा (iii) मूल सवं ग र् अथवा िवभाग म (cid:7286) प-े मैि(cid:7069)क्स (44900-142400 रुपए) म(cid:7286) लेवल-7 म(cid:7286) िनयिमत आधार पर इस पद पर िनयुि(cid:7334) के प(cid:7391)ात् इस (cid:7061)डे म(cid:7286) तीन वष र् की िनयिमत सवे ा; Secy.¹Hkkx IIμ[k.M 3 (i)º Hkkjr dk jkti=k % vlk/kj.k 11 अिधसूचना नई िदल् ली, 15 मई, 2017 सा.का.िन. 469(अ).—केन् (cid:7076)ीय सरकार, एत(cid:7375)ारा राष् (cid:7069)ीय िपछड़ा वगर् आयोग अिधिनयम, 1993 (1993 का 27) की धारा 5 की उप-धारा (2) के साथ पिठत घारा 17 की उप-धारा (2) के खंड (क) (cid:7367)ारा (cid:7079)दत् त शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए और राष् (cid:7069)ीय िपछड़ा वगर् आयोग (लेखा अिधकारी) भत(cid:7278) िनयम, 2014 को उन बात(cid:7298) के िसवाए अिध(cid:7059)ांत करते हुए, िजन् ह (cid:7286) ऐसे अिध(cid:7059)मण से पूवर् िकया गया ह ैया करने का लोप िकया गया ह,ै सामािजक न् याय और अिधकािरता मं(cid:7074)ालय के अधीन राष् (cid:7069)ीय िपछड़ा वगर् आयोग म(cid:7286) लेखा अिधकारी के पद पर भत(cid:7278) करने की प(cid:7373)ित को िविनयिमत करने के िलए िनम् निलिखत िनयम बनाती ह ै:— 1. सिं क्षप्त नाम और (cid:7079)ारंभ : (1) इन िनयम(cid:7298) को राष् (cid:7069)ीय िपछड़ा वगर् आयोग (लेखा अिधकारी) भत(cid:7278) िनयम, 2017 कहा जाएगा । (2) ये राजप(cid:7074) म(cid:7286) (cid:7079)काशन की तारीख को (cid:7079)वृत ह(cid:7298)गे । 2. पद सख्ं य ा, वग(cid:7278)करण और प-े मिै (cid:7069)क्स म (cid:7286)लेवल : उक् त पद(cid:7298) की संख् या, उनका वग(cid:7278)करण, पे-मैि(cid:7069)क् स म(cid:7286) उनका लेवल वही होगा जो इन िनयम(cid:7298) से उपाब(cid:7373) अनुसूची के स् तंभ (2) से स् तंभ (4) म(cid:7286) िविन(cid:7416)दर्ष् ट ह ै। 3. भत(cid:7278) की प(cid:7373)ित, आय-ु सीमा, अहतर् ाएं आिद : उक् त पद(cid:7298) पर भत(cid:7278) की प(cid:7373)ित, आयु-सीमा, अहतर् ाएं और उनसे संबंिधत अन् य बात(cid:7286) वे ह(cid:7298)गी जो उक् त अनुसूची के स् तंभ (5) से स् तंभ (13) म(cid:7286) िविन(cid:7416)दर्ष् ट ह (cid:7289)। 4. िनरहतर् ा : वह (cid:7390)ि(cid:7334), - (क) िजसने ऐसे (cid:7390)ि(cid:7334) से िजसका पित या िजसकी प(cid:7360)ी जीिवत ह,ै िववाह िकया ह;ै या (ख) िजसने अपने पित या अपनी प(cid:7360)ी के जीिवत रहते हुए िकसी (cid:7390)ि(cid:7334) से िववाह िकया ह,ै उ(cid:7334) पद पर िनयुि(cid:7334) का पा(cid:7074) नह(cid:7277) होगा : परन्तु यिद केन्(cid:7076)ीय सरकार का यह समाधान हो जाता ह ैिक ऐसा िववाह ऐसे (cid:7390)ि(cid:7334) और िववाह के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनुज्ञेय ह ै और ऐसा करने के िलए अन्य आधार ह (cid:7289)तो वह िकसी (cid:7390)ि(cid:7334) को इस िनयम के (cid:7079)वतर्न से छूट द ेसकेगी। 5. िशिथल करन ेकी शि(cid:7334) : जहां केन्(cid:7076)ीय सरकार की यह राय ह ैिक ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण ह,(cid:7289) उन्ह (cid:7286) लेखब(cid:7373) करके तथा संघ लोक सेवा आयोग से परामशर् करके, इन िनयम(cid:7298) के िकसी उपबंध को िकसी वगर् या (cid:7079)वगर् के (cid:7390)ि(cid:7334)य(cid:7298) की बाबत, आदशे (cid:7367)ारा िशिथल कर सकेगी। 6. Short title and commencement. – (1) These rules may be called the National Commission for Backward Classes (Accounts Officer) Recruitment Rules, 2017. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of posts, classification and level in pay matrix. – The number of the said post, its classification, level in pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.¹Hkkx IIμ[k.M 3 (i)º Hkkjr dk jkti=k % vlk/kj.k 15 3. Disqualification. – No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living has entered into or contracted a marriage with any person; shall be eligible for appointment to any of the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons. 6.
