करते हुए, दत् तक्रहहण जिजनयमन, 2017 का संिोधन करन े के जलए जनम्न जलजखत जिजनयमक को ऄजधसूजचत करती ह,ै
ऄथाात ् :
1. संजषण)प्त नाम और प्रारंभ - ा1अ आन जिजनयमक का संजषण)प्त नाम दत्तक्रहहण ासंिोधनअ जिजनयम, 2021 ह।ै
(2) ऄन्यथा ईपबंजधत के जसिाय, ये जिजनयम राजपत्र म ेंईनके प्रकािन कद तारीख को प्रिृत हकगे।
2. दत् तक्रहहण जिजनयमन, 2017 (आसे आसमें आसके पश् चात प्रधान जिजनयमन कहा गया हअै म,ें ऄध् याय IV के पश् चात,
जनम्न जलजखत ऄध् याय ऄंत: स्ट्थाजपत दकया जाएगा:-

22क. ऄध्य ाय का लाग ूहोना .- ा1अ यह ऄध् याय जनम्न जलजखत पर लागू होगा-

ऄजधजनयम, 1956 (1956 का 78अ के ऄधीन सभी दत्तक्रहहण मामलक ।
ाखअ हगे दत्तक्रहहण ऄजभसमय से बाहर के देिक स ेसंबं जधत सभी दत्तक्रहहण मामलक पर।
ा2अ केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण, हहद ू दत्तक्रहहण और भरण-पोषण ऄजधजनयम, 1956 (1956 का 78अ के
ऄधीन ऄंतर-देिीय दत्तक्रहहण मामलक के अिेदनक को रजजस्ट्टर दकया जाएगा ।
22ख. रजजस्ट्रीकृत दत्त क्रहहण जिलखे के मामल े म ें प्रदिया - ा1अ ऐसे मामलक में जहााँ दत्तक्रहहण जिलेख हहद ू दत्तक्रहहण
और भरण-पोषण ऄजधजनयम, 1956 (1956 का 78) के ऄधीन दत्तक्रहहण के ऄनुसरण म ें दत्तक्रहहण ासंिोधनअ
जिजनयमन, 2021 के प्रारंभ होने से पहल े ही जनष्पाददत दकया जा चुका ह,ै दत्तक्रहहण जिलखे के तथ्यक का समथान करन े
िाले ऄपेजषण)त दस्ट्तािेज ऄनुसूची 33 में ईपबंजधत प्रारूप म ें जजला मजजस्ट्रेट द्वारा सम्यक रूप से सत्याजपत जसफ़ाठरि कद
जाएगी।
ा2अ ऄनुसूची 33 के ऄनुसार दस्ट्तािेजक का सत्यापन प्राप् त होने पर, केंद्रीय दत्तक्रहहण ससं ाधन प्राजधकरण हगे
दत्तक्रहहण ऄजभसमय में यथा ईपबंजधत प्राप् तकताा दिे से ऄनच्ु छेद 5 या ऄनच्ु छेद 17 के ईपबंधक का पालन करेगा।
ा3अ ऐसा प्रमाणपत्र प्राप् त होन े पर, केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण हगे ऄनुसमर्थथत देिक के जलए ऄनापजत्त
प्रमाणपत्र जारी करेगा और ऄंतदेिीय दत्तक्रहहण के संबंध में बालकक के संरषण)ण और सहयोग पर हगे ऄजभसमय के बाहर के
देिक के मामल,े केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण द्वारा ऄजं तम समथना पत्र जारी दकए जाने के जलए केंद्रीय दत्तक्रहहण
संसाधन प्राजधकरण द्वारा प्राप् तकताा देि के संबंजधत सरकारी जिभाग से ई्त दत्तक्रहहण के स्ट्ि ीकृजत पत्र कद मांग करेगा।
22ग. भािी ऄतं र-देिीय दत्त क्रहहण के जलए प्रदिया - ा1अ दत्तक्रहहण ासंिोधनअ जिजनयम, 2021 के प्रिृत्त होने के पश्चात
िुरू दकए गए मामलक म,ें पात्र ऄ-जनिासी भारतीयक या भारत के प्रिासी नागठरक काडाधारकक द्वारा, हहद ू दत्तक्रहहण और
भरण-पोषण ऄजधजनयम, 1956 ा1956 का 78अ के ऄधीन सभी ऄंतर-देिीय दत्तक्रहहण के जलए जनम्नजलजखत मानक
सामान्य प्रदिया लाग ूहोगी जो भारत से दकसी बालक का दत्तक ्रहहण दकया है।
ा2अ कोइ जहन्द ू भािी दत्तक ्रहहण माता जपता, जो साधारणतया जिदेि में जनिास कर रह े और भारत में रहने िाल े
भारतीय हहद ूमाता-जपता स े पदै ा हुए भारतीय हहद ू बालक को गोद लेन े के आच्छुक ह,ै ऄपन े साधारणतया जनिास के देि में
दकसी प्राजधकृत जिदेिी दत्तक्रहहण एजेंसी या केंद्रीय प्राजधकरण या संबंजधत सरकारी जिभाग ाहगे दत्तक्रहहण ऄजभसमय से
बाहर के देिक के मामल े मेंअ, जैसी भी जस्ट्थजत हो, से संपका कर सकते ह।ैं
ा3अ ईनके साधारणतया जनिास के देि म ें प्राजधकृत जिदेिी दत्तक्रहहण एजेंसी या केंद्रीय प्राजधकरण या संबंजधत सरकारी
जिभाग ाहगे दत्तक्रहहण ऄजभसमय से बाहर के देिक के मामल ेमेंअ पात्र और ईपयु् त भािी दत्तक माता-जपता के अिेदन को
केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण को प्रायोजजत करेगा।
ा4अ केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण प्राजधकृत जिदेिी दत्तक्रहहण एजेंसी से प्राप् त प्रायोजक पत्र को बालक के
जनिास के जजले के जजला मजजस्ट्रेट के साथ साझा करेगा।
ा5अ जजला मजजस्ट्रेट एक पाठरिाठरक पृष्ि भूजम ठरपोटा तैयार करिाएगा, जजसमें जैजिक माता-जपता और दत्तक जलए जान े
के जलए प्रस्ट्ताजित बालक से सबं ंजधत सभी अिश्यक दस्ट्तािेज िाजमल हकग े और ठरपोटा ऄनुसूची 34 म ें जजला बाल संरषण)ण
ऄजधकारी या जजला बाल सरं षण)ण आकाइ के माध्यम स े संचाजलत कद जाएगी।
ा6अ पाठरिाठरक पृष्ि भूजम ठरपोटा प्राप् त होने पर, केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण आस े संबंजधत प्राजधकृत जिदेिी
दत्तक्रहहण एजेंसी, या केंद्रीय प्राजधकरण, या संबंजधत सरकारी जिभाग ाहगे दत्तक्रहहण ऄजभसमय से बाहर के देिक के
मामले मअें को ईनके साधारणतया जनिास के दिे ाहगे ऄनुसमर्थथत देिकअ म ें ऄनुच्छेद 5 या ऄनुच्छेद 17 के ऄधीन अिश्यक
ऄनुमजत या दत्तक्रहहण का समथान ाहगे दत्तक्रहहण कन्िेंिन से बाहर के देिक के मामल े मेंअ का पत्र जारी करने, जैसी भी
जस्ट्थजत हो, के जलए ऄ्रहेजषत करेगा।
22घ. दत्त क्रहहण प्रदिया - ा1अ जहन्द ू दत्तक्रहहण और भरण-पोषण ऄजधजनयम, 1956 ा1956 का 78अ के ऄधीन संपन्न
दत्तक्रहहण के पषण)कार संयु् त रूप से जजला रजजस्ट्रार को दत्तक्रहहण जिलेख, जजला मजजस्ट्रेट को प्रजत सजहत, प्रस्ट्तुत करेंगे।
ा2अ जिलेख कद ऐसी प्रजत के अधार पर, जजला मजजस्ट्रेट ऐसी जांच करेगा, जजसे िह स्ट् ियं का समाधान होने पर ईजचत
समझे दक हहद ू दत्तक्रहहण और भरण-पोषण ऄजधजनयम, 1956 ा1956 का 78अ के सभी ईपबंधक, और जनधाारणक का
जिजनयमक के ऄधीन पालन दकया गया ह ैऔर ऐसी जांच तीस ददनक कद ऄिजध के भीतर परू ी कद जाएगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3
(3अ यदद जजला मजजस्ट्रेट तीस ददनक के भीतर जांच पूरी करने में जिफल रहता है, िह तीस ददन के भीतर जांच ठरपोट ा
ईपलब्ध कराने म ें ऄसफल रहन े के जलए सत्यापन प्रमाण पत्र के साथ कारण देने के जलए बाध्य होगा, पषण)कार रजजस्ट्रीकरण
ऄजधजनयम, 1908 ा1908 का 16अ के ऄधीन संबंजधत ईप-रजजस्ट्रार के पास दत्तक्रहहण जिलेख रजजस्ट्रीकृत करा सकत े ह,ैं
जजसमें दकए गए अिेदन का जििरण देकर यह सूजचत कर सकते ह ैं दक ईप-जिजनयम ा2) में जनर्ददष् ट जनधााठरत समय के
भीतर जजला मजजस्ट्रेट से जांच प्राप् त नह हुइ ह।ै
ा4अ आसके पश् चात जजला मजजस्ट्रेट यह प्रमाजणत करते हुए सत्यापन प्रमाणपत्र केन्द्रीय दत्तक्रहहण संसाधन प्राजधकरण को
ऄ्रहेजषत करेगा दक-
ाकअ दत्तक्रहहण के जिलेख म ें ऄजभजलजखत दत्तक्रहहण हहद ू दत्तक्रहहण और भरण-पोषण ऄजधजनयम, 1956
ा1956 का 78अ के ईपबंधक के ऄनुसार दकया गया ह,ै जजसमें ऄनुसूची 33 में बालकक कद सोर्ससग, दत्तक माता-
जपता कद पात्रता और ईपयु् तता सजम्मजलत ह।ै
ाखअ िह दत्तक बालक या जैजिक माता-जपता, बालक के दत्तक्रहहण के समय दकसी दबाि में नह ह;ैं
ागअ दत्तक्रहहण सभी संबंजधत पषण)क कद अपसी सहमजत से संपन्न हुअ था;
ाघअ दत्तक्रहहण कद प्रदिया में कोइ धनीय जिचार सजम्मजलत नह ह ैऔर दत्तक्रहहण बच्चे के सिोत्तम जहत में ह।ै
22ङ. ऄनापजत्त प्रमाणपत्र और ऄनरूु पता प्रमाणपत्र जारी करना - ा1अ रजजस्ट्रीकृत दत्तक्रहहण जिलेख पर जजला मजजस्ट्रेट
से सत्यापन प्रमाणपत्र, और ऄंतर-देिीय दत्तक्रहहण के संबंध में बालकक के सरं षण)ण और सहयोग पर हगे दत्तक्रहहण
ऄजभसमय में ईपबंध के ऄनुसार प्राप् तकता ा देि स े ऄनुच्छ ेद 5 या ऄनच्ु छेद 17 के ऄधीन अिश् यक ऄनुमजत प्राप् त होन े पर,
केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण हगे ऄनुसमर्थथत देिक के जलए ऄनापजत्त प्रमाणपत्र जारी करेगा और तत्पश् चात
ऄनुच्छेद 23 के ऄधीन ऄनुरूपता प्रमाणपत्र केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण द्वारा दकया जाएगा।
ा2अ हगे दत्तक्रहहण ऄजभसमय से बाहर के देिक के मामले म,ें केंद्रीय दत्तक्रहहण संसाधन प्राजधकरण द्वारा बाद में एक
समथान पत्र जारी दकया जाएगा।
ा3अ दत्तक्रहहण के बाद छमाही अधार पर संबंजधत ऄजधकृत जिदेिी दत्तक्रहहण ऄजभकरण, या केंद्रीय प्राजधकरण, या
संबंजधत सरकारी जिभाग, जैसी भी जस्ट्थजत हो, से ऄनुिती ठरपोटा प्राप् त कद जाएगी।”

हहद ूपुत्री या पुत्र कद पुत्री ािैध र्त संबंध या दत्तक्रहहण द्वाराअ नह होनी चाजहए।
ग. यदद दत्तक्रहहण दकसी पुुषष द्वारा दकया गया ह ै और दत्तक ली जाने िाली बाजलका हो, तो दत्तक्रहाही जपता
दत्तक ली जान े िाली पुत्री स ेकम से कम 21 िषा बडा हो।
घ. यदद दत्तक्रहहण दकसी मजहला द्वारा दकया गया ह ै और दत्तक जलया जान े िाला पुत्र हो, तो दत्तक्रहाही माता
दत्तक जलए पुत्र िाले बालक से कम से कम 21 िषा बडी हो।
ङ. िही ऄपत्य दकसी ऄन्य व्यजि द्वारा दत्तक नह जलया जा सकता।

जिजनयमक के प्रारंभ के पहल,े जहन्द ूदत्तक ्रहहण और भरण-पोषण ऄजधजनयम, 1956 (1956 का 78) के ऄधीन दत्तक ्रहहण
के ऄनुसरण पहले ही जनष्पाददत दकया गया ह ै । यह प्रमाजणत दकया जाता ह ै दक ऐसे भूतलषण)ी ददये जाने से दकसी व्यजि पर
प्रजतकूल प्रभाि नह पडेगा ।

NOTIFICATION
New Delhi, the 17th September, 2021
G.S.R. 641(E).—In exercise of the powers conferred by clause (b) and (c) of section 68 read with
clause (3) of section 2 of the Juvenile Justice (Care and Protection of Children) Act, 2015 (2 of 2016), the
Central Government hereby notifies the following regulations to amend the Adoption Regulations, 2017,
namely:-
1. Short title and commencement. - (1) These regulations may be called the Adoption (Amendment)
Regulations, 2021.
(2) Save as otherwise provided, these regulations shall come into force on the date of their
publication in the Official Gazette.
2. In the Adoption Regulations, 2017 (hereinafter referred to as the principal regulations), after Chapter
IV, the following Chapter shall be inserted, namely:-
“CHAPTER IV-A
PROCEDURE FOR CHILDREN ADOPTED UNDER THE HINDU ADOPTION AND
MAINTENANCE ACT, 1956, BY PARENTS WHO DESIRE TO RELOCATE CHILD ABROAD
22A. Application of Chapter.—(1) This Chapter shall apply to—
(a) all adoption cases under the Hindu Adoptions and Maintenance Act, 1956 (78 of 1956) by prospective
adoptive parents or adoptive parents residing outside the country.
(b) all adoption cases pertaining to countries outside the Hague Adoption Convention.
(2) The Central Adoption Resource Authority shall register applications for inter-country adoptions
concluded under the Hindu Adoptions and Maintenance Act, 1956 (78 of 1956).
22B. Procedure in the case of registered adoption deed.- (1) In the cases where the adoption deed has
already been executed in pursuance of adoption under the Hindu Adoptions and Maintenance Act, 1956 (78
of 1956), before the commencement of the Adoption (Amendment) Regulations, 2021, the requisite
documents supporting the facts of the adoption deed shall be duly verified and recommended by the District
Magistrate in the format as provided in Schedule XXXIII.
(2) On receipt of the verification of documents as per Schedule XXXIII, the Central Adoption Resource
Authority shall comply with the provisions of Articles 5 or 17 from the receiving country as provided in the
Hague Adoption Convention.
(3) Upon receiving such certificate, the Central Adoption Resource Authority shall issue no objection
certificate for Hague ratified countries and in cases of countries outside the Hague Convention on
Protection of Children and Co-operation in respect of Inter-country Adoption, a letter accepting the said
adoption from the Government department concerned of the receiving country shall be sought by the
Central Adoption Resource Authority in order to issue the final support letter from the Central Adoption
Resource Authority.
22C. Procedure for prospective inter-country Adoption.- (1) In the cases initiated after the coming into
force of the Adoption (Amendment) Regulations, 2021, the following standard common procedure shall be
applicable for all inter-country adoptions concluded under the Hindu Adoptions and Maintenance Act, 1956
(78 of 1956), by eligible non-resident Indians or Overseas Citizens of India cardholders, who are to take a

(2) Any Hindu prospective adoptive parent habitually residing abroad and willing to adopt an Indian Hindu
child born to Indian Hindu Parents, residing in India, may approach an Authorised Foreign Adoption
Agency or the Central Authority or concerned Government department (in case of countries outside the
Hague Adoption Convention) in their country of habitual residence, as the case may be.
(3) The Authorised Foreign Adoption Agency, or Central Authority or concerned Government department
(in case of countries outside the Hague Convention) in their country of habitual residence shall sponsor the
application of eligible and suitable prospective adoptive parents to the Central Adoption Resource
Authority.
(4) The Central Adoption Resource Authority shall share the sponsoring letter received from the Authorised
Foreign Adoption Agency with District Magistrate of the district of residence of the child.
(5) The District Magistrate shall get a family background report prepared which shall include all required
documents related to the biological parents and the child proposed to be adopted and the report shall be
conducted through the District Child Protection Officer or the District Child Protection Unit in the
Schedule XXXIV.
(6) On receiving the family background report, the Central Adoption Resource Authority shall forward it to
the concerned Authorised Foreign Adoption Agency, or Central Authority, or concerned Government
department (in case of countries outside the Hague Adoption Convention) in their country of habitual
residence for issuing necessary permission under Articles 5 or17 (Hague ratified countries) or letter
supporting adoption (in case of countries outside the Hague Adoption Convention), as the case may be.
22D. Adoption process.- (1) The parties to an adoption concluded under the Hindu Adoptions and
Maintenance Act, 1956 (78 of 1956) shall jointly present the deed of adoption to the District Registrar with
copy to District Magistrate.
(2) Based on such copy of the deed, the District Magistrate shall conduct such inquiry, as he may deem fit,
to satisfy himself that all the provisions of Hindu Adoptions and Maintenance Act, 1956 (78 of 1956), and
the stipulations under the regulations have been followed and such inquiry shall be completed within a
period of thirty days.
(3) In case the District Magistrate fails to complete the inquiry within thirty days, he shall be bound to give
reasons alongwith verification certificate for failing to provide the inquiry report within thirty days, the
parties may register the adoption deed with the Sub-Registrar concerned under the Registration Act, 1908
(16 of 1908), indicating the details of application made and that inquiry from District Magistrate has not
been received within the stipulated time referred to in sub-regulation (2).
(4) The District Magistrate shall thereafter forward the verification certificate to the Central Adoption
Resource Authority certifying the following that-
(a) the adoption recorded in the deed of adoption has been made in accordance with the provisions
of the Hindu Adoptions and Maintenance Act, 1956 (78 of 1956), including the sourcing of the
child, the eligibility and suitability of the adoptive parents in Schedule XXXIII.
(b) the adopted child or the biological parents are not under any duress while giving the child in
adoption;
(c) the adoption had been concluded with mutual consent of all parties concerned;
(d) there has been no monetary consideration involved in the adoption process and the adoption is
in the best interest of the child.
22E. Issue of no objection certificate and Conformity Certificate.- (1) On receipt of verification
certificate from the District Magistrate, on the registered adoption deed and necessary permission under
Articles 5 or 17 from the receiving country as provided in the Hague Adoption Convention on Protection of
Children and Co-operation in respect of inter-country Adoption, the Central Adoption Resource Authority
shall issue no objection certificate for Hague ratified countries and Conformity Certificate under Article 23
shall be issued by the Central Adoption Resource Authority subsequently.
(2) In the case of countries outside the Hague Adoption Convention, a support letter shall be issued by the

(3) Post-adoption follow-up reports on a half-yearly basis shall be obtained from the concerned Authorised
Foreign Adoption Agency, or Central Authority, or the Government department concerned as the case may
be.”.
3. In the principal regulations, after Schedule XXXII, the following Schedules shall be inserted, namely:-

(d) not married, or if married, whose marriage has been dissolved or whose husband is dead or has
completely and finally renounced the world or has ceased to be a Hindu or has been declared by
a court of competent jurisdiction to be of unsound mind, has the capacity to take a son or
daughter in adoption.
5. Capable of giving in adoption under HAMA (As per section 9 of the Hindu Adoptions and
Maintenance Act, 1956 (78 of 1956))
(a) Father with consent of the mother unless the mother has completely and finally renounced the
world or has ceased to be a Hindu or has been declared by a court of competent jurisdiction to
be of unsound mind.
(b) Mother if the father is dead or has completely and finally renounced the world or has ceased to
be a Hindu or has been declared by a court of competent jurisdiction to be of unsound mind.
(c) Guardian of a child shall have the capacity to give the child in adoption.
6. Eligibility of Child for adoption (As per section 10 of the Hindu Adoptions and Maintenance
Act, 1956 (78 of 1956)) –
(a) he or she is a Hindu.
(b) he or she has not already been adopted.
(c) he or she has not been married, unless there is a custom or usage applicable to the parties which
permits persons who are married being taken in adoption.
(d) he or she has not completed the age of fifteen years, unless there is a custom or usage applicable
to the parties which permits persons who have completed the age of fifteen years being taken in

7. Other conditions for a valid adoption (As per section 11 of the Hindu Adoptions and
Maintenance Act, 1956 (78 of 1956))-
(a) if the adoption is of a son, the adoptive father or mother by whom the adoption is made must not
have a Hindu son, son’s son or son’s son’s son (whether by legitimate blood relationship or by
adoption) living at the time of adoption.
(b) if the adoption is of a daughter the adoptive father or mother by whom the adoption is made
must not have a Hindu daughter or son's daughter (whether by legitimate blood relationship or
by adoption) living at the time of adoption.
(c) if the adoption is by a male and the person to be adopted is a female, the adoptive father is at
least twenty-one years older than the person to be adopted.
(d) if the adoption is by a female and the person to be adopted is a male, the adoptive mother is at
least twenty-one years older than the person to be adopted.
(e) the same child is not adopted by any other person.

Explanatory Memorandum.
It is proposed to provide facility of inter country adoption, in the cases where adoption deed has already
been executed in pursuance of adoption under the Hindu Adoptions and Maintenance Act, 1956 (78 of
1956), before the commencement of these amendment regulations. It is certified that no person is
prejudicially affected by giving such retrospectively.
