## Report on the Competition Commission of India Procedure for Engagement of Experts and Professionals Amendment Regulations, 2022 **1. Executive Summary:** This report analyzes the Competition Commission of India (CCI) Procedure for Engagement of Experts and Professionals Amendment Regulations, 2022, as published in the Gazette of India on April 12, 2022. This amendment revises the 2009 regulations concerning the engagement of experts and professionals by the CCI. Key changes include the substitution of "Experts or Professionals including Research Associates" with "Experts and Young Professionals", modifications to qualifications and experience requirements for Economists and Lawyers, the addition of "Financial Analyst" as a new expert category, revisions to categorization criteria, adjustments to remuneration and age limits, clarification on the engagement term, and the inclusion of confidentiality and secrecy provisions. The primary purpose of these amendments appears to be broadening the scope of expertise within the CCI, formalizing the inclusion of young professionals, and strengthening confidentiality measures. **2. Introduction:** This report provides an overview and analysis of the Competition Commission of India Procedure for Engagement of Experts and Professionals Amendment Regulations, 2022 (hereinafter referred to as "the Amendment Regulations"), based solely on the text published in the Gazette of India on April 12, 2022. This report aims to inform affected parties about the key changes introduced by these Amendment Regulations. **3. Policy Overview:** * **Original Policy:** The Amendment Regulations modify the Competition Commission of India Procedure for Engagement of Experts and Professionals Regulations, 2009. * **Core Objective(s):** Based on the text, the objective is to revise the procedures for engaging experts and professionals by the CCI, updating qualifications, experience requirements, remuneration structures, and including confidentiality provisions, potentially to enhance the CCI's capacity to handle complex competition-related matters. **4. Background and Rationale:** The Amendment Regulations suggest a need to update and refine the CCI's process for engaging experts and young professionals. The additions of new categories like "Financial Analyst", revisions of qualification and experience requirements, and the inclusion of young professionals indicate a potential expansion of the skill sets required by the CCI. The addition of confidentiality clauses highlights a desire to protect sensitive information handled by engaged professionals. **5. Key Provisions / Changes:** The Amendment Regulations introduce the following key changes: * **Change 1: Terminology:** Replaces "Experts or Professionals including Research Associates" with "Experts and Young Professionals" throughout the document. This change explicitly includes and formalizes the role of "Young Professionals" within the engagement framework. * **Change 2: Qualifications and Experience (Economist and Lawyer):** Significantly modifies the required qualifications and experience for Economists and Lawyers. The changes emphasize specific expertise in areas like microeconomics, industrial economics, competition assessment, and judicial/legal work. These amendments increase the specificity and rigor of the requirements for Economist and Lawyer roles by highlighting specific experiences and degree specializations. * **Change 3: Addition of "Financial Analyst" Category:** Introduces a new category of "Financial Analyst," defining required qualifications (Master's degrees in Commerce or Business Administration with Accounting and Finance, Chartered Accountant, Cost and Works Accountant, or Company Secretary) and experience (Business Manager/Financial Manager, Chartered Accountant, Cost and Works Accountant or Company Secretary in reputed organizations handling financial ventures). This addition suggests a need for specialized financial expertise within the CCI. * **Change 4: Categorization Criteria (Schedule II):** Replaces the existing Schedule II, introducing experience-based categories for Young Professionals (Grade I and II) and Experts (Grade I, II, and III) with defined experience thresholds (Up to 3 years, minimum 3 years, minimum 5 years, minimum 10 years, minimum 15 years, respectively). This change introduces a more structured approach to categorizing experts and young professionals based on years of experience. * **Change 5: Remuneration and Age Limits (Schedule III):** Replaces the existing Schedule III, adjusting the lumpsum monthly remuneration and age limits for each grade of Young Professional and Expert. The new schedule specifies increasing remuneration based on grade, along with corresponding age limits. * **Change 6: Engagement Term:** Modifies the standard engagement term to a contractual basis for not less than one year and up to three years, with a potential extension of up to two years in special cases. This provides greater clarity and flexibility in engagement durations. * **Change 7: Confidentiality and Secrecy:** Adds a new subregulation 4 to Regulation 9, outlining confidentiality and secrecy obligations. Experts and Young Professionals are now governed by the Indian Official Secrets Act, 1923, and must provide integrity certificates and a self-undertaking regarding criminal records. This change reinforces the importance of data protection and ethical conduct. * **Change 8: Omission of Proviso** Regulation 8, subregulation 9's proviso has been Omitted. **6. Target Audience and Stakeholders:** The primary target audience includes individuals interested in engaging with the Competition Commission of India as experts and young professionals. Stakeholders include: * Economists * Lawyers * Financial Analysts * Chartered Accountants * Cost and Works Accountants * Company Secretaries * The Competition Commission of India (CCI) itself * Recruitment and HR departments within the CCI. **7. Implementation Aspects (Inferred):** * **Responsible agency/bodies:** The Competition Commission of India (CCI) is responsible for implementing these regulations. * **Timelines or procedures:** The Amendment Regulations came into force on the date of their publication in the Official Gazette (April 12, 2022). The CCI will need to update its recruitment and engagement procedures to align with the revised qualifications, experience requirements, remuneration structures, and confidentiality provisions. The Commission will implement the new engagement term during its hiring practices. **8. Expected Outcomes / Impact of Changes:** The expected outcomes of these Amendment Regulations include: * Enhanced expertise within the CCI through more specific qualification requirements. * Formalized engagement of young professionals, potentially bringing fresh perspectives and skills to the CCI. * Improved protection of confidential information due to the added confidentiality and secrecy provisions. * More structured categorization of experts and young professionals based on experience, facilitating better allocation of responsibilities and remuneration. * Greater clarity and flexibility in engagement terms. **9. Conclusion:** The Competition Commission of India Procedure for Engagement of Experts and Professionals Amendment Regulations, 2022, represent a significant update to the framework governing the engagement of experts and professionals by the CCI. These amendments aim to enhance the CCI's expertise, formalize the inclusion of young professionals, strengthen confidentiality measures, and provide greater clarity and flexibility in engagement terms. The changes are likely to have a positive impact on the CCI's ability to effectively address complex competition-related matters.
