और िोधन ऄक्षमता संजिता, 2016 (2016 का 31) की धारा 240 के साथ पठित धारा 196 की ईपधारा (1) के खंड (न)
द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, भारतीय ददवाला और िोधन ऄक्षमता बोड ड (कारपोरेट व्यजियों के जलए ददवाला
समाधान प्रदिया) जवजनयमन, 2016 का और संिोधन करने के जलए जनम्नजलजखत जवजनयम बनाता िै, ऄथाडत:् -
1. (1) आन जवजनयमों का संजक्षप्त नाम भारतीय ददवाला और िोधन ऄक्षमता बोड ड (कारपोरेट व्यजियों के जलए
ददवाला समाधान प्रदिया) (तीसरा संिोधन) जवजनयम, 2021 ि ै।
(2) ये रािपत्र म ेंप्रकािन की तारीख को प्रवृत्त िोंग े ।
2. भारतीय ददवाला और िोधन ऄक्षमता बोड ड (कारपोरेट व्यजियों के जलए ददवाला समाधान प्रदिया) जवजनयमन,
2016 (जिन्ि ें आसम ें आसके पश्चात् मलू जवजनयम किा गया ि)ै के जवजनयम 17 में, ईप-जवजनयम (1) के पश्चात्, जनम्नजलजखत
ईप-जवजनयम ऄंतःस्ट्थाजपत दकया िाएगा, ऄथाडत्:-
“(1क) सजमजत और सजमजत के सदस्ट्य, संजिता और आन जवजनयमों के ऄधीन कारपोरेट ददवाला समाधान प्रदिया
की बाबत कृत्यों का जनवडिन और िजियों का प्रयोग ईन ददिाजनदेिों के ऄनुपालन में करेंग,े िो बोड ड द्वारा िारी
दकए िाएं ।” ।

3. मूल जवजनयमों के जवजनयम 36क में, ईप-जवजनयम (4) के पश्चात्, जनम्नजलजखत ईप-जवजनयम ऄंतःस्ट्थाजपत दकया
िाएगा, ऄथाडत:् -
“(4क) रूजच की ऄजभव्यजि के जलए अमंत्रण में कोइ भी ईपांतरण ईस रीजत में दकया िा सकेगा जिस रीजत म ें
रूजच की ऄजभव्यजि के जलए अरंजभक अमंत्रण दकया गया था:
परन्त ुऐसे ईपांतरण एक से ऄजधक बार निीं दकए िाएंग े ।”।
4. मूल जवजनयमों के जवजनयम 36ख में, ईप-जवजनयम (5) के पश्चात्, जनम्नजलजखत परन्तुक ऄंतःस्ट्थाजपत दकया
िाएगा, ऄथाडत:्-
“परन्तु ऐस ेईपांतरण एक से ऄजधक बार निीं दकए िाएंग े ।”।
5. मूल जवजनयमों के जवजनयम 39 में, ईप-जवजनयम (1क) के स्ट्थान पर जनम्नजलजखत ईप-जवजनयम रख े िाएंग,े
ऄथाडत:् -
“(1क) समाधान व्यावसाजयक, यदद समाधान योिना के ऄनरु ोध में पठरकजल्पत िो,-
(क) ईप-जवजनयम (1) के ऄधीन प्राप्त समाधान योिना म ें ईपांतरण ऄनुज्ञात कर सकेगा दकन्तु ऐसा एक
से ऄजधक बार निीं िोगा; या
(ख) समाधान अवेदकों को ऄपनी योिनाओं में सुधार करने के जलए समथड बनान े िते ु चुनौती प्रणाली का
ईपयोग कर सकेगा ।
(1ख) सजमजत, ऐसी दकसी समाधान योिना पर जवचार निीं करेगी िो-
(क) जवजनयम 36ख के ऄधीन सजमजत द्वारा यथा-जवजनर्ददष्ट समय के पश्चात् प्राप्त िोती ि;ै या
(ख) ऐसे दकसी व्यजि से प्राप्त िोती ि,ै जिसका नाम भावी समाधान अवेदकों की ऄंजतम सचू ी म ें प्रकट
निीं िोता ि;ै या
(ग) धारा 30 की ईपधारा (2) और ईप-जवजनयम (1) के ईपबधं ों का ऄनपु ालन निीं करती ि ै।”।

Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons)
(Third Amendment) Regulations, 2021
No. IBBI/2021-22/GN/REG078.—In exercise of the powers conferred by clause (t) of
sub-section (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of
2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations further to
amend the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate
Persons) Regulations, 2016, namely: -[भाग III—खण् ड 4] भारत का रािपत्र : ऄसाधारण 3
1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Insolvency
Resolution Process for Corporate Persons) (Third Amendment) Regulations, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons)
Regulations, 2016 (hereinafter referred to as the principal regulations), in regulation 17, after sub-
regulation (1), the following sub-regulation shall be inserted, namely:-
“(1A) The committee and members of the committee shall discharge functions and exercise powers under
the Code and these regulations in respect of corporate insolvency resolution process in compliance with the
guidelines as may be issued by the Board.”.
3. In the principal regulations, in regulation 36A, after sub-regulation (4), the following sub-regulation
shall be inserted, namely:-
“(4A) Any modification in the invitation for expression of interest may be made in the manner as the initial
invitation for expression of interest was made:
Provided that such modification shall not be made more than once.”.
4. In the principal regulations, in regulation 36B, after sub-regulation (5), the following proviso shall be
inserted, namely:-
“Provided that such modifications shall not be made more than once.”.
5. In the principal regulations, in regulation 39, for sub-regulation (1A), the following sub-regulations shall
be substituted, namely:-
“(1A) The resolution professional may, if envisaged in the request for resolution plan-
(a) allow modification of the resolution plan received under sub-regulation (1), but not more than
once; or
(b) use a challenge mechanism to enable resolution applicants to improve their plans.
(1B) The committee shall not consider any resolution plan-
(a) received after the time as specified by the committee under regulation 36B; or
(b) received from a person who does not appear in the final list of prospective resolution applicants; or
(c) does not comply with the provisions of sub-section (2) of section 30 and sub-regulation (1).”.
