In exercise of the powers conferred by clauses (b) and (c) of sub section (1) of section 7 of the Customs Act, 1962 (52 of 1962), the Central Board of Indirect Taxes and Customs
Okay, here's the policy analysis report based solely on the provided government policy text:
**POLICY ANALYSIS REPORT**
**1. Executive Summary:**
This report analyzes Notification No. 362025/Customs N.T./S.O. 2312(E), dated May 23, 2025, which amends a previous customs notification (No. 631994/Customs N.T.). The amendment facilitates the use of the railway line connecting Raxaul in India and Birganj in Nepal for traffic-in-transit, aligning with the Treaty of Transit between India and Nepal dated June 1, 2023. The key finding is the expansion of approved transit routes via Raxaul to include the railway, likely to improve trade efficiency between the two countries.
**2. Introduction:**
This report provides an overview and analysis of Notification No. 362025/Customs N.T./S.O. 2312(E), a customs notification published by the Ministry of Finance, Department of Revenue, on May 23, 2025. The analysis is based exclusively on the provided text of the notification.
**3. Policy Overview:**
* **Amendment:** This notification is an amendment to the Government of India, Ministry of Finance, Department of Revenue, Notification No. 631994/Customs N.T., dated November 21, 1994.
* **Core Objective(s):** The objective of the *amendment*, as inferred from the text, is to modify existing regulations pertaining to customs procedures at the Raxaul land frontier with Nepal to facilitate rail-based traffic-in-transit between India and Nepal. This appears to be in accordance with the Treaty of Transit between India and Nepal.
**4. Background and Rationale:**
* **Amendment Rationale:** The amendment likely addresses the need to formally recognize and approve the Raxaul-Birganj railway line as a legitimate route for traffic-in-transit. The original notification likely only specified road-based transit. This amendment is likely required to operationalize the Treaty of Transit between India and Nepal dated June 1, 2023 with respect to rail transport. The rail link likely offers a more efficient transport option compared to roadways.
**5. Key Provisions / Changes:**
* **Specific Part of Original Policy Changed:** The amendment modifies the "Table" within the original Notification No. 631994/Customs N.T. concerning the "land frontier of Nepal," specifically "Raxaul."
* **New Rule/Provision:** The amendment adds a new entry "d" to column 4 of the table, which specifies the following: "Railway line connecting Raxaul in India and Birganj in Nepal."
* **Effect of the Change:** This change expands the allowed transit routes at Raxaul to explicitly include the railway line. Goods can now be transported via rail between Raxaul and Birganj under the traffic-in-transit agreement.
**6. Target Audience and Stakeholders:**
Based on the text, the primary target audience and stakeholders are:
* Businesses and entities involved in trade and transit of goods between India and Nepal.
* Customs officials and authorities responsible for implementing and enforcing customs regulations at the Raxaul border.
* Railway operators involved in the Raxaul-Birganj route.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Central Board of Indirect Taxes and Customs (CBIC) is the responsible body, as it issued the notification. Local customs officials at Raxaul will be directly involved in implementation.
* **Timelines/Procedures:** The notification is effective from the date of its issuance (May 23, 2025). The transit procedures will be governed by the Treaty of Transit between India and Nepal dated June 1, 2023, though the specific details of those procedures are not included in this document.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of this amendment are:
* **Increased efficiency of trade:** Rail transport is generally more efficient for bulk cargo than road transport, so this change likely facilitates greater trade volume.
* **Reduced transportation costs:** Depending on factors such as fuel prices, transport by rail can be more economical.
* **Improved trade relations:** By facilitating trade and adhering to the Treaty of Transit, this amendment should improve trade relations between India and Nepal.
* **Reduced border congestion:** By diverting some traffic from roads to rail, the amendment could help alleviate congestion at the Raxaul border crossing.
**9. Conclusion:**
Notification No. 362025/Customs N.T./S.O. 2312(E) is a targeted amendment that expands transit options at the Raxaul border crossing to include the railway line connecting Raxaul and Birganj. This amendment is likely intended to improve trade efficiency and facilitate traffic-in-transit between India and Nepal, aligning with the existing Treaty of Transit. This is a significant step in improving the cross-border transportation infrastructure.
