जिश्वजिद्यालय अनुदान आयोग अजधजनयम, 1956 (1956 का 3) की धारा 26 के खंडों (f) और (g) तथा धारा 12A की उपधाराओं (2) और (4) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, जिश्वजिद्यालय अनुदान आयोग एतद्द्वारा जिश्वजिद्यालय अनुदान आयोग (समजिश् िजिद्यालय संस्ट्थान) जिजनयम, 2023 में जनम्नजलजखत संिोधन करता है, अथाात्: -
1. सजं िप्त िीर्का और प्रारंभ –(1) इन जिजनयमों का नाम जिश्वजिद्यालय अनुदान आयोग (समजिश् िजिद्यालय संस्ट्थान) संिोधन जिजनयम, 2026 कहा िा सकेगा। (UIN:2/2026) ।
(2) य ेरािपत्र में उनके प्रकािन की जतजथ से प्रिृत्त होंगे।
2. जिश्वजिद्यालय अनुदान आयोग (समजिश् िजिद्यालय संस्ट्थान) जिजनयम, 2023 (जिसे आगे मलू जिजनयम कहा गया ह)ै के जिजनयम 1 की उपजिजनयम (3) म,ें परंतुक (Proviso) के पश्चात्, जनम्नजलजखत परंतुक (Proviso) अतं :स्ट्थाजपत दकया िाएगा, अथाात्: - 2843 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु यह भी प्रािधान दकया िाता ह ै दक केन्द्रीय सरकार दकसी परोपकारी संगठन द्वारा प्रायोजित तथा सरकार द्वारा पयााप्त रूप से जित्तपोजर्त समजिश् िजिद्यालय संस्ट्थान (डीम्ड टु बी यूजनिर्साटी) को केन्द्रीय सरकार द्वारा जिजनर्दाष्ट अिजध के जलए अपने संस्ट्थापन प्रलेख (मेमोरेंडम ऑफ एसोजसएिन) को िारी रखने की अनुमजत द े सकती ह,ै बित े दक संस्ट्थान यह प्रदर्िता करे दक िह अपन े जिजधित लेखापरीजित लेखा-बही के माध्यम से अपनी आय का न्द्यूनतम पचास प्रजतित स्ट्िय ं अर्िात करन े म ें सिम ह;ै अथाात ् संस्ट्थान की कुल प्राजप्तयां तथा कुल व्यय, सरकार द्वारा ददए गए अनुदानों के दोगनु े स े अजधक हों तथा संबंजधत सरकार द्वारा जनधााररत अन्द्य कुछ मानदंडों की पूर्ता भी करे, और यह सभी ित ें उस अिजध की समाजप्त से पूिा पणू ा की िाएं, जिसके जलए अनुमजत प्रदान की गई ह:ै परंत ु यह भी प्रािधान दकया िाता ह ै दक केंरीय सरकार, दकसी संिैधाजनक प्राजधकरण या केंर सरकार अथिा राज्य सरकार द्वारा प्रायोजित समजिश्वजिद्यालय संस्ट्थान (डीम्ड टू बी जिश्वजिद्यालय संस्ट्थान) को, केंरीय सरकार द्वारा जनर्दाष्ट अिजध तक, अपने संस्ट्थापन प्रलेख (मेमोरेंडम ऑफ एसोजसएिन) को िारी रखने की अनुमजत दे सकती ह।ै
3. मूल जिजनयम के जिजनयम 4 म,ें-
(i) उपजिजनयम (1) के खडं (b) के उपखंड (i) म,ें "तीन क्रजमक चक्रों के जलए" िब्दों के स्ट्थान पर "या समतुल्य राष्ट्रीय मूल्यांकन एिं प्रत्यायन पररर्द (नेक) ग्रेड, तीन चक्रों के जलए, जिसमें निीनतम चक्र भी सजम्मजलत ह"ै िब्द प्रजतस्ट्थाजपत दकए िाएंगे;
(ii) उपजिजनयम (2) के स्ट्थान पर जनम्नजलजखत उपजिजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “(2) अजधजनयम की धारा 2 के खंड (f) के अंतगात स्ट्थाजपत जिश्वजिद्यालय अथिा दकसी जिश्वजिद्यालय की संघटक इकाई भी समजिजश् िद्यालय संस्ट् थान (डीम्ड टू बी जिश्वजिद्यालय सस्ट्ं थान) बनने या दकसी अन्द्य समजिश्ि जिद्यालय संस्ट् थान (डीम्ड टू बी जिश्वजिद्यालय संस्ट्थान) के ऑफ- कैम्पस के रूप में बनन े के जलए आिेदन कर सकती है, और मौिूदा जिश्वजिद्यालय अथिा जिश्वजिद्यालय की संघटक इकाई को राज्य सरकार के उपयुि प्राजधकरण से अनापजत्त प्रमाणपत्र प्रस्ट्तुत करना होगा दक यदद उन्द्ह ें समजिश् िजिद्यालय संस्ट् थान (डीम्ड टू बी जिश्वजिद्यालय संस्ट्थान) का दिाा प्रदान दकए िाने या दकसी अन्द्य मौिूदा समजिश् िजिद्यालय संस्ट् थान (डीम्ड टू बी जिश्वजिद्यालय संस्ट्थान) के ऑफ-कैम्पस के रूप म ें पात्र पाया िाता है, तो राज्य सरकार उन्द्ह ें अजधसूचना द्वारा जनरस्ट्त (डी-नोरटफाई) कर दगे ी, और संबंजधत संस्ट्थान को केिल संबंजधत राज्य सरकार द्वारा जिजधित जनरस्ट्तीकरण (डी-नोरटदफकेिन) के पश्चात ही छात्रों को प्रिेि देने या ऑफ- कैम्पस अथिा नए समजिश् िजिद्यालय संस्ट् थान (डीम्ड टू बी जिश्वजिद्यालय संस्ट्थान) के रूप में काय ा करने की अनुमजत दी िाएगी।”
4. मूल जिजनयम के जिजनयम 6 की उपजिजनयम (5) म,ें "अजधजनयम की धारा 3 के अधीन दकसी उच्च जििा सस्ट्ं थान को रािपत्र में अजधसूचना द्वारा समजिश्वजिद्यालय संस्ट् थान (इंस्ट्टीट्यूिन डीम्ड टु बी यूजनिर्साटी) घोजर्त करेगा" िब्दों के स्ट्थान पर "अनुमोदन या तो तीन िर् ा की अिजध के जलए िैध आिय पत्र (लेटर ऑफ इंटेंट) िारी करेगा अथिा प्रस्ट्ताि को उसके कारण बताते हुए अस्ट्िीकार कर देगा" िब्द प्रजतस्ट्थाजपत दकए िाएगं े।
5. मूल जिजनयम के जिजनयम 23 म,ें - (क) िीर्ाक 'क. कुलाजधपजत' के अंतगता ,-
1) खंड (1) के परंतुक म,ें “केंर या राज्य सरकार अथिा उसके अजभकरणों, संबंजधत सरकार द्वारा जनयुि दकए िाएंगे” िब्दों के स्ट्थान पर “संिैधाजनक प्राजधकरण या केंर सरकार या राज्य सरकार अथिा उसके अजभकरणों, संबंजधत संिैधाजनक प्राजधकरण या केंर सरकार या राज्य सरकार द्वारा जनयिु दकए िाएंगे” िब्द प्रजतस्ट्थाजपत दकए िाएंगे;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3
2) खंड (3) म,ें - (ए) 'सरकार' िब्दों के स्ट्थान पर 'संिैधाजनक प्राजधकरण या सरकार' िब्द प्रजतस्ट्थाजपत दकए िाएंगे; (बी) 'उपयिु सरकार' िब्दों के स्ट्थान पर 'संिैधाजनक प्राजधकरण या उपयुि सरकार' िब्द प्रजतस्ट्थाजपत दकए िाएंग;े (ख) िीर्ाक 'ख. कुलपजत' के अधीन, खडं (3) में, उपखंड (a) के स्ट्थान पर जनम्नजलजखत उपखडं प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् — "(क) संिैधाजनक प्राजधकरण या केन्द्रीय सरकार या राज्य सरकार या उसके अजभकरणों द्वारा प्रबंजधत या जनयंजत्रत अथिा केन्द्रीय सरकार या राज्य सरकार या उसके अजभकरणों स े अपनी िार्र्ाक प्राजप्तयों का पचास प्रजतित या उससे अजधक अनदु ान प्राप्त करने िाले समजिश्वजिद्यालय संस्ट् थान (इंस्ट्टीट्यूिन डीम्ड टु बी यूजनिर्साटी) में, जिश्वजिद्यालय अनुदान आयोग (जिश्वजिद्यालयों एिं महाजिद्यालयों म ें जििकों एिं अन्द्य अकादजमक कमाचाररयों की जनयुजि के जलए न्द्यनू तम योग् यता तथा उच्च जििा में मानकों के अनुरिण के जलए अन्द्य उपाय) जिजनयम, 2018, यथा समय-समय पर संिोजधत, का अनुसरण करत े हुए, खोि-सह-चयन सजमजत (सचा-कम-सेलेक्िन कमटे ी) का गठन संिैधाजनक प्राजधकरण या केन्द्रीय सरकार या राज्य सरकार या उसके अजभकरणों द्वारा दकया िाएगा:
बिते दक िहााँ सरकार न े दकसी परोपकारी संगठन द्वारा प्रायोजित समजिश्वजिद्यालय संस्ट् थान (इंस्ट्टीट्यिू न डीम्ड टु बी यूजनिर्साटी) को उसके जिद्यमान संस्ट्थापन प्रलेख (मेमोरेंडम ऑफ एसोजसएिन) को िारी रखने की अनुमजत द े दी ह,ै िहााँ कुलपजत की जनयुजि के जलए खोि-सह-चयन सजमजत नीच े (b) म ें जिजनर्दाष्ट अनुसार होगी।"
6. मूल जिजनयम के जिजनयम 24 म,ें िीर्ाक 'ख. िल्ु क संरचना' के अधीन, खंड (2) म,ें “'राष्ट्रीय जचदकत्सा पररर्द” िब्दों के स्ट्थान पर “राष्ट्रीय जचदकत्सा आयोग” िब्द प्रजतस्ट्थाजपत दकए िाएंगे।
9. जिजनयम 32 की उपजिजनयम (3) म,ें खंडों (d) से (n) तक को क्रमिः उपजिजनयमों (4) से (14) के रूप म ें पुनःसंखयांदकत दकया िाएगा। प्रो. मजनर् आर. िोिी, सजचि [जिज्ञापन-III/4/असा./55/2026-27] UNIVERSITY GRANTS COMMISSION
NOTIFICATION New Delhi, 21st April, 2026 University Grants Commission [Institutions Deemed to be Universities] Amendment Regulations, 2026 (UIN:2/2026) F. No. 1-1/2021(CPP-I/DU) .—PREAMBLE:.
In exercise of the powers conferred by clauses (f) and (g) of section 26 and sub-sections (2) and (4) of section 12A of the University Grants Commission Act, 1956 (3 of 1956), the University Grants Commission hereby makes the following amendments in the University Grants Commission (Institutions Deemed to be Universities) Regulations, 2023, namely: -
1. Short title and commencement - (1) These regulations may be called the University Grants Commission (Institutions Deemed to be Universities) Amendment Regulations, 2026 (UIN:2/2026).
(2) They shall come into force on the date of their publication in the Official Gazette.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
2. In the University Grants Commission (Institutions Deemed to be Universities) Regulations, 2023 (hereinafter referred to as the principal regulations), in regulation 1, in sub-regulation 3, after the proviso, the following proviso shall be inserted, namely:˗ ̶ “Provided further that the Central Government may permit an institution deemed to be University sponsored by a philanthropic organisation and substantially funded by Government to continue with its existing Memorandum of Association for such period of time as may be specified by the Central Government subject to the criteria that the institute shall demonstrate, through its duly audited books of accounts that it is able to generate a minimum of fifty per cent. of its revenue on their own, that is, total receipts as well as total expenses of the institute is more than twice the government grants given to them and fulfilment of certain other criteria laid down by the respective Government and this shall be achieved on or before the end of
the period for which the permission is given:
Provided also that the Central Government may permit an institution deemed to be University sponsored by a constitutional authority or Central Government or State Government to continue with its existing Memorandum of Association for such period of time as may be specified by the Central Government.”.
3. In regulation 4 of the principal regulations,˗ ̶
(i) in sub-regulation (1), in clause (b), in sub-clause (i), for the words “for three consecutive cycles”, the words “or equivalent National Assessment and Accreditation Council grade, for three cycles, including the latest cycle” shall be substituted;
(ii) for sub-regulation (2), the following sub-regulation shall be substituted, namely:- “(2) Universities established under clause (f) of section 2 of the Act or a constituent unit of a University may also apply to become an institution deemed to be University or an off-campus of another institution deemed to be University and the existing University or constituent unit of a University shall submit a no objection certificate from appropriate authority in the State Government, that the State Government shall de- notify them if they are found eligible to be granted the status of institution deemed to be University or as an off- campus of any other existing institution deemed to be University and the institution shall be permitted to admit students or work as an off-campus or a new institution deemed to be University only after formal de-
notification by the concerned State Government.”.
4. In regulation 6 of the principal regulations, in sub-regulation (5), for the words “declare an institution of higher education as an institution deemed to be University under section 3 of the Act, by notification in the Official Gazette”, the words “either issue approval or Letter of Intent valid for a period of three years or reject the proposal stating reasons thereto” shall be substituted.
5. In regulation 23 of the principal regulations,—
(a) under the heading A. Chancellor,—
(i) in clause (1), in the proviso, for the words “the Central or State Government or its Agencies, shall be appointed by the respective Government”, the words “constitutional authority or Central Government or State Government or its Agencies, shall be appointed by the respective constitutional authority or Central Government or State Government” shall be substituted;
(ii) in clause (3),—
(A) for the words “Government” the words “constitutional authority or Government” shall be substituted;
(B) for the words “appropriate Government”, the words “constitutional authority or appropriate Government” shall be substituted;
(b) under the heading B. Vice-Chancellor, in clause (3), for sub-clause (a), the following sub-clause shall be substituted, namely:— “ (a) in the institution deemed to be University managed or controlled by constitutional authority or Central Government or State Government or its Agencies, or receiving funds more than or equal to fifty per cent. of their annual receipt from the Central Government or State Government or its Agencies, as the case may be, the Search-cum-Selection-Committee shall be formed by constitutional authority or Central Government or State Government or its Agencies, following the University Grants Commission (Minimum Qualifications for Appointment of Teachers and Other Academic Staff in Universities and Colleges and other Measures for the Maintenance of Standards in Higher Education) Regulations, 2018, as amended from time to time:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5
Provided that where the Government has permitted an institution deemed to be University sponsored by a philanthropic organisation to continue with its existing memorandum of association, the Search-cum- Selection-Committee for appointment of Vice Chancellor shall be as specified in (b) below.”.
6. In regulation 24 of the principal regulations, under the heading B. Fee structure, in clause (2), for the words “National Medical Council”, the words “National Medical Commission” shall be substituted.
9. In regulation 32, in sub-regulation (3), clauses (d) to (n) shall be renumbered as sub-regulations (4) to (14) respectively.
