ii. सेवाजनवृजत्त या सेवामुि होने पर उस राज्य जचदकत्सा पररषि में पंिीकरण कराएंग े या वहां स्ट्र्ानांतररत कराएगं े िहां व े प्रैजटिस करना चाहत ेह;ैं iii. जवजनयम 7 में खडं (iv) के बाि, जवजनयम 7 के खडं (iv) के जलए एक प्रावधान इस प्रकार िोडा िाएगा: बिते दक सिस्त्र बल जचदकत्सा सेवा (एएफएमएस) में कमीिन प्राप्त मेजडकल प्रैजटििनसि अपनी सेवा अवजध के िौरान अपनी दकसी भी अजतररि जचदकत्सा योग्यता को उस राज्य जचदकत्सा पररषि म ें पंिीकृत कराएगं े, जिसके सार् वे पंिीकृत ह ैं और ऐसी प्रजवजि एएफएमएस म ें उनकी सवे ा की अवजध के जलए सभी राज्यों और केंद्र िाजसत प्रिेिों में मान्य रहगे ी। iv. जवजनयम 8 में खडं (iii) के बाि, जवजनयम 8 के जलए एक प्रावधान इस प्रकार िोडा िाएगा: बिते यह भी दक खडं (i) में दकसी बात के होते हुए भी सिस्त्र बल जचदकत्सा सेवा (एएफएमएस) में सेवारत मेजडकल प्रैजटििनसि का लाइसेंस केवल जनधािररत समय के भीतर नवीकरण आवेिन प्रस्ट्ततु न करन े के कारण जनजरिय नहीं दकया िाएगा और एएफएमएस संबंजधत राज्य जचदकत्सा पररषि को, िहां भी लागू हो, नवीकरण आवेिनों के सार् कमीिन प्राप्त मेजडकल प्रैजटििनस ि का जववरण वार्षिक आधार पर प्रस्ट्तुत करेगा और राष्ट्रीय आयुर्विज्ञान आयोग को ररकॉडि उपलब्ध कराएगा। v. जवजनयम 9 में खडं (v) के बाि खंड (vi) इस प्रकार िोडा िाएगा: सिस्त्र बल जचदकत्सा सेवाओं में सेवारत मेजडकल प्रैजटििनस ि पर सेवा की अवजध के िौरान प्रैजटिस के जलए लाइसेंस के हस्ट्तांतरण से संबंजधत प्रावधान लागू नहीं होंग,े और ऐस े प्रैजटििनसि को उनकी सेवा िाजयत्वों के आधार पर सभी राज्यों और केंद्र िाजसत प्रिेिों म ें प्रैजटिस करने के जलए अजधकृत माना िाएगा। vi. जवजनयम 10 के बाि, नया जवजनयम 10क इस प्रकार िोडा िाएगा: 10क. सिस्त्र बल जचदकत्सा सेवाओं (एएफएमएस) में सेवारत मेजडकल प्रैजटििनसि द्वारा कजर्त पिे ेवर किाचार के मामल े में अजधकार-क्षत्रे - (1) इन जवजनयमों म ें दकसी बात के होते हुए भी, िहां सिस्त्र बल जचदकत्सा सेवाओं में सेवारत दकसी मेजडकल प्रैजटििनसि के जवरुद्ध पेिेवर किाचार या जचदकत्सीय लापरवाही का आरोप लगाया िाता है, वहा ँ जिस राज्य जचदकत्सा पररषि म ें वह प्रैजटििनर पंिीकृत ह,ै उसे उसराज्य जचदकत्सा पररषि की जसफाररि पर जिसके क्षेत्राजधकार में कारिवाई का कारण उत्पन्न हुआ है, मामल े का जनणयि करन े का अजधकार होगा। (2) िहां ऐसा कजर्त किाचार का मामला पंिीकरण वाल े राज्य के अजतररि दकसी अन्य राज्य में होता ह,ै वहां घिना-स्ट्र्लके राज्य जचदकत्सा पररषि जिकायत प्राप्त कर सकती है, मामल े की िांच कर सकती ह ै और उजचत कारिवाई के जलए पंिीकरण की राज्य जचदकत्सा पररषि को उपलब्ध ररकॉड ि के सार् िडं पर अपनी जसफाररि के सार् ररपोिि भेि सकती ह ै और पंिीकरण वाली राज्य जचदकत्सा पररषि द्वारा उस पर की गई कारिवाई की सूचना घिना-स्ट्र्ल के राज्य जचदकत्सा पररषि तर्ा नैजतकता और जचदकत्सा पंिीकरण बोड िको िगे ी।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (3) इस जवजनयम में जनजहत कोई भी लागू प्रावधान सिस्त्र बल सेवा जनयमोंके अंतगित अनुिासनात्मक या प्रिासजनक कारिवाई को बाजधत नहीं करेगा। डॉ. राघव लगं र, सजचव [जवज्ञापन-III/4/असा./15/2026-27] नोि: मुख्य जवजनयम भारत के रािपत्र, असाधारण, भाग–III खडं 4, दिनांक 12 मई, 2023 एनएमसी अजधसूचना स.ं आर.15021/04/2022-ईएमआरबी-पंिी. में प्रकाजित दकया गया र्ा। राष्ट्रीय आयुर्विज्ञान आयोग “मजे डकल प्रैजटििनसि का पंिीकरण और जचदकत्सा की प्रैजटिस करने के जलए लाइसेंस जवजनयम, 2023" में कुछ संिोधन प्रस्ट्ताजवत करता ह।ै जवजनयम 2, 6, 7, 8, 9 में संिोधन तर्ा 10क का समावेिन करने हते ु मसौिा जवजनयम तयै ार दकया गया ह ै और उजचत प्रदिया का पालन करत े हुए सक्षम प्राजधकारी द्वारा अनुमोदित दकया गया ह ै और इसे उन सभी जहतधारकों की िानकारी के जलए प्रकाजित दकया िा रहा है, जिन पर इसका प्रभाव पड सकता ह,ै तर्ा यह सूचना िी िाती ह ै दक उि मसौिा जवजनयम (संिोधन)पर जवचार, भारत के रािपत्र में इसके प्रकािन की प्रजत सावििजनक रूप से उपलब्ध कराए िाने की जतजर् से तीस (30) दिनों की अवजध समाप्त होने के पश्चात दकया िाएगा। उपयुिि जनर्ििि अवजध के भीतर दकसी भी व्यजि स े प्राप्त आपजत्तयों और सुझावों पर राष्ट्रीय आयुर्विज्ञान आयोग द्वारा जवचार दकया िाएगा। आपजत्तयां और सुझाव यदि कोई हों, तो उन्ह ें उप-सजचव (पिं ीकरण ईएमआरबी),एनएमसी, कमरा नंबर. 003, गस्ट्े ि हाउस, ग्राउंड फ्लोर, राष्ट्रीय आयुर्विज्ञान आयोग, पॉकेि-14, सटे िर-8, द्वारका, फेि-1, नई दिल्ली-77 के पत े पर प्रेजषत दकए िा सकत े ह ैं तर्ा नीच े संलग्न जनधािररत प्रारूप में ईमले (regn_regulations_amend_2026@nmc.org.in) द्वारा भेिे िा सकत े ह:ै आपजत्तयां और सुझाव केवल उपरोि ई-मले आईडी पर ही भिे े िाएं तर्ा दकसी अन्य माध्यम, िैस े भौजतकरूप से या अन्य दकसी तरीके से प्राप्त आपजत्तयों / सुझावों पर जवचार नहीं दकया िाएगा। अजधसूचना का मसौिा राष्ट्रीय आयुर्विज्ञान आयोग की वेबसाइिhttps://www.nmc.org.in पर उपलब्ध होगी। सझु ाव/रिप्पजणया ँ प्राप्त करन े का प्रारूप ि. स. ं व्यजि/सगं ठन का नाम अजधसचू ना के मसौि े का वह रिप्पजणया/ंसझु ाव तकि रिप्पजणया ं एव ं पता, सपं कि नबं र, सम्बद्ध भाग, जिस पर ई-मले आईडी रिप्पजणया ंकी िा रही ह ै NATIONAL MEDICAL COMMISSION NOTIFICATION New Delhi, the 7th April, 2026 “Registration of Medical Practitioners and Licence to Practice Medicine (Amendment), Regulations 2026” No. R.11012/04/2025-Regn/NMC.—In exercise of the powers conferred by clauses (zj), (zk) and (zl) of sub section (2) of section 57; of the National Medical Commission Act (30 of 2019), the National4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Medical Commission hereby makes the following draft Regulations to amend the “Registration of Medical Practitioners and Licence to Practice Medicine Regulations, 2023” namely- 1. (i)These Regulations may be called the “Registration of Medical Practitioners and Licence to Practice Medicine(Amendment), Regulations2026”. (ii)They shall come into force from the date of their publication in the Official Gazette. 2. In Registration of Medical Practitioners and Licence to Practice Medicine Regulations, 2023 i. In Regulation 2 after clause (a), a new clause (aa) shall be inserted as: “Armed Forces Medical Services (AFMS)”shall mean the integrated medical services of the Indian Armed Forces functioning under the Ministry of Defence, Government of India, and responsible for providing medical care to serving armed forces personnel, veterans, their dependents and others as per mandate”. ii. In Regulation 6 after clause (e), a proviso to regulation 6 shall be inserted as: Provided that Medical practitioners commissioned or joined in the Armed Forces Medical Services (AFMS)- i. shall opt to be registered and licensed with one State Medical Council of their choice at the time of joining AFMS till the duration of service and authorized to practice in any State or Union Territory in Indiaby virtue of service obligations; ii. shall, upon retirement or release from service, register withor transfer to theStateMedical Council where they intend to practice; iii. In Regulation 7 after clause (iv), a proviso to regulation 7 clause (iv) shall be inserted as: Provided that medical practitioners commissioned in the Armed Forces Medical Services (AFMS) shall register any additional medical qualification with the State Medical Council with which they are registered during the period of service, and such entry shall remain valid across all States and Union Territories for the duration of their service in AFMS. iv. In Regulation 8 after clause (iii), a proviso to regulation 8 shall be inserted as: Provided further that, notwithstanding anything contained in clause (i), the licence of the medical practitioners serving in the Armed Forces Medical Services (AFMS), shall not be rendered inactive solely on account of non-submission of the renewal application within the prescribed time and the AFMS shall furnish the details of commissioned medical practitioners along with renewal applications, wherever applicable, to the concerned State Medical Council on annual basis and provide the record to National Medical Commission. v. In Regulation 9 after clause (v), clause (vi) shall be inserted as: The provisions relating to transfer of licence to practice shall not apply to medical practitioners serving in the Armed Forces Medical Services during the period of their service, and such practitioners shall be deemed to be authorized to practice across all States and Union Territories by virtue of their service obligations. vi. After Regulation 10,new regulation 10A shall be inserted as: 10A. Jurisdiction in case of alleged professional misconduct by medical practitioners serving in Armed Forces Medical Services (AFMS)— (1) Notwithstanding anything contained in these Regulations, where an allegation of professional misconduct or medical negligence is made against a medical practitioner serving in the Armed Forces Medical Services, the State Medical Council with which the practitioner is registered shall have the jurisdiction to decide the matter upon the[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 recommendation of the State Medical Council within whose territorial jurisdiction the cause of action arose. (2) Where such alleged misconduct occurs in a State other than the State of registration, the State Medical Council of the place of occurrence may receive the complaint, inquire the matter and shall forward the report with its recommendation on the punishment, along with available records, to the State Medical Council of registration for appropriate action and the action taken thereon by the State Medical Council of registration shall be communicated by them to the State Medical Council of the place of occurrence and to the Ethics and Medical Registration Board. (3) Nothing in this regulation shall preclude disciplinary or administrative action under applicable Armed Forces service laws. Dr. RAGHAV LANGER, Secy.
