30) की धारा 10, 24, 25 और 57 के साथ पठित सामान्य खंड अजधजनयम, 1897 (1897 का 10) की धारा 21 द्वारा प्रित्त िजियों का प्रयोग करत े हुए, राष्ट्रीय आयुर्विज्ञान आयोग एतद्द्वारा जचदकत्सा जिक्षा जवजनयम, 2023 के मानकों के रखरखाव (एमएसएमईआर-2023), जिसे अजधसूचना संख्या एफ. सं. एन-पी016/1/2023-पीिीएमईबी-एनएमसी दिनांक 19 जसतंबर, 2023 के माध्यम से अजधसूजचत दकया गया था और भारत के रािपत्र, असाधारण, भाग III, खंड 4, संख्या 652, दिनांक 21 जसतंबर, 2023 म ेंप्रकाजित हुआ था, को तत्काल प्रभाव से हटाया िाता ह।ै

2. इस अजधसूचना के हटाए िान े के बाविूि, वार्षिक प्रकटीकरण ठरपोटि (एडीआर) प्रस्ट्तुत करन े की आवश्यकता राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 की धारा 24(झ) और 25(ि) तथा समय-समय पर लागू जवजनयमों के अनुसार प्रभावी बनी रहगे ी। 7969 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

3. संक्रमणकालीन और व्यावृजत्त उपबंध: जचदकत्सा जिक्षा जवजनयम, 2023 के मानकों के रखरखाव के अजधसूचना स े हटाए िाने के बाविूि, जनम्नजलजखत पर कोई प्रभाव नहीं पडगे ा: (क) उि जवजनयमों के अजधसूचना से हटाए िाने की तारीख से पूवि, उनके अधीन जवजधवत की गई अथवा की गई मानी िाने वाली कोई भी कारिवाई;

(ख) उि जवजनयमों के अजधसूचना स े हटाए िान े की तारीख स े पूवि, उन जवजनयमों के तहत जवजधवत रूप से प्रिान दकया गया कोई भी अनुमोिन, नवीनीकरण, आििे , जनणिय या जनिेि; (ग) उि जवजनयमों के अजधसूचना से हटाए िाने की तारीख से पूवि, अर्िित, उपार्िित अथवा अजधरोजपत कोई भी अजधकार, जविेषाजधकार, िाजयत्व या िवाबिेही;

घ) उनकी अजधसूचना से हटाए िान े की तारीख से िीक पूवि लंजबत कोई भी आवेिन, कायिवाही, अपील, िांच या अन्य मामला, िहा ाँ तक लाग ू हों, उि जवजनयमों के प्रावधानों के अनुसार और इस अजधसूचना के प्रावधानों के अधीन िारी रखा िाएगा और उसका जनपटारा दकया िाएगा;

बित े दक अजधसूचना स े हटाए िाने की तारीख को या उसके बाि उत्पन्न होन े वाल े दकसी भी मामले पर राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 और उस समय प्रवृत्त वधै ाजनक और जवजनयामक प्रावधानों द्वारा लागू होगा।

NOTIFICATION New Delhi, the 14th October, 2026 MAINTENANCE OF STANDARDS OF MEDICAL EDUCATION REGULATIONS, 2023 - DE-NOTIFICATION F. No. Legal/NMC/Misc/2026/22.— In exercise of the powers conferred by section 10, 24, 25 and 57 of the National Medical Commission Act, 2019 (30 of 2019), read with section 21 of the General Clauses Act, 1897 (10 of

1897), the National Medical Commission hereby de-notifies the Maintenance of Standards of Medical Education Regulations, 2023 (MSMER-2023) which was notified vide Notification No. F. No. N-P016/1/2023-PGMEB-NMC dated 19th September, 2023 and published in the Gazette of India, Extraordinary, Part III, Section 4, No. 652, dated 21st September, 2023, with immediate effect.

2. Notwithstanding such de-notification, the requirement of furnishing the Annual Disclosure Report (ADR) shall continue to operate in accordance with Section 24(i) and 25(h) of the National Medical Commission Act, 2019 and the regulations applicable from time to time.

3. Transitional and Saving clause: Notwithstanding the de-notification of the Maintenance of Standards of Medical Education Regulations, 2023 shall not affect-

(a) any action duly taken or purported to have been taken under the said Regulations before the date of their de-notification;

(b) any approval, renewal, order, decision or direction duly granted, issued or made under the said Regulations before the date of their de-notification;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

(c) any right, privilege, obligation or liability acquired, accrued or incurred under the said Regulations before the date of their de-notification;

(d) any application, proceeding, appeal, inquiry or other matter pending immediately before the date of their de-notification, which shall be continued and disposed of in accordance with the provisions of the said Regulations, insofar as applicable, and subject to the provisions of this Notification:

Provided that any matter arising on or after the date of de-notification shall be governed by the provisions of the National Medical Commission Act, 2019 and the statutory and regulatory provisions in force at the relevant time.

4. This Notification shall come into force on the date of its publication in the Official Gazette.
