## Policy Analysis Report: National Highways Authority of India - Entrustment and Functions **1. Executive Summary:** This report analyzes two notifications issued by the Ministry of Road Transport and Highways on March 26, 2021. The first notification entrusts specific sections of National Highways to the National Highways Authority of India (NHAI). The second notification amends a previous notification (S.O. 1096E, dated August 4, 2005) regarding the exercise of functions related to the execution of works on National Highways by State Governments. The key finding is that the amendment redistributes responsibilities for highway works between the Central Government and the State Governments of Madhya Pradesh and Uttar Pradesh for specific sections of various National Highways, modifying prior arrangements. **2. Introduction:** This report aims to provide a clear and concise overview of two notifications pertaining to National Highways in India, based solely on the provided text. The analysis focuses on the entrustment of highways to NHAI and the amendment to the delegation of execution responsibilities to State Governments. This information is intended for those within the affected industry and other interested stakeholders. **3. Policy Overview:** * **Policy 1 (Entrustment):** The core objective of the first policy (S.O. 1385E) is to formally assign responsibility for the management and development of specific sections of National Highways to the National Highways Authority of India (NHAI). * **Policy 2 (Amendment):** The core objective of the second policy (S.O. 1386E) is to modify the existing distribution of responsibilities between the Central Government and certain State Governments (Madhya Pradesh and Uttar Pradesh) concerning the execution of works on sections of specified National Highways. * The original policy being amended is notification number S.O 1096E, dated the 4th August, 2005. **4. Background and Rationale:** * **Policy 1 (Entrustment):** The policy likely addresses the need for a designated authority to manage and develop specific National Highway sections effectively. This could stem from a desire to improve highway infrastructure, facilitate transportation, or streamline project execution. * **Policy 2 (Amendment):** The amendment appears designed to address a need for revising the allocation of responsibilities between the Central Government and the State Governments of Madhya Pradesh and Uttar Pradesh for the execution of works on designated National Highway sections. The precise rationale for this adjustment is not explicitly stated, but it could be due to factors such as changes in administrative capacity, project priorities, or funding arrangements. **5. Key Provisions / Changes:** This section focuses on the changes introduced by the amendment (S.O. 1386E). * **Specific Part Changed:** The amendment directly modifies the "Schedule" of the original notification (S.O. 1096E) by substituting the entries for serial numbers 13 and 24. * **New Rule/Provision:** The amendment stipulates that the functions related to the execution of works pertaining to the National Highways described in column 2 of the table shall be exercisable by the State Government specified in column 3 of the Table against each highway. The affected highways and their sections are listed in detail, specifying chainage (kilometer points) for each. **A summary is below** **For Madhya Pradesh (Serial No. 13):** The State Government of Madhya Pradesh is assigned responsibility for the execution of works pertaining to the following: * So much of National Highways No. 7 excluding from Km. 243.600 to Km. 651.500 Rewa State to Katni to Madhya Pradesh-Maharashtra Border, No.12 excluding from km 315.725 to km 421.325 Bhopal Bioara Section, No. 12A excluding from Km 89.600-Km192.400 of Mandla-Chilpi Section and from Km. 477.600 of NH7 to Km. 22.800 of NH12A Madhya Jabalpur Barela Section, 12A Extn 231 km Damoh to Orchha, No. 26A, No. 27, No. 59 excluding from km. 9.500 to km. 171.000 Indore-Jhabua MP-Gujarat Border, No. 59A. This represents a shift in responsibility from the default, which presumably was either direct Central Government oversight or a different delegation arrangement. **6. Target Audience and Stakeholders:** * **Policy 1 (Entrustment):** The direct target audience and stakeholders are the National Highways Authority of India (NHAI), construction companies, contractors involved in highway development, and the users of the specified highway sections. * **Policy 2 (Amendment):** The primary target audience and stakeholders are the State Governments of Madhya Pradesh and Uttar Pradesh, construction companies and contractors operating within these states, residents and businesses along the affected highway sections, and the NHAI. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The NHAI is the responsible body for the highway sections mentioned in policy number S.O. 1385E. The State Governments of Madhya Pradesh and Uttar Pradesh are responsible for implementing the works on their respective highway sections as per the amendment (S.O. 1386E). * **Timelines/Procedures:** No specific timelines are detailed in the text. The State Governments must comply with the rules in force under the National Highways Act, 1956, during the execution of works. The exact procedures would be governed by those rules. * **(Amendment Specific):** The State Governments would need to establish internal processes for planning, tendering, and overseeing the execution of works on the newly assigned highway sections. They will be required to ensure compliance with the National Highways Act of 1956. **8. Expected Outcomes / Impact of Changes:** * **Policy 1 (Entrustment):** The intended outcome is likely improved management, development, and maintenance of the specified National Highway sections under the NHAI's purview, hopefully resulting in better infrastructure and smoother traffic flow. * **Policy 2 (Amendment):** The intended outcome of the amendment is a revised allocation of responsibilities between the Central Government and the State Governments of Madhya Pradesh and Uttar Pradesh, leading to potentially more efficient and responsive execution of highway works within those states. The potential impact includes: * State Governments having greater control and flexibility over highway projects within their jurisdictions. * Potentially faster decision-making and project implementation due to localized oversight. * The need for enhanced coordination and communication between the Central Government, NHAI, and the State Governments to ensure seamless project execution and adherence to national standards. **9. Conclusion:** The notifications issued on March 26, 2021, represent a significant step in the management and development of National Highways in India. While the first notification assigns NHAI the authority of specific highways, the amendment to the existing policy regarding the execution of works on National Highways aims to streamline project implementation by empowering State Governments. This redistribution of responsibilities could lead to improved highway infrastructure and enhanced connectivity, provided effective coordination and adherence to established regulations are maintained.
