Short title and commencement.— (1) These rules may be called the Railway (Notices of and Inquiries into Accidents) Amendment Rules, 2019. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Railway (Notices of and Inquiries into Accidents) Rules, 1998, after rule 9, the following rule shall be inserted, namely:— “9A (1) The reports containing the names and addresses of the injured victims or persons deceased shall be dispatched to the Principal Bench of the Railway Claims Tribunal. Wherever the names of next of kin of the deceased passengers are known, the said information shall also be furnished to the Principal Bench of the Railway Claims Tribunals. (2) Legal Aid to Claimants or victims of accidents:- It shall be the duty of the Railway Administration to forward the names of the injured victims or the persons who died in a railway accident to the Principal Bench of the Railway Claims Tribunal for rendering appropriate legal aid for obtaining compensation in the manner provided under the Railway Claims Tribunal Act and to that end, wherever information is available, the names of the next of kin shall also be furnished to the Principal Bench of the Railway Claims Tribunal.” [No. 2018/Safety(A&R)/19/29] NARESH CHAND GOYAL, Principal Executive Director/Safety Note: The principal rules were published in the Gazette of India vide number G.S.R. 5, dated the 2nd January, 1999 and subsequently amended vide numbers G.S.R. 64, dated the 6th March, 1999, 858(E), dated the 22nd November, 2001 and G.S.R. 526(E), dated the 2nd August, 2013.
